MESSAGE FROM AMP ADMINISTRATOR

To be the leading nation in vessel registration, with over 8,000 ships sailing under the Panamanian flag, makes us feel pride in our country, in our human capital and in all the investors who place their trust in the transparency and integrity of our work.

The Economic Commission for Latin America and the Caribbean (ECLAC) has distinguished our ports as being the most efficient in the region, and this allows us to say that we have taken all the correct steps to place our terminals at the top of the rankings in port operations and cargo movements.

The current management of the Panama Maritime Authority (AMP) has succeeded in having Panama accepted as a Cooperating Member of the Tokyo Memorandum of Understanding as of October 2015 – a significant achievement. The Tokyo MOU embraces 19

members consisting of authorities and entities from several countries plus five authorities as observers.

Panama’s position as a world-class referent underlines our duty to watch over our national maritime wealth and manage the equitable distribution of this wealth through our port industry, our merchant marine and our seafaring people.

We have undertaken this unwavering commitment to all Panamanians, whether they be working in large ports or small quays. That is why our institution, which accounts for 23 per cent of gross domestic product, is working to expand our national growth and participate in all those government projects that generate works and infrastructure benefiting the entire nation.

AMP will continue to advance, steadily and transparently, looking to uphold the high standards of efficiency and reliability that distinguish it.

Ser la nación líder en abanderamientos de naves, con más de ocho mil buques bajo bandera panameña, nos hace sentir orgullosos de nuestro país, de nuestro capital humano y del conjunto de inversionistas que apuestan por la transparencia e integridad de nuestra labor.

La distinción otorgada por la Comisión Económica para América Latina y el Caribe (CEPAL) a nuestros puertos como los más eficientes de la región, nos lleva a poder afirmar que hemos dados los pasos correctos para que nuestras terminales estén posicionadas a la cabeza en operaciones portuarias y movimiento de carga.

La actual administración de la Autoridad Marítima de Panamá incorporó al país como Estado Cooperante del Memorando de Entendimiento (MOU) de Tokio a partir del mes de octubre de 2015, lo cual es un logro importante. Tokio MOU está conformado por 19 autoridades y organizaciones de diversos países, más 5 autoridades en calidad de observadores.

El hecho de que Panamá sea un país de referencia a nivel mundial nos compromete aún más a reforzar nuestro deber con la administración de la riqueza marítima nacional y con la distribución equitativa de esa riqueza, a través de nuestra industria portuaria, nuestra marina mercante y nuestra gente de mar.

Este compromiso que tenemos con todos los panameños, que laboran en grandes puertos o en pequeños atracaderos, es inquebrantable; es por esto que nuestra institución, que aporta el 23 por ciento del producto interno bruto, dirige su camino a ampliar el crecimiento nacional, contribuyendo con su aporte a los proyectos del Gobierno Nacional que involucran obras e infraestructuras de interés para toda la nación.

La AMP avanza y seguirá avanzando con paso firme y transparencia, en pro de mantener los altos estándares de eficiencia y confiabilidad que la caracterizan.

PANAMA HAS MOST STABLE ECONOMY IN REGION Panama, with a population of 3.9 million people (2014 figures), has experienced a steady growth in its economy over the past decade.

According to the Economic Commission for Latin America and the Caribbean (ECLAC), Panama will again lead expansion in the region in 2015 with a six per cent increase in gross domestic product.

World Bank figures reveal that Panama’s GDP in 2014 amounted to US$ 46.21 billion and that direct foreign investment reached US$ 4.836 billion in 2014. This is a major factor driving the growth of the Panamanian economy.

For this reason, the Panamanian economy is considered one of the most stable on the American continent.

PANAMÁ CON LA ECONOMÍA MÁS ESTABLE DE LA REGIÓN Panamá, con una población de 3.9 millones de personas según cifras de 2014, ha registrado un crecimiento sostenido de su economía en la última década. El país volverá a liderar la expansión regional durante el 2015, de acuerdo con la CEPAL, con un alza en el PIB de 6 %.

Cifras del Banco Mundial (BM) revelan que el PIB de Panamá en 2014 alcanzó la cifra de 46,21 mil millones de dólares y la Inversión Extranjera Directa (IED) sumó 4,836 mil millones de dólares en el 2014. Este es un factor importante como motor del crecimiento de la economía panameña.

Por lo anterior, la economía panameña es considerada como una de las más estables de América, siendo sus principales motores de crecimiento los servicios financieros, turísticos y logísticos, que en su conjunto representan el 75 % del PIB.

El sistema bancario, pilar de la economía de Panamá, sumó 90,196 mil millones de dólares en activos al cierre del año 2014, cuando en el año 2013 fueron 80,173 mil millones de dólares, lo que representa un aumento de 12.5 %.

services are the main drivers of growth in Panama, together accounting for 75 per cent of GDP. The banking system, a pillar of Panama’s economy, recorded US$ 90.196 billion in assets at the close of 2014 – an increase of 12.5 per cent compared with the US$ 80.176 billion of 2013.

RISK RATING The risk-rating agency Moody’s confirmed in early 2015 the risk rating for the Republic of Panama as Baa2, with a ‘stable’ perspective, based on its steady economic growth of nearly 8.2 per cent annually over the past 10 years and the government’s improved debt-to-GDP ratio.

According to Moody’s, the ratio of debt to GDP went from 66 per cent in 2005 to 42 per cent of GDP in 2008 and in recent years it stabilized at around 40 per cent of GDP.

Another of the risk-rating agencies to maintain Panama’s investment grade was Standard & Poor’s, at BBB with a ‘stable’ perspective, because of its economic growth, diversified economy and moderate level of public debt.

“Panama’s economy will continue to grow by close to six per cent over the next three years,” said Standard & Poor’s.

From 2000 to the present, the nation’s unemployment rate dropped from 13.5 to 4.8 per cent and the average rate of inflation was 3.1 per cent.

Panama is renowned as a provider of international services and, in particular, of transportation services through the canal. Its service-oriented economy has turned the country into an international center for such activities as maritime transportation, distribution services and banking.

La firma Moody’s confirmó a principio de 2015, que la calificación de riesgo de la República de Panamá era de Baa2 con perspectiva Estable, basado en el continuo crecimiento económico del país, cercano al 8,2 % anual en los últimos 10 años y a la mejoría gubernamental de la relación deudaProducto Interno Bruto (PIB).

La agencia calificadora de riesgo precisó que la relación deuda/PIB pasó de 66% en 2005 a 42 % en 2008, y que en los últimos años se ha estabilizado alrededor del 40 % del PIB. Otra de las agencias calificadora que mantuvo el grado de inversión a Panamá fue Standard & Poor’s BBB con perspectiva estable por su continuo crecimiento económico, la diversificación de la economía y un moderado nivel de deuda pública. Standard & Poor´s estima “que la economía de Panamá continuará creciendo cerca de 6 % durante los siguientes tres años”.

Desde el año 2000 hasta el presente, la tasa de desempleo pasó de 13,5 % a 4,8 % y la tasa de inflación del país promedio 3,1 %.

El país se caracteriza por ser un proveedor de servicios internacionales, en particular de transporte a través del Canal. Su economía orientada hacia los servicios convierte al país en centro internacional de actividades tales como el transporte marítimo, los servicios de distribución y la banca.

SOCIAL RESPONSIBILITY OF PANAMA’S MARITIME SECTOR

AMP is responsible for a range of functions that include managing, promoting, regulating, planning and executing all strategies, standards, plans and programs relating to the operation and development of the maritime sector.

The Authority manages the world’s largest ship register and is responsible for enforcing all applicable regulations related to crews, training, and seafarer certification and watchkeeping. It is also in charge of proposing and coordinating the development plans for the port system.

Although the activities of the maritime sector generate millions of dollars for the national economy as well as hundreds of jobs, a component that was still absent from the mix was the

social responsibility that the concession-holding companies needed to take on, by cooperating with the Government of Panama to address the needs of the most vulnerable segments of the country’s population.

This is why the current AMP management approved by resolution of the board of directors that a social responsibility clause be included in all concession contracts, in order to dispense with the subjective approach of formerly allocated concessions.

ATTENTION The AMP has been able to identify social needs requiring urgent attention in areas such as the transportation of goods and persons of limited resources and lacking essential facilities; and also those affecting academic and technical education, with a view to supporting the personal development of people connected with the maritime sector; and any other social needs that might require the Authority’s support.

Over the past few years the port concessionaires, by agreement with the Authority, had begun to include in their contracts a commitment to make financial contributions to meet urgent social needs. However, the AMP

considered it necessary to regulate these agreements.

Once the amount of the contribution to be made by the concession-holder is determined, the relevant funds are to be managed by the concession-holder while the AMP will determine the time frame for completion of the contributions or projects.

