WAITING ON THE STATE New permits agreement is on the horizon as contractors seek answers ALEX RICKERT alex@keysweekly.com

ontractors were notably present in Marathon City Hall for the city council’s May 10 meeting, eager for an update on the progress made by the city in its negotiations with the Florida Department of Economic Opportunity (DEO) to adopt a new Memorandum of Understanding (MOU) and shorten wait times for permits. The response they heard was largely the same as the month before: wait for the state. The new memorandum, which dictates the development orders (permits) sent to DEO for review, became a necessity following the state’s revocation of the previous MOU, in place since 2005. On Feb. 25, the DEO issued a Notice of Violation concerning a development at the end of 39th Street in Marathon, commonly known as the Boatworks project. Though the Boatworks project had obtained a conditional use permit for the site, the state appealed a revision to the development agreement that allowed previous live-aboard units to become upland residential units when determining the number of market rate units allowed. DEO then contended that the city’s decision to issue building permits for four units in the project during the pending appeal violated the appeals process. At its March 8 meeting, the city council adopted a resolution to replace the old MOU. The modified MOU was sent to DEO for review and approval, but instead of signing the version drafted by the city, the state sent back a further revised version more than four weeks later on April 8. Four days later, the city council unanimously adopted the state’s draft of the MOU at its April 12 meeting and sent it back to the state for final approval and enactment. Intending to streamline the permitting process between the city and state, Marathon planning director Brian Shea also suggested improvements to the language in the

new MOU draft specifying the types of permits that should be rendered to the state. One such example: under the state’s April draft of the MOU, all subsequent permits for properties receiving a conditional use permit would require review by the state, including typical repairs to electrical, plumbing and air conditioning systems throughout the life of the building. The city’s hope was that future clarifications of the day-to-day workings of the MOU could be addressed in subsequent additions or revisions to the approved document, but that the state’s draft unanimously approved by the city council in April would take effect quickly. DEO declined to sign the version of the MOU approved by the council, opting instead to send back a revised copy on May 5 with further provisions specifying the types of permits that should be sent to the state department. “What you have before you is something that I believe should be signed this week by DEO, regardless of the length of time it took us to get to this point,” said city manager George Garrett on Tuesday night, while noting that city staff still believes the new MOU needs eventual revision to work effectively for both parties. “The state has committed to come down here and work with us on this subject, and we are committed to going up there to work with them in the near future,” he added. Placing approval of the MOU’s most recent stateauthored draft on its consent agenda, the city council unanimously voted to approve the memorandum and send it to the state once more for final approval. onroe County and the city of Key West soon could be trading some spaces. When county commissioners meet on Wednesday, May 18 in Key West, they’ll discuss a potential swap of the county-owned Higgs Beach for part of the city-owned HAWK Missile site off Government Road. “It doesn’t make much sense for the county to own a beach in the heart of the city,” said County Commissioner Craig Cates, who’s been working with Key West City Manager Patti McLauchlin on the preliminary plans. McLauchlin told the Keys Weekly she’s long had a vision for the whole Higgs Beach area, from the Indigenous Park and Knight Pier to the dog park, beach and playground. Additional agreements could include the city’s use of the countyowned Bayshore Manor property to temporarily house homeless people while the city rebuilds its shelter. ALSO ON MAY 18… • Commissioner Jim Scholl‘s swearing-in ceremony. Scholl, a former Key West city manager and commander of Naval Air Station Key West, was appointed by Gov. Ron DeSantis to fill the seat of Eddie Martinez, who resigned in December, until the November election. Scholl has already filed paperwork to run for the seat in November. • Commissioner David Rice has requested an update on the Poinciana Gardens assisted-living facility, which has a new management team in place and received a financial

reprieve last year from the county and the city of Key West. • Officials will discuss a “resolution establishing the Monroe County Employee Housing Rental Program for residential units owned by the county,” states the May 18 agenda. • Another item includes a lease renewal for a county employee already living in a county-owned property and paying $550 per month. • A $99,000/year contract with Kisinger Campo & Associates will be considered for “pedestrian bridge inspection services.” It remains to be seen whether this contract relates to the historic pedestrian railway bridges that line U.S. 1. There are 23 such bridges and seven are currently closed due to partial collapses and safety concerns. The county commission meets at 9 a.m. on Wednesday, May 18 at the Harvey Government Center in Key West. A complete agenda is available at monroecounty-fl.gov.

