President’s Letter

Monday, Jan. 29, Director Bob Hoh, Director Jennifer Zukowski, General Manager Phil Rodenberg and I joined other large communities in Richmond to speak to the Virginia Senate Committee on General Laws and Technology in opposition to Senate Bill 861, introduced by Senator Bryce Reeves “by request”.

While we appreciate Sen. Reeves’ leadership and service, Senate Bill SB 861 would have required association boards of directors, like LOWA’s Board, to get approval by a majority vote of members (50 percent plus 1) in the community before they could do a project costing $1 million or more. This limitation would include new projects as well as reserve projects. As you know, we have a reserve study made every five years to help us know what our major repair and replacement expenses will be for the next 40 years. Reserve funds are our savings accounts for those repairs and replacements. We put more money into reserves as we get closer to the year the repair or replacement is due. Under this bill, even if we had the money in reserves to pay for a repair or replacement costing $1 million or more, we couldn’t do it until we had a favorable member vote to do so. It could take months to get the necessary 2,129 favorable votes. Even worse, if we had a disaster such as a hurricane that caused significant damage, we couldn’t fix the damaged areas even with insurance money if the cost was $1 million or more.

The damaged areas could not be touched until there was a successful vote in favor of spending the money on the repair.

Phil and I both spoke in opposition to the bill because of the limits it would place on our ability to maintain our community.

Members of other HOAs, including Brandermill, Stone Ridge, Westridge and Cascades Community Associations also attended the hearing.

LOWA governing documents require elected members of the board of directors to maintain our community. The Senate bill could not have changed that responsibility. The bill would have just made it very difficult, if not impossible, to carry out our responsibility.

I am happy to say that the Senate Committee listened to our objections and those of other HOAs and voted 14 to 0 to “pass by indefinitely” SB 861 and to send it to the Virginia Housing Commission to study the impact of the bill on home owner associations across the State.

Flashing Yellow Light/Turn Signal on Route 3. Orange County Supervisor Lee Frame brought good news … and a check … with him to the Feb. 3 Board of Directors meeting. The Board of Supervisors agreed to reimburse LOWA a total of $33,586.94 for funds LOWA spent on engineering design services related to the Route 3/Lake of the Woods Parkway/ Goodwin Drive intersection improvements, including the flashing yellow light and turn lane designed to relieve traffic congestion at our Front Gate. The funds are left over from the construction project, and originally came from the $150,000 Walmart Special Use permit for Route 3 received by the Orange County in 2012. The LOWA Board voted to deposit the amount in our Contingency Reserve, which brought the current balance over $110,000. This reserve is for unforeseen spending requirements such as a large, unanticipated operating cost that could be the result of an emergency event. By policy, we maintain the Contingency Reserve at $100,000 or more, and so we did not need to add anything to next year’s budget for this use.

Speaking of the Route 3 flashing yellow light, VDOT Resident Engineer Alan Saunders will lead an information session and open house on this topic on Thursday, Feb. 22 from 5 to 8 PM at the Clubhouse. VDOT will help answer questions about the use of the flashing yellow light from the turn lane, such as who has the right of way when the signal is flashing yellow.

According to our Security Chief Scott Walker, the flashing yellow light has helped ease congestion with light to moderate levels of traffic. During periods of heavy traffic, however, the turn lane from Fredericksburg still stacks up. Approximately 1.9 million vehicles come through the Front Gate each year. As Route 3 through traffic and Front Gate traffic continue to grow, someday LOWA will need to consider building another gate on Route 3.

Thank You For Your Questions Part II

This column is in response to Member questions related to the Clubhouse Area Recreation Complex project.

1. Where do we stand on the $5 million CARC Project?

At the Jan. 16 Board meeting, the Board voted to submit a loan application for up to $5 million to Mutual of Omaha Bank, a Community Association Bank. We will not know the amount of the loan until the project has been bid in May, but we expect the amount to be lower because of cash in hand and member assessment payments in April.

