The Sylvan Lake Improvement Association, Inc. – Since 1908 – The origin of Sylvan Lake dates to the 1836-37 Indiana Legislature’s authorization for construction of a ship canal from Michigan City to Fort Wayne, passing through the Elkhart River. This canal by agreement with Ohio and Pennsylvania was to connect Lake Michigan and Lake Erie. To provide a navigable feeder, a dam was built across a tributary of the Elkhart River, forming the lake known as Sylvan Lake at Rome City. The work on the canal was abandoned after the State had expended $200,000 and found they had undertaken too much because of the railroad procuring charter to build in this part of Indiana. Rome City is the largest community in Orange Township, Noble County, and encompasses Sylvan Lake with a shore line of 16 miles and covering some 640 acres, making it the largest of 147 lakes in Noble County. The Sylvan Lake Improvement Association was officially incorporated on August 19, 1908 by Fred A. Sims, Secretary of State. The officers were William J. Hosey, President; John A. Jennings, Vice-President; Robert S. Moses, Secretary; J.B. Niezer, Treasurer; and Peter Hekenuis, Director. The original by-laws called for five members of the board of directors. As stated in the State Charter, 1908, the object of this incorporation is “to improve and conserve generally the natural beauty and facilities for recreation and advance the welfare of SYLVAN LAKE, to cooperate in and contribute to any program designed for further sanitation, wildlife conservation, highway improvements, utility service and any other move toward our mutual benefits...”. Since its formation In 1941, H.B. 273 was passed by the Indiana legislature which prohibits the lowering of Sylvan Lake. Prior to 1941 it was custom to lower the level of Sylvan Lake each fall and raise it each spring. This practice resulted in much controversy among landowners around the lake. As a result H.B. 273 was passed making it unlawful to lower the water level of any lake containing more than 20 acres more than 12 inches below the high water mark established by the dam creating the lake. In the early 1960’s it became very apparent that the association was facing a much more serious problem than the yearly posting of speed limit signs and warning buoys or removing debris. The growth of algae had become so abundant that it was killing Sylvan Lake. The Board of Directors and the membership were determined to save Sylvan Lake. The directors sought guidance into how to fight the algae problem. The course of action presented to them by the Sanitary Engineering Division of the State Board of Health was the use of copper sulfate. In 1965, Sylvan Lake was again lowered at the request of the association for a period of 30 days. The lowering was done for clean-up and beach maintenance and to check for septic systems flowing into the lake. It was hoped that lowering the water level would also help control the algae problem. During 1963-64, Dr. Wetzel, of Indiana University, conducted studies of SylvanLake. Dr. Wetzel spoke to the association at the 1966 Annual Meeting and described the lake as one of the most productive lakes in the world. He termed it “Hyper-eutrophic.” In 1967, the DNR conducted the first fisheries study. Between 1962 and 1972, the association was given dedicated service by many directors, four who took on added responsibility as president. Those men included Matthew Junk, Keith Marks, Samuel Adams, and Loy Reitz. Others served before them, unnamed here, but equally deserving in recognition. Parr and John Kessen. With Mr. Kessenâ&#x20AC;&#x2122;s resignation in 1992, Joe Costello was again asked to serve as president and he agreed to serve a one year term. He is currently serving as president. In 1974, Sylvan Lake was hit by the April 11 tornado with severe damage to property, which resulted in the lowering of the lake from July, 1974, to March, 1975. The association worked hard to remove debris left by the tornado. Also, in 1974, the town of Rome City began planning a wastewater collection system and treatment facility, at a cost of nearly three million dollars, and was completed in 1975. Lake residents who formerly had individual septic systems were connected to the municipal facility and Kendallville upgraded its wastewater treatment facility to reduce nutrient inputs into Sylvan Lake. On December 3, 1975, the first meeting was held to explore the possibility of a research based experimental lowering of the lake for a couple of years to improve water quality. The project was headed by Dr. David Eberly of Manchester College. During 1976-77, efforts to secure funds from the EPA for the project were unsuccessful. In 1978, funds became available and the project was officially begun. The IDNR conducted seven fish population surveys by 1976. Fish harvest surveys were conducted in 1977 and in 1981. On September 19, 1984, the IDNR conducted a total fish eradication and restocking project at Sylvan Lake. This project, one of the largest of its kind ever conducted in Indiana, involved the application of a chemical fish toxicant called rotenone to the lake and to many of its incoming tributaries. Within a month after treatment, fish restocking was underway. During the fall of 1984 and the spring of 1985, bass, bluegill, catfish and walleye fry were stocked. The fish eradication project was seven years in the making. Through the efforts of State Senator Bob Meeks, $200,000 was appropriated for the