permits for new buildings or expansion of the footprint of an existing structure; transfers of ROGO exemptions, building rights and development rights; variances from the city’s land development code; construction of new marinas; accessory use permits including pools and tiki huts; marina construction; and dredging, among other listed development orders. According to a table attached to the new draft, less significant permits, including those for electrical and plumbing work, fire alarms and suppression systems, fencing, irrigation, sewer connections, solar work, roofing, and window and door replacement, among others, would no longer make their way to the state. According to the same table, renovation or remodeling permits would still require review. Until the agreement is signed, however, the continued extended wait times are now causing financial strains on contractors and, in some cases, an inability to respond to safety concerns. Derrick Lazzara and Charlie Brown are the president and vice president, respectively, of the Florida Keys Contractors’ Association. According to the pair, what initially began as a “mild annoyance” is now “ridiculous.” “It’s starting to affect employees, because jobs are supposed to be happening,” said Lazzara. Brown added that while he is not yet aware of any contractors who have laid off employees due to the sluggish permitting process, it’s “a possibility that’s going to get here quick.” Though new builds are also affected, Lazzara and Brown specifically cited multiple contractors’ concerns with extended timelines for routine service repairs and minor projects within existing structures, adding compliments for a permitting process that was moving “much smoother” under building official Noe Martinez before the MOU was revoked. “If I turned in a repair permit and marked it ‘emergency,’ I usually had it back between 24 and 48 hours, sometimes even the same day,” said Brown. As of now, time-sensitive repairs from air conditioning units to unsafe decks and electrical meters could be staring down a wait period of more than two months. Under the previous MOU, permits issued by the city but not sent to the state would have a 30-day appeal period before the project could receive a final inspection. However, complications with already-issued permits were rare, and most contractors would commence work immediately upon issuance.

“There’s always a little something saying you have 30 days, but most people down here don’t even know that exists,” said Brown. New drafts of the MOU, however, specifically state that “no development order issued by the City shall take effect or be acted upon by any developer until the city’s applicable appeal period has expired.” For permits sent to the state, the same rule applies until the state’s 45-day review period expires, the state waives its right to appeal, or any ongoing appeal has concluded. Combined with extended review periods, the inability to move forward with permitted projects for up to 75 days has tempted several companies to forgo the process entirely. “There’s a lot of people thinking the same thing,” one contractor who declined to be named told Keys Weekly. “Why bother putting in for a permit just so I go out of business waiting?” Lazzara and Brown credited Garrett for his willingness to keep in contact throughout the MOU’s revisions. However, with nearly three months since the original agreement was revoked, contractors are looking for more than an explanation of the city’s constant dialogue with DEO. And even with questions about the circumstances that led to the Notice of Violation and subsequent termination of the MOU, their focus is on moving forward. “It’s not a matter of being frustrated with the city or how we got here,” said Brown. “It’s a frustration from not moving forward. … We’re still stuck in this purgatory.” “We’re starting to question, what’s the problem?” said Lazzara. “Why is this dragging on so long? … Now you are actually messing with people’s livelihood and businesses. Employees are at risk, everything. It’s just not worth it.”

he partial collapse a month ago of the historic Shark Channel fishing bridge at MM 11 prompted officials to permanently close the bridge, along with six other relics of Henry Flagler’s Overseas Railway that line U.S. 1. “Currently, seven bridges along the Overseas Heritage Trail are closed for safety purposes. The Niles Channel Bridge was closed in 2011 and South Pine Channel Bridge was closed in 2012. The Ohio-Missouri, Ohio-Bahia Honda, Missouri-Little Duck and Lower Sugarloaf were closed in 2014. In April 2022, to ensure the safety of our visitors, DEP closed the Shark Key Bridge along the Florida Keys Overseas Heritage Trail,” Erin McDade, deputy press secretary for FDEP, told the Keys Weekly in a May 5 email. “These seven bridges are closed to all pedestrian and recreation activities, and boaters in the area should exercise caution when nearby. All visitors are asked to adhere to posted signage and respect the barricades. DEP will coordinate with the Florida Department of Transportation to determine the next steps for the closed bridges

along the Overseas Heritage Trail. Visitor safety is our priority as we determine the path forward. We apologize for any inconvenience and will provide updates on the trail’s webpage as they become available.” The Florida Keys Overseas Heritage Trail is designed to provide an alternative bicycle and pedestrian route down the Florida Keys. The trail includes 23 historic railway bridges, seven of which are now closed. The Keys Weekly first reported the partial collapse and closure of the Shark Channel Bridge on April 15, and requested copies of inspection and maintenance reports from the Florida Department of Environmental Protection, which manages the 23 historic pedestrian bridges that are part of the Florida Keys Overseas Heritage Trail. “We’re working on compiling the inspection reports you requested,” McDade told the Keys Weekly on May 5. “The bridges are part of Henry Flagler’s Florida East Coast Railway built around the turn of the century. At more than 100 years old, the bridges are no longer used for transportation purposes; however, they are continually evaluated for safety concerns.”

t its meeting on May 3 and 4 in Gainesville, the Florida Fish and Wildlife Conservation Commission (FWC) approved a number of immediate and potential rule changes for species commonly harvested both recreationally and commercially in the Florida Keys. A rule change for recreationally harvested dolphinfish (mahi-mahi) approved at the March FWC meeting also took effect on May 1. A summary of the rule changes for each species is listed here. For reference purposes, state waters refer to the area from shore to three nautical miles on the Atlantic side of the Keys, and from shore to nine nautical miles on the Gulf side. More information regarding fishing regulations is at MyFWC.com/marine. Alternatively, the Fish Rules app uses an angler’s phone’s GPS to track his or her current location and provide the appropriate regulations in real time. Dolphinfish (mahi-mahi) Effective May 1, the recreational bag limit has been reduced from 10 to 5 fish per person in Atlantic state waters. The private recreational vessel limit has been reduced from 60 to 30 fish per vessel in Atlantic state waters. Blueline Tilefish The 2022 recreational blueline tilefish season will be temporarily modified. Typically open from May 1 through Aug. 31 in Atlantic state and federal waters, the recreational season will close early in state waters this year on July 26. The shortened season matches the season recently announced by NOAA for federal waters and is intended to prevent overfishing over the course of the 2022 season.

