Equestrian Center Dog Festival

Welcome Back to the Clubhouse

by Melissa Zukowski, Equestrian Operations Assistant Manager Here at Lake of the Woods Equestrian Center, if there’s one thing we love more than our ponies, it’s our dogs. If you swing by for a visit, there is a good chance you’ll meet one of management’s fine Dog Assistants- Layla, Cooper, CJ, or Sasha. We are all happy to announce the return of the Lake of the Woods Equestrian Center Dog Festival.

On April 28 from 11 AM to 4 PM, we will be hosting a whole pack of canine friends. Our local SPCA and various dog rescues will be on site to help find forever homes for dogs in need.

The Orange County Sheriff’s Department will host demonstrations of their K-9 partners’ abilities in the covered arena at 1:30 PM. Our equine friends will also be available for $5 pony rides from 11 AM to 1 PM and again from 2 to 4 PM. Come join us in celebrating all of our four-legged friends! All dogs are welcome to attend, but please remember to bring a leash. Give us a call with any questions at 972-2238.

by Ryan Richardson, Clubhouse Manager There are a lot of things going on at the Clubhouse this spring including Easter Brunch on April 1, Mother’s Day Brunch on May 13 and the deck grand re-opening, just to name a few.

We have enhanced our menus, to include daily and monthly specials along with the always-tasty Prime Rib Nights on Friday and Saturday. If you are more into fish and seafood, our raw bar with local oysters, clams and shrimp is a favorite of the membership, or you can let Chef Robert tempt your taste buds with his fish and seafood specials. Come on in to the Clubhouse, and give it a try; you will LOVE it!

Sunday brunch (the best deal in town - $13.95 for adults and $7.95 for kids under 10) continues every Sunday from 10 AM to 1 PM with carving, omelet, and waffle stations.

Starting April 15, we will be hosting Family Night Buffets featuring different themed buffets and continuing every third Sunday of the month from 4 to 7 PM - $11.95 for adults and $6.95 for kids under 12; this month’s menu will include Clubhouse Fried Chicken, Mac and Cheese, green beans with red peppers, pasta and potato salads with cookies and brownies for dessert! Bring the family out for dinner at the Clubhouse!

The deck is being replaced and expanded this spring to accommodate more seating and live music. The Summer Concerts on the Point will return on May 25 and will continue on the fourth Friday of every month.

The incredible Lake of the Woods Independence Day Celebration, with the best fireworks display in central Virginia, is scheduled for July 7.

Early Boat Registration Ends March 31 There’s still time to get your boat registered early. Member Services is open Saturdays, from 9 AM-1 PM; and Mon-Fri, from 8:30 AM-5 PM. Decals are available for motorized (pink) and non-motorized (blue) watercraft.

Please bring your letter with you when registering your boat. Attach one decal on each side of hull at forward end of the watercraft so that decals are clearly visible. Decals must be affixed to and displayed on watercraft in the water, on canoes and kayaks on LOWA racks, or in the designated Dry Sail Parking area by May 1 to avoid a potential summons. (Reference LOWA Regulation X.B.1).

We recommend that after buying the decal, you apply it immediately to your boat.

The Easter Bunny has his boat decal, and so should you. Hop to it!

To give you an idea of the potential effect of the proposed referendum, we need to look at what the effect would have been on some prior projects if the referendum had been in effect then. The proposed referendum would require 2,129 member votes in favor of any project requiring an expenditure of $500,000 or more. No source of funds is specifically exempted by the referendum, so using funds from assessments, reserves, insurance, gifts, etc., over the $500,000 threshold, would trigger a requirement for a favorable vote by 2,129 members.

One example from the past is the replacement of Sweetbriar Pool, which was seriously damaged in 2016 by being drained too quickly by the pool management company we were using at that time. It didn’t make business sense to repair the multiple cracks in the pool, so a replacement was necessary.

Insurance covered over $500,000 of the replacement cost, with the remaining cost covered by various reserves. Spending the insurance money alone would have required a member vote. It is doubtful that enough members would have voted in time for the pool to have been replaced for the 2017 swim season.

There have been some statements that Lake of the Woods doesn’t need two pools. On the contrary, both pools are heavily used. The only way we managed the summer that Sweetbriar Pool was closed was that everyone cooperated in taking turns using the pool. That cooperation included groups like swim team members and water aerobic exercise participants, plus people just swimming for fun. The only way we could manage permanently with just one pool would be if we had one much larger pool with considerably more parking than we have now.

4. MEMBER COMMENTS ON UNFINISHED BUSINESS AND NEW BUSINESS AGENDA ITEMS

Construction of the Community Center was another large project which would have triggered a required member vote if this referendum had been approved at the time of that project. There was enough controversy about building the Community Center that the amount of time required to get the number of votes could have delayed the project for a very considerable time. It’s hard to imagine how we would manage today without the Community Center. It is used for everything from Board and committee meetings to plays and pickleball.

As time goes by, construction costs will likely increase. More projects will meet the $500,000 threshold, triggering the requirement for a favorable member vote before the project can proceed, resulting in delays for significant repairs and replacements.

ECC Approval Needed for Structures or Improvements

Spring is just around the corner, and many of us will be turning to outside projects. Before you buy or build outside items, please be aware of our Restrictive Covenant 5A which states the following: “All plans and specification for any structure or improvement whatsoever to be erected on or moved upon or to any lot, and the proposed location thereof on any lot or lots the construction material, the roofs and exterior color schemes, any later changes or additions after initial approval thereof and any remodeling, reconstruction, alterations or additions thereto on any lot shall be subject to and shall require the approval in writing before any such work is commenced of the Environmental Control Committee.”

Secchi Depth at Keaton’s has improved from 1.82 feet in July 2013 to 4.11 feet in July 2017.

