Environmental Control Committee Appeal and LOWA Violation Charges Referendum

Vote Yes and Yes! Why are we writing yet another article on this topic? Because too much confusing and incorrect information has been published on social media and elsewhere. Let us break this down very simply: The Appeal (Question 1) This Referendum should strike a personal note with every one of you. A woman told us recently that LOW is her “Happy Place.” She will live here until she passes. Many of us feel that way. We all want our happy place to be as beautiful as possible. Our governing documents allow us to build or modify our homes to create our happy places. But what if there is something you’d like that hasn’t been incorporated into these documents and you are denied your plan just for that reason? Or the ECC decision violates one of our rules? Do you really want to hire a lawyer for upwards of $1,000, or more? Wouldn’t you rather save your money and have the opportunity to appeal that decision to the BOD? We would. Regardless of what you’ve been told, your ability to appeal to the BOD does not exist without this referendum. We know this firsthand. Save your money. Make the BOD work for you. Vote Yes for the Appeal. Violation Charges (Question 2) The community is better served when we all abide by the rules. We all purchased homes in LOW and agreed to follow these rules. After many costly letters (most by certified mail) for violators, LOWA’s only recourse is to expend funds to clean up others’ property. It is personal. It is your money being spent. The only means to collect from the property owner at this time is to put a lien on the property. Do you really want to continue paying for the upkeep of others’ property? Vote Yes to the violation charges.

Vote yes on Question 2. If you approve Question 2, you will enable us – your Association - to better manage lot violations.

Why would you want this? For example, let’s say that your neighbor collects junk in their yard which would be a violation of LOWA’s regulations. Right now unresolved lot violations impact all members and cost everyone money. After several attempts to contact and work Costume Contest & Music with the homeowner, LOWA must go to court to resolve the violations. The legal fees ultimately impact your assessment. If we have the ability to charge fees to people that don’t maintain their lots, then they incur the costs, not you, and they ultimately will clean their lots.