Cobia A number of changes to cobia regulations for recreational and commercial anglers will take effect July 1. The minimum size limit will increase from 33 to 36 inches (measured by fork length) for all state waters. The commercial bag limit will be reduced from two to one fish per harvester per day in Atlantic state waters, and both the recreational and commercial vessel limit will be reduced from six to two fish per vessel per day in Atlantic state waters. The changes are intended to match pending regulations in the Gulf of Mexico and Atlantic federal waters and were deemed necessary after a recent stock assessment determined that the cobia stock is being overfished. Redfish FWC granted initial approval for changes in management regions and regulations for redfish in state waters. Under the proposed changes, the Florida Keys would fall under the Southwest management region, which would see the current eight-fish vessel limit reduced to two fish. Captains and crew would be prohibited from retaining a bag limit while on a for-hire trip, and the off-the-water transport limit would be reduced from six to four fish per person. “With this new management approach, this agency is committed to continuing to work with our partners and stakeholders in finding solutions for redfish,” said FWC chairman Rodney Barreto. A final rule hearing will be held later this year after FWC staff continue to gather input on the proposed rule changes.

ATTRACTING & RETAINING TEACHERS SCHOOL’S NEW RESOURCE GUIDE TO ASSIST THE HOME SEARCH

strategic plan is in the works for the Monroe County School District. Recruiting and retaining a workforce, as well as maintaining a safe environment on school grounds, were among the items discussed during a May 10 school board gathering at Coral Shores High School. Elisa Levy, strategic planning consultant, said focus group meetings show many teachers relaying a need to live in the Keys. Financially, that’s becoming a challenge due to a hot housing market and a lack of workforce housing. “We understand what the need is here and the gravity of the situation,” Levy said as she unveiled a list of goals and strategies, which included developing workforce housing. “You’re already working on Trumbo, which would be useful probably all the way up to Marathon.” The school district is seeking to develop its administrative headquarters property on Trumbo Road in Key West. The 5.9-acre property is adjacent to the Lang Milian public housing complex that is also ripe for renewal. Included in one company’s proposal for Trumbo Road are 76 rental apartments, a new two-story, 20,000-square-foot administrative building, and 1.27 acres of green space. Levy said focus groups also discussed the fact that many new teachers are overwhelmed when it comes to finding a place to live. A housing resource guide and a point person teachers could call for assistance were among the possible activities the district could do. Later in the meeting, Henry Russell, executive director of personnel and instructional leadership, told school board members that a new employee resource guide is out to assist school employees with housing options. Russell said School Superintendent Theresa Axford told him the district needed to come up with a resource tool for new and current employees with information on the local housing market. Russell said the district felt it could create a tool to give employees that could identify and locate potential places to live. The guide starts with a welcome message from the superintendent and fun facts about the Keys before going into a list of housing options from the Lower Keys and Upper Keys, as well as Florida City and

Homestead, since a number of teachers and employees live on the mainland. Russell said they’ve captured the current housing availability in the Keys. “This is a tool that’s being developed, so as we are made aware of more and more opportunities in our communities, we will continue to add and update this document,” he said. Russell added that he sent letters to real estate agents throughout the Keys and local chambers of commerce to let them know they were creating a housing guide. In addition, the resource guide includes a variety of child care services from the Lower Keys to Upper Keys, as well as information about hospitals, DMVs, internet services and local utilities. The resource guide is on the district’s website under the employment and human resources tabs. Among the other strategies Levy unveiled that the district could employ to attract and retain teachers and staff are expanding an employee recognition program and identifying exit trends beyond income and housing. Increasing staff compensation and financial support, such as free after school care and increased longevity bonuses were also listed as possible things the district could look into. As for safety, Levy said the goal is creating and maintaining safe, healthy and inclusive environments that foster students’ mental and physical health. Strategies within a list unveiled by Levy included increasing security in school hallways and bathrooms to prevent vaping and vandalism. “Two years ago we weren’t talking about vaping. This year it has exploded according to (school resource officers),” Levy said. Preventing bullying on and off campus and ensuring consistent implementation of student attendance were other strategies outlined in Levy’s presentation. A workshop with principals on the strategic plan is set for Thursday, May 19 and Tuesday, May 24. Principals will take the plan to teachers by the end of the school year. Levy said a final strategic plan draft will be presented to school board members during a retreat on June 14. The plan could be finalized by August.