In this way, the Authority is looking to ensure that the wealth generated by the maritime sector should increasingly benefit the less privileged people of Panama.

Panama, a leader in ship registration, has one of the most competitive port systems in the world. This and other activities are regulated by the Panama Maritime Authority (AMP), an organization created by Decree Law No 7 of 10 February 1998, which unified all the diverse existing public maritime divisions of the Public Administration under a single umbrella.

LA RESPONSABILIDAD SOCIAL DEL SECTOR MARÍTIMO PANAMEÑO Panamá es líder en abanderamiento de naves y cuenta con uno de los sistemas portuarios más competitivos del mundo, estando estas y otras actividades reguladas por la Autoridad Marítima de Panamá (AMP), institución creada mediante Decreto-Ley No. 7 de 10 de febrero de 1998, por el cual las distintas competencias marítimas de la Administración Pública en su momento se unificaron en una sola entidad.

Entre las múltiples funciones a cargo de la AMP figuran administrar, promover,

regular, proyectar y ejecutar las estrategias, normas, planes y programas relacionados con el funcionamiento y desarrollo del sector marítimo.

Está a cargo de administrar el registro de buques, el más grande del mundo; tiene la responsabilidad de hacer cumplir las normas vigentes sobre dotación formación, titulación y guardia de la gente de mar; y también proponer y coordinar los planes de desarrollo del sistema portuario.

Las actividades del conglomerado marítimo generan millones de dólares a la economía nacional y cientos de plazas de trabajo, pero aún faltaba el componente de responsabilidad social de las empresas concesionarias de colaborar con el Estado panameño en apoyar necesidades de los sectores más vulnerables del país.

Es por ello que la actual administración de la AMP, aprobó mediante resolución de la Junta Directiva una cláusula de responsabilidad social en los contratos de concesiones, para así eliminar la subjetividad a que en esta materia estuvieron sujetas las concesiones anteriormente otorgadas.

La entidad, en el ejercicio de sus funciones, ha logrado identificar necesidades sociales que requieren ser atendidas de manera urgente y que impactan sectores vinculados al transporte de mercancías y de personas de escasos recursos y que no cuentan

con facilidades en este sentido; asimismo necesidades que afectan la preparación académica y técnica, para contribuir al desarrollo humano de las personas que colaboran en el sector marítimo; y cualesquiera otras necesidades sociales que requieran el apoyo de la Autoridad.

Ha sido costumbre en los últimos años que los concesionarios portuarios, de común acuerdo con la institución, incluyeran cláusulas en sus contratos contemplando aportes importantes con impacto social; sin embargo, la AMP consideró que era necesario reglamentar estos acuerdos.

Una vez se determine el monto del aporte a realizar por parte del concesionario, será este quien administrará sus fondos. La AMP determinará el plazo en que se ejecutarán los aportes o proyectos.

De esta manera, la entidad busca que la riqueza que se genera en el conglomerado marítimo llegue cada vez más y más a los menos favorecidos del país.

A particularly interesting development is that the project could be the catalyst for a novel association between the public and private sectors through a newly formed association of the sector for energy efficiency, the Global Industry Alliance. The association contemplates the participation of leading private-sector companies, including classification societies, shipbuilders, shipowners and ship operators, maritime equipment suppliers, port operators, management system providers and maritime consultants.

RESPONSABILIDAD DE PANAMÁ CON EL MEDIO AMBIENTE Panamá, junto a otros nueve Estados Miembros de la Organización Marítima Internacional (OMI), participará en el plan piloto del Proyecto GloMEEP, cuyo nombre oficial es “Transformar el sector del transporte marítimo mundial para un futuro de bajas emisiones de CO2 a través de la mejora de la eficiencia energética”.

Estos países piloto principales recibirán ayuda para adoptar un enfoque rápido a fin de introducir reformas institucionales, políticas y legales pertinentes, impulsar la acción gubernamental a nivel regional y nacional y la innovación industrial, con el objeto de apoyar la implantación eficaz de las prescripciones sobre eficiencia energética de la OMI. La OMI, el Fondo para el Medio Ambiente Mundial (FMAM) y el Programa de las Naciones Unidas para el Desarrollo (PNUD), han firmado un acuerdo para asignar 2 millones de dólares a este proyecto, cuyo objetivo es apoyar la adopción e implantación de las medidas de eficiencia energética para los buques.

Este Proyecto GloMEEP se centrará concretamente en la creación de

capacidad para la implantación de medidas técnicas y operacionales en los países en desarrollo, en los que está aumentando la concentración del transporte marítimo. El objetivo es promover un sector marítimo bajo en emisiones de carbono, a fin de reducir al mínimo los efectos adversos sobre el cambio climático de las emisiones del sector, la acidificación de los océanos y la calidad del aire a nivel local.

Un aspecto especialmente interesante del proyecto es su papel como posible catalizador de una asociación innovadora entre los sectores público y privado en el marco del proyecto, a través de una nueva Alianza mundial del sector (GIA) para la eficiencia energética. Está prevista la participación de las compañías líderes del sector privado, incluyendo sociedades de clasificación, constructores, propietarios y operadores de buques, proveedores de equipo marítimo, operadores portuarios y proveedores de sistemas de gestión y de servicios de consultoría marítima.

PANAMA’S AIR CONNECTIVITY

According to the World Economic Forum, Panama is the second most competitive country in Latin America and the Latin American country with the highest economic growth.

Panama has been classified in absolute terms – that is, without considering distribution of wealth – as a medium to high income country.

The buoyant Panamanian economy prompted the International Monetary Fund to announce that according to its official projections – and should the current trend continue – Panama would become the ninth-largest economy in Latin America over the next 12 years. It is currently in 13th position.

The geographical location of the Isthmus of Panama has played an essential role in Panama becoming the most important commercial route in the history of the Americas. It lies between the Caribbean Sea to the north and the Pacific Ocean to the

south, bordering Colombia to the east and Costa Rica to the west. Panama is the connecting link between Central America and South America. It covers a territorial area of 75,517 sq km – the narrowest on the American continent.

Its role as a transit route goes back to the time of the so-called Portobelo Fairs, a trade event recorded in history books as playing an important part in the transfer of gold from the New World to Spain.

LOCATION Thanks to this unique geographical location, Panama has been able to create a veritable passenger transshipment hub for the American continent at Tocumen International Airport, one of the few in the region boasting two runways.

This airport is now in its second stage of expansion, known as T2, costing over US$ 600 million and set for completion in the second half of 2017.

When this is complete, the airport

is expected to handle more than 20 million passengers a year.

T2 includes the construction of the new terminal building, boarding bridges, a baggage handling system, a cooling plant, an access boulevard, an aircraft apron and a new control tower, which will be built once the location of the third runway has been determined.

Tocumen International currently has flights to 83 destinations in 34 countries in the Americas and Europe.

The 2014 official figures show that 8,536,342 passengers passed through the airport, 9.7 per cent more than in the previous year. Of this total, 4,369,202 or 48.8 per cent were transit passengers – a segment that was up 12.2 per cent compared with the previous year.

Thanks to its excellent connections, Tocumen International has the potential to attract air cargo distribution activities. Its air cargo terminal is ranked No 1 in the Central American region for cargo movement.

La vocación como ruta de tránsito se remonta a las llamadas Ferias de Portobelo, evento de intercambio comercial que, según libros de historia, jugó un papel importante para el trasiego del oro hacia España desde el Nuevo Mundo.

En virtud de esta localización geográfica única de Panamá, le ha permitido crear todo un centro de trasbordo de pasajeros para el continente americano desde el Aeropuerto Internacional de Tocumen, siendo uno de los pocos en la región con dos pistas de aterrizaje disponibles.

CONECTIVIDAD AÉREA DE PANAMÁ Panamá es el segundo país más competitivo de América Latina, según el Foro Económico Mundialy el país latinoamericano con mayor crecimiento económico. El país está catalogado en términos absolutos, es decir, sin tener en cuenta la distribución de la riqueza, como de ingresos económicos mediano-altos.

El avance de la economía panameña ha hecho que el Fondo Monetario Internacional (FMI) anunciará que según sus proyecciones oficiales, y de mantenerse las tendencias actuales, el país se convertiría en la novena economía de América Latina en los próximos 12 años. Actualmente, ocupa la posición 13.

La posición geográfica del istmo de Panamá ha jugado un papel fundamental en su destino de ser la ruta comercial más importante del continente americano a largo de su existencia.

Limita por el Norte con el Mar Caribe, por el Sur con el Océano Pacífico, por el Este con Colombia y por el Oeste con Costa Rica.

