Recharge, Reflect, Reconnect As we move into June and the start of summer, I hope each of you finds time to step away from the demands of work to recharge and enjoy your families. The (somewhat) slower pace of summer offers a welcome opportunity to reflect on our work, reconnect with friends and colleagues and appreciate the community we share within the Lee County Bar Association (LCBA).

This month, I want to highlight two upcoming events that showcase both the collegial and charitable spirit of our membership.

First, the Lee County Bar Foundation Annual Charity Golf Tournament will take place on May 15. This event has become one of our most enjoyable traditions, one that offers an opportunity to give back to our community while enjoying a great day on the course. Whether you’re there to compete, sponsor or simply cheer on your colleagues, your participation directly supports the Foundation’s important work.

Also, please mark your calendars for the Young Lawyers Division’s 6th Annual “Burritos with the Bench” on Friday, June 5, at the Lee County Justice Center. This has quickly become a favorite event, offering a relaxed and collaborative environment to get to know our judges outside the courtroom.

It is a great forum for mentorship and building relationships across all levels of practice.

Finally, on behalf of the LCBA, I extend our heartfelt condolences to the families of Jeff Garvin, Judge John Carlin and Joe D’Alessandro. Spring into Summer Around May we all begin making summer plans! You might be thinking about your kiddos and what they are going to do during the summer, or you might be finalizing plans for a summer getaway. Well, for me, this summer will be like no other!

Why, you ask? Because I am getting married!

Planning events is not new to me, what with the 70+ in-person and virtual events I plan for the Lee County Bar Association (LCBA) each year, but planning a wedding for yourself is way different!

At the same time, I’m working on all the things happening here at the LCBA, including the LCBA Foundation’s Annual Golf Tourney, Burritos with the Bench, and a slew of CLE’s within various sections!

Aside from these local events, I want to share a special event happening in July. The Florida Bar will hold its annual Voluntary Bar Leaders Conference at The Opal Grand Oceanfront Resort & Spa in Delray Beach from July 10 to 11.

This exciting event is open to anyone, and if you want to join those of us on the YLD Board or Executive Council, I encourage you to attend! For more information, please email me, and I can share all the details with you!

Before any of this summer stuff happens, one of my favorite event series happens: Law Week! This will have already happened when this issue of Res Gestae hits your desk, so if you attended, you noticed it was a little different this year.

Our longtime Law Week Chair, the Honorable John Carlin passed away in March, and while we will carry on all of our Law Week traditions, they simply will not be the same without him. Every year, he, his Judicial Assistant Beth Nichols, and I (and my predecessors) worked closely to produce this series of events. Those memories will be cherished.

Lastly, and on a happier note, in August we will welcome back, Paige Greenlee, who was voted Florida Bar president-elect designate. She will share with us her plans for the The Florida Bar and much more!

We hope to see you all soon at these events as we “spring” into summer!

Florida Supreme Court Creates

NEW INTERIM SUSPENSION The Florida Supreme Court has created a new category of discipline defined as “interim suspension.” The Interim Suspension Rule 3-5.3 was adopted in SC2025-0727 and went into effect on Dec. 5, 2025. The rule authorizes The Florida Bar to file a petition for an interim suspension for any lawyer charged with a felony by information or indictment. In practice, it is believed that The Florida Bar filed a petition for interim suspension against every lawyer who had a pending felony charge. Prior to this amendment, The Florida Bar had no authority to discipline a lawyer solely on the basis of a charged felony.

The rule provides that The Court may suspend a lawyer upon information or indictment which “reflects adversely on the lawyer’s fitness to practice law.” Upon petition by The Florida Bar, the Court may issue an order to show cause to respondent. Upon consideration of the petition, response and reply, the Court may suspend respondent immediately until there is a disposition of the criminal charges. If there is a determination or judgment of guilt, the respondent will then be subject to the felony suspension rule. If the charges are disposed of favorably to respondent, the interim suspension will be dissolved and expunction of the interim suspension may be ordered.

