Today we spotlight Jennifer Ciskanik from our Member Services Team. Jennifer has lived in LOW for over 15 years, joining the community in 2005. While not a formal member of any committees or activities, she truly appreciates the amount of effort and hard work so many members put in to help make LOW a great place to live Jennifer worked as a paralegal for many years for multiple law firms and got her realestate license before deciding to become a fulltime homemaker.

She began working in Member Services on a part-time basis about a year and a half ago.

Currently she supports the Member Services Team one to two days a week and has become a solid member of the team. She really enjoys working Jennifer Ciskanik in Member Services and helping members with everything they need to enjoy our community to the fullest. Her advice to members: when contacting Member Services in person, on the phone or by email, have your member number available (Section/Lot#). This can easily be found on your member ID card. Having this information readily available will get you answers to your question(s) that much more quickly. She also notes that if you have never lived in a homeowners’ association community before, you may be somewhat put off by all the rules and regulations. After getting the routine down and asking questions, you will eventually gain an appreciation for them and understand their importance in successfully providing you with the community’s amenities and services.

As a reminder, Member Services representatives are available from 8:30 AM to 5 PM, Monday through Friday, and from 9 AM to 1 PM, Saturdays. The Member Services phone number is 540-972-2237.

On occasion, the subject of fences within Lake of the Woods comes up, with Members who either support or oppose the restrictions on them. The following are excerpts from the Restrictive Covenants, the entire body of which are located on the LOWA website, under the Administration heading and Governing Documents subheading.

5. ENVIRONMENTAL CONTROL COMMITTEE (in part) A. All plans and specifications for any structure or improvement whatsoever to be erected on or moved upon or to any lot, and the proposed location thereof on any lot or lots, the construction material, the roofs and exterior color schemes, any later changes or additions after initial approval thereof and any remodeling, reconstruction, alterations or additions thereto on any lot shall be subject to and shall require the approval in writing before any such work is commenced of the Environmental Control Committee (herein called “Committee”), as the same is from time to time composed.

E. The Committee shall have the right to disapprove any plans, specifications or details submitted to it in the event the same are not in accordance with all of the provisions of these Restrictions; if the design or color scheme of the proposed building or other structure is not in harmony with the general surroundings of such lot or with the adjacent buildings or structures; if the plans and specifications are incomplete; or in the event the Committee deems the plans, specifications or details, or any part thereof to be contrary to the interests, welfare or rights of all or any part of the real property subject hereto, or the owners thereof. The decisions of the Committee with respect to plans, specifications, or details thereof shall be final. (Referendum Aug 1996) 6. SIZE AND PLACEMENT OF RESIDENCES AND STRUCTURES D. In order to preserve the natural quality and aesthetic appearance of the existing geographic areas within the Subdivision, all property lines shall be kept free and open to one another and no fences shall be permitted on any lot or lot lines except where, in the opinion of the Committee, a fence or other enclosure, as a structure or aesthetic feature of a design concept, will contribute to and be in keeping with the character of the area. (Bold emphasis added) Fences are permitted when approved by the Environmental Control Committee, pursuant to the above language. There are some fences not associated with pools within Lake of the Woods, but my limited observation is that they are mainly consistent with the historical significance of the area (wooden fences, split rail fences).

The Association has a hierarchy of documents by which it governs. At the top of the hierarchy is the Restrictive Covenants. These covenants can only be changed by vote of the Membership by and through a referendum. To pass a referendum, 50% plus one vote of the Membership is required, which amounts to 2,130 votes in favor of the proposal.

The process for Members to call a Special Meeting to hold a referendum is contained in the Bylaws, Article IV, Section 2. It requires a petition containing 800 signatures, one per lot. The petition must (1) specify the purpose(s) for which the meeting is being held; and (2) be delivered to the Secretary. No business other than that stated in the petition shall be transacted at such Special Meeting. A Special Meeting shall also be called to close referendum voting on amendments of the Articles of Incorporation and Declarations.

Currently, any decision by the ECC is final. However, one part of the current ongoing referendum, if passed, would offer an opportunity to appeal a denial by the Committee under certain circumstances. While our ECC works to find solutions with Members, the opportunity for an appeal is one worthy of a “yes” vote.