Panamá es el eslabón que une América Central y América del Sur. Tiene una extensión territorial de 75.517 km²,

Este Aeropuerto se encuentra en la segunda fase de expansión llamada T2 por un monto de más de B/. 600 millones, la cual deberá culminarse en el segundo semestre de 2017, permitiéndole dar servicio a más de 20 millones de pasajeros anuales.

La fase T2 consiste en la construcción de la estructura de la nueva terminal, puentes de abordaje, sistema de manejo de equipaje, planta de enfriamiento, bulevar de acceso, plataforma de estacionamiento de aeronaves y la nueva torre de control, la que se construirá una vez se defina la ubicación de la tercera pista.

Actualmente, el Aeropuerto Internacional de Tocumen conecta con 83 destinos en 34 países de América y Europa. Cifras oficiales de 2014, fijan que por este aeropuerto se movilizaron 8.536.342 pasajeros para un alza en relación con el año anterior de 9,7 % y que de este volumen total, el 48,8 % representó pasajeros en tránsito (4.369.202).

Este segmento creció en 12.2 % en comparación con el año anterior.

Debido a la gran conectividad aérea que tiene el Aeropuerto Internacional de Tocumen tiene un potencial para atraer actividades de distribución de carga aérea. La Terminal de carga aérea de Tocumen es #1 en movimiento de carga en la región centroamericana.

PANAMA’S SEA CONNECTIVITY Thanks to its geographical location and to the presence of the canal – one of the world’s most important commercial routes – Panama is a natural connecting link between north and south both by air and sea.

Panama and connectivity are virtually synonymous. Indeed, for more than a decade, Panama has been at the top of the regional index for shipping connectivity published annually by the United Nations Conference on Trade and Development (UNCTAD).

The canal is only a few months away from the official launch of the third set of locks for neo panamax vessels of 12,000 teu capacity. The ACP decided that the inaugural sail-through should be allocated by public tender as there are many cargo entities interested in being part of this landmark event.

The plan also includes the widening and deepening of navigation channels at Gatun Lake and the sea entrances at the Pacific and the Atlantic, as well as deepening of the Culebra Cut.

The canal expansion includes the building of two new locks, one on the Pacific side and the other on the Atlantic, each with three chambers and three water-saving basins per chamber.

The new locks will allow the transit of ships with a length of 366 meters, a breadth of 49 meters and a tropical fresh water draft of 15.0 meters.

LOCKS The new locks for neo panamax vessels will use tugs to position and maneuver ships within the chambers, replacing the existing ‘mule’ electric locomotives.

De acuerdo con cifras de la Autoridad del Canal de Panamá (ACP), en el año fiscal 2014 (1 octubre al 30 septiembre) se registraron 11.947 tránsitos por la vía acuática para un total de 325.882.086 toneladas CP SUAB (unidad de medida del Canal de Panamá).

Las principales rutas comerciales que se favorecen de la existencia del Canal de Panamá son: Costa Este de los Estados Unidos-Asia; Costa Este de los Estados Unidos–Costa Oeste de Suramérica; Europa-Costa Oeste de Suramérica; Costa Este de los Estados UnidosCentroamérica.

La ampliación del Canal permitirá a la vía recuperar su protagonismo frente a otras rutas y a tipos de carga que no se podían atender con el servicio actual.

El Canal de Panamá se encuentra a escasos meses de inaugurar oficialmente el tercer juego de esclusas para barcos neo panamax (buques de 12.000 teus de capacidad). La entidad canalera decidió que el primer tránsito inaugural será sometido a subasta pública, y muchos segmentos de carga están interesados en ser parte de esta historia.

La ampliación del Canal de Panamá consiste en la construcción de dos complejos de esclusas de tres niveles cada una con tres tinas de reutilización de agua por nivel, una en el lado Pacífico y otra en el lado Atlántico.

Este programa conlleva también el ensanche y profundización de los cauces de navegación existentes del Lago Gatún y de las entradas del mar del Pacífico y del Atlántico, así como la profundización del Corte Culebra.

En las nuevas esclusas para barcos neo panamax se usará remolcador para el posicionamiento y maniobra de buques dentro de las cámaras en reemplazo de las locomotoras, que tienen más de un siglo de existencia.

Las dimensiones de los barcos que podrán navegar las nuevas esclusas serán 366 metros de eslora, manga de 49 metros y un calado de 15 metros en agua dulce tropical.

BEST PORT SYSTEM IN LATIN AMERICA Panama has the world’s fifth-best port infrastructure, according to the World Economic Forum. There are five world-class container terminals in Panama – two on the Pacific coast and three on the AtlanticColon coast – operated by leading companies.

The 2014 ranking by container volumes prepared by the Economic Commission for Latin America and the Caribbean (ECLAC) for the 20 leading ports in the Latin American region showed that the top two positions were held by the port

systems of Balboa on the Pacific, with a throughput of 3,468,283 teu, and the Colon ports on the Atlantic, with 3,286,736 teu moved.

RANKING Each year, ECLAC prepares a ranking that shows in detail the container cargo movements of 120 ports in the region, based on information compiled directly by port authorities and sea terminal operators.

In addition, PSA Panama will install eight new cranes with an outreach of 24 rows and 12 rail mounted gantry cranes.

The Balboa container terminal has 47 hectares dedicated to storage of

containers and five berths for containerships. Balboa has 25 gantry cranes for handling panamax, post panamax and super post panamax ships, and 83 rubber tired gantry cranes.

EXPANSION An expansion program was completed recently at this terminal, increasing its storage capacity to over 78,000 teu.

Balboa has 3,468 reefer plugs, more than any other in Panama.

En la entrada Pacífica del Canal de Panamá se localizan los puertos de Balboa, operados por Panama Ports Company, miembro del Grupo Hutchison Port Holding, y PSA International Inc. de Singapur.

Este último arrancó una inversión de $400 millones que consiste en la instalación de 800 metros lineales de muelle, dos muelles simultáneos para megabuques y la expansión de su patio de contenedores a 2 millones de teu.

Adicionalmente, PSA Panamá instalará ocho nuevas grúas de 24 líneas de extensión y 12 grúas de patio montadas en riel.

En tanto, la terminal de contenedores de Balboa tiene un total de 47 hectáreas dedicadas al almacenamiento de contenedores y 5 muelles para barcos portacontenedores. Balboa opera con 25 grúas pórtico de tipo panamax, postpanamax y súper-post-panamax, y 83 RTGs (grúas pórtico sobre neumáticos).

Esta terminal culminó recientemente sus trabajos de expansión, aumentando el espacio de almacenamiento para contenedores a más de 78 mil teu.

COLON PORTS On the Atlantic side, the Port of Manzanillo, operated by SSA Marine (a subsidiary of Carrix), received four new super post panamax gantry cranes, said to be the largest of their kind in the region in capacity terms.

With the addition of this new equipment, Manzanillo International Terminal (MIT) will have a total 11 post panamax cranes and eight super post panamax cranes, serving containerships along 2,000 meters of quay.

It is worth mentioning that in 2015 the Manzanillo port introduced the first automatic stacking cranes to be owned by a Latin American port.

CRISTOBAL Panama Ports Company also has a port on the Atlantic side. The Port of Cristobal has 13 quay gantry cranes, of which four are panamax and the rest are post panamax. There are 1,360 reefer plugs.

Another terminal in the Colon port complex is the Colon Container Terminal, owned by Taiwan’s Ever-

green Group. The terminal has five panamax gantry cranes (14 rows), five post panamax gantry cranes (18 rows), 30 RTG/yard cranes (six plus one) and 984 reefer plugs.

This transshipment capability on both the Pacific and Atlantic coasts is what has allowed Panama to continue being the leader in Latin America for container movements.

A unique aspect of the Panama port system is the coast-to-coast railway, running parallel to the canal and originally opened in 1855. Operated by the Panama Canal Railway Company on a 50-year concession from the state, it carries about 7.9 million tons or 700,000 teu of cargo each year.

Double-stack rail cars are used to haul containers on the 76 km single-track line. The company operates on the basis of seven formations of 11 trains each, running continuously like a production line.

Con estos nuevos equipos, el puerto de MIT contará con 11 grúas postpanamax y 8 grúas súper-post-panamax que prestarán servicio en los 2.000 metros de muelle de MIT para barcos portacontenedores.

Cabe mencionar que durante el 2015, el puerto de Manzanillo puso en funcionamiento las primeras Grúas Automáticas de Patio en un puerto de América Latina.

También Panama Ports Company (PPC) cuenta con un puerto en el Atlántico panameño llamado Cristóbal. Este puerto tiene 13 grúas pórtico de muelle, de los cuales 4 son panamax y el resto post-panamax. Cuenta con 1360 plugs (conexiones para refrigerados).

Otra de las terminales del complejo portuario de Colón es Colón Container Terminal (CCT), brazo portuario de la compañía taiwanesa Evergreen.

