Hollyfield Park New Addition

by Nick Blankenship, Stormwater Inspector The Buildings Department has built a batting cage and pitching mound area as a new addition at Hollyfield Park. The batting cage is equipped with a new L-screen pitching fortress. Please do not use steel cleats while practicing within this new feature.

The LOWA-Lioness Lions Club Halloween Scavenger Hunt was a SPOOKTACULAR success. This was a terrific event for the families of LOW. We had over 70 vehicles full of excited children in wonderful and creative costumes.

Parents, grandparents, and other participating adults were so appreciative of this safe and fun activity for their children. A huge thank you to the Scavenger Hunt Committee, Lioness volunteers and spouses. A special thanks to our co-sponsors, Lake of the Woods Association, Phil Rodenberg, Tracie Hayes, Amber Hubbell, Carolyn Brodeur, Lisa Naghshineh, and Travis Miller.

Why have we extended the Referendum?

We have no choice.

If you look at Section 14 of our Declarations, you will find that the Board of Directors is required to repair, maintain, and restore lots and the exterior of buildings and other improvements erected thereon to comply with our Rules and Regulations. We used to be able to charge fines for violations.

What happened? The Shadowood case happened, where the Virginia Supreme Court did not allow an HOA to charge fines because the fines were not written in their Declarations. For 50 years we were able to charge fines, but no more.

Members in violation receive two letters asking them to bring their violations into compliance. Thankfully, most Members are more than willing to correct their violations and do so right away. If a member needs more time, we are ALWAYS willing work with that member. The goal is compliance, not punishment. There are a few Members in violation, however, who refuse to bring their lot into compliance. I wish I were permitted to share pictures of some of these lots with you. You would be grateful you do not have to live next to them.

Imagine if the Board decided, forget it. We don’t care about lot violations.

Do whatever you want. If LOWA turns into a rundown community so be it.

Why should we care?

I’ll tell you why. We don’t have a choice. We have a responsibility to you, the Members, and we need your help. We need you to grant us the ability to enforce our Declarations, Rules, and Regulations for lot violations.

On Oct. 21, a representative from the Elections Committee, our Director of Finance, and our GM contacted VOTE.NOW to obtain an interim ballot count of the 2019/20 Referendum. As of Oct. 21, 2,160 ballots had been cast, representing 50.9% of the membership. Of those who voted, 80% were in favor of the ECC Amendment giving Members an opportunity to appeal an ECC decision. Of those who voted, 70% voted in favor of allowing the Board to assess charges for violations of the Declarations, Rules, and Regulations.

For the first time LOWA lakefront lots were added to the new FEMA Flood Insurance Rate Maps following a 2018 FEMA study that added the main lake and Keaton’s lake as designated flood zones.

LOWA’s Lakes are being mapped by the Federal Emergency Management Agency for flood insurance purposes for the first time, and it is extremely important we get the 100-year flood stage level as accurate as possible on the maps.

FEMA’s proposed Flood Insurance Rate Maps (FIRM) are better than first proposed, thanks to LOWA’s engineering consultant. However, we need FEMA to adjust the flood stage downward another two feet on the Main Lake and another one foot on Keaton’s Lake (aka the Fishing Lake) to be accurate.

Get up to speed on FEMA flood maps as they pertain to your lot. Here is the link to our webpage with flood maps, and the video of the Oct. 21 Board Meeting on the topic of FEMA maps: https://www.lowa.org/FEMAMaps. Once the final maps are published, LOWA Lakefront Lot owners will have new federal flood insurance and county building permit requirements.

Orange County Government is gathering and passing on comments to FEMA. The LOWA Board of Directors has already adopted a resolution with a formal appeal for map adjustments. (See Page 4).

If you are one of the 862 lakefront lot owners, please consider writing to Orange County before the Nov. 25 deadline to: 1. Support LOWA’s formal appeal that the preliminary FIRM maps need further downward adjustment. Preliminary FEMA maps released in August 2020 show flood stage levels are still too high: o Main Lake is at 321 feet above sea level when it should be 319 feet. o Keaton’s Lake is at 288 feet above sea level when it should be at 287 feet OR 2. Support LOWA’s formal appeal and point out any special characteristics of your lot. For example, you may have built up your lot to build your home, the extra fill dirt may have changed the flood stage level on your lot.

