Heading Into Season

It’s hard to believe summer is already coming to an end. As our kids head back to school, and we settle back into the routines of work and family life, it feels like we’re kicking off another busy season. Our calendars are already filling up with hearings, meetings and Lee County Bar Association (LCBA) events. And, as we know, the holidays will be here before we know it. I want to pause and remember our friend and colleague, Steve Wetter, Esq. My heartfelt condolences go out to his family and loved ones. I will miss seeing Steve around the courthouse and stopping to talk with him. He was a talented lawyer, a respected member of our legal community and someone who made practicing law a little more enjoyable for those around him. He will be deeply missed. We'd also like to honor the late Judge Steele, who left a profound impact on our legal community here in Southwest Florida. Please visit pages 22-23 for a tribute written by Dawn Maselli, Esq., and John Miller III, Esq. I also want to extend my heartfelt congratulations to our Executive Director, Lauren Baugh, on her recent wedding. client obligations in a Fee Agreement the Opinion warns that “noncompliance with a trivial obligation or based on a client’s insubstantial failure to comply with an obligation set forth in the engagement agreement” will not be an appropriate basis for withdrawal. Examples of inappropriate obligations are those that are contrary to other obligations in the rules. A fee agreement cannot impose an obligation for a client to accept a settlement or otherwise impinge on objectives and scope of representation as set forth in Rule 4-1.2. Neither should a lawyer include obligations in a fee agreement that do not relate to the representation.

A lawyer’s fee agreement often reveals hard lessons learned through disputes with clients. Modifications to a lawyer’s standard fee agreement are often made after a client dispute in an effort to avoid similar disputes in the future. ABA Formal Opinion 523 (Engagement Agreements) provides guidance regarding whether such provisions that impose client obligations in a fee agreement are appropriate. The Opinion frames the analysis in relation to what a fee agreement may include as a permissible basis for withdrawal from a representation pursuant to Model Rule 1.16 (Declining or Terminating Representation).

Examples of appropriate client obligations include the most obvious, which is the requirement to meet financial obligations. It is recognized as appropriate to spell out “firm policies for handling expenses, including e-discovery charges, as well as provisions addressing, among other things, dispute resolution, choice of law, file retention and anticipated adjustments in lawyer hourly rates on a periodic basis.” Additional obligations may include prohibiting a client from engaging in public communication, requiring a client to cooperate with discovery requests and to refrain from recording communications with the lawyer. However,

One controversial provision sometimes included in fee agreements is what is known as a future or advance waiver of conflict of interest. Such a waiver purports to allow a lawyer to represent other clients in the future who have adverse interests to the client who is party to the advance waiver. These waivers allow for representation of clients with adverse interests as long as they are not “substantially related” to the work performed for the advance waiver client. As a result, such waivers have the effect of authorizing application of the less stringent former client conflict provisions to a current client while lessening the traditional duty of loyalty to a client. Advance waivers are often used in large law firm fee agreements. At least one such waiver was found to be enforceable by a federal District Court in Florida. They are also recognized in the comment to Model Rule 1.7 and in ABA Formal Opinion 05-436 (Informed Consent to Future Conflicts of Interest). Unlike the Model Rules, the comment to Florida Rule 4-1.7 does not specifically recognize advance waivers. The enforceability of advance waivers in Florida has not yet been clearly decided. However, it is significant that the Florida Supreme Court has already rejected the application of federal law in relation to disqualification of counsel by conflict in Young v. Achenbauch, 136 So. 3d 575 (Fla. 2014).