fish kill. On May 17, 1988, Sylvan Lake Improvement Association was awarded $15,300 for a feasibility study on the Lake Enhancement T-2000 Program. Due to the efforts of State Representative Brad Fox and State Senator Robert Meeks, the Association has been assured of $100,000 toward the design and implementation of this water filtering system. The Association agreed to pay 25% of the project up to $25,000. In December, 1992, a couple owning property two houses from the spillway, became concerned because the rear of their property was sluffing away. The town board determined there was nothing the town could do so the couple contacted state officials and the DNR and SEMA were brought into the problem. In February, 1993, the dam was considered unsafe and in May, 1993, the DNR ordered the lake lowered 7.2 feet to relieve the stress to the embankments. State officials determined seepage from the dam posed a threat to area property owners. The state provided $200,000 to study the dam and assigned the engineering firm of Fisher & Lawson to the project. In February, 1994, the state asked the court to temporarily allow the level of Sylvan Lake to remain at the lower level and the court ruled that water would need to begin returning to the normal level by May 15, 1995. In September, 1994, the Governor declared the dam an emergency situation and announced $5.3 million was allocated to the project. A contract was awarded to Reith/Riley Construction, based on the engineering plan of Fisher/Lawson, for the rehabilitation of the earthen embankment, abandoning the existing spillway, and constructing a more adequate spillway system. The state went back to court and received an extension of the May 15, 1995 date for completion of the project to September 30, 1995. The dam was completed in September, 1995, and the lake level was returned to normal after 21/2 years. Construction of the Weir Dam, the Water Filtering T-2000 Project, was through the design phase and was scheduled for construction in 1993, but was put on hold because of the lowering of the lake level. When the lake level was returned to normal in September, 1995, the process for construction of the Weir Dam at the east end of Pit Basin began again. Approval to proceed was received in the fall of 1997 and the contract was awarded to L.L. Genes, Inc. Construction began in March, 1998, and was completed in July, 1998. 56

To enable the Association to raise the money for the T-2000, the Association began having “Bingo” at the Rose Garden in Kendallville. In June 1994, the Association ceased bingo operations in Kendallville and began looking for an alternative site. The Masonic Lodge building on Highway 9, south of Rome City, was for sale. The Association purchased the building for $110,000 and determined to add a 1500 sq. ft. addition to the original 3900 sq. ft. building. A new kitchen was installed, along with new bathrooms, storage rooms, game room and offices. Three smoke eaters were installed, exhaust fans, new furnace, air conditioning units, a new well, soft water system and sound system. Association members have benefited through completion of the Weir Dam T-2000 Project, the Reassessment Project, spraying the lake for weeds, providing the lake patrol and buoys, the annual Member Dinner, Christmas decorations and fireworks. In 1999, the Association and the town of Rome City entered into an agreement to pave roads around the lake and in town that normally would take the town several years to complete. By gifting theproject approximately $65,000 and an interest free loan of $171,000 to the town for 10 years, the roads were completed in the fall of 1999. The Sylvan Lake Improvement Association has paid between $10,000 and $30,000 annually for weed control and water quality for several years. In addition, the association entered into a project with the Lare program. The Sylvan Lake Association received $20,000 in 2007, $26,000 in 2008, and $77,000 in 2009. In May, 2007, the Association purchased CAMP BIG ISLAND, approximately 110 acres on the lake, for $1,250,000. This was known as BOY SCOUT ISLAND for many years. This culminated in 20 years of effort to acquire the island to keep it in its natural state and from being developed. Phase 1 has been successfully completed, and the Association retired the loan in order to save interest and in anticipation of receiving pledge money to pay the Association. Through the efforts of the Association volunteers, Bingo continues to enable the Association to donate funds throughout the community. You are encouraged to continue your membership and support and encourage new residents to join our ranks. In this way, the Sylvan Lake Improvement Association will continue to provide the leadership to support the homeowners and the community. Member Dinner, Christmas decorations and fireworks. In 1999, the Association and the town of Rome City entered into an agreement to pave roads around the lake and in town that normally would take the town several years to complete. By gifting the project approximately $65,000 and an interest free loan of $171,000 to the town for 10 years, the roads were completed in the fall of 1999. The Sylvan Lake Improvement Association has paid between $10,000 and $40,000 annually for weed control and water quality for several years. In addition, the association entered into a project with the Lare program. The Sylvan Lake Association received $20,000 in 2007, $26,000 in 2008, and $77,000 in 2009.

