Board election information (i) is being emailed to Members who have their emails on record with LOWA by LOWA’s trusted agent, Vote-Now.com, (ii) is included in the July 29 Lake Currents, and (iii) is available at the Holcomb Building Member Services. This year Members will be electing three Directors from a list of four candidates. The three candidates receiving the highest number of votes will serve three year terms.

Format for the Forum is as follows: • In-Person: Doors open at 3 PM for members to submit their questions for the Candidates on 3x5” cards provided by the committee. The cards will not be taken after 3:45 PM.

President’s Letter

Our election for Board of Directors opens today.

Those who have signed up for electronic voting will receive their ballots today. There is a ballot in this issue of Lake Currents and paper ballots are available at the Holcomb building. We have four great candidates for three open positions. I strongly recommend reading the candidate bios and viewing their interviews on our website: www.LOWA.org/Vote2022. At the end of each bio, click on the video to hear their interviews. Also, the annual Candidates’ Forum will be held on Sunday, July 31 from 4-6 PM at the Community Center.

We had a very full July 20 BOD agenda. Look for the new Regulation XIV, Schedule of Penalties for Violations, in this issue of Lake Currents. We approved the Annual Property and Liability Insurance package for the next year, Aug. 1, 2022, through July 31, 2023. We also approved Final Design and Construction Funds for the Patrick Henry Court drainage project. Alas, our Salt and Sand storage shed has bit the dust. It was built on top of chip and tar, without a concrete floor. The foundation sat on the chip and tar and has been undermined. Water flows into and through the structure, not good for storing salt. We approved a contract to replace it with a new shed with a proper concrete floor and apron.

In my last letter, I talked about FiberLync plans to expand into LOW. Jenny Cord from FiberLync and Jim White of the Orange County Broadband Authority gave us a demonstration on their fiber optic internet service. They will soon be installing the first phase of their service in Lake of the Woods in Section 7. They explained that their internet service is installed underground.

During the recent winter storms, none of their customers throughout Orange County lost their service. Rates for monthly service range from $49-$79 for internet-only service. Customers may elect to keep their current cable tv, but move their internet to the more efficient speed and reliability of fiber optic service with no data caps. They also showed us how to stream television programs through the internet should one choose to do so. After an evaluation of the success rate in Section 7, they will look at expansion into the rest of LOW. Finally, some bittersweet news. Chief Scott Walker is leaving us to go to work for CSX. After 30 years of law enforcement, he wanted a career change for his final ten years of working. He told me he always loved the trains that came through the fields and town where he grew up. He talked with CSX and Norfolk Southern. He chose CSX and now he’ll be “working on the railroad, all the live long day.” Best wishes to Scott. We will miss him greatly.

Motion by Rappoport, passed unanimously, that the Board approve the minutes of the June 29, 2022 Regular Board of Directors meeting.

2.5 Special Recognition Award President Brown and General Manager Phil Rodenberg awarded a Certificate of Appreciation to Allied-Universal Security Chief Scott Walker for his excellent service over the past nine years. Chief Walker will be leaving us August 1 to take a new position at CSX Corporation.

Chief Walker came to LOWA on May 1, 2013, when then-Allied Barton won our security contract. He has been an outstanding Chief, leading his officers and working with the Board, staff and membership to accomplish lasting improvements in our community’s security. His accomplishments include improvement of Main Gate access control, implementation and expansion of TEK Control visitor management, expanded use of surveillance cameras, an expanded and improved lake patrol program, including improved watercraft, and interconnection with Orange County emergency radio system. He has worked well with the Board of Directors and committees, giving monthly updates at the Board meetings and Safety and Security Committee meetings.

Chief Walker significantly improved LOWA’s relationship with Orange County Sheriff Mark Amos and with Commonwealth Attorney Diana O’Connell.

We will miss his can-do, yes sir/yes ma’am, capable approach to community policing!

Chief Walker talked about his greatest accomplishment here at LOWA: “Our relationship with Sheriff Amos and his office. Most people would not understand that this type of mutual respect and partnership is unparalleled in our industry. For a contract service to share the same radio system and benefit from equipment donations.

This type of relationship is unheard of in the industry. My most cherished accomplishment of my career.”

AUS has put forward Major Richard Harrell as our Interim Chief beginning Aug. 2. Major Harrell is a retired Navy Master Chief. He came to AUS here at LOWA in 2014. He has worked every security position in the Chief Walker community – access control, armed patrol, lake patrol, and then Special Conservator of Peace. He has been the Major since 2020. I ask that everyone get behind Interim Chief Harrell as he leads his 20 officers through this transition.

Board Seeks Member Input on Amending Regulation XIV, Schedule of Penalties for Violations, Regulation I, General, and Regulation VI, Use of LOW Roads and Parking Lots The Board of Directors is seeking member comment regarding proposed amendments Regulation XIV, Schedule of Penalties for Violations, Regulation I, General, and Regulation VI, Use of LOW Roads and Parking Lots. Members who wish to provide comment or feedback should email the Board at Board@ LOWA.org by August 12, 2022.

What is proposed? Changing the listed regulations to update the procedures for dealing with violations of LOWA regulations.

Why? Regulation XIV, Schedule of Penalties for Violations, has not had a comprehensive review in 10 years, the section does not mirror current practice and the 2019 referendum on violation charges failed to get 2,130 yes votes to place in our highest governing document ability to charge the state-authorized charges.

