Time and again we ask ourselves and those about us two questions: ‘Who are our present leaders?” and “Who will be our future leaders?” The questions are interwoven, for the future is dependent on the present, as the present depends on the past.

We are concerned with the Jewish ramifications of the questions. We are gravely concerned for the many mem bers of the community who are waiting for a hand to be reached out to them and for a road to be marked out, and for assistance along the way to a better to morrow. We are concerned thattheWay will not be compromised.

Recently, we came across these comments on Jewish leadership by a person who has long been giving heart and soul for the benefit of our orthodox community. and for the secular com munity as well. As a former president of the Union of Orthodox Congregations and the current president of the Na tional Council of Young Israel, the words of Harold Jacobs carry much weight.

Says Mr. Jacobs: Our rabbis tell us that we live in times when we can hear “the footsteps of the Messiah,” which accounts for the wild extremes of Jewish history which we have lived through in the past forty years. We seem to be trapped in an uncontrollable cycle of good and bad news. The Holocaust was followed by the birth of Israel, the rampant assimiliation of the American Jewish Community has been followed by a dramatic resurgence of our Or thodox community. The relentless enmity of the Arab nations yielded four tragic wars, but resulted in an expanded Israel which now includes our holiest sites and most of our biblical territory.

We are now completing another cycle, which began with the cautious exultation of the Camp David Treaty, and which has just concluded in a traumatic withdrawal from Yamit and Sharm-El-Sheikh.

The future promises more and un known gyrations in Jewish fate, both for Israel and American Jewish community, which find themselves more inextrica bly linked than ever. Such times call for courage and wisdom, especially on the part of those who seek to lead KIal Yis roel. They also require a breadth of vi sion and experience; in the United States and Israel; in the government

and the private sector; in the religious and secular communities.

In this media-saturated age, all public leaders must be careful not to allow others to use their names and prestige to further goals and aims which may be detrimental to KIal Yisroel. Jewish lead ers must find and maintain a consistent position, to steer a steady course for our people, and have the courage to buck the tide, when necessary, to reach our ultimate goals.

The Midrasn describes the times of the Messiah as an era when “the face of the generation is like the face of a dog.” Our rabbis interpret this to be referring to our Jewish leaders, our public “face,” who seem to lead, as a dog on a leash may seem to lead its master running ahead, but always stopping to look back, ready to change direction in an in stant should the master turn.

Some have accused the Jewish com munity of walking in lockstep, rubberstamping Israeli government policy without input or comment. Anyone who believes this has no understanding of the constant concultative process, on all levels, within the Jewish community and with representatives of the govern ment of Israel. It may be true that, in some Jewish organizations, there is a vacuum of leadership, where there may be no interplay of ideas for lack of inter nal communications with the grass roots constituency.

But, what is most important, there is often difficulty in Jewish leaders com manding the respect and attention of a broad spectrum of the community. They may be out of touch. They may not be sufficiently sensitive to the issues of concern to our people. They may not sufficiently identify as Jews. In short, our Jewish leaders must become more Jewish. They must be as concerned with what the Torah thinks, what Jewish history will think, than whether their opinions match the latest Gallup Poll or will be idealogically “in” with their secu lar friends.

The Jewish community needs a strong, experienced hand at the helm, one which will not be swamped or swayed by the stormy seas ahead, and one that will steer a true course towards the destiny and redemption of our people, as outlined by our Torah herit age.

said American tradition of active concern for relgious freedom, and for those who are oppressed on racial or other grounds will be zealously con tinued. Certainly those Americans who have been elected to public of fice, from the highest down, will surely consider it their privilege and duty to show what America and Americans stand for. To be sure, such action is not always universally popular; there may even be obstacles to overcome, but do not all deeds of virtue require effort, as it is written, “Man unto toil is born” (Job 5:7). Cer tain it is that, inasmuch as these are responsibilities which Divine Provi dence places upon persons in posi tions of public office and trust, G-d provides them also with the neces sary capacities to carry them out. All that is required is personal determi nation and courage and the proper approach, to make such a stand ef fective and productive of desired re sults.

The Torah teaches us: “Seek the peace of the city whither I have caused you to be carried away, and pray unto G-d for it; for in the peace thereof shall you have peace. “(Jer. 29:7)j.

We are also mindful of the Tal mudic teaching that it is proper to speak in praise of the hospitality one enjoys. (Ber. 63b).

In light of the above, it is only right that we should gratefully recall on this solemn and festive occasion of the anniversary (Yahrzeit) of my saintlypredecessor, myfather-in-law of blessed memory, the role which this country, the United States of America, and its great leaders, played in saving his life, not once but twice, under the most crucial and dire circumstances. As we know full well, the resolute intervention in his behalf by leading Americans and other world figures played a decisive role in obtaining his liberty after his arrest in 1927, under a ruthless re gime which was determined to put an end to his religious activities.

Again, thirteen years later, it was largely through American diplomatic

intervention that my saintly fatherin-law was saved from the Holocaust. Moreover, every courtesy and facility was extended to him and his family, and his entourage, to transfer the headquarters of the Chabad Lubavitch movement to these shores. Here, in this blessed country of religious freedom, the movement has flourished with renewed vitality, with unprecedented national and global scope.