Preserving Camp Big Island In May, 2007, the Association purchased CAMP BIG ISLAND, approximately 110 acres on the lake, for $1,250,000. This was known as BOY SCOUT ISLAND for many years. This culminated in 20 years of effort to acquire the island to keep it in its natural state and from being developed. Phase 1 has been successfully completed, and the Association retired the loan in order to save interest and in anticipation of receiving pledge money to pay the Association. You are encouraged to continue your membership and support and encourage new residents to join our ranks. In this way, the Sylvan Lake Improvement Association will continue to provide the leadership to support the homeowners and the community.

Indiana Boating Laws IMPORTANT – Don’t forget the new DNR Boating Laws. 1) No wake no wash 200’ from shore. Entering and exiting dock and dropping off skiers and jet skis. 2) All people aboard must have CG approved life jackets, not seat cushions, and all boats must have a throwable flotation device. 9-31-2-2 Watercraft required to be titled. Sec. 2. (a) Except as provided in subsection (b), a watercraft that is required to be registered in Indiana must have a certificate of title issued under this chapter. (b) A watercraft acquired by the Indiana owner of the watercraft before January 1, 1986, is not required to have a certificate of title until after ownership of the watercraft is transferred to another person. PLACEMENT OF REGISTRATION NUMBER Display of Numbers on Motorboats (310 IAC 2-1-2) (A) The boat number awarded by this state shall be: (1) Painted on, or attached to, each side of the bow, on the forward half of the motorboat and above the waterline, of the motorboat for which it was issued so as to be clearly visible for identification purposes. (2) Of a single color which will sharply contrast with the color of the background, e.g. black or white. (3) So maintained as to be clearly visible and legible at a distance of at least on hundred (100) feet. 58 Sylvan Lake 2017 Lake Directory

(4) Readable from left to right. (5) In block-letters of good proportion of not less than three (3) inches in height. Expiration Decals The expiration decals shall be attached to the right side of and within three (3) inches of the registration numbers. 14-1-1-7 Life preservers Sec. 7. (a) All boats shall be equipped with at least one (1) life preserver, ring buoy, life jacket, buoyant vest, or buoyant cushion, of a make or type approved by the United States Coast Guard, for each person on board. This subsection does not apply to sailboards or wind-surfing boards. 14-1-1-16 Prudent operation Sec. 16. Every person operating any boat shall operate the same in a careful and prudent manner, having due regard for the rights, safety and property of other persons, the conditions and hazards, actual and potential, then existing, including weather and density of traffic, and possible injury to the person or property of other persons. 14-1-1-18 Restrictions on operators under age 14 Sec. 18. It shall be unlawful for any person under the age of fourteen (14) years to operate a watercraft with a horsepower rating in excess of ten (10) horsepower except under one of the following conditions: 1. Accompanied by a person over the age of eighteen (18). 2. Accompanied by any person holding a certificate of completion of an approved boating course (approved boating course to be determined by the department of natural resources). 3. Such person under age fourteen (14) shall have completed an approved boating course. 14-1-1-20 Operation in manner endangering others Sec. 20. No person shall operate any boat in such a manner as to: (1) unnecessarily endanger the person or property of another person; (2) unnecessarily interfere with the safe and lawful use of the public waters of this state by another person. 14-1-1-26 Traffic rules Sec. 26. Every person operating any boat shall observe the following traffic rules when applicable. (a) When two (2) boats are approaching each other “head and head,” or nearly so, each boat shall bear to the right and pass the other boat on its left side; (b) When two (2) boats are approaching each other obliquely or at right angles, the

boat on the right shall have the right-ofway; (c) A boat operated on a river or a channel shall bear to the right. (d) A boat may overtake and pass another boat on either side if the same can be done with safety and within the assured clear distance ahead, but the boat overtaken shall have the right-of-way; and (e) A boat leaving a dock, pier or wharf or the shore shall have the right-of-way over all boats approaching the same. TRAFFIC DIRECTION NOTE The following is a law in many states. Although not yet a law in Indiana, it is strongly recommended and requested. All moving traffic on the lake should proceed in a counter clockwise manner. Please respect other boaters and comply. 