Who proposed it? The proposed amendments are the results of a review of the Regulation by a General Manager Working Group of the Board, committees and the staff.

What is the effect? Changes to terminology and situations where violations may be referred to the Orange County Court system.

PROPOSED AMENDMENTS TO REGULATION XIV, CORRECTIVE ACTIONS FOR VIOLATIONS Delete entire regulation and replace with the following:

XIV. CORRECTIVE ACTIONS FOR VIOLATIONS A. General. LOWA may impose sanctions for violations in the form of charges, suspensions, and legal actions, depending on the nature of the violation.

B. Legal and Compliance Committee (LCC) Authority. The LCC, under the authority of the Board of Directors pursuant to the Articles of Incorporation, may impose a charge up to $50 for violations as follows: 1. Speeding. Violations of the speeding regulations in Section VI.C, Use of LOW Roads and Parking Lots pursuant to Section 13 of the Restrictive Covenants. In addition, multiple violations committed during the same incident or three or more violations within a 12-month period from the first offense may result in LOWA pursuing legal sanctions through the Orange County General District Court for corrective action (e.g., an injunction) against the appropriate party. This provision will not limit LOWA pursuing legal sanctions through the court as described herein if the Board determines in any event that such action is in the best interests of LOWA under the circumstances. The LCC will keep records of LCC findings of guilty and make recommendations to the Board.

2. Watercraft Operations. Violations of the watercraft operations regulations in Section X, Use of the Lakes. In addition, the Committee may recommend that watercraft operators who have received LCC findings of guilty for two (2) boating violations of Section X regulations within a 12-month period from the first offense have their use of the Lakes suspended for up to thirty (30) days and for three (3) or more LCC findings of guilty for up to one (1) year.

C. Virginia Uniform Traffic Summons 1. LOWA Security will issue Virginia Uniform Traffic Summons in the following instances of traffic violations: a. Passing a stopped school bus with flashing lights (See Administrative Resolution 2018-3); b. Exceeding the posted speed limit by twenty (20) miles per hour (See Administrative Resolution 2014-5); c. Other traffic violations listed in Regulation VI, Use of LOW Roads and Parking Lots, for laws of the Commonwealth of Virginia that pertain to secondary roads, including causing an accident, failure to maintain control, etc.; or d. Reckless boating (See Administrative Resolution 2021-3). e. Parking in handicapped spaces and/or emergency access areas.

2. Virginia Uniform Traffic Summonses are adjudicated in Orange County General District Court.

CURRENT REGULATION XIV, SCHEDULE OF PENALTIES FOR VIOLATIONS A. Traffic, The Legal and Compliance Committee, under the authority of the Board of Directors, may impose up to a fine of $50 for any violation of LOWA traffic regulations. Multiple violations committed during the same incident may result in a penalty for each violation.

The following flagrant traffic violations are serious due to the nature of the action or because of the potential for harm to life and property and in addition to monetary fines may result in the suspension of barcode access for members and restriction of entry for non-members. The length of suspension or restriction shall be designated by the Board of Directors with LCC recommendation. (2/2012) 1. Accumulating three moving violations within any 12-month period.

(8/2013) 4. Passing a stopped school bus displaying flashing red light, including a school bus with flashing red light anywhere in an intersection. (Refers to Regulation VI.A.) (8/2013) 5. Improper or illegal entry or assisting another vehicle in improper or illegal entry through either the front or rear automatic gates. (Refers to Regulation II.B.) (8/2013) 6. Exceeding posted speed limit by 20 miles per hour. (Regarding Regulation VI.C.) (8/2013) 7. Reckless driving, other than high speed. (Refers to Regulation VI.A.) (8/2013) 8. Driving without a valid operating permit, or driving on a suspended or revoked operator’s license. (Refers to Regulation VI.A.) (8/2013) 9. Parking construction related vehicles, trailers or other equipment on any LOWA property without the consent of the General Manager. (Refers to Regulations VI.D., VI.I and VI.J.) (8/2013) 10. Parking in handicapped spaces and emergency access areas. (Refers to Regulation VI.A.) (8/2013) 11. Failure to obey a reasonable order from a security officer, including showing photo identification. (Refers to Regulation VI.M.) (8/2013) 12. Failure to yield the right of way to emergency vehicles, including LOWA security vehicles. (Refers to Regulation VI.N.) (8/2013) B. LAKES Effective May 7,2011, the Legal and Compliance Committee, under the authority of the Board of Directors, may impose a fine of $50 for any violation of any regulation of Section X of LOWA Regulations. (5/2011) In addition to any other penalties that may be levied by LOWA for violations of Regulation X, the Legal and Compliance Committee may recommend to the Board of Directors that a watercraft operator who has received convictions for two boating violations of Section X regulations within one calendar year may suffer the loss of their boat operator’s license for up to 30 days and for three or more citations may lose their license for up to one year. What Is a Proxy Ballot and Why Does LOWA Use Proxy Voting?

by Rick Rappoport, Secretary, LOWA Board of Directors Today is the start of the annual election season for LOWA, and I wanted to take a few minutes to provide some further explanation why LOWA uses Proxy Voting.

