President’s Letter by Clifton D. Wilks

Dear Members of the Lake of the Woods Association, I am writing to follow up on the financial irregularities that were identified during the annual Association financial audit this past summer. We have received the report from the Forensus Group on the losses incurred due to alleged inappropriate activity of our former Director of Finance. As previously reported by the president, the Board engaged the services of Forensus to conduct an objective, independent, forensic accounting investigation. The work was performed by former Department of Justice experts including a Certified Fraud Examiner in accordance with American Institute of Certified Public Accountants procedures. The complete report is available on www.LOWA.org/Forensus, (member login required). It will also be published in an upcoming Lake Currents. Their findings are summarized as follows: The Forensus report identifies “We have filed a claim numerous transgressions committed by Roy Mayberry, however Mr. Mayberry for the loss with our has not yet been officially charged insurance carrier.” with a crime. Forensus identified 95 transactions totaling $457,197.34 of seemingly improper payments made to Roy Mayberry’s personal Paypal account. Forensus determined that Mr. Mayberry’s scheme involved making electronic payments directly to his account from LOWA’s operating bank account. These improper transfers were hidden by inflating the values of our fixed assets balance, meaning that he showed the value of LOWA property as having increased during a given fiscal year without there actually being a physical increase. The transactions began on June 19, 2014, and ceased on January 2, 2018. There was no evidence of the Paypal scheme in any of our other LOWA’s Bank accounts. Forensus found no evidence of additional material misconduct (such as skimming, credit card fraud or fraudulent invoicing) by Mr. Mayberry, nor did they find evidence of collusion among other LOWA employees, or anyone else. Audits from 2015, 2016 and 2017 did not detect Mr. Mayberry’s scheme. It was found by our field auditor during the current audit year, thus delaying our final audit report. These losses occurred under various Auditors, Treasurers, Directors of Finance and Boards of Directors. We have more to be implemented. We know Members have been greatly concerned about the situation. In my opinion, Members have been patient and understanding of the delicate balance between investigations and disclosing information that all of us want to see. We have filed a claim for the loss with our insurance carrier. Orange County Sherriff’s Office and the Orange County Commonwealth Attorney are investigating Mr. Mayberry’s conduct and will determine whether to prosecute Mr. Mayberry. We will continue to cooperate fully with law enforcement and provide any assistance requested. We have provided a list of questions and answers that that will be published along with the full report. I hope you will find these helpful in understanding the scope of the alleged financial irregularities. Members will NOT have to “make up” the loss through our assessments. The Association remains financially solvent and capable of meeting all of its financial obligations. We are planning a Town Hall meeting as soon as we can arrange the calendar with our Forensus investigators. Regular Board of Directors Meeting

Building up. Construction projects are exciting, and our Clubhouse Complex project is beginning to come out of the ground. Favorable weather the week of Nov. 19 enabled our contractors to be very productive. Ramsey Masonry continued the placement of footing concrete masonry units on both the Fitness Center Building, and the Pool Equipment Building. The placement of the footing CMU to the Slab On Grade elevations should be complete by this publication. Soon you will see the walls rising out of the ground. Meanwhile, Olympia Pools is backfilling around all below-pool-floor plumbing with stone dust. In early December, LOWA will begin discussing the upcoming budget to include the plans for opening the new pool and fitness facilities in summer 2019. LOWA will offer three types of Fitness Center memberships: Individual, Couples (Individual Plus One), and Family. We will hire part-time attendants to staff the new center, and to run the new pool snack bar that is accessible from the pool and also the beach. Tearing down. Several members have asked me why the burned-out dwelling in the 700 block of Lakeview Parkway remains standing. Sadly, on May 1, the lot owner died in a fire that left the dwelling beyond repair. This is an heir property. The estate has not yet been settled. The issue is proper legal notice. We have been in touch with the estate administrator and an attorney who will notify all heirs. We hope the heirs and the Association can resolve the situation amicably by early January. The Association’s Declaration of Restrictions requires a dwelling destroyed by fire to be removed within six months. See Section 8.A (p) below: Section 8.A (p) Any dwelling or outbuilding on any lot in the Section or Subdivision which may be destroyed in whole or in part by fire, windstorm or for any other cause or act of God must be rebuilt or all debris removed and the lot restored to a sightly condition with reasonable promptness, provided, however, that in no event shall such debris remain longer than six months. The Declaration allows the Association to tear down the structure and bill the lot for the work (Reference Section 14). The Board of Directors would need to vote to approve this. Enjoy your holidays! Glad You Asked How Healthy are LOWA’s Finances? by Bob Hoh, LOWA Board Treasurer Since my last article, a lot has happened here at the Lake. Our quarterly financial statement is complete - see pages 4, 6-7. The forensic auditors have delivered their report to the Board of Directors – see page 2. Considering all the rain, the CARC project is progressing well – see page 3. I’ll touch briefly on each of these items. First, our fiscal year second quarter financials show that we are indeed healthy and overall we are performing close to expectations with a relatively small negative variance to budget. However, some amenity revenues and expenses remain off the mark. Certainly, the severe weather has caused a hardship on many of our members with leaks and flooding that none of us had expected or welcomed. It has challenged our maintenance crews, and we are prioritizing our resources and adding additional funds to our upcoming budget to develop and execute an effective stormwater management plan. Next, four main points regarding the forensic audit.