The Court first expressed the concern that “Without an appropriate rule modification, an attorney may remain eligible to practice law during the pendency of a felony case…” in a June 11, 2021, letter to The Florida Bar from the Clerk of the Supreme Court. The letter requested that the Bar initiate the rulemaking process to propose an appropriate rule “in a continuing effort to protect the public.” However, as the Bar digested the request, substantial opposition developed, especially from the Criminal Law Section. What emerged was a proposed rule with caveats and procedural hurdles that had fractured support within the Board of Governors. The Court rejected the proposed amendment in SC22-143.

In a highly unusual procedure, the Court abandoned the traditional rulemaking procedure when it propounded, on its own initiative, the new rule in 2025. In what has now become a trend, the Court assumed a more direct role in the disciplinary fact-finding process and declined to have a referee preside over an evidentiary hearing. Instead, the Court itself will consider the submissions in relation to an order to show cause and then issue a decision.

The due process concerns initially expressed by the Criminal Law Section resurfaced when on Dec. 5, 2025, the Bar made a mass filing against lawyers with an outstanding felony. This included cases in which respondents were enrolled in drug court, veterans court or other diversionary programs that are based on the policy of restorative justice.

As of the writing of this article, the Court has made few rulings on the multitude of petitions.

However, in at least one instance, the Court did dismiss a petition involving a respondent enrolled in a diversionary program.

As many of you reading this can attest, the life of an attorney can be quite stressful. Every day, attorneys juggle challenging deadlines, long work hours and complex matters. In addition, attorneys often have to communicate with clients in emotional situations.

Getting relief from that stress comes in many forms. Some attorneys listen to music, others paint, many exercise and others are in bands. For one attorney couple in Lee County, backcountry skiing or ski touring takes the edge off and helps to keep them emotionally balanced.

Co-managing partners Andrea and Chris Smith of Goldstein, Buckley, Cechman, Rice, Purtz, Smith & Smith have found an unusual way to unwind from the pressures of practicing law. Whenever their schedules allow, the husband-and-wife attorneys head west to the mountains, trading Lee County courtrooms and conference calls for snow-covered peaks and quiet wilderness. Skiing has become their favorite escape from the daily demands of trial work.

Their preferred style is backcountry skiing, a challenging form of the sport that takes place far from ski lifts and groomed trails. Instead of riding a chairlift to the top, participants climb the mountain on their own. Special nylon or mohair strips called skins attach to the bottom of skis, allowing them to glide forward over snow while gripping enough to prevent sliding backward as you climb. In Chris’ case as a snowboarder, he uses a splitboard, a snowboard that separates into two ski-like pieces for climbing uphill before reconnecting for the descent.

Most of the Smiths’ backcountry ski adventures take place in the mountains of Utah. Ski adventures have also taken the Smiths to the mountains of Colorado, California, Oregon, Canada, Japan and Norway.

They usually get started before the sun comes up. They climb 4,000 to 6,000 feet with a 25- to 40-degree pitch, then ski down, all of which takes several hours. Then, they do it all over again, two to three times a day.

The appeal of backcountry skiing goes far beyond the workout or the thrill of the downhill ride. For Andrea and Chris, it offers a rare opportunity to disconnect from the emails, phone calls and demands of their profession. In the mountains, cell service is often nonexistent, and the focus shifts entirely to the terrain, the weather and the moment. As an attorney, this is a great way to clear your mind from the daily grind of practicing law and remain grounded.

“It’s one of the few times when you truly have to be present,” Andrea says. “You’re paying attention to the snowpack, the conditions, the route you’re taking.

There’s no room to think about anything else.”

Preparation is also an important part of every outing.

Avalanche safety training, studying weather reports and evaluating snow conditions are all essential before heading into the backcountry. The Smiths rely on experienced guides in some circumstances, but also take personal responsibility for understanding the environment they are entering.

“You learn quickly that the mountains demand respect,” Chris says. “You can’t rush anything, and you have to trust the people you’re with.”

“There’s nothing like skiing a line that hasn’t been touched yet,” Andrea says. “You feel like you’re discovering something.”

The couple also appreciates how the sport strengthens their partnership. Spending hours climbing together requires communication, encouragement and patience. Those same qualities, they say, translate back into their professional lives.