Lake of the Woods Association, Inc. is a Virginia non-stock corporation and as such, its Board of Directors must be elected by members in good standing, voting in person or by proxy at a formal meeting of the members. Proxy ballots count toward establishing LOWA’s quorum of 800 members for such a meeting. Members can attend the meeting in person and cast their vote for one or more (but no more than three) Board candidates. Alternatively, members who choose not to attend the meeting can still cast their votes by appointing another person (a proxy) to represent them at the meeting and cast their vote. This is done by use of a proxy ballot.

A proxy ballot is a document a member completes to formally appoint another member to vote as directed, without the appointing member having to attend a membership meeting. Most members vote by proxy ballot.

Proxy voting may be unfamiliar to those thinking in terms of a state or local government election with its election day voting and absentee ballots. LOWA is not a government, and elects its Board through members voting in person or by proxy at a formal membership meeting.

Proposed Regulation XIV p. 4 D. Processing Measures for Violations 1. Unauthorized Parking on LOWA property will result in a written warning and/or towing or immobilization of the vehicle at the owner’s expense. a. Unauthorized parking, including the parking of construction-related vehicles, trailers, or other equipment without the consent of the General Manager, will receive one written warning. b. Subsequent violations may result in LOWA having the vehicle(s) towed or immobilized, e.g. tire boot, at the owner’s expense. c. Exception: Towing without warning is authorized for an emergency, direct threat to public safety or interference with public safety and road operations (See Section VI.D.2.f.)

2. Damaging LOWA property will result in LOWA charging the offender for actual damage to LOWA property (See Section VI.A). Failure of offenders or their insurance to pay for such damage may result in legal action to collect for cost of the same.

3. Malicious, intentional or willfully negligent damaging of LOWA property (Vandalism) will result in LOWA charging the offender for actual repair and/or replacement and cleanup expenses and/or the offending party may be referred to the Orange County Commonwealth Attorney or Magistrate for prosecution at their discretion. The General Manager may also suspend use of the amenity for one month where the vandalism occurred through Section I.G. and issue a summons to LCC for recommendation to the Board of a longer suspension.

4. Littering within LOWA, including around the Trash Compactor and 9.9 Maintenance Area will result in a written warning and a demand to remove the refuse, litter, or debris. The offender may be charged for actual repair and/or replacement and cleanup expenses. Thereafter, LOWA may pursue legal action for compliance.

5. Disturbing the peace (including barking dogs and noise) will result in a written warning from LOWA Security. Upon the occurrence of a third offense within a 12-month period from the first written warning, the Board may pursue legal action for compliance, including removal of the offending animal(s) from the community by order of an Orange County Judge. This provision will not limit LOWA pursuing legal sanctions through the court as described herein if the Board determines in any event that such action is in the best interests of LOWA under the circumstances. The LCC will keep records of the written warnings and make recommendations to the Board.

6. Restrictive Covenant (Lot Violations) are processed pursuant to the provisions of the Restrictive Covenants and applicable law. Lot owners are subject to lot violation charges as approved by the Board representing expenses to LOWA for compliance (See Administrative Resolution 2021-8). Failure to adequately protect a waterfront lot from erosion is specifically included as failure to maintain the lot in a satisfactory manner.

Failure of the Member to correct the deficiencies may result in legal action to compel compliance.

7. Firearms/Weapons Violations (Section IV.C) will result in a written warning, thereafter LOWA may pursue legal action to compel compliance.

8. Trespassing/Unauthorized Access on LOWA Common Areas (other than criminal trespass) will result in a written warning, thereafter the offending Member, Family Member, Tenant, Authorized Occupant, and/or Guest may have their use of the specific amenity or common area suspended by the General Manager for up to one (1) month or for a longer period to be determined by the Board of Directors. LOWA may pursue instances of criminal trespassing through the Orange County court system for action at their discretion.

9. Continuing Violations. LOWA will pursue violations of a continuing nature through the appropriate Orange County Courts for corrective action (e.g., an injunction) against the appropriate party.

10. Violating any Rules and Regulations not specifically mentioned above will result in written warning to the person responsible and the Member. Failure to correct the violation(s) may result in suspensions or legal action pursuing compliance.

11. Cost Recovery of all notices prepared by LOWA Staff representing expenses and costs to LOWA for compliance will be pursued pursuant to Section 12.D of the Restrictive Covenants.

VIOLATIONS OF A CONTINUING NATURE For a violation of a continuing nature, a charge not to exceed ten (10) dollars per day may be assessed for a maximum of 90 days for a total of nine hundred (900) dollars. While this is a one-time fine for any one-time violation of a continuing nature, any uncorrected violation may, at the decision of the Board of Directors, be taken to the appropriate county / state court.(5/2008)

Golf Committee on Respecting Private Property

We thank Nancy King for her Viewpoints letter published on 1 July and likewise thank the many golf course residents who have collected golf balls in their yards and placed them in accessible containers for golfers to take. That is the essence of “neighborly” as Nancy suggested.

At issue in this article is the relationship among golfers and residents adjacent to the golf course. First, golfers will respect the LOWA approved “No Trespassing” signs a few residents have installed. But all golf course residents should recognize that buying a home on the perimeter of a golf course carries with it the inherent risk that golf balls will inadvertently land on residential property. The accepted practice across the U.S.A. is that golfers are permitted to enter the property if the ball is visible and can be quickly retrieved. However, walking around the property or hunting for the ball in the bushes/garden is not permitted. Naturally, we’re dealing with humans and we can expect the rare instance when a golfer may forget this “universal” rule. Nonetheless, our golf pro shop will endeavor to explain these basic courtesies to everyone.