2. OPEN SESSION 2.1 Pledge of Allegiance Motion by Clawson that the Board enter into Open Session at 2:00 p.m., and to affirm that the Board met earlier today in Executive Session for the purpose discussing and considering contracts; and to consult with legal counsel.

President Wilks explained the guidelines for the meeting using Zoom teleconferencing platform capabilities and how Board and member participation is being accommodated.

Happy Memorial Day, LOW! This weekend kicks off summer activities and the Maintenance Department and Amenities Staff have been preparing for this time. Here is a quick around the Lake report of 10 Things to Know for the holiday: 1. Clubhouse and Sweetbriar Pools will open Thursday, June 11, assuming Virginia is in Phase 2 of reopening. This will give the pool staff two weekdays to get used to the new protocols before the Saturday crush.

We are still waiting to hear from the Governor what capacity restrictions, if any, there will be. If the restriction is 50 percent, we will be able to host approximately 125 pool patrons at each pool using the new physical spacing and cleaning protocols. We will ask members and their guests to limit pool time to two hours, especially if capacity restrictions are tight or if high attendance creates lines.

2. Beach sand restrictions are raised to no more than 50 people with social distancing between people not in the same household, starting Friday, May 22.

3. Elvis has entered the barn! The Equestrian Center welcomes our newest horse, Elvis. He is a 19-year-old Quarter Horse/Welsh cross. Elvis loves kids and will be ready for lessons and camps. The Equestrian Center is offering private lessons by appointment during the Virginia Phase 1. Come see if Elvis sports Blue Suede (Horse) Shoes! (See Elvis on page 7.)

4. Main Marina Gas Dock is open for business. Members can purchase boat decals for kayaks and canoes for $20. Staff replaced all vertical piling bumpers on the gas dock to improve the look and utility of the dock.

5. Lake Patrol is enforcing boat decals for boats underway on the Main Lake as of May 16. Lake Patrol will be reminding boaters to have the right U.S. Coast Guard-approved life jackets. Member Services at Holcomb Building is assisting boat owners with decal requests.

6. New carpet. We took advantage of the Woods Center closure to replace carpet and freshen up the paint in Fareways and Pro Shop. Someday soon we hope to be back open so you can enjoy the new look. The Community Center will get its carpet replaced in early June.

7. Fareways hours will be extended to 6 PM starting Friday, May 22, so that the café closes at 6 PM Wednesday through Sunday. Fareways is already open until 9 PM Monday and Tuesday. The patio is open for 50 percent capacity seating.

8. The Clubhouse deck opened last Friday to 50 percent capacity. It was nice seeing members enjoying the outdoors with spacing between tables.

9. Sand bunkers. The long-anticipated Billy Bunker Project to replace sand bunkers on the golf course is underway as of May 19. The contractor will be here for four to five weeks replacing bunkers, working around the course from the 1st to the 18th Fairway.

10. Memorial Day is a federal Holiday for honoring and mourning the military personnel who died while serving the United States Armed Forces. God bless our veterans who unselfishly gave their lives for our country and God bless the USA!

May 14 Board minutes from p. 3 to Borrow/Grant Collateral, a copy of which is attached hereto and made a part of this Resolution which authorizes, empowers and directs the Treasurer of Lake of the Woods Association, Inc., Walter E. Diercks, to do the following for and on behalf of the Corporation with Village Bank: Borrow money, execute notes, grant security, execute security documents and negotiate items; and to perform any further acts and things, to pay any and all fees and costs, and to execute and deliver such other documents and agreements as he may in his or her discretion deem reasonably necessary or proper in order to carry into effect the provisions of the Small Business Administration loan through Village Bank.

4.2 Consideration of Adopting a Resolution Delegating to the General Manager Authority to Open the Lake of the Woods Fitness Center.

The following is a correction to the proposed amendment pertaining to Bylaws Article X.8.e, Virtual Meetings, that was published in the May 8 issue of Lake Currents. The correct language (below) was also included in May 8 issue as part of the draft minutes from the May 2nd meeting (see page 15).

The Board of Directors is seeking member comment regarding proposed amendments to Bylaws Article X, Committees, Virtual Meetings. Members who wish to provide comment or feedback should email the Board at Board@LOWA.org by the extended deadline of 5 PM, Friday, May 29.