We credit much of the improvement to our roadside ditch program and structural projects.  Keaton’s Lake = 38,349 feet reconstructed roadside ditches; two structural projects completed: 13th Fairway Stream Restoration, and Eastover Park Water Quality Retrofit; one structural project in design: 14th Pond Project. In 2017, we did not need to treat Keaton’s Lake for harmful blue green algae, after having two treated outbreaks a year from 2013-2016.  Main Lake = 20,917 feet reconstructed roadside ditches; with the first structural project (Flat Run Forebay) in design.

We see several promising signs, but we recognize we have much work left to do. Nitrogen and phosphorous levels remain high in the lakes.

Over the past three years, Total Nitrogen has been higher than the EPA recommended level. The Main Lake has averaged approximately 2.5 times the EPA standard, and Keaton’s Lake has averaged approximately 3 times the EPA standard.

Over the past three years, Total Phosphorous has also been higher than the EPA recommended level. Both Main Lake and Keaton’s Lake have averaged approximately 3 times the EPA standard. However, 2017 Total Phosphorous results for Keaton’s Lake are healthier than comparative 2016 Total Phosphorous results.

Q. What is the status of the Flat Run Forebay on the Main Lake?

A. In design. LOWA is pursuing an alternative, “in lake” approach to catching sediment and pollutants. On April 18, the Environmental Resources Manager will brief the Board of Directors on his work with an environmental engineer on a conceptual plan. The project to build a

I hear from members who would like a status report on our Lakes Management Implementation Plan (LMIP) designed to improve the health of the Main Lake and Keaton’s Lake (aka Fishing Lake), and who would like to see progress on the LMIP during the Clubhouse Area Recreation Complex Project. The LMIP is being advanced, and I wanted to share some of the answers provided to inquiring members.

Board Seeks Member Comments on Proposed Amendment to LOWA Bylaws Article X: Committees The Board of Directors proposes to amend the LOWA Bylaws Article X, Committees, and seeks member input on the proposed changes. Members are asked to review the proposed changes and are welcome to forward written comments on the proposed amendment to the board by April 28. Comments may be emailed to: board@LOWA.org.

What is the proposed amendment and why: The amendment specifies that three types of committees may be appointed by the Board of Directors: Required, Standing, and Special (or Ad Hoc). It spells out the characteristics of Ad Hoc committees, and adds some additional requirements for committees, including the requirement that a committee publish its business agenda, three days prior to any meeting, on the Association web site, and places the responsibility for timely submission of the agenda to the Communications Manager on the committee chair. It also reorganizes the existing article to consolidate liability indemnification into a new section 11.

Who proposed it? The GM and the LOWA attorney recommended the Board modify the bylaws to recognize the existence and characteristics of Special (Ad Hoc) committees in addition to the required and standing committees, and the Rules Committee also joined in this recommendation. In addition, the Board added the requirement to publish committee agendas prior to meetings and of locating the liability indemnification language into a separate section. The Board, at its March 3 meeting, voted to publish the proposed amendment in Lake Currents for member review and comment.

The overall mission of Lake of the Woods Committees is to add value to the Association by advising and assisting the Board of Directors and the General Manager in carrying out their responsibilities to the Association. Their specific responsibilities and special characteristics or exceptions, if any, shall be delineated in their respective charters and approved by the Board of Directors. The Board may appoint or dissolve any committee as it deems in the best interest of the Association, except that the following committees contemplated by Article II.6 of the Articles of Incorporation, shall be required: a. Environmental Control Committee (ECC). The specific powers and duties of this committee are granted and set forth in the Declaration, as amended. In addition, the Board may assign other duties and procedures to the committee which, in the opinion of the Board, will benefit the Association. (i) Composition: The committee shall be composed of not more than seven (7) members but not less than three (3) members in good standing appointed by the Board of Directors for three-year staggered terms. After completing one three-year term, a member may be re-appointed for a second three-year term, but may not thereafter be re-appointed again until after the lapse of one year. However, a member appointed to fill an unexpired term may then be appointed and/or re-appointed to serve two consecutive terms.

Any vacancy on the committee shall be filled through appointment by the Board to serve out the unexpired term (ii) Liability: The members and former members of the ECC shall be indemnified, at Association expense, to the extent of coverage under the Association’s Directors and Officers Liability Policy, against expenses actually and reasonably incurred by them in connection with the defense of any claim, action, suit or proceeding against them by reason of being or having been such member. b. Finance Committee. The purpose of the Finance Committee is to advise the Board on financial management and policy issues, and to provide to the Board financial analyses and projections to aid the Board in managing the efficient and effective use of the Members’ annual assessment and the other fees paid by the Members of the Association.

As the population of Lake of the Woods increases, so does the number of pet companions in our neighborhoods, creating increasing amounts of waste.

Pathogens are a great concern associated with pet waste. These pathogens can be harmful to humans if accidently ingested by swallowing lake water, or consumed in foods from our gardens after rain runoff spreads the pathogens from the waste all around.  Pet waste can carry microbes such as Salmonella, and E. coli. These can cause abdominal gas, diarrhea, and even more serious illness. They may even be fatal to those with weakened immune systems.  Pet waste, especially dog waste, often contains roundworms, hookworms, ringworms, tapeworms and other parasites.  Cat waste can also contain Toxoplasma gondii, which are highly resistant to most disinfectants. Toxoplasmosis is a serious health concern for pregnant women and also those with compromised immune systems.

Studies performed on watersheds in the Seattle, Washington, area found that “nearly 20 percent of the bacteria found in water samples were matched with dogs as the host animals.” (USOW, E.P.A, July 2001) Pets should not be allowed to defecate near streams, ponds, or lakes.

Stream banks should not be the normal territory of our pets. Walk pets in grassy areas, parks, or yard. Don’t leave waste near the road or ditches. It can get washed down the ditches and eventually could make it to our lakes.

LOWA Regulation IV.B.8 states: “Pet owners shall be responsible for the removal of their pet’s droppings from LOWA grounds, road rights-of-way and also for removal of any pet droppings on their own lot which may accumulate and thereby cause an offensive odor or unsanitary condition.”