I urge Orange County to support the formal appeal of Lake of the Woods Association to the Federal Emergency Management Agency to modify its Federal Insurance Rate Maps to accurately depict flood stage levels in the Lakes as follows: o Main Lake at 319 feet above sea level. o Keaton’s Lake at 287 feet above sea level.

2.5 Selection of New Board Member to Replace Director Forrest.

The following members submitted applications declaring their candidacy to fill the vacant seat on the Board of Directors: Clifton D. Wilks, Frank DiPasquale, Robert Shope, Jeffrey George and David H. Wilson. President Zukowski asked for nominations for Director. Director Clawson nominated Bob Shope. Director Vickery nominated Clifton D. Wilks. There being no other nominations, nominations were closed. Voting was done by secret paper ballot.

Votes for Bob Shope: 2. Votes for Clifton D. Wilks: 4.

Clifton D. Wilks was elected as Director on the Board to serve until the 2021 Board election.

President Zukowski welcomed Director Wilks to the Board and asked that he be seated.

3. Discussion of the Annual Update of the Reserve Study Prepared by Miller Dodson Associates.

General Manager Phil Rodenberg provided the Board with an overview of the updated 2021 Reserve Study. A Reserve Study is required by Virginia state law and is to be reviewed annually.

Finance Director Charles Maneval highlighted selected projects currently in the 2020-2022 Capital Spending Plan, with the focus mainly on year 2021 projects. Mr. Maneval and key Operations Center staff responded to questions from the Board.

Special Projects Manager Hunter Spencer reported his observations on possible options for widening the pavement on Lakeview Parkway Phase 4 project (Lakeview Parkway to Constitution Boulevard) to create a pedestrian walkway on one side of the road.

The General Manager asked the Board for any questions they might have on any items in the Capital Spending Plan for years 2023 through 2025.

Mr. Rodenberg and the Finance Director responded to questions from the Board and members.

The Board will consider adopting the updated Reserve Study at their November 7 Board meeting for planning and budgeting purposes.

4. Member General Comments Members commented on plans for additional security cameras, equipment replacement, golf cart lease contract renewal and stormwater culvert issues.

5. Adjournment Motion by Clawson, passed unanimously, to adjourn the meeting at 12:26 p.m.

Honoring Veterans: A Luminary Tribute at the Fort Germanna Visitor Center

Join the Germanna Foundation as we honor all veterans by illuminating the grounds of the Fort Germanna Visitor Center with luminaries. At 6:00 pm we will hold a ceremony in which we ring the bell in Germanna’s Memorial Garden in honor of all the veterans. This event is free and open to the public.

C. Referendum Update President Zukowski provided a status report on the 2019/20 Referendum from data provided by Vote.NOW. To date, 2160 ballots have been cast, 682 paper and 1485 electronic, for a participation rate of 50.9%.

Returns show that 80.7% of those voting were in favor of Amendment #1, and 70.3% voted in favor of Amendment #2. The General Manager noted that we still have not reached the threshold for the amendments to be recorded in the court, and we will need 2130 or more votes to pass.

6. UNFINISHED BUSINESS: None.

7. NEW BUSINESS 7.1 Consideration of Actions Related to Covid-19 LOWA Community Activities and Business Operations. (D-20-114) Finance Director Charles Maneval provided an update on LOWA’s financial status. He recommended the Board approve extending the waiver of late payment fees through January 31, 2021. Our application to waive repayment of PPP funds we received is in process. Staff continues to work to identify cost savings and we are expected to meet our financial obligations through the end of the year.

In response to the persistent presence of the Covid-19 pandemic, the Board took the following actions: Motion by Diercks, passed unanimously, that the Board amend the previously-approved FY2020-21 Fee Schedule to waive the 6 percent (6%) Interest Charge for non-payment of Assessment after 30 days until January 31, 2021 for payment plans for any member declaring the late fee is a financial hardship. Such member accounts that are delinquent on February 1 will receive the Interest Charge.