We now have a ranger patrolling the course. That person is in a golf cart identified by the yellow flag attached to the roof. Should there be cause, residents should inform the ranger or call the pro shop 540-972-2230.

ECC is Seeking New Members

Your free time is valuable, so why not consider joining one of Lake of the Woods Association’s most unique core volunteer committees, the Environmental Control Committee? The ECC is currently seeking applications from members who are interested in ensuring that all exterior improvements comply with the LOWA Covenants and Regulations for residential lots thereby preserving the unique aesthetic harmony of our community and maintaining property values.

The committee is composed of seven members and meets every other Thursday at 9 AM. You would have the opportunity to not only work closely with other committee members but interact directly with our LOW membership to review their proposed projects, where much of our work takes place.

So, if you enjoy working with people and wish to maximize your valuable free time, consider making a difference by volunteering to join the ECC. The application form may be downloaded from our website, www.LOWA.org/forms or picked up from the Holcomb Building. Completed applications should be mailed or delivered to the attention of the Chairman, ECC, LOWA, 102 Lakeview Parkway, Locust Grove, VA 22508.

To be valid, a proxy ballot must appoint another Association member to cast the vote of the appointing member, and the proxy ballot must be signed and dated. The proxy ballot may be submitted in advance of the announced Meeting of the Membership, but the ballot is not officially cast until the vote is called during the meeting. At that time, the proxy must vote for the candidate(s) designated by the appointing member. A proxy may not substitute choices. It is important to note that the proxy must be present in person at the Membership Meeting in order to cast the proxy ballots entrusted to them. A proxy may also vote on other questions that may arise during the meeting, such as voting on any parliamentary or procedural matters, including recess and/or continuation of the Annual Meeting.

LOWA’s election procedures allow for the LOWA Secretary to be the default proxy for those members who wish to vote in the Board election, but choose not to attend the Membership Meeting in person. However, a member may choose to name a different proxy. A blank space is provided on the proxy ballot for that purpose.

To be counted as a valid vote, the proxy ballot must clearly identify the member casting the proxy ballot. A proxy ballot will not be counted if it is not signed and dated, if the identity of the member voting cannot be determined, or if the member is not in good standing with the Association.

From the very beginning, LOWA was founded on the principles of self-governance by its membership. LOWA encourages all members to participate in LOWA elections – it’s your community!

Pirates & Mermaids Day at Sweetbriar Pool (left), Summer Arts & Craft Camp (right).

The Pools and Community Activities Committee introduced a new event to our summer schedule with Arts and Crafts Camp at Sweetbriar Pavilion, July 11-13. Twenty-two children participated and worked on projects that involved painting, paper, photography, and 3D crafts. There were lots of lessons learned and ideas to organize the event for next summer.

Many thanks to the parents and artists who joined us during this initial attempt. And an extra special thank you to all the volunteers, parents, committee members, and LOW Arts members who made this camp possible.

We could not have done it without you. It’s very exciting to see that we have some very creative young minds in Lake of the Woods.

Pirates and Mermaids again sail into Sweetbriar Pool. Our local pirates and mermaids gathered at Sweetbriar Pool, Saturday, July 16, to pillage and plunder. After being cancelled due to rough seas on July 9, the second voyage was a success, as our pirate ship returned and a beautiful reef with lots of new underwater creatures decorated our fence lines. Jellyfish and sea turtles swam under the shade structures while pirates and mermaids lined up to get their tattoos. Lots of pirate treasure was found with free ice creams, cannon ball snacks (cheese balls to you land lubbers) and ring pops.

Even our lifeguards joined in the fun and dressed in theme. Lots of pirates walked the diving board plank and slid into the shark infested depths.

Wonder what surprises will appear next summer at Pirates and Mermaids?

We’ll see you there…if ye dare!

You see something swiftly gliding along the surface of the water. Is it an otter? No, too short.

Is it a beaver? No paddle-like tail.

It’s probably a muskrat.

Muskrats have thick, shiny fur with a scaly, rat-like tail. They get their name from the strong odor they emit to communicate with each other. This semi-aquatic mammal prefers shallow water, 4-6 feet deep. Their lodges, up to 3 feet high with multiple underwater entrances, are built of plants and grasses, Photo by Carl Sergent leaves, sticks, and mud. Muskrats may also simply burrow into a bank to make their home, so holes in your bulkhead make a handy nesting spot.

Muskrats eat mostly aquatic plants, but will also go for fish, frogs, insects, and shellfish. In turn, they are an important food source for raccoons, bald eagles, owls, hawks, foxes, and large turtles. They are an integral part of aquatic ecosystems. However, as often happens when humans populate a natural environment, conflict arises.

Here at Lake of the Woods, muskrats have been blamed for destroying gardens and chewing through electrical wires on boats. But rather than immediately jumping to the conclusion that muskrats are pests and must be removed, some residents have found solutions to co-existing with these creatures.

To prevent muskrats from eating your plants, you may: 1) avoid plantings near the water’s edge (although muskrats have a “home range” of 200 yards). 2) employ strong odors to discourage them. Used kitty litter can be placed around the perimeter of your garden. Coyote urine, in the form of spray or pellets, has been used by local community members to effectively deter muskrats.

