The new Flat Run Forebay (located on the main lake near the back gate) was completed in May 2020. The buoy warns boaters of the submerged rock wall.

Flat Run Forebay is a best-management-practice structure which is part of the 2012 Lakes Management Implementation Plan. The forebay is designed with a submerged rock wall to catch excess sediment and nutrients, suspended in the water column, before they are dispersed throughout the Main Lake. Excess suspended sediments can make water appear murky, contribute to poorer sunlight penetration, and contain excess nutrients. Excess nutrients contribute to harmful blue-green algae blooms and eutrophication. The forebay is located near the back gate on the main lake.

As-built, estimated removal rates are: • 372 tons of Total Suspended Sediment per year captured in the forebay, preventing it from being dispersed throughout the Main Lake. o Management will monitor the staff gauge at the site to determine when to dredge, however, initial engineering estimates indicate that the forebay will likely need to be dredged for sediment every two – three years.

• 2,455 pounds of Total Nitrogen per year captured in the forebay, preventing it from being dispersed throughout the Main Lake • 415 pounds of Total Phosphorous per year captured in the forebay, preventing it from being dispersed throughout the Main Lake

Members are asked to vote for up to, but no more than, two candidates for the two vacancies. All votes/proxies (by electronic means [including via computer or telephone], or by mail) must be received by September 4 to be counted. Any person designated by a member as proxy holder on the proxy ballot must attend the meeting in person for that proxy ballot to be valid.

Alternatively, Members attending the Annual meeting in person may vote in person on paper ballots provided at the Annual Meeting prior to the announcement of the closure of the voting by the presiding officer.

Stage Alive! Wait Till Next Year

It has been over 200 years since we had a year without summer - 2020 has become a “summer less” year. In 1816 a volcanic eruption in Indonesia generated so much ash that the sun was shadowed, snow fell, and crops failed. Put into perspective, the cancellation of Stage Alive’s 2020-2021 season may be easier to accept.

The Board held off making the call as long as we could, but three factors burned our bridges. First, we couldn’t be sure of the availability of the high schools’ auditoriums, and no other adequate venues exist. Second, some of the performers are beginning to question their willingness to travel.

And finally, many of our subscribers—including our Board—are among the most vulnerable to COVD-19.

Current subscribers have been notified and offered a credit toward the 2021-2011 season or a refund.

There will a 2021-2022 season beginning in September 2021 with the Richmond Symphony, which promises to end our cultural drought.

The LOWA Candidates Forum, which usually takes place in August, has been canceled. Carl Clawson and Teri Vickery are the two candidates running uncontested to fill two seats that will become vacant in September, 2020. The Elections Committee and the candidates have agreed it is not necessary to have the forum.

To learn more about the candidates, please see their interviews on TV 18 or online at LOWA.org. You may also read about the candidates in the July 3 Lake Currents.

As LOWA is a non-stock corporation, we must hold an election at a called Meeting of the Membership, even when the candidates are uncontested.

LOWA needs a minimum of 800 votes to secure a quorum for the meeting.

Meeting notices have been sent out and members may vote online using their unique code (as noted on the notice) via Vote-Now.Com (preferred method), via telephone voting with Vote-Now.Com, by paper proxy ballot (available only by request), or in person at the Annual Meeting of the Membership on Monday, Sept. 7.

LOWA Cancels Sept. 5 Celebration of Patriotism

Happy summertime, LOW! The Association has decided to cancel the Sept. 5 Celebration of Patriotism because of COVID-19. It is a super disappointing decision, but I see no way that we can invite thousands of members and guests to gather during this pandemic. No parade, no Clubhouse Point activities, no ski show, and no fireworks this year.

1. EXECUTIVE SESSION Motion by Clawson, passed unanimously, to enter into Executive Session at 1:01 p.m. for the purpose of discussing matters involving violations of the Declaration and Regulations for which a member, his family members, tenants, guests or other invitees are responsible; and discussing a personnel matter.

Motion by H. Brown, passed unanimously, to exit Executive Session at 2:11 p.m.

Main reasons why: 1. Assuming the current restrictions of 250-person gatherings will still be in place, all events - parade, Clubhouse Point activities, ski show, and fireworks – usually handle no less than 2,000.