1. In spite of the large amount of the apparent fraud, the association is financially solvent and well positioned to meet all our obligations. 2. We are filing an insurance claim for the full amount of unrecovered funds. 3. We have initiated corrective actions with our internal controls to preclude a recurrence of the fraud. 4. The forensic investigation results have been turned over to law enforcement to assist in any prosecution actions. Lastly, we are processing the third CARC contractor draw, probably the last before we activate the Mutual of Omaha Bank loan for interest-only payments during construction. These first three payments were covered by LOWA funds including the first “CARC� portion of the assessment and will reduce the final loan amount. Glad you asked. by Denise Shoemaker, Member, Community & Youth Activities Committee The Community Youth Activities Committee hosted its first Halloween party at the Clubhouse on Oct. 28. We had a wonderful turnout and a great time was had by all that came. The CYAC plans on hosting this event again next year. Bingo at the Clubhouse was on Nov. 17 for the very first time. We had about 125 people in attendance. Thank you for coming out and donating canned goods to the Wilderness Food Pantry. The CYAC would like to thank the East Orange County Little League for donating a free registration and Clubhouse Manager Ryan Richardson for donating a brunch certificate to the Clubhouse. We can’t wait to host the next Bingo night!

as told to: Equestrian Manager Bridget Hutchens Hello, again! Mr. Squishy here, and I hope everyone had a fantastic Thanksgiving! I was hoping for an apple pie, but Miss Bridget says I need to watch how much sugar I eat. I sure have a lot to report to all of my faithful readers. I’m excited to announce we are hosting a New Year’s Pony Camp January 2 to 5, 10 AM to 1 PM, ages 6-12; $175 member; $200 non-member. Only six spots still available. This will be a very fun program for kids who don’t want to ride in the summer because it’s so hot. Fancy, Prescott, Scotty, Patton, Shady and I will be teaching lessons on grooming, riding and how to take care of us in the winter. Miss Bridget said she will have hot cocoa ready for snack time (hopefully I can have mine with extra marshmallows!) I think that New Year’s Pony Camp or Summer Pony Camp would be make excellent Christmas gifts this year! If you decide to purchase a session of camp to give as a gift, the Equestrian Center will include a long-sleeved t-shirt to put under the tree. Gift certificates are available as gifts for all our services; I highly recommend gifting pony rides with yours’ truly. Gifts in the form of lessons, lesson packages, trail rides or pony treats have a 100 percent Squishy-approval rate. Before encountering snowstorms and extreme cold this winter, consider following FEMA recommendations to:  Make a Family Communications Plan (https://www.ready.gov/ make-a-plan) to know how to contact one another, and get back together in case of emergency. 

Make an Emergency Kit (http://www.ready.gov/kit) for at least three days of self-sufficiency.

During Snowstorms and Extreme Cold, FEMA recommends the following:  Drive only if absolutely necessary. If you must drive, travel in daytime, don’t travel alone, and keep others informed of your schedule and route. 

Walk carefully on snowy, icy walkways



Avoid overexertion when shoveling snow. Take breaks, push the snow instead of lifting it, and lift lighter loads.



Keep dry.



If going outside, wear several layers of loose-fitting, lightweight, warm clothing, rather than one heavy layer.



Wear mittens, which are warmer than gloves



Wear a hat and cover your mouth with a scarf to reduce heat loss.

