Ever wonder what is the number one dispute in almost any construction litigation or arbitration? That would be our friend the change order. Or, as one judge stated, construction is nothing more than “organized chaos“ and “analogous to ever changing commands on the battlefield.” Fact is, when you are facing a judge there is hardly any construction dispute that does not include within its nasty ambit that loved or dreaded concept of an extra. And guess what the number one defense to paying is? Claiming the change order was not in writing, even if you were directed to do the work! So let us get our arms around how to make sure you are paid such extras.

Example: Frank is a general contractor who has a contract with a veterinarian to construct a new vet clinic and boarding facility. The property has a back section reserved for a parking with a steep slope up from the pavement toward the back of the lot. The base contract and specs layout a 4-foot X 80-foot redwood retaining wall with drainage through an outlet directly onto the parking lot surface, where it will drain downhill into the street. But in laying the foundation, it was determined there is constant moisture from an underground spring, making the

soil unstable. After talking to a soil engineer, the vet owner acknowledges it is an extra in the presence of two witnesses, clearly directing Frank to construct a 4-foot X 80-foot CMU retaining wall with underground drainage exiting through a curb at street level. It is further agreed to be done on a T and M basis based on the same hourly rate as under the base contract.

You can guess what happened next.

Frank went back to his office and prepared a written change order, faxing it to the owner. They had a number of conversations later, but it was never signed. The owner never told him to stop or not do the work. Relying on the owner’s good faith, Frank diligently had his crew do the necessary work. They even worked overtime so as not to unnecessarily extend the completion date.

But after submitting a number of invoices, he continued to get the “runaround” and was never paid.

At trial, it was uncontested Frank did the work and it was an extra, but it is claimed no payment is due because the change order was not reduced to writing. The owner offered to the judge’s a copy of the contract which stated: “Contractor shall make no changes in the work required to be performed under this contract, nor perform any extra

and 3. the contractor relied upon that direction and actually did the work. And better yet, if you send the owner a change order and it is never signed, in most cases you will have an even better chance of prevailing as long as it is delivered prior to starting the work.

Now some good news. You will be happy to know that since the mid-20th century, most (but not all) states do not require a signed change order as long as: 1. there is clear evidence the owner verbally authorized and directed the work, 2. the work actually is an extra,

It is a legal theory that if you are told to do something and rely to your detriment, the party benefiting from your services waives the right to require the technicality of a signed change order because it was a condition solely within their control.

Steps to take to protect your rights: • Pre-Construction job meetings.

Make it clear your goal is to complete the base contract as quickly as possible without the delays of change orders. Let the owner know change orders will make the project more expensive. Now is the time to do any revisions to the contract if they want otherwise. Make it look like you are doing them a favor to advise on such financial matters — so they can stay within budget.

• “Let’s have a little talk,” when you are confronted with the first change order. Remind the owner of your initial conversation where you said the project will be more expensive and take longer if there are changes. Let them know you are willing to continue with the base contract, but if they want change orders, it will costs more.

• Memo of Meeting. Write a “short and sweet” Memo confirming any conversation you have about a change order and e-mail or fax it to the owner or representative within 24 hours. It will confirm that the additional work will is an extra and was directed by the owner. If terms have been agreed upon, including price and time extension, confirm that as well.

4. Okay chance Owner directs the change, no agreement on terms or that it is an extra, contractor performs and sends an invoice (but not a change order) shortly after.

5. Little chance Same as above, but invoice sent out at end of the job.

6. No chance Same as above, except owner does not request change — it is done solely by the contractor.

Mt. Olive community gets help from NJ bridge builder FLANDERS, NJ — Imagine being cut off from the town you have lived in for 27 years when suddenly, access to your community was severed by Hurricane Irene. The otherwise gentle river near your house became a flash flood, washing away the only bridge between your community and the outside world. This is what the Costello’s and the Ulbrich’s of Mill Road in Mt. Olive Township, NJ faced on Sept. 28, 2011.

In only two hours, the water had completely overtaken the road and destroyed the old wooden bridge that connected Mill Road to Mt. Olive.

In the aftermath of this natural disaster, the community began the process of trying to rebuild their lives. Beyond the obvious logistical problems of no longer having a bridge into town, one of the families on Mill Road had special needs child that required regular medical care. To this family, the lack of a bridge represented much more than inconvenience. To further

complicate matters, the community bridge and road are not owned by the township, so the community residents bear the responsibility of replacing the bridge.