According to the most recent timeline, in February we receive final design documents and apply for a building permit. In April we send out requests for bids. We expect to award a contract on May 5. Construction of the project runs from May 2018 to May 2019. (Timelines are always subject to change.)

The most recent timeline is on www.LOWA.org/ CapitalProjects. Recent Board votes on the CARC project are on the site under Newsfeed. All Lake Currents articles related to the project, from 2014 to the present, are included. Documents related to the project (that we can upload) are added website as new information becomes available.

2. I don’t use the amenities. Why should I have to pay for the CARC project?

LOWA’s Articles of Incorporation, Article V, Section 4 states, “There shall be only one class of membership.� This means there is one vote per lot and no one is excluded from using an amenity. We all pay the same amount whether we use an amenity or not. The information is included in our Disclosure Packet when we become owners in Lake of the Woods.

Even if you don’t use the amenities, your lot benefits from the community having them.

REPORTS 3.1 Report from Orange County Board of Supervisors Supervisor Lee Frame reported the Virginia General Assembly is in session and the County has contacted our representatives on issues important to us. Two have to do with school funding, and another with increased funding for control of invasive species. He would like permission to acknowledge Child Abuse Prevention Month in April using pinwheels provided by the Orange County Office on Youth. He presented a check for $33,586.94 to LOWA from Orange County, which represents VDOT’s unspent portion of the $150k proffer from Walmart for improvements to our main gate entry lanes on Route 3.

There is an opening for a District 5 representative on the Social Services Board. Interested residents should contact Mr. Frame for more information.

3.2 Report from Orange County Sheriff: In January, Orange County received 2457 calls for service, 50 of those from LOW. There were 125 warrants issued, 680 civil papers served (79 in LOW), 45 criminal transports and 63 traffic tickets written, 23 on Route 3.

There was only 1 call for service from Walmart.

Sheriff Mark Amos reported his office received a call reporting a woman being attacked at the golf course, but when investigated, officers determined there was no danger to the public.

Sheriff Amos provided updated information on the investigation into threatening letters and e-mails sent to a member of the Board.

3.3 Report from Allied-Universal Security Chief Scott Walker reported that the month of January was fairly quiet except for an unusual 3-vehicle motor vehicle accident. Of note were 3 reported thefts, 1 incident of vandalism, 1 report of breaking and entering, 2 structure fires, 17 incidents of illegal dumping and only 3 animal complaints.

Staff responded to 172 calls for service.

Security is working with the IT Department on readying the new license plate reader system. Staff is also working on a public service video to air on Channel 18 informing members on the proper action to take when reporting emergencies.

3.4 Report from LOW Volunteer Fire & Rescue, Inc.: No report available.

3.5 Report from Orange County School Board Representative Jim Hopkins reported that Superintendent Dr. Brenda Tanner plans to retire at the end of this school year. Public input will be solicited at a special meeting scheduled for February 5 at 6:00 p.m. at Locust Grove Middle School. There is also an online survey residents can use for comments on the Orange County website. The School Board will be accepting applications for Superintendent from February 15 through March 15, 2018.

3.6 Reports of Officers President’s Report President Cumming reported that on January 29 she joined Board members Bob Hoh and Jennifer Zukowski, and GM Phil Rodenberg in Richmond to speak to the Senate Committee on Science, Technology and General Laws opposing Senate Bill 861 which would require association Boards of Directors, like ours, to get the approval of 50% plus 1 members

On Jan. 31, the GM presented the proposed budget to the community and explained the new approach for allocating the cost of the CARC project in the assessment. For details about this new option, please refer to the Budget Transmittal letter on www.

On February 3, GM Phil Rodenberg presented the Board with the current revised proposed budget for FY2018-19. After considering input from the membership and Finance Committee, the assessment proposal was updated with a 7-year payment schedule for the CARC special assessment. For FY2018-19, the assessment would be $1390 (Capital Replacement, O&M expense and Contribution to Reserves), and $191 additional for the CARC project, for a total of $1581 per lot this year.