In other news, the school board heard a report on the legislative session in Tallahassee from state Rep. Jim Mooney. A number of K-12 education bills passed through the legislature, including one that requires high school students to take a financial literacy course before graduating. “I’ve said this since 1973 when I started teaching: we’re not teaching kids how to balance a checkbook. We teach them a lot of great stuff, but we don’t teach them a lot of stuff that really matters to their lives at the end of the day,” Mooney said. He also highlighted House Bill 1421 that improves school safety, security and transparency and refines plans for drills and reuniting families. House Bill 1467 improves the transparency around selecting library materials and establishes 12-year term limits for school boards. “They tried to get eight (years) passed,” Mooney said. He also delved into House Bill 1557, the parental rights bill. He said he voted against the bill after a tremendous amount of soul searching, reading and figuring out why the bill was as “vague as it was written.” In his statements to the board, Mooney said he takes pride in reading bills from beginning to end multiple times and discussing it with leadership and the bill sponsor. He said the vagueness in the bill “was too much for me.” “I looked and thought to myself, we don’t teach sex ed to K-3 anyway in Florda. It’s not in our curriculum, period,” he said. “Terms like inappropriate, those are very vague terms. I can tell you coming out of local government, ordinances I’ve been involved with that were vague ultimately allowed attorneys to feast. “Putting the school board and teachers in peril of lawsuits, and they don’t have to be definite, that’s the hard part of understanding why things can go sideways,” he continued. “It takes someone who thinks something is inappropriate. Therefore, the school board becomes the punching bag.” The next school board meeting is set for Tuesday, June 14 at 5 p.m. at Key West City Hall.

hase Taylor has always been a fan of serving others around him. With a new career in the United States Coast Guard, he’ll do that in more ways than one. A 2021 graduate of Marathon High School, Taylor completed an eight-week boot camp in company Z201 at the Coast Guard Training Center Cape May on May 6. Within a week, he’ll ship out to Petaluma, California for a 2021 MHS graduate Chase Taylor will pursue a career in 14-week training course to the Coast Guard as a Culinary become a Culinary Specialist. Chase is no stranger to the culinary or public service fields, traveling throughout Florida during his high school career for culinary competitions with MHS’ Chef Flavor and spending nearly 250 hours per year as an Explorer cadet with the Monroe County Sheriff’s Office. “He’s always been about the service of others and dedicated to being there for them,” said his mother, Sherrie Taylor. Though Chase’s training will take him across the country, the eventual goal will always be to return to the weather and the waters he knows best. “We always knew he wanted to be back in the Keys,” said Sherrie. “That’s exactly what he’s aiming for. … He’s definitely a hometown boy, and he’s gone through this so that he can come back down here to serve.” Chase credits his family as well as company commanders SK2 Midgett, DC2 Barnes and MK2 Pacheco for supporting him and helping him adjust to the expectations and lifestyle of a Coast Guardsman. MOTHER’S DAY ISN’T FOR EVERYONE LOCAL MOM RAISES AWARENESS OF PARENTAL ALIENATION

illions of moms spent Mother’s Day immersed in lopsided hearts drawn, homemade cards and breakfast in bed. But others spent the day avoiding social media for its onslaught of sentimentality, as well as every pink-hued, retail reminder of mothers lost and the ache of their absence. Women unable to have children feel a heavier emptiness in their arms the second Sunday in May. And mothers who have buried a son or daughter are overwhelmed by the loss of the child that was taken from them. Still others have never had a mom worthy of celebration. The holiday also means heartache and helplessness for mothers who have lost contact and connection with a child due to parental alienation. What’s parental alienation? “Parental alienation occurs when a trusted adult, usually a parent, intentionally displays to the child unjustified negativity aimed at the other parent,” child psychiatrist Richard Gardner wrote in 1998. "The purpose of this strategy is to damage the child’s relationship with the other parent and to turn the child’s emotions against that other parent. …Children, programmed by the allegedly ‘loved’ parent, embark upon a campaign of denigration of the allegedly ‘hated’ parent,... a campaign that is encouraged by the other parent.” The power of a parent to motivate or manipulate a child is profound, and often weaponized following bitter break-ups and custody battles. The manipulative tactic can lead a child to vehemently disparage the targeted parent, in effort to win approval from the "good" parent. The child may also sever all contact with the targeted parent, often in violation of visitation and shared custody agreements. Experts are careful to emphasize that parental alienation “can only be applicable when the ‘hated’ parent has not abused or neglected the child or exhibited any behavior that would justify the child’s animosity,” states a report from the National Center for State Courts. Prevalence of parental alienation An estimated 11% to 15% of divorce and separation of couples with children feature some degree of parental alienation. Not all cases are severe or permanent, but no attempts at alienation can be overlooked or dismissed as inconsequential, states a 2021 article by forensic psychologist