David Scapicchio, the mayor of Mt. Olive Township, was struggling with the resident’s problem when he received a call from Mabey Bridge & Shore’s Product Specialist, Jim Porreca. Porreca had heard about Mt. Olive’s situation and wanted to let the mayor know that his company was ready to help. Mayor Scapicchio explained that the Mill Road community did not have the resources to replace the bridge and asked if there was anything we could do to help.

Porreca wasted no time working out a plan to get the citizens reconnected with their community, families and emergency essentials. When Mabey saw the need for the residents and realized that financing was not going to be available, the company did not hesitate to provide a bridge under a program

Crews have prepared the site for a concrete pour early next week, once the weather clears.

Many a watchful eye is focused upon the Slate Hill Constructors, Inc. crew working on the redecking and road repair project currently under way on State Fair Boulevard near the New York State Fairgrounds complex in Syracuse. As spring weather allowed an early start to this year’s work schedule, Project Superintendant, Dale Carlson said that the work is approximately 40 percent complete as they head into the first week in May. More importantly, for those who use State Fair Boulevard as a daily commuter route, and for those who are planning to attend the New York State Fair in August, Carlson said that weather permitting; the work will be completed on time.

“We were hoping to pour concrete this week (week of April 23), but because of the rainy weather, it looks like we will have to wait until next week to do that,” he said during a recent interview with Hard Hat News. “This project is about a half mile from the fairgrounds and it is an important access road into the facility. We will be replacing the bridge decking, bearings and pavement on either end of the 100-foot by 75-foot bridge. Our targeted completion date is August 4 and we should be completed by then.”

“We do work in New York State from Buffalo to Albany,” he said. “At our peak, we will have seven or eight crews out on jobs, with a total workforce of about 60 people. This year, because of the nice weather, we got an early start, especially on this project. We were out here the first week in March.

That usually isn’t the case in the Syracuse area for this time of year.”

Worker’s personal needs Carlson said that whenever possible, Slate Hill Constructors attempts to assign jobs to workers who live near to the jobsite to help make travel and family relations more favorable for the workers. While safety and attention to work hazards is foremost in the thinking of the typical worker or job supervisor, everyone knows that it is important to have the right tools for the job. One of the “tools” that a worker relies upon at every jobsite yet is rarely discussed in a public forum is a clean and safe restroom at the jobsite.

Sabre Enterprises’ Scott Wilkinson explains how his company has become one of the leading portable restroom providers in New York State.

“Sabre began in 2006 with 12 portable units working out of a single garage,” he recalled. “Since then we’ve grown by adding new units and by acquiring two other entities that were also in the portable restroom business. Now, we have close to 1000 portable restrooms available to serve our customers.”

Over the years, Wilkinson, along with two other owners, has added equipment and staff in their growth process. “Jerry Vecchairelli and Robert Dumas, both have come onboard in the past year,” he said. “John Wike is also involved in the daily activities of the business. All together, we employ seven people year round.”

“Our service area includes customers in the greater

Watertown area up north, to Binghamton to the south, Geneva to the west and to the other side of Utica to the east,” he said. “That is about a 70 mile radius of Syracuse. That gives us a good territory for service scheduling on a weekly basis.”

“We have three route drivers that maintain the customers’ units, some of whom have their restrooms serviced once per week while others are serviced more often,” he said. “We have four pumper trucks and two flatbeds that we use to pickup, deliver and service the units. As part of our good stewardship of the environment, we take the waste material that we collect, to waste treatment plants that are in some of the counties that we serve.”

Wilkinson said that Sabre not only serves contractors like Slate Hill Constructors, who are doing replacement work on a bridge near the State Fair Grounds, but they also supply units for other larger events other than construction jobs,” he said. “One event that we serviced last year was training exercises at Fort Drum military base. We serviced over 200 portable restrooms daily for one month for over 7,000 troops that where training for deployment overseas. This job reinforced our thinking that we can take on any event no matter what size. It also gave us a great feeling of being involved and doing a small but thankful part for our

military.”

