And there are few things more real than land.
Technology helps us identify the audience. Print allows us to engage them differently. The modern timber and paper industries have evolved as well. Trees are a renewable crop. Working forests are planted, managed, harvested and regenerated. Responsible forestry supports rural economies, wildlife habitat and continued investment in keeping land productive. Paper can also be recycled and returned to the manufacturing cycle. There is something worth considering in that comparison. A magazine begins with a renewable natural resource. A data center requires substantial technology, infrastructure, electricity and water to produce and distribute an almost unlimited stream of digital information—an increasing amount of which may never have originated with a human being. Technology remains an important part of what we do. Land.com connects people with land opportunities, AcreValue provides increasingly sophisticated property intelligence, and AI will undoubtedly become a valuable tool for our industry. But a tool should not replace the human behind it. The stories in Texas LAND are about real people, real land and real experiences. F O R WARD
Dividing Family Land Keeping the Peace
The ranch sat on Crabapple Creek in northern Gillespie County over a mile from the nearest county road. Granite bluffs, live water, oak-studded pastures and wildlife-packed cedar hillsides, a quintessential Texas Hill Country ranch. —
22
The Way Forward • A D V E R T O R I A L
The family had been talking about dividing the ranch for years. One conundrum after another never led anywhere except to crippling arguments around the kitchen table. A sibling’s terminal diagnosis finally moved them to action. Time was running out. If decisions weren’t made, more heirs would soon be at the table. At sunrise, we unloaded the UTV and set up our surveying equipment as the aging siblings pulled through the ranch gate. Four of them. Three vehicles. Only the two sisters rode together. We spent the morning trying to settle division lines. By midday, two siblings were face to face in the pasture, fingers in each other's chests, arguing over where one line should fall. I looked past them and saw the ill sister sitting alone on the UTV, weeping. The ranch that was supposed to be a shared blessing had transformed into a curse that was tearing her family apart. She knew how little time she had left to spend on it. Later, she signed the partition deed from her hospital bed, a little while before she passed from this world. The morning’s outcome did not begin with those siblings. It began a generation earlier, with a parent who could not make the hard decisions necessary to divide the property, so the children inherited the decisions along with the land. When one or more people own a percentage of everything but none of it specifically, it is an undivided interest. Nothing defined on the ground. No one can point to a pasture and say, "That is my portion." A Texas A&M University AgriLife study found that while 69 percent of farms expected ownership to continue in the next generation, only 23 percent had a plan to make it happen. No plan and no survey lines mean no clarity and no peace.
collateralize an undefined interest in a thousand acres. The solution is defining each person's interest now so that each one has the agency to borrow against their own portion while preserving the rest of the family's interest. Where should a family start? By getting clear on what each person truly wants. It is impossible to give anyone what they want if they haven’t voiced their wishes out loud. Get input from professionals who see the land differently: an appraiser, a developer and a conservation land trust will each assign value differently to the same ranch. Understand that a 33 percent interest may not translate to one-third of the acreage when the water well, powerlines, structures, workable land, live water and road frontage all exist in different places. We opened this four-part series with Abram and Lot in Genesis 13, separating their households and choosing which portion each would hold. We will close with Psalm 16:6, "the lines are fallen unto me in pleasant places; yea, I have a goodly heritage." David borrows the language of land to express his gratitude and the peace that comes when people know what they are receiving. Long before plats and deeds, a portion (or a lot) was assigned by the casting lots to randomly determine who received what. This is not the best case for your family. You can decide what falls to whom, or you can push that decision to the next generation by leaving the land in an undivided interest. The pertinent question is not whether your family will divide the land, but whether you will lead the effort or leave it to chance. Clarity brings peace. Undivided interest in land does not. °
The Next Handoff Will Not Look Like the Last One Roughly 150 million acres of U.S. agricultural land is expected to change hands over the next 10 to 20 years. In Texas, an estimated 41 percent is projected to transfer by 2035. Previously, when the next generation kept working the land, undivided interest was tolerable because the best outcome was the land staying together. That is changing. Few of the generation now inheriting working farm and ranchland intend to operate it. Many are scattered across the country, holding non-agricultural jobs and having no plans to work the land for a living. At best, they hope to keep it intact for recreation or leasing so it still produces a yield. When the heirs are not operators, the land's highest value is generally realized in the marketplace, which often demands that it be subdivided to define each heir's ownership. It is difficult to sell an undefined portion of land.
Define It Before You Have To Consider a daughter who wants to build on the family ranch. She needs one acre to build on, but a lender is unlikely to

Q & A • Five Questions About Data Centers
3
Why do rural projects seem to be prompting more controversy?
CN: Several reasons come to mind. First, county governments have no control over land use in the county, so local people who will be affected by a data center don’t have any meaningful input into whether they get a project in their rural neighborhood. Second, many parts of rural Texas are either beginning to struggle with water

If the county doesn’t provide incentives at the level the developer wants or needs, the developer can walk away from the deal and the community, although that is not a guarantee. Horse Canyon Ranch recreational paradise 27,740± Acres
Culberson County
Within its 27,740± acres, the Horse Canyon Ranch in Culberson County showcases the diverse, rugged beauty of far West Texas. Historically, used as a working ranch, the lowfenced property is a recreational paradise that can be accessed from both I-10 and Highway 90. The Lobo-Garren Ranch Road, a wellmaintained county road, transects the property linking both major thoroughfares. While the Horse Canyon Ranch has plenty of the wide-open spaces that define the region, it is only 20 minutes from Van Horn, the county seat, and just over an hour to Marfa, one of Texas’ most beloved destinations. The ranch is nestled between the Jeff Davis Mountains and the Wiley Mountains. With its expansive views and desert climate, it is reminiscent of Arizona Because the landscape includes both desert rangelands and craggy, but accessible mountains, the ranch is home to pronghorn antelope, blue quail and some Gambel’s quail as well as mule deer, aoudad sheep, free-ranging elk and the

occasional mountain lion or black bear. For the past couple of years, the ranch has implemented a protein feeding program using approximately 22 feeders scattered across the property. Working with the Texas Parks and Wildlife Department, the ranch team participates in aerial wildlife surveys. Historically, used as a working ranch, the property has been rested from cattle grazing for the past few years. Horse Canyon Ranch is a recreational paradise with agricultural infrastructure including three sets of working pens. The ranch is divided into nine main pastures and three traps. The cattle operation could be easily reinstated as an additional income stream and range management tool. In good years, the carrying capacity is 300 to 350 head of mother cows. The ranch has five working wells, with a mixture of electric submersible and solar pumps, and two non-functional wells. Water distribution to meet the needs of wildlife and livestock has
been an on-going effort. The ranch is home to an extensive network of piping, water troughs, storage tanks and wildlife guzzlers. The main headquarters includes a threebedroom/two-bathroom ranch house with a full kitchen, living room and central heat and air, a barn, a storage barn and a tack room as well as one of the three sets of working pens. Existing hunting and grazing leases create great income producing opportunities for a new owner, if desired. Horse Canyon Ranch offers a lifestyle as big as the West Texas sky. Here you can get away from it all and rediscover the peace that comes from elbow room and the grandeur of nature. Call Howard W. Hood, Broker, at (830) 739-3815. The ranch is listed for $785/acre.

Two Creeks Ranch has six center pivots and five water wells including two Edwards Aquifer irrigation wells: one with 276 acre-feet of base Edwards Aquifer water and the other with 60 acre-feet of transferable Edwards water.
