DeLaney Joins KRIRM Faculty

W

ith a dedication to develop real-world decision-making skills in our students that exemplifies excellence in ranch management, we are always looking to engage the very best minds on our faculty team.

The foundation of our educational model includes practical experience, from boots on the ground ranch management, combined with an advanced set of business management skills. We know success in the decades ahead will require this complete skillset as the complexity of ranching continues to increase. In order to develop graduate students with such skills, our faculty and external teaching partners must possess the same expertise and experience. To that end, it is with great excitement that we announce the recent expansion of our faculty to include David S. DeLaney in the new role of Practitioner in Ranch Management.

Dave is arguably the most experienced manager of complex ranching operations in all of North America – an addition to our team that only makes sense.

In 2021, Dave DeLaney retired as Vice-President and General Manager of Ranching and Wildlife at King Ranch, Inc. There is no single job in ranching that is more complex or historically recognized. Dave DeLaney has had an amazing and impactful career that young and ambitious ranch managers dream about. His career has also equipped him with unique insights, experiences, and unending passion for our industry and heritage. At the same time, Dave has been one of the most influential direct supporters of KRIRM and has served on the KRIRM Management Council as a charter member since 2003. His council service has been stellar; however, it is the direct teaching and mentoring of graduate students that has helped shape excellent decision-makers and leaders.

Over the years, Dave DeLaney has had a hand in mentoring 50 KRIRM graduate students, and continues to serve many as a mentor post-graduation as they work through the challenges of leadership and decision-making as managers in the ranching industry. DeLaney has developed 32 case study projects over 19 years involving King Ranch cattle, wildlife, natural resources, business contracts, and employee management systems. These case studies provide the context that glues together the graduate training concepts introduced in the KRIRM graduate curriculum.

Tenatious Trio Graduation Prepares for

KRIRM’s 2022 graduates are grateful & optimistic as they pursue their passion in the ranching industry

I

n May 2022, three individuals will earn their Master’s degree from the King Ranch® Institute for Ranch Management program – joining an elite group of 47 other graduates who have earned that title over the past two decades. KRIRM’s Class of 2022 includes Scott Crozier, recipient of the Clement Family Endowed Fellowship; John Worthington, recipient of the Four Sixes Endowed Fellowship; and Ethan Young, recipient of the Tio Kleberg Endowed Fellowship.

Collectively, this trio navigated their KRIRM coursework while balancing the challenges of the global pandemic, and they have emerged tenacious, grateful and optimistic to pursue their passion in the ranching industry.

Ethan Young describes the experience saying, “The last year has been unique in that the program wasn’t immune to 4 King Ranch® Institute for Ranch Management | Spring 2022

the effects of the COVID-19 pandemic. Our class got to experience remote learning, reduced class size, and travel restrictions.” But despite that, he adds, “During all of that, the program was able to showcase the ranching spirit, and that no matter how bad it gets we can’t go back and we can’t stay here, so we might as well go forward.”

Future Focused It was that can-do attitude and forward-thinking mindset that brought these three men to the KRIRM program in the first place. Young, a native of Utah where he worked at Ensign Ranches throughout his formative years, says he was fortunate to meet a handful of former KRIRM graduates while he was in college and working on ranches. Of those individuals, Young saw “how capable they were at managing,” and says, “I wanted to be able to sit at the table with them.”

– John Worthington Young says he was also interested in the systems thinking approach KRIRM uses, along with its mission to keep American ranching and its heritage alive.

Likewise, Oklahoma native John Worthington, learned about the KRIRM program shortly after graduating from Oklahoma State University through a friend that had applied to the Institute. Worthington says his interest in KRIRM was piqued by the opportunity to learn from and network with professionals in the industry in a wide range of fields. He adds, “I also liked the format of the program and the projectbased learning approach taken by the Institute.”