Other large events that Sabre will be serving in the coming year include Taste of Syracuse and The Syracuse Corporate Challenge Race. Outdoor concerts such as KROCK at the NYS Fairgrounds and road and cycling races are on the agenda as well. “As summer events and construction projects become more numerous, we get busier,” he said.

“Routinely, we offer same day service when someone calls to arrange for a unit to be delivered to their site,” said Wilkinson. “If a customer calls in the morning, we will do everything we can to have it there that day. Our rental rates are extremely reasonable.”

Wilkinson said that they have plans to broaden their coverage area in the future, with new locations in Watertown, NY and Binghamton planned. “We would like to make this happen within the next two years,” he said. “The past six years have offered a lot of challenges when it comes to the growth of our business, but overall, we have been able to expand even while the economy and more specifically the construction industry, has had some temporary setbacks.”

The CX470C excavator provides six percent more lift capacity than the previous B Series model. With its standard arm length of 11-foot 1-inch, the Case CX470C excavator has a maximum dig radius of 39-feet 4-inches, a maximum dig depth of 25-feet 4-inches and a dump height of 25-feet 5-inches.

Like other excavators in the Case C Series, the new CX470C features Case Intelligent Hydraulic System technology that reduces total fuel consumption and improves performance.

Boom Economy Control (BEC) automatically reduces engine RPMs and hydraulic power to the boom when speed and power is not a priority, such as when swinging back to the hole. Swing Relief Control (SWC) technology manages the hydraulic power allotted at the start of the swing operation, and Spool Stroke Control (SSC) creates an automatic pressure adjustment to meet demand during digging operations, but without building unnecessary pressure. Then, the feature of Auto Economy Control (AEC) lowers RPMs when the joysticks are inactive.

Also boosting fuel economy and performance are engine improvements such as computer-controlled fuel delivery and variable geometry turbocharging, as well as automatic matching of engine performance and RPMs to power demands and hydraulic system requirements.

“Typical CEGR systems lose fuel efficiency, but with the Case Intelligent Hydraulic System technology and engine improvements, we’ve actually increased fuel efficiency on the Case CX470C excavator by five percent over our previous B Series model,” O’Brien explained. “And all of our Case C Series excavator models continue to be in the top of their class for productivity.”

Historical Construction Equipment Association announces new corporate members BOWLING GREEN, OHIO — The Historical Construction Equipment Association (HCEA), a 501(c)3 non-profit organization dedicated to preserving the history of the construction, dredging and surface mining equipment industries, announces that Alex E. Alex E. Paris Contracting Co. was founded in 1928 and undertook WPA projects, primarily road building. It operated a large coal mine from the 1930s through early 1950s, then underground utility construction starting in the late

Seattle subway project gets out of a hole with precision mudslinging by SENNEBOGEN 870 M SEATTLE, WA — Mudslinging isn’t the type of activity that normally wins accolades, but Michael Diponio has nothing but praise for the way his SENNEBOGEN 870 M material handler has been heaving the muck around at his current jobsite for Sound Transit in Seattle.

Sound Transit is extend-

ing the U-Link subway from its LRT station at Pine Street to a new station planned at Capitol Hill.

Diponio, the vice president of Michigan based Jay Dee Contractors, is project manager for the Jay Dee/Coluccio/Michels joint venture which will mine the two tunnels, each 21-feet in diameter and 3,800-feet long.

Tunneling like this is Jay Dee’s stock in trade and the family-owned business has been doing it for more than 45 years. With the U-Link project, however, Diponio faced unique challenges posed by the environmental standards of Washington State and the city of Seattle.

The problem, in a word,

is muck. Conveyors from the project’s two tunnel boring machines deliver their tailings in the form of a heavy slurry to the open cut for the future subway station. The slurry arrives about 80-foot below grade and Diponio has to move the wet muck up to road level and haul it out to his fill site without compromising the city’s strict standards for

Cleanup can be costly “We’re working in a very urban area here, and our haul route travels directly through a residential area,” Diponio explains.

“The track out is severely limited, and using thousands of gallons of wash water every day is counter productive.” The contract includes significant cash incentives for complying with these requirements, and a local environmental technician is stationed on the site to monitor the operation.

Officials for the city and consultants conduct a walking tour of the project every week.

