DELIVERY

Delivery is provided for bulls traveling less than 300 miles. Arrangements will be made for bulls traveling over 300 miles at the least possible expense to the buyer. Bulls may not have completed all veterinary work. These bulls will be kept free of charge until April 15th, or until work is complete, at no expense to the buyer. If a bull is found to be unsatisfactory during this time, the buyer will be immediately made aware and made whole with a 110% refund or satisfactory replacement bull.

TERMS AND CONDITIONS

Except for those stated in the terms and conditions below, there are no warranties, either expressed or implied, as to the merchantability or fitness for a particular purpose with respect to the cattle being sold at this auction. The warranties and guarantees set forth in the “Terms and Conditions” are in lieu of all other warranties, either expressed or implied, and the remedies provided therein shall be the sole and exclusive remedy for the Buyer, or any party claiming through Buyer, for any breach of warranty or guarantee therein provided, and all other obligations or liabilities. All cattle in this sale are offered according to the laws of the State of Nebraska.

1. BIDDING The Auctioneer in charge will settle any disputes as to bids, and his decision on such matters shall be final.

2. TERMS terms of sale are cash.

3. PURCHASER’S RISK Each animal becomes the risk of the Buyer as soon as sold.

4. CERTIFICATE OF REGISTRY A transferred certificate of registry is available for each animal upon request.

5. HEALTH All animals are eligible for interstate shipment, except for otherwise announced. Interstate health papers will be furnished for each animal in accordance with prevailing State/Federal Regulations.

6. BREEDING GUARANTEE All animals that sell for $3,000 or more will receive a full first season breeding guarantee. If an animal is determined to be a non-breeder during his first season of service, then a credit to future sales will be awarded to the said bull’s owner in the amount of purchase less salvage. All claims must be made by September 20, 2023.

7. GENETIC DEFECT AND PARENTAGE GUARANTEE a. The parentage of all animals sold by the Seller is guaranteed to the extent that the animal is by the sire and out of the dam that is indicated on its registration papers. b. All test results confirming an animal’s genetic defect status must be disclosed to potential buyers prior to that animal’s sale.

8. RETAINED OWNERSHIP Dvorak Brothers Ranches, Inc. (sellers) will be retaining a semen interest in several animals in this offering. The sellers reserve the right to collect semen from any bulls in which an interest is retained at sellers’ expense and buyers convenience. The Sellers are also retaining possession rights to animal. The sellers and buyers will negotiate the terms of possession.

9. ANNOUNCEMENTS Announcements made from the auction block shall take precedence over the sale catalog and/or any additional printed information regarding animal(s) sold.