Don’t leave it on your lawn. Rain runoff can spread it to gardens and also to the roadside ditches and drainage easements which flow to our lakes.

Pet waste can also lead to a buildup of excessive nutrients. In a lake, the nutrients cannot be carried away (unlike in moving water like a river or stream). This excess can cause thick mats of algae, scum and foam, odor and taste problems and death and disease of fish and other aquatic organisms.

An increase in the water’s pH as a result of the increased growth of algae is another impact that is not directly visible. High pH can be toxic to fish and other organisms, it can also make other substances, such as ammonia, even more toxic than they otherwise are.

These overgrowths of algae and aquatic plants such as Nitella and Hydrilla cost L.O.W.A. time and money in the effort to minimize these effects.

Approximately $13,000-$17,000 is spent most years on aquatic algaecides, and herbicides (overgrowth dependent).

The most effective way for pet owners to minimize the impact of pet waste on the lakes and also on vegetable gardens is to simply clean up and dispose of the pet waste.  Slide a plastic newspaper bag, grocery bag, or disposable glove over your hand and arm, carefully pick up the poop, then roll the bag down your arm and tie the doggy doo inside for disposal in the trash.  Another way of disposing of pet waste is to purchase or build your own doggy loo. A doggy loo is a pet waste digester installed in the ground where decomposition can occur. For around $90 you can purchase a model such as the “Doggy Dooley kit.” It contains a galvanized steel tank with a polymer lid, a supply of digester powder containing bacteria to speed up decomposition, a long-handled scooper, and an odor-eliminating solution.

3.5 Report from Orange County School Board Representative Jim Hopkins reported the School Board has received 21 applications in their search for a new Superintendent of Orange County Schools, and expects to receive more before the March 15th deadline for submissions. He provided the Board with a summary of the security measures the schools employ on a regular basis to insure student safety, including security guards, police officers and building security protocols.

The County Administrator has submitted his budget recommendations, which did not include a tax increase. Last week, FEMA issued updated flood plain maps in the County which now include LOW topography not included in earlier maps. Mr. Frame said he would inquire as to the reason for the addition of LOW to the flood plain maps.

3.2 Report from Orange County Sheriffâ&#x20AC;&#x2122;s Office: No report available.

3.3 Report from Allied-University Security Chief Scott Walker said that statistics for February are not yet available but overall it was a quiet month. Staff was kept extremely busy yesterday responding to calls reporting fires, a loose boat, downed trees and power outages from the very high winds that hit our area.

Search for Board of Directors Candidates Begins

by Nancy King, Secretary, Nominating Committee Consider becoming a candidate for the LOWA Board of Directors. We have one vacancy with 1-year unexpired and two vacancies with 3-year terms to fill, so we are seeking a minimum of five candidates to run for the three vacancies.

To be qualified, candidates must meet the requirements of LOWA bylaws; article V.1., which states â&#x20AC;&#x153;shall be a member in good standing, elected by the Members in good standing. A Director shall not have a conflict of interest as defined by the Virginia Nonstock Corporation Act, and, before election, shall sign a statement attesting that he/she has not been convicted of a felony.â&#x20AC;?

A member in good standing is evidenced by having a name on the deed, deed of gift, or other qualified conveyance or distribution as recorded in the Orange County Courthouse; and by being current in all LOWA finances.

The deadline for submitting applications is 4 PM on April 30. The official application can be downloaded from LOWA.org or obtained as a hard copy at Member Services in the lower level of the Holcomb Building. Completed applications must be submitted in hard copy to the General Managerâ&#x20AC;&#x2122;s office. Please see the March 9 Lake Currents issue for more details. The Nominating Committee is available to answer questions from applicants.

Special Community Discussion Guidelines Regarding the Petition-Initiated Referendum These unsolicited letters are being shared with the community in an effort to help voters make an informed decision. Lake Currents will be featuring this special section in the next issue, April 6. Any member in good standing may submit a letter. Letters must not exceed 300 words and must follow all other Viewpoints Guidelines. In fairness to all, letters submitted for this section may not be submitted prior to the deadline date, March 26, but must be submitted on that date. Message to LOW Members

We, the below listed past LOWA presidents, strongly oppose the proposed change to the LOWA Covenants. We are not advocating for the CARC Project as we see the CARC Project and the covenant change as two entirely separate issues. Combining these issues clouds the serious impact that the covenant change will have on the future of Lake of the Woods. Some of the reasons for our opposition include: The LOWA Board of Directors has the fiduciary responsibility and legal obligation to maintain the infrastructure and property values of Lake of the Woods. Although individual members pay for this, it is the Board who can be held responsible and sued for failure to do so. Some significant upgrades to facilities are necessary to remain competitive in the housing market and protect property values. If the Virginia state government required some corrective action on one of our dams that exceeded the dollar value limit, such action could be delayed resulting in fines or other penalties. The $500,000 limit will preclude more and more new and replacement projects as inflation eats into that limit. The LOWA difficulty in getting the required percentage of votes for even widely accepted changes, such as eliminating the right of first refusal, would preclude getting approval for any significant maintenance or upgrade necessary to maintain property values.

In conclusion, we recommend that you vote NO on the referendum to require membership vote on expenditures of $500,000 or greater.

In spite of the interference of the General Manager and members of the Board, over one thousand members have signed a petition to cap spending on new programs without a referendum. The Board is now engaged in a campaign to convince the members that if the referendum is approved, the Board will not have the ability to make needed repairs, replace worn-out facilities and amenities, or deal with emergencies. That is simply not true.

The governing documents of our Association clearly list the powers of the Board to manage the finances and operation of our Association. Article II of the Articles of Incorporation and Article 12, sections A through D, of the Declaration of Restrictive Covenants guarantee the present and future Boards every conceivable power to operate and maintain all LOWA facilities.

The Board clearly has the authority to levy assessments accordingly.