To stay in shape for their intense mountain sport while living in the flat part of the country – Florida –, the couple does a lot of running, cycling and cardio exercises, as well as lifting weights. Their ideal ski touring trips would include staying on an icebreaker ship to ski the fjords in Norway and visiting the backcountry in Patagonia. Ultimately, they hope to ski tour on every continent.

“I think it helps teach resilience,” Chris says. “You plan, prepare and hike uphill for hours at a time to get to the goal, which is the top. It is much like practicing law in that regard. If you can summit huge mountains it puts things into perspective and helps you realize that proper preparation and resilience can you get you through almost any challenge you face while practicing law.”

For Andrea and Chris Smith, the climb is worth every step.

Backcountry skiing offers more than adventure; it provides balance. Far from courtrooms and case files, the mountains remind them to slow down, stay present and reconnect, returning to their legal careers refreshed, focused and ready for the challenges ahead.

Meet the Honorable ALANE C. LABODA Judge Alane C. Laboda grew up in Fort Myers and returned home to practice law after earning her Bachelor of Arts from George Washington University in Washington, D.C., and her Juris Doctorate from the University of Miami.

In 2008, Judge Laboda was appointed by Governor Charlie Crist to the Circuit Court Bench. She has served on the bench throughout the Twentieth Judicial Circuit during her tenure, having enjoyed her time in the various counties getting to know each of the respective local bar members. One of her favorite things about serving on her docket is the opportunity to meet lawyers from all over the state.

Q: W hat was your practice before you went on the bench?

A: In 1992, I started as an Assistant State Attorney, working for former State Attorney Joe D’Alessandro.

I began with the misdemeanor division and moved from there to handle juvenile, felony and capital cases before departing. I have had the honor of trying cases as co-counsel with Stephen Russell, Esq. (who later served as the State Attorney from 2003 to 2018), and The Honorable U.S. District Court Judge Sheri Polster Chappell.

To diversify my legal experience, I went from the practice of criminal law to civil law. I joined Henderson, Franklin, Starnes & Holt in 1997, working in the Torts and Insurance Practice Section. At Henderson Franklin, I handled predominantly professional liability cases, working mostly with Mike Corso, Esq., and Bruce Stanley, Esq. As one of the few attorneys in the firm with a criminal law background at that time, I also handled what I liked to call the “weird and bizarre” cases, which were typically things that were out of the norm for the firm. It provided variety and opportunity to expand my areas of practice.

enough to have several incredible mentors, including those I mentioned above, but I would have to add Marshall Bower, Esq. (currently the President and Executive Director of The Foundation for Lee County Public Schools, Inc.), and the current State Attorney for the Twentieth Judicial Circuit, the Honorable Amira Fox. Getting to try cases with all these attorneys taught me trial skills and knowledge that have served me to this day.

Q: W hat is your current docket?

A: General Civil, Guardianship and Probate.

Q: What advice do you have for lawyers appearing in front of you?

A: Preparation, preparation, preparation.

Q: Do you have any advice for new lawyers?

A: Become an active observer! Take time to go to the courthouse, with colleagues or on your own, and watch the attorneys practicing before the court.

Listen and learn. Hearings can be an incredible opportunity to gain insight into what things to do right as a practitioner and what behaviors to avoid. If you participate in remote proceedings, pay attention to the other cases being called on the docket. But if you can make the time, come to court in person and take advantage of how much there is to learn happening right in front of you.

Q: What is the top thing to avoid doing in your courtroom?

A: Attorneys should not come to Court and leave the Rules of Professional Courtesy and Conduct outside the door.

Q: What is the most professional thing you have seen in your courtroom?

A: The lawyers, especially in highly-contested cases, who come to Court fully prepared and on time.

They present their legal arguments in an organized and thoughtful fashion, clearly demonstrating to the Court that they know their case and the applicable law. They set their client’s emotions aside and accept that the opposition may take a different position, but it never gets personal between the attorneys.

Q: You’re a Dolphins fan. Who is the greatest Dolphin of all time?

A: That would be Larry “Zonk” Csonka! I even had a dog named after him.

Q: Are the ’72 Dolphins the greatest football team of all time?

A: Yes. Can you name another NFL team with a perfect season?

Have you ever met someone famous, like a celebrity or famous chef?