Access to justice is one of the cornerstones of a strong and fair community. Yet for many individuals and families facing legal challenges, the cost of hiring an attorney can place legal representation out of reach. Pro bono legal services help close that gap, ensuring that vulnerable residents have access to legal guidance, advocacy and representation regardless of their financial circumstances. Members of the Lee County Bar Association (LCBA) play a critical role in advancing access to justice through their volunteer work with organizations such as Lee County Legal Aid Society and Florida Rural Legal Services (FRLS). Their dedication exemplifies the legal profession's commitment to public service and the principle that justice should be available to all, not just those who can afford it. In the legal world, pro bono, meaning "for the public good," refers to legal services provided without charge to individuals who cannot afford representation. While criminal defendants have a constitutional right to an attorney, the same is not true in most civil legal matters. As a result, people facing issues such as eviction, foreclosure, domestic violence, child custody disputes, probate matters, consumer debt actions, and elder and family law cases often navigate the legal system alone. Pro bono attorneys help bridge the gap by providing advice, representation and advocacy for those who would have to fend for themselves. The impact of this work can be truly life-changing. A family facing homelessness may be able to remain in stable housing. A survivor of domestic violence may obtain a protective order. A senior citizen may receive assistance with protecting their hard-earned assets or resolving consumer issues. Children may gain access to needed services, and parents may receive help securing custody arrangements that serve their children's

best interests. Through pro bono service, legal professionals contribute directly to stronger families, more stable communities and a more equitable justice system. Lee County Legal Aid Society Lee County Legal Aid Society has been serving low-income residents since 1967, providing free civil legal assistance through qualified attorneys and certified legal representatives. The organization offers support in a wide range of legal matters, including family law, employment issues, landlord-tenant disputes, probate matters, consumer concerns and civil litigation. Its mission reflects a longstanding commitment to ensuring that financial hardship does not prevent residents from accessing legal help. A significant portion of Lee County Legal Aid Society's success is attributable to volunteer attorneys who generously donate their time and expertise. Through initiatives such as virtual legal clinics and the Self-Help Center, volunteer lawyers provide free consultations to residents seeking guidance on pressing legal concerns. Members of the LCBA have demonstrated extraordinary leadership in this effort. During the association's annual Pro Bono Awards, numerous attorneys, judges and legal professionals have been recognized for their outstanding volunteer service. In 2024, Lee County Legal Aid Society Executive Director Andrew Banyai, Legal Director Blair DeMinico, and volunteer attorneys Maria Alaimo, Lisa Gelman, Carlena Hull, Susan Larned, Kristianna Soto, Frank Talty and Patty Talty were among those honored for their commitment to providing legal assistance to low-income residents. Their work, along with that of many other local attorneys, helps ensure that vulnerable community members receive meaningful access to legal resources. Many of these volunteers contribute hundreds of hours annually. According to reports highlighted by The Florida Bar, a core group of private-practice attorneys collectively donates approximately 1,000 hours of pro bono service each year. Their efforts support programs addressing landlord-tenant disputes, foreclosures, evictions, probate cases, debt collection matters, custody issues, elder law and domestic violence cases. Such generosity demonstrates the legal profession's enduring commitment to community service and professional responsibility. Florida Rural Legal Services FRLS serves as another essential provider of civil legal assistance in Southwest Florida and throughout a large portion of the state. FRLS works with low-income individuals, farm workers, seniors, veterans, children and other vulnerable populations. The organization relies heavily on partnerships with private attorneys, retired lawyers, law students and legal professionals to expand access to legal representation in areas such as family law, consumer advocacy, housing, guardianship, elder law, immigration and public benefits. Recognizing the demands placed on modern legal practices, FRLS has developed flexible opportunities for attorneys to volunteer. Its "Pro Bono on Demand" initiative allows family law attorneys to provide legal advice remotely through virtual clinics. facing issues involving divorce, child support, custody, paternity and time sharing. FRLS performs conflict checks, manages scheduling and provides malpractice coverage during volunteer sessions, making participation both efficient and impactful. Meet The Honorable GILBERTO PEREZ Judge Gilberto Perez sits on the circuit bench in Lee County, assigned to the Unified Family Court Division. He first took the bench as a magistrate, serving from 2015 to 2020, before Governor DeSantis appointed him to the circuit bench in 2020. Judge Perez, a first-generation American, is proud of his Cuban roots. His parents emigrated from Cuba to the United States in 1967, and their gratitude toward their new nation shaped Judge Perez’s life path. As recent immigrants, his parents urged Judge Perez and his siblings to give back to their community. Judge Perez remains close to his family, and his brother and a sister live here in Lee County. Judge Perez has spent much of his career in public service. He began at the Miami-Dade Legal Aid Society before taking a position with the Florida Attorney General’s Office, where he represented the Department of Children and Families. Here in Southwest Florida, he represented the people of the 20th Judicial Circuit as an assistant state attorney before taking the bench as a magistrate and then circuit judge. This article was lightly edited for length.

