Director of Facilities Hired

I am pleased to announce the candidate selected to replace Jessica Graves as Director of Facilities is Theodore R. (Ted) Mattingly. He has accepted the offer of employment and will join the team on Aug. 24. His email address will be: TMattingly@Lowa.Org Ted has over 25 years of facilities management experience, including operations oversight, project management, process improvement, and workflow coordination. He has been in his current position Th as Director of Facilities and Administrative Services eo do with the National Recreation and Park Association re R. for over 16 years. In that position, Ted oversees all (T e d) M operational and administrative functions including operating and a tti n g ly capital budget development, preventive maintenance and repair, life safety systems, construction and project management, space planning, physical security, contract management, risk management, and purchasing and records management. He is a member of the senior leadership committee and leads the emergency response and sustainability teams. Prior to working at NRPA, Ted was the Facilities Operations Manager with the American Council of Life Insurers and Facilities Coordinator with the American Red Cross.

Ted earned a Bachelor of Science in Business Administration and Management from Towson University. He is credentialed as a Certified Facility Manager (CFM) and a Sustainability Facility Professional (SFP) by the International Facility Management Association. He also has a Professional Certificate in Facility Management from George Mason University. Since 2004, Ted has been an Adjunct Instructor with George Mason University’s Facilities Management Program.

From the more than 20 resumes received during our recruitment, six initial interviews were conducted. Following the initial round, four candidates were invited to meet with the GM, Senior Managers, the Maintenance Foremen, and the Operations Center Managers.

Scenic Photo Contest

We are excited to announce the Third Annual LOW Scenic Photo Contest. We are looking for great photographs that showcase our community, amenities and activities. Perhaps you have already taken some fantastic shots, or maybe you want to explore LOW (while social distancing) and take some now. All photos that primarily feature a scenic view of common areas within LOW are welcome.

Any type of camera may be used to take the photo. Got your cell phone handy? Then snap a great shot and send it to us!

Winners will receive LOWA Gift Certificates (no cash value) and will be announced and their photos featured in the Sept. 11 issue of Lake Currents.

LOWA Gift Certificates will be awarded as follows: first place $50, second place $25, third place $10.

Winners will be selected by the LOWA Communications Staff. All decisions are final, including any disqualification due to contest rule violations. Please see below for contest rules & entry instructions. All eligible entries will be uploaded to LOWA.org on Sept. 11 for members to view.

President’s Message

Election Voting As of the date I am preparing this message, the vote count for the election of Directors stands at 548. Although this election is uncontested - two candidates for two upcoming vacancies - our Bylaws require a vote by the Membership for the candidates to be elected and require at least 800 valid inperson or proxy ballots to establish a quorum for the meeting.

Article V, Section 2 of the Bylaws states, in part: “. . . All Directors shall serve until their successor(s) have been elected at the Annual Membership Meeting, and as certified and seated at the first Board of Directors Meeting following the Annual Membership Meeting.”

In my opinion, one of the tasks for the new Board may be amending the Bylaws to make it efficient and inexpensive to elect Directors at the Annual Meeting of the Board of Directors, rather than the Annual Members Meeting, only in an uncontested election. To do so with little or no expense in the above circumstances will require that the Board of Directors (consisting of seven Members) votes to elect the candidates at the Annual Meeting of the Board of Directors. The Bylaws will have to state that the Directors are required to vote in the affirmative to elect the candidates. There might be other ways of doing this, but I leave that to the lawyers. Revising the Bylaws to cover that circumstance may have unintended consequences, such as discouraging qualified candidates from throwing their hats into the fray.

Referendum Voting: This is nearly my last opportunity to speak about the referendum as Association President. At the June 24 Board meeting, we voted to initiate suits after July 16, 2020 against three Members who are failing to properly maintain their property. The Association has exhausted the notification process and engaged in numerous efforts, over and above the legal requirements, for nearly a year, trying to get the Members to comply with the Covenants/Regulations.

Thereafter, the Members substantially corrected the deficiencies, however, getting that compliance cost you, the Members, $4,200 in direct and indirect expenses.