The signatures of the petitioners now before the Board are not challenging the power of the Board to replace an amenity, but to create a new expenditure without approval. If needed, the current Clubhouse pool can be replaced in its current location for little more than $1 million, but the Board has elected to move the pool 200 yards at a cost of $5+ million without the approval of the membership.

At the heart of the petition is the Board’s refusal to hear the pleas of homeowners not to place an undue burden on their finances for an unnecessary project most members do not want.

PLEASE VOTE “YES” TO APPROVE ON THE BALLOT SENT TO YOU REGARDING THE AMENDMENT.

Q. How did the proposed amendment to the Declaration of Restrictions get on the ballot?

A. Members of LOWA worked over a period of eight months to collect signatures for a petition. The initial list of names submitted with the petition fell short of the 800 valid signatures required, but a supplemental list brought the count to 805 and automatically triggered the referendum.

Per LOWA Bylaws, Article IV, Section 2: A Special Meeting of the Members of the Association may be called at any time by the President, or the Board of Directors, or upon written request of eight hundred (800) of all the Voting Members of the Association who are eligible to vote. A Special Meeting shall also be called to close referendum voting on amendments of the Articles of Incorporation and Declarations.

LOWA, through its trusted agent Vote-Now.com, emailed and mailed proxy ballots to all members on March 5 for the Special Membership Meeting called for April 24 at 7 PM in the Community Center LOWA is a nonstock corporation and uses proxy ballots mailed ahead of the meeting and ballots received at the meeting to determine whether the amendment will be approved or disapproved.

Q. What does the amendment do?

A. The amendment creates a new requirement for the Board of Directors to seek majority member approval for any capital project of $500,000 or more, regardless of whether it is for a new or replacement capital project. If approved, the specific language of the petition will be added to and amend the recorded LOWA Declarations of Restrictions as a new Section 12(H). The language from the petition (below) is printed on the ballot verbatim and cannot be altered in any way.

The Board of Directors shall obtain majority approval (50%+1) of LOWA Members for expenditures of $500,000 or more for any new capital, replacement capital or improvement capital project.

Q. Why is the Board opposing the amendment?

A. The Board voted unanimously to oppose this referendum proposal for the following reasons: 1. Scheduled and emergency repairs/replacements of large assets (Lakeview Parkway, lakes, dams, golf course, and swimming pools) must await “majority approval,” which is 2,129 of all 4,257 lots 2. Large emergency repairs must await majority approval even though we have millions in insurance coverage to responsibly handle the situation. If the Veterans Dam was damaged by a hurricane, can you imagine waiting for membership approval?

3. The proposed limit may seem like a lot today, but it will be even more limiting as time goes on.

4. Member participation in Board elections has been 30 percent for the last five years. LOWA will have to plead with members to vote at the 50 percent level.

5. Delays in LOWA’s ability to make necessary replacements could decrease our property values.

Q. Will the amendment affect the CARC Project?

A. Possibly. It depends on the outcome of the April 24 Membership Meeting.

Q. How many votes are required to approve the amendment?

A. The number of votes required to pass the petition referendum is the same as would be required for members to approve spending. Passage would require a majority of the lot owners (50 percent + 1), which is 2,129 of the 4,257 lots.

by William Logan, LOW Member The Lake of the Woods Governing Documents established, in its foundation, provisions to allow for modifications. The Bylaws can be amended by the Board of Directors without referendums; however, the Declarations of Restrictions (Covenants) must be changed through referendum by the Board of Directors or by members. The petition language “to amend the LOWA Declarations of Restrictions and Bylaws to read” was designed to avoid potential conflict between the documents. The collection of 800 petition signatures, as required by the bylaws, fulfills the requirements to demand that the Board of Directors schedule a Special Meeting of the membership to vote for these modifications to the governing documents.

In June 2017, members that were deeply concerned about the yearly increases in the assessment due to years of spending policies of the Board of Directors began a petition drive to limit spending of the Board to $500,000 on any new capital, replacement capital or improvement capital project without the approval of the members, using the existing mandated governing document voting requirement of 50 percent + 1 lot owners. The Board, with the assistance of the LOWA security forces, reacted by placing restrictions, limitations, constraints and roadblocks on the petition organizers to collect the necessary signatures requiring some 8 months to complete this requirement.

In February 2018 the petition, containing more than 1,000 signatures were submitted to the Board for certification by the secretary. Only 765 signatures were certified, with the Board then refusing to accept any further signatures. This decision was overturned two weeks later and the additional signatures were obtained to meet the certified 800 signature requirement. On March 2, 2018 the Lake Currents contained an article by the Board President stating that the Board did not agree with the referendum. On March 5, 2018 the Board began mailing ballots for the referendum, sending out emails opposing the referendum, sending letters with an attached opinion statement from the attorney representing the association & members mirroring the Board letter opposing the referendum. The opinion by the LOWA attorney, which neglected to consider the provisions of the Bylaw’s, provided no legal precedent or case history for their opinion.

All members have a right to one vote per lot including the members of the Board. That right should include an open vigorous campaign to debate and discuss the merits of the referendum. This campaign going forward should be waged on a “equal and level playing field” including but not limited to equal space in the Lake Currents, display of signs and advertising, equal access to email communication and equal paid first-class mailings.

General Manager from p. 3 forebay (before the lake) was put on hold in 2017 when LOWA found out from Rapidan Service Authority there are significant utilities that would be prohibitively expensive to relocate in the Flat Run drainage area next to Back Gate Drive.

Q. Is the Flat Run Forebay Project adequately funded?

A. To be determined. The Board has already authorized $138,000 for the project. We will not have the new estimate until a new approach is designed by our environmental engineer and approved in concept by the U.S. Corps of Engineers. The amount may be enough, but construction costs have been increasing in the current economy.

Q. Is it true Rapidan Service Authority owns Back Gate Drive?

A. False. LOWA owns the roadway as evidenced by the recorded plat. We have since 1982. RSA concurs. Some members thought RSA owned the road after seeing an Orange County GIS map that seems to indicate the RSA property line goes onto a portion of the road.