Ian Blotcky and psychiatrist Dr. William Bernet. Child psychologist and parental alienation expert Richard Warshak agrees. “The existence of parents who effectively teach their children to hate the other parent, and of children who absorb this lesson, is beyond dispute,” says Warshak. Impacts of parental alienation “Children alienated by one parent have little if anything positive to say about the rejected parent and often rewrite the history of their relationship to obscure or ignore any happy memories,” Warshak writes. “They seem content to avoid all contact with the parent, may reject an entire branch of their extended family, and often threaten to defy court orders for contact with the rejected parent.” The offending parent uses his or her influence to make the child believe falsehoods about the targeted parent: She doesn’t love you; he doesn’t want you; she abandoned both of us; we only have each other now; he’s an alcoholic; she’s mentally ill; he has new kids with his new wife; she’s a drug addict; he’s abusive; you don’t have to go see her; he just wants to make trouble for us; you don’t need her; at least you still have one parent who loves you. “A parent who corrupts reality and teaches a child to hate the other parent represents a grave danger to the child’s mental health,” Blotcky and Bernet write. “The consequences of severe parental alienation on children are well-documented: low self-esteem, self-hatred, depression, anxiety, lack of trust in others, substance abuse and more. Rejected parents struggle with depression and anxiety due to being demonized and actively excluded from their children’s lives.” Raising awareness “Alienating behaviors by a parent are often hidden and ferociously denied, so much so that the offending parent casts himself or herself as the victim rather than the aggressor,” write Blotcky and Bernet. Fortunately, they said, an increasing number of family court judges, child advocates, mental health professionals, attorneys and social workers are becoming aware of and alert to parental alienation, the power of a parent’s influence and the long-term consequences of such manipulation. “Parental alienation is illegal in five countries, but it’s not officially recognized by the U.S. family court system,” said Jenn Stefanacci Portier, a Key West mother and business owner who became an outspoken opponent of parental alienation after

becoming estranged from her 11-year-old son about a year ago, despite sharing custody with his father. “The system is flawed, antiquated and in need of education and reform to protect the children of PA. The effects are generational.” Victims and opponents of parental alienation — adults who were deceived as kids, the parents they discarded, vigilant judges, mental health professionals, court mediators and custody advocates — join forces each year on April 25 for Parental Alienation Awareness Day. The day is meant to find solutions, spread information and expose the devastating power that one parent can have over a child’s beliefs, relationships and future. Stefanacci Portier and her husband, Grant, spent April 25 walking 11.4 miles around Key West in honor of the 11.4-year-old son she’s desperate to reconnect with. Born in Key West, her son moved with his father to mainland Florida in August 2020, when he was 9. “I agreed to shared custody, visitation and a parenting plan rather than force my 9-year-old son to testify on the stand in court,” Portier said. “I wouldn’t put him through that.” Portier said her son suddenly started refusing all contact with her a year ago despite prior months of daily calls and texts, weekend visits and baseball games on the mainland. “For a while, I believed only a few were going through this nightmare and even fewer understood it,” said Stefanacci Portier posted on Facebook after attending a Parental Alienation retreat last month in Jacksonville. “The fact that there was even a need for a parental alienation retreat means this is way bigger and affects way more families then we imagined. Over the past year, I have slowly spoken out about PA. I was afraid of retribution and embarrassed to explain my situation.” She remains committed to reconnecting with her child and is exploring her options, after years of custody hearings and six-figure legal bills, she said. “For generations, everyone has known the mom always gets the kids. So when a kid doesn’t live with the mom, people just automatically assume she did something egregiously wrong,” she said. “It’s the complete opposite with alienated parents. I fall into that category, but so few people truly understand what goes on with it.”

large section of beach, as well as the tent camping sites, at the popular Bahia Honda State Park near Big Pine Key have been closed since Hurricane Irma in September 2017. But Park Manager Mark Duncan called the Keys Weekly last week to let us know the Sandspur Beach area has officially reopened for daytime use. “The tent camping area will be next to reopen and we’ll start taking reservations for those spots in the coming weeks,” Duncan said, adding that the park’s cabins on the bayside have been open, but the tent camping sites, which typically have a waitlist several months long, will be a welcome return. Restoration of the state park still continues, but the reopening of Sandspur Beach is a huge postIrma milestone, Duncan said.

The other popular stretch of beach, Loggerhead Beach, reopened in 2018, a year after the storm, park officials said. “After the storm passed, volunteers and staff came together to remove debris, clear paths and begin the long road to recovery. Restoration efforts are still taking place to restore the beloved park,” states the Florida State Parks website. “After the storm passed, biologists determined which park ecosystems had suffered significant damage and how that would affect native plant species. Biologists then created a plan to restore these hurricane-damaged habitats. Hurricane Irma was not the first storm to hit Bahia Honda, nor will it be the last. But what is notable is that each time, people from all over the state come together to rebuild and renew the park which they hold so dear. The projects that have taken place here are a true testament to the spirit of resilience and perseverance that shines brightly at Bahia Honda State Park.”

t’s midnight on the streets of Marathon, and a little red car is making its way to every mural, statue and landmark on the island. As the car leaves, the occupants seem to have left their surroundings completely unchanged. However, in the virtual world of Pokémon GO, Marathon’s Midnight Marauders, Tom and Jackie O’Neil, have left their mark. The augmented reality app merges the real world with the incredibly popular Pokémon franchise. After choosing one of three teams to join, the game uses a phone’s GPS to track players as they move in real time, offering them chances to catch Pokémon, interact with other players, collect supplies, and even challenge others for supremacy in battle hotspots known as gyms. Launched in 2016, the game became a social media phenomenon as players took to the streets (literally) in a quest to catch ’em all. Tom and Jackie have lived in the Keys since 2003; they began playing the game almost immediately when it became an instant hit at launch. Jackie is well-known for playing a unique set of 20 to 40 songs, from ’70s hits to Scottish music, before each show at the Marathon Community Theatre, and said her friends there first tipped her off to the game. “I started not too long after, because a