14-1-1-27 Hazardous wake or wash Sec. 27. No person shall operate any motorboat so as to approach or pass another boat in such a manner or at such a rate of speed as to create a hazardous wake or wash. 14-1-1-28 Circular course around fisherman or swimmers Sec. 28. No person shall operate any motorboat in a circular course around any other boat, any occupant of which is engaged in fishing or any person swimming. 14-1-1-29 Restrictions on operation near shoreline Sec. 29. No person shall operate any motorboat so as to approach or pass within two hundred (200) feet of the shore line of any lake or channel thereof at a place or point where such lake or channel is five hundred (500) feet or more in width, except for the purpose of trolling or for the purpose of approaching or leaving a dock, pier or wharf or the shore of such lake or channel. No person shall operate any motorboat so as to approach or pass within two hundred (200) feet of the shore line of any lake or channel thereof at a rate of speed greater than ten (10) miles per hour. 14-1-1-22 Speed Sec. 22. No person shall operate any boat at a rate of speed greater than is reasonable and prudent, having due regard for the conditions and hazards, actual and potential, then existing, including weather and density of traffic, or greater than will permit him, in the exercise of reasonable care, to bring such boat to a stop within the assured clear distance ahead. 14-1-1-23 Speed; night Sec. 23. A person may not operate a boat during the period between sunset and sunrise at a rate of speed greater than ten (10) miles per hour. 14-1-1-11 Night Operation; lights Sec. 11. It shall be unlawful to operate any boat upon the public waters of this state during the period between sunset and sunrise which is not equipped with a light or lights as hereinafter required, all in good repair and operating conditions and all displayed and lighted or burning. 14-1-1-12 Motorboats and sailboats; white light aft All motorboats and auxiliary sailboats shall be equipped with one (1) or more white lights aft, casting a combined light combined visible three hundred and sixty (360) degrees for a distance of two (2) miles or more, under the following conditions: (1) All motorboats and auxiliary sailboats whether under power and sail or power alone must display either: (A) an all-around white light aft, or (B) a combination of one (1) stern light visible through an arc of twelve (12) points or one hundred thirty-five (135) degrees to the stern, and one (1) or more masthead lights visible twenty (20) points or two hundred twenty-five (225) degrees so as to complete the white light arc over the horizon. 14-1-1-13 Motorboats and motorized sailboats; starboard and port lights Sec. 13. All motorboats and auxiliary sailboats equipped with a motor or engine rated at fifteen (15) horsepower or more and all sailboats over twenty-two (22) feet long shall be equipped with combination lights forward showing green to starboard and red to port 60

visible for distance of one (1) mile or more and so affixed or attached as to throw light from dead ahead to two (2) points abaft the beam of said respective sides. These lights shall be affixed or attached to the bow of the boat, except that sailboats operating under sail alone may combine the red and green lights with the stern light at the uppermost point of the mast. 14-1-1-62 Pontoon boats; lights Sec. 62. All flat bottomed boats supported by floats, commonly called pontoon boats, shall be required to display a fixed combination red and green light forward and fixed white light aft, according to standards as prescribed by the Indiana Department of Conservation. 14-1-1-6 Motorboats; muffler or underwater exhaust Sec. 6. It shall be unlawful for any person to operate a motorboat on the waters of this state unless said boat motor has exhaust or other device which muffles or suppresses the sound of the exhaust so as to prevent excessive and unusual noise at all speeds. 14-1-1-9 Depositing litter, filth, etc., in public waters. Sec. 9. (a) In the operating or use of watercraft no person shall throw, dump, place, deposit, or cause or permit to be thrown, dumped, placed or deposited any litter, filth, putrid or unwholesome substance, or the contents of any water closet, or toilet, catch basin, or grease trap in or upon public waters or the banks of public waters of this state. 14-1-1-32 Operation of boat towing, water skiers, etc. Sec. 32. No person shall operate any motorboat towing any water ski, watersled, aquaplane or similar object, or any person thereon, unless said motorboat is occupied by at least one other person who is giving his entire attention to watching the object or person towed and unless the person operating said boat is giving his entire attention to the operation of said boat. 14-1-1-33 Unnecessary sounding of whistle or horn; nuisance