The revised proposed FY2018-19 Budget will be presented to the Board for a vote on adoption at their February 21 Board meeting.

The GM reported that The Association continues to coordinate with Mutual of Omaha Bank regarding the overall loan process to ensure timing of the loan application will coincide with the expected awarding of a contract for the CARC project in May 2018.

Bank representatives have offered to attend its Feb. 21 Board meeting.

The State of Real Estate at the Lake

ď&#x201A;ˇď&#x20AC; In 2016, the market was pretty flat compared to 2015 in regard to total sales, which held at 243 with a decrease in distressed sales to 11.1 percent. However, 2016 saw the median price jump to $225,000, a healthy 7.1 percent increase. ď&#x201A;ˇď&#x20AC; 2017 told a totally different tale: 294 total sales, a whopping 21.1 percent increase over 2016 with only 5.8 percent being distressed. The median sales price climbed to $239,000.

What a difference a year makes! 2017 was an amazing year for real estate sales in Lake of the Woods, with sales increasing 21+ percent over 2016. New construction has continually been on the rise as well.

Of the 294 total sales in 2017, only 17, or 5.8 percent, were either short sales or foreclosures.

In 2010, a whopping 43 percent of all sales were either short sales or foreclosures. Weâ&#x20AC;&#x2122;ve come a long way!

Average days on the market, which is the number of days it takes from the time a property is listed until it goes under contract, has steadily declined from 111 in 2013 to 95 days in 2017. Itâ&#x20AC;&#x2122;s also telling to note that a significant number of lots have sold in the past five years. From Jan. 1, 2013 to Dec. 31, 2017, 155 lots changed ownership. New construction has been increasing as well. 2013 saw 17 new construction starts, while 2014 had 18, In 2015, there were 41; in 2016, there were 28; and there were 30 in 2017.

Another good year in 2018 is anticipated! Our low taxes in OC will potentially be even more appealing to prospective residents.

1. Protect the common areas including all buildings, dams, marinas, parks and lakes. Three times a day the roving patrol checks LOWA property for unlocked doors, suspicious persons, damage to the buildings, etc. Officers check for dash tags on cars in the common area parking lots. Security has 39 check points to check.

2. Enforce LOWA regulations on the roads and lakes, including speeding. For reckless speeding – 20 miles over the posted speed – Security issues a summons to Orange County General District Court.

3. Assist the Sheriff with law enforcement matters. We have an excellent relationship with Sheriff Amos and his deputies. Our Special Conservators of the Peace (SCOP) Officers can enforce state law in a designated geographic area. County 911 will often dispatch Security to an emergency call here at LOWA, and Security can sometimes handle the concern before the Sheriff’s deputy arrives. An example is alarm activation calls. Security also assists with fire and emergency medical events. We facilitate a Neighborhood Watch group with Watch Captains throughout the Community to “observe and report” any suspicious activity. When asked by the Sheriff, we assist in getting the word out about an urgent public safety matter through our social media outlets.

What LOWA provides here for security is extensive. However, Lake of the Woods Association cannot guarantee your personal security. We have security measures such as screening visitors at the gate that deter crime, but we cannot completely prevent crime. No one can. Each of us has to take the precautions a cautious person would to protect himself/herself.

Member Petition Status

by Cliff Wilks, Vice President, LOWA Board  4 signatures were illegible and Address/Section/Lot# were missing, illegible or not identifiable.  6 signatures did not match the LOWA database or Orange County records for authenticity.  22 signers were not Members in good standing

At the Jan. 16 Board meeting, member Michael Balzano presented a box of petition forms to the Secretary of the Board.

The petition signatures were reviewed on Jan. 19 and 22 by the Board Secretary, Elections Committee Chair and LOWA Finance Department staff.