couple people that I knew from the theater started and showed it to me,” she said. “Tom started playing Pokémon a month later because he kept hearing me talk about it. I was like, ‘You should play with me, so we can both be the same team and all!’” Now, Jackie and Tom have nearly caught them all, with almost 730 different Pokémon found. The pair are night owls, and they found that 2 a.m. was an excellent time to go catch Pokémon and win battles at gyms while their opponents around town were sleeping. However, over the years, the game has changed for the O’Neils. “It’s really not the same as it was,” said Jackie, recalling the community aspect that drew her to the game in the first place. “When we first started playing, the first two years or more, when there was something big to take down, like a Legendary Pokémon at a gym, somebody would put out the word and we’d all go. There would be all these cars there, and everyone’s children and dogs. And then COVID came and ended that. … Everyone would jump in their car and go someplace, then go ‘OK, let’s go to the next one!’ and a whole caravan of cars would go.” “We’d even have people bringing brownies and other food,” added Tom. “We had parties and a half.” Recently the O'Neils have been putting aside the “midnight” in Midnight Marauders in favor of walking around Crane Point with its many Pokémon hotspots. Approaching a Pokémon GO gym, Tom counted down

for Jackie to join in and defeat a newcomer, and in 15 seconds Tom and Jackie had won the battle for their team, the yellow “Team Instinct.” The O’Neils combined their hunt for Pokémon with a search for real life animals, complete with names like Red the snake and Twofer the green heron. The couple are true animal lovers, as evidenced by the fauna that form the highlights of their travel stories. Having visited all seven continents, they had stories about everything from penguins to moose. Asked about their favorite travel destination, both listed Kenya. “I remember one night hearing this sound of breathing coming from the bathroom, and when I went to look, there were zebras right outside,” said Jackie While a walk in Marathon will result in more raccoon sightings than zebra, the O’Neils’ enthusiasm for wildlife, virtual and real, is contagious. And if you play Pokémon GO, look out for those Midnight Marauders.

s water levels continue to plunge at alarming rates in drought-stricken areas of the western U.S., strange discoveries are occurring around Lake Mead just outside of Las Vegas. Most notably, water levels have dropped so low that barrels containing human remains are being discovered on a daily basis. he spring football game is less than a week away. Every year, schools throughout Florida participate in a spring game after hosting 20 team practices. This year, the Dolphins will take on Palm Glades Prep in a home contest on Wednesday, May 18 at 6 p.m. The purpose of the spring game is to introduce potential new players to the sport. It gives young athletes an opportunity to get a feel for what the fall team will be like before diving head first into a long season. “The spring season is much shorter and less intense compared to the fall season, which is all grind,” said head coach Mac Childress. This spring, about 50 players originally came out to play. However, the heat and constant physical impact aren't for everyone, so the team is currently sitting at about 40 committed players. “We’re really happy with this number,” said Childress. “It's about

double the players we ended up with last fall.” He believes the current roster will follow through when the regular season resumes in the fall. Assisting Childress are coaches Sean Roussin, Sean McDonald, Carl Stanton, Chris Flingos and Andre Garvey. “When coaching a team, you want the best people to surround you, both on and off the field,” Mac said. “I am lucky to have a group that is always pumped and ready to put in the work.” With several returning veterans and a larger program, the coaching staff will look to change up their practice plan this spring, breaking the team down into smaller groups to give players more individual reps and improve the roster from top to bottom. In their last matchup with Palm Glades in 2021, Marathon earned a 7-0 win. The Fins will use the upcoming game as a way to judge their improvement as well as an indicator of team weaknesses to target before the regular season kicks off in August.

Forty boats carrying 156 anglers headed offshore in the hopes of tipping the scales at the evening weigh-in at Curly’s Coffee and Marina before enjoying an awards banquet at Key Colony Inn. The tournament netted an impressive $65,000 for Habitat for Humanity of the Middle Keys, which will be used for the organization’s new affordable homes development in Marathon. A