Q: W hat was your practice before you took the bench?

A: I was a family law litigator right out law school, first with Legal Aid in Miami for about three or four years. I later represented the Department of Children & Families handling juvenile dependency litigation, first as a line attorney and then as bureau chief [in the Office of the Attorney General]. I moved here [to Lee County] in 2002 and practiced as an assistant state attorney, starting in misdemeanor. Later, I moved to the Special Victims Unit, where I prosecuted crimes committed against children and the elderly and sexual assault crimes. I practiced family law in private firms, at Henderson Franklin and at my own firm.

Q: Do you have any tips for new lawyers? A: Know that there are things that you don’t know. Q: You’re a film fan. What is your favorite movie and why?

A: I am still a film fan, but I have become a theater fan, also. Probably my favorite movie is "All About Eve." The dialogue is so interesting, and the story is built around the theater. It’s an early Marilyn Monroe role and stars Bette Davis.

Q: What is your favorite stage production? A: "Wicked." I loved "The Wizard of Oz" film and novel. I recently saw "To Kill a Mockingbird" here in Fort Myers. Richard Thomas [author’s note: John-Boy from "The Waltons" for people of a certain age] played Atticus Finch.

Q: What is your favorite courtroom movie and why?

Q: What made you want to be a judge? A: From when I was very young, I wanted to be a judge. In my middle school legal studies class, the teacher asked me to be the judge. After law school, when I was practicing on the east coast, I applied to be a magistrate. I wasn’t selected, but I still had an interest after I came to Lee County. I was raised to be service-oriented: My brother served in the U.S. Army and my sisters all volunteer in their communities. I wanted to serve by becoming a judge.

A: "Witness for the Prosecution." Billy Wilder’s direction, the lighting and the great cast with Charles Laughton, Marlene Dietrich and Elsa Lanchester. Also, "A Few Good Men." The Tom Cruise character’s cross-examination of Col. Jessup.

Q: W hat is a practice tip that a lawyer might be surprised to hear?

Carlos A. Kelly, Esq., is a business and real estate trial lawyer at Henderson, Franklin, Starnes & Holt, P.A., where he clerked as a rising 3L in 1996 and has practiced since graduating from Emory Law School in 1997. He’s held a variety of leadership positions at Henderson Franklin, and he enjoys mentoring new lawyers.

A: Lawyers won’t be surprised to hear this, because we [judges] all say the same thing. “Be prepared. Know your case.”

Q: What is your current docket? A: The Unified Family Court involves juvenile dependency cases, juvenile delinquency cases and family law.

