Village Board mulls litigation to remove LIRR poles

DiFrancisco commended the Parks Department staff for clearing western parts of the Motor Parkway areas behind Stewart Field.

Garden City Mayor, Theresa Trouve summed it up best at the Board of Trustees meeting last Thursday night , when she stated that, “we owe it to the people of the estates area to litigate. This is not just an estates issue; it is a village issue.” The issue in question is the mammoth sized utility poles near the Merillon Avenue LIRR station, that have been a source of frustration and anger to local residents. The village trustees had differing viewpoints on whether to go through with the litigation process, after the board recently held a meeting with Town of Hempstead Supervisor, Donald Clavin. At the meeting, which was held earlier this month, Clavin and his staff recommended that the board retain the services of federal and state attorney, Joseph Macy. Trustee Stephen Makrinos, said even though he is sympathetic to the residents who live along Merillon Avenue, he does not support the motion to proceed with litigation at this time. “We need to look at a couple of basic questions we don’t have answers to you yet, including how much will an attorney charge us and how long the litigation will take?” Said Makrinos. “The message I received at the meeting with Mr. Clavin, is that our best hope and most likely outcome is only having one of the poles come down.” Trustee John Delany, said he was concerned about going forward with litigation, because it did not appear that the Town of Hempstead would fully support the village in its stance to have all the poles removed or modified. “It is difficult for me to vote for litigation, because we are risking the prospect of not all of the poles being taken down,” said Delany. “I would like to see a more definitive response from the attorney on this, and at this point I just don’t have that comfort level.” In addition to the mayor, the trustees who voted in favor of going through with the litigation process include Robert Bolebruch, Louis Minuto, Mark Hyer and Colleen Foley. Trustee Bolebruch said that while he’s fully in favor of litigation, his thought process revolved around what the village was getting into by taking legal action against the LIRR. “If we’re going forward with this, we need to know we’re totally going up against the LIRR,” said Bolebruch. “I believe that as a municipality

The parking lot, which is located north of Stewart Avenue sits partly on the roadway of the former Long Island