Motion by Diercks, passed unanimously, that the Board amend the previously-approved FY2020-21 Fee Schedule to waive the $50 Late Fee charge for non-payment of Assessment after 60 days until January 31, 2021 for payment plans for any member declaring the late fee is a financial hardship. Such member accounts that are delinquent on February 1 will receive the Late Fee charge.

Motion by Diercks, passed unanimously, that the Board amend the previously-approved FY2020-21 Fee Schedule to waive the $12.50 per transaction charge for semi-annual and quarterly payment options until January 31, 2021 for any member declaring the $12.50 transaction surcharge is a financial hardship.

7.2 Consideration of Adopting a Resolution Regarding FEMA Flood Insurance Rate Mapping. (Resolution 2020-23) (D-20-115) Motion by P. Brown, passed unanimously, that the Board adopt Resolution 2020-23, a Special Resolution, regarding FEMA Flood Insurance Rate Mapping.

7.3 Discussion of Reserve Study.

The General Manager asked the Board for their feedback on the updated FY-2021 Replacement Reserve Study prepared by Miller Dodson Associates. Board members voiced their approval of management’s approach relative to the CTR, reducing R&R capital spending and including stormwater management capital projects as part of the Lakes Management Plan. The Board will undertake a more detailed review at a special meeting of the Board on October 27th in the Community Center to make any further

Don Rissmeyer, Professional Engineer with A. Morton Thomas & Associates, gave a presentation to the Board in support of LOWA adopting a Resolution formally appealing to FEMA to modify their Federal Insurance Rate Maps to accurately depict flood stage elevations of our lakes. He reviewed the 2020 updates to the maps and reviewed the next steps to be taken.

Mr. Theodore Voorhees, Orange County Administrator, provided information on how the floodplain elevation changes could affect established and new construction regulations in Orange County. The County will be sending postcards to all property owners who are affected by any change in the maps. Both Mr. Rissmeyer and Mr. Voorhees responded to questions from the Board and several members. The LOWA Communications Department has posted a link to the maps on the LOWA website.

At this point and without objection, the Board took up a vote on Item 7.2 to adopt Resolution 2020-23.

4.2 Lakes Management Implementation Plan (LMIP) Semi-Annual Report Interim Director of Facilities Bobby Jones updated the Board on the status of projects in the LMIP. Construction of the Flat Run Forebay, gabion wall and finishing work has been completed. Warranty work and repairs needed following construction of the 14th Pond Retrofit and Forebay project have also been completed. Drainage issues on Mt. Pleasant and culvert replacements at several locations are under reconstruction to improve stormwater management. The Roadside Ditch Reconstruction Program is 58% complete and ahead of schedule.

Mr. Jones provided current nutrient data, physical property measurements and water quality data that reflect the health of our lakes.

Both lakes continue to score higher than recommended levels of nitrogen and phosphorus. Efforts to improve water quality will continue through construction of sediment and nutrient-removing structures, reconstruction of deteriorated roadside ditches and public education.

4.3 Planning Committee List of New Asset and Improvement Reserve (NAIR) Projects for the Five-year Capital Plan.

Planning Committee Vice Chair Allen Priester gave a brief overview of the Planning Committees evaluation of six New Asset and Improvement projects being considered for inclusion in the Five-year Capital Plan. He explained the process and criteria used to evaluate and rate all projects proposed in the 2021-2025 New Asset and Improvement plan. This review will assist the Board as they continue to work on preparing the FY2021-22 budget.

5.2 Report from the General Manager, Phil Rodenberg A. Coronavirus Status of LOWA Amenities, Events, Meetings and Business Operations.

The General Manager updated the Board on the current status of LOWA community activities and business operations. The Clubhouse will sell carry-out meals in lieu of the annual sit-down Thanksgiving dinner.

Christkindlmarkt will be held as an outdoor market at the Clubhouse lower level parking lot. A home decorating contest will be held in place of the annual Holiday Party.

B. September Financials In September, we collected $154,945 in current year lot assessments, for a total of $5,893,614, or 81.9% of total lot assessments billed, as compared to 81.1% collected by this time in the prior fiscal year.