The Board Secretary and Elections Committee Chair presented the results of their review of the petition signatures at the Feb. 3 Board meeting. The petition process had begun in May of 2017. Of the 981 signatures on the petition forms, 765 were valid; 216 were invalid. The invalid signatures break down as follows:

Conclusion: the petition, as presented to the Board of Directors on Jan. 16, did not meet the requirements for calling a Special Meeting according to Article IV, Section 2 of the Association Bylaws. On Feb. 3, the Board of Directors voted to close the petition as not meeting the requirements of the Bylaws.

Reading is Delicious at Orange County Public Libraries!

The next LOW Vets meeting will be at 7 PM, Thursday, Feb. 22, in the lower level of the Clubhouse. The meeting’s program will feature the Wilderness Battlefield of the Civil War, and Ellwood Manor – the only remaining structure from that Battlefield.

Mark Leach, president of the Friends of the Wilderness Battlefield, will review the significance of our surroundings, activities of FOWB, and their plans for the future.

Right here in 1864, the Overland Campaign that ended the Civil War, started.

The Friends of the Wilderness Battlefield is one of the National Park Service’s most successful volunteer groups.

Leach will describe the group’s success in restoring Ellwood, as well as maintaining it and interpreting it for the public. FOWB is now recruiting volunteers for 2018, and Mark will have volunteer information available.

The meeting will also have a business portion to include voting on LOW Vets By-Law changes. Members will be briefed on club activities of interest. This will be an opportunity to catch up with friends, pay dues for 2018, and purchase club clothing.

New members are welcome, and the public is invited.

Carder has a BA from Randolph College in Art History and Dance. She has worked at FAM since July 2017. Prior to Rac this position, she was employed as a Curatorial hel C ar d er Assistant at the Maier Museum of Art in Lynchburg.

Melanie Johnson has a BA in Art History from the University of Mary Washington in 2012 and has worked at FAM since graduation. Her role as Development and Marketing Officer includes oversight of the Museum’s membership program.

The Lake of the Woods Church new season of monthly concerts continues with Modern Piano, featuring virtuoso Alina Kiryayeva on Saturday, Feb. 17, at 7 PM. “Praised for her powerful command of the instrument, unique interpretations and clarity of sound, Alina Kiryayeva captivates the audiences with her profound philosophical insight and charismatic stage presence,” one reviewer said.

A native of the Ukraine, Kiryayeva performed her first solo recital at age eight and her solo debut with an orchestra at the age of 11. First prize winner of the Senigallia International Competition, Italy, Kiryayeva has also claimed top prizes in piano competitions in the USA, including the Grace Welsh International Competition, and the California Young Artist International Competition. She was honored by the Ukrainian President with an “Achievement in Arts” award. Kiryayeva earned both B.S. and M.S. degrees from the Julliard School of Music with a full piano scholarship.

In 2013, she released a solo piano album Sonatas, which was featured on Women in Music on CKWR Radio in Ontario, Canada. Kiryayeva’s upcoming chamber music performances include appearances in the Steinway Series at the Smithsonian Museum and in the Library of Congress in Washington DC. There will be a Cookie Concerto reception, and a chance to meet with Ms. Kiryayeva following the performance. The James Madison Museum of Orange County Heritage is excited to announce a collaboration with Finders Keepers to present an appraisal fair fundraiser for the benefit of the museum. The event will be held on the museum grounds at 129 Caroline Street, Orange, on Saturday, May 19.

In the spirit of the PBS hit series Antiques Roadshow, the appraisal fair will offer attendees the opportunity to have a verbal appraisal of a variety of antique and unique treasures by a group of local experts while enjoying the beauty and heritage of the Town of Orange, the “Crossroads of the Civil War”. The museum is a presidential and cultural museum which preserves a wealth of historic objects related to the diverse history of Orange, as well as Presidents James Madison and Zachary Taylor.

The appraisal fair is anticipated to become an annual event.

