bout three years ago it was recognized that Thailand was an excellent candidate to be the 33rd Society of LESI. There was an established organization in the country, Licensing Association Thailand (LAT), and an active business environment. Yvonne Chua approached LES Japan to be the mentor society for this effort, as they had experience in this type of activity. The Membership Committee of LESI had the responsibility for guiding and approving new members, being sure that they can comply with LESI’s bylaws and rules. The LAT presented a first draft of their future bylaws to the committee and by the fifth draft, their document was accepted. LAT was accepted as LES Thailand by a unanimous vote of the delegates at the International Management and Delegates Meeting in Brussels. This vote came at the IMDM which was held before the LESI Annual Conference in Brussels, April 10, 2015. After reports by Sumiko Kobyashi, Chair of the Membership Committee, and Ichiro Nakatomi, President of LES Japan, the mentoring society, acceptance was recommended. The key players For LESI in this activity were Yvonne Chua, LES Japan, the Membership Committee, Patricia Bunye (President-elect LESI), and Heinz Goddar. LES Thailand currently has 52 members, with 40% professionals, 30% industry and 30% academic and public organizations. They have an active plan for seminars, meeting, education and attendance at LESI and regional functions, and membership growth in the coming years. The President of the Society is Dr. Wilaiporn Chetanachan. A warm and hearty welcome to LES Thailand from all the LESI family. ■

y goal as the president of LESI for the next year is to focus on the LESI value proposition, i.e., the LESI deliverables that attract new members and retain existing members. This project actually began several months ago during the Winter Planning Meeting held in Cancun, Mexico. While a bright sun was warming the beaches on Sunday, January 25th, thirty-five members of the LESI leadership team spent the entire day in a windowless conference room working on ways to improve the LESI value proposition. The attendees included the LESI Board, several past presidents, national presidents and committee chairs. The agenda for this Winter Planning Meeting was threefold: first, to review the various deliverables (i.e., a service or benefit that LESI offers to its members) that make up the LESI value proposition; second, to prioritize those deliverables; and third, to identify specific things we can do to improve the four deliverables of the LESI value proposition that have the highest priority. During the morning, a current or past committee chair or board member led a discussion on a specific deliverable that is part of the overall LESI value proposition. We addressed eleven different deliverables that LESI provides to its members. We then spent 15-20 minutes discussing how each different deliverable contributes to the LESI value proposition for existing and prospective LES members. At the end of the morning session, each attendee completed a ballot containing a list of each deliverable discussed. The attendee could assign a ranking from one to ten (ten being the highest) for each deliverable. After all of the votes were tallied, the total scores for each deliverable reflected its respective priority. The four highest ranked deliverables would help us answer the question, “What should be the focus of our limited time and money during the next LESI year?” After the votes were counted, the deliverables with the highest vote tallies were meetings, publications, communications and eduation. The attendees then spent the afternoon exchanging ideas on how LESI can improve on these deliverables. Over the next 12 months, the chairs of the Meetings, Publications, Communications and Education Committees and the LESI Board will focus on action items to improve our value proposition in these four high-priority deliverables. I plan to report on progress in future editions of this publication. Our primary focus on meetings, publications, communications and education does not mean that we will ignore the other deliverables that LESI provides. On that note, April 26 is World IP Day. John Paul and Gary Keller are coordinating with our 33 societies in organizing a program in conjunction with World IP Day. I hope that you find a way to do something special in connection with World IP Day with your local society. Speaking of societies, I would like to congratulate and welcome our newest society, LES Thailand. The LESI Board of Delegates officially approved the admission of LES Thailand on April 12, 2015 at the Annual International Delegates Meeting in Brussels, Belgium. LES Thailand has a great leadership team, and a solid foundation for a vibrant LES chapter. It is great to have them as part of the LES family. I also want to congratulate LES Benelux for organizing an outstanding LES International Annual Conference in Belgium on April 12-15, 2015. Another exceptional LESI Annual Conference is planned for May 15-18, 2016, in Beijing, China. Please mark your calendars. You will not want to miss this one. I am very proud to be the president of LES International. I count it as one of the highest honors of my professional career because LES is such a prestigious organization of highly accomplished IP professionals. I am very grateful for all the help and support I received from many past-presidents, board members and other LES members along the way, and most of all from my wife and best friend, Jacki. ■