Truly those great American were the emissaries ofG-d to save not only his life alone; for it meant also a new lease on the expansion of the move ment he headed. Indeed, this was his greatest cause for rejoicing, as he points out in his encyclic letter ofthe 12th of Tammuz, the anniversary of his liberation (coinciding with his birthday). He went even further to say the the event was relevant not only to his followers, but to every Jew, even one who had nothing more than his Jewish name; certainly to those for whom Judaism, Torah and Mitzvos are the very essence of life.

Recalling all this with sincere gratitude, we are confident that the

For it was here, in this great metropolis, that my saintly father-in-law landed and was officiallywelcomed, first as a distinguished visitor (1929-30) and, ten years later, as a refugee and resi dent.

In the hospitable and conducive atmosphere of this warm-hearted city, he set up his headquarters in 1940, after the Holocaust, and it soon became the hub from which the movement’s far-reaching activities radiated throughout the United States and abroad.

We appreciate the kind tribute paid to our movement on this occa sion, and in all humility trust that it was well earned. For, while our move ment is engaged in a variety of activities to bring the light of the Torah, and the experience of the Mitzvos to every Jew it can reach and has no proselytizing activity among non-Jews, it directly and indirectly promotes the ideals of morality and equity among men of all creeds. Our adherents and followers are particu larly conscious of the obligation ofall Jews, as Maimonides rules, to pro-

mote the so-called Seven Command ments, with all their ramifications incumbent upon all mankind which are indispensable to any human so ciety, if it is to be governed by the principles of true morality and jus tice, law and order.

Since the sign oflife is in growth, it is to be hoped that the City’s, State’s and Federal Government’s, aid and cooperation will likewise grow, for the benefit of many and the gratify ing results and accomplishments of the past should only stimulate a great ambition to accomplish even more.

OfThe Spiritual And Moral Crisis

A great deal is heard lately of the energy crisis, economic crisis etc., and of ways and means to cope with them, but not enough about the spiritual and moral crisis.

American history tells us that this nation was founded on the inaliena ble rights of men. First and foremost among these rights is the right of re ligious freedom. As everybody knows, the pilgrims came to America to be able to practice here their religi ous, free from persecution. The majority of the early settlers were re ligious refugees, who firmly believd in G-d and his Word, the Bible. They were determined to foster this belief and to protect their right to bring up their children in the belief in G-d. Parenthetically it may be added that all new born nations and states, bar ring none, would do well to emulate the principles upon which the Amer ican nation was established.

The belief in G-d which brought the early Americans to these shores was not an abstract belief in a Su preme Being Whose presence is con fined to the Seventh Heaven. It was a belief that permeated every aspect of their everyday life, particularly the education of their children. It was this uncompromising belief that prompted and guided the Founding Fathers to formulate the Bill of Rights.

Times have changed, but the truth never changes. Yet, through cir cumstances which need not be de lved into here, the spirit and letter of the Constitution on religious free dom has come to mean—to some—

freedom from religion. We are wit ness to a sad phenomenon: some well-meaning Americans, even some organizations, use the very same Bill of Rights in a way that is weakening and undermining the belief in G-d in American life. It has prevented finan cial aid, federal, state and local, to any educational institutions where children are taught to believe in G-d. Even the mere mention ofa Supreme Being in a brief non-denominational prayer, to start the day off, has been proscribed.

There can be no doubt that the in tent of the Founding Fathers was to preserve religious freedom, not to deny it; to preserve religious equality not to wean the nation away from 0d, G-d forbid. Juvenile delinquency and crime have become so rampant as to pose a serious threat to society. Clearly, a child that is brought up without fear of G-d in his heart will have no fear or respect for a police of ficer. There is no substitute for rest raining the child unless he, or she, is brought up, from infancy and throughout the formative years, in the belief in the Supreme being, Whose Providence extends to each and everyone individually, at all times, and in all places. Or, as a great teacher and “Guide of the Perplexed” Maimonides expressed it: “The foun dation ofall foundations, and the pil lar of all sciences, is to know that there is a Supreme Being, the creator of all things that exist.

And taking a clue from the Divine “Constitution,” the Ten Command ments, we already had occasion to point out that the fulfillment of the commandments “Thou Shalt Not Murder,” “Thou Shalt Not Steal,” etc., can be assured and can with stand any temptation only if they are preceded by the knowledge that “I am the L-rd thy G-d, Who brought thee out of the land of Egypt, from the

house of bondage.” The pilgrims knew this when they fled from their “Egypt,” and they wished to ensure for themselves and posterity the newly-found freedom. We have also seen what happens to a society that has no fear of G-d: we have seen the Holocaust.

At the time when the Constitution was written, there was no need to worry about the preservation of the belief in G-d. The need that was im perative then was to preclude the es tablishment of a state religion, or give priority to any religious denomi nation over another. Nowadays, however, the nation is faced with so cial disorders largely due to a lack of belief in G-d. Should not the Con stitution be amended, or better still according to many, be interpreted in a way to meet this national crisis?

The Constitution was enacted with provisions for amendments, and, in fact was coupled from the start with a number ofamendments, and many more were added in the course of time to meet the national exigencies. There has not been great er emergency than now.

Time is of essence, particularly in matters of education. Children grow up every day. They should not be subjected to substitutes for faith in G-d, or to educational experimenta tions sometimes more harmful than good.