I met Kurt Warner when he was dedicating a new USO facility at the St. Louis Airport. He came across as humble and kind.

Years later, I met a man at the Burger Bar in Punta Gorda who was Kurt's supervisor at the Hy-Vee grocery store in Iowa (where Kurt was a night stocker) when the St. Louis Rams called Kurt to become the Ram's backup quarterback.

What is your greatest professional or academic accomplishment thus far in your career?

Being appointed by Governor DeSantis as a County Court Judge.

What is the most adventurous thing you’ve ever eaten?

Food is cultural, often driven by what is traditional and what is available. What some may consider adventurous is standard fare for others. I ate a few meals in Afghanistan where everyone ate from the same plate, and I was not certain what the meat was. I have eaten a variety of wild game, including rabbit, squirrel, deer, antelope, bighorn sheep, elk, moose, turtles and alligator.

What advice would you give your younger self about law school, your legal career, work/life balance, etc.?

The advice I would give is to talk to as many people who are lawyers as you can. The area that you think you might want to practice in may not be the area of law you wind up practicing in. Do not be afraid to try something new if you are interested in practicing in another field of law.

Tell us about an item of interest that sits on your desk, and what it represents to you.

A sticky note I penned with these words of advice from Circuit Judge Geoffrey Gentile: “Provide a fair and courteous hearing and rule promptly. Be worthy of the responsibility.”

Better Together Why Southwest Florida’s Solo Practitioners and Small Firms Should Thrive Together Even though the regional Southwest Florida population has exploded in recent years, small businesses are still the backbone of the local communities ranging from Sarasota to Marco Island. In an increasingly competitive and growing market, solo practitioners and small firms working in isolation can be financially and logistically challenging and leave many newer entrepreneurial startups focused on making ends meet rather than on their caseloads. Furthermore, the naturally competitive nature of the legal profession makes it difficult to have an open and honest conversation with other attorneys about what makes elements of their business work and don’t work.

However, collaboration between solo practitioners and small law firms is essential for growth and sustainability n a rapidly changing economic area like Southwest Florida. When smaller firms work together, they can leverage each other's strengths to create opportunities that might be unattainable individually. This is not just a dubious exercise in goodwill and compassion, but it is a proven driver of revenue and client growth. For example, recent research from the Thomson Reuters Institute shows that firms that prioritize collaboration are better able to increase their share of client legal spending, particularly in a market where there is still growth, but demand may be flattening due to the rise of artificial intelligence and other technological threats. By working together across practice areas or with other firms, solo practitioners and small firms can position themselves as comprehensive resources rather than a “one off” service provider.

On a broader level, the legal industry itself is moving toward more collaborative models.

The rapid growth of AI-driven legal service providers reflects increasing demand for partnerships that provide reliable and trustworthy legal solutions over a simple prompt. In an economy that it is heavily influenced by a rotation of newcomers through tourism and seasonal residents, these developments reinforce a simple but powerful reality: collaboration is a strategic advantage to businesses that embrace it, allowing solo practitioners and small firms to harness the new population of families and business in the rapidly evolving Southwest Florida landscape.

Joe D'Alessandro, Esq.

By John Dommerich Jr. Legendary lawyer and hometown hero Joe D’Alessandro passed away on Feb. 16, 2026, at the age of 86, leaving behind an enduring legacy in the Lee County legal community.

Born and raised in Fort Myers, D'Alessandro’s roots in the community shaped a lifetime of public service. He graduated from Fort Myers High School in 1957 and earned his undergraduate degree from the University of Florida in 1961. He then obtained his Juris Doctor from Stetson University College of Law in 1964, before returning home to begin his remarkable career.

In 1969, at just 30 years old, he was appointed the first ever State Attorney for the newly created Twentieth Judicial Circuit. Over the next 33 years, he served with distinction, guiding the circuit through decades of rapid population growth and an evolving legal system. Respected throughout

Florida for his commitment to the fair administration of justice, he balanced being tough on crime with a genuine compassion for others.

D'Alessandro helped mentor countless attorneys who went on to enjoy successful legal careers. His influence extended far beyond the courtroom and left a lasting imprint on the legal profession.