What is proposed? Why? The amendment to Subsection 8.e, is proposed in response to new practices that have been put into place due to the COVID-19 pandemic; there is also a need for the Bylaws to better define the requirements for committees to hold a virtual meeting.

LOWA Obtains “FORGIVABLE” SBA Paycheck Protection Program Loan

Who proposed it? The LOWA President proposed the additional language for the Virtual Meetings.

What is the effect? Committees will be permitted to host meetings via an entirely virtual platform, if there are extenuating impractical, or unsafe circumstances, and that the committees obtain authorization from the General Manager, who will coordinate committee support.

At a special meeting on Thursday, May 14, the LOWA Board approved LOWA accepting a loan through the Paycheck Protection Program. LOWA received the loan the next day from the Small Business Administration through a participating lender, Village Bank. LOWA’s financial audit firm and law firm reviewed the loan before the Board voted to approve it.

The PPP is intended to provide funds for small businesses and other organizations to help them continue to retain and pay their employees during a time where these organizations, including LOWA, have had their operations disrupted by government-required restrictions related to the COVID-19 pandemic. At the time the loan was established, the unfavorable budget impact to LOWA directly related to these restrictions was estimated to be between $15,000 and $20,000 per week. It is uncertain when the negative economic impact of COVID-19 will lessen. If it weren’t for the PPP loan, LOWA would have been forced to dramatically cut staffing and operations to conserve cash to prevent a potential shortfall in the current fiscal year, which began May 1.

Even with such cuts, there would have remained a risk of a shortfall, which might require deferring maintenance, or potentially require an additional assessment amount to cover any shortfall and maintenance deferrals.

The amount of the PPP loan is $782,100 and carries an interest rate of 1%. It is an unsecured loan. The principal amount was determined by a specific formula set by the SBA at the time LOWA applied for the PPP loan in April, and roughly approximates 10 weeks of payroll and related expenses. To be “forgivable,” loan proceeds must be used primarily to maintain employee staffing levels. The proceeds can also be used to cover utility bills and mortgage interest payments to some degree. While the SBA has not finalized the calculation formula to be used to determine how much of LOWA’s PPP loan will be forgivable, it is currently estimated that approximately $500,000 of the loan would be forgivable. Before adjusting for the forgiveness of most of the PPP loan, the loan terms would require LOWA to begin making payments in December 2020 of approximately $44,000 per month until the loan would be paid off in May 2022. The actual repayments will depend on the exact amount forgiven, as well as the Board’s later decision on whether some or all the unforgiven portion of the loan should be repaid early.

The proposed amended section reads as follows: 8.e. Electronic Participation. In the event it is impractical or unsafe to assemble in a single location, as determined by the General Manager, Committee and subcommittee members may, if authorized by the General Manager, meet in an entirely virtual platform via telephonic, video conference, or other electronic means, including entirely virtual meetings, subject to the availability of conferencing equipment or software by LOWA. If the meeting will be entirely virtual, in such circumstances the Committee or subcommittee must give notice of the entirely virtual meeting to LOWA members contemporaneously with notice provided to the Committee or subcommittee members, using the best available method given the nature of the impractical or unsafe circumstances, and the Committee or subcommittee must make arrangement for LOWA members to have access to the meeting through telephonic, video conference or other electronic means. All virtual meetings must be coordinated through the General Manager for time, date, and Committee or subcommittee support. LOWA is not responsible for providing equipment to individual Committee members, subcommittee members, or LOWA members to facilitate their participation. Otherwise, when there are no such impractical or unsafe circumstances, meetings of Committees or subcommittees shall be held at a physical location, in which case Committee or subcommittee members may participate via telephone, video conference or other electronic means, subject to the availability of conferencing equipment or software by LOWA, provided however that at least two (2) Committee or subcommittee (for subcommittee meetings) members must be physically present at the meeting place included in the notice.

The question has been brought up: Who owns and maintains the ditches in Lake of the Woods?

First, let’s talk about ownership of platted drainage easements.