Again, we look to the President and Congress to lead the nation, not only out of an energy crisis and economic recession, but “also” out of the spiritual and moral crisis, upon which ultimately depends the future ofthis great nation under G-d, whose slogan is “In G-d We Trust!”

The Voice ofAmerica

Of the many lessons that come to mind on this auspicious occasion,

one is particularly instructive and relevant.

It has already been mentioned ear lier that the United States played a decisive role in the liberation of my saintly predecessor, whose life and work we honor tonight, and in his emigration from behind the Iron Cur tain. It was America in action— quietly, persuasively, firmly and ef fectively. It did so because it felt its duty to do a humanitarian act, and in doing so it demonstrated that this was American policy. It also proved that the voice ofAmerica, the voice of America’s conscience, is heeded around the world. Just as America helped my saintly father-in-law to come out from behind the Iron Cur tain, so it can today and tomorrow help many Jews to emigrate from there. We are certain that through quiet but firm diplomacy, without publicity, a greater number of Jews are likely to be helped to emigrate from there.

Most important also is to do every thing possible to alleviate the religi ous needs of those Jews who still have to, or choose to, remain there. They are entitled to the free exercise of their religion and to other basic human rights, rights which know of no geographical boundaries.

I am certain that I’m expressing the thought of thousands upon thousands, Jew and gentiles, in say ing that we firmly hope and expect that the President of the United States and the U.S. Congress will use their good offices, consistently and in the fullest measure, in this great humanitarian endeavor.

If there is a world’s conscience, America must be the voice that echoes it. It is not the time at all to underestimate its influence in the world. And certainly, the isolation policy in ourjet era is impossible.

OfPeace In The Holy Land

As mentioned earlier, the founders of the American nation were imbued with belief in G-d and with the spirit of the Holy Bible. It is, therefore, un derstandable that there should be a special affinity between the Ameri can people and the People of the Book, the Jewish people. America has traditionally shown its empathy with the Jewish people, particularly in times of stress, and at present proudly hosts the largest Jewish community in the world. And Ameri can Jews have contributed to the best of their abilities to the indepen dence and prosperity of the United States, as is well known.

The traditional American affinity for the Jewish people has found its most eloquent expression in the moral, economic and military aid which it has consistentlyextended to the people of Israel in the Holy Land.

To be sure, America, as a leading democracy in the world, has its ves ted interests in that part ofthe world, which inevitably coincide with a via ble, secure, and strong democratic Israel in that strategic crossroad re gion. But basically it is America’s moral integrity, stemming from its own experience as a nation under G d, and the recognition of its commit ment to world peace, that prompts its policy.

Moreover, as a nation born, reared and nourished with a deep sense of reverence for the Bible and for the in alienable rights of all men, it recog nizes the inalienable right of the Jewish people to its homeland, the land which is acknowledged by all nations of the world as the Holy

Land. This right has its roots in the everlasting convenant between G-d and our Father Abraham, as is re

peatedlyreaffirmed in the HolyScrip tures. To quote but several familiar passages: “For all the land that thou seest—I will give unto thee and unto thy seed forever” (Gen. 13:15); “On that day G-d made a convenant with Abram, saying; unto thy seed I have given this land” (ibid. 15:18); “I shall give unto thee, and unto thy seed after thee the land of thy sojourn, all the land of Canaan, for an everlast ing inheritance” (ibId. 17:8), and more in this vein.

In light of the above, there Is no need to convince the American gov ernment and people of this commit ment vis-a-vis the Jewish people In general, and the land ofIsrael In par ticular.

Nor Is there any need to justify American aid to Israel in order to in sure its security. Just as America’s own military superiority is designed as a deterrent to aggression by any for eign power that might have designs on the U.S.A., so is the strength of the land of Israel a necessary deterrant in the face of its enemies. For this reason the magnitude ofaid pro vided till now is not enough. If nonbelligerence is to be achieved in that region, the land of Israel must have sufficient aid to resolutely discour age any attempt on its security. This is the way to dispel effectively the illu sion about a “military solution” and to achieve a negotiated and lasting peace.

The Jewish people is the People of the Book, not a people of the sword. Its destiny is linked with the Torah, which was given by G-d in order to bring peace to the world, for “Its ways are ways of pleasantness, and all its paths are peace” (Gitt. 59b; Prov. 3:17).

We hope and pray for the day when the world will be free from the fear of war, and the vast resources that now go into wasteful military arsenals will be applied in peaceful and productive channels for the material and spiritual well-being of all mankind, in accordance with the prophecy of the prophet Isaiah: “And they shall beat their swords into plowshares and their spears into pruninghooks; nation shall not lift up sword against nation, neither shall they learn war anymore” (Isa. 2:4).

Can a Non-Jew Acquire Rights in Eretz Y’srael?

If a non-Jew acquires a piece of land in Eretz Yisrael, the mitzvot of the land still apply to it. This does not mean that the non-Jew must sepa rate tithes or first-fruits from his produce or keep the laws of the seventh year. A non-Jew is never ob ligated to keep more than his seven mitzvot. It means that a Jew who buys the produce before the agricul tural process is completed must sep arate tithes etc. The fact that it grew in land owned by a non-Jew does not exempt him from these mitzvot.