To prevent muskrats from chewing the wires in your boat, you may install (yourself or professionally) a mesh cage. This has been a good long-term means of solving the problem for several local boaters.

Muskrats exist as part of our lake neighborhood, but also exhibit frustrating behavior sometimes. Let’s try to find creative solutions to enjoy Lake of the Woods together.

Season of Gratitude at Garden Club This has been a year of hard work in all our gardens, with big rewards for all of us in LOW with beautifully renovated garden spaces.

The Wilderness Library Garden is the most recently completed. It has been replanted primarily with native plants to support our local butterflies, bees, and birds. Please stop by to admire the blooms and learn about plants you might like in your own Photos provided garden. Natives typically are easier Wilderness Library Garden to care for and thrive in their local environment. All the plants are labeled; the natives have an “ N” added to the common name. Also take time to admire the beautiful sculpture donated by Nicole Pappas in memory of her mother. We’re grateful to her and everyone who have donated time, money, and material to this lovely space.

We’re also grateful to our donors to Penny Pines, an initiative we’ve long supported. This project reforests places destroyed by fire and storms.

Periodically we award a “ plantation” of trees to an individual who has been especially supportive of the Garden Club. Recently our president, Debbie Hein, presented one to Ryan Richardson, Clubhouse Manager, with gratitude for his support of our activities.

The LGA enjoyed participating in the LOW 4th of July Parade, in honor of our 50th Anniversary, passing out candy, bracelets, and necklaces to the children. It was a lot of fun for everyone.

On July 20, LOW artists gathered for the third in a series of Art Walks, this time to Lorton. Meeting first for lunch at the Brickmaker’s Café, we then visited the Workhouse Art Center, once a women’s prison, now an active center for the arts. Displays and demos make every day a special day to visit the Workhouse Art Center.

Our organized art walks and the Fareways Cafe art exhibits and artist’s receptions are some of the benefits provided to active members of LOW Arts.

We welcome new members and invite you to join our monthly meetings on the first Monday of each month in the community center.

LOW Arts is already planning for our annual Fall Fine Art Sale and Show.

During our August meeting, Joe Freeland will report on last year’s art show, so that we may learn and grow as we move forward with greater success. This year the dates will be moved to Oct. 29 and 30 in the Community Center. Mark the dates on your calendars; we would love to see you all there.

3. Member Comments on Business Agenda and General Member Comments President Brown reviewed the meeting conduct guidelines. One member commented on the proposed amendments to the Regulations.

4. PRESENTATIONS 4.1 Annual Independent Financial Audit Report.

(Rescheduled to August 17 Board meeting) 4.2 Property and Liability Insurance Package Review via Zoom Bill Mackey, Lead Agent with Bankers Insurance LLC, provided details of the current insurance environment and the results of shopping our coverages with a variety of carriers in order to get the lowest premiums for our needs. Cyberliability quotes showed a considerable increase over last year from all carriers. Some quotes have not yet been received and Bankers’ recommendations will not be finalized until August 1.

Without objection, President Brown took up Item 7.2 on the Agenda at this time for a vote on the annual Property and Liability Insurance Package.

4.3 FiberLync Demonstration Jenny Cord, FiberLync Business Development representative, gave a slide presentation on the proposed installation of FiberLync fiber optic internet service cable inside LOW. She provided some history of the technology, and covered the advantages, installation process, monthly costs and service tier plans available to residents. Plans are to initiate a pilot installation in Section 7 but they will need residents to pre-register on their website at www.FiberLync.net to gauge interest by the overall community.

Ms. Cord and Jim White, Chairman of the Orange County Broadband Authority, responded to questions from the Board and members present.

4.4 Financial Plan Regarding Board Goal #5: Roadway Infrastructure Strategic Plan Director of Finance Charles Maneval gave a slide presentation to update the Board on progress made formulating a strategic and financial plan to convert all chip and tar roadways to asphalt. He provided a list of possible implementation and financial assumptions. Cost savings that could be achieved over a 20 or even 40-year period would still have an impact on the assessment. Our annual incremental conversion of Chip & Tar program will continue as scheduled. The new Board will consider the analysis, project priorities and next steps at their September retreat, and management will further fine tune costs and savings assumptions. The topic will be discussed further during the FY2023/4 budget process.

5.2 Report of the General Manager, Phil Rodenberg A. Coronavirus Status: LOWA Community Activities and Business Operations LOWA staff vaccination rate is now 89.8%, up from 88.8% last month.

The CDC issued an update noting that currently Covid-19 spread is considered to be in a HIGH level of transmission phase and recommended a return to wearing masks indoors in public. All LOWA amenities will remain open but masks are recommended indoors.

B. June Financials In May and June we collected $5,787,267, or 73.6% in FY2022/23 lot assessments billed, compared to 74.7% at this time last year. As of June 30, the delinquency rate was 6.75%. The Preliminary Unaudited Income Statement Budget-to-Actual Comparison Summary showed a favorable variance of $285,787, primarily the result of unbudgeted NCR receipts and amenities performing better than budget for the first two months.

C. Lakes Management Update E-coli testing at all beaches was completed June 21, with all samples indicating our beaches were safe for swimming and water activities. Attempts using swan decoys and fencing have not been successful deterring geese from the 14th Fairway pond. Bumpers were installed at the small marina dock to help defray boat damage. Dredging is planned around Turtle Island to remove excess sediment built up before the Flat Run Forebay was installed.

