KAM Physician Matt Mancini, MD Inducted as TMA President KAM Past President and UT Surgeon, Matthew L. Mancini, MD, was recently inducted as the 164th President of the Tennessee Medical Association. Dr. Mancini was born in Boulder, CO and raised in Kansas City, MO. He earned a bachelor’s degree from the University of Notre Dame, graduated from Mercer University School of Medicine in Macon, GA and completed his residency in general surgery at the University of Tennessee Medical Center, where he still practices today with University Surgeons Associates. He is board certified in general surgery and has held several academic and hospital appointments in the Knoxville area during the past decade, including serving as Chief of the Division of General Surgery at the UT Graduate School of Medicine since 2014. His exceptional professional achievements earned him the Outstanding Alumnus Award from the UT Graduate School of Medicine in 2015.

Dr. Mancini has stated that he will continue TMA’s effort against the opioid crisis. Additionally, he wants to continue his focus on revamping TN’s Episodes of Care that have impacted so many physicians. His work on Episodes of Care in past years is largely credited for the ‘pause’ recently achieved while program changes are made. Without this ‘pause,’ many more specialties would have begun to feel the impact as more episodes were scheduled for rollout.

During Mancini’s address to the House of Delegates he spoke in regards to the importance of TMA membership and the impact it has on the issues that effect the House of Medicine. In one example, Mancini reminded physician members of the fairly recent decrease in malpractice insurance premiums, which was attributed to the efforts of organized medicine across the state. Together we are stronger!

Montgomery Gentry Band Returns for KAPA’s Boot Scootin’ Ball On April 27th, the award winning Montgomery Gentry Band returned to Knoxville to perform at the 2018 KAPA’s Boot Scootin’ Ball. The annual event is hosted by the Knoxville Academy of Medicine Foundation and all proceeds benefit Knoxville Area Project Access, also known as KAPA. The event included a private concert by the Montgomery Gentry Band. In addition to the high energy show attendees enjoyed a western themed dinner, a photo booth, free moonshine tasting, bottomless beer along with the opportunity to partake of this year’s specialty drink, the KAPA Black and Blue Shiner!

This year’s silent auction featured over 55K in donated items and was a highlight of the evening. The largest KAPA silent auction to date featured everything from jewelry, vacation getaways, art, a luxurious hot tub and collectibles.

The KAPA’s Boot Scootin’ Ball helps continue the work of a much needed program in our area. Since 2006, KAPA has coordinated more than $275 million in donated care to low income individuals that have no any other access to health care through either government programs or employer-sponsored insurance.

ACADEMY NEWS Legislative Update

By: Elise Denneny, MD, FAAO-HNS, FACS KAM Legislative Chair TMA House of Delegates met May 5, 2018. Region 7 was well represented by KAM, BCMS and RACMS delegates.

The following resolutions were passed.

Resolution 1-18: Resolved that the TMA /AMA HOD delegation be directed to amend AMA HOD H-185.940, “Beers or Similar Criteria and Third party Payer Compliances Activities” to actively advocate with health insurance companies not to utilize the Beers Criteria within their physician rating mechanisms, such as STARs and HEDIS quality measures, and that TMA advocate with health insurance companies in Tennessee to change the manner in which they utilize the Beers Criteria as a rating tool for physicians.

Comment: We will continue to fight against payors implementing flawed “quality “ measures which impact physicians ability to deliver quality care.

Resolution 2-18: Resolved that the TMA/ AMA HOD delegation be directed to seek change that would require Centers for Medicare and Medicaid Services (CMS) to obtain all needed information through Coalition for Affordable Quality Healthcare (CAQH) instead of requiring physicians to make quarterly entries for Medicare and Medicare Advantage plans. Comment: We will continue to fight additional administering “busy work” mandated by the government.

Resolution 6-18: Resolved that the TMA supports fair and transparent processes for the evaluation of a physician’s mental health during licensure, credentialing and hiring or retention processes to reduce the stigma and potential for inappropriate negative professional consequences for physicians who disclose mental health conditions and will work with stakeholders to improve policies and procedures and communication for the evaluation of

a physician’s mental health during licensure, credentialing, and hiring or retention processes to reduce the stigma and potential for inappropriate negative professional consequences for physicians who disclose mental health conditions and encourage the proactive use of mental health services by physicians as part of a normative lifestyle or self care in consideration of the unique stressors they face and the TMA adopt as policy the quadruple aim which adds the goal of improving the worklife of physicians as a key plank in health care delivery systems which have adopted the Triple aim.