Q. Which LMIP Projects are advancing and which projects are delayed?

A. Flat Run Forebay and the 14th Pond Retrofit Projects are in design.

Culp’s Cove Stream Restoration Project has been scheduled for 2024/2025 and 15th Fairway Drainage Project is scheduled for 2026 to allow time to complete the current LMIP projects and build back up our replacement reserve.

Q. What is the status of the 14th Pond Project to benefit Keaton’s Lake?

A. In design. We will be scheduling meetings in April and May to review the design with all the stakeholders including the Golf Committee and adjacent owners. The 100 percent design and approvals goal is late June/ early July, with competitive bidding for construction services to follow. We anticipate project completion in January 2019, about five months after award of contract.

c. Legal and Compliance Committee (LCC). The LCC functions as the regulation enforcement arm of the Board. The LCC holds hearings and resolves allegations of violations of the Declaration and Rules and Regulations established by the Association. d. Maintenance and Ecology Committee (M&E). The M & E Committee assists the Director of Facilities and the General Manager in evaluating the physical condition of all Association-owned facilities, grounds and equipment.

From time to time the Board may establish and appoint special (or ad hoc) committees to advise the Board on specific projects, needs or issues. The Board may appoint as many Members in good standing to serve on a Special Committee as it deems necessary. The Board may also appoint the General Manager and key Management staff to serve as nonvoting members. In establishing a Special Committee, the Board shall state the Special Committee’s assignment and an expected end date to complete the assignment. In any event, the Board shall have the authority to change the Special Committee’s assignment and/or dissolve the Special Committee at any time. The Special Committee shall remain established until dissolved by the Board. The Board shall also have the authority to remove and/or replace Special Committee members at any time.

Unless otherwise provided in the Declarations or as required by law, all committees function as advisors to the Board and have only that specific authority granted to it by the Board as outlined in the Committee Responsibility Section of its charter. Under no circumstances shall the committee Chair or any other committee member give direction to any LOWA personnel in dealing with committee matters except as approved by the General Manager. Additionally, no personal financial gain shall accrue from service on a LOWA Committee, except that requests for reimbursement of direct expenses, with receipts attached, may be submitted to the GM with the approval of the committee Chair.

Section 3. Reporting Responsibility. The committees report to the Board. In addition to committee meeting minutes, oral and written reports shall be given periodically at the Board’s monthly meeting at least as often as specified in the committee charter. When a committee approves a motion requesting Board action, that motion will be forwarded in writing to the Board with a copy to the General Manager. A brief annual report of the committee’s activities during the preceding year shall be submitted to the Board by August 1 of each year, using a Board approved format.

Section 4. Composition. Unless otherwise provided in the Declarations or as required by law, the provisions of this Section 4 shall apply to all committees. All committee members shall be appointed by the Board from LOWA Members in good standing. Each committee shall be composed of not less than seven (7) voting members appointed for three-year staggered terms. A committee may have as many alternates and advisors as needed to perform committee activities, as requested by the Committee Chair, and as approve by the Board. Any voting member vacancy whether by term expiration, resignation, or removal shall be filled through appointment by the Board with the Chair’s recommendation. Family members occupying the same LOWA household may not serve on the same committee during the same time period. The Board may also grant exceptions to the number of voting members who may serve on a committee at any given time, based on the needs of that committee to carry out its mission. Such exceptions shall be stated under “Special Characteristics” of the respective Committee Charter. A member of the Board may serve as liaison to a committee without voting privileges.

The purpose of the Lake Patrol is to use regulations and enforcement to provide a safe environment for those enjoying the lakes. It also assures that only registered watercraft use the lakes and facilitates an enjoyable recreation experience where one user does not unduly interfere with other approved uses.

We want to tell the community what to expect from the patrol in this boating season. Some things will change. Some will remain the same.

Things remaining the same include:  Continuing to educate boaters in correct boating practices and procedures. The primary method is stopping boaters observed making mistakes and explaining to them what they are supposed to do for safety and regulatory compliance.  Responding to emergencies.  Managing crowded situations, such as Concerts on the Point and Fourth of July fireworks.  Issuing summons to boats not displaying current registration stickers and to power boat operators who have not passed the Lake of the Woods boating test.  While the Lake Patrol boat will not be on the lake every hour of every day, there is enough randomness scheduled so that no one can predict when the boat will not be there.

On Saturday, April 7, we will be selling used golf clubs for $5 each or a set of used golf clubs for $25. All monies raised will go to LOWA’s PGA Junior Golf Leagues. The sale will be from 9 AM to noon.

On April 9 through 13, we will be offering our Ladies Beginner Golf Classes. These are beginner classes. Classes will be from 4-4:45 PM / 5-5:45 PM. Class size is limited to six students per class. During the class, we will cover the grip, stance and posture, putting, chip shots, pitch shots, irons and woods. We will also cover LOWA local rules and the etiquette of the game. Cost will be $50 per student. Please sign-up in the Pro Shop or call the Pro Shop for more information 972-2230.

On April 13, we will be hosting a Commuter Golf Outing starting with a shotgun start at 6 PM. Cost is $5 per player, including golf, cart, pulled pork barbeque, and soft drink. Long commute? Pressed for time but still want to play golf? Stop by the Pro Shop to sign-up for our Commuter Golf Outing by April 11.

In 2018, there will also be some changes. These include: o In response to verified reports of reckless boating last year, such as boating under the influence and towing tubers at 9 PM, emphasis will be on trying to catch and issue a summons to reckless boaters. o Also, in response to many verified reports of violations of rules prohibiting certain activities between sunset and 7 AM last year, there will be an emphasis on curtailing those practices, including operating personal watercraft, towing skiers and/or tubers, and exceeding applicable speed limits. o Boaters stopped for routine violations of boating rules may be asked to show the officer the safety equipment required for their boat. (PFDs, fire extinguisher, throw cushion, etc.) o Boaters stopped for repeat violations are more likely to receive a summons than another warning.