Environmental Resources Manager Nick Blankenship responded to questions about the chronic algae blooms at Keatons Lake. Aerator installation on the lake should be completed by this coming weekend.

5. REPORTS 5.1 Reports of Officers The President, Vice President and Treasurer had no report.

Secretary Rappoport reported that on July 10 there was an incident involving a private plane flying very low over the main lake, in violation of FAA regulations prohibiting such activity on flight maps. Our Security staff and the Sheriff’s department have undertaken an active and ongoing investigation, and any members having information on the plane and pilot are encouraged to contact law enforcement.

At 19, I came to the U.S. in 1982 from the old Soviet Union. Later as a Flight Attendant with Eastern Airlines, I met and married a Navy F-14 Fighter Pilot.

We moved to Lake of the Woods in 1990 with our two children. The same year I received my Realtor’s degree from Germanna College. I also managed my husband’s construction company that he started at the lake.

I am proud of my grown children, now 30 and 31. They grew up right here at the lake.

Today, both my son and son-in-law proudly serve in the military, both NAVY SEALs. My dedication to this community and its members speaks loudly. Within the last 30 years, Lake of the Woods is transforming into a 4000-homes, vibrant, amenitiesfilled community.

I have served on the Clubhouse and Pool Committees, and organized the LOW Walkers Club, currently 86 members strong. I enjoy being a member of the LOW Garden Club.

Veterans Club

Lake Currents July 29, 2022

We intend to celebrate June 12, 2023, as Women Veterans Day. This holiday is not recognized nationally and is currently only accepted by 11 states.

We think it is appropriate that the Lake of the Woods Veterans Club should show respect to the women that have been veterans by acknowledging this date. There is a special charm to a woman who can qualify on a weapon, dig a foxhole, and low crawl through tough terrain. Among all women in America, only 1.5% are veterans. The real world doesn’t operate the same way that military service does. To be successful it takes tenacity, resilience, and determination to barrel through the many trials that face a woman veteran: from the casual “ Thank your husband for his service,” when a passerby sees the Vet plates, catcalling at the all-ranks club to the proverbial silence that permeates the aftermath. They were squeezed into stereotypes too small that could never comprise what women were in reality: well-forged warriors.

The LOW Veterans Club has featured women guest speakers at our meetings, but continues to have difficulty in attracting new women veterans as members. Challenges are meant to be overcome; that philosophy is now advancing at the Veterans Club. Faithful camaraderie: a brotherhood and a sisterhood is burgeoning. The embodiment and culture of “duty, honor and country.” is enmeshed with humor, family, and innovation. The Veterans Club has recognized the above and its applicability to our Lake of the Woods women veterans. It’s time to make room.

All club members are reminded - as in the past - there will be no club general meeting in July. Each Lake of the Woods resident veteran and any interested women veterans are invited to the Veterans Club Meeting on the last Thursday of August, the 25th, at 7 PM in the basement of the Clubhouse.

Guide to In-Home Support Published

LOWLINC, a nonprofit organization here at Lake of the Woods dedicated to helping older adults continue to live independently in our community by providing a wide range of volunteer services and referrals to service providers when needed, has published a “Guide for Knowing Your Options for In-Home Support” available to LOWLINC members and volunteers.

Spearheaded by Emily Slunt, Ph.D., former LOWLINC President and a current Board Member, and other members of the LOWLINC Health and Wellness Committee, this new guide is intended to help older adults who may need or benefit from in-home assistance at some point in time. “It is hoped that the material will be helpful in planning ahead so you know your options if and when you experience a health crisis,” writes Emily in her letter to members introducing the guide. “This document could be referred to as Plan B or a back-up plan when you need more help at home.”

The guide describes different categories of in-home care providers to assist LOWLINC members and their families understand the differences among various levels of care and identify appropriate level(s) to fit their needs. Caregiving needs may arise suddenly such as after a sudden diagnosis, a fall, or a degree of memory loss. In this document, the different types of home care providers are defined as well as the training, skills and requirements for each category. A description of Hospice is also included as a resource for end-of-life support.

We hope this guide will be helpful and that it will encourage LOWLINC members plan for additional assistance as needed to remain safely in their own homes.

5.4 Committee Reports A. Environmental Control Committee (ECC) Vice Chair Elizabeth Dulaney submitted an annual report to the Board.

Two more new members are needed and they are actively recruiting members. In the past year, ECC approved 46 new home construction projects and reviewed and approved 175 requests for upgrades, resulting in new construction fee income of $690,000. There were 425 requests for tree removal, of which 397 were approved. The Committee has been working on updating Section XVI of the Regulations. There are 150 reports of ECC violations currently being pursued. The Committee would like to propose changes to their procedures to add an Alternate member who can function as a substitute for voting purposes when needed, shorten the procedure for processing small violations, and reject approval of any new project for any member who already has an outstanding violation that has not been corrected.

D. Other Business Our election agent, Vote.Now, will open voting for the 2022 Board election on July 29. Members will be voting to elect 3 new Board members from four candidates.

Independence Day activities all took place with no adverse events. Main gate traffic went more smoothly than in any prior year with Security staff using the new modified traffic pattern for the visitors lane.