Reducing The Uncertainty Around Ownership Of IP Rights By Fadi Micaelian

magine a world where there was no real property deed of trust. What would happen if after you bought your house, someone else could challenge your ownership and have you kicked out? That would certainly have a disastrous impact on the real estate property industry. The basis of a solid economy is confidence; the confidence that if you invest and own a property, it is yours. Fuzzy ownership rights are not a basis for a solid economy. Unfortunately, in the IP world, the balance has shifted too far to the side of fuzzy ownership. It has become far too easy to challenge the exclusivity rights granted by the USPTO. In addition, it seems that judges shy away from issuing injunctions, which would be the equivalent of an eviction of squatters in real estate. The economy of the future depends on invention and innovation, and it is our responsibility to build a system that offers less uncertainty, in order for our economy to prosper. How Do We Do That? The U.S. has recently switched from a first to invent to a first to file system. This means that the USPTO has acknowledged that they would award exclusivity only to inventions that are filed. In other words, in order to claim their rights inventors must file their inventions. This means that if they do not file an invention, they implicitly forfeit their rights to that invention.

As a result, when a patent is challenged for prior art, it should only be challenged with the existing body of inventions recognized by the USPTO; this is the body of patents filed at the USPTO. Not a paper that was written or a research that was made or any other form of evidence that was never claimed. It is the first to file/claim who is granted the exclusivity. The implication of that reform, is considerably positive: 1. It would further encourage inventors to share their inventions by filing with the USPTO. 2. It would make it easier for examiner to check for prior art. As they would only need to search the USPTO database. 3. It would reduce the sources that can be sought to challenge a granted patent based on prior art. As a result, such a reform, would significantly reduce the uncertainty attached to an intellectual property, and thus bolster our invention economy. I further believe that in order to challenge a patent using another one, the challenger should have a stake in the patent used to challenge. In other words, using the real estate analogy, you cannot ask for an eviction of a squatter unless you have a claim to the given property either through ownership (assignee) or through rent (licensee). I realize it takes a village to make “simple” changes, and that there are serious implications especially at the international level. However, such changes would bolster a U.S. economy driven by innovations. ■

LESI Past President’s Council (PPC) Meet At Conference In Brussels

he LESI Past Presidents Council is an ad hoc Committee that was formed in January 2011, during Jim Malackowski’s LESI Presidency. The Chair of this Committee is the immediate Past President. The PPC was formed to allow the Society to continue to benefit from the experience and LESI institutional knowledge of the Past Presidents. Patrick O’Reilley was the first Chair. The Mission of the PPC is: (i) to informally gather Past Presidents in attendance at each major LESI conference or planning meeting to discuss potential suggestions to the Board to further the mission of the Society and (ii) to assist the President and President Elect as requested on an ad-hoc basis. Such assistance varies from the simple offering of sage advice to active participation in a particular project not otherwise within the domain of the traditional Board or Committee agenda. ■

Creating Value in Tomorrow’s Smart Economy—Towards 2020 and Beyond The 2015 LESI Annual Meeting was held April 12-15 in the beautiful Steigenberger Hotel in Brussels, Belgium By Laura MacDonald and Jean-Christophe Troussel

erhaps the meeting’s success, both in numbers and enthusiastic responses, was due in no small part to the relevance of the theme, which enabled sessions covering new technology trends, their IP and patent implications and of course the business of licensing and its role in our ever smarter and connected societies. This concept of a smart economy combines successful elements of the enterprise economy and the innovation or ‘ideas’ economy, while promoting a high-quality living environment, improving energy, environment, security and promoting social cohesion. “Smart economy” has the objective of harnessing the ingenuity and creativity of people to drive research, innovation and commercialization. It has, at its core, the creation of an exemplary research, innovation and commercialization ecosystem. It is, therefore in the DNA of what LES is about and of what its members work at on a daily basis. • Brussels hosted 498 registered people from 48 countries who shared interest and expertise in this theme and were welcomed by our LESI President, Arnaud Michel, and the LES Benelux President, Jean-Christophe Troussel. • We were entertained by and learned a great deal from our keynote speaker, André Kuipers, medical