2. Physical distancing requirements among participants will be a challenge in any phase of the day. Large events are chaotic by nature. The protocols for a large event like this are extensive - more signs, hand washing stations, enhanced bathroom sanitization, guest flow plans, visible markers for queue lines - to name just a few.

3. Virginia COVID-19 cases are rising; we cannot predict potential changes in the Governor’s Guidelines in the coming weeks.

4. Cancelling the fireworks means we lose half of the first payment - $3,575 (prepaid fees) – but we get to use the other half as a $3,575 deposit for next year’s Independence Day Event. We save $7,150 by not making the second payment.

We also save on Point event rides, and Maintenance and Security overtime.

OPEN SESSION Pledge of Allegiance 2.1 Motion by Zukowski, passed unanimously, to enter into Open Session at 2:25 p.m., and to affirm that the Board met earlier today in Executive Session for the purpose of discussing matters involving violations of the Declaration and Regulations for which a member, his family members, tenants, guests or other invitees are responsible; and discussing a personnel matter.

Roll Call: Present in person: President Wilks, Vice President Zukowski and GM Phil Rodenberg. Present via Zoom teleconference: Treasurer Diercks, Secretary P. Brown, and Directors Clawson, H. Brown and Forrest.

2.2 Confirmation of Quorum and Meeting Notice Secretary P. Brown confirmed that a quorum is present and proper notice sent to all members of record.

2.3 Approval of Agenda Motion by H. Brown that the Board approve the Agenda.

Motion by Wilks, passed unanimously, to amend the Agenda to postpone Item 6.3 to the August 19, 2020 Board meeting. Vote on the original motion as amended passed unanimously.

2.4 Approval of Minutes of the June 24, 2020 Regular Board of Directors meeting.

Motion by P. Brown, passed unanimously, to amend Item 4.3 so the second sentence reads: “They approved forwarding to the Board the Committee’s comments and suggestions for the Golf Business Plan and discussed how to address remedial work needed on the #13 and #14 holes.”

Vote on the original motion to approve the minutes of the June 24, 2020 Regular Board of Directors meeting as amended passed unanimously.

2.5 Resolution of Appreciation for Facilities Director Jessica Graves.

(Resolution 2020-20) President Wilks and General Manager Rodenberg presented a Resolution extending sincere appreciation to Jessica Graves for her years of service to LOWA and naming the Equestrian Center Covered Ring the “Jessie Graves Arena”.

legal remedy available to the Board and/or the Association under the Restrictive Covenants, Articles of Incorporation, Bylaws, Rules and Regulations and applicable laws. (10/7/17) H. Damage to LOWA property must be paid for by the members responsible for such damage, to include damage caused by their families, guests, their registered tenants and their families or their families’ guests. (2/5/2011) I. Established fees or other charges must be paid by sponsoring members, their guests or their registered tenants. Members are responsible for the unpaid fees of their families or guests while using LOWA amenities.

(2/5/2011) J. Violation of LOWA Regulations may be reported by a LOWA member to the Security Office for appropriate action, and the reporting member may sign as a witness to the violation.

With sufficient evidence, Security may issue a citation which can result in the levying of penalties by the LOWA Legal and Compliance Committee.

(See Regulation XIV.) Revocation of privileges may also be imposed by the Board of Directors.

K. PROCEDURE FOR NEW AND AMENDED LOWA REGULATIONS: (2/5/2011) All Regulations become effective when promulgated and/or amended according to the following procedure.

Step one: A proposal for a change to LOWA Regulations can come from a LOW member in good standing, a LOWA committee, the General Manager or the Board of Directors. The Board of Directors shall determine if the request has enough merit to send to the Rules Committee and the LOWA Counsel.

Step two: The Rules Committee conducts research to determine if the request is redundant or in conflict with the governing documents or any other regulation. If the Rules Committee determined that the proposal is redundant or conflicting it shall report this conclusion to the Board. Otherwise, the Rules Committee shall prepare a resolution using appropriate language in congruence with the governing documents and submit the resolution to the Board.

Step three: After receiving the reports of the general counsel and the Rules Committee, the Board of Directors approves, modifies or rejects the resolution. If approved, the Board forwards it to the General Manager for publication in the Lake Currents. The LOWA membership will then have not less than two weeks to comment to the Board on the new regulation.