Over time, debris collects in the channel of the easements and inhibits the flow of water, causing the water to find the path of least resistance, which may lead to flooding of surrounding areas. The question is how we can help alleviate or eliminate flooding from our easements during heavy rainstorms. The first step would be with basic routine maintenance. On a regular basis, especially during the rainy season, the channel should be cleared of debris, i.e. leaf build-up, sticks, logs, and trash. Also, if the property owner’s easement happens to be a creek, the owner should inspect the banks of the channel and determine if there are any small saplings that are creating blockages and trim only those. By over trimming or removing the saplings you could cause the banks to collapse. Inspect the channel, looking for any eroded areas Example 3 Example 4 that can be repaired with riprap. Remember, prior to paving or replacing your driveway culverts, you are required to get a permit and approval. Remember that keeping the channels clean and culvert pipes open for proper drainage can help alleviate the flooding during heavy rainfalls.

Now that we have begun our new fiscal year, I want to thank all Members who have made their annual assessment payments and updated their registrations and member information. If you have not taken steps to make, or begin making, your assessment payments and update your information, we need you to get in touch with us today to avoid issues with amenity access, including barcode access to the front and back gates.

Realizing we do not live in a perfect world, I am taking this opportunity to advise all Members of possible delays starting Thursday, June 4, when entering the Lake through either the front or back gate barcode entry points, as those barcodes relating to family guests, blood relatives and cohabits that Members have not renewed for the 2020-2021 year will be automatically deactivated.

As a reminder, barcodes for these individuals need to be renewed every year with Member Services by completing and submitting the proper forms

by May 1 as part of the annual assessment process.

Then Boise informed the Association that they would transfer the properties to them, whether they agreed or not. Several of the Association members went, as private citizens, to the Court in Orange to stop such a transfer.

Another road block! As the parties waited for a court hearing, Ernie Holcomb drew up a counterproposal requiring items to be brought up to standard, which Boise-Cascade finally accepted. Engineering experts were found to check the condition of the dam, roads, lakes, etc.; and 97 percent of the members voted to proceed. In the end, the recreational properties were transferred under Deed of Gift, and $212,000 went to Boise-Cascade to purchase several lots they had taken in foreclosure proceedings, two service buildings, golf course machinery, and Clubhouse and Pro Shop furnishings. The final result was not exactly the solution the Board members desired, but they felt that it was the best that could be accomplished to bring “as much as possible under one entity.”

In a talk given to the LOW Lioness Club in September of 1990, long-time resident Jack Eckels stated, “In looking back over the years, we all owe a deep debt of gratitude to Ernie Holcomb, who in those formulative years, stood for not only what was right, but had the patience and fortitude to follow through.” With members like Ernie Holcomb, the first in a long line of volunteers working for the good of our community, residents should be thankful for the results, which allow all of us to enjoy the relaxed lifestyle we have in Lake of the Woods.

Today the Holcomb Building still houses the LOWA administrative staff and the offices of Lake Currents and Channel 18. It is the main information hub for information about living at LOW. The staff handles assessment questions, application forms for amenities, paperwork for new home owners, flyers about groups and events in LOW, and just about any question you need answered. If the administration staff cannot answer your questions, they will try to direct you to someone who can. Think of our champion, Ernie, the next time you come to do business at the Holcomb Building.

Reprinted from May 8, 2009 Lake Currents Newsletter Many venues at LOW have been named for people who made important contributions to our community—many of whom are no longer remembered by those currently living here. Shoosmith was the name of the builder who won the contract for digging the main lake, the dam and spillway, and the roads; Walt Velona and George Lewis were dedicated members of the LOW Lions; the Woods Center was named to honor Barbara Wood, a LOWA secretary who worked her way up to general manager during the 1980s-1990s. The Holcomb Building was the first in this tradition, named for Ernest Holcomb, the first Lake of the Woods lot owner at to be a member of the Board, in April 1969. The developers had been in complete control since 1965.

The transition from total control by the developer, Boise-Cascade, to LOWA as an independent home owners’ association in January of 1973 was a difficult and rocky process. Ernest Holcomb was the person who represented the property owners in the negotiations.

Ernie graduated from Texas A & M with two degrees in Economics. He served as a Naval officer in World War II, after which he was employed by the Department of Agriculture in Washington, D.C. It took all this experience to tackle the problems facing the Association.

