The Lie

The Facts

The Greater Tzaneen Municipality is perpetuating a blatant lie regarding “non-issues” surrounding the construction of the controversial Sasekani/ Nkowankowa road. The Bulletin appears to have been deliberately misled about the truth surrounding the project. Last week the Bulletin reported on the project, after consultation with the GTM through its spokesperson, Mr Neville Ndlala. In their reply to our enquiry the GTM “confirmed that the construction resumed”. Ndlala added that “all disputes have been resolved and that nothing would disturb the project again”.

On Friday, shortly after the Bulletin hit the streets we made further enquiries and were directed by representatives of MacP Construction to their attorney, Mr Louis Erasmus. We consulted with Erasmus, who explained to us that the direct opposite of the reported GTM claim was in fact true. “There are numerous disputes between the GTM and MacP which forms the subject matter of a current and ongoing arbitration”, he explained, and accentuated that these disputes have not been resolved. He stated that a senior advocate has already been appointed as arbitrator in this matter. “Pleadings have been exchanged and closed. We anticipate the arbitration hearing to take place during January or February next year in Pretoria.”

Whilst the spokesman for the GTM is crying foul after our report of two weeks ago (see graphic herewith), they have failed in their dispute to refute our report.

Another set of lies! This seems to be the alarming trend by local governments in presenting explanations and so-called facts when sensitive information is being investigated by the Bulletin. A mere two weeks after we had published an attorney’s emphatic refutal of “facts” presented to us by the Greater Tzaneen Municipality, the Mopani District Municipality’s explanation of what is happening regarding the transfer of health inspectors from the provincial department to the MDM, does not tally with new credible information that we have obtained.

Questionable statements by the MDM 1 “The allegations that we received R20 million from the department of health to specifically deal with the devolution of environmental health inspectors are not true”. 2 The MDM ignored our statement that 28 new vehicles that had been purchased for the inspectors to execute their duties, are collecting dust. 3 “… a Memorandum of Understanding (MOU) between us and the department of health has been concluded and it will be signed soon…”

1 Sorry, MDM, you’re right, your denial that you did not receive R20m from the department is correct. According to the latest information, however, the R20m is in fact R60m (since it was R20m per year from 2010). May we refer you to the National Treasury for affirmation of the R60 million. 2 Added perspective: the vehicles are not being utilised for official purposes. If used officially, the inspectors would be eligible for limited private use (as a taxable fringe benefit). However, the vehicles have been and still are used as private transport. In that sense, we suppose, they are not collecting dust. According to a an official letter from the department of health dated 12 December 2011 another dimension of the vehicle situation unfolded, regarding the head of department’s refusal to approve the official use of the vehicles. 3 According to our information the Section 78 investigation was until very recently still outstanding, preventing the parties from entering into any binding agreement (causing the long unnecessary delay). Has it been done now? The investigation by the Bulletin of this debacle, is ongoing, and we will report to you on further findings.