On a personal note, I will miss seeing him around town. I had known him since I was a kid, and he played a significant role in my family’s life. He hired my father to work for him in 1976 and was important to my father’s development as a lawyer. He was always supportive to me throughout my own legal journey.

He will truly be missed.

Judge John Carlin

The Honorable Judge John S. Carlin passed away on March 5, 2025, at the age of 65, leaving behind a legal legacy not soon forgotten.

Born in Canton, Ohio, in 1960, Judge Carlin graduated from Timken High School in 1978 and went on to earn his bachelor’s degree in political science and his Juris Doctor from The Ohio State University. In 1985, Judge Carlin relocated to Lee County, where he served our community for more than 30 years.

After moving to Fort Myers, Judge Carlin was an assistant state attorney in the Twentieth Judicial Circuit, and later joined law firm Gerald, Cary & Duncan, followed by Decker & Smith, P.A. He then decided to run for Lee County Judge and was elected to the position in August 1990 and sworn in in January 1991. Five years later, Judge Carlin ran for an open Circuit Court position and was elected without opposition. Just three years prior, he was honored by the Florida Law Related Education Association.

He earned the respect of colleagues and the legal community for his dedication to the judicial process and his service to the community.

For more than three decades, Judge Carlin served Lee County and the Twentieth Judicial Circuit, earning his reputation as a fair, steady and principled judge who respected the Constitution, the rule of law and every individual who entered his courtroom.

He was known for a disciplined judicial approach rooted in the faithful application of the law as enacted, not shaped by personal preference or political agendas. Judge Carlin believed a judge’s role is to uphold the Constitution, protect individual rights and ensure that every person who comes before the court is treated with dignity and fairness. Attorneys and litigants alike recognized his courtroom as well-run, orderly and guided by consistency and common sense.

He will truly be missed by all. The Lee County Bar Association is proud to honor his extraordinary legacy to the legal community at large, but also his Law Week legacy. We extend heartfelt condolences to his family, friends and colleagues.

Jeffrey Garvin, Esq.

Jeffrey R. Garvin, Esq., passed away on March 22, 2026, at the age of 77. A pillar in the Lee County community, he was well respected in the practice of personal injury law and many other areas.

Born in Lakewood, New Jersey, Garvin graduated from Manatee County High School in 1966 and later earned his bachelor's degree from Western Carolina University and his Juris Doctor from the University of Florida Levin College of Law. Garvin’s legal career spanned more than five decades, and he was also deeply committed to his community and profession, serving as past president of the Edison Community College Endowment Corporation and past president of the SanibelCaptiva Rotary Trust Fund. He also served on the board of directors of the Academy of Florida Trial Lawyers, chairing numerous committees

and contributing his leadership and expertise to the advancement of the legal profession. He was a past president of the Florida Chapters of the American Board of Trial Advocates and a member of the Calusa Inns of Court. Throughout his career, he published numerous articles and was a co-author of Trial Advocacy: The Official Handbook of the Academy of Florida Trial Lawyers.

Never one to slow down, even in "retirement,” he stayed active and continued giving back through his Rotary Club or volunteering at his daughter's school.

Garvin will truly be missed by all.

The Lee County Bar Association is proud to honor this legal legend.

Connections: Cooperative skills and team building grow in a positive group setting with participants learning firsthand how to create positive connections with others.

At South Seas

In early April, my fiancé Steve and I decided to take a trip out to South Seas and see what the hubbub was about, as I kept hearing they had improved and modernized. Now, I haven’t been to South Seas since the Summer of 1996, so when I planned this visit, I knew things would be different, but WOW, was I surprised!

It all begins at the South Seas Registration Office, where a very friendly face will greet you with a fresh mimosa. From there, we were able to take a golf cart tour of the entire property, and while it seems very quaint everywhere you turn, the truth is, the property is huge!

Touring Captiva Landing Our tour guide, Caitlin, was quick to answer all our questions and pointed out that guests booking through the South Seas resort and Club Captiva members have access to amenities, including The Clutch golf course, boat rentals, water tours, and multiple dining options, as well as Captiva Landing.

Our first stop on the tour was Captiva Landing, which is essentially the front of the property.