TRIBUTE SPOTLIGHT There are judges who are remembered for the opinions they write, and there are judges who are remembered for the people they were. The Honorable Judge John E. Steele belongs to both of these categories. His distinguished service on the United States District Court for the Middle District of Florida reflected a steadfast commitment to the rule of law, but those who had the privilege of appearing before him or serving with him will remember something even more enduring – his unfailing courtesy, quiet humility, patience and genuine respect for every person who entered his courtroom. He administered justice with wisdom and fairness, led without seeking attention and left an indelible mark not only on the federal judiciary but on the countless lawyers, law clerks and colleagues whose lives he touched. Judge Steele, Senior United States District Judge for the Middle District of Florida, passed away on July 14, 2026. He was born in Michigan and attended the University of Detroit College of Law. After beginning his career at the Wayne County Prosecuting Attorney’s Office, Judge Steele joined the United States Attorney’s Office in Grand Rapids before transferring to the Jacksonville office in the Middle District of Florida. In 1998, Judge Steele joined Mahoney Adams & Criser. Judge Steele was appointed as a U.S. District Judge for the Middle District of Florida in July of 2000, after previously serving as a U.S. Magistrate Judge on the same court starting in 1991. He took senior status in 2016. He oversaw thousands of civil and criminal cases. He was incredibly involved in the legal community, attending events and mentoring attorneys,

new judges and legal assistants. No matter how busy he was, he was always available for a hug, a handshake or a simple “Hello. How are you doing?” The Honorable Judge Sheri Polster Chappel, who served with Judge Steele as a U.S. District Judge in the Middle District for many years, remembers Judge Steele as a great judge but also a great human being. Judge Chappel recalls that she "was fortunate to know him not only as an exceptional judge whose wisdom was matched only by his kindness, but as a trusted confidant and dear friend. His quiet demeanor concealed an extraordinary legal mind, and his humility, wisdom and unwavering integrity made him someone I will always admire and deeply miss. His legacy will endure in the lives he touched and the example he set." Judge Steele was known for his kind heart, wittiness and willingness to help others. He treated everyone with respect, dignity and integrity. The Lee County Bar Association is proud to honor Judge Steele. We extend our condolences to his family, friends and colleagues. He will be greatly missed. May he rest in peace.

What advice would you give your younger self? When people told you time goes by quickly, it really does. Take a minute to slow down and enjoy each moment a little more. I graduated college in three years instead of the usual four years, and law school in two years instead of the usual three. As a result, I became a staff attorney in Fort Myers managing a portion of the civil docket for the federal judges, including actions filed under 42 U.S.C. section 1983, habeas corpus cases, and reviewing capital habeas corpus cases, at the age of 25. I have found that there are two types of lawyers: those who like family law and those who don’t. Oh sure, it’s possible for attorneys to dabble in a variety of subjects, but when it comes to family law, it really comes down to either you love it, or you hate it. Even for those of us that love it, it’s never easy. The family law attorneys in Southwest Florida have to navigate the issues that shape the daily lives of families, such as divorces, custody battles, domestic violence concerns and even adoptions. Because the stakes are so personal to the parties involved, it’s essential that our lawyers stay informed and up to date on changes in family law. The Lee County Bar Association's (LCBA) Family Law Section offers a meaningful way for our legal practitioners to strengthen their knowledge, sharpen their skills and build relationships that enhance the quality of their work.

Christopher Whitney, Esq., is a general magistrate for the Twentieth Judicial Circuit Court in Lee County, Florida, where he presides primarily over family law cases, Baker Acts and Marchman Acts. He is co-chair of the LCBA Family Law Section.

Empowering the Next Generation

For decades, Big Brothers Big Sisters of the Sun Coast has been changing lives through the power of mentorship. The organization creates and supports one-to-one mentoring relationships that help young people build confidence, overcome challenges and realize their full potential. Serving youth across Florida's Gulf Coast, the program pairs children, known as "Littles," with caring adult mentors, or "Bigs," who provide friendship, guidance and encouragement during critical years of development. One mentor who embodies the mission of the organization is The Honorable Judge Trent Reichling, who was named the 2025 Big Brother of the Year. Alongside his Little Brother, Lucas, he has been part of the program for nearly six years. Judge Reichling was inspired to become a Big because he wanted to make a direct and lasting difference in the life of a young person.