As of September 30, the Unaudited Income Statement Budget-to-Actual Comparison Summary showed a favorable variance of $61,737, primarily as a result of greater than-budgeted NCR fees received, offset by CARC interest expense. The delinquency rate on September 30 was 5.9%.

C. Other Business Communications staff launched a new LOWA Member Ad Referral Program offering discounts to new advertisers, and Loyalty bucks to members who refer them, when they subscribe to a 6-month serial ad package in Lake Currents. Details of the program can be found on the LOWA website www.LOWA.org/Loyalty.

Grant Christie was hired as of October 13th as our new Grounds Foreman.

5.3 Committee Liaison Reports A. Board of Examiners Vice President P. Brown reported that the Board of Examiners has recommended amendments to Regulations X.5.a, X.5.d and X.7.b., to change the time water activities on the lakes must cease from sunset to 30 minutes after sunset. The changes would coordinate our Regulations with those of the Code of Virginia.

The Board agreed by consensus to direct the General Manager to prepare the proposed Regulation X amendments for referral to the Rules Committee and LOWA attorney by the Board at their November 7, 2020 meeting.

B. Legal and Compliance Committee (LCC) Director Clawson reported that LCC reviewed 180 summonses. Of those, 114 were issued to guests. Speeding was cited in 77 cases.

Stephen Farnsworth, Ph.D., professor and director of the Center for Leadership and Media Studies at the University of Mary Washington, will speak to the Lake of the Woods Democratic Club at 1 PM, Nov. 11, via the Zoom online meeting app.

Farnsworth, a political scientist, author, and political commentator, will share his perspective on this unique election season and on the state and federal election results.

Many thanks to all our friends and supporters who planted a yard sign, donated, or gave their time through the year to help our Democratic slate rt o of candidates. As this is written, the election results are w n s unknown, but there can be no doubt that these efforts have r a F Ste p h e n made a difference, both locally and nationally.

While our November meeting will focus on an election debriefing, we hope that all of our club members and campaign volunteers will mark their calendars for our Dec. 9 meeting, during which we will hold our own club officer elections and celebrate the many contributions of our volunteers.

LOW Fire & Rescue Annual Food Drive

by John Farrell Jr., Volunteer Firefighter Members of the Lake of the Woods Volunteer Fire & Rescue Company, along with our partners at the Locust Grove Walmart Supercenter, Store #5731, will be holding our fourth annual food drive this year from 9 AM to 3 PM on Nov. 14 and 15, at the Walmart Supercenter located at 2533 Germanna Highway.

This event supports the Lions Wilderness Food Pantry in the Locust Grove Town Center on Route 20. Funds and food collected are transferred to the pantry to help our neighbors in need. The food drive will occur the weekend before the pantry distributes approximately 75 Thanksgiving dinners to clients, with any additional food collected carried over to distribute before the Christmas holidays.

“Our members look forward to this event each year. We could not help our local food bank without the support of partners such as Walmart and our community members,” said Past Fire Chief and Food Drive Chairman Dick Ferguson. “When we collect for our local food bank, we make sure that 100% of everything collected goes to the pantry. When purchasing items for a food bank, we try to tell folks to avoid junk food, items in glass or cellophane packaging which can break in transit.”

If you would like to assist with the food drive, some of the items that are needed include: • Canned corn and canned green beans • Stuffing mix and canned yams • Dinner rolls • Bottled or canned turkey gravy • Canned cranberry sauce and applesauce • Instant potatoes • Rice or pasta • Canned meats and vegetables • Canned fruit (peaches, pears, or fruit cocktail) • Crackers, cereal, and granola bars The Volunteer Fire & Rescue Company responded to 899 calls for service in 2019 and serves the various residents, commercial businesses, houses of worship and academic institutions located in the Locust Grove, Germanna and Wilderness areas of eastern Orange County along Route 3 and Route 20.

In 2021, the Lake of the Woods Volunteer Fire & Rescue Company Inc. will celebrate its 50th anniversary (1971-2021) of “Neighbors Helping Neighbors.”