The last count of ballots submitted for the referendum stands at 2,107, still 493 below the 2,600 target. Even when, or if, that target is reached, it is not known at this time whether either or both referendum items will pass. Each and every lot owner has a responsibility to maintain their property in a manner satisfactory to the Board of Directors (Restrictive Covenants, p. 11). Since, without passing the second referendum question, we cannot levy a charge of ten dollars per day for ninety days, which would provide an incentive for the lot owners to effect repairs, we must use the legal system. The referendum is not a scheme to generate revenue. It is an attempt to get the minority of lot owners who cannot or will not maintain their property to do so. If you are one of the unlucky lot owners living next to a property that is not maintained, you should need no incentive to vote, and vote yes, in the referendum.

3. MEMBER COMMENTS ON BUSINESS AGENDA AND GENERAL MEMBER COMMENTS Two members spoke on safety issues associated with the current skier-down flag rules.

4. REPORTS 4.1 Report from Orange County Board of Supervisors Supervisor Lee Frame reported that Board meetings are currently being held via Zoom. Since public hearings are not advisable at this time, a 2-week comment period is being held open on issues to receive comments from residents. The County has continued to conduct business as usual, having adopted the budget and a 6-year road plan. The County is in the earliest phase of establishing broadband in the County, with hookup to schools taking priority. More information on the 8 phases of the broadband project can be found in the July 31 issue of Lake Currents.

Whew! We dodged a bullet with Tropical Storm Isaias! We opened the gates at the two dams, and it seems we kept the lake levels even. It was a little bit of art and a little bit of science.

Have you seen the single engine airplane flying above the Main Lake? There’s a real buzz about it around the neighborhood.

For some members it lifts their spirits to see those aerobatic turns. For others it’s a drag on the mind to think the pilot is flying too close to homes.

One said it rattled her dishes. This might not be a subject of much weight for some, but the thrust of this column is to enlist your help in identifying the airplane or the pilot.

I called Buzz Jarrell, the airport manager at Orange Airport. He said visual flight rule (VFR) pilots don’t necessarily file flight plans. He believes it’s someone who lives here in LOW or comes to be seen by friends in LOW. • I would like to talk to the pilot about minimum flight levels. I’m concerned the plane is flying too low. You can help! We need to get the “N” number from the side or tail of the fuselage. The “N” number starts with an N. It can consist of: • One to five numbers (N12345) • One to four numbers followed by one letter (N1234Z) • One to three numbers followed by two letters (N123AB) It would help if you can also get more details like: • High wing or low wing • Single wing or Biplane • One engine or two • Color scheme But we really need get the “N” number.

So, is this plane too low? Former Example of N Number location Air Force and airline pilot (and Lake Currents copy editor) Dan McFarland and I discussed it, and it’s a bit of a gray area. The Federal Aviation Regulations have two applicable standards for minimum safe altitudes in FAR 91:119: 1. (b) Flight over congested areas is 1,000 feet above the highest obstacle within 2,000 feet. Congested areas include any area of a “city, town, settlement or over any open-air assembly.” Even though “settlement” reminds me of pioneer days, I think it’s safe to say our community of 9,000 is a settlement.

2. (c) Over other than congested areas is 500 feet above the surface except over open water or sparsely populated areas. In those cases, an aircraft cannot be operated within 500 feet of a person, vessel, vehicle, or structure. This exception for open water makes me concerned because I have received reports the plane flew down the lake. If there are boats on the lake - and we have over 2,000 watercraft in LOWA - it is not open water.

The Governor’s Stay At Home Order precludes Members from physically attending BOD Meetings. Instead, Members may either send comments ahead of time to Board @LOWA.Org. or attend the virtual meeting via Zoom. Members of record may record any portion of this meeting so long as (1) you first notify the President for an announcement before you begin and (2) you do not interfere with other members or the official recording. (See Administrative Regulation 2016-4.)

Who proposed it? Fitness Center staff has observed skateboarders on the Clubhouse Pool/Fitness Center entryway and sidewalks. The GM recommended the change. The Rules Committee and LOWA attorney have reviewed the amendment and their recommendations have been incorporated into the amendment.

Why? Skateboarders are using the Clubhouse Pool/Fitness Center sidewalks and entryway.

What is the effect? Adding these to the prohibition list will help deter skateboarders in areas where members are walking and will allow Security to enforce the rule.