March 30: Welcome Home Vietnam Veterans Day

In 2009, the Veterans Affairs Committee of the Virginia Ancient Order of Hibernians, in tandem with other like-minded Virginia organizations, proposed legislation to obtain formal recognition for Viet Nam Veterans residing in the Commonwealth. Former Virginia delegate Ed Scott (30th District) co-sponsored the legislation.

In January and March 2010, the House of Delegates and the Senate, respectively, agreed on House Joint Resolution Number 136 to designate “March 30, in 2010 and in each succeeding year, as Welcome Home Viet Nam Veterans Day to celebrate the service and numerous contributions of the Commonwealth’s Viet Nam-era veterans”.

The proclamation notes that the war was a divisive issue in the United States, and that many members of the Armed Forces were deprived of public support and appreciation for their patriotic service. It further states “it is never too late to say thank you” to our Viet Nam veterans.

The proclamation encourages recognition of the day with ceremonies and activities that promote awareness of the numerous contributions made by veterans who served in Viet Nam. Today, approximately 262,000 Viet Nam veterans reside in the Commonwealth.

year for a one (1) year term and forward its new structure to the Vice President of the Board with a copy to the General Manager: a. Chairperson (Chair). The Chair is responsible for calling and conducting meetings, setting and submitting the agenda, and periodically, providing written and oral reports on committee activities to the Board and community as specified in the committee charter. The Chair must be a voting member of the committee. b. Vice Chairperson (Vice-Chair). In the absence of the Chair, the Vice-Chair performs all the duties of the Chair. Vice-Chair must be a voting member of the committee. c. Secretary. To be elected by the voting members of the Committee, or in absence of a vote, may be appointed by the Chair. The Secretary takes the minutes of all meetings, submits them in draft form to all Committee members.

Following approval by the Committee, the Secretary submits the approved minutes to the Board of Directors, General Manager, Communications Coordinator, and all Committee members. In the absence of both the Chair and Vice-Chair, the Secretary shall act as Chair pro-tempore.

Section 6. Meetings. The following apply to all meetings of the LOWA committees: a. Open Meetings. Subject to Section 55-510.1 of the VPOAA, all committee meetings shall be open to all members. Minutes shall be recorded and shall be available to all association members. b. Executive Sessions. Committees may convene in executive session for a period during any meeting in accordance with Section 55-510.1 of the VPOAA.

c. Notice of Meetings. Notice of the time, date and place of each meeting of a committee shall be published at least three (3) business days in advance in a manner where it is reasonably calculated to be available to a majority of the Lot Owners. d. During a meeting at which the agenda is limited to specific topics the comments of members may be limited to the topics listed on the meeting agenda. e. Electronic Participation. Section 54. Composition. Unless otherwise provided in the Declarations or as required by law, the provisions of this Section 54 shall apply to all committees except Special (Ad Hoc) Committees. All committee members shall be appointed by the Board from LOWA Members in good standing.

The Board in its sole discretion, may remove a committee member with or without cause. Unless otherwise set forth by the Board in the committee charter, each committee shall be composed of not less than seven (7) voting members appointed for three-year staggered terms. A committee may have as many alternates and advisors as needed to perform committee activities, as requested by the Committee Chair, and as approved by the Board. Any voting member vacancy whether by term expiration, resignation, or removal shall be filled through appointment by the Board with the Chair’s recommendation. Family members occupying the same LOWA household may not serve on the same committee during the same time period. The Board may also grant exceptions to the number of voting members who may serve on a committee at any given time, based on the needs of that committee to carry out its mission. Such exceptions shall be stated under “Special Characteristics” of the respective Committee Charter.

A member of the Board may serve as liaison to a committee without voting privileges as a non-voting member.

Section 65. Organization. EachThe committee (with the exception of the Special (Ad Hoc) Committees) will elect the following officers from its committee members during its first meeting in September of each year for a one (1) year term and forward its new structure to the Vice President of the Board with a copy to the General Manager: a-c “Officer Role Descriptions” remain the same.

Cause 4 Paws, a 501c(3) non-profit feline rescue organization, is kicking off our fundraising season at the Lioness Flea Market, Saturday, March 24. We will be at the Locust Grove Middle School, located at 6368 Flat Run Road, off Route 20 from 8:30 AM to 2 PM. We will have t-shirts, animal-themed jewelry, dog & cat items and lots of yard sale items.

Proceeds help us to continue our mission of providing veterinary care to homeless felines, and placing them in their forever homes.

Become a ‘Knight of the Blind’

Let’s hope that the nasty weather is finally behind us and we can look forward to some nice spring days out on the course. Be sure to sign up for the Opening Scramble on Tuesday, April 3. This is a fun event where the foursomes are made up of both 9 and 18 holers. Remember that the shotgun start time for the month of April is 9 AM, and you should check in by 8:30.

The 9 holers are hosting an invitational on Friday, April 27. Look for the sign-up sheet in the ladies’ lounge at the Woods Center. The deadline to sign up is April 13. Any 18 holers willing to help out that day, please contact Dorothea Barnes.

The LGA is always looking for new members. It is an active group of lady golfers of all abilities. We have an organized game every Tuesday, April through October. There is an 18-hole group and a 9-hole group. The games vary from fun foursome games, such as scrambles, to individual tournaments where you compete with others in your flight. If you have any questions about membership in the LGA, contact LGA President, Kathy Smith at 972-3093 or via email at kunze1471@comcast.net.

Helen Keller challenged the Lions to become “Knights of the Blind in the crusade against darkness” in 1925. The Lions accepted her challenge, and our work ever since has included sight programs aimed at preventable blindness. The Lions Club International Foundation, our charitable component, provides grants to prevent river blindness, measles, and diabetes and supports advanced research all around the world to combat vision problems using advanced gene therapy techniques.