For Scott Crozier, who was raised on a small family ranch in northeast Utah and northwest Colorado, his introduction to KRIRM came through attendance at a ranch horse symposium hosted by the Institute. While there he ran into Justin Staley, who had been Crozier’s supervisor years earlier during an internship at Sheridan, Wyoming-based AgReserve. Staley, a recent KRIRM grad, introduced Crozier to faculty member Rick Machen. Crozier appreciated the encouragement these individuals and others gave him to consider applying to the Institute, and shortly thereafter he felt the call to pursue a path to KRIRM.

He adds, “I’ve enjoyed interacting with Institute leadership and my fellow classmates. I appreciate the opportunity to surround myself with individuals who are passionate, driven, and want to become better each day.”

Internship Experiences Also valued by the KRIRM students was the opportunity to complete an internship in collaboration with a working ranch.

Young completed his internship on a cattle ranch in central Florida, where he appreciated being pushed out of his comfort zone, and notes, “cattle ranching in Florida is very different than in the western states.” His project consisted of working with the agronomy, cattle, and GIS departments to develop a plan and a financial analysis of pasture reclamation.

Young explains, “The ranch was experiencing loss of pasture productivity due to encroachment of invasive plants. I worked across the three ranch departments to create a standard operating procedure that identified the criteria for what qualified a pasture for renovation and what renovation would look like. The final part of the project included an internal rate of return on the identified pastures.”

“I was able to take what I had learned in the ‘classroom’ and apply it to a real ranch. It showed me that I can perform these tasks and be competent in doing so. I gained a lot of confidence from this experience,” Young concludes.

Today, as Crozier reflects he says, “I feel fortunate to be a part of it. The classwork has been important, but I especially enjoyed the networking through the lectureships and symposiums. Meeting people and hearing their stories, there are great opportunities to learn from that.”

Young counts the managerial finance course and projects as one of his favorite opportunities. He explains that the focus was on real-life scenarios that these individuals may face in their careers, and says, “It gave me the chance to see if I was able to approach the problem and come to a decision that has a financial justification that is accurate. The class created the learning opportunity of the classroom while providing the atmosphere of presenting to an executive board.”

Worthington has similar perspectives saying, “I’ve really enjoyed the symposiums/lectureships for the knowledge I’ve gained, as well as the networking opportunities that the events have provided. I’ve also enjoyed the opportunities to travel to ranches and visit with owners and managers. Learning different ways to approach problems and accomplish goals in diverse environments has been really interesting.”

KRIRM students appreciate the many opportunities to learn from ranch owners and managers while also visiting their operations.

was a financial analysis of various segments of the ranch.

Worthington says, “I gained a deeper understanding of company structures and the financial decision-making process that leads to profitability.”

Crozier interned at Vermejo Park Ranch owned by Turner Enterprises at Raton, New Mexico. His project analyzed evergreen encroachment rate through a series of 63 transects.

Then from data collected, treatment strategies with a focus on hydro-axing were evaluated, along with financial analysis.

Crozier came away from the experience noting, “While this project is at the beginning stages of a multi-year effort, it was neat to be involved at that benchmark level.” He adds, “While the project was complex, it was real and it’s rewarding to know they may take and apply your advice.”

What’s Next All three of these individuals are eager for their next steps as managers in the ranching industry. Young notes, “I want to work for a company or individual who values the heritage of ranching … I am excited to be a part of the industry at a time that I will have an opportunity to influence the survival of ranching.”

Crozier is seeking a role that offers a combination of managing cattle and horses and matches his passion for the industry. He notes, “People are going to eat beef, so the

ranching industry is not going anywhere. I’m excited for the future, but the ranching industry has to be prepared.” He points to consumers concerns related to animal welfare and sustainability, as well as the rising costs that producers face.

That said, he concludes, “It’s going to take a lot of business skills, transparency and innovation, but it’s needed.”

Worthington is interested in a management position that provides experience in various aspects of a ranching operation, and says, “I have a background in agriculture and wildlife management; I would enjoy a position that incorporates a wildlife conservation component into a production agriculture operation.”

Worthington concludes, “I’m excited about the opportunities that the ranching industry is offering to recruit and retain people interested in agriculture. We’ve seen connectivity and knowledge sharing drastically increase with the use of social media and other online platforms. People are interested in our stories and want to participate in the industry to continue the ranching heritage and legacy into the future.”