El puerto cuenta con 5 grúas pórtico panamax (14 filas), 5 grúas pórtico post – panamax (18 filas), 30 RTG/grúas de patio (6+1) y 984 conectores para contenedores refrigerados.

Esta es la oferta portuaria de trasbordo tanto del Pacífico como del Atlántico panameño que le ha permitido al país mantenerse líder por años en América Latina en movimientos de contenedores.

La oferta portuaria panameña tiene un componente único en América Latina, y es el servicio ferroviario de costa a costa. La empresa Panama Canal Railway Company (PCRC) tiene una concesión con el Estado por 50 años y esta vía moviliza aproximadamente 7,9 millones de toneladas o 700 mil teu. Su longitud es de 76 km de una sola vía y hace el transporte de contenedores en vagones de doble altura. Disponen de 7 formaciones de 11 trenes cada una que funcionan en continuo como una línea de producción.

CRUISE PORT As well as handling containers and general cargo and providing fuel terminals, the Port of Colon has a dedicated cruise terminal.

According to the 2014 figures (January to December) the port received 236 cruise ship calls with 408,833 passengers.

The Republic of Panama offers the cruise industry the unique attraction of the canal; but in addition to this world wonder it offers such places of interest as Portobelo and the Gatun Lake, while the City of Panama has a range of visitor attractions including the Biodiversity Museum, exclusive shopping areas and the Casco Viejo (Old City).

MUSEUM The Biodiversity Museum was designed by the Canadian-born architect Frank Gehry and was his first design for Latin America. The museum tells the story of how the Isthmus of Panama came into being, joining two continents, dividing a great ocean and changing the world’s biodiversity for all time.

operators to offer sightseeing tours to Panama City with a journey time of only 45 minutes from Colon.

In the coming months the city of Colon will be able to offer a new incentive with the introduction of a Special Free Port System that is intended to give the area a commercial boost and represents the fulfillment of a promise made by the current government.

TAX FREE This system will allow both tourists and local people to enjoy tax-free shopping. The initiative includes a commitment to hire Colon labor. A percentage of the workers must be Colon people if investors wish to claim the incentives.

Tax exemptions will include no import duties or tariffs. Investment will be sought through incentives similar to the fiscal benefits scheme in Panama’s Old City, with incentives for the financing of loans, incentives to landlords and building owners, incentives to merchants and parking lots.

Meanwhile, both Panama and the islands of Aruba and Curaçao (part

of the Kingdom of the Netherlands) will encourage the development of the new South Caribbean cruise route and will promote the city of Colon and the islands of Aruba and Curaçao as tourist destinations. To that end, the relevant tourism authorities will coordinate actions and market this new tourist route to the major cruise shipping companies.

Pero otro de los atractivos que tendrá la ciudad de Colón en los próximos meses será la implementación del Sistema Especial de Puerto Libre, que traerá un mayor dinamismo a esta zona y que fue un compromiso del actual gobierno.

Pero Colón no solo tiene puertos de contenedores, carga general y terminales de combustibles, sino también cuenta con una terminal especializada para atender barcos de pasajeros (cruceros). De acuerdo con cifras de 2014 (enerodiciembre) hubo un arribo de 236 cruceros y 408.833 pasajeros.

REACTIVATION OF STATE-OWNED PORTS The current management of the Panama Maritime Authority (AMP) has been reactivating and developing the main stateowned ports throughout the country.

Inc, will prepare a feasibility study for the launching of the business model, identifying and analyzing the potential market and determining the volumes to attract investors to Puerto Armuelles.

Among them is Puerto Armuelles, in the Barú district of Chiriquí Province.

As a starting point, the AMP signed a Non Reimbursable Technical Cooperation Agreement with the CAF Latin American Development Bank, which will provide support by hiring a consultancy service to “structure a viable business model for Puerto Armuelles”. The firm in charge of the consultancy, Nathan Associates

One of the aspects to be included in the study is the possibility of connecting Puerto Armuelles with a supplementary port on the Atlantic coast. This would benefit the provinces of Chiriquí and Bocas del Toro, where a center for perishable goods could be established to promote trade in the region.

CONSULTANCY Likewise, AMP convinced CAF to hire a consultancy for the “structuring of a viable business model to promote private investment for the development of the Vacamonte Port” with a view to determining business opportunities, possible customers and operators and viable activities consistent with fishing activities at this Pacific port.

The AMP initiated tender proceedings for the multipurpose terminal of the Port of Aguadulce in Cocle Province.

This multipurpose port includes

a containerized cargo area, a fuel storage area, grain silos and facilities for other types of cargo.

The tender will contemplate a 20-year concession, with a three-year deadline to complete the first stage of the works.

The land to be tendered covers 26 hectares of the current facilities at the Port of Aguadulce. The Authority has excluded from it a three hectare reserve of mangrove forest within the port area proper as part of its environmental responsibility.

REACTIVACIÓN DE PUERTOS ESTATALES La actual administración de la Autoridad Marítima de Panamá (AMP) ha emprendido la política de reactivar y desarrollar los principales puertos estatales ubicados a lo largo y ancho del país.

Entre ellos se encuentra Puerto Armuelles, localizado en la provincia de Chiriquí, distrito de Barú. Como paso inicial, la AMP suscribió un Acuerdo de Cooperación Técnica No Reembolsable con el Banco de Desarrollo de América Latina (CAF) el cual apoyará con la contratación de una consultoría para la “estructuración de un modelo de negocios viable para Puerto Armuelles”.

La consultoría está a cargo de Nathan Associates Inc, que debe elaborar un estudio de factibilidad para la puesta en marcha del modelo de negocio, la identificación y análisis del mercado potencial, y la determinación de volúmenes para la atracción de inversionistas en Puerto Armuelles.

Dicho estudio debe explorar, entre otras, la posibilidad de conectar el puerto de Puerto Armuelles con un puerto complementario en el Atlántico.

Esto beneficiaría a las provincias de Chiriquí y Bocas del Toro, donde podría establecerse un centro de productos perecederos, promoviendo un intercambio comercial en la región.

Asimismo, la AMP logró que el CAF contratara una consultoría para la “Estructuración de un modelo de negocio

viable para la promoción de la inversión privada en el desarrollo del Puerto de Vacamonte”, a fin de determinar las oportunidades de negocio, los posibles clientes y operadores y las actividades viables, en consonancia con la actividad pesquera que actualmente desarrolla en este puerto del Pacífico.

La AMP inició el proceso de licitación para la terminal multipropósito del Puerto Aguadulce, provincia de Coclé.

Esta terminal multipropósito incluye un segmento para carga contenerizada, un área para el almacenamiento de combustible, silos de almacenamiento para granos, así como otro tipo de mercancías.

El tiempo estipulado de la concesión incluida en la licitación es de 20 años, contemplando un término de 3 años para la culminación de la primera fase de la obra.

El área de terreno que se va a licitar comprende 26 hectáreas de las actuales instalaciones del Puerto Aguadulce. La entidad ha excluido un área de reserva de 3 hectáreas de manglares que se encuentran dentro del recinto portuario como parte de su responsabilidad ambiental.

ancillary maritime industries in the Pacific area of the country, specifically at the location of the old ferry, next to the Bridge of the Americas and in the Balboa area.

Nevertheless, companies providing services on the Pacific coast of Panama had been asking to be granted a quay area by several of the former managements.

The Authority will develop this quay under a public-private agreement. The old concession, which was never developed, covered 9.5 hectares and had been intended to address the needs of the ancillary maritime industry.

TERMINALES DE COMBUSTIBLES Panamá es una de las rutas de comercio obligada, generando que su conglomerado marítimo se desarrolle para ofrecer todo tipo de servicios a las miles de naves que anualmente pasan por esta vía.

BUNKERING Panama is one of the world’s most traversed commercial routes, and this drives the development of its maritime complex to offer all kinds of services to the thousands of ships transiting the canal each year.

The Panama Maritime Authority (APM) has fostered the growth of this sector by granting several concessions for the development of maritime and port facilities contributing to an expanded capacity for storage and distribution of bunker fuels.

One of these business activities is bunkering, and major companies have invested millions to offer first-class fuel storage facilities.

AMP figures for 2014 show that 20,970,418.30 net barrels of bunker fuel were sold on both coasts of which 19,501,326.8 net barrels were fuel oil.

La Autoridad Marítima de Panamá ha facilitado este crecimiento de la actividad otorgando concesiones para el desarrollo de instalaciones marítimas portuarias que contribuyen al aumento de la capacidad de almacenamiento y distribución del combustible marino.

Operating in a tax-free zone, this terminal has a storage capacity of 2.1 million barrels of heavy fuel oil and diesel.

The other terminal is Decal, on Taboguilla Island, at the entrance to the canal. It has 26 storage tanks and a capacity of 356,500 cubic meters and is able to handle four to five barges per day.