A new shade structure was installed near the cart barn by our Buildings Department.

The GM and A. Morton Thomas will host a Town Hall on August 9 at 6:00 p.m. in the Community Center to discuss the findings of the Wake Boat Study.

An update on the progress and status of filling key open staff positions was provided.

5.3 Committee Liaison Reports Director Wilks reported the Planning Committee is working on updating the Land Use Study which they would like to submit to the Board at the second Board meeting in September. Director Rappoport reported the Lakes Committee is involved in discussing and investigating the chronic algae blooms at Keaton’s lake to identify a solution.

7. NEW BUSINESS 7.1 Consideration of Accepting the Annual Independent Audit Report for FY2021/22.

(Rescheduled to August 17 Board meeting) 7.2 Consideration of Approving the Annual Property and Liability Insurance Package for the Period August 1, 2022 through July 31, 2023. (D-22-81) Motion by Diercks, passed unanimously, that the Board approve the annual Property and Liability Insurance Package for the period August 1, 2022 through July 31, 2023 and authorize the General Manager to bind the policies and report to the Board at its August 6 meeting, as long as the total renewal for all policies is no greater than $30,000 more than the budgeted amount.

7.3 Consideration of Approving Final Design and Construction Funds for the Patrick Henry Project with Funds to Come from the Lakeview Parkway Culvert Retrofit. (Resolution 2022-20) (D-22-82) Motion by Rappoport, passed unanimously, that the Board adopt Resolution 2022-20, a General Resolution, regarding approving final design and construction funds for the Patrick Henry Project, funds to come from the Lakeview Parkway Culvert Retrofit.

7.4 Consideration of Awarding a Sole Source Contract to R. E. Horner for Salt/Sand Shed in the Amount of $165,750 with Funds to Come from the Repair and Replacement Reserve and the New Construction and Renovation Reserve. (Resolution 2022-21) (D-22-83) Motion by Zukowski, passed unanimously, that the Board adopt Resolution 2022-21, a General Resolution, regarding awarding a sole source contract to R. E. Horner for the Salt/Sand Shed in the amount of $165,750, funds to come 18

from the Repair and Replacement Reserve and the New Construction and Renovation Reserve. (Note: The total project budget, to include demolition, survey and contingency costs, is estimated to be $171, 250.)

7.5 Consideration of Approving a Relocation of Easement Agreement and Authorizing the President to Sign the Document. (D-22-84) Motion by Wilks, passed unanimously, that the Board approve a Relocation of Easement Agreement and authorize the President to sign the document.

7.6 Consideration of Lot Violation Enforcement and Entering Lots for Maintenance. (D-22-85) Motion by Wilks, passed unanimously, that the Board declare a continuing violation of the Restrictive Covenants exists on the lots in Cases #22-0720-01, 22-0720-02, 22-0720-03, 22-0720-04 and 22-0720-05, and the Board suspend the voting rights and the use of the recreational amenities, including the main and back automatic gates until the violation is corrected, in accordance with Section 12.G.b of the Restrictive Covenants, effective August 4, 2022. I further move the Board authorize Management to send a legal Demand Letter to bring the lot into compliance.

Motion by Wilks, passed unanimously, that the Board approve entry to the lot in Case #22-0720-06 on or after July 20, 2022 to perform maintenance as stipulated in the ECC Chair’s letters to the individual lot owner, and that the property be billed for the cost related to such work in accordance with Paragraph 14 of the Restrictive Covenants.

I, GENERAL J. Violation of LOWA Regulations may be reported by a LOWA member to the Security Office for appropriate action, and the reporting member may sign as a witness to the violation. With sufficient evidence, Security may issue a citation which can result in the levying of penalties by the LOWA Legal and Compliance Committee. (See Regulation XIV.)).. Revocation of privileges may also be imposed by the Board of Directors.

Town Halls. On July 21, LOWA hosted a Security Contract Town Hall with 50 members in attendance, in person and by Zoom. AUS General Manager Joseph Ruggiero and Director of Operations William Lowery from the Richmond office made the case for a one-year renewal of the contract.

Chief Walker and Major Harrell answered questions about the various aspects of security operations in our community, including access control of the gates, road patrol, lake patrol, and LOWA asset protection. Chief Walker talked about the proposed night closure for guests from midnight to 6 AM, which is a cost-saving concept to be further discussed by Safety & Security and the Board in August and September. The video of the Security Contract Town Hall is on www.LOWA.Org. Our next Town Hall will be on the topic of Wake Boating, Aug. 31, at the Community Center and via Zoom. LOWA has retained A. Morton Thomas and Associates and Gary Greene Engineering to study the impact of wake boating on the Main Lake. Currently, all wake surfing is limited to the Centerline Buoy Course near the dam, and wake boarding is prohibited within 300 feet of shore and south of a line between Buoys 17 and 28 when a wake boat is deploying wake-enhancement devices.

VI, USE OF LOW ROADS AND PARKING LOTS A. Failure to comply with this regulation could result in fines up to $50 sanctions for each infraction as shown in Regulation XIV,. CORRECTIVE ACTIONS FOR VIOLATIONS SCHEDULE OF PENALITIES FOR VIOLATIONS. (1/2005).

D.2.g. During an emergency ice/snow condition as declared by LOWA’s President, the following pertains: (1) During extremely hazardous ice or snow road conditions, members are strongly advised to restrict their vehicular travel on LOW roads to emergency travel only.