"I wanted to be able to have a direct and positive impact on a child in this community through mentorship. As a state and federal prosecutor, I'd seen too many young men end up in the criminal justice system because they had succumbed to negative influences and lacked direction or guidance. I wanted to do my part in changing that." For Judge Reichling, the experience has been just as meaningful for him as it has been for Lucas. "It's incredibly gratifying. I couldn't imagine not being a Big. It's had a profound impact on my life. The bond I've developed with my Little Brother can't be put into words." Through dedicated volunteers and meaningful relationships, Big Brothers Big Sisters of the Sun Coast continues to strengthen children, families and communities while inspiring brighter futures for the next generation.

2026 What is Sizzle Dining? And why do I keep seeing their logo on my favorite restaurant menus? Well, let’s start from the beginning, which was 10 years ago. That's when Sizzle Dining Founder/Executive Director Guy Clarke and the Sizzlers (I just made that up — his team is not officially called "the Sizzlers") started this concept in Naples. This was an 11-day event where 26 restaurants would offer specially priced dinners, and since then it has grown to a whopping 140 participating restaurants. What are these restaurants participating in, and what for? Great questions! These restaurants are offering specially curated menus at lower rates per dish, which benefits both you (the diner) and the restaurant, since September is one of the slowest months for the hospitality industry. That is a great concept for sure, but they have taken it a step further to also help the community at large via their nonprofit partner, the Southwest Florida Chapter of Blessings in a Backpack.

It is seriously a top-notch place with an amazing menu clearly curated with love and a hint of New Orleans.

CRAFTING NEWS Guest Articles That RELEASES. Grab Media Attention. Journalists once “pounded the pavement” searching for story ideas. Today, media welcome news tips and encourage businesses to submit content for editorial consideration. That presents great opportunities for law firms that can send press releases to announce new attorneys, shareholders, locations or practice areas, as well as promotions, milestone verdicts, awards and philanthropic activities. Attorneys also can author articles and guest opinions exploring new laws and regulations, estate planning, personal injury, elder law, business litigation, real estate and more. Not every news release, bylined article or guest opinion makes it into print, though. That’s why a strategic approach to media relations is critical. Priority Marketing’s public relations team drafts and distributes content every day that is published in local newspapers and magazines and aired on television and radio. These seven elements are essential when submitting copy to media:

1. Follow AP Style Publications adhere to the Associated Press Stylebook, which covers punctuation, grammar and word usage. Following these guidelines allows time-strapped editors to simply cut-andpaste copy with minimal editing.

2. Craft Catchy Headlines Journalists receive hundreds of emails daily. Capturing their attention requires a strong subject line, which usually is the headline and should be five to 10 words that entice reporters and editors to open the email and learn more.

Media value original, innovative and interesting content. News releases are informative, factual and straightforward, while bylined articles can feature more adjectives, adverbs and persuasive copy.

4. Be Clear and Concise English instructors preach the five Ws: who, what, when, where and why. News stories answer those five questions and provide audiences with information they need to know.

5. Include Compelling Quotes News releases are straight to the point, but quotations from partners, presidents or chairpersons inject personality and individuality into the copy. Meanwhile, articles should reflect the writer’s voice and avoid corporate speak and acronyms.

6. Proof the Copy Typos in news releases represent a quick path to the deleted folder. Carefully proof copy to ensure every word and sentence is written to perfection.

7. Share Eye-Catching Visuals Powerful images draw readers’ attention and illustrate stories. Strong visuals improve the likelihood of content being published. Photos should be at least 1-2 MB – preferably larger – so they are clear in print. Additionally, rely on a professional writer, not artificial intelligence, to draft news releases. AI doesn’t know your firm’s culture, brand, market or audience. Priority Marketing put one AI platform to the test, and the result was a 400-word news release riddled with grammatical and factual errors – 26 mistakes in all. Law firms that address the above still lack one asset crucial to generating media coverage – relationships with media. Experienced public relations professionals have strong connections and regular contact with assignment editors, reporters and producers. Their emails are opened, texts are read and phone calls are answered.