This year, the event is being chaired by Finders Keepers (108 W. Main Street, Orange), purveyors of an eclectic blend of yesterday and today in their storefront, as well as offering all types of estate liquidation services. LOW Anglers: 2017 in Review

Low Anglers had a wonderful 2017, and we fully expect that 2018 will be as fun and as competitive.

Below is a brief recap of our year: May 6, 2017, we held our annual Veterans Fishing event, which is always a wonderful time for the veterans and the community. Thanks again for everyone’s support!

Team Lake Record was able to clinch the Anglers of the Year title by consistently finishing in the top five, (5 of 6 tournaments).

The Classic is held in October, and allows the top five teams for the year and the wild card winner to compete for the Classic Championship. In this contest, Team Lake Record (13.25 pounds) was overtaken by Team Kickin Bass (13.55 pounds).

This February, the 2018 schedule will be posted and published. New members are always welcome as well as volunteer support for our 2018 Veterans Fishing event.

The final audition for Play On is Sunday, Feb. 11 at the Community Center from 2 to 4 PM. The comedy has roles for 10 characters, seven women and three men. There are two young male and female characters, while the rest are middle to older ages. The comedy is a play within a play. The author keeps revising the script and interfering with actors who are trying to get their play rehearsed and performed.

Act one is a rehearsal of the dreadful show. Act two is the neardisastrous dress rehearsal. The last act is the actual show in which anything that can go wrong, does. When the author decides to give a speech during curtain calls, you will be treated to a madcap climax to this thoroughly hilarious comedy. If you like comedy, think about coming to the last auditions and reading for a part.

Play dates are April 20, 21, 22, 28 and 29. The 22nd and 29th are matinees.

Join the Players and help with all the duties associated with putting on this production. We meet on the second Wednesday of the month in Classroom 1 of the Community Center at 7 PM.

The existence of an autoimmune disease was not discovered until 1957, and it was not until the 1970’s and 1980’s that it was widely taught to be a disease in medical schools.

There are over 100 known autoimmune diseases. Some 70 million Americans have some form of arthritis. The chance of an individual having an autoimmune disease is double that of having cancer, and is higher than the chance of suffering from heart disease. Women are seventy-eight percent more likely to suffer from an autoimmune disease than from breast cancer. Women in their 40s, 50s or 60s are most vulnerable to common autoimmune diseases.

Those who know they have an autoimmune disease may have already been diagnosed by a doctor. However, many other individuals may suspect they have one of some type, based on their aches and pains. Having a family history of autoimmune diseases, including a daughter with rheumatoid arthritis, and a granddaughter with fibromyalgia, I know these diseases are crippling to one’s everyday life. Exercising CAN help!

If you have pain, stiffness, occasional swelling or difficulty moving a joint, exercise can help. Individuals with an autoimmune disease, or who have had knee, hip, shoulder or back problems will benefit from exercise.

Board Minutes

February 3 Minutes from p. 4 before the Board could spend money on any capital project costing $1 million or more. Such a restriction would include funds for new projects, reserve projects and even repair projects covered by insurance. Other HOA representatives also spoke against passage of this bill, and a couple of HOA residents spoke in favor of it.

President Cumming was pleased to report that the Committee voted 14 to 0 to “pass by indefinitely” the bill and send it to the Housing Commission to study the impact on HOAs. Vice President’s Report: No report.

Treasurer’s Report: Treasurer Bob Hoh addressed some of the financial and budget-related issues raised at the last Board meeting. His remarks focused on the Petition presented to the Board and the Finance Committee’s report which had good recommendations but lacked details on aspects of LOWA’s financial picture that he felt did not allow for a full analysis.

Mr. Rodenberg provided some highlights from the Budget Change Sheet which summarizes all the changes to the budget that were incorporated since the initial budget was released.

The revised proposed FY2018-19 Budget will be presented to the Board for a vote on adoption at their February 21 Board meeting.

A cost savings in our electric bill of $1008 per year will be realized when several electric meters at Campground A, which are no longer needed, are taken out of service.