As a matter offact, the Mishna lays down that:

“He who sells his field (in Eretz Yisrael) to an idolator is compelled to buy the fruit thereof (whatever the price) and to bring the first fruits (to the Temple in Jerusalem).”

(Gittin 47a)

The reason given is “for the pub lic good”; that is, to discourage Jewish landowners from selling their land to non-Jews.

There is a dispute (in Gtttin 47) as to precisely what rights a non-Jew can acquire in Eretz Yis rael. According to Rabbah, his ac quisition of the land cannot de prive the fruit which grows on it of its sanctity (as stated above). The verse says “The land is Mine” (Vayikra 25:33); i.e. its sanctity remains in all respects. On the

other hand, his acquisition is ab solute in the sense that he is enti tled to make alterations in the configuration of the land, such as digging pits, ditches etc. Accord ing to Rabbi Elazar, however, the converse is true: the fruits which grow in the land are free of maas ser, but the non-Jewish purch aser has no right to change the character of the land.

Rambam follows Rabbah’s view and accepts that both the land and the produce retain their sanc tity. However he expresses this in a rather surprising way. He writes (Terumot 1,10):

If a non-Jew acquires land in Eretz Yisrael, the mitzvot do not cease to apply to it. It retains its sanctity, and if a Jew re-acquires it (from the non-Jewl this does not count as “conquest by an indi vidual” (and all the mitzvot still apply to by Torah law].

“Conquest by an individual” refers to the provision that the status of Eretz Yisrael is acquired only by an act of the whole nation. Conquest by an individual cannot bestow such status. Rambam apparentlythinks it necessary to state that the portion of land acquire by a non-Jew does not lose its status as Eretz Yisrael, and thus does not need —re-conquering”, so that the question of “individual (Continued on page 14)

When we leave our homes, unfor tunately, we do not always take our standards of kashruth with us. Often, this lack is the result of ignor ance or misinformation, rather than a deliberate neglect ofthe laws ofkas hruth.

There seems to be a popular mythology of Halachah concerning kashruth on the road, which has grown up over generations. People who are scrupulous in the obersvance ofevery detail and chum rah of kashruth in their own kitchen, including glatt kosher, can be seen with their yarmulkas in place, eating in “vegetarian” restau rants which have no rabbinic super vision, which are open on Shabbos and which don’t even necessarily claim to be kosher.

When confronted with the seeming contradiction in their actions, these people will look atyou quizzically and say, “What could be wrong?” They will point to others around them say ing, “It must be all right; look at ev eryone else eating here.”

The factors which must be consid ered in such a situation are the myriad of uncontrolled and un known factors which can make the most innocent-looking “vegetarian” restaurant non-kosher. Every baked item, every food which is prepared with shortening or oil, may, in fact, contain small but significantpercen tages of non-kosher shortening or oil, even ifthe list of ingredients does not indicate their presence. Desserts and confections could contain ques tionable gelatin or stabilizers. Even a seemingly innocent item like coffee creamer can be non-kosher. There could be a non-kosher fish item on

the menu, or a non-kosher grape product on the table or in the kitchen. Even ifthe offending item is no longer on the menu or in the kitchen, as long as it once was pre sent, it would have contaminated every utensil it was cooked in and served on. Once these utensils are washed, in hot water, with the other dishes or utensils in the restaurant, all of them could be contaminated and must be considered non-kosher. When in a regular, non-kosher res taurant, all of these same factors apply, plus the daily and pervasive presence of non-kosher meat, fish and cheese throughout the opera tion. All of the utensils and dishes must be assumed to be non-kosher, at all times. Yet, there are some otherwise scrupulous Jews who will innocently order cooked fish, pre pared and served on these non kosher utensils, and insist that they have not violated the laws of käsh ruth. Even hard or soft-boiled eggs can be problematic in a non kosher restaurant. There are even questions of Mans Ayiri about just walking into a non-kosher restau rant. Speak to your rabbi about these problems.

Things You Can Eat

This is a problem which affects not only travellers, but individuals who, in their daily lives, constantly are surrounded by food from vending machines, restaurants and candy counters. What, ifanything, is a kas hruth observing Jew allowed to eat from these sources?

The first necessary assumption is that all of the utensils and foods cooked in them are Tre(f What does that leave—those foods which are known to be kosher in their original state, and have only come into con tact with the non-kosher utensils when they are cold and clean. Even then, there are further kashruth considerations. For instance, spicy foods, or foods which require effort to cut with a knife, are considered Halachically to be heated, and can be contaminated by contact with even cold and clean non-kosher uten sils.

That brings us down to whole fruits and vegetables, pre-packaged

foods with reliable Hashgochas and natural or standard foods (milk, juice, Coca Cola, etc.) which are served essentially unaltered and cold. A kosher, packaged cold cereal and milk is another possible selec tion. Again, confer with your rabbi for specific guidelines.

at About a Cup of Coffee

Since coffee is typically brewed and served hot in restaurants, it would seem to be eliminated by the rules above. However, since coffee urns are not usually washed with the other utensils, they can be assumed to be kosher, even in non-kosher restau rants. However, the spoons and cups of the restaurants could contami nate the coffee, and the creamer could also be non-kosher. Therefore, the kosher consumer shold exercise care even when ordering a cup ofcof fee “to go.