It combines a variety of amenities situated around not one, but three water features: 1. A kid-friendly pool with multiple slides, where a giant bucket of water fills up and drops water on everyone around.

2. My favorite is the lazy river, because what is better than catching rays in the open air while gliding along in a pool of water?

3. The quiet option. While it is not an adults-only pool, it is indeed mostly adults.

All these areas have private cabanas that can be rented and secured shut, so you can have a central location for snacking, laying out or just taking a nap!

After we left Captiva Landing, we saw a zillion different things on our way to the restaurant where we would have dinner. You literally have it all right on their property!

Dining at Haborside While we were at South Seas for the quick tour, we chose to dine at Harborside, where they feature fresh seafood and Italian inspired dishes with a huge cocktail, beer and wine menu. We

walked in and were seated on their outside deck, where they had a musician playing all kinds of fun music to welcome those of us on the patio.

As the sun was setting, we needed to have a nice libation to sip on. As of late, I have become a Pinot Noir fan, so I stayed loyal to that, and Steve opted for his go-to, a smoked old fashioned.

He has told me that it is ranked in his top two!

Their menu is rather extensive, as you would expect, to serve every pallet, so we decided to try a little of each section, starting off with one of our favorites, raw oysters on the half shell, which was served with a mildly spicy mustard and the traditional cocktail sauce. Both were good, but the mustard was very unique and added a level of flavor we were not expecting, for sure. They offer a variety of salads, and one that stood out was the wedge salad, which is always a great option, and it was HUGE, so we shared it. The lettuce was so crisp and refreshing!

When it came time to choose an entree, Olga, our server, was met with my standard question: “What is your most popular dish?” She said the Frutti Di Mare Cioppino and the Grilled Branzino, which both sounded like other languages, so we imagined they would be good. We took her advice and also added the mushroom risotto.

I do not need to explain why; I mean, come on!

Risotto is just comforting, so we had to!

As we sat there, we were swiftly greeted with a basket of these house-made rolls accompanied

by butter, and the smell of rosemary wafted over as it came to us. When our entrees arrived, they came plated like art, and although that was very appreciated by us both, we saved our words and dug right in.

The fresh and delicate grilled dish on Steve’s plate was amazing with a fresh made pico on top that really brightened the flavor. My dish was a magical bowl of seafood and red sauce. It had clams, mussels, shrimp, fish and scallops, and each one was so tender and flavorful. Served with crusty slices of baguette to use as a vessel to scoop up the sauce, it was amazing!

The Perfect Staycation Destination South Seas is the perfect place to bring your family, friends and anyone else, both from here and not from here. The views, the food, the drinks... It was all really a great experience!

mental health into FOCUS As the second anniversary of the inception of Lee County Bar Association’s Mental Health and Wellness Mission (MHWM) approaches, I’d like to take the time to bring mental health back into focus for all of us.

I’m seeing it, and I’m hearing it. Our legal community continues to be stressed out.

Some of us are doing “okay,” but some of us are still coping in unhealthy ways. We talk about work/life balance, but are any of us really getting that done? Did we start the new year off with excitement and resolutions, and where are we on that right now?

Is that new gym membership just sitting there? What about that huge water jug?

Is it still 75% full at 5 p.m.? What about your mental health? Have you researched therapists? Have you made an appointment? What are you doing for yourself each day to make sure you are taking care of you? Nothing? Yeah, me too... Let's talk about it.

I’ve shared my journey before. I was lost, I was hurting, and I hated myself, but you would never know it. I was a master at pretending. I “hit bottom” and got help, and I worked at it, but like everything else, consistency is key. If I stop using it, I lose it. I recently checked in with myself and realized that I was letting “all the things” take over; I was not focusing on myself like I used to.

I’ve gained five pounds. I’m letting my exercise regimen slide. I haven’t seen my therapist in a while. I am putting “all the things” ahead of my own well-being, I am treading water most days, and I just want to crawl into bed by 8 p.m.

Sound familiar?

Let’s get back on track! Spring is here, the weather is warmer (FINALLY!), and now is the time to refocus on what is so important – our mental health! If you started taking care of yourself, but you have “let things slide” like I have, it’s not too late to readjust and get back where you need to be — for you and everyone around you.