Horner on a modified proposal for consideration at the February 21 Board meeting to include the following features: 1) Replacement and expansion of the Dining Room deck to include an approximately 8 x 64-foot addition to include Wolf Serenity Decking (composite) boards, repair and replacement of the existing iron railing and new iron railing as needed; 2) Replacement of the wood deck boards of the Grill Room and Members Lounge decks with the Wolf Serenity Decking (composite) boards and repairing/repainting of the existing iron railing; 3) Removal of the four trees inside the deck area; 4) Replacement of the light posts and fixtures with new light posts and fixtures with LED lighting and electrical outlets; and 5) Addition of propane fire pits will be procured separately by staff.

Director Clawson further requested the contract specify that the contractor use blind fasteners to attach the deck boards to the deck, and new brown lattice to go around the bottom the deck. This was accepted by the Board without objection.

6.4 Consideration of Approving a Stormwater Management Facility Maintenance Agreement and Authorizing the President to Sign on Behalf of the Lake of the Woods Association. (D-18-26) Motion by Wilks, passed unanimously, that the Board approve a Stormwater Management Facility Maintenance Agreement and authorize the President to sign on behalf of Lake of the Woods Association.

Each session, the Virginia General Assembly considers many bills that could impact Orange County, either positively or negatively. Before each legislative session, the Supervisors prepare a list of the county’s legislative priorities for submission to Senator Reeves and Delegate Freitas. We also provide inputs to the Virginia Association of Counties for the legislative priorities that VACo submits to the legislature as a whole. The general theme of both VACo and Orange County priorities addresses financial issues and local government’s authority to control its destiny.

For the upcoming 2018 General Assembly, Orange County has prepared inputs on about 20 separate issues. Some issues address adequate state funding for schools, teacher pensions, children’s services and at-risk family programs. There are also economic recommendations dealing with workforce development, tourism and business-attracting incentives which we have used successfully on several occasions recently.

We are supporting some current broadband legislation and opposing new legislation similar to that defeated last year that would seriously restrict the county’s ability to provide broadband to citizens throughout the county. We also oppose any effort to transfer responsibility for local roads to the county.

A continuing issue we address is the ability of the county to maintain its existing authority for decisions regarding land use and development.

Our priorities include two issues affecting school funding. The first addresses the Local Composite Index, which affects education cost sharing between the state and county. One of the LCI calculation components is the total value of real estate in the county. Counties that have higher values must share more of the costs. However, because much of the Orange County’s agricultural and forested land is under Land Use Taxation, the tax revenue is substantially reduced and therefore the LCI does not accurately reflect the county’s ability to fund education. We support legislation to adjust LCI calculation to reflect this. The second school funding issue addresses the cost of competing for highly qualified teachers. Surrounding counties receive an adjustment for higher costs, but Orange County does not. We are recommending that we receive the same adjustment.

Virginia has an Invasive Species Management Plan that needs better funding. At my request, we made support for adequate funding of this plan one of our priorities for consideration by our legislators.

If you look at a map of Orange County, you will see a straight line separating Orange County from Spotsylvania County. The precise location of that line has not been determined. Even the end points are not precise.

A number of years ago, the Supervisors considered conducting a survey to determine its precise location. However the expense was considered prohibitive. The line crosses a number of parcels that would appear to be in two separate counties. For many years, the Commissioners of Revenue of the two counties have had an agreement on which parcels would be taxed by each county. This makes the boundary as seen for taxation purposes as a jagged line that follows parcel boundaries. This situation has been satisfactory, but now that some land use issues such zoning or parcel division have arisen, it is time to more precisely determine a boundary.

There is current legislation that allows the use of the Geographic Information System for boundary determination and as a legislative priority both counties have requested that we be allowed to use the GIS legislation. A bill to permit that is progressing through the legislative process. Once that bill becomes law, the counties will have to agree on a new, but jagged, boundary.