I am always looking for groups who wish to hold a golf event at Lake of the Woods Golf Course. Please call Rea Hargraves, 540-972-2230, if you have a group, or know of someone wishing to hold an event starting in the spring of 2019. I will be offering private golf lessons in the Community Center from Dec. 31 to Jan. 4 and Jan. 14 to 18. Sign-up sheets will be posted on Dec. 4 in the Pro Shop. Class times will be 8 AM to 10 AM. Tomorrow is the last chance to make your reservation for the LOW Veterans Club annual Christmas Party Dinner on Friday, Dec. 7 at the Clubhouse. The cost of the dinner is $25 per person. The menu consists of one of four choices, which include chicken Chardonnay, Chancellorâ&#x20AC;&#x2122;s beef, tilapia with lobster cream sauce, and stuffed acorn squash. Dinner service will start at 6:30 PM while attendees listen to the DJ Dicky Estes until 10 PM. Favorite World War II requested songs will be played along with other musical tunes. LOW current residents who are past members of any Armed Service and their guests are encouraged to attend. Business attire is suggested and tuxedo is optional. Wearing of military medals or ribbons on lapels is encouraged. The LOW Veterans Club has decided to invite and provide free meals at the Christmas dinner to all LOW World War II veterans and their spouses and care givers. If you are, or know of, a WWII veteran, please contact Mike Fergusan at colmferguson@msn.com or Mike Landers at mikelanders4@verizon.net. Additionally, the Christmas dinner will feature a Christmas tree decorated with pictures of veterans. Any veteran can submit a picture of themself in uniform by Dec. 1. Also, a picture of a family member in uniform is welcome. The pictures will be placed on the tree and returned later. The indoor presentation was well received.

On Nov. 2, Rapidan Service Authority had a sewage leak (a break in a forced main line, where sewage was being pumped, rather than moved by gravity), near the 2900 block of Lakeview Parkway. The leak was discovered during the early morning hours by a Member. RSA responded on scene to the reported leak. LOWA Environmental Resources sampled adjacent waters for E.coli, an indicator bacteria for the presence of sewage. Lab results for E.coli samplings were above the state-recommended threshold (235 colonyforming units per 100 milliliters of water) for swimming and water activities. LOWA sent out an e-mail advising members not to swim in or around Fishermanâ&#x20AC;&#x2122;s Point Cove. LOWA monitored and sampled adjacent waters through Nov. 9, at which time sampling results were once again below the state-recommended threshold. LOWA then lifted the no swimming advisory for waters in or around Fishermanâ&#x20AC;&#x2122;s Point Cove. For additional information about the sewage leak, please contact RSA at 540-972-2133. Childhelp Activities