Forcing Boise-Cascade to move with dispatch to complete the “comparatively novel” vacuum Ernest J. Holcomb pump sewage system by appealing to the Health Department and the State Corporation Commission, and dealing with the chaos that developed from the fact that there were six groups with conflicting jurisdiction at the Lake were just opening skirmishes in the ongoing battle to wrest independence from Boise-Cascade.

The biggest battles were over the method by which transfer of the roads, parks, and recreational facilities (which were in very poor condition and, in some cases, potentially over hazardous) to the Association. Boise’s first suggestion was that they would accept $2,500,000 to transfer properties. The Association members laughed and suggested that “$1 and other valuable considerations, meaning our good will” would be more appropriate since the homeowners were promised those facilities in all the advertising that had been circulated by Boise-Cascade. In late 1970, the offer was reduced to $1,500,000. In the winter of 1971-72, the offer was lowered to $900,000, then to $600,000. The Board members continuously refused because the assets to be transferred were still in poor condition. Boise-Cascade threatened to open amenity membership in the independently-owned golf club to the public; however, the Association controlled the Front Gate and the Security force and would not admit the public. A standoff!

The LOW Lions are pleased to announce this year’s high school and community college scholarship winners.

Our Germanna Community College $1,000 scholarship winners are Camila Jorge and Jessica Gentry. Our high school $2,000 scholarship winners are Isaac Anderson, Joshua Lyon, Kamryn Davis, Makenna Ritenour, and Darian Lee. Our Selven Powell Memorial Golf Tournament funded a special Community Service $1,500 Scholarship for Hannah Howard, an OCHS student from Gordonsville, enrolled in the Blue Ridge Virtual Governor’s School. She plans to attend a four-year college, possibly Virginia Commonwealth University, majoring in psychology with a concentration in mental health and substance abuse.

Camila Jorge lives in Culpeper. A graduate of Eastern View High School, working as a licensed practical nurse at Dogwood Village in Orange, she is studying to become a registered nurse, and ultimately a nurse practitioner.

Jessica Gentry is also studying to become a registered nurse. She lives in Orange, is a graduate of Orange County High School and works as a licensed practical nurse at an assisted living facility.

Joshua Lyon of Locust Grove intends to study government and international politics at George Mason University. He served as a congressional intern for U.S. Senator Michael Enzi and a campaign intern for Virginia State Senator Bryce Reeves. The Orange County High School senior attends the Blue Ridge Virtual Governor’s School, is a member of the Naval Sea Cadet Corp, Junior ROTC, and the National Honor Society, and is a varsity swimmer and baseball player.

Kamryn Davis lives in Lake of the Woods and plans to study musical theater at James Madison University. She is a senior at OCHS, a member of the choir, and studies voice to prepare for her future career in theater.

Isaac Anderson is a junior ROTC cadet at OCHS and received the Silent Warrior Medal. He lives in Barboursville, manages the OCHS robotics team, and is a member of the National Honor Society and the debate team. He plans to study business administration at Piedmont Virginia Community College.

Makenna Ritenour, from Orange, is a senior at OCHS and plans to study elementary education at Roanoke College. She is a member of Blue Ridge Virtual Governor’s School, interned with Orange County Social Services, played on the JV basketball team, and was manager of the JV girls soccer team.

Darian Lee is senior class president at OCHS. He lives in Gordonsville and plans to study music industry at James Madison University. He is a bandleader, a member of the OCHS band and plays on the baseball team.

Just as the slogan was w used in WWII recruiting, we are using it to seek new members for Neighborhood Watch Our latest membership count is 1243 individuals. This makes us the largest Neighborhood e Watch in Virginia, but we seek to involve even more residents in the task of making LOW as safe as possible. This does not indicate that LOW is unsafe, e, only that with citizen involvement we can all participate pate in looking after LOW. The quarantine for the corona virus slowed down recruitment of new members by our Block Captains as they were unable to get out and meet people. Additionally, new member orientation meetings were suspended, slowing another aspect of recruitment.

Car Parade to Honor First Responders

A car parade is being planned to honor First Responders who live and work in LOW. The parade will be coordinated with LOW Fire and Rescue.