Our LOW Lions conduct vision screening in the schools, recycle eyeglasses for use by the visually impaired all around the world, and promote vaccination and diabetes information to prevent blindness. Our last dinner meeting featured Lion Vrla Leach who is our Lions of Virginia coordinator for the Leader Dogs for the Blind program. This critical program raises puppies and trains dog to support the visually impaired and educates those with vision problems in working with their guide dogs.

Our LOW Vision Support Group provides a forum for neighbors with vision issues to share problems and solutions, and to bring in experts to offer advice. It meets on the first Tuesday of each month at 10 AM in the Community Center. Our last meeting featured Holly Frisch, the founder and president of Volunteers for the Blind, who described the many services that local volunteers provide to neighbors by helping them read medical bottles and food boxes, assist with shopping and transportation, and other incidental support. At our April 3 meeting, Kristi Moore will describe NuEyes Smartglasses which electronically enhance low vision with variable magnification and contract and a text-to-speech capability.

How can you help? Please consider joining the LOW Lions and become a Knight of the Blind supporting our vision and other community service programs. Board Minutes

March 3 Minutes from p. 6 Director Zukowski said that the Lakes Committee voted to ask the Board to seek a legal opinion on the need for hand rails at beaches with bulkheads.

They are also recommending a zero mph wake speed on the lake at night.

January Financials In January we collected $146,004 in current year lot assessments, for a total of $5,494,617, or 95% of FY2017-18 lot assessments billed. Our current delinquency rate is 2.1%, compared to 2.6% at this time last year. The Preliminary Unaudited Budget Summary is showing an unfavorable variance $54,654 as of January 31. Management is delaying or freezing hiring in some cases in order to reduce the negative budget variance. Projected income from Clubhouse banquets over the next couple of months and other strategies to slow expenses are being employed to help reduce the negative deficit.

B. Lakes Management Report Our Environmental Resources Manager met with the US Army Corps of Engineers and A. Morton Thomas and Associates on site of the 14th Pond Retrofit and Forebay Water Quality Improvement project location on February 23 to confirm wetland delineation. A. Morton Thomas will submit the application for permit to the Army Corps of Engineers.

C. Clubhouse Area Recreation Complex Project Update An updated budget for the CARC project shows an estimated reduction from the earlier cost projections, but any future updates will depend on contractor bids due in at the end of April.

The General Manager provided the Board with a snapshot update on the financial status of the CARC project, including progress toward design permitting, a bidding timeline and current projected construction schedule.

D. Other Business Maintenance re-used the spare heat pump unit from the old ECC roundhouse to replace the heating furnace at the Ferris House.

The insurance claim submitted for reimbursement of costs incurred from damage to the Clubhouse sprinkler system are only partially settled with AIG. LOWA will continue to provide AIG with the documentation needed to fully settle our claim.

The referendum from members requesting the adoption of an expenditure limit is in progress. Vote.Now.com is expected to be sending out ballots by mail and e-mail on Monday, March 5.

Chester Guzek, Assistant GM and Golf Pro Rea Hargraves are finalizing a Memorandum of Understanding with Wilderness Presidential Resorts to designate LOW as their preferred golf course, in exchange for LOWA

designating the Resort as LOWA’s preferred overnight accommodation.

3.8 Committee Reports A. Community and Youth Activities Chair Alexander Vasquez reported that the Family Date Night dinner and dance event on February 24 was well attended. He said the Committee will be focusing on planning events that promote family time. The next activity scheduled will be a March Madness event on March 24.

B. Maintenance and Ecology Chair Dan Cianci spoke on the need for more volunteers on the Committee who represent a cross section of our diverse community. The Committee has been working on reviewing equipment replacement schedules and documenting detailed data on equipment usage to assess more accurately LOWA’s needs when it comes to annual budget planning. He stated his opinion that the Board has promoted an adversarial atmosphere.

4. Member Comments on Business Agenda Members commented on gauging progress made to improve the health of our lakes, and how management verifies that all tenants are registered tenants.

5. UNFINISHED BUSINESS 5.1 Discussion of Overarching Goals The Board adopted vision, mission, values and overarching goals statements on June 21, 2017. On July 18, 2017, the Board requested input from all LOWA Committees on suggested strategies to implement overarching goals. As of February 26th, the Board has received input from 11 Committees. Management recommended that a special meeting of the Board be held this spring to work through comments from the Committees and update the overarching goals.

The Board requested the General Manager schedule a day in May for a Board Retreat to review proposed strategies suggested by the Committees that support LOWA’s overarching goals.

5.2 Consideration of Publishing in Lake Currents the Proposed Amendments to Bylaws Article X: Regarding Special (Ad Hoc) Committees. (D-18-34) Motion by Wilks, passed unanimously, that the Board publish in Lake Currents the proposed amendments to Bylaws Article X, regarding Special (Ad Hoc) Committees.

5.3 Consideration of Approving an American Institute of Architects Contract with RRMM Lukmire Architects, P.C., and Authorizing the President to Sign. (D-18-35) Motion by Wilks, passed unanimously, that the Board approve the American Institute of Architects Contract with RRMM Lukmire Architects, P.C. for the Clubhouse Area Recreation Complex Project, and authorize the President to sign.

Expenditure Limit Referendum. (D-18-36) Motion by Zukowski, passed unanimously, that the Board adopt a position opposing the referendum which limits expenditures to $500,000 without a Referendum. The language requires a membership vote to approve expending funds from reserve accounts, operating funds, insurance proceeds, Federal disaster relief, grants and gifts. The delay in waiting for the results from a vote of the Membership poses a real risk that LOWA would be unable to adequately address and rectify situations, even when LOWA is obligated to do so under the Declarations and Bylaws.

The Board further agreed by consensus to make the LOWA attorneyâ&#x20AC;&#x2122;s comments on the amendment proposed in the Referendum available to members, and that the Board recommend a vote against the proposed amendment in a separate mailing to members.