Vending machines which dispense items known to be non-kosher (such as hot soup or grape soda) can pose many of these same problems.

Admittedly, the selections are very slim. So the question remains, when on the road or far from home in your own town, where can you go for kosher food? Surprisingly, the an swer to that question is far easier today than it was fifteen or twenty years ago. The best place to shop is at a candy counter or in almost any large supermarket.

Because of the prolification of reli able kashruth supervision on a wide variety ofpackaged foods, the Jewish traveller (or away-from home rtosher) can find kosher food ready to eat, straight from the package. Examples includes candy, potato chips and pretzels commonly available in single-serving packages at most candy counters or lunch counters (but make sure there is a Hashgochah on the product you buy.) If you are willing to buy in slightly larger quantities, then sim ply get off the highway at the nearest shopping center, stroll down the aisles of the supermarket, and you are likely to find reliably kosher baked goods, condiments and ready to-eat fish foods almost anywhere you may be, in addition to fresh fruit and the other items listed above.

JUDAISM AND THE PERMISSIVE SOCIETY

Is Our Society More Permissive Than Others?

Sociologists stress that which ev eryone experiences, namely that we live in an age of social change and upheaval, of the breakup of the old order of society. Yet the new order is in some ways less permissive than the old, both in the legal and the so cial sense of the word. In the legal sphere, we are hedged about and re stricted by laws which limit our free dom in the areas of travel, finance and business, the spoken and the written word, drug usage, etc. In the social sphere, the persuasive materialism of Western civilization has weakened the freedom of the in dividual and has brought about what the sociologists term an “other-di rected” mode of behaviour, i.e. that which is motivated by a desire to fol low others. As David Reisman says at the conclusion of his notable book “The Lonely Crowd”: “If the other-di rected people should discover that they no more assuage their loneliness in a crowd of peers, than one can assuage one’s thirst by drinking sea water, then we might expect them to become more atten tive to their own feelings and aspira tions. The idea that men are created free and equal is both untrue and misleading. Men are created diffe rently. They lose their social freedom and individual autonomy in seeking to become like each other.” The mass media of today, and the closeness and intensity of all communication,

create a constant barrage of influ ences upon human individuality which are in danger ofweakening it. Instead, the individual strives to adhere to the status symbols which are in danger of weakening it. In stead, the individual strives to adhere to the status symbols which are created by the mass media and the strong communications which inflence him. He wishes to belong to what is fashionable, to be “with it” in ideas, in way oflife and dress, to con form to the fashionable way ofthink ing and behaving. This frequently leads to the loss of individuality and freedom.

On the other hand, our society is certainly more permissive in various fundamental ways. These fall into ten categories, which we will now consider.

1. Morals. Relativistic ethics which are fashionable according to the code ofthe new morality do not accept any absolute moral power above man. They adopt the philosophy that “there’s no such thing as good or bad; ‘this only thinking makes it so.” They accept no code of right or wrong. Relativistic ethics are based partly upon a misconstruction, an application of apparent scientific principles to spheres where they do not apply. The principle of casuality which is today doubted in the sphere of physics, has been transferred to the sphere ofmorality, and forms the basis for the sciences of psychology and sociology. This has largely led to

viewing sin as an illusion or even as a maladjustment to a certain “pattern of culture”. It is assumed that real values are only illusions that are rela tive to a specific pattern of culture. These ideas are taught by professors and leaders of our present day soci ety.

2. Sanctions. This relativism has led to the removal of all moral or re ligious sanctions. The only ones that exist are legal or totalitarian. As a re sult, guilt and shame have gradually disappeared. Since this view does not accord with reality, anxiety takes their place, with far more serious consequences. We need not be sur prised if the younger generation has no respect for any authority, even for the university professors who have inculcated these principles into their minds and hearts.

3. Insecurity. The general anxiety is increased by the insecurity which exists in our generation after two world wars and the knowledge that we live under the threat of nuclear destruction. This has led to a society which is filled with a spirit of anar chy and tension, and which lives under the symbol of the bomb.

4. Widened Horizons. The enor mous advances in the twentieth cen tury in educational opportunities, the proliferation of new spheres of knowledge and the availabilityofnew experiences has led to a plurality of perception and to a widening of the

horizons facing the younger generat ion. However, there has been no com parable advance in moral and spiritual guidance. No direction has been given to contemporary youth to help them know in which way to make use of and to which purpose to direct the knowledge and experience which they had been given.

5. Leisure. The increase of leisure time and the surplus of means avail able in Western civilization has created a situation in which people have an overabundance ofboth with out knowing for which purpose it is to be used. It has created an inner vacuum in the life of man.

6. Self-Indulgence. Frequently we find that self-indulgence and the consumption of goods dominate human behavior and are regarded as the end of life. This has created a spirit ofapathy and withdrawal from serious concern as to the purpose of living, and has introduced to the ex perience of life what is known as the “fun syndrome”.

7. Experimentation. All this leads to an attempt amongst the young to experiment in all spheres without re gard to the spirit of harmony. Ex perimentation in aspects of life which are regarded in present dayso ciety as being forbidden, is obviously very attractive. According to Prov erbs, “stolen waters taste sweet”. In our age of hippies and trippies, of flower-power and psychedelic experi ences, pot-indulgence, drop-outs and ins, sit downs, get highs, of drugs, gambling and vandalism, it is the spirit of prohibition itself which creates the excitement.