The simplest approach to moving the muck was with stacking conveyors transferring it up to a muck bin or to waiting dump trucks. However, the conveyor process resulted in the muck splashing too much for crews to clean up. “The drop from the end of the conveyor into the dump was about 6 or 7-feet.

The muck was splattering everywhere, 30 or 40-feet.

It was going right up our sound wall! We had a ‘splooge patrol’ of five guys with loaders going

full time to clean up.”

The muck wouldn’t splatter so much if it was drier, of course, but it then becomes too sticky to offload easily from the buckets and dumps.

Foaming agents are actually added by the Tunnel Boring Machine to condition the muck so that it flows freely from the excavation chamber.

Precise handling is the solution “What we needed was a method to place, not drop, the material precisely into the dump trucks. We looked at some other machines, but we needed more horsepower and more mass to get the stability for a precise transfer. We went with the SENNEBOGEN 870 M on the recommendation of Modern Machinery. But really, we had no idea if it was going to work.”

The SENNEBOGEN 870 M is a purpose built material handler weighing 165,000-pounds and powered by a 426 hp engine. The wheeled unit is mounted on a specially reinforced platform raising it 30-feet above the floor of the excavation where the muck flows in.

Modern Machinery fitted the machine with a SENNEBOGEN extra long boom to make the 63-foot reach up to the waiting trucks. Its 2.5-yard clamshell bucket was also custom built with tight bucket closing tolerances to prevent leakage and spilling as the clamshell bucket swings over the truck bed.

The SENNEBOGEN is positioned down in the hole, 40-feet beneath the ground surface. Once the bucket is raised above the surface and the machine swings over the edge of the shaft, the machine operator loses sight of the bucket. Jay Dee’s operators scoop up the muck and guide it up to the road level using two cameras to find their way. One camera is mounted at the boom knuckle and another is positioned roadside by the trucks’ station. With a total boom length of 63-feet, they have just 3-inches of clearance to reach their targets, the dump bodies and pup trailers. The bucket is carefully lowered directly into the bed, with only inches of clearance on either side of the bucket, before the bucket is opened to let the muck flow out.

The fleet of dump trains grew as operators became increasingly proficient with the 870 M and the drivers were able to navigate into the exact position with the help of markings painted on the pavement.

Picking up the pace

The SENNEBOGEN 870 delivers its payload smoothly over 60-feet in the air and carefully deposits it in truck. fill the trailer. The system was able to get the job done but the question on Diponio’s mind was, how much time would it take? “This method has performed well beyond our expectations,” he’s pleased to say. “We now have eleven trucks moving through the cycle and the SENNEBOGEN more than keeps up with them.”

Governor Andrew M. Cuomo announced a $29.7 million investment for NY Works projects to upgrade and repair six parks in Western New York.

New York Works is designed to reinvent state economic development with innovative new strategy that will put New Yorkers back to work rebuilding the state’s infrastructure. The Task Force will help create tens of thousands of jobs by coordinating comprehensive capital plans, overseeing investment in infrastructure projects, and accelerating hundreds of critical projects across

the state.

“New York State has passed, for the second year in a row, a transformative and balanced budget that holds the line on spending, while focusing on job creation and government efficiency,” Governor Cuomo said. “The centerpiece of this budget is the New York Works program, a new strategy for leveraging capital to put New Yorkers back to work and rebuilding our aging infrastructure including the state park system that is used by so many people across the state.”

curve very quickly. “Before we started, we spent a day or so with the operators, going over the drawings to make sure everyone understood the concept. The first tests came in at 20 minutes for a full load, and we were looking for 12 minutes,” he recalls. “The average now is under 10 minutes, which means we can now meet our production projections!”

The best loading time achieved by any operator so far is just six minutes.

The contractors are looking forward to earning their bonus for environmental compliance, too. Even at its fastest loading times, the 870 M is moving with precision, enough that the worksite stays meticulously clean.

“The inspectors can tour the site in their street shoes without a problem,” claims Diponio. Jay Dee’s “splooge patrol” has been replaced by a crew of two who police the site once a day with a wheelbarrow. A wheel washer system and street sweeper take care of any spillage coming from the trucks’ tailgates.

According to Diponio, the controlled success of the “mudslinging” operation can be credited to the right choice of machine and to SENNEBOGEN’s smooth hydraulics system. “The 870 M is a larger machine than we first considered, but Will Wintermute at Modern Machinery recommended a heavier machine for added stability.” The 870’s hydraulic boom, he says, gives his operators more control over the bucket than a cable crane or excavator would allow.