Shining a Lighton Solar Projects Considerations from a Ranch Perspective

I

n the last decade, there has been a substantial increase in the development of solar energy projects in the US, and much of the surge in development has occurred in areas that have a history of ranching as a primary land use.

Land managers often seek additional income streams and enterprises supported by their land assets, it is important to have a thorough decision-making process to ensure long-term value of the asset is sustained. While the decision to seek or secure a solar energy project ultimately depends on the specific needs, goals, and objectives of an individual entity, there are some important considerations common to a due diligence process. These include temporal, physical, financial, and liability components. As with many decisions facing ranch owners and managers, elements of each consideration may affect the others, and the overall decision should be considered from a systems perspective.

Temporal considerations Surface use agreements and energy (oil and gas) leases are familiar to many landowners. Renewable energy leases have similarities to more traditional surface agreements, but differ in some material ways. One difference is duration. A solar lease project typically has a minimum term of 20 years, and often these terms extend to 50 years. The duration of these agreements makes careful advance consideration very important – landowners will live with the decision for a long time after it is made. Solar lease agreement terms are often

divided into phases. The ‘development’ phase is the period from the initial lease through site development, construction, and installation of the solar equipment. The ‘operations’ phase commences when the installation comes online and begins power production. Because the operator is not generating power (nor income) during the development phase, a lower annual lease payment is offered, which increases during the operation phase. Unlike oil and gas development, which typically occurs relatively quickly, the development phase for a solar project can extend for long periods. Land managers should carefully consider the terms of the lease and the maximum duration of the development phase, as this can substantially alter the true value of the agreement.

Additionally, the operations phase may exist as a set term (e.g., 20 years) from the end of the development phase, and so the total length of the lease can be extended beyond expectation if the development phase is lengthy.

Physical Considerations The acreage required for solar installations varies with the specific type of installation and location. Use of 8 to 10 acres per 1 megawatt (MW) of generation capacity had been a ‘rule of thumb’ estimator, but improvements in solar technology have reduced the footprint, and current estimates are 2 to 5 acres per MW constructed. The cost of solar generation capacity has also decreased, with current estimates of $1 to $1.50 per Watt; or $1 million per MW. may include fewer total acres than oil and gas or wind leases, but there is an important difference in these projects.

In a typical oil and gas lease, the operating sites (drilling, production wells, and storage sites) occupy a small percentage of the total acreage. The same is true for wind installations.

This typically allows concurrent use of the surface with modest restrictions. For example, it is common for grazing to continue on most of the leased acreage, excluding only the footprint of the operating equipment. With solar installations; however, effectively 100% of the leased site will be utilized, and little or no opportunity for concurrent use exists.

This key difference in the use of the leased surface means that income from a solar lease ‘instead of ’ rather than ‘in addition to’ other land use, and access to and through the site will be restricted. It is important for land managers to consider the placement of the site so that it minimizes the interference with other operating activities, such as livestock movement, vehicular access, and the placement of easements and roads for site access. Easements may also be required for installation of substations and transmission lines that support the solar installation; proximity to existing infrastructure is often a determinant of site suitability.

While it is obvious that hunting and other access-based activities will be curtailed on the solar site itself, landowners must also consider possible restrictions on activities adjacent to the site. The solar developer may place restrictions in the lease directly, or, due to liabilities resulting from damage caused by adjacent activities, the landowner may be required or elect to limit those activities for some distance around the site. Hunting is an example where the activities of the landowner’s adjacent tenants (the hunters) may cause damage to the solar equipment (a bullet can do irreparable damage to solar panels). Solar leases often also contain ‘negative easements’ to prevent actions that limit or interfere with solar intercept – shading or blocking sunlight from reaching any portion of the site. This can limit adjacent timber production, 8 King Ranch® Institute for Ranch Management | Fall 2021

construction of buildings, or even activities that may generate significant dust, like materials extraction. This potential loss of use from the adjacent areas may also be an important consideration, and at least should be an element of lease negotiation.