8. Marriage. It is above all in the sphere of marriage that the permis siveness of our gener~tin reveals it self. There is an increase of promis cuity, and public expression in its favour. Recently, a prominent news paper featured the photograph of a bride in a dustbin with the caption; “Are we the last Married Generat ion?” Premarital and extra-marital relationships have not onlybeen con doned, but are officially advocated. Sexual perversions and homosexual ity have become the subject of ex

perimentation amongst large sec tions of the younger generations. We live in the age ofthe pill, an age ofthe pursuit of pleasure without fruit, of self-indulgence without responsibili ty. This has led to a great deal of un happiness and insecurity, to un wanted children, to VD, and to the breakup of marriage and the family.

9. Family Relationship. Not only is there a breakdown ofthe natural and wholesome relationship between man and women, there is a similar breakdown of the relationship be tween parent and ~hiId. Since the attitude towards society is an egalita rian instead of a functional one, human beings are viewed as having equal status. This has led to a situa tion wherein husband and wife, par ent and child are regarded as equal voices in the family. We therefore sometimes have the situation where, instead of parents bringing up chil dren, it is the children who bring up the parents. “The young shall put the elders to shame, the elders shall rise up before the little ones, the son shall disown the father and the daughter rise up against her mother.” We live in an atmosphere of other-directedness where only peers matter. There is, therefore, a large gap be tween the generations. This is due to a large extent to the permissive at titude parents have towards their young, and also because the young find themselves in a chaos created by adults. This has affected the Jewish communityas well, where there is in creasing unhappiness and deli quency amongst the youth.

10. Order. The permissiveness of our generation with its concomitant disorder pervades many spheres of life. It shows itself in the chaotic character ofmuch music, in the plas tic arts, in painting and poetry. The artist expresses through his medium the tohu and bohu ofour generation.

How Judaism Removes the Evils ofthe Permissive Society

We will now examine in detail how Judaism combats the various nega tive aspects of the permissive society which we have described.

1. Morals. Through its belief in an absolute moral power and by instil ling a constant consciousness ofthis power, Judaism develops in man firmness and stability in moral val ues. The Book ofKoheleth, whichbe gins by showing the relativity in na ture, human behaviour and society and morals, ends with the words “the end of the matter, when every thing has been heard is: fear G-d and ob serve His commandments for this is the whole of man.” This means that by accepting the absolute code of the commandments ofG-d all the relativ ities of life can be transformed into meaningful and stable modes of liv ing. Man is created in the image ofG d—Tzelem Elokim—indicating that he can relate himself to the absolute One, and by striving to imitate Him gain absolute significance for his life. This does not mean that the ab solute code of objective ethics of Judaism does not take into consid eration the subjective circumstances ofthe individual. As it is said in Prov erbs: “The thiefwho stole because he is hungry will not be despised”. Our sages speak of the ttnok shenishbah—of the infant who has been taken into captivity amongst idolators—who is not regarded as re sponsible for the sins he has commit ted. This is not to be confused with relativistic ethics; rather, in judging the behaviour of an invidual, one must at all times take into considera tion all the subjective aspects of his circumstances. The objective code of ethics remains stable and firm throughout.

There is, a largegap between the generations.This is due to a large extent to the permissiveness attitudeparents have towards theiryoung, and also because the youngflnd themselves in a chaos created by adults.

2. Sanctions. The basic sanction of Jewish observance is a moral and re ligious one. In the Diapora, these are the only sanctions which exist. The sense ofguilt which this can create is better than the anxiety and neurosis which are the end-product ofpermis siveness. Through constant moral eduation—Torah study—respect for religious and moral authority is built up in the minds and hearts of com mitted Jews, which is in direct con trast to the lack ofrespect for author ity which characterizes student pro test and unrest.

3. Insecurity. Instead ofthe spirit of insecurity which characterizes our age, Judaism inculcates bitachon and emurtah, trust and firm belief. It teaches: “the L-rd is with me, I have no fear. What can man do unto me?.

It is better to shelterwith G-d than to trust in man.” The Gaon of Vilna explains that chasah, the root ofthe Hebrew word for “shelter”, means to trust when there has been no prom ise. In other words, it is better to rely upon G-d when there has been no clear promise than to rely upon the promise of man. The observance of the Sabbath, the symbols of the Sukah, the daily prayers and bles sings bring about a situation ofhap piness and firmness in the life of a Jew. “Blessed is the man who tnis~ts in the L-rd.”

4. Widened Horizons. The Jewish term for education, hinuch, indi cates that its ideal is one of consec ration, education towards high spiritual and moral ideals. With such moral guidance, wide experience and increasing educational oppor tunities will not bring confusion and will not lead to the loss of a sense of direction. The Torah, says the Book of Proverbs, grants discernment to peta’im. The word “peti” (usually translates as “simple”) describes one who is open (patach)—like our gen eration—to manifold and often con flicting influences and trends of thought and life. What is required is discernment, clear guidance as to what is right and wrong. This is given by the Torah. The Ethics ofthe

Fathers states: “Who is a wise man? He who learns from every man, as it is said: ‘I have learned from all those who could teach me because your statutes were my constant thought and conversation’.” In other words, width ofexperience and broadness of mind can do a great deal of good as long as a person has a measuring graph—the statutes of G-d— whereby he can know what to accept and what to reject.

