Government Affairs Update Greater Louisville Association of REALTORS December 11th, 2015 Louisville Metro Government

Short Term Rentals: In the fall many Council members started receiving complaints from their constituents regarding short-term rentals of residential property using hosting platforms like Airbnb and VRBO. In response to this issue, several Council members have placed forward two versions of a proposed ordinance to deal with these properties. One would require the property owner to register and have fire and health department inspections similar to what a bed and breakfast would have to go through to operate.

The second proposed ordinance sponsored by Julie Denton would allow people to rent out their home on a short-term basis for up to 180 days a year and require that host to pay the transient room tax that is already required under the law.

One issue that was brought up by GLAR members was that the definition of a transient user under this ordinance included month-tomonth rentals. GLAR wanted that definition to not include month-to-month rentals and many Council members agreed with that amendment.

The ordinance was up for a vote in front of the Public Safety Committee on Wednesday, December 9th. There were minor changes made to the ordinance during this committee meeting.

The biggest change is that a short-term rental host has to register with the LM Revenue Commission. This ordinance also does not require any inspections by health, fire, or other public safety agencies in the home being used as a short-term rental.

The revised ordinance was up for a full MC vote on December 17 at 6 p.m. at City Hall, and it passed.

Dan Jones is the 2015 Ed Melton Award recipient

By Henry Schildknecht Congratulations to Dan Jones, the 2015 recipient of the Ed Melton Award, the recognition given annually at our December meeting to a club member who has contributed to the growth and success of the Kentuckiana Real Estate Investors Association.

Dan was the 18th person to have received this prestigious honor.

Each November the prior recipients gather for our annual dinner meeting. At that time we discuss those KREIA members who have given so much of their time and energy to our organization and decided whom should be honored for their service with this year’s award.

The previous recipients of the award looked on as Dan was honored at the December meeting.

Dan Jones was found to be well-deserving of the award for many reasons.

Dan has been a long-standing and dedicated member of KREIA. His membership goes back over 20 years, and he personally knew and worked with Ed Melton.

It was noted that he has hosted more LOTS programs than anyone in KREIA. He makes Learn on the Site an actual educational experience, exactly what the board anticipated when the program was created over twenty years ago.

When one arrives at a Dan Jones’ Lots program, you just know that by the time that you leave, you will know everything that Dan did to rehab the house and turn it around.

Dan also enjoys passing on his experience to new investors and has been extremely instrumental in the implementation of KREIA’s mentor programs. He was one of the ten mentors when the program was held on Thursday afternoons at Mastersons prior to the dinner meeting. He also appears as an instructor on the mentor program currently offered.

He loves to talk with fellow investors about landlording, financing and rehabbing. All of his presentations are very detailed and thorough. His talks are very enlightening, interwoven with a dry sense of humor to capture and keep your

attention so that you will not miss anything.

His selection fulfilled all of the attributes of a recipient of the Ed Melton Award: a long-standing KREIA member, an active real estate investor, an advocate of fellowship among our members and an educator for all those who hear his presentations.

So we all thank Dan Jones for all of his years of service to KREIA, and congratulate him for receiving the 2015 Ed Melton Award.

Section 8 Inspection Basics and Contacts A KREIA resource for Louisville landlords

By Mark Roseberry In the November issue of the KREIA newsletter, KREIA board member Dan Jones wrote up an informational guide for best practices in dealing with Section 8 tenants and Louisville’s Metro Housing Authority. This month, he’s invited Mark Roseberry, Section 8’s Customer Service Ombudsman, to offer some follow-up information on inspections and personnel.

Housing Choice Voucher Inspection Basics 1. Each unit on the Housing Choice Voucher program is required to pass an initial inspection prior to being accepted for new tenancy on the program. Then it must pass an annual inspection conducted each year the unit remains under contract. Additionally, complaint inspections and or quality control (QC) inspections may be scheduled as needed.