Resolution 7-18: Resolved that the TMA will urge the AMA to promote federal action requiring opioid treatment programs (OTPs) to submit dispensing data to prescription drug monitoring programs (PDMPs) in accordance with state laws and will urge legislators to require that all healthcare entities including OTPs be required to report controlled substance prescribing to the PDMPs. Comment: this will help physicians identify methadone and suboxone use by patients. (Currently both are exempt from reporting) Resolution 10-18: Resolved that the TMA HOD engage healthcare plans to provide benefits including integrative services for patients with chronic pain and form a task force to explore with healthcare plans alternative payment mechanisms to facilitate innovation in the delivery of integrative services to patients with chronic pain. Comment: the future of value driven care presents the opportunity for mayors and physicians to co-align effective programs. It is imperative creation of these pathways have physician input.

Future direction from the House of Delegates will address effective adolescent social media campaigns to fight opioid use, exploration of future pathways for medical students who did not match, continued monitoring Medicaid exchange plans and addressing big Pharma and PBM aka Pharmaceutical benefit managers. Blount County Medical Society Quarterly Update By: Travis Groth, DO BCMS President

“Education is the most powerful weapon which you can use to change the world.” –Nelson Mandela. This quote resonates to me over the last year as Tennessee continues to push for change amidst the opioid crisis. Change is happening right here in Tennessee. I was fortunate to attend the Tennessee Medical Association (TMA) House of Delegates meeting in Nashville in early May. Delegates for Blount County Medical Society included myself along with Drs. Bob Proffitt and Marvin Beard. We also had the honor of having Dr. John Ingram, founder of the John Ingram Physician Leadership Institute and TMA Past President, present to represent our medical society. Hot topics of discussion were first and foremost the Opioid Crisis in Tennessee. TMA Immediate Past President, Nita Shumaker, MD, used her platform last year during her presidency to institute changes which would address this crisis. With the recent release of Governor Haslam’s new plan Tennessee Together, the state is also making changes. Key points of Haslam’s Plan include limiting the initial supply of opioid prescriptions to a five-day supply of medications with daily dosage limits of 40MME (morphine milligram equivalents); increasing prevention through education of grades K-12; identifying women of childbearing age who are chronic opioid users to provide education in regards to Neonatal Abstinence Syndrome (NAS); and attacking illicit sales/trafficking of opioids with the help 8

of TBI. Tennessee now has the most stringent opioid laws in the country.

Other hot topics discussed at TMA included how to help physician burnout, utilization of social media to reach adolescents and educate students, and gun control. This was a great first time experience for me personally to see how change is being made at the state level. I highly encourage other physicians to become active participants and educate yourselves as physicians strive for positive change both at the state and federal level.

In addition to the TMA House of Delegates, Knoxville Academy of Medicine hosted KAPA’s Boot Scootin’ Ball which was a huge success! Entertainment included music by the famous Montgomery Gentry Band. Upcoming events include a trip to the horse races at Keeneland in October, and an outdoor BBQ Bash Tailgate party hosted by Blount Medical Society in early fall where we can socialize while watching the Tennessee Volunteers on a large projector at a local venue.

To Summarize, this last quarter has been a busy one both at the local and state level. TMA continues to be a strong voice for physicians in our state. I encourage others locally to get more involved and contact me if you have questions in regards to membership or how to be more proactive. Simply joining TMA and Blount Medical Society is a great place to start. The John Ingram Physician Leadership Institute is another great way to get involved and gain priceless leadership experience. I am grateful for this opportunity to serve as President of Blount County Medical Society and will continue to put my best efforts forward.

KAM Telemedicine: Part Two

By: Patrick McFarland, MD Resident Physician, PGY-4 Department of Anesthesiology University of Tennessee Graduate School of Medicine Previously, we covered the basics of telemedicine, discussing how it can improve access to care. Briefly, real-time interactive telecommunications services can aid in healthcare delivery to patients when providers are remote or scarce. Furthermore, we highlighted certain obstacles to telemedicine’s success (i.e. lack of physical exam, costly installation and maintenance, and regulation and restriction with regards to implementation and reimbursement). Today, we will address each of these barriers, as I round out my last publication as KAM Resident Liaison, as I finished residency training this June!