The Budget continues the Governor’s commitment to fiscal responsibility while creating jobs and strengthening communities across the state. It closes a multi-billion dollar deficit with no new taxes, fees or gimmicks, limits spending growth to two percent or below for the second year in a row, and launches the New York Works Task Force to invest billions of dollars to rebuild the state’s roads, bridges, parks and other infrastructure and create tens of thousands of jobs.

The Budget includes key economic development and transportation initiatives, important re-

forms to improve government efficiency and measures to strengthen communities across the state.

New York Works establishes the New York Works Task Force The New York Works Task Force will coordinate capital plans across 45 agencies and authorities, oversee investment in projects and access to funding, and facilitate the creation of tens of thousands of jobs.

Prior to the New York Works initiative, there was no comprehensive state plan for the $16 billion in annual capital expenditures by 45 state agencies and authorities.

In some cases, including with respect to projects by the Port Authority, the MTA and the Dept. of Transportation, billions of dollars of taxpayer or commuter funds are being used to fund transportation plans in the same region with no coordination between the agencies. For the first time, the New York Works Task Force will develop a coordinated capital infrastructure plan among agencies and authorities.

The Task Force, made up of leaders in finance, labor, planning and transportation will also recommend financing options for projects and methods to accelerate construction of critical infrastructure.

The New York Works Task Force will consist of fifteen members. Nine of the members will be appointed by the Governor and six by the Legislature. All major state agencies and authorities will participate in an implementation council to coordinate capital planning.

All New York Works projects will be posted on the web with real time updates so that New Yorkers can track the progress of projects in their community. The full list will be posted online over the next several days.

Rebuilding New York’s State Parks The New York Works Fund will provide $89 million, leveraging $143 million in total funding, to rehabilitate state parks, representing the single largest infusion in history of capital dollars for New York’s parks.

Currently, 83 percent of state parks are deteriorating. Projects will be funded in every region of the state and will en-

hance the visitor experience and enable our state parks to reemerge after years of decline.

The New York Works Projects in Western New York are as follows: • Allegany State Park: Upgrade the electrical systems in the Red House and Cain Hollow campgrounds, which are currently outdated and present health and safety concerns. In addition, they cannot accommodate modern camping ve-

hicles - Cost: $2,400,000.

• Allegany State Park: Reconstruct the Cain Hollow and Camp 5 restroom and shower buildings. Located in the Quaker camping area, these two deteriorated facilities are visible signs of disinvestment in this park. Cost: $950,000.

• Midway State Park: Construct a new building around the park’s historic carousel to replacing the existing failing structure.

Cost: $150,000.

Two, 5-foot long spread auger sections efficiently deliver material to the left and right hand sections of the screed. Each screw auger features its own speed control, allowing operators to independently adjust material flow to either side of the screed. The auger sections back up to each other, leaving no separation in the center. This new drive and screw auger arrangement reduces centerline segregation and eliminates the need for reversing augers and the center gearbox drive found on competitive mainline pavers.

The exclusive three point suspension system essentially “floats” the paver over pre-existing irregularities, maintaining a consistent feed height at the screed for a smoother mat. Raising and lowering of the paver’s rear frame by the patented frame raise system assists in truck loading and unloading and allows operators to fine-tune the head of material at the spreading augers, reducing some forms of segregation.

The CR652RX rubber tire paver includes the new generation remix antisegregation system design, which virtually eliminates material and thermal segregation at the last stage of the paving process. Two sets of two counter rotating augers with interleafing flights uniformly draw down material from all areas of the hopper and aggressively reblend the asphalt to produce a more homogeneous mix. The entire length of the auger shafts is lined to reduce wear.

Standard receiving hopper capacity of the CR652RX paver is 16.7 tons. When equipped with the available hopper insert that channels asphalt directly into the hopper’s reblending augers, hopper capacity increases to 27 tons. Unlike other insert designs, Terex hopper inserts are shaped so there are no “dead spots” where asphalt can gather and cool to create thermal segregation.