7. Member General Comments Members commented on competitive bidding, the Referendum, and a comment that the annual assessment has only increased on average 3.17% per year over the past 21 years.

Orange County Supervisor Lee Frame will give a talk on RSA at Civic Club meeting on March 14 at 7 PM in the Clubhouse.

8. Director Comments Director Clawson appreciated the excellent response of Fire and Rescue to the fires that were reported during the high windstorm event on March 2.

He suggested a spare Security boat be made available to Fire Department responders when circumstances indicate a need.

According to the 50th Anniversary Steering Committee, funds raised by Friends of Lake of the Woods were instrumental in reducing the cost of the 50th Anniversary Celebration.

These tax-deductible charitable donations totaled $7,800, which included $1,050 from individuals and $6,750 from local businesses.

One of the more significant donations was made by Walmart, in response to an historical preservation grant request submitted by FLOW. These funds were used to help create an historical and educational display which was featured throughout the year in all of LOWâ&#x20AC;&#x2122;s community areas.

In addition, unplanned profits from ticket sales for the two Rave On concerts in February 2017, along with private donations to the FLOW charity project, were enough to cover expenses for all of the remaining special activities.

Many of these special events (concerts and dinner dances, for example) were self-supporting through ticket sales. Others, like the 5K Run T-Shirts and enhanced Independence Day activities and fireworks on July 1, were supported by donations.

This is where contributions to FLOW helped. Every dollar returned to LOWA by the steering committee held down the cost of the celebration to LOWA members.

Tickets are selling for Play On, the comic murder mystery play within a play. If you have never been behind the scenes of a play from its beginning rehearsals, this is the one to see. If something can go awry, it will happen - including constant script changes from the author. Our 10-person cast, directed by Barbara Cochran, has been rehearsing for a month with one more month until opening night.

Play dates are April 20, 21, and 28 at 7:30 PM and two matinees, April 22 and 29 at 2 PM. Ticket prices are $20 for adults and $18 for students. We meet the second Wednesday of the month in Classroom 1 of the Community Center, starting at 7 PM. Our next meeting is scheduled for May 9.

The County Administrator presented his recommended budget at the last Supervisor meeting. The bottom line is that he did not propose any tax rate increases. However, revenue is still expected to grow 2 percent in the next fiscal year, due to the inherent growth in new real estate, personal property and other local tax sources. As a result, there will be over $900,000 in additional funds available to meet anticipated needs. The breakdown of significant revenue sources for the county’s General Fund is: Real Estate (49 percent), Personal Property (13 percent), Commonwealth of Virginia (13 percent), other local taxes (11 percent), permits and charges for services (8 percent).

On the expenditure side, there is a planned 2 percent market wage adjustment for most county employees and a new public safety salary and classification plan to better reflect operational hours and retention issues for deputies, fire, EMS and 911 personnel. Orange County maintains a self insurance fund for health insurance that has helped to control costs for both county and school employees. However, an 8 percent increase has still been included in next year’s budget.

The budget also includes a significant increase in county funding for Orange County School System. However, the county support is predicated on estimated state funding and since the state budget has not yet been approved, the county funding is still not definite. County funding for the LOW Volunteer Rescue Squad remains the same as last year, but the funding for the five volunteer fire companies in the county has been increased 5 percent for the rising costs of maintenance, operations and training. There was an increase in funding for the Central Virginia Regional Jail, but that was almost fully offset by a decrease in funding required for the Rappahannock Juvenile Detention Center. The budget includes two new full-time personnel, one for the airport and one for the Geographic Information System and public safety helpdesk. A part time employee is also added for the Main Library.

Overall, the county’s General Fund and your tax money is spent as follows: Education 36 percent, Public Safety 21 percent, Debt Service 15 percent, Health and Welfare 8 percent, Public Works 6 percent, General Administration 6 percent, Judicial Administration 3 percent, Community Development 2 percent, Parks, Recreation and Cultural 2 percent, and NonDepartmental 1 percent.

The County Administrator’s proposed budget presentation can be found on the county website by going to the Finance Department page. If you have input for the county budget, you should attend the public hearing on the budget and the tax rates which will be held at 7 PM, April 3, in the Board Room at the Gordon Building in the Town of Orange.

In 2015, the Supervisors adopted a set of financial policies which have led to upgrades in the county’s bond rating in the last several years. This budget applies those financial policies.

LOW Vets Celebrate a Decade of Service

The Lake of the Woods Veterans Club (LOW Vets) was organized 10 years ago this March and has grown dramatically, in both members and projects, since that time. Thirty-seven charter members elected Ed Kessler president in 2007. By 2017, the Club has had 265 past or present members.

Ted Ferriter, Bob Hoh, Dick Bradie, Bill Derryberry, and Dan Greene have followed Ed Kessler as president.

Any LOW resident who is a veteran of any branch of the United States military, National Guard or Reserve Forces, the Coast Guard, or the Merchant Marine is eligible for membership. Club members include six World War II veterans.

In addition to giving members a fellowship opportunity with other veterans, the club tries to promote patriotism and citizenship. A principle club mission is to support the LOW community. Ceremonies for Memorial Day, Independence Day, and Veterans Day, with Flag Honor Guards, speakers, and marching units help fulfill this goal. The club is also a means of learning about veteran’s benefits.

Charter Member Joe Wascalus organized an Honor Guard that provides a “final salute” at funerals for deceased veterans. Families interested in a “final salute” ceremony should contact the current leader, Joe McEuen, at 9722054 or MAC3RDGD@gmail.com, to discuss arrangements.

LOW Vets meet most months on the fourth Thursday at 7 PM in the lower level of the Clubhouse. Programs provide topics of common interest ranging from Orange County Sheriff Amos to photo interpreters to combat photographers to Defense Attachés. Field trips have taken veterans to the Quantico Marine Base, and Fort AP Hill. Some programs help explain benefits available to veterans.