We will be at the Christkindlmarkt at the Community Center on Saturday, Dec. 1, from 9 AM to 3 PM. We will be selling Christmas items, Cause 4 Paws t-shirts, pierced earrings, bracelets, and necklaces with animals, fantasy, travel and food themes. You can also purchase tickets for our 2018 raffle drawing; the grand prize of which is a Lap Size Cat Quilt constructed by the Fredericksburg Modern Quilt Guild. The quilt was made from a pattern called The Kittens by Elizabeth Hartman and made with various colors of cat faces on a grey background. You also can win many other prizes donated by local businesses. Raffle ticket prices are: $2 for one ticket, $5 for three tickets and $10 for eight tickets. The raffle drawing will be held Thursday, Dec. 6, in the Cardinal Room at Fareways, beginning at noon. Cause 4 Paws is a 501(c)(3) non-profit charitable organization supporting feline rescue. We are continually in the need of volunteer foster homes, monetary donations and donations of the following cat/kitten food: Purina Kitten Chow, Purina Cat Chow, Friskies Pate canned food and Fancy Feast Kitten Wet Food. The Childhelp Halloween Party on Oct. 27 featured lots of activities. Besides bowling, “the gym was busy with children, dressed as power rangers, super heroes, mummies and a few queens of the Nile, searching for eyeballs in goo, designing a Halloween Treat Bag, trying to make a hole-in-one, tossing things at the witch and pumpkin, sitting with Madam Itchy to discuss good fortunes, struggling to bite a donut from a string, thinking of a name for our new dragon, having their photo taken, filling their treat bags with goodies, and taking time to stop for a refreshing drink. Most importantly they were having fun and creating good memories. Nina Doherty and her crew from the DC Chapter, supplying pumpkins and paint, guided the children to create amazing works of pumpkin art. Roxie the Clown was on hand to make beautiful balloon toys,” said party co-chair Karen Woods. We will meet at 11 AM at the Village gym for our Auxiliary Holiday Luncheon on Wednesday, Dec. 5. Other upcoming events include Alice C. Tyler Holiday Party on Dec. 8 at 1 PM. If you have not received your invitation or Christmas Buddy assignment, please contact Wade at whardman@childhelp.org. The Susannah Chandler Chapter, NSDAR, is off to a great start this year! In September, members attended the Virginia DAR Fall Forum in Richmond, and participated in many of the workshops. In November, members also attended the Five-Chapter National Defense Luncheon, hosted by the Louisa Court House Chapter, and enjoyed a program by a retired Air Force colonel, and a delicious meal prepared by the culinary arts students from Louisa County High School. This event will be held here at LOW next year, hosted by Susannah Chandler Chapter. Our last meeting had a wonderful program presented by Marty Hartmann, Orange County Historical Society member, on Who Was Susannah Chandler? We learned more about her life here in Orange County in the 1700’s! Our December meeting will be our annual colonial Christmas Party; friends and families are welcome to attend. Our meetings are held monthly on the second Saturday, at the Community Center, at 1 PM. Interested visitors are always welcome. Anyone interested in more information on the Daughters of the American Revolution or in finding your Revolutionary patriot, feel free to contact us! We are happy to assist! Please plan to attend our Holiday Annual Meeting where members and their guests are welcome. This general membership meeting will be held on Thursday, Dec. 13, at the Clubhouse dining room, beginning with a social and cash bar at 11:30 AM, then lunch served at 12:30 PM. The Orange County High School Chorale will entertain us. This year our menu will consist of a garden salad, with entrees of chicken Chardonnay, (boneless breast of chicken with a Chardonnay cream sauce), or tilapia topped with a lobster cream sauce. Our sides will consist of green beans with red peppers and almonds, and garlic mashed potatoes. We will conclude with a dessert of cherry pie with vanilla ice cream. We will also have baked rolls and butter, coffee, hot tea and iced tea. For those who are vegetarians, there will also be a dish provided. The cost will be $10 for members and $20 for nonmembers. Please make sure that your reservations are received no later than Dec. 4. Make your checks payable to LOW NARFE, and enter the number of meals by each selection, “Chicken,” “Fish,” or “Vegetarian” in the memo line of the check. Mail them to NARFE Chapter 1885, P.O. Box 360, Locust Grove VA 22508. We would also like to ask everyone to bring a non-perishable food item for donation to the Food Bank. As you know, the Food Bank needs everyone’s help, especially with the holidays coming up. This will be the final meeting of this Chapter. 3.2 Report of the General Manager, Phil Rodenberg A. CARC Project Update Footings and piers have been poured and the exterior walls have been stabilized. Next steps include finishing pool piping, begin rebar for the pool floor, continue work on the parking lot stone sub-base and begin masonry. Relocation of the REC power line at the Clubhouse will not result in any additional cost to LOW. B. Other Business Paving for construction of a new basketball half court at Sweetbriar Park has begun and should be completed this month. Finishline Environmental has started work on four remedial stormwater projects approved by the Board to address flooding issues impacting private lots. Due to an RSA sewer force main break, the main lake cove between Edgemont Circle and Boxwood Trail experienced high E. coli contaminant levels. Further testing this week revealed that contaminant levels are now below the threshold for acceptable levels and safe for human activity. 3.3 Committee Liaison Reports Finance Committee liaison Bob Hoh reported that more members are using credit cards to pay for fees and purchases, resulting in increased processing fees for LOWA. He mentioned that LOWA performs criminal background checks on all candidates being considered for hire, and those who will be handling money also undergo a credit check. LOWA invests mainly in money market and CDs to maximize stability and preserve capital. Golf Committee – Pro Shop and Golf Maintenance Budgets. Liaison Bob Hoh reported that the Golf Committee voted unanimously to recommend the Board use two spreadsheets they provided as the starting basis for developing the next budget for the Golf Pro Shop and Golf Operations. The spreadsheets reflect performance of these cost centers over the past three years and should help the Board provide a budget that is more realistic than recent past budgets. Fitness Committee liaison Walter Diercks reviewed the fee schedule for the new Fitness Center as recommended by the Fitness Committee. The proposal calls for a modest increase in fees and the addition of an attendant, with the understanding that next year will be a trial year when it comes to adjusting income against expenses due to variables in the areas of membership and staffing. Pools Committee liaison Zukowski reported that the Pools Committee voted to recommend that the 2019 Pool season end on Labor Day and not be extended. External Affairs liaison Pete Brown reported the Committee working group continues to study broadband issues. The County is down to one pad site remaining at the Industrial Business Park which two companies are considering. The GWAP is due for release in early 2019 and the Orange County Comprehensive Plan will be attached to it. Real estate statistics show that 211 homes have been sold in LOW so far this year. Community and Youth Activities liaison Carl Clawson said there will be a Bingo Night this Saturday, November 17 from 6-8 p.m. at the Clubhouse.