D. Referendum Update Secretary P. Brown reported that to date 2,107 total votes have been cast, 1425 electronic and 682 paper ballots. They will be monitoring usage of the new vote-by-phone option.

4.7 Report from the General Manager, Phil Rodenberg A. Coronavirus Status of LOWA Amenities, Events, Meetings and Business Operations The General Manager updated the Board on the most recent changes to community activities and business operations as LOW gradually increases service and amenity availability times for members. All activities for the September 5 Celebration of Patriotism, formerly the July 4th celebration, have been cancelled due to the pandemic.

B. June Financials In June, we collected $249,254 in current year lot assessments for a total of $5,167,991, or 71.8% of the total lot assessments billed. As of June 30, our delinquency rate was 7.5%, and the Unaudited Income Statement Budget-to-Actual Comparison Summary showed an unfavorable variance of ($10,853). Adjusting for the CARC Loan interest expense variance on the loan totaling $29,896, the Operations Budget versus Actual for the two months of the year came in favorable at $19,043. The downturn in revenue from all amenities continues due to the pandemic. LOWA will continue to manage operations to mitigate as much negative impact as possible on our financial picture.

C. Lakes Management Report Lake sediment dredging operations are currently underway at dredging point #13. Dock bumpers were replaced at the Main Marina boat ramp. Water testing at Keaton’s lake on July 20 found no blue-green algae. Low levels of the algae detected in the front entrance pond were treated with algaecide on July 24th.

The County received $3.3M from the Coronavirus Aid Relief Economic Security Act distribution of funds, which will be directed to help meet expenses for the County, towns and businesses, and provide family assistance and support broadband. A second $3.3M has also been promised.

Rapidan Service Authority has deferred their rate increase planned for July until the end of August, and is suspending disconnecting service to residents for unpaid bills through August.

4.2 Report from Orange County Sheriff: No report available.

4.3 Report from Allied-Universal Security Security Chief Scott Walker reported an uptick in minor vandalism in July in the Hollyfield Park area, which is being investigated. Of note, in July there were 9 motor vehicle accidents, 14 welfare checks and 18 noise complaints. Staff is working with Lakes Committee volunteers to review video footage to build a statistics base for traffic volume at the front gate.

4.4 Report from LOW Volunteer Fire & Rescue President Mike Cianci reported that in July the Fire Department responded to 31 calls, 14 inside the LOW and 17 outside. There were 7 fire calls, 6 vehicle accidents, 9 public service calls and 7 fire alarms. The Rescue Squad had 17 calls for service, 10 inside LOW and 7 outside.

They performed 7 hospital transports.

4.5 Report from Orange County School Board Representative Jim Hopkins reported that this year’s school opening for students has been moved from August 10 to August 24. Teachers will be reporting a couple of weeks before that and continue to address instruction formats acceptable to students, parents and teachers.

4.6 Reports of Officers President Wilks reported that former Board member and Marine combat veteran Ernie Meier passed away on July 13.

The Vice President, Treasurer and Secretary had no report.

He also reported that the Elections Committee met on July 20 to discuss how to handle the Annual Meeting logistics and the various voting methods available to members. Administration will e-mail members to remind them to vote in the Director election.

I’m concerned because back in 2011 we had a seaplane do touch and go exercises on the main lake. Our regulations prohibit aircraft landings and so we got the N number and contacted the aircraft owner. He said weeks after our incident the pilot and his passenger crashed the plane taking off from an airport.

Bottom line. I’m not trying to be a killjoy, but I believe the pilot should stay 1,000 feet above the water towers at Flat Run and Wilderness Shores. So that, if there is an emergency, the pilot can divert the plane away from the homes here.

If you can get the tail number, we will contact the pilot! You will need a long lens camera or binoculars.

Due to the fun and success of the July 4 Flag Boat Parade, with a record number, over 40, patriotic boats, we have scheduled a second boat parade for Saturday, Sept. 5 at 5 PM. Decorate your boat as you wish, with flags or any other theme.

This will be shore and cove enjoyment while easily watching floating entertainment, from clever boaters, as they provide fun and success once more!

The Match Play Tournament is continuing; the first and second rounds are completed. If you won your second-round match, the third-round match must be completed by Aug. 21.