Step four: The Board of Directors shall take into consideration the comments received from the membership and shall adopt, reject or modify the proposed changes. Should the proposed redraft of the regulation be significant as proposed by a majority vote of the Board, the changes will again be published in Lake Currents for public comment.

Following the designated two weeks for comment and final approval by the Board of Directors, the adopted or modified Regulation(s) will be incorporated into the LOWA Regulations. The Board of Directors will upon adoption, announce the effective date of the proposed and/or modifies Regulation(s).

Step five: The GM shall ensure the adopted amendment is published in Lake Currents in a timely manner before enforcement begins. (6/15/16)

The Board of Directors is seeking member comment regarding proposed amendments to LOWA Regulation 1.G. regarding Sanctions for Persons Who Engage in Conduct that Causes Member, Tenant, or Guests Public Nuisance or Disturbing the Peace. Members who wish to provide comment or feedback should email the Board at Board@LOWA.org by 5 PM, Friday, Aug. 14 What is proposed? Amending LOWA Reg. 1G to expand the scope of offenses for which a member may be penalized for improper activities including: • Physical or verbal abuse, threatening behavior, or belligerence • Causing or creating a disturbance, nuisance, inconvenience, annoyance, alarm, or apprehension to another person • Endangering another person or their property • Compromising the health and safety of another person.

AND • Expanding the sanctions for such offenses to include, in addition to citation: o Suspension of use o Any other legal remedy available under the governing documents and applicable law.

Why? The current regulation allows only for “citation” and not other penalties for such offenses on common areas such as beaches. This amendment would provide for barring offenders from using a beach or other common area.

Who proposed it? The General Manager recommended the Board authorize publication of this amendment for member comment. The Rules committee and the LOWA attorney have reviewed it and agree it is ready for publication.

What is the effect? The amendment would allow the board to bar offenders from using common areas such as beaches for violations of the amended regulation.

The proposed amendments to the bylaws are highlighted in bold and strike thru read as follows: I. GENERAL A. The Restrictive Covenants and Articles of Incorporation of the Association authorize the Board of Directors of the Association to promulgate and enforce Regulations. The Articles also provide for a Legal and Compliance Committee to assist the Board of Directors in Regulations enforcement.

B. A great deal of the effort which goes into making our community function well comes from committees and individual volunteers. Thus, the residents and other property owners play a large role in shaping and enforcing these Regulations. While the Regulations are enforceable through a system of fines and penalties, the best controls are achieved through the cooperation and participation of all residents and property owners. Therefore, recommendations for changes or additions to these Regulations are welcomed and encouraged.

C. The use of LOWA amenities is authorized for property owners and tenants in good standing, their families and guests and any individual or organization that has received the approval of the General Manager.

(2/5/2011) D. A Member is eligible to vote, use amenities and receive a membership card when all fees and service charges are paid in full.

E. All persons using LOWA amenities and facilities do so at their own risk and LOWA assumes no responsibility for injury, damage or loss of property resulting from such use, whether officially open or not.

(6/1996) F. Activity constituting, or resulting in, disturbing the peace in LOW is prohibited.

G. Proper decorum must be observed by all persons for any activity in or on the common areas or common facilities of the community. Members may be assessed a charge for violations of the Restrictive Covenants and Rules and Regulations committed by themselves, their families, guests, and tenants, as well as guests of their tenant and/or their contractors and the contractors of their tenants while the contractors are within LOWA. Any P persons who engages in conduct that either (i) violates the Restrictive Covenants or Rules and Regulations for use of the common area or common facilities of the community, or (ii) is physically or verbally abusive, threatening or belligerent toward any other person in, on or around the common areas or common facilities of the community, or (iii) causes or creates a disturbance, nuisance, member, tenant, or guests public inconvenience, annoyance, or alarm or apprehension to any other person in, on or around the common areas or common facilities of the community, or (iv) endangers the person or property of any other person or LOWA in, on or around the common areas or common facilities of the community, or (v) compromises the health and safety of any other person in, on or around the common areas or common facilities of the community, is subject to sanctions, including but not limited to citation, suspension of use, and any other

In February of 2019 Lake of the Woods introduced RainedOut, a text message alert service, as a means of notifying members “about sudden, unexpected, critical and rapidly-changing situations which affect daily life at LOW,� such as road and amenity closures.

