Village votes to continue legal battles with MTA BY RIKKI N. MASSAND At a special meeting held on Friday, December 10th, the Garden City Board of Trustees voted to continue the legal process with the lawsuits against the Metropolitan Transportation Authority (MTA) and Long Island Rail Road (LIRR). The Board has authorized the village’s Special Counsel retained for the case, attorney Joseph Macy of law firm of Berkman, Henoch, Peterson, Peddy & Fenchel, P.C. “to continue to take all necessary steps to appeal, and perfect the appeal.” The Board also authorized Special Counsel Macy “to take all necessary steps to continue to appeal, and perfect the appeal” in the second case; the Incorporated Village of Garden City v. Metropolitan Transportation Authority, Long Island Rail Road Company, Long Island Power Authority (LIPA). BY RIKKI MASSAND Garden City Village Board of Trustees approved an extension for two Franklin Avenue restaurants to offer outdoor dining until next autumn, although without outdoor heaters. The dining areas also will have to be approved by the Garden City Department of Building superintendent. The outdoor dining area’s design will include seating and the layout of furniture plus umbrellas -- substantially similar to what has existed and was previously presented to the village. The Building Department will also review the hours and days of operation for outdoor dining behind Waterzooi and Novita, with the timing of the extension going into effect January 1, 2022 through the end of October, not beyond. Novita and Waterzooi’s management, led by co-founder of Waterzooi Christopher Werle, attended the Board of Trustees’ meeting on December 9 at Village Hall. Werle spoke about what has transpired as the restaurants transitioned to winter setups, and looking into the new year they have decided to do without outdoor heaters. During the Board’s November meeting fire safety at the outdoor dining areas had been discussed. The current license agreement, which allows the restaurants to use village property, expires on December 31st. The current license agreements do permit the use of heaters.

At its meeting on Tuesday, December 14th, the Garden City Board of Education voted 4-1 to send a letter to New York’s governor and Department of Health requesting local control over Covid-19 health and safety protocols in the schools. Trustee Matthew Wakeham, the only representative to vote against the letter, suggested a partnership alternative with Northwell Health, the local health department, and the other school districts in Garden City’s quadrant to align on perspective and desired next steps.