Veterans Club

Just in case some in the community have been wondering, the LOW Players are still active. While we have had to cancel the 2020 show season because of Covid-19, we have been making plans for now and the future.

Until this pandemic is controlled, it is imperative that everyone stay safe, which means anything we might decide to do must meet CDC guidelines and state mandates. For those who have not gone to our website recently, if you click on www.lowplayers.org, and go to the home page, there is an option to watch a taping of Fiddler on the Roof, with Bob McGrath as Tevye, in the Russia of 1880. This was one of our most popular productions, and we hope that you take advantage of this opportunity to enjoy it.

More recently, some of you may have had a chance to see five of our members perform on the Clubhouse deck, singing Broadway show tunes.

We offer our thanks to clubhouse manager Ryan Richardson for providing this venue. Lee and I were among the lucky ones having reservations for this fun evening. It was doubly nice to see others enjoying themselves as well.

As to what is ahead, if we are able, we will be performing Four Weddings and an Elvis in the spring and the musical The Addams Family in the fall.

In the meantime, we are looking at other ways to bring entertainment to our community while keeping everyone - both patrons and players - healthy and safe. Everyone keep your fingers crossed that there will be a safe and effective vaccine coming.

The LOW Veterans Club will conduct its annual Veterans Day ceremony on Wednesday, Nov. 11,,at the Community Center. The public is invited and encouraged to attend. Masks and social distancing required. The 11 AM commemoration is of the signing of the Peace of Versailles, officially ending World War I, that was signed at 11:11 AM on Nov. 11, 1918. This hour-long patriotic event will pay tribute to American veterans who have proudly served their country.

This tribute honors all service members of the Armed Forces that honorably served this country in peace and war. Throughout our country’s history, military service members have put on their uniforms to protect the values and liberties that this county was founded upon.

In the spirit of honoring veterans, the Clubhouse will offer a free Veterans Appreciation dinner to any Armed Service veteran LOW resident that night.

A veteran must be a member of the LOW Veterans Club, or present a valid Armed Forces Identification Card, a veteran’s card, or a DD214 to receive the dinner. Wearing of masks is required for entering the facility.

The dinner will be served from 5 to 9 PM, with music provided by the Chris and Mark Band. The entrees include: chicken parmesan over pasta; liver and onions; twin pork chops; tilapia with lobster sauce; vegetable lasagna. All entrees are served with two sides. Guests can order off the regular menu and pay accordingly. Reservations are required. Further details are included in this Lake Currents issue (See pg. 6). To make reservations, contact the Clubhouse at 540-972-2221. The Veterans Club expresses our gratitude to the Clubhouse for providing this offer. President’s Remarks President Zukowski explained the benefits to LOWA members to vote to approve the two separate and independent proposed Amendments to the Declaration of Restrictions in the Referendum to: 1) Amend Section 5, subsections B, D and E; and Section 6, Subsection C of the Declarations to clarify an Environmental Control Committee (ECC) quorum and establish an ECC appeal to the Board of Directors; and, 2) Amend Section 12 of the Declarations to add a new Subsection H to establish Board authority to assess charges for violations of the Restrictive Covenants (Declarations), Rules and Regulations.

President Zukowski provided an Interim Ballot Count of the 2019/20 Referendum from data provided by Vote.NOW. To date, 2160 ballots have been cast, 682 paper and 1485.96 electronic, for a participation rate of 50.9%.

Returns show that 80.7% of those voting were in favor of Amendment #1, and 70.3% voted in favor of Amendment #2. The General Manager noted that we still have not reached the threshold for the amendments to be recorded in the court, which is 2130 “yes” votes for each question to pass.

by Gene Mulholland, Communications, MGA The advent of fall can present a daunting challenge in finding your ball.

The many trees lining the golf course have begun to shed their leaves and, even though the area in which the ball landed is known, it is sometimes impossible to find. Therefore, a local rule was adopted and is commonly referred to as the “leaf rule.” That rule is in effect from Nov. 1 of the current year through February of the following year. The rule states “A ball known or virtually certain to be lost in an accumulation of leaves(loose impediments) in the General Area may be substituted with another ball and dropped, without penalty, as near as possible to the spot where it was thought to originally lay, no nearer the hole.”