The terminal at Bahía Las Minas, operated by Vopak, shall have nine storage tanks for gasoil and maritime fuel oil, as well as for clean petroleum products, with an added capacity of 376,000 cubic meters. The Bahía Las Minas terminal is strategically located 10 km from the canal entrance and is one of the leading centers for regional distribution of petroleum products.

PETROAMÉRICA Also on the Pacific coast is the PATSA Petroamérica Terminal, with a storage capacity of 1.1 million barrels. It has two quays with 39.0 ft (11.8 meters) depth. The terminal is increasing its capacity by providing 350,000 barrels of jet fuel storage for Tocumen International Airport and taking charge of a new dock for the

Another new facility is the Telfers Terminal, in the Port of Cristóbal, with a storage capacity of 1.2 million barrels and 400 meters of quay.

Terminal con capacidad de almacenar 2.100.000 barriles de HFO y DIESEL La otra terminal es Decal, ubicada en Isla Taboguilla, en la entrada del Canal de Panamá, que tiene una capacidad de 356.500 metros cúbicos y 26 tanques de almacenamiento con capacidad para manejar entre 4-5 barcazas por día.

También en el Pacífico se localiza PATSA-Petroamérica Terminal con una capacidad de almacenamiento de 1,1 millones de barriles. Cuenta con dos muelles con 39 pies de calado.

Actualmente incrementa su capacidad de almacenamiento de combustible en 350.000 barriles de jet fuel, combustible de aviación para uso en el Aeropuertode Tocumen y para hacerse cargo de un nuevo muelle para la industria marítima auxiliar (operadores logísticos y el Canal de Panamá).

En el lado Atlántico, se ubican otras terminales especializadas de combustible como son: Oiltanking Colon, S.A., localizado estratégicamente entre dos grandes terminales de contenedores como CCT y MIT. Tiene una capacidad de almacenamiento de 300.000 bbl.

La terminal de Bahía Las Minas, operada por Vopak, contará con nueve tanques de almacenamiento de gasóleo y fuelóleo marítimos, así como productos limpios de petróleo y con una capacidad agregada de 376.000 m3. La terminal de Bahía Las Minas tiene una ubicación estratégica al encontrarse a diez kilómetros de la entrada del Canal de Panamá y es uno de los centros de referencia para la distribución regional de hidrocarburos.

Otras de las nuevas incorporaciones es la Terminal de Telfers, ubicada en el puerto de Cristóbal, tiene una capacidad de almacenamiento de 1,2 millones de barriles y 400 metros de muelle.

MODERNIZACIÓN DE REGISTRO PÚBLICO DE NAVES Con el fin de mantener la competitividad de nuestro registro de naves, el cual es número uno a nivel mundial, se realizaron modificaciones a la Ley 55 del 6 de agosto de 2008 a través de la Ley 27 del 28 de octubre de 2014.

The Panama Ship Registry is currently the leader in ship registration, with over 9,000 vessels registered, of which 8,122 belong to the international merchant marine.

BENEFITS The new law allows the registration of ship titles and mortgages written in English, accompanied by the relevant excerpt in Spanish. Recording a Mortgage Excerpt benefits the user because it saves time, since the user only needs to translate the Mortgage Excerpt and not the whole contract.

In order to maintain the competitiveness of its Ship Registry, renowned as number one of its kind in the world, Panama introduced some amendments to Law No 55 of 6 August 2008 by means of Law No 27 of 28 October 2014.

The adoption of this measure entails great advantages for the Registry, allowing banks and creditors to consult the deed text in English on the Registry web page, thus ensuring reliability, security and immediacy.

La mencionada ley permite el registro de los títulos e hipotecas de naves en idioma inglés con su respectivo extracto en idioma español. La inscripción de un Extracto de Hipoteca tiene la bondad que le ahorra tiempo al usuario puesto que solo debe traducir el extracto de la hipoteca y no el contrato completo.

Esta acción representa un sustancial ahorro no solo en costos, sino también en tiempo de tramitación y respuesta para los clientes del registro de naves de Panamá. Con esta herramienta el usuario puede tener garantizada la inscripción rápida de su documento y le da a la bandera panameña la oportunidad de competir con otros registros.

La adopción de esta medida implica grandes ventajas para el registro, toda vez que los bancos y acreedores tienen la posibilidad de consultar inmediatamente la escritura en idioma inglés en la página web de dicha institución, generando confianza, seguridad e inmediatez.

MODERNIZATION OF PANAMA SHIP REGISTRY Panama is the world’s leader in ship registration, both in tonnage terms and in the number of ships; but in order to maintain that leadership, the Panama Maritime Authority (AMP) has undertaken a series of actions to enhance its competitiveness in the registration of ships.

In the near future – by the end of 2016 – the Panama Ship Registry expects to register some 185 vessels. The main classes of vessel expected to be registered are tankers (35 per cent), dry bulk/passenger ships (34 per cent),

bulk carriers (25 per cent), offshore industry vessels (five per cent), and fishing and miscellaneous vessels (one per cent).

As the organization responsible for managing the Ship Registry, the AMP intends to make inroads into emerging markets such as gas carriers, since traditionally the Panama flag has been known for its large number of bulk carriers.

Nueva solicitud de licencia reglamentaria de estación de radio (visión cliente): Con esta nueva solicitud el usuario que tramita, ya no tendrá que aportar tanta información al solicitar la licencia; por otro lado, el tiempo de verificación y visto bueno se reducirá de forma considerable.

Plataforma electrónica para la aplicación, revisión y emisión de certificados técnicos electrónicos (Cultura Paperless): Actualmente, se encuentra en construcción un prototipo en plataforma web para la emisión de certificados técnicos del registro mercante. Los beneficios a corto plazo, una vez que inicie su operación este sistema, es la facilidad de emisión de certificados en horario 24/7 y en cualquier lugar del mundo.

Once it is launched, this system will allow certificates to be issued on a round-the-clock basis, anywhere in the world. In addition, there is expected to be a validation system for documents issued.

- Website grouping by subject of merchant marine circular letters: The AMP is working to organize and group all circular letters issued by the Authority by specific subject. This system is expected to achieve a reduction in search time for users.

PROCESS On 2 January 2015 the AMP implemented the process of automated discount for the registration of new-build vessels. The advantage of this new process is that the two independent processes that were previously required, discount and registration, have been integrated into a single four-hour process that is fully transparent to the user.

This new facility provides the user with transparent, actual and immediate information, since the system requires the input of data such as the vessel’s age, gross tonnage and place of construction in order to determine the discount percentages to which it is entitled, which may even reach a full 100 per cent, such as provided by Law No 57 of 6 August 2008 General Merchant Marine Act and the Resolution of Additional Exemptions No 106-65-DGMM of 17 September 2014.

There is no longer any need to submit a discount application memorandum.

The resolution is now issued automatically by the system; the Director’s signature is digital (paperless policy); and the registration of new-build vessels is completed in about three hours, provided the legal requirements are met.

El pasado 2 de enero se implementó el proceso de abanderamiento de naves de nueva construcción con descuento automatizado. El valor agregado de este nuevo proceso es que antes se trataba de dos procesos independientes, en tanto que hoy es uno solo con un tiempo promedio de 4 horas, en el cual se logró unificar estas 2 fases (descuento y abanderamiento), realizándolo de forma transparente para el usuario.

Esta novedosa función brinda al usuario una información transparente, real e inmediata, toda vez que al ingresarse los datos del abanderamiento, el sistema utiliza elementos como edad de la nave, tonelaje bruto y lugar de construcción para determinar los porcentajes de descuentos que por derecho le corresponden a la embarcación; los cuales pueden ascender hasta un 100%, tal y como lo señala la Ley No. 57 de 6 de agosto de 2008 “General de Marina Mercante” y la Resolución de Dispensas Adicionales No. 106-65-DGMM del 17 de septiembre de 2014.

Se eliminó la necesidad de presentar memorial de solicitud de descuento ya que ahora la resolución la emite automáticamente el sistema; la firma del Director es digital (paperless), y el abanderamiento de naves de nueva construcción se culmina en aproximadamente en 3 horas, siempre que cumplan con los requisitos de ley.

REGISTRATION OF CONTAINERS Upon the enactment of Law No 27 of 28 October 2014, container owners shall be able to register the relevant contracts of sale, renting, financial leasing, mortgage or any such other containerrelated matters at the General Directorate of Vessels’ Titles and Encumbrances. This provides users with legal certainty regarding their ownership title.