Initially, RainedOut was completely free of charge; however, in late 2019 RainedOut switched to a pay as you go service. To date, just under 900 members have subscribed to the text message alerts. LOWA is conducting this brief poll to determine if our members wish to keep the service or to cut it as a costsavings measure to reduce expenses in the LOWA Communications Department budget.

This year we are asking the LOW Community to consider donating cash and/ or checks (made payable to LOW Lioness Foundation) so that we can shop for the exact items the schools need. The committee will shop for you, either in retail stores or online. Rest assured; we are constantly looking for the best deals! We would appreciate your donations made by Aug. 10 to give us enough time to shop and deliver everything to the schools.

The decision was made in the interests of our community and the safety of both our members and all those who would attend. D. Referendum Update Secretary P. Brown reported that to date 2,105 total votes have been cast, 1423 electronic and 682 paper ballots. The Election Committee is recording videos that will be available next week to encourage voting. The Elections Committee is seeking new volunteers to serve on this important committee.

5. UNFINISHED BUSINESS 5.1 Consideration of Approving the Golf Business Plan. (D-20-78) Motion by H. Brown, passed unanimously, that the Board approve the Golf Business Plan dated July 14, 2020.

5.2 Consideration of Publishing in Lake Currents for Member Comment Proposed Amendments to LOWA Regulation I.G: General, Regarding Sanctions for Persons Who Engage in Conduct that Causes Member, Tenant or Guests Public Inconvenience, Annoyance or Alarm. (D-20-79) Motion by Clawson, passed unanimously, that the Board approve publishing in Lake Currents for member comment proposed amendments to LOWA Regulation I.G: General, regarding sanctions for persons who engage in conduct that causes member, tenant or guests public inconvenience, annoyance or alarm.

5.3 Status Report on FY2019-20 Board Goals.

General Manager Phil Rodenberg summarized the current status of the eight Board goals adopted by the Board last fall. The Flat Run Forebay project has been completed. All others are partially complete and/or continue to progress and are at various stages of completion according to the 201920 Board Goal Implementation Plan. Goals such as improving stormwater management and financial internal controls, and closing out the Referendum are expected to continue into the next Board year.

OPEN SESSION Announcement: General Manager Rodenberg reported that a part-time Clubhouse employee has tested positive for COVID-19. LOWA is working with the Virginia Department of Health—Rapidan Health District, who will be conducting contact tracing. LOWA continues to enforce health safety practices and sanitation requirements since reopening in Phase 2. The General Manager will issue a notification to all members after the Board meeting.

C. Committee Changes Motion by Zukowski, passed unanimously, that the Board approve the Committee changes as presented in the Committee Change List dated July 14, 2020 as follows: (D-20-77)

Motion by Zukowski, passed unanimously, that the Board adopt Resolution 2020-20 as presented, a Special Resolution, regarding appreciation for Jessica Graves.

President Wilks explained the guidelines for the meeting using the Zoom Teleconferencing Platform and how Board and member participation is being accommodated.

E. Annual Meeting of the Membership—Logistics Secretary P. Brown reminded members to read President Wilks upcoming article in Lake Currents. A quorum of 800 proxy ballots is required to elect and seat a new Board. Marion Pronk Hall can only seat about 50 people due to COVID restrictions, so we encourage everyone to vote in advance, preferably by e-mail through Vote-Now.com. We also encourage Members not to name another Member as their proxy as that person must attend in person for the vote to be cast and counted. Instead, voters should leave the proxy blank and the Secretary will cast your vote as you have indicated. Members may watch the meeting on Zoom but they will be observers only. Votes must be cast by proxy or in person. Paper ballots will be available at the Community Center at the Annual Meeting of the Membership on September 7th.

4.2 Report from the General Manager, Phil Rodenberg A. Coronavirus Status of LOWA Amenities, Events, Meetings and Business Operations The General Manager updated the Board on the most recent changes to community activities and business operations as LOW gradually increases service and amenity availability times for members. The July Concert on the Point has been postponed until the fall. Guests are now allowed at the pools.