51-foot sperm whale was the last thing one expected to see on the morning of May 11, laid out in the gravel parking lot of Robbie’s Marina on Stock Island. There it was. A striking but sad sight, with a mouth of biblical proportions. The male sperm whale was found on May 10, beached on the northeast side of the Mud Keys about eight miles offshore of Key West. “We got a call from the marine sanctuary about it (Tuesday), and went out at high tide last night, around 8:30 p.m. and towed it in, arriving at Robbie’s around 3:30 a.m.,” said Sean Morley, owner of TowboatUS in Key West and Key West Harbor Services. “Fortunately, Robbie’s allowed us to bring it in here so biologists can do their work to determine its cause of death.” Biologists from Florida Fish & Wildlife Conservation Commission (FWC), and experts from marine mammal stranding groups and the Florida Keys National Marine Sanctuary, quickly got to work, making large incisions in the rough skin of the whale to determine its cause of death through a process called a necropsy, which is similar to an autopsy that’s performed on humans. “We really won’t know anything further about what happened until later tonight or tomorrow,” FWC officials told the Keys Weekly on the morning of May 11 at the marina, adding that they are looking into unconfirmed reports of a pod of sperm whales possibly being in the area in recent days. a juvenile sperm whale was sighted off the Upper Keys earlier in the week. Investigations continue into any potential correlations, FWC officers said. Sperm whales are the largest of the toothed whales and have one of the widest global distributions of any marine mammal species, according to the National Oceanic and Atmospheric Administration (NOAA). “They are found in all deep oceans, from the equator to the edge of the pack ice in the Arctic and Antarctic,” the agency says. “They are named after the waxy substance — spermaceti — found in their heads. The spermaceti is an oil sac that helps the whales focus sound. Spermaceti was used in oil lamps, lubricants and candles. “Sperm whales were a primary target of the commercial whaling industry from 1800 to 1987, which nearly decimated all sperm whale populations. The International Whaling Commission placed a moratorium on commercial whaling in 1986. The species is still recovering, and its numbers are likely increasing. The sperm whale is listed as endangered under the Endangered Species Act and depleted under the Marine Mammal Protection Act,” states the NOAA Fisheries website.

Marathon Mermaid Charters turned a dream into a custom-built reality ALEX RICKERT alex@keysweekly.com

F

or most, the phrase “do it yourself” might refer to painting a room, doing some light landscaping, or maybe even some minor auto repairs and maintenance. For Angela Tizzano and John Strama, owners of Marathon Mermaid Charters, DIY means building five 50-foot catamarans from the ground up. The couple met in 2015, when Tizzano worked for Captain Hook’s while Strama operated his rental boat business, Quality Boat Rentals. Tizzano had dreamed of owning a charter vessel of her own for years, but when the couple explored the possibility of purchasing a Corinthian catamaran – used by similar dive and snorkel operations throughout the Keys – they were dismayed to find themselves at the bottom of a three-year wait list. That’s when the “wheels started turning” in Strama’s head, and in June 2018, the idea for the original Marathon Mermaid – a name taken from Angela’s Instagram handle – was born. “He’s practically been working on boats since he was in the womb,” said Angela. “He was like, ‘I could build one of these boats.’ We didn’t really understand at the moment in time when he had that epiphany all the work that included.” With a list of pros and cons from Angela’s experiences on boats in Roatan and the Keys, the couple met with a naval architect to draft plans. Strama eventually convinced Alachua-based A&M Manufacturing to extend a previously-designed 28-foot fiberglass pontoon to a wider, taller 50-foot model, and work began in earnest. On top of nearly a year of drafting, submitting and modifying plans for Coast Guard approval, standards for the new boat design required almost weekly inspections throughout the build. Required modifications even found Strama and his crew crawling inside the preconstructed hulls to add structural support. After 18 months of work, the original Marathon Mermaid passed stability tests and earned its Certificate of Inspection, and Angela’s dream business opened on Jan. 1, 2020 – just three months before COVID closures killed the momentum of a successful launch. With no other choice, the couple sold their brand new creation to the Spottswood family in Key West. “We have four daughters. We still had to put food on the table, and we put all of our eggs in this basket,” said Angela.

The pair’s hard work was not wasted, however, as the Spottswoods loved Strama’s design and soon requested to purchase a second identical vessel. Seeing an opportunity, Angela and John struck a deal with the family: if the Spottswoods would pay the material costs for two boats to be built, Strama would forgo labor charges for the project. The family agreed, and Marathon Mermaid was back in business. Determined never to crawl inside a small pontoon for fiberglass work again, Strama relayed the Coast Guard’s required improvements to A&M, and hulls are now delivered fully fortified and ready for building. In fact, a visit to Driftwood Marina will find three of the catamarans lined up side by side in various stages of completion. With the second Mermaid already in the water and operational and the Spottswoods’ boat nearly finished, the other two vessels will go to an eventual second Mermaid operation in Islamorada and a new project in Marathon to be announced soon. That’s a lot of boat building for a man who says he doesn’t want to build boats. Strama’s design could continue to serve charters and other services throughout the Keys. But even with five nearly-complete builds under his belt, he said he’ll be happy when the most recent projects are finished. “I’m doing these three, and then (Angela)’s getting one more smaller one, and then I’m done,” he said with a laugh. Marathon Mermaid now offers reef snorkel, sandbar and sunset cruises for up to 42 passengers comfortably aboard Strama’s creation. “It’s beautiful,” said Angela. “We didn’t cut any corners, it’s all cushioned, and we really stay on top of the crew to make sure they keep it clean.”

PART 2

ATTACK AT INDIAN KEY: THE INDIANS

The story of Chekaika and Lieutenant Colonel Harney This is the second part in a four-part series on the attack at Indian Key.