I have been fortunate to have a built-in mentor who inspired my passion for law at an early age. That person is my father, Scott Moorey, who is also a criminal defense attorney in Lee County. Our work is rooted in service, but for me, that commitment to serving others does not end when I leave the courtroom. Long before I ever practiced law, I found another calling that continues to shape who I am today: fighting to end hunger in Southwest Florida through the Harry Chapin Food Bank.

Bank was one of my first priorities. I joined the Hunger Walk Committee, helping organize one of the organization's signature fundraising events. For many years, I worked to raise funds, recruit and inspire walkers, volunteer my time and spread awareness about food insecurity throughout Southwest Florida.

In 2016, I was honored to join the board of directors, where I served for six years. partners, the Food Bank distributes nearly 40 million pounds of food annually, including more than 12 million pounds of fresh produce. Since 1983, it has distributed nearly 500 million pounds of food throughout our region. Just as importantly, 96 cents of every dollar donated goes directly to programs and services, and every $10 donated helps provide 20 meals, which is enough to feed a family of four for five days. Today, we are working to raise $30 million to build a state-of-the-art, 110,000-square-foot Hunger Action Center that will double our annual food distribution capacity from 40 million pounds to 80 million pounds. The new facility will feature expanded refrigerated and dry storage, 10 truck bays, an enhanced volunteer center and dedicated spaces for community collaboration and education. It will also include a grocery store-style market where neighbors can choose the foods that best meet their families' needs with dignity, as well as a Neighbor Resource Center that will connect individuals with services such as job coaching, financial literacy and other resources that address the root causes of hunger. Beyond increasing capacity, the new Hunger Action Center will strengthen disaster response capabilities and position the food bank to meet the needs of our growing region for decades to come. Perhaps the most meaningful part of this journey is that it has become a true family affair. In 2025, my husband and I opened our home to host a capital campaign event that raised more than

$150,000 for the Hunger Action Center. My parents have become dedicated supporters, and today my own children volunteer in the same warehouse where my journey began. Watching three generations of my family serve side by side has been one of the greatest blessings of this experience. As attorneys, we often measure success by the cases we resolve or the clients we help. Community service reminds us that our influence extends well beyond our professional responsibilities. We have the ability to lend our leadership, talents and voices to organizations that strengthen our communities. Whether serving on nonprofit boards, mentoring future leaders, volunteering or supporting charitable causes, each of us has the opportunity to make a meaningful impact outside of our legal practice. My work with the Harry Chapin Food Bank is about helping ensure those same families have hope, dignity and the resources they need to build a better future. Both have taught me that meaningful change begins with showing up, serving others and investing in the community we are fortunate to call home. LOCAL BAR ASSOCIATION ACHIEVES REVITALIZATION MILESTONE At its June 10 Leadership & Legacy Membership Welcome Reception, the Isaac Anderson Jr. Bar Association was approved as an affiliate of the Virgil Hawkins Florida Chapter of the National Bar Association, the statewide organization for Black attorneys in Florida. The Isaac Anderson Jr. Bar Association now joins just 20 other chapters as an affiliate. Congratulations!

KEY LEGISLATION TO ENHANCE JUSTICE SYSTEM EFFICIENCY House Bill 177 (HB 177) was signed into law on June 16, 2026. HB 177 began as Regional Counsel Ita M. Neymotin’s idea for her master’s thesis, which was later studied, refined and ultimately culminated in the passage of HB 177. This bill codifies the process for cross-jurisdictional capital case assignments between regions and has the potential to save Florida taxpayers up to $150 million over the next 10 years.

LEGAL AID SOCIETY CELEBRATES EXPANSIONS AND GROWTH Lee County Legal Aid Society has hired Kevin Sarlo as a staff attorney, expanding the organization’s elder law practice, and housing attorney Sems Al Bazz was officially admitted to the Florida Bar. Sarlo and Al-Bazz will continue strengthening the organization’s efforts to assist low-income residents throughout Lee County.