Aesthetic value may also be an important consideration, especially regarding effects on adjacent acreage.

While vegetation buffers can be maintained around solar installations, there may still be some effect on the value of adjacent real estate. This should be considered in the total cost and benefit of the project to landowners.

The concentrated surface use by solar installations may also generate conflict with other interested parties. For example, mineral interests are often superior to surface interest, and the potential for conflict between a mineral interest with a right to produce from the site where solar equipment is to be installed must be considered. While this can likely be reasonably accommodated, it may be important to seek agreement on potential future mineral development sites and hold those out of the footprint of the solar installation.

Financial Considerations Due to the physical reality of ‘instead of ’ rather than ‘in addition to’ alternate land uses, the value of the solar lease should be considered net of losses in other income streams.

While the direct reductions due to grazing removal can be readily estimated, managers should consider how a reduced livestock inventory –assuming that some inventory reduction occurs to maintain acceptable stocking rates on the reduced available acreage – might affect the distribution of fixed costs of the operation. When the acreage represented by the solar lease is a small proportion of the total grazing acres, this effect may be negligible; however, if the solar lease represents a more substantial portion of the available acreage, the reduction in inventory and resultant escalation of fixed costs per animal remaining can make the livestock operation unsustainable.

The ‘uncovered’ fixed costs can be assigned to the solar project, representing an additional offset to the lease income.

Similarly, if hunting activity is affected beyond the boundaries of the installation, then the total reduction in hunting revenues must be considered against lease income, not just the direct reduction in acreage at a prevailing lease rate.

As with most surface use agreements, the landowner will likely require inclusion of a ‘restoration’ provision in the lease, where the solar operator is required to return the site

to its prior condition at termination of the lease agreement.

Landowners should consider the likelihood of achieving this objective, and the resultant impact of future land value as a part of the financial consideration.

In Texas, some material property taxation issues must also be considered. Land used for agriculture in Texas qualifies for a special valuation based on the land’s productive value rather than its market value, and this difference in valuation and assessment can be substantial. Once the property is no longer used primarily for the purpose that qualified it for the special use valuation, the landowner may be liable for a 3-year rollback tax (the difference between the market value and the special use value assessment) plus interest. The land will be taxed at market value going forward for the duration of the solar project life. Even if the project is terminated and the land reclaimed, it will take at least 5 years for the landowner to regain the special valuation, during which the property is taxed at market value. It is important for landowners to be aware of this liability and to include mitigating provisions in the lease agreement.

Overall, the present value of the land considering the current income stream and projected appreciation should be

compared to a present valuation under the solar lease over a realistic life, considering the duration of the development and operations periods and payments, future land value, and tax liabilities to generate an objective comparison of the total net value of the project.

Conclusion Entering into a solar lease agreement is a generational decision. It is important that a framework for decision making that considers multiple impacts be developed, and that the physical and financial elements be jointly considered. It is useful to use a comparison of present values under a realistic ‘business as usual’ scenario and the solar lease scenario, to best illustrate the relative value of the solar lease over its long lifetime. Due to the complexity of lease agreements and the importance of terms in shaping the key considerations, landowners should engage appropriate counsel to aid in developing the specifics of the decision framework.

This framework allows landowners to consider effects of this change in land use on the entire system, and to make the best decision for their specific conditions and circumstances.

In addition to Dave’s experience at King Ranch, he worked at the third largest cattle feeding entity in the United States, Friona Industries, L.P. from 1992-2003, serving as General Manager between 1996 and 2003. Prior to that role, he was the Operations and Procurement Manager of Corsino Cattle Company of Amarillo, Texas.

Dave DeLaney earned a B.S in Biology from the University of Richmond and a M.S. in Animal Nutrition from Texas A&M University.

