LOWA Regulations Regarding Fire Pits by Matilde Barone, Covenants Inspector

With the recent spate of structure fires within Lake of the Woods, LOWA knows that our members are concerned about how they can protect their homes, families, pets, and neighbors. With that in mind, we have collaborated with LOW Fire & Rescue to include an article, and we would like to remind our members about our regulations pertaining to fire pits and outdoor aesthetic features. Our regulations are as follows:

Recently, our community has been impacted by fire. While these are unusual occurrences in our community, as a member of the fire service, I understand firsthand that when fire strikes, lives are suddenly turned upside down. We can take some steps to mitigate the impact of wind-blown embers igniting dry vegetation andthreatening homes. If you plan on having a recreational fire, please:  Check your local rules, regulations and ordinances related to outdoor fires!  Keep the size no larger than three feet in diameter and two feet high, and confined to a permanent outdoor fire ring, a portable outdoor fireplace, or a commercially designed chiminea.  Residents are also required to install a screen to prevent embers from escaping  Have a garden hose, fire extinguisher, or five-gallon bucket of water nearby. Place fire pits, outdoor fireplace, outdoor heating lamps, or chimineas clear from low hanging branches or the overhang (eaves) of a house, or other structures. It is important to remember that embers blowing from a backyard fire pose the same threat to yourhome as embers from a wildfire. To help mitigate, you should take some actions, such as:  Cleaning out gutters of seasonal debris,  Clearing away leaves and needles in the 0-5 foot “immediate zone” around the house,  Moving any flammable material away from wall exteriors, like mulch, flammable plants, firewood piles, and  Removing anything flammable stored underneath decks or porches. Most of all, safely enjoy your patio and help us keep blowing embers that come from any source fromthreatening our homes this season. We know that this is an exceedingly difficult time for our community. It is our goal to not only help community members during an emergency but to also help community residents recognize and mitigateincidents and emergencies such as a home fire. D.5.n All fire pits which are to be installed on any LOWA lot must be approved by the ECC. Design, location, and type of materials must be included with the ECC application. Fire pits must be located behind the home, observe a twenty-five (25) foot setback from the rear property line, and be located within the side planes of the house. The fire pit must be surrounded on the outside, above ground, by a noncombustible material. The fire pit must not exceed five (5) feet in diameter including the outer wall surrounding the pit, must not exceed twentyfour (24) inches in height above ground, and must have a one fourth (1/4) inch opening grate for the pit when in use. Use of cooking grills, portable or tabletop fire pits and/or chimineas are not included in the above restrictions. (3/2021) G.3.d Open burning, including but not limited to the burning of lumber, pallets, scrap wood, leaves, yard waste, garbage, and similar items, as well as warming fires, is prohibited (5/2015) K.9. Outdoor Aesthetic Features: (3/2021) a. Outdoor Aesthetic Features must conform to LOWA setback requirements. This includes anything built or constructed, permanent or temporary, unless otherwise approved or required by the ECC to be placed outside the prescribed setbacks. (3/2021) b. Outdoor Aesthetic Features include pergolas, trellises, canopies, arbors, archways, fireplaces, fire pits, outdoor kitchens, seating walls etc. All outdoor aesthetic features which are to be installed on any LOWA lot must be approved by the ECC. (See also Section I. Approval Process) (3/2021) c.4 Fireplaces and fire pits: design, location, and type of materials must be included with the ECC application. Fireplaces and fire pits must be located behind the home and must be located within the side planes of the house. The fireplace or fire pit must be surrounded on the outside, above ground, by a non-combustible material, and must not exceed six (6) feet in height.