doctor, engineer and general handyman capable of rebuilding everything on a space shuttle as he fulfilled his role as an astronaut. He described in fascinating detail his training for and time spent on the international space station. A whole universe of challenges and innovation came to life for us, all with impact, of course, on our world. • The plenary speakers also drew large crowds as they shared their inspiration, from Professor Sir Henry Markram leading the global endeavour to map the human brain, to the complex reality of 3D printing products and processes for all sectors, as delivered by Fred Vancraen, CEO of Materialise. The in triguing current and future world of the Internet of things was shared with us all thanks to Luc van den hove of IMEC and Stephen Mellor of the Industrial Internet Consortium, where global industry shares its uses and plans for utilising the Internet in delivering our daily technologies and products. The phoenix-like world of failure and success in life sciences was also presented by David Dodd, from his global pharma leadership and entre- preneurial track records. LES Global News—Highlights of industry, government and intergovernmental agencies ensured a stimulating choice each morning after the keynote speakers. We heard from the EU Commission, EPO, OHIM on IP Policy in Europe, while industrial leaders from GE Healthcare, Philips, UCB and GSK shared practical insights into the crossover of Life Sciences and ICT. Energetic visions from today’s smart societies were also presented in a series of panels covering sectors such as transportation, energy and urban planning. We were also honoured to host an illustrious panel of IP judges covering U.S., European and Asian perspectives, willing to face questions from participants. With 24 workshops on offer, including enthusiastic and effective contributions from all the LESI Committees, some participants claimed to have been tempted to clone themselves in order to attend sessions in parallel. The extensive program was also much appreciated, as indicated in the following snippets received in response to the question: What topic or theme was the most interesting for you at the conference? “The mock license negotiation was entertaining and instructive at the same time.’’ “Alliance management, negotiation tactics, lessons learned, networking.’’ “Relations between academics and industries (from an industry point of view).’’ “I found the guest speakers to be very interesting and I really enjoyed the fact that you had managed to get such inspiring speakers, well done! I found meeting the judges and the (workshop) regarding copyright to be the most interesting.’’ One additional feature of LESI 2015 was the parallel

scheduling of the 4th Global Technology Impact Forum, usually hosted in Switzerland. Given its mutual interest for many LESI participants, it was held in the Steigenberger on Tuesday afternoon, enabling LESI participants to attend. The hotel premises made networking among participants very easy and convenient. The Belgian taste for good food, good wine and good fun was also featured. Guests enjoyed the beautiful setting of the Monday dinner at Bozar and dancers stayed tuned until the end with live Beatles’ songs after the gala dinner. The sunny weather added a final touch in a hotel that benefits from a lot of daylight. From Jean-Christophe Troussel, “As President of LES Benelux I would like to thank LESI Past-President Arnaud Michel, and his exquisite wife Elisabeth, for their vibrant support to the whole conference and Fiona Nicolson of the Meetings Committee for her very professional supervision of the whole process of organising this LESI event in Brussels. As I said during the Conference, nothing would be possible without our sponsors, and we are truly grateful to all of them. The success of this Conference is the result of the hard work and professional insight of a core team of ten dedicated individuals. They were applauded during the gala dinner and they hugely deserved it. The team was led by Laura MacDonald (Head of the Program Committee) and Lex van Wijk (Organisation Committee). Much credit goes to them. I immensely enjoyed working closely with them during these last 18 months. The whole crew is proud and extremely happy to hear and read that participants hugely enjoyed this successful Conference, and we look forward to many more enriching LESI Conferences around the world. Young Members Congress Events At The LESI Annual Meeting In Brussels By Thomas Adocker

there were more YMC Events than ever at the Annual LESI Conference in Brussels. Starting on Sunday evening, after the Welcome Reception, about 60-70 Young Members continued the evening in a nice pub with food and drinks. On Tuesday in the afternoon, Young Members organized a “Speed Networking Event” (pretty much like speed dating but for professional purposes). Around 30 Young Members took part and had lots of fun and used this opportunity to intensify their contacts. On Tuesday evening, the YMC Dinner took place in a wonderful restaurant at Sablon, “L´entrée des Artistes.” More than 70 Young Members enjoyed the excellent food and drinks. A big part of them continued the Thomas Adocker, Chair of the YMC, encourages participation in the Mentoring Program at the Conference.

evening with a pub-crawl in the city—the hard core Young Members stayed out until sunrise. Beside the social events, YMC members volunteered as social media supervisors and presented helpful information about the social media activities of LESI and YMC to participants of the Conference. Furthermore, a YMC booth created great interest where Young Member activities—in particular the Mentoring Program—were presented and an outlook was given for future YMC Conferences. This year there will be specific YMC Conferences in Munich on July 3 and in Chicago on September 11. Both conferences will be one-day events followed by a dedicated evening program. ■