(2) Any resident parking or abandoning a vehicle on LOW roads, cul-de-sacs, shoulders or road right-of-ways (including ends of driveways forward of the front boundary of private lots) will be subject to a penalty sanctions as shown in Regulation XIV,. The maintenance and improvement of Orange County roads are a significant direct concern of most Supervisors.

The internal roads in Lake of the Woods are controlled by the LOWA Board of Directors and the county does not get involved with them. There are some county and state concerns about the entrances to LOW, but other than that, we manage our own roads. The county Supervisors are directly involved with both state roads and private roads.

Orange County has about 900 miles of state-maintained roads. Of these, about 190 are considered primary roads, such as Routes 3, 20 and 512 and the remainder are secondary roads. The Virginia Department of Transportation maintains a Six-Year Plan for the secondary roads in the county. This plan lays out specific secondary road improvements and the schedules for those improvements. Usually, specific improvements are for road sections of about a mile or less. The improvements most often involve surface treatment and, in some cases, roadside ditches. Current improvement costs range from $100,000 to $460,000 and funding is allocated over two or more years to allow funding for planning prior to funding actual construction. This year four road sections are being funded.

VDOT receives specific secondary road funding for Orange County and makes recommendations to the Supervisors as to how and where those funds are allocated. For FY 22-23 the state allocates $488,149 to Orange County for secondary road improvements. This is state funding and local taxpayer funds are not involved. The Supervisors, based on their knowledge of road needs throughout the county, will approve those recommendations or make changes as appropriate. Once the Supervisors have completed their work, the Secondary Six-Year Plan must undergo a Public Hearing to receive comments from affected citizens. Usually there is little input at this stage since the Supervisors are well aware of citizen concerns. The most recent Public Hearing and Supervisor approval was conducted on May 19. Near term improvements are planned for Old Office Road and Matthews Mill Road.

The Supervisors also are involved in other secondary road decisions.

When a developer builds new roads as part of a development, the roads are eventually transferred to VDOT if they were built to VDOT standards. Part of that process is for the Supervisors to recommend that VDOT take over responsibility for such roads. In reverse of that process, the Supervisors at a recent meeting recommended the abandonment of a road that was on the state inventory list, but which did not exist. The Supervisors also designated four secondary roads as Rural Rustic which allows paving for a low volume road while re-establishing ditches and shoulders and leaving trees and vegetation undisturbed. This concept ensures environmental and financial stewardship while still providing basic paved road access. When citizens request new signage or speed limit changes on secondary roads, VDOT will conduct studies to determine if such changes are appropriate after the Supervisors formally request such studies.

In addition to the state secondary roads discussed above, there are many private roads in the county. Orange County prescribes standards for construction of private roads to ensure adequate access for residents, businesses, and emergency vehicles. In addition to construction standards, the county requires road maintenance agreements to ensure continued access. The Lake of the Woods Covenants provide the mechanism for LOW road maintenance. In the past, before such requirements were established, some private roads were poorly constructed and did not have any agreements to keep them accessible. The new county ordinance requires that any road serving more than seven lots must be built to VDOT Secondary Street Acceptance Requirements. Roads that serve up to seven lots have specific standards defined in the ordinance.

In 1962, the Supreme Court held that the Establishment Clause prohibited the recitation of school-sponsored prayer in public schools. The recent Kennedy v. Bremerton School District Supreme Court decision did not overturn the 1962 decision, but it overruled many legal precedents and opened the door for prayer in public schools by employees.

When the general public hears the phrase “separation of church and state,” they tend to interpret it to mean no prayer in public schools. This is a misassumption because students have been permitted to pray in schools at lunch or most anytime, as long as it does not interfere with instruction. In the Tinker decision in 1969, the Supreme Court declared that students “do not shed their constitutional rights to freedom of speech or expression at the schoolhouse gate.” If school employees are not participating, students can also receive religious instruction in school. For many years, the Lake of the Woods Church sponsored a Good News Club at the Locust Grove Middle School. School employees did not take part; volunteers from the church administered the club.

The recent Kennedy decision will have little effect on a student’s right to pray but is a dramatic change for school employees. Before the Kennedy decision, most school districts prohibited employee prayer if a student could overhear it. The reasoning was students are required to attend school, and hearing a prayer by a public school employee was considered a form of coercion. The Kennedy decision rejects the presumption of coercion. In Kennedy, the court reasoned that secondary school students are mature enough to understand that their school allowing someone’s freedom of speech or prayer does not mean the school is endorsing that view, let alone forcing students to participate.

The obvious question is, how will the Kennedy decision affect our schools? The following views are my own and do not represent the opinion of the school board. I predict the Kennedy decision will have little effect on students in elementary school. It may have some impact on middle school students. For example, in the Good News Club, school employees could now participate, but not in a leadership role. Middle school coaches may also want to use prayer, as approved in the Kennedy decision.

Almost all court cases concerning prayer in public schools have been at the high school level. The Kennedy decision wiped out most of the prevailing legal precedents school officials have depended upon for decision-making.

Therefore, there is the potential for a significant increase in prayer in our high school, including sporting events and graduation. We may even be able to return the baccalaureate service to the high school. For prayer in public schools, the Kennedy decision is a game changer.