Our colleague, Shelly Finman, Esq., recently said, “Self-care for lawyers is of critical importance.” To continue to quote Finman about practicing law, he said, “I am reminded of my personal transition in my practice mantras and skills…over many years.

This style of practice evolved into a 24/7 mindful way of life. In helping others in our job and in other ways, we are actually becoming more mindful in our personal life.”

Mindfulness and self-care are so important, but they are also difficult to master.

Start Small So, where do we start? SMALL. Start small, start simple. Take five or 10 minutes each day just for you. Do something nice for yourself, whether it’s a short walk in the sunshine, a cup of coffee (or ice cream), journaling, stretching or a few minutes of quiet and meditation. Between work, commutes, kids, family, community and more work, many of us have trouble finding five or 10 minutes a day just for ourselves. Consistency is important, so start small with something reasonable that is easy to accomplish. This will help you create the habit of bringing your well-being back into focus.

Spring Clean With spring also comes spring-cleaning; another way to start small is to clear away the clutter. Straighten your desk and get loose files and paperwork into organized systems. Stop at a car wash to take care of the place in which you probably spend hours each day; drive through, trash the empty water bottles and take-out bags, and vacuum out all the Cheerios® and Cheez-Its®.

Maybe even add a Little Tree® while you’re at it.

Clear your closet of everything that doesn’t fit and donate it all. There are so many places in our lives that can be cleaned up and cleared out in 10 to 15 minutes; a clear space is great for our mental health.

Make the Appointment What if things are worse? What if we are way past “letting things slide a little bit?” Maybe it’s time to make that therapy appointment. Remember, the MHWM is still here if you need it. Have you seen the latest MHWM update in the Res Gestae?

What Law School Doesn’t Teach About Work-Life Balance Law school prepares students to think like lawyers, but it doesn’t prepare them particularly well for how lawyers live. In law school, the workload is substantial, but it’s structured.

The pace is predictable, and there are natural breaks built into the calendar. There are no client emergencies at 8 p.m., no last-minute filings by opposing counsel, and no expectation to be constantly available.

Practice is different. For new lawyers, the first two to three years often feel overwhelming. The hours can be long, the work unpredictable and the learning curve steep. Opposing counsel and client demands introduce a level of urgency.

Under all that pressure, it’s not uncommon for new lawyers to question whether they’re cut out for the profession or whether the demands of the practice will permanently consume their time.

Those feelings are normal. The early years of practice are, in many ways, an adjustment period, not just intellectually, but psychologically – and that adjustment takes time.

The concept of “work-life balance” can be misleading in that context. A more realistic goal is work-life harmonization. That is, developing the ability to function effectively within the demands of the profession while still preserving elements of a personal life.

There are a few practical principles that can help.

1. First, accept that some degree of imbalance is inevitable early on. Trying to maintain a perfectly balanced schedule every day will only lead to frustration. Instead, focus on consistency over time. There will be heavy weeks, but those are often followed by lighter ones. The goal isn’t a daily “balance,” but long-term sustainability.

2. Second, control what you can. While a lot of a young lawyer’s schedule is reactive, small areas of control are important – a workout, a dinner, etc.

3. Third, develop responsiveness without being perpetually “on-the-clock.” Being reliable and timely is important, but not every task demands immediate attention.

4. Fourth, build efficiency early. The more quickly a lawyer can finish routine tasks, the more control they regain over their time.

Over time, what once took hours becomes manageable in a fraction of the time.

5. Finally, recognize that you’ll adapt. The pressure that you think is overwhelming now will become familiar.

Remember, the early challenges of the practice are not indicators of failure; they’re part of the process of becoming a competent attorney. And work-life harmonization isn’t developed overnight.

It grows gradually through experience, efficiency and connection with colleagues and mentors inside and outside the office.

For many young lawyers, connection to the local legal community can ease that process.

Involvement with the Lee County Bar Association (LCBA) and its Young Lawyers Division, through events like Burritos with the Bench or the LCBA Foundation Charity Golf Tournament (May 15, 2026), offers opportunities to network, find mentors and engage socially with peers facing the same early-career challenges .