The Member/Member Tournament is now scheduled for Tuesday, Aug. 25. We will not be having the social the day before due to requirements to slow the spread of the Covid-19 virus. Sign-up sheets and instructions are posted in the ladies’ lounge in the Woods Center.

The Ladies’ Club Championship Tournament has been tentatively rescheduled for Oct. 17 and 18. If you have an opinion regarding these dates, please contact Sheran Marks and let her know.

The annual Fall Membership Meeting will take place on Tuesday, Sept.

8, at 7:45 AM, in the Fareways Café before golf. This is when we vote on our slate of officers for the next year.

Our start time for Tuesdays in August is 8 AM with sign in by 7:30. Remember to stay hydrated and stay in the shade as much as possible on these hot days.

LOW Ladies ’n Friends LOW Ladies ’n Friends is a senior ladies bowling league that meets at the AMF Bowling Center in Fredericksburg each Monday from 10 AM to noon.

Teams of three ladies bowl three games each week, for 27 weeks. The season ends by April 2021. The 2020-2021 season will begin on Monday Sept. 14.

Since Monday, Sept. 7, is Labor Day, a planning meeting will take place on Monday, Sept. 14, at 9 AM prior to bowling that day. We will meet at the lanes to confirm returning teams, review league rules, review weekly costs and meet any new members.

LOW Garden Club: Behind the Scene

While COVD-19 has squashed regular meetings and field trips, it hasn’t deterred members from participating in other activities. On an on-going basis, volunteers weed and prune gardens at the Clubhouse, Memorial Garden, Library, and butterfly garden. Food Bank collections have been increased from a box full at regular meetings to a carload. Our last pick-up was Aug. 10, from 1 to 3 PM, at the Clubhouse. If you missed it, catch us next time.

We coordinate collections with the seasonal needs of the Food Bank, and have the following schedule: September - dessert mixes, brownies, cakes, cookies, etc.

October - oil, cooking sprays November - side dishes, pasta, rice, potato, stuffing, etc.

December - coffee or tea January - pancake mix, Bisquick, and or syrup February - canned soup (everyone likes chicken noodle) March - cereal April - single serving items May - pickles, olives, etc.

We will also resume collections for Penny Pines, and a jar will be available at the time food bank collections are made.

Cancelled: LOW’s Fourth Annual Wine Tasting and LOWLINC Fundraiser

For months, we’ve been hoping to have LOW’s annual wine tasting event and LOWLINC’s largest fundraiser on Sept. 27. A 15-member planning committee has been diligently working since April to prepare, even as we monitored Covid-19 case numbers and event guidelines in Virginia and our area. We’d lined up six local wineries and arranged for a food truck and our Clubhouse to offer a variety of food options. Twenty-five generous businesses contributed as event sponsors. We were all set to begin selling tickets Aug. 15. It was going to be a great event!

However, over the last few weeks, it’s become clear that with Covid-19 case numbers rising and the health and safety of the LOW community our highest priority, we simply can’t hold the event this year. Even an outdoor event at Sweetbriar Park could potentially pose a health risk to volunteers, attendees, and winery and food truck vendors. We evaluated a Plan B virtual drive-by event during

which ticket holders could pick up pre-ordered wine, but we felt that it would not achieve our goal of having a fun, community-wide event. So, as with so many other events this challenging year, we must regrettably cancel the 2020 Art of Wine. We certainly hope 2021 will be a better year in every way – and that a 2021 community wine event will be possible.

Since the Art of Wine is LOWLINC’s biggest fundraiser, if you were planning to join us on Sept. 27 (or even if you weren’t), we welcome your online donation at lowlinc.org or with a check mailed to LOWLINC, PO Box 518, Locust Grove, VA 22508. 6.3 Consideration of Approving a Drainage Relocation Easement and Authorizing the President to Sign. (D-20-89) Motion by Forrest, passed unanimously, that the Board approve a drainage relocation easement and authorize the President to sign the documents in a form approved by the LOWA attorney.

6.4 Consideration of Entering Lots for Maintenance. (D-20-90) Motion by Forrest, passed unanimously, that the Board approve entry of the Lots in Case #20-0801-01 and Case # 20-0801-02 on or after August 1, 2020 to perform maintenance as stipulated in the ECC Chair’s letter to the individual lot owner in the first Case, and the Stormwater Inspector’s letter in the second Case, and that the property be billed for the cost related to such work in accordance with Paragraph 14 of the Restrictive Covenants.

