There were a host of twists and turns along the way, but the Arlington County government narrowly dodged a towing-related slapdown in the state Senate. It may only be a temporary victory, however, as similar legislation appears likely to pass in the House of Delegates, setting up a showdown between the two bodies. A measure patroned by Del. Tim Hugo (R-Fairfax) that would prohibit Arlington, and other Northern Virginia localities, from imposing what is known as a “second-signature” requirement on towing companies and property owners that use their services appeared headed to passage this week. The measure was reported out of the House Committee on Transportation on a 21-0 vote, and was placed on the House’s uncontested calendar for final disposition. “We will see how that goes,” said County Board Chairman Jay Fisette, who said Arlington officials were joined by their counterparts in Alexandria, Fairfax County and Falls Church in opposition.

The measure being voted on contains one major change from Hugo’s initial bill: It strips out a provision that would have required localities to increase from $135 to $150 the minimum charge for towing improperly parked vehicles from private property in Northern Virginia. But it retains the provision that would, in effect, nullify the Arlington County Board’s vote of December, requiring towing companies to get a signature from the property owner or designee for every tow, rather than give towing companies blanket authorization to remove vehicles. That change irked both the towing industry and Arlington Chamber of Commerce, which vowed to have it overruled at the state level. Continued on Page 22