In 2021, Dave was awarded an Honorary Doctorate from Texas A&M UniversityKingsville. DeLaney has served on the Board of Directors for the Texas Cattle Feeders Association (TCFA), the National Cattleman’s Beef Association, and the Texas Southwestern Cattle Raisers Association (TSCRA). Beyond that, he has served on the Executive Committee of Texas Wildlife Association, TSCRA, and TCFA. Dave DeLaney is among the most recognized international experts in ranching.

he King Ranch® Institute for Ranch Management (KRIRM) is excited to offer this year’s hybrid symposium Oct. 27-28, 2022, titled “Ranching in the 21st Century: Learn Proven Strategies from Industry Leaders”. The 19th Annual HOLT CAT® Symposium on Excellence in Ranch Management will be delivered simultaneously in Kingsville, Texas, and online.

When creating a successful enterprise there is no silver bullet to getting it done. There are a multitude of variables that determine the decisions that need to be made. However, after looking at the philosophical approach and strategies, you start to see a common mindset amongst management of the most successful ranches, both large and small. With the experienced slate of ranch owners and managers presenting at this symposium, attendees will take away ideas and examples straight from the best minds in the industry.

The symposium will kick off with Derrell Peel, PhD and Professor of Agribusiness at Oklahoma State University.

Dr. Peel’s presentation will identify key trends in the everchanging market. Peel will share his insights on the future challenges and opportunities of the ranching industry, with special focus on the beef supply chain.

Following Peel’s presentation will be Clint Richardson, General Manager of Deseret Cattle and Citrus, and Shelby Horn, Vice President and General Manager of Abell Livestock. “What is your business?” It’s a simple question

Richardson will share his perspective on the land business in relation to the business enterprise the land supports. Horn will then discuss the opportunistic mindset and approach to finding, evaluating, and implementing less traditional ranching enterprises.

The day will conclude with Dale Smith giving us his approach to managing the JA, Excell, Turkey Track, and RO Ranches. Smith will discuss his philosophy on land, business, management, and risk as he describes one of the most innovative models of ranching success in North America.

Day 2 of the symposium will encompass the characteristics of success and will begin with Tom Field, PhD, Executive Director of the Engler Institute for Agriculture Entrepreneurship at University of Nebraska-Lincoln. Gary Price, owner and manager of 77 Ranch, and Sage Askin, owner and manager of Askin Land and Livestock, will provide proven strategies that have worked for their operations. Not all landowners have a large amount of acreage to operate, and Price will discuss how to find profit on those mid-sized

ranching operations. Askin will follow up with his take on how to build a successful ranching operation from scratch.

The last two presentations of the day will provide attendees with the personal success stories of James Sewell, General Manager of TA Ranches, and John Maddux, Owner and Manager of Maddux Cattle Company. Sewell will explain how he adapted TA Ranch operations into the successful enterprise it is today. Maddux will follow up with his perspective and unique story of the evolution of Maddux Cattle Company after working on Wall Street for 12 years.

Registration for symposium is $150 and includes entrance to an industry trade show, an evening social and dinner where the 2022 Texas Farm Credit Certificate in Advanced Ranch Management recipients will be recognized, and an in-depth tour of King Ranch.

Introducing Anne Thurwalker Associate Director of Development for KRIRM

W

e are pleased to announce the addition of Anne Thurwalker as the new Associate Director of Development for KRIRM in conjunction with the Office of Institutional Advancement. Anne has had a successful career serving in a development role for several organizations, including the Caesar Kleberg Wildlife Research Institute at Texas A&M University-Kingsville.

Anne is also no stranger to the ranching and agricultural industries. She is a fifth-generation farmer and a fourthgeneration cattle rancher. She and her husband, who also works in agribusiness, continue to operate a small Brangus enterprise in Hebbronville, Texas.

She says, “I was very fortunate to be born into two families who loved Texas and loved the land. They spent their lives

investing in it through raising crops and cattle. The values and ideals they held about the purpose and importance of agriculture are deeply ingrained in me. The work that KRIRM is doing is not only important to me, but also vital in sustaining our ranching heritage. KRIRM is a world-class organization and has a tremendous reputation in the industry.

I am honored to be part of this team and look forward to sharing my experience in development to expand the program.”

Anne and her husband Sam have two children. When they aren’t busy with school activities, they enjoy time at the ranch and all that living on the Texas Coast has to offer.