B. May Financials In May, LOWA collected $932,921 in current year lot assessments for a total of $4,919,402, or 68.4% of the total lot assessments billed. As of May 31, the Unaudited Income Statement Budget-to-Actual Comparison Study showed an unfavorable variance of ($19,615), reflecting the impact of the business slowdown related to the COVID-19 pandemic. No members were considered delinquent as of May 31 for current year lot assessments.

C. Lakes Management Report Construction contractor Docks of the Bay was on-site July 6th for warranty repair to the fabric gate in the Gabion wall of the Flat Run Forebay. A step and handrail were installed at Harpers Ferry Beach.

4.3 Committee Reports Environmental Control Committee (ECC).

Chair Mike Rugless provided the Annual Report for the year-ending April 30, 2020. Since May 1, 2019, staff has reviewed 55 new home construction projects and 100 other upgrade or add-on home/property projects, generating $690,239 in new construction/renovation fees for LOWA. In addition, 415 tree removal requests were reviewed for approval. ECC staff has been developing a program to add Regulations covering outdoor aesthetic features desired by members, and reviewing the LOWA Regulations for other possible changes or inclusions.

New “No Trespassing” signs have been installed on appropriate member properties and owners are pleased to have them to help protect their property.

6. NEW BUSINESS 6.1 Consideration of Naming Rights for Buildings. (See Item 2.5) No other action taken.

6.2 Consideration of Coronavirus Status at LOWA Amenities, Events, Meetings, Offices and Financial Status. (D-20-80) Finance Director Charles Maneval provided the Board with an update on LOWA’s financial status, which remains good. No change has been made to the underlying assumptions made for the first quarter forecast. Funding of the FY2019/20 operating deficit will be addressed at the end of July.

Assessment income is comparable to that of last year and is commensurate with the budgeted amount. A loan from the Paycheck Protection Program has proved beneficial to keeping and bringing back staff required to support our amenities and operations. The GM and Finance Director recommended the Board extend fee waivers in key areas, and make an early payment on the CARC loan which would achieve considerable savings on loan interest.

Motion by Diercks, passed unanimously, that the Board approve making a prepayment of $100,000 to Mutual of Omaha Bank towards the repayment of the Clubhouse Area Recreation Complex loan to save $31,000 on future interest payments, funds to come from the CARC Reserve Fund collected as part of the annual assessment.

by Heather Kuzma, Communications LGA The Match Play Tournament is under way. The first round is completed. If you won your match, the second-round match must be completed by Aug. 7.

The Presidents Cup Tournament began last Tuesday, July 28. If you couldn’t play that day, you can still participate by playing in the second round on Aug. 4, and the third on Aug. 11. You will pay an additional one-time $2 fee to play in the Presidents Cup. There will also be a regular Tuesday game each week with the usual $3 fee.

There are two events coming up in August. Tentative dates for the Ladies’ Club Championship are Saturday and Sunday, Aug. 15 and 16. This is a LOWA event and will be handled by the pro shop. Look for the sign-up sheet and details in the pro shop area. The LGA Member/Member Social and Tournament are tentatively scheduled for Monday and Tuesday, Aug. 24 and 25. Sign-up sheet and details will be posted in the ladies’ lounge at the Woods Center.

Next Tuesday, Aug. 4, is the first Tuesday of the month; that means it is Food Bank collection day. Please bring your non-perishable food items to donate to the Wilderness Food Bank. Look for Dottie Lohr’s car with the trunk open to collect your items. Cash or check donations are also welcome, and Dottie will deliver them to the Food Bank.

7. DIRECTOR COMMENTS Directors commented on considering adopting some guidelines for naming buildings, and how suggestions are handled through the rules process.

6.3 Consideration of Sending to the Rules Committee and the LOWA Attorney the Proposed Amendments to Regulation XVI: Environmental Control and Construction Procedures. (This item was postponed to the August 19 Board meeting.)

6.4 Consideration Entering Lots for Maintenance. (D-20-81) Motion by Forrest, passed unanimously, that the Board approve entry to the lot in Case #20-0714-02 on or after July 14, 2020, to perform maintenance as stipulated in the ECC Chair’s letter to the individual lot owner, and that the property be billed for the cost related to such work in accordance with Paragraph 14 of the Restrictive Covenants.