On behalf of the outgoing board (Sheran Marks, Karen Woods, Ellen Bearden, Dorothea Barnes, Pat Shrader, Lisa Halpin, Loretta Yurkus, Janice Mincey, Karen Cakouros, and Kitty MacFadden), Sheran Marks thanks the LGA members for their patience and support. This year was very challenging due to COVID, but we made it through.

Dues for the new season are payable now. The amount remains the same at $25. Please make your checks out to LOW LGA and note if you are a 9 or 18 holer. Place the checks in the box in the Woods Center ladies’ lounge. The deadline for paying dues, if you want to be listed in the LGA booklet, is Jan. 15.

The LGA Christmas party is cancelled due to COVID restrictions.

However, we will still be sponsoring a needy local family. If you would like to make a donation for the sponsored family you can make your check out to LOW LGA and note “for Christmas family” or put cash in an envelope with the same note on it. Deposit your donations in the box in the ladies’ lounge at the Woods Center no later than Dec. 15.

Our organized Tuesday golf is over for this year. We hope there will be some nice days and we can continue to enjoy the course during the winter.

The team of Ralph Debnam, Lem Forrest, Mike Hill, and Bill Halpin won the Gross Team Points game held on Oct. 21, with 11 teams competing.

Orange County

Orange County was the recipient of a one-acre parcel of land as part of a proffer for a rezoning. This land is located on Route 20 near Route 522 and the proffer was for use as a park. The property has an existing pavilion that would be available for picnic or other group gatherings. The Orange County Parks and Recreation Foundation has agreed to raise funds for fencing, tables and other small amenities and the county Parks and Recreation Department will take on responsibilities for maintenance. This will provide a park facility closer to the east end of the county.

The Supervisors recently were briefed by a representative from Dominion Energy on their activities in Orange County. One of the major changes was that Dominion recently acquired the Madison Solar project that will be constructed in the county. Another significant project is the undergrounding of outage-prone power lines in the county, with over 18 miles moved underground in the last seven years. They also explained their prioritization process for restoring power after outages.

Recently, the Board of Supervisors and the Economic Development Authority sent letters to the Virginia Board of Pharmacy supporting an application for Trulieve VA, Inc. to operate a pharmaceutical processing facility in Orange County. If they receive the permit from the state, Trulieve plans to construct and operate a pharmaceutical grade medical cannabis production facility at the industrial park that includes growing and processing cannabis for the Virginia market. Trulieve has conducted similar operations in several other states and has a record of focus on healthcare. The Board of Pharmacy has very stringent standards for such an operation and our support letters are just a small part of the process that Trulieve must follow.

This project has the potential for a significant benefit to the county both in terms of jobs and tax revenue.

Orange County received another Coronavirus Aid, Relief and Economic security Act (CARES Act) grant for about $2 million to implement the Fiberlynk Wi-Fi hotspot project. These hotspots are an innovative solution that provides free Wi-Fi for students, businesses, telecommuters, and residents. The grant award will help the county build 31 miles of fiber optic lines that will pass 555 homes that can receive fiber to the home in 2021.

The grant will also allow the county to rapidly install a county wide network that will place a free Wi-Fi hotspot within one mile of 1,600 homes and within two miles of 5,971 homes. The hotspots are being placed throughout the county in partnerships with over a dozen community facilities including churches, parks, and fire stations.

The county also received a grant from Homeland Security to purchase three tents to provide mass medical care for the county’s Emergency Services Program. The school system received $227,000 in federal funding for the School Head Start Fund, part of which was funding for the COID-19 response. Your county staff continues to effectively seek and obtain grants to provide better services to the citizens.

Once a year, the Supervisors hold their regular meeting at Lake of the Woods. This year it will be held on Nov. 18. The Supervisors will vote on the resolution requesting The Federal Emergency Management Agency to accurately depict the 100-year flood stages of the Main Lake and Keaton’s Lake. The meeting will be made available on YouTube to watch later.