3.4 Committee Report Fitness Committee Chair Donna Price reported the Committee’s main focus this year is to work with the Board and LOWA management as progress is made on the new Fitness Center building, and keep the temporary Fitness Center in the Clubhouse running smoothly. They also submitted to the Board their recommendations for a revised fee schedule and hiring an attendant at the new facility. A Rave-Ons concert scheduled for December 10 and 11th is expected to bring in revenue to help purchase new equipment. Short-term goals include an Open House to attract new members and keeping members informed throughout the year on important issues that affect the Fitness Center and walking trails.

The small cast from the Players is busy rehearsing for A Nice Family Christmas, which is being presented at The Inn at Kelly’s Ford on Dec. 14 and 15 at 7 PM with a matinee on Dec. 16. This comedy is the story of a young newspaper writer who is given one chance to avoid being fired by writing about a family Christmas – his own. He goes home to see his recently-widowed mother, his eccentric grandmother, his crazy uncle, fighting siblings and their spouses, all of whom provide constant laughs. When they discover that he is going to publish family secrets about their dysfunctional family, the fruitcake hits the fan! LOW Book Club by Mary R. Nolan

The selection for the Dec. 12 LOW Book Club meeting is A Tree Grows in Brooklyn, by Betty Smith. A work of fiction inspired by the author’s childhood, the book is timeless in its depiction of lives and events. The tree seems to grow out of the cement sidewalk and serves as an analogy for the ability to thrive in a harsh environment. The family that is the central focus of the book lives in extreme poverty and emotional turmoil during the first two decades of the 20th century. Their story is filled with compassion, laughter, cruelty and heartache, and has been read and loved for 75 years. The book is available in all three local library systems (Orange County, Culpeper County and Central Rappahannock Regional). The LOW Book Club meets at 1 PM on the second Wednesday of the month in the meeting room of the Wilderness Library. The book chosen for the Jan. 9, 2019 meeting is People of the Book, by Geraldine Brooks. It is a fictionalized account of the history and events contained in an ancient Hebrew manuscript. The Gift of Speaking

by Alayna Stiffler, President, Wilderness Toastmasters Speaking is a gift; one that we are given every day of our lives. Talking to people at work, on the phone, with friends, neighbors, or people everywhere, we have a voice. Universally, communication is the skill that connects people; it starts at a very young age, and even when a person is unable to speak the language, they can find a way to communicate, whether by pointing or using gestures to describe what they are saying. Social media allows people to communicate with typing. Words form in the mind and are communicated to the fingertips that type the words to carry on a conversation on a screen. Opinions are shared; rebuttals are often shared as well. What is the difference between the two types of communicating? One is oral and the other, non-oral. The oral communicator finds ways to carry on a vocal conversation, whereas the non-oral communicator carries on a silent communication. They may be comfortable with keyboard conversations yet at a loss having a conversation beyond the keyboard. Toastmasters helps people to get their voice back and offers them the gift of conversation. The Orange County Department of Social Services recently provided a quarterly report to the Supervisors. Currently there are 29 children in the foster care system. As I have mentioned before, there is still an urgent need for foster parents in the county. When there are insufficient foster homes in Orange County, we have to move children who need foster care to another county. Removing a child from a home because he or she is at risk is traumatic for the child. If we can keep the child in the county, we can offer some stability by keeping them in the same school and somewhat connected to friends and activities. If we donâ&#x20AC;&#x2122;t have a local foster home, and have to move the child out of the county, the trauma for the child is amplified considerably. The Department of Social Services is also preparing to implement the Medicaid expansion recently approved by the Virginia General Assembly. It is anticipated that 1,200 to 1,400 new applicants will be eligible and will require processing by department staff. This is almost double the current caseload. The state is providing an additional $122,623 to assist with implementation and, at this point, no county match is required. However, in future years, the county will have to come up with a 20 percent match. The Supervisors were also briefed on the programs conducted by Rappahannock Rapidan Community Services. They are a regional provider of behavioral health, intellectual disability, substance abuse and aging services on behalf of local governments. For mental health, they are able to provide same day service for walk-ins seeking help or counseling at clinics in Culpeper and Fauquier. They have trained more than 200 people in crisis intervention to help de-escalate situations where individuals are experiencing a mental health crisis. They have programs for outpatient opioid treatment, including people as young as 15. RRCS provides a variety of services to people with intellectual/ developmental disabilities, including group homes, one of which is located in LOW. There is a senior center in the Town of Orange and they provide other senior services such as housing vouchers and chronic disease management. Funding for these services is provided through federal and state programs, fees (which include Medicaid, insurance, and direct client payments based on ability to pay) and local governments which provide support at the rate of $6.69 per person. In Orange County, RRCS has provided behavioral health services to over 500 people, intellectual service to over 200 people or families, and substance abuse services to about 200 people.