First, inherently, telemedicine lacks a physical exam. Ideally, a clinical scenario includes a face-toface physical examination; however, when unable, the physician-led team-based care model can arguably play a role with physician-extenders. Multidisciplinary teams, led by physicians and consisting of various physician-extenders in advanced practice providers, nurses, etc., already play a vital role in hospital and clinics. Translating this practice into telemedicine may be easier than previously thought. The combination of live sessions with physician-extenders with physician supervision via telemedicine may help address the access to care issue, if patient safety and quality are preserved. A recent study in joint replacement patients demonstrated how teletherapy may be useful in reducing post-operative pain. Teletherapy, in the form of cognitive therapy sessions via skype, showed improved outcomes in a small, high-risk,

TennCare to “Pause” Rollouts of EOC

TennCare recently announced that the state will temporarily pause expanding its episodes of care payment model. This pause will allow TennCare to concentrate on improving and maintaining episodes already in place.

“After months of discussions and years of meeting about episodes, I am ecstatic to get this news that TennCare has agreed to pause expansion and work on what is in place to hopefully avoid more problems and frustrations in the future,” said Matthew L. Mancini, MD, a Knoxville surgeon and President of the Tennessee Medical Association. Dr. Mancini has worked to lead the charge for TennCare to “Pause and Patch” the Episodes of Care as it is a severely flawed system.

In TennCare’s announcement, they stated that there will not be any Technical Advisory Groups (TAGs) held this fall and the following episodes will be paused:

patient population. If telemedicine can increase access to care, improve patient outcomes, and reduce reliance on opioids, we must investigate!

Second, telemedicine requires costly installation and maintenance of equipment and technology; although, this may be one of the larger myths surrounding its use. Look no further than our neighbors in southeast Tennessee, Chattanooga. Recently, Chattanooga developed one of the nation’s fastest and most efficient internet services, 100 times faster than national average. Due to lack of market competition, Chattanooga classified internet service as a public utility and developed its own broadband service. Not only did Chattanooga find success in this respect, but they also experienced record profits. The city planned to use these profits to expand service to outlying rural communities, however, private interests took notice and successfully lobbied state legislature to prevent this from occurring and prevent other areas from duplicating Chattanooga’s success.

The law would need revisiting, but Chattanooga’s example dispels the notion technology and equipment carry high costs. In fact, tech companies from around the country flocked to relocate in Chattanooga to capitalize on this fortuitous opportunity.

Lastly, regulations currently limit telemedicine’s potential. This barrier requires strong advocacy efforts, as again, the law needs revisiting. Current federal and state regulations limit the use of telemedicine to only certain types, in certain circumstances. Telemedicine comes in several forms and policymakers should approve all modes of use to maximize patient benefit and improve access to care.

Finally, thank you all for the opportunity to share my thoughts in these publications. KAM has been a source of inspiration for me, and I hope to spread that inspiration to all who read. Thanks, and enjoy the summer!

ACADEMY NEWS Region 7 Has Strong Participation at TMA Annual House of Delegates The TMA House of Delegates met for their Annual Meeting on Saturday May 5th at the Nashville Marriott. During this time Delegates gathered from across the state to discuss the many issues that impact the profession and determine priorities for the TMA for the coming year. Physician delegates in the House discussed a number of resolutions affecting the practice of medicine in Tennessee, and patient health. Among the notable policies were: • Encouraging physicians to seek out mental health services to help reduce stress and improve their work life balance, and eliminate the stigma for physicians who disclose mental health conditions.

• Change state laws to give Tennessee medical school graduates who do not match in residency programs opportunities to practice under supervising physicians in areas of the state with a primary care physician shortage.

• Seek partnerships for a digital media campaign to educate adolescents about the dangers of opioids, and promote alternative pain management therapies.

• Petition health insurance companies to cover more alternative, nonopioid pain management therapies.

• Seeking federal action to allow methadone treatment programs to report controlled substance dispensing data at the state level.

Region 7 was well represented with many delegates giving of their time to protect the profession, as well as, advocate for their patients and Tennessee residents.

The #MeToo movement has gained momentum as high-profile cases have made national headlines putting the issue square on the minds of employees and employers alike. So, what conduct is legally considered “sexual harassment” and how should employers respond to such allegations?