This does not mean to say that Judaism advocates repression. The Sages (in Talmud Yerushalmi, Kidushin) say that “man in the fu ture will have to give an account and reckoning of everything that his eye saw from which he did not derive benefit and pleasure.” This is not to be regarded as an advocation of hedonism. Its meaning is that only if a person combines his self-in dulgence with moral and religious experience does he derive full benefit and joy, and insure that the in dulgence will not develop into mis ery. It is with such moral guidance that a person can develop his per sonal freedom and individuality. He will not be in danger of becoming a slave to his environment.

5. Leisure. Leisure has never posed a problem for the Jew but has been his greatest opportunity. Bitul Zeman, waste of time on things of nought, is regarded as a great crime. Time is the greatest possession of man, and should be used for the ful fillment of divine commandments, for the betterment of humanity, for the improvement of self, of one’s

knowledge and understanding of Torah.

6. Self-Indulgence. Consumption and indulgence should never be re garded as an end but are an impor tant means. Judaism believes in the concept of Simcha shel Mitzvah. This means that the ideal, the end, is the Mitzvah—the fulfillment ofG-d’s commandment. Indulgence of this nature can remain constant and will lead to Simcha, to spiritual growth.

Rabbi Yehuda Halevi in his Kuzari describes the ideal personality as the Chasid, the saint in whose character all qualities play a part. He suppres ses neither spiritual nor material faculties but instead harmonizes them all for the purpose of fulfilling G-d’s commandments. It is this type of ideal towards which the Jew should strive and which will lead to a constant spirit of positive achieve ment and the love of G-d. It is impor tant to realize that contrary to com mon belief, the love ofG-d frequently takes precedence over the fear ofG-d, as we say in our daily prayers, “Le’ahava uleyirah et shmecha”— “to love and fear Your Name.” This means that educationally the do’s should take precedence over the don’ts. The positive aspects of Judaism, which frequentlymake use of the material inclinations of man rather than suppresssing them, are a priority in Jewish life. This is ex pressed in the words of the Sages: “I have created the Torah as a spice for the evil inclinations” (not an antidote as it is usually translated). This means that the material inclinations of man will not bring him constant pleasure, unless he spices them with the Torah. A spice is used in order to give extra taste and extra pleasure. So the Torah will do the same to the material inclincations of man, if he uses them for the service of G-d.

7. Experimentation. Judaism will make life far more exciting if people experiment not in all sorts of perver sities, but instead strive to satis1~ the instinctive drives through Torah. As the Sages have said, “Ifthe evil inclination meets you, then draw him into the house of study. If he is made of fire, the waters of the Torah

will quench him. If he is made of stone, then the waters of the Torah will melt him.” This means that the evil inclination, the primitive in stincts of man, will find far greater satisfaction and happiness in the study and observance of Torah than in any experimentation outside this sphere. “It is healing for all his flesh” (Provers). The Torah brings a spirit of harmony, integrity and wholeness to the life of man, which gives him great creativity and makes all per verse and lower modes of life seem trivial and unexciting.

8. Marriage. In the sphere of mar riage, Judaism offers us the deepest satisfaction, stability and sanctity. It regards marriage as the ideal state, considering an umarried person as ravak—an empty man or women. It believes in setting up a relationship within marriage of kidushirt and nisuim—of santification and uplift. It introduces the balance between a very strong physical relationship and strong platonic one. This is done through the laws of Nidah and Mik veh, which bring about a constant renewal ofthe initial happiness with in marriage to husband and wife. and produce a renewal of their mar riage relationship. This constant re newal oflove within marriage creates a spirit of security for the children, surrounding them with an atmos phere of harmony, solidarity, stabil ity and love. The frittering away of sexual powers which is taught by the new morality has an adverse effect upon culture, as is shown in the im portant writings of Unsworth on “Sex and Culture”. Judaism believes in principles ofdiscipline, in chastity for the sake of chastity. It is only by opposing extra-marital and pre-mar

ital experimentation, by introducing a strict discipline upon sexual in stincts ofman, that human misery can be avoided, and happiness within marriage can be developed. The ener gies of human beings can also be sublimated and evolved for higher cultural and religious purposes. In contrast to the permissive slogans of our society, Judaism believes that pleasure without fruit, that pleasure for its own sake, is self-defeating. For all indulgence involves responsi bility.

9. Family Relationship. Judaism believes in the functional attitude to wards society. This indicates that a husband and wife have their specific roles to fulfill in life, different from one another. Parents and children likewise, in order to set up a har monious unit of the family, must play out theirspecific roles. Kibud av vaem—children must show honour to their parents. Parents, on the other hand, must show understand ing towards their children and have duties towards them. Their duties are not just material ones, but spiritual ones—”veshinantam levanecha“—“You shall teach Torah to your children.” If parents teach children there is no fear ofa generat ion gap, as there is constant com munication concerning important and fundamental issues of life be tween the older and the younger gen eration. It is only when this com munication breaks down, when there is no spiritual contact between parents and children, that the younger generation altogether re volts against the dominance of the older generation. In Jewish life, how ever, father and child establish a close bond through the study of the Torah. Through the observance of G-d’s commandments they are able to walk together to fulfill these corn mandments—”vayelchu shnehem yachdav”.