7. DIRECTOR COMMENTS Secretary P. Brown reminded residents to vote in the Director election, which will require a minimum of 800 proxy votes for a quorum in order to seat a new Board. President Wilks said he has been working with ECC on potential revisions to Section XVI of the Regulations, which should be ready for review at the August 19 Board meeting.

August 1 Board Minutes from p. 15 D. Other Business The GM confirmed we have received the final two policy quotes for umbrella insurance, which were signed and now completes the 2020-21 LOWA Property and Liability Insurance package. The final package premium was $553,507, $5,926 lower than the maximum approved by the Board, but $10,158 higher than budgeted for FY2020-21.

Fareways is again hosting Trivia Night on Wednesdays from 6-8:00 p.m. Participants must sign up ahead of time, and attendance is limited to 40 people.

The GM announced that Ted Mattingly has been hired as our new Director of Facilities. He is expected to start work on or about August 24.

Pony Camps were successful this year in spite of operating at half-capacity of mostly 8 to 10 campers per week instead of the usual 14 maximum.

A music license agreement was signed with Global Music Rights on July 23. The annual fee is $2,350, which will come from the 201 Communications Budget.

4.8 Committee Reports Clubhouse Committee Annual Report Chair Chaz Kilby (on Zoom) reported that Committee membership has remained consistently optimum in recent years. Sales at the end of FY2019 totaled $1.21M, and $1.12M at the end of FY2020; the latter was negatively impacted by a significant reduction in service due to pandemic restrictions. Member subsidy of the Clubhouse through assessments has been reduced 39% since five years ago, from $7.29 to $4.78 per month. Expansion of the Clubhouse deck was timely, allowing 45% more members to dine outdoors when Phase 2 easing of restaurant dining restrictions kicked in. Over 200 potential new members attended the fall Realtor Open House, and more follow-up steps were added to the Newcomers Reception to extend contact with new residents. No capital projects are proposed at this time, but several projects are scheduled for routine renovations in the Five-year Plan.

In the coming year, the Committee will focus on customer satisfaction, member feedback and monitoring fiscal performance.

In May, Orange County received about $3.3 million in funding under the federal Coronavirus Aid, Relief and Economic Security Act. This funding was made available to assist in the county’s response to the COVID pandemic. The size of this grant required a public hearing to amend the current county budget and after the public hearing in early June, the Supervisors approved the spending plan for these funds.

The funds were allocated into four program areas: County Direct Response program area covered expenses such as extra staff, COVID testing, a new childcare facility, building access controls, cleaning, and election preparations. The program for Individual and Family Assistance was used to augment the Department of Social Services funding for help with expenses such as rental assistance and utility bills. The Business and Community Partner Support program provided funding to the towns, volunteer fire companies, Germanna Community College, the Regional Jail, free clinics, food pantries, and local businesses. The fourth program area was the Broadband Access Emergency Projects enabling better remote operations and education. I advised the LOW Fire & Rescue Company and the Lions/Lioness Food Pantry of the opportunities for funding assistance through the appropriate program. In late July, the county was advised that we would receive another $3.3 million CARES Act grant and county staff is preparing a funding plan for these funds. Another public hearing is anticipated for this budget amendment.

Recently, the Supervisors approved issuing about $15 million in bonds to fund several capital projects. Capital projects make up about a quarter of the annual Orange County budget. These projects can be funded in several ways.

The smaller projects like vehicles, computers, equipment, building upgrades, furnishings, etc. are directly funded from the annual General Fund budget.

Some projects, such as airport improvements, are funded in part by grants.

Other more costly items can be funded by lease option agreements. The largest items such as school and other new buildings are usually funded by issuing bonds. Currently, there are about $75 million in outstanding bonds with about $10 million in annual bond servicing costs. The $15 million in new bonds will fund the expansion of the landfill, a new roof and upgrades to the Gordon Barbour Elementary School, upgrades to the Blue Bell Building to be used by the school system for career and technical training and funding to continue the development of broadband internet capability in the county. Five different financing organizations submitted proposals for this bond and the Atlantic Union Bank was selected as providing the best financing plan. The annual service on this new bond will be about $1.3 million a year for 15 years.