Positioned at or below hopper wing level, the augers feature a constant 12-inch diameter, so material is pulled from directly above the full length of the shafts. A new, larger variable pitch design — 10-inches at the front of the hopper to 12-inches just before the feed tunnel — quickly channels material from the hopper to the spreading augers, increasing truck exchange efficiency. The augers’ sloped design results in a larger opening at the end of the feed tunnel, eliminating material buildup.

Upon exiting the hopper, asphalt enters the feed tunnel’s approximately 8foot long mixing zone under the engine compartment. Here, 100 percent of the uniformly drawn down material is mixed in a figure eight pattern by the pugmill style mixers as it is channeled to the spreading augers.

Hey Roge rI’ll be honest with you — overhead allocation is complicated, and the real answer to your question is way beyond the scope of this column. For a more detailed explanation, I recommend working with your CPA to find the most appropriate method of overhead allo-

Companies can use many different methods to allocate overhead. For example, you can allocate using job revenue, labor hours or costs, material costs, subcontract costs,

equipment costs, or a combination thereof.

Let’s use an over simplified example. Assume that you’re a labor intensive contractor and you’re working on three jobs on which you’ve spent $80,000 in indirect expenses that you want to allocate as overhead to your jobs. The success of your jobs depends on how productive your workers are, so it makes sense to use labor in determining a formula for allocating overhead.

In this case, it doesn’t matter how big the jobs were — but it does matter how productive they were because your company

depends on efficient labor to make a profit. Overhead exists to support your workers on the jobs and the more labor you use, the more overhead is absorbed. This method gives you a more realistic view of your profitability.

As I said, working with your CPA to determine the best method for your business is best.

Whichever method you choose, there are many construction specific accounting systems can help contractors to track overhead costs, calculate a ratio against actual expenses and report this in a way that’s understandable and accurate. Run-

ning these reports regularly will give contractors a more accurate understanding of all costs and give a clearer picture of the bottom line.

Case CX210C excavator boosts power, fuel economy LAS VEGAS — Case Construction Equipment today launched its CX210C full sized excavator at the World of Concrete 2012 show. The most recent addition to the company’s C Series product line, the CX210C model features increased fuel efficiency, productivity and improved serviceability and operator comfort.

The new Case CX210C excavator achieves 160 net hp using Tier 4 Interim certified cooled exhaust gas recirculation (CEGR) technology that burns cleaner while delivering superior horsepower. A new narrow undercarriage version, measuring 8-foot 6-inches wide, is available for easier transport.

“The new Case CX210C excavator delivers both the lower operating costs and higher productivity that contractors expect,” said Tim O’Brien, brand marketing manager, Case Construction Equipment. He cited 10 percent fuel economy gains, three percent cycle time reductions and seven percent lift capacity increases among crucial product improvements.

“An advanced version of the Case Intelligent Hydraulic System technology reduces total fuel consumption and improves performance,” O’Brien said.

Boom Economy Control lowers engine RPMs during the boom down and swing operation, while the Auto Economy Control lowers RPMs when the joysticks are inactive. Swing Relief Control technology manages the hydraulic power allotted at the start of the swing operation, and Spool Stroke Control creates an automatic pressure adjustment dur-

ing digging operations.

“These fuel efficiency gains are especially significant,” O’Brien explained.

“While typical CEGR systems lose fuel efficiency, we’ve actually increased fuel efficiency on our Case CX210C excavator by 10 percent over the previous B Series model. While delivering exceptional fuel efficiency, the Case C Series models continue to be in the top of their class for productivity.”

He continued, “Because excavators run with little change to engine speed, CEGR technology was the best choice for efficiency and convenience.”

Increased productivity With three percent faster cycle times than previous models, the new Case CX210C excavator can load more trucks or trench further during every work shift. Along with faster cycle times, the new Case excavators offer operators smoother and easier control and maneuverability.

The CX210C provides seven percent more lift capacity and boasts a 440pound increase in operating weight to tackle bigger jobs. The excavator has an operating weight of 47,800-pounds, a bucket digging force 34,171-pounds, arm digging force of 24,729-pounds and a maximum dig depth of 21-foot 10inches. Standard bucket sizes range from .65 to 1.53-cubic-yards.

The new excavator offers three power modes — SP (speed priority), H (heavy duty) and A (automatic) — to allow operators to choose the best mix of power and fuel efficiency. The throttle settings