INSCRIPCIÓN DE CONTENEDORES Con la promulgación de la Ley 27 del 28 de octubre de 2014, los propietarios de dichos contenedores podrán inscribir los respectivos contratos de compraventa, arrendamiento financiero o leasing, hipoteca o cualquier otro gravamen que se constituya sobre estos en la Dirección General de Registro Público de Propiedad de Naves, y de esta forma contar con la seguridad jurídica de su propiedad.

NAVAL FINANCE ACT The Panama Maritime Authority (AMP) favors the creation of a Promotion of Naval Finance Act, benefitting from the Panama banking system, the largest in Latin America, and the advantages of a world-class maritime system.

Panama, with its solid banking center, is a leader in ship registration. It has a modern, reliable and trustworthy maritime mortgage system and a reliable and secure ship registration system. Nevertheless, an essential component is needed to achieve the AMP’s objective: giving fiscal incentives to compensate for the market’s low interest rates.

Among the benefits contemplated by this Bill are full exemption from income tax on any financing originating in the Republic of Panama, something that will favor the creation of well-paid jobs, the attraction of capital and the eventual establishment of shipyards for building new ships.

According to 2014 figures, the Panama banking sector boosted gross domestic product by 7.5 per cent.

LEY DE FINANCIAMIENTO NAVAL La Autoridad Marítima de Panamá (AMP) impulsa la creación de una Ley de Promoción al Financiamiento Naval, aprovechando el sistema bancario panameño, el más grande de América Latina, y las ventajas de un sistema marítimo de primer mundo.

Panamá cuenta con un centro bancario robusto, es líder en abanderamiento de naves, y tiene un sistema de hipoteca naval moderna, ágil y confiable, al igual que un sistema de registro de naves confiable y seguro. Sin embargo, requiere de un elemento necesario para lograr ese objetivo: incentivos fiscales que compensen las bajas tasas de mercado.

Entre los beneficios que contempla este proyecto de ley se encuentra el cero pago del impuesto de la renta a los financiamientos que se produzcan desde la República de Panamá, lo que repercutirá positivamente en la generación de empleos bien remunerados, la atracción de capitales

NEW TECHNICAL OFFICES In order to assist its clients from all over the world and different time zones, the Panama Maritime Authority (AMP) decided to set up new technical offices in emerging markets.

The Authority opened new regional technical offices, under the name of Segumar, in Istanbul, Turkey, and Imabari, Japan. The latter is particularly important because the head offices of Japan’s major shipbuilders are also located there.

The Istanbul office has been favorably received by users, since major shipyards are also present in that city.

In addition, with the purpose of strengthening the Registry’s presence in the United States, the AMP intends to open over the next few months a Segumar office in Los Angeles, California. As a result, the Registry would have 10 Segumar offices spread around the world. In addition to those mentioned above, the Registry currently has technical offices in Panama City, New York, Piraeus (Greece), Seoul and Busan (South Korea), Tokyo and Singapore.

Initiatives such as this have allowed the Panama Registry to be present at the same time and in the same place as its international customers, thus helping to strengthen its commercial ties with them.

The range of services performed by these offices include technical and nautical advisory services; emergency assistance; issuing of technical certificates (International Tonnage Certificate, Exemption Certificate, etc).

NUEVAS OFICINAS TÉCNICAS Como respuesta a nuestros clientes en todas partes del mundo y con distintos husos horarios, esta Administración tomó la decisión de poner en marcha nuevas oficinas técnicas en mercados emergentes.

Es por eso que se abrieron nuevas oficinas regionales técnicas, llamadas SEGUMAR, en Estambul, Turquía, y en Imabari, Japón, siendo este último resaltado por la presencia de las oficinas centrales de los armadores japoneses más importantes.

La oficina en Estambul, Turquía, ha tenido buena acogida entre los usuarios debido a la presencia en aquella ciudad de importantes astilleros.

Adicionalmente, con el propósito de robustecer la presencia del Registro en las costas estadounidenses, se estima que en los próximos meses la AMP estará abriendo una oficina de SEGUMAR en Los Ángeles, California. Así, ya serían 10 oficinas de SEGUMAR alrededor del mundo, pues además de las ya mencionadas, actualmente el Registro cuenta con oficinas técnicas en Panamá (Panamá), Nueva York (EE.UU.), Pireo (Grecia), Seúl (Corea del Sur), Busan (Corea del Sur), Tokio (Japón), Singapur (Singapur).

Definitivamente, este tipo de iniciativas le ha permitido al Registro panameño tener presencia en el mismo tiempo y espacio que sus clientes internacionales; permitiéndole estrechar de este modo sus lazos comerciales.

Los servicios que se ofrecen son: consultoría técnico-náutica, asistencia en caso de emergencia, emisión de certificados técnicos (International Tonnage Certificate, Exemption Certificate,etc), autorizaciones, entre otros.

PARIS AND TOKYO MOU WHITE LISTS

LISTAS BLANCAS DE PARIS MOU Y TOKIO MOU La AMP, como entidad regente del registro panameño, trabaja para que Panamá se mantenga dentro de las listas blancas de los Memorandos de Entendimiento (MOU) más importantes, como los MOU de París y de Tokio.

En el caso del MOU de París, su misión es eliminar la explotación de buques de calidad inferior a través de un sistema armonizado de Control del Estado del Puerto.

Según datos del Paris MOU on Port State Control, emitidos en Junio 2015, el Registro panameño, luego de haber sido objeto de 6.098 inspecciones a sus buques, se mantiene en la lista blanca.

As the managing organization, the Panama Maritime Authority (AMP) works to keep the Panama Registry on the white lists of the major Memorandums of Understanding such as the Paris MoU and Tokyo MoU. The Paris MoU has a mission to eliminate the operation of inferior-quality ships by means of a harmonized Port State Control (PSC) system. According to the Paris MoU data of June 2015 on PSC, the Panama Registry, after having undergone 6,098 vessel inspections, remains on the white list.

The main objective of the Tokyo MoU is to set up an efficient PSC system

for the Asia-Pacific region by enlisting the cooperation of its members and harmonizing their activities, in order to eliminate any deficient ships. Here, too, Panama continues to be included in the Tokyo MoU white list.

ACCOMPLISHMENT A major accomplishment by the current APM management was to get Panama accepted in the capacity of Cooperating State under the Tokyo MoU as of October 2015. The Tokyo MoU is made up of 19 authorities of several countries and entities, plus five authorities as observers.

El cuanto al MOU de Tokio, su principal objetivo es establecer un régimen eficaz de Control del Estado del Puerto en la región de Asia y el Pacífico a través de la cooperación de sus miembros y la armonización de sus actividades, para eliminar los buques deficientes. Donde de igual forma, Panamá a la fecha se mantiene en la lista blanca.

La actual administración de la Autoridad Marítima de Panamá logró incorporar a Panamá como Estado Cooperante en el MOU de Tokio a partir del mes de octubre de 2015, siendo este un logro importante. El Tokyo MOU está conformado por 19 autoridades de diversos países y organizaciones, más 5 autoridades en calidad de observadores.

AUDIT BY RECOGNIZED ORGANIZATIONS AUDITORÍA POR ORGANIZACIONES RECONOCIDAS The Panama Registry has entrusted the inspection of its ships to 31 private organizations, known as Recognized Organizations (ROs), in charge of inspecting and issuing statutory certificates on behalf of the Republic of Panama.

The International Maritime Organization (IMO) requires that, whenever

registries adopt such systems, the flag state should have in place a system to make sure that such entities certify the required safety standards for seafaring, navigation and protection of the marine environment.

The last audit performed by the AMP took place in 2008, but the current management has initiated a new one that is 33 per cent complete.

El registro panameño ha delegado la labor de inspección de sus buques a 31 entidades privadas, conocidas como Organizaciones Reconocidas (OR), las cuales se encargan de inspeccionar y emitir certificados estatutarios en nombre de la República de Panamá.

La organización Marítima Internacional (OMI) exige que siempre que se den este tipo de esquemas en los registros, se creen medidas para que el Estado de Pabellón se cerciore de que dichas entidades estén cumpliendo con los estándares de seguridad de la vida humana en el mar, seguridad de

la navegación y protección del medio ambiente marino.

El último proceso de auditoría que había realizado la AMP tuvo lugar en 2008, pero la actual Administración inició nuevamente este proceso, el cual tiene un avance de 33%.

USER CONFIDENCE IN PANAMA REGISTRY According to international projections, the Panama Registry will continue to grow, as evidenced by the recent addition to the Panamanian flag of a number of containerships belonging to the world’s secondlargest shipping company, the Mediterranean Shipping Company (MSC).

The world’s largest containership, the ‘MSC Oscar’, sails under the Panamanian flag. This 394 meter long vessel

has a capacity of 19,224 teu and is said to be the world’s most efficient vessel.

ADDITION Another addition to the Registry is the ‘MSC Oliver’, built by Daewoo Shipbuilding & Marine Engineering in South Korea. This vessel is 380.84 meters long and 59 meters wide, with a capacity of 19,223 teu.