If humanity would adopt the uni versal ethics of Judaism, Introduc ing its pattern of international rela tions, as well as basic principles that should govern all human beings, the world would not be in such a state. Then the younger generation would have respect for the manner Inwhich

the older generation Is conducting world affairs. Judaism requires that we Involve ourselves In bringing Its universal ethics to humanity. It Is this aim which underlies the idealism of many of the younger people and makes them turn against the older generation who are so often concerned wIth self-Interest. Judaism, which opposes this self-in terest, can serve as an Ideal bridge between the young and old, if It would be adopted universally.

10. Order. Judaism teaches us to in troduce order, system and control in life, making it into a constructive ad venture.

This is illustrated by the mltzvah of tztzith. The garment in which the Jew envelops himself represents the type of atmosphere and influence into which he should be immersed. The tzizith are to be tied into knots to remind us that the Jewish religion requires a measure of self-control, but two thirds of the thread are left free and open, to show that through control a double measure of creativ ity and freedom can be produced. The tzizith also teach us that “You should not go astray after your eyes and your heart”; that a person should notjust follow the whims and fancies of his heart and eyes, which view things externally and mate rially. Instead, he should be kadosh—one who dedicates his whole life to G-d in a constructive manner and removes himselffrom all forms of moral chaos. Judaism teaches not self denial but self-dis cipline, for the purpose of self fulfill ment. Judaism can thrive most posi tively in a permissive society. In our age even more than in others, the positive meaning of the Jewish way of life can fill the vacuum existing in present day society. Judaism teaches that “motar ha-adam mm ha-Behema aymn “; the advantage of man over the beast lies in the ability to say “no” to manyofthe permissible acts and activities of present day so ciety. It is only in this way that we can structure a life built not on permis siveness, but on freedom—the free dom which lies in subservience to the law of G-d.

Ifparents teach children there is nofear ofagenerationgap, as there is constant communication concerning important andfundamental issues oflife between the older and the youngergeneration.

conquest” does not arise. It is rather puzzling that the Rambam should have thought it necessary to say this. Why should it be thought that acquisi tion by a non-Jew might cause the land so acquired to revert to the status of chutz la’aretz (land which is no part of EretzYisrael)?

The answer is that there are two factors which operate to bestow sanctity on Eretz Yisrael:

(1) Acquisition by the Jewish people, by conquest or otherwise;

(2) Settlement by Jews.

Now there is no doubt that both these factors are required to bestow sanctity on the land; the question is, are they also needed to enable the land to retain its status? Rambam apparently holds that ownership of the land must be present continu ously, and ifownership ofany part of the land were ever to be effectively re linquished, that portion would re vert to chutz-la-aretz status. Fortu nately, however, the halacha lays down: em kinyan le-nochri be-eretz yisrael—”there can be no effective acquisition of (any part of) Eretz Yis rael by a non-Jew”. Consequently no acquisition by a non-Jew, by con quest or purchase, can change the

status of Eretz Yisrael. (This princi ple applies to the land reoccupied by the Jews under Ezra at the begin ning of the Second Temple period, and also to all the land conquered and re-settled subsequently, during the Hasmonean and Herodian periods; i.e. virtually the whole ofthe Biblical Eretz Yisrael and Transjor dan.)

So far as the monetary aspect is concerned, however, the non-Jew has the same rights as any other pur chaser and can therefore dig pits and ditches at will.

There would seem another reason why the acquisition ofland by a nonJew could not be effective in chang ing the status ofEretzYisrael. This is because any such acquisition could surely never be absolute. The Torah prohibits the absolute sale of land in EretzYisrael(Vayikra 25, 23). Ifany one purports to sell any part of Eretz Yisrael absolutely, both the buyer and the seller transgress a law of Torah; that part of the contract pro viding for an absolute sale is invalid; the original (Jewish) owner is enti tled to redeem his land from the pur chaser any time after the first two years; and failing this the land re verts to him without payment in the Jubilee year (the fiftieth year). (Vay

ikra 25, 24-28; Rambam, Hilchot Shemitta ve-Yovel, 11:1)

However, these laws only apply when all (or most) Jews reside in Eretz Yisrael and the original tribal divisions are preserved, as in the time ofJoshua. Neither of these con ditions applied in the time of Ezra. Only a fraction of the Jewish nation returned to Eretz Yisrael from the Babylonian Exile, and the tribal divi sions were not maintained. Con sequently the laws of the Jubilee did not apply during the Second Temple period. It would appear that Rambarn holds that the law prohibiting absolute sales ofland is part and par cel of the Jubilee legislation, and so this law, too, did not apply during the Second Temple period. Absolute ownership of the land became possi ble, and there was thus a theoretical possibility that a non-Jew might ac quire absolute ownership in part of Eretz Yisrael and so deprive the land of its sanctity. But here again the Halacha steps in with its overriding principle: em kinyan le-nochri be eretz yisrael—”a non-Jew can never have effective ownership over [any part of] Eretz Yisrael”. This outcome is therefore avoided and all parts of Eretz Yisrael retain their sanctity for all time.