Title VII of the Civil Rights Act prohibits discrimination “because of sex.” This includes a prohibition of conduct that equates to sexual harassment. The EEOC defines two types of sexual harassment: “quid pro quo” and “hostile work environment.” Quid pro quo sexual harassment occurs when “submission to or rejection of [the] conduct by an individual is used as the basis for employment decisions affecting [the] individual.” For example, quid pro quo harassment occurs when an employee is not promoted because he or she refused to engage in sexual acts with a superior. A hostile work environment due to sexual harassment occurs when the conduct purposefully or unreasonably interferes with an individual’s work performance. Often, but not always, quid pro quo sexual harassment and hostile work environment occur together.

So, when does conduct cross the line from inappropriate behavior to sexual harassment? Title VII says “unwelcome” sexual conduct that is a “term or condition of an individual’s employment” constitutes a violation of the Act. Furthermore, the conduct must be so frequent or severe that it creates a hostile work environment or results in an adverse employment decision. Thus, Title VII does not prohibit teasing, offensive comments, immature behavior, bad judgment, or isolated incidents that are not “serious.” In other words, it does not prohibit someone from being a jerk in the workplace.

Consider the following allegations from a U.S. Sixth Circuit Court of Appeals opinion: a male supervisor permitted male employees to work

flexible hours, but denied female employees the same request; he accessed female employees’ computers to check their internet search histories; he prohibited one female plaintiff from cashing in her vacation time, but permitted male employees to do so; he laughed and chatted with male employees, but “smirked” at female employees; he loudly popped packing materials in the area where female employees worked.

Sexual harasser or jerk? According to the Sixth Circuit Court of Appeals, the male supervisor was a jerk, but not a harasser, and the harassment did not constitute sexual harassment under Title VII. The Court held that, in all, the events would not be considered by a rational person to be so severe or pervasive to alter the conditions of her employment.

“Without question, [the] actions… showed both immaturity and bad judgment,” the Court continued, but they “do not support the conclusion that the working environment was objectively hostile or abusive.”

What is an employer to do? Create and enforce appropriate policies regarding not only harassment but inappropriate workplace conduct, as defined by the employer. Then, investigate every allegation of inappropriate conduct. Be mindful during the investigation process that the conduct may or may not meet the Title VII definition of sexual harassment, but you may still discipline or terminate those employees who are being jerks for violation of the inappropriate workplace conduct policies.

KAMA CORNER By: Kirstin Kropilak, KAMA President and Tina Callicutt, KAMA Immediate Past President Our 2017-2018 KAMA year came to an end with our last meeting on May 3, 2018. During the meeting we installed officers for our 2018-2019 year, they are ready to give their all next year. This year’s theme embodied being a friend to each other, our community, and other organizations, like KAM, within our community. The University of Tennessee College of Social Work determined that in 2015 9,373 individuals accessed homeless services from KnoxHMIS partner agencies. In Knox county between October 1, 2016 and September 30, 2017, the Knoxville News Sentinel reported that our first responders had to deliver naloxone 1200 times for opioid overdoses. Medscape reports physicians have the highest suicide rate among any profession, which is a reason the Tennessee Medical Foundation remains such a wonderful resource for doctors. These statistics are the driving force behind the continued effort we put into our organization each year. The hand of help we give with friendship and being a part of “Team Knox County “ will hopefully one day lower / eliminate these community issues.

We thought it only appropriate to write this article together since we have worked side by side this year and want it to end in the same way.

Again, an underlying theme for us, one that I, Kirstin, will carry through in my year as president: Teamwork.

Tina orchestrated my installation using a Team KAMA theme. It was fabulous! Little did she know that I was using Teamwork as a theme for my year. Great minds think alike.

We have another exciting year planned, with a great team in place.

We are looking forward to our annual picnic with KAM welcoming new members. Our first fundraiser, Fashiondrama will be on October 4, 2018 at Gettysvue Country Club. Cynthia Gash and Robin Hutchins are the “Head Coaches” for this event, and they are encouraging everyone to purchase their tickets as soon as possible, as only 100 seats are available. Our second major fundraiser is Doc Rock in January 2019 and will be led by Susan Brown and Dr. Lytle Brown. This is always a popular event and directly benefits the non-profit organization the band represents.

Our efforts to join the fight against the opioid epidemic will be strengthening as we begin to volunteer in Knox County schools this year. Barbara Crist and Carolyn Cates are leading the charge to make KAMA a presence in educating middle school students. Volunteers from KAMA are being trained by the Metro Drug Coalition to do an interactive after school program with the kids. The focus will be on 3 zip codes with the highest overdose deaths and naloxone deliveries.

Thank you for a wonderful year. We are looking to another strong year of partnership with KAM from our picnic to other events. We appreciate all the help and support.