CONFIANZA DE LOS USUARIOS HACIA EL REGISTRO PANAMEÑO Las proyecciones internacionales indican que el registro de naves seguirá creciendo en los próximos años, y prueba de ello es que recientemente se incorporaron a la bandera una serie de buques portacontenedores de la segunda naviera más grande del mundo, Mediterranean Shipping Company (MSC).

El mayor buque portacontenedor a nivel mundial, el MSC Oscar, enarbola la bandera panameña. Este barco de 394 metros de eslora tiene una capacidad de carga de alrededor de 19.224 teu. La MSC OSCAR es actualmente la nave más eficiente del planeta.

ASSESSMENT OF SEAFARER COMPETENCE The management of the AMP’s Seafarers Division decided to abandon the competence assessments used by the former management and replace them with an endorsement and recommendation system, which recognizes the titles issued by other maritime authorities.

This is an executive decision, included within the maritime authorities’ duties.

The endorsement/recommendation formality costs US$ 500. Each of the assessments and endorsements has a different underlying rationale.

to certain nationalities, such as in the case of Greece, where an officer over the age of 60 finds it difficult to obtain a license in his own country because of its restrictive laws.

ASSESSMENT Despite this, through a competence assessment, Greek officers are able to obtain a Panamanian title.

Currently this AMP division has six applications from international training centers awaiting recognition.

La Dirección de Gente de Mar de la AMP decidió eliminar las evaluaciones por competencia aplicadas en la administración pasada, reemplazándolas por el mecanismo de endoso y refrendo, que consiste en reconocer los títulos expedidos por otras administraciones marítimas.

Esta acción le compete a las administraciones porque forma parte de las obligaciones de las autoridades marítimas.

Los endosos/refrendos tienen un costo de $500 por el trámite. Los “assessment” tienen un propósito distinto del de los refrendos. Inicialmente existían los “assessment” para ciertas nacionalidades, como es el caso de Grecia, donde un oficial después de los 60 años tiene problema para adquirir licencias en su propio país porque tiene una legislación que lo limita.

Es así que, a través de una evaluación de competencia o assessment, pueden obtener un título panameño. Los “assessment” nacen para nacionalidades restringidas.

Actualmente hay seis trámites de Centro de Formación a nivel internacional que han solicitado que esta dependencia de la AMP les otorgue el reconocimiento.

PANAMA: COMMITTED TO COMPLIANCE WITH INTERNATIONAL REGULATIONS Committed to comply with international maritime regulations and aiming to strengthen the nation’s position, Panama’s National Assembly ratified the Nairobi International Convention on the Removal of Wrecks by passing Law No 26 of 4 May 2015.

This Convention seeks to establish a legal framework to address everything from the definition of a wreck and a shipowner’s liability for expenses associated with locating, marking and removing wrecks, to a shipowner’s obligation to take out insurance or other financial security covering its liabilities under the Convention. In this respect, the Nairobi International Convention requires this financial obligation from owners of ships with a registered tonnage of 300 gross tons or more.

GUARANTY According to the Convention, the affected states reserve the right to remove any wrecked ship and issue a government guaranty to shipowners and captains of other countries, since it imposes on the latter a financial liability for the removal of hazardous

wrecks. This provides, therefore, a legal instrument for recovery of expenses, because it authorizes the removal of wrecks by an affected state for a shipowner’s account.

The Nairobi International Convention on the Removal of Wrecks was approved on 18 May 2007 by the International Conference on the Removal of Wrecks organized by the IMO in the Kenyan capital.

PANAMÁ: COMPROMETIDO A CUMPLIR NORMAS INTERNACIONALES Con el compromiso de dar cumplimiento a las legislaciones internacionales en materia marítima, y para seguir fortaleciendo nuestra posición como potencia mundial, la Asamblea Nacional ratificó el Convenio Internacional de Nairobi sobre la remoción de restos de naufragio, aprobando la Ley N°26 del 4 de mayo de 2015.

Este convenio busca instaurar un régimen legal dentro del cual se detalla desde la definición de naufragio hasta la responsabilidad del armador respecto a los gastos de localizar, balizar y retirar los restos de embarcaciones, pasando por las obligaciones de los armadores de poseer un seguro u otra garantía financiera que cubra las responsabilidades que exige este tratado. A este respecto, el Convenio Internacional de Nairobi exige esta medida financiera a los propietarios de naves cuyo arqueo bruto de registro sea igual o superior a 300 GT. De conformidad con este acuerdo, los países se reservan el derecho a remover cualquiera embarcación que haya naufragado, estableciéndose una garantía estatal frente a los armadores y capitanes de otros países, toda vez que impone a los mismos una responsabilidad financiera para la retirada de restos peligrosos de naufragios, convirtiéndose en una vía jurídica para asegurar el cobro de los gastos, al legitimar la remoción de restos realizada por un estado a costa del armador.

El Convenio Internacional de Nairobi sobre la remoción de restos de naufragio fue aprobado el 18 de mayo de 2007 por la Conferencia Internacional sobre la Eliminación de restos de naufragio convocada por la OMI, en Nairobi.

LOGISTICS IN PANAMA

Panamá es un país cuya vocación de servicio es su principal eje y su economía gira en torno al conglomerado marítimo cuyo motor es el Canal de Panamá.

Panama is a country with a fine reputation for support services and its economy revolves around the maritime cluster promoted by the canal.

In the 2014 Index, Panama’s overall ranking was 3.19 compared with 2.93 in 2012. In terms of the infrastructure variable, Panama scored higher than Chile.

In 2014 Panama was placed 45th out of 160 in the World Bank’s Global Logistics Performance Index (LPI) and was ranked second in Latin America after Chile.

The general score obtained by each country in the LPI reflects the perceptions about a country’s logistics, judging it by the efficiency of its customs clearing process; the quality

The scores for these variables are averaged for each of the countries under survey and brought together in a single score, arrived at by analyzing the main components.

CLUSTER The maritime cluster includes services relating to cargoes and ships, all regulated by the Panama Maritime Authority (AMP). The Panama ports move on average over 6.5 million teu per year. It is expected that the

expanded canal, which should be in operation within the first four months of 2016, will lead to the setting up of a Value Added Logistics Services (VALS) hub, leaving behind the transshipmentbased model.

From an operational perspective, the cargo logistics system in Panama is made up of four market sectors: international, foreign trade, redistribution (including domestic supply) and the national production chains. The main structural hubs, from a national perspective, are the north-south line between the Colon and Panama City nodes; and the east-west line from Paso Canoas through David to Panama City.

The main logistics stakeholders are working on a Logistics Master Plan with the support of international financial entities. Panama is the first country to apply the methodology prepared by the Inter-American Development Bank in a paper entitled National Plan for Logistics and Cargo Transportation (PNLog).

In Panama, the available ancillary logistics services prevail over a scant offering of value added services. In this context, some models of value added cargo services have been successfully applied to specific niches such as the pharmaceutical sector and may increase over the next few years.

En promedio, por los puertos panameños se movilizan más de 6,5 millones de teu anuales. Se espera que con la ampliación de la vía acuática, la cual deberá estar en funcionamiento el primer cuatrimestre de 2016, se conforme un centro de Servicios Logísticos de Valor Agregado (SLVA), dejando atrás el modelo de eje de trasbordo.

Desde el punto de vista funcional el sistema logístico de cargas en Panamá está conformado por cuatro segmentos de mercado: internacional, comercio exterior, redistribución (incluyendo el abastecimiento interno) y las cadenas productivas nacionales. Los principales ejes estructura a nivel nacional son el Eje Norte-Sur entre los nodos de Colón y Ciudad de Panamá y el Eje Este-Oeste desde Paso Canoas a David y a Ciudad de Panamá.

Los principales actores de la logística trabajan en un Plan Maestro de Logística con el apoyo de organismos financieros internacionales. Panamá es el primer país en que se inicia la aplicación de la Metodología para la formulación de los Planes Estratégicos Nacionales en Logística de cargas (PNLog), elaborado por el Banco Interamericano de Desarrollo (BID).

En Panamá predomina la oferta de servicios logísticos auxiliares, frente a escasos servicios de Valor Agregado. En este último punto, hay modelos de éxito de servicios de valor agregado a la carga en nichos como el sector farmacéutico, que se pueden incrementar en los próximos años.

LOGISTICS CABINET GABINETE LOGÍSTICO El Gobierno de la República de Panamá ha identificado a la logística como uno de los cuatro pilares de la economía. Por ende, emitió el Decreto Ejecutivo # 881 de 13 de noviembre de 2014 que crea una estructura de naturaleza administrativa y de característica institucional, denominado Gabinete Logístico, el que reúne algunas de las expectativas planteadas en las mesas de trabajo entre el sector público y privado con el apoyo del Banco Interamericano de Desarrollo (BID).