Attorney wellness goes beyond physical health. It includes protecting our mental well-being, too. Burnout is, unfortunately, a very real part of our profession. In fact, The Florida Bar even offers a free CLE on burnout in the legal profession. We have all heard the familiar reminders: self-care is not selfish, and it is important to make time for ourselves and create a work-life balance. We may even begin the New Year with the best intentions, only to realize by April that we have not started to prioritize self-care, or that we did for a few weeks and then stopped.

So, what can we do to better support ourselves?

Judge Kimberly Bocelli shares that even with significant time constraints, she prioritizes running two to three days a week with friends. She also finds using a stand-up desk helpful for avoiding long periods of sitting throughout the day. Additionally, she notes that some colleagues use walking pads in their offices or take time to walk outside during lunch.

Attorney John Miller shares, “I just got a Peloton in my office so that I can jump on when I have a free second.” These examples highlight an important point: creating small pockets of time throughout the day – even just 15 minutes – can help you recharge. Whether it is taking a short walk, stepping outside for fresh air, or simply pausing for a few moments, these small actions can make a meaningful difference.

We often tell ourselves we need a large block of time to make an impact, but a better question is: What can I realistically do each day to decompress, de-stress, or recharge? Setting realistic goals and starting small are key steps toward creating lasting change.

Wellness does not have to happen only during the workday.

Finding time outside of work is just as important. This may include involving your family, and there is an added benefit, as you are now modeling healthy habits for your children.

John Miller shares, “We take a lot of walks around the

neighborhood as a family.” Attorney Mykisha Atisele enjoys participating in community arts and crafts projects with friends, bringing creativity and joy into her routine. Attorney Alexandra Anderes makes time for social and cultural experiences, inviting friends to join her at the theatre or for events at Blinking Owl Books in Fort Myers.

Employers can also play an important role in supporting attorney wellness. One example is the Public Defender’s monthly Wellness Wednesday program. The author acknowledges a personal connection to this initiative. Each month, I host a 30-minute session open to attorneys and support staff, with virtual options available for outlying counties.

These sessions may include chair yoga or guided practices focused on relaxation, gratitude, or other wellness topics.

Public Defender Kathy Smith has been a strong supporter of this program and of prioritizing attorney mental health. It is also worth checking with your own employer to see what resources may be available. For example, when Judge Bocelli was a magistrate, county employees were provided with a free subscription to the Calm app while employed with the county, which offers guided meditation and relaxation tools.

As you build your personal wellness toolkit, consider incorporating activities that bring you joy and support your well-being. At the same time, recognize that there may be moments when additional support is needed. The Lee County Bar Association offers up to six free counseling sessions for active Florida Bar members in Lee County. The Florida Bar also provides the Florida Lawyers Helpline at 1-833-351-9355, a free, completely confidential service that connects members with professional counselors, including up to five free counseling sessions per year.

Taking care of your mental and physical health is not optional!

It is essential to sustain both your career and your overall well-being.

u Lindsay Compton Which sports team do you root for and why?

The Red Sox. I grew up in New England watching and crying over the Red Sox until 2004. I lived in Boston when the Red Sox beat the curse, and it was the most magical season and one of my favorite memories.

Have you ever met someone famous, like a celebrity or famous chef?

While I lived in Boston, I met a few Red Sox players around town, including David Ortiz, David Roberts (who saved the season in games four and five of the American League Championship Series (ALCS) Championship game) Michael Lowell and Coco Crisp. I met my favorite musician ever, John Williams, at the Schermerhorn in Nashville. It took everything in me not to pass out. I also met Phillip Glass, who composed one of my favorite film scores of all time (Notes on a Scandal) in Nashville.

What is your favorite hobby, and why do you like it?

Caring for plants. It is soothing and quiet.

If you could share a meal with any famous historic figure, who would it be and why?

Abolitionist John Brown. I’d want to speak with John Brown to better understand what drives someone to challenge an unjust system and to explore the conviction, clarity of purpose and willingness to act when others hesitate.

Tell us about an item of interest that sits on your desk, and what it represents to you.

A picture of my father who passed almost three years ago. He encouraged me so much and would be so proud of what I have accomplished.