2. All inspections referenced are required to meet housing quality standards (HQS) as defined locally in the City Property Maintenance code Chapter 156.

3. Initial Inspection. Each unit submitted is inspected prior to new tenancy. The RTA (Request for Tenancy Approval) submitted with lease papers is used to identify the unit, owner, address, utilities, and the number of bedrooms. These papers are not to be submitted until the unit is ready for inspection.

The initial inspection (like other inspections) determines if the unit meets housing quality standards.

Inspectors are looking at all areas of the unit, including the number of qualifying bedrooms, the appliances, the utilities, and ensuring the unit is clean and ready for a new tenant.

Along with the physical inspection the unit is rentcomped as part of the initial process.

In the event the unit passes, the owner and tenant will receive a pass letter a few days after the inspection. This letter allows the tenant to move into the unit. The letter details the process for the first month's tenant payment if there is one and states that final numbers will follow in a couple of weeks.

In the event the unit fails or that no one meets the inspector to allow access, the process stops and the tenant is given an opportunity to seek new lease papers or to request another inspection of the unit. If the tenant desires another inspection, he or she must wait until all

Then the tenant must call (502) 569-6468 to request re-inspection.

4. Annual/Complaint or QC inspections. Every unit will be re-inspected annually to ensure the unit is being maintained to the HQS. It is the responsibility of the owner/manager to maintain the HQS during the period of time unit is under contract. Inspections are intended to be a confirmation of the unit condition.

Complaint inspections, as the name implies, occur when a problem is reported about the unit. QC inspections are done randomly to ensure our inspection process is working properly.

In the event an Annual/Complaint or QC inspection passes, the owner and tenant will be sent a pass letter stating the unit meets the HQS. In the event an Annual/Complaint or QC inspection fails, the inspector will allow a reasonable time for correction (typically 30 days) as noted on the inspection fail report. Shorter times are required for emergency items. The inspector will return and check to see the violations are all corrected. In the event corrections are not made and the unit fails a second inspection, the Housing Assistance Payments (HAP) will be abated until repairs are completed and the unit passes HQS inspection. Appropriate letters will direct you how to proceed and to notify Mark Roseberry in writing of completion and to request re-inspection via mail, fax or email.

Failing to make corrections of all violations once a unit is in abatement may result in cancellation of the contract, loss of HAP and the relocation of the tenant.

Evernote: Side Storage for Your Brain

By Lauren Willoughby There are so many things to remember in life: project notes, business associates’ contact information, property addresses, birthdays of family and friends....

And there are so many ways to use technology to help keep track of what needs remembering.

One of the best ways to hang on to the information you need is by signing up for an Evernote account at evernote.com, then installing the app on all your brain annexes — whether Mac, PC, tablet or phone.

Enter a piece of information one time, on one device, and you’ll be able to call it up later on any other device where you’ve installed Evernote and signed in.

Say you’re sitting at your office computer, typing up a scope of work in Evernote for your latest rehab. Later, while you’re kicking back in the den, you make some changes to the SOW on your iPad. And maybe the next day, while you’re roaming the aisles of Home Depot for fun, you spot the faucet of your dreams — so you call up the SOW on your Android phone and modify it with the new SKU. Evernote works in the cloud to sync your data among all your devices, so an edit made on one platform is reflected everywhere.

How you organize your information is up to you. You can create a separate notebook for each area of your life, or you can lump everything into one notebook. You can create individual notes for each discrete piece of information, or you can pile everything into just a few notes.

A note can hold typed information, clips from Web pages, images and even other files — such as PDFs and Word and Excel documents.

Evernote’s search function is awesome: It’s like Googling for informational needles in your own personal data haystack. And you can assign custom tags to notes, which helps you group and locate related information.

Do you have a set of bread-and-butter documents you need to have on hand? Forms, leases, contracts and the like? Bring their PDF or DOC files into Evernote — as attachments — and you’ll always have them at your fingertips.