El documento en mención en su artículo 3 define quienes conformarán el Gabinete Logístico, el cual estará presidido por el Ministro de la Presidencia e integrado por el Ministerio de Comercio e Industrias, Economía y Finanzas, Obras Públicas, Relaciones Exteriores, Autoridad del Canal de Panamá, Autoridad Marítima de Panamá, Autoridad de Aeronáutica Civil, Autoridad Nacional de Aduana, Autoridad de Tránsito y Transporte Terrestre, Secretaría de Ciencias y Tecnología y Secretaría del Metro.

The Government of Panama has identified logistics as one of the four pillars of the economy. As a consequence, it has created the Logistics Cabinet, an entity that is administrative in nature and institutional in structure.

The Logistics Cabinet was set up

by Executive Decree No 881 on 13 November 2014 to realize some of the ideas discussed in joint work committees made up of representatives of the public and private sectors, with the support of the Inter-American Development Bank (IDB).

The Logistics Cabinet is presided over by the Presidential Office Minister and includes representatives of the Ministries of Industry and Trade, Economy and Finance, Public Works, External Affairs, the Panama Canal Authority, the Panama Maritime Authority, the Civil Aviation Authority, the Customs National Authority, the Transit and Land Transportation Authority, the Science and Technology Division and the Metro Division.

The decree states that each institution shall be represented by its highest authority or by such highly placed

- Set up ordinary meetings every two months to address matters pertinent to the Logistics Cabinet; and extraordinary meetings when justified by the need to evaluate any key aspects.

CREACIÓN DEL PRIMER INSTITUTO TÉCNICO El Gobierno de la República de Panamá conociendo el potencial de Panamá en sectores económicos claves tiene como norte la educación de su recurso humano en niveles técnicos.

CREATION OF THE FIRST TECHNICAL INSTITUTE Aware of the country’s potential in key economic sectors, the Government of Panama has a core mission to promote the technical education of its human resources.

In this context, the current government announced the setting up of the first Higher Technical Institute of the East (ITSE). This center responds to the need for a strengthening of the higher academic education of young people, with careers and programs adapted to the labor demands of the private sector; and constitutes an effort to transform the model of higher technical education by involving all public-sector stakeholders and agents, business people, universities and civil society.

Through the new ITSE, the authorities seek to attract students who for financial, academic or social reasons are not in a position to attend – or are not interested in attending – college, but need a job to make a living.

This institute will train technical experts in logistics, languages, business, environmental health, hotel industry, electronics and engineering and other careers as they become required according to the labor demand from employers.

This center will revolutionize the country’s traditional technical and professional training system so that Panama is able to confront the challenges posed by its development, the globalized economy and the role that its geographical location and the canal have assigned it in terms of international trade, global development and peace.

COURSES This educational project includes short courses (one or two years) with flexible curricula to meet the demands of the business sector. The institute has been set up in response to state policy, which aims to harmonize education with the labor market, locally and nationally.

The ITSE will offer short courses on which students will be trained in the skills required by today’s industry.

The study programs are based on practical and theoretical courses. The academic curricular studies are divided into 70 per cent practical courses and 30 per cent theoretical.

Students spend the last three to six months of their training working on internships in companies before graduating.

Bajo ese concepto, la actual administración gubernamental anunció la construcción del primer Instituto Técnico Superior del Este (ITSE). Este centro es una respuesta a la necesidad de fortalecer la formación académica superior de los jóvenes, con carreras y programas innovadores a la demanda laboral que requiere el sector privado y es un esfuerzo de transformación del modelo de educación superior técnica; involucrando a todos los actores y agentes del sector público, empresarios, universidades y sociedad civil.

A través del nuevo ITSE se busca atraer a aquellos estudiantes que por razones económicas, académicas o sociales no tienen capacidad o interés en ir a la universidad, pero que necesitan de una plaza de trabajo para subsistir.

Se formará a profesionales técnicos en las ramas de logística, idiomas, negocios, salud ambiental, hospitalidad, electrónica e ingeniería y otras carreras que se requieran de acuerdo con la demanda laboral.

Este centro revolucionará la educación técnica y profesional en la historia del país, poniendo a la nación panameña a la altura de los retos que le plantea su desarrollo, la economía globalizada y el papel que nuestra posición geográfica y el Canal de Panamá nos asignan en favor del comercio internacional, el desarrollo mundial y la paz.

Este proyecto educativo incorpora carreras cortas de uno a dos años, con diseños curriculares flexibles que satisfacen la demanda del sector empresarial. La creación de este Instituto es una respuesta a la política del Estado que plantea articular la educación con el mercado laboral en el ámbito local y nacional.

El ITSE ofrecerá carreras cortas de uno o dos años en las que se capacitará a los estudiantes con las habilidades relevantes para las necesidades actuales de la industria.

Los programas de enseñanza están basados en aprendizaje práctico y teórico. El currículo académico se distribuye en 70 % prácticos y 30 % teóricos.

Los estudiantes pasan los últimos tres y seis meses de su preparación haciendo prácticas en compañías antes de graduarse.

UMIP: A CENTER OF HIGHER STUDIES Fifteen years after the creation of the country’s first center for higher maritime studies, the International Maritime University of Panama (UMIP) is focused on meeting the national and international demand for skilled labor.

UMIP was created by Law No 40 of 1 December 2001. It is a public institution with a board of directors made up of representatives of the public and private sectors of the Panamanian maritime industry.

This center for higher studies includes

a School of Nautical Science for the training of future merchant navy officers, pursuant to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers (STCW) 78/95.

In this context, UMIP also complies with the requirements of the Belgian Maritime Inspectorate (BMI) for the certification of courses. BMI’s recognition of UMIP as a center for maritime training opened up shipping and hiring opportunities for Panamanian cadets in the European merchant fleet and facilitated the hiring of cadets and officers by the shipping company Euronav.

BMI’s certification includes all courses offered at UMIP, consistent with the international regulations set out under the STCW Training Convention, as amended and approved by the International Maritime Organization (IMO).

UMIP’s certification by BMI as a center of training and education means that it meets all standards and regulations to train captains, chief officers and deck officers in charge of the navigational watch; as well as chief engineers, second engineers and engine-room watchkeeper engineers, according to the international standards on maritime activity and safety; all of which will allow the Panamanian merchant navy officers to serve on European Union flag vessels.

UMIP is constantly in touch with the private sector to address its demand of human resources in different specialized areas of the maritime sector, and for this reason, new careers have been added to the educational offer.

UMIP: CENTRO DE ESTUDIOS SUPERIORES A quince años de haberse creado el primer centro de estudios superiores marítimo del país, la Universidad Marítima Internacional de Panamá (UMIP), está enfocada en atender la demanda de recurso especializado, tanto a nivel nacional como internacional. La UMIP fue creada mediante Ley No. 40, de 1 de diciembre de 2001.

Esta es una institución estatal cuya junta directiva está compuesta por representantes del sector público y privado del sector marítimo panameño.

Este centro de estudios superiores cuenta con una Facultad de Ciencias Náuticas que forma a los futuros oficiales de marina mercante bajo estándares del Convenio Internacional sobre Normas de Formación, Titulación y Guardia de la Gente de Mar 78/95.

Prueba de esto es que la UMIP cumple con los requisitos de la Inspectoría Marítima de Bélgica (Belgium Maritime Inspectorate, BMI), para la certificación de cursos.

El reconocimiento de la Inspectoría Marítima de Bélgica (BMI) a la UMIP como centro de formación marítima le abrió oportunidades de embarque y contratación de cadetes panameños en la flota marítima europea, y a la vez facilitó el embarque de cadetes y contratación de oficiales en la naviera Euronav.

La certificación de BMI incluye todos los cursos que ofrece la UMIP, en concordancia con las regulaciones internacionales establecidas por el Convenio de Formación STCW y sus enmiendas, aprobadas por la Organización Marítima Internacional (OMI).

La certificación de BMI a la UMIP como centro de entrenamiento y formación, significa que cumple con los estándares y regulaciones para capacitar capitanes, primeros oficiales y oficiales de cubierta a cargo de la guardia de navegación; así como a jefes de máquina, segundos ingenieros e ingenieros a cargo de la guardia de máquinas, según las normas internacionales que rigen la actividad y seguridad marítima, lo que permitirá que los oficiales de marina mercante panameña puedan prestar sus servicios en buques con bandera de la Comunidad Europea.

UMIP mantiene comunicación constante con el sector privado para atender la demanda de recurso humano en diferentes áreas de especialización del sector marítimo; por tal razón, se han incorporado nuevas carreras a la oferta educativa.