While initially planned for classic, antique cars and street rods, any unusual or special edition vehicle is welcome to participate. Time and date of the parade will be determined after interest in participation is determined, and coordination with LOW Fire and Rescue, LOW Security and the General Manager are completed.

The plan is to assemble in the Clubhouse Lower Level Parking Lot, then line up and circle the LOW Fire House, then proceed around Lakeview Parkway and back again to circle around the Fire House and then park in the Lower Level Parking lot, spread out so anyone desiring can view the cars from a safely separated distance.

The Orange County Broadband Authority, whose five members are also the five county supervisors, recently met to approve the budget and next step plans for broadband internet coverage in Orange County. Connectivity is planned in five phases. There has been significant progress to date in terms of completion of the core fiber network.

Phase 1, connection and operation at all the schools, has been completed.

Phase 2, connection to P25 Public Safety Radio System, is in progress with completion of fiber connections to the facilities and the towers. Tower equipment has been procured and installation is in progress. Phase 3, connection to the Network Access Point at to the Equinix Culpeper Facility, is in progress.

Agreements for wholesale internet access to and fiber connection there have been completed as well as the OCBA authorized procurement of the equipment to be installed there. Phase 4, connection to local government facilities, is in progress with fiber connection completed and ongoing testing underway. Phase 5, connection to citizens and businesses in the county, is just getting started.

A few underserved areas have been identified as potential places to start connections. The current challenge is to establish the rates and the policies for installation to individual subscribers. That is expected to be completed by the middle of next month, along with approval of a customer interface and support contractor. By late August, the installation and testing of the broadband network equipment should be completed. In September, the OCBA expects to identify and begin coordination with the Beta Testers, who will use the system to determine how well it works and what needs to be improved. The OCBA plans to start installation to new subscribers in November of this year. Any fiber connections to Lake of the Woods residents by the OCBA will depend on how, or whether, the LOW Association wants to engage in providing fiber service.

Orange County government is continuing to function during the current COVID-19 crisis. Most departments are functionally close to normal, but the Department of Social Services has been particularly challenged, due to the much larger number of county residents who have lost jobs because of the crisis. The federal Families First Coronavirus Response Act instituted extensive and unprecedented policy changes for all programs administered by the DSS. Annual Medicaid renewal reviews will be delayed by 90 days, and no Medicaid cases will be closed even if income criteria are exceeded.

Cases will be closed only for death, the client moving out of state, or requesting it. For other support programs such as the Supplementary Nutrition Assistance Program (Food Stamps), Temporary Assistance to Needy Families, and Childcare, there are additional relief measures. The annual certification for these programs has been extended by six months, ensuring that recipients have continued coverage during this period, regardless of potential changes to their eligibility. The Act also allows states to exempt individuals from complying with work requirements to receive benefits until after the public health emergency is ended. DSS staff continues to respond to Child and Adult Protective Services reports. If direct contact with clients is required, staff visit in person wearing face masks, face shields, gloves, and booties. Of concern is the 50% reduction in child protective reports. Since school is not in session, no reports are coming from school staff. Video conferencing is used for required meetings; even an adoption was finalized by video with the Circuit Court.

The Rappahannock-Rapidan Community Services Board oversees the provision of services for seniors and individuals with mental health issues and mental disabilities. Services are provided to residents of five counties, including Orange County. The Board has three representatives from each county. Due to recent unexpected changes, there are two Orange County vacancies on the Board. If you are interested in serving in this capacity, please contact me or apply on the Orange County website.

LOW Community

It looks like there might finally be something to look forward to for LGA members. The start of our season, and many of our events, had to be postponed or cancelled. Many of us have been happy to get out and play some golf, even with lots of restrictions. It beats sitting home on a nice day.

If, as hoped, phase 2 of the LOW reopening plan starts on June 5, maybe we can start playing our Tuesday LGA golf on June 9. Let’s hope phase 1 goes without incident and we can get on with our 2020 season. As soon as our president, Sheran Marks, gets the word, she will notify all of us when we can begin Tuesday league play.

Meanwhile, our veryy generous ladies started collecting cash and food d donations for the Wilderness Food d Pantry on March 20. By the end nd of April, the LGA collected d $4,870 and a large amount of food items.