Sec. 33. No person operating any boat shall sound any whistle or horn when the passage of such boat is clear and without danger or when a warning signal is not necessary to prevent injury to a person or property. Unnecessary sounding of a whistle or horn is hereby declared to be a public nuisance and is hereby prohibited. 14-1-1-34 Siren Sec. 34. No person other than a duly appointed peace officer shall operate or sound any siren. 14-1-1-35 Load beyond safe carrying capacity Sec. 35. No person shall operate any boat which is loaded with passengers or cargo beyond its safe carrying capacity, having due regard for the type, construction and condition or state of repair of said boat and the conditions and hazards, actual and potential, then existing, including weather and density of traffic. 14-1-1-36 Motorboats; occupants on gunwhales or bow decking Sec. 36. No person operating any motorboat shall permit any occupant to sit, stand or lie on the gunwhales and no person operating any motorboat less than twenty-one (21) feet in length, shall permit any occupant to sit, stand or lie on the bow decking thereof, except for the purpose of anchoring, mooring, casting off or other necessary purpose. 14-1-1-37 Navigation aids; mooring to or tampering with Sec. 37. No person shall moor or attach any boat to any buoy, beacon light marker, stake, flag or other aid to safe operation placed upon the public waters of this state by, or by others under authority of, the United States or the state of Indiana, or shall move, remove, displace, tamper with, damage or destroy the same. 14-1-1-42 Accident or collision; duties of operator Sec. 42. The operator of any boat involved in any accident or collision resulting in injury or death to any person or damage to any boat or other property shall: (a) Stop such boat immediately and as close as possible to the scene of such accident; (b) Return to the scene of such accident and remain there until he has complied with the requirements of this section. (c) Give his name and address, a full identification of the boat operated by him and the name and address of the owner and, upon request, exhibit his operator’s license, to the operator or operators of the other boat or boats and to any person or persons injured; (d) Render reasonable assistance to any person injured, including carrying or arranging for carrying such person to a physician, surgeon or hospital for medicinal or surgical treatment if it is apparent that such treatment is necessary or if the injured person so requests. 14-1-1-43 Accident or collision; notice, report Sec. 43. The operator of any boat involved in any accident or collision resulting in injury or death to any person or damage to any boat or other property to an apparent extent of two hundred dollars ($200) or more shall: (1) give notice of such accident to the office of the sheriff of the county or to the nearest state police post or to the nearest conservation office immediately and by the quickest means of communication; and (2) mail to the department a written report of said accident within twenty-four (24) hours. 14-1-1-63 Person between ages of 16 and 18; jurisdiction of prosecutions Sec. 63. Any person between the ages of sixteen (16) and eighteen (18) who violates any of the provisions of this chapter may be prosecuted and tried in any court having jurisdiction over adults who violate any of the provisions of this chapter. Chapter 5. Operating a Watercraft While Intoxicated. 14-1-5-1 “Chemical test” means an analysis of a person’s blood, urine, or other bodily substance for the determination of the presence of alcohol or a controlled substance. “Intoxicated” means under the influence of: (1) alcohol; 62

(2) a controlled substance; (3) any drug other than alcohol or a controlled substance; or (4) any combination of alcohol, controlled substances, or drugs; such that there is an impaired condition of thought and action and the loss of normal control of a person’s faculties to such an extent as to endanger any person. “Law enforcement officer” includes conservation officers employed by the department of natural resources. 14-1-5-7 A person who operates a watercraft in waters over which Indiana has jurisdiction impliedly consents to submit to the chemical test provisions of this chapter as a condition of operating a watercraft in Indiana. 14-1-5-9 (a) If the chemical test results in relevant evidence that the person is intoxicated, he may be arrested for an offense under this chapter. If the chemical test results in prima facie evidence that the person is intoxicated, he shall be arrested for an offense under this chapter. (b) A person who refuses to submit to a chemical test may be arrested for an offense under this chapter. (c) At any proceeding under this chapter, a person’s refusal to submit to a chemical test is admissible into evidence. Floating Objects & Structures 1. Any floating object or structure such as a marker or distance buoy, raft or other similar object may not be placed in or upon the water until a permit for same has been applied for and granted by the Indiana Department of Natural Resources. Permit information as well as identification of the owner must be displayed on all floating objects and structures. Such objects and structures must be removed from the water no later than November 15, of each year, and may not be reinstalled or relocatedupon the water prior to March 15 of the following year.