6.5 Consideration of Approving Annual Property and Liability Insurance Package for the Period August 1, 2020 through July 31, 2021. As I have mentioned in a previous article, Orange County is proceeding with a program to provide broadband internet access throughout the county. Like electricity and telephone service, broadband internet service is becoming more essential to living and working in today’s modern connected environment. The county got a big boost in this effort when we received a federal grant to provide fiber optic connectivity to the county schools. The county augmented that grant to fund additional fiber optic strands beyond those needed for the schools. Those additional strands will be used in support of the upgrades to the county’s emergency radio communication system, connectivity between county offices, and to provide broadband service to county residents.

This broadband internet access program will focus on areas of the county that do not currently have broadband access available. The towns of Orange and Gordonsville, Lake of the Woods and Wilderness Shores already have broadband available and are not covered by this program. Of the 17,459 addresses located in Orange County, 9,345 already have broadband internet access. The remaining areas of the county that are underserved are mostly the rural areas of the county, where homes and businesses are widely spaced; commercial service providers do not consider them profitable.

The program is proceeding in eight phases. The first phase is the installation of the core fiber network providing services to the schools. That core network extends the length of the county and is now complete. The second phase is the fiber connections of the public safety radio system from the dispatch center to five of the six radio towers. The sixth tower will be connected by microwave. This phase is in progress. The third phase is connecting our core network to the rest of the world’s internet by two separate paths to the Network Access Point at the Equinix Culpeper Data Center.

Contracts and agreements are in place to provide that connectivity, but actual connection is still in progress. The fourth phase is the connection of various government facilities and this phase is also in progress. These phases are not in sequence in that all of them are proceeding simultaneously.

Phases five through eight deal with connecting county businesses and residences. Those roads with higher densities of addresses along the roads will be in Phase 5. The costs associated with reaching those addresses are directly related to how much fiber needs to be installed along the roads. The biggest bang for the buck is in higher density areas where more addresses can be served for given installation costs. Phase five is expected to serve about 3,745 addresses. Phase six and seven are expected to serve 1,320 and 846, respectively. Phases five through seven are expected to take 36 months, starting this month. Phase 8 is designed to reach the remaining 2,200 households in subsequent years, as broadband operations generate funds to expand the network. As we progress, there are many factors that could lead to adjustments to that plan.

For those addresses along state roads, the Orange County Broadband Authority can get permits to run fiber along those roads. On private roads, easements to run fiber along those roads will have to be obtained from each property owner, which can be a cumbersome process. Individual property owners will have to work with their neighbors to arrange such easements, as the county does not have the staff to manage that process.

Due to the coronavirus, the reopening of schools this year will be far from normal. On July 12, the Orange County School Board voted to delay the first day of school for students until Monday, Aug. 24. This delay will permit the teachers to have three weeks to plan for the changes needed to reopen the schools. How the schools will open is a work in progress, but at this time, full-time face-to-face instruction seems to be off the table.

Back in March, when we first became aware of the coronavirus, Dr. Anthony Fauci and many others told us the data would drive decisions concerning the virus. But as administrators across the Commonwealth are making plans to reopen our schools, the data-driven approach appears to have been forgotten.

The risk to children from the coronavirus is small. The death rate for children from the flu is higher than that of the coronavirus. According to the Virginia Department of Health, for children under the age of 19, there have been no deaths in Virginia associated with the coronavirus.

Some are asking, what is the risk to the teachers when schools reopen? Dr. Mark Woolhouse, a leading epidemiologist and one of the British government’s leading scientific advisers, has said there has been no recorded case of a teacher catching the coronavirus from a student anywhere in the world. As schools all over Europe are opening with full-time face-to-face instruction, Dr. Woolhouse has said it may have been a mistake to close schools in March, given the limited role children play in spreading the virus.

The data says the coronavirus is a low risk to our students, and the students are a low risk to their teachers. Therefore, based on the data, in my opinion, the Orange County Public Schools should reopen by offering students the option of full-time face-to-face instruction or online instruction using Virtual OC.