T

he University of West Florida’s John Worth has researched the Calusa people in both Spanish and Cuban archives. One of the people he identified was the celebrated Indian chief Antonio. Physically, he is remembered as a strong, well-developed man who stood, at the very least, six feet tall. Antonio, an established captain with a ship, was a leader of the Spanish Indians who sailed for Florida with his crew during the second escalation of the Seminole War. In stories about the Seminole War, Antonio is known by a different name. He is called Chekaika. The first time Chekaika’s name enters the lexicon is the summer of 1839. Lt. Col. William S. Harney led a mission to establish a trading post along the banks of the Caloosahatchee River. The Caloosahatchee empties into Pine Island Sound at Cape Coral, Florida, on the west coast. Harney Point can be found in Cape Coral, at the end of Edith Esplanade. Harney led 25 soldiers, two interpreters, one civilian trader and his four employees down the Caloosahatchee River. Somewhere near the mouth of the river, perhaps at Harney Point, the troop stopped along the shore, set up camp, and established an area for the trading post. A distance of about 300 yards separated the camp and the trading post. In the day or two immediately following their arrival, a group of Indians created a campsite on the other side of the river. Three days after the trading post was established, the Indians lit bonfires and began to dance into the night. In the early morning hours of July 23, 1839, under cover of night, they crossed the river. As many as 160 Indians attacked. The coordinated assault against both sites was launched simultaneously, with Chekaika leading his men to at-

Chekaika’s hideaway was a tree island rising out of the Everglades. The isolated hardwood hammock, accessible by shallow draft boats like canoes, was surrounded by the Everglades’ “River of Grass.” Harney was one of the lucky ones who escaped, barely, with nothing but his nightclothes. Several days later, he arrived at Indian Key aboard a small schooner. The Caloosahatchee River attack would prove to be one of the most successful Indian attacks of the Seminole War. One of the things that made Chekaika a standout was his preference for attacking in the early morning hours when darkness still covered his approach. The tactic would be repeated just over one year later. Sometime in the last days of July 1840, Chekaika led a war party away from his tree island hideaway. How many people were among the group of warriors has never been verified, and the numbers given range from 50 to

136. However many there were, they traveled in 17 canoes, paddled south through the slough, and followed a course that might have led them to Whitewater Bay. From there, they traveled down the Halbatahatchee River and into Florida Bay. The trip would have taken about six days. It is generally thought that the Indians stopped and waited at Lower Matecumbe Key before advancing to Indian Key. From his ship at Key Biscayne, Lt. McLaughlin penned a letter to Secretary of the Navy Paulding dated Aug. 4, 1840: “Lt. Rogers in the Wave, sailed today with 18 canoes for Cape Romano, on the western coast, touching on his passage at Tea Table Key for provisions and to take off all the people capable of quitting the hospital, for another attempt to cross the Everglades from the vicinity…” Rogers sailed away from Tea Table Key and Fort Paulding on August 6 with all but a handful of able-bodied men left behind. Midshipman Murray and five sailors were left behind to administer aid to the hospital’s sick and wounded. Night came, midnight passed, and Aug. 6 became Aug. 7. Chekaika led the 17 canoes away from Lower Matecumbe Key, across the Atlantic shallows in those early morning hours, and out to Indian Key. They quietly pulled their canoes up onto the western side of the island and crept ashore where they waited to attack before being discovered by Mr. Beiglett and Mr. Glass.

“I

t’s basically adult girl scout camp. You’re gonna love it.” While we sat around her firepit, Kelly Cox excitedly told me about a statewide outdoors workshop run by Florida TIFFANY FWC and sent me the link DUONG to sign up. A measly $175 covers cabin lodging (dorm style) and gourmet food for three days and two nights. There are clean showers and bathrooms. It also includes all workshops and night activities. When the week came, Cox’s mom Susie joined us for the festivities. “Being over the age of 60 with more free time on my hands,” she said, “I decided to step out of my comfort zone and try something new.” We drove up to Everglades Youth Conservation Camp in West Palm Beach to begin our long weekend at stay-away camp. The grounds are gorgeous – set around a freshwater lake stocked with fish, surrounded by flowers and native plants and full of opportunities to have fun. The stated goal of the BOW program is to allow anyone to learn more outdoors skills and to become more comfortable being in the wild. Intended for women particularly but open to anyone, the courses are run by

FWC officers and scientists who volunteer their time to share their skills and knowledge. I had little idea about what I’d signed up for, but I left with a buoyed spirit, some new skills and wonderful memories. “Women are the most untapped demographic in outdoor recreation, and programs like BOW are critical because they reduce barriers to entry for those activities,” Cox said. “Plus, the workshops are safe, affordable and fun. They foster a supportive environment where women can try new outdoor activities in a judgment-free way.” The courses are designed for people who have never tried these activities before but want to learn, the FWC website says. They’re also appropriate for those with some experience but who want to improve their skills or learn new ones. Workshops include everything from fly fishing and small-game hunting to boating basics and backpacking survival skills. I opted for an eclectic mix of courses, starting with water ecology and outdoor photography. This was followed by fire starters, talking turkey, small game, clay shooting and gator hunting. I rounded out my weekend learning to cook gourmet campfire meals. Cox aptly described BOW experience as the combination of the nostalgia of summer camp with the challenge of trying new things outdoors. She used the weekend as an opportunity to gently broach her fear of guns and loud noises – under professional supervision. I watched as patient FWC ladies who hunt and regularly shoot coached and supported Cox through her anxiety. She ended up shooting five rounds of clays in a row and feeling very supported. The random text message updates I sent my family included exclamations like “I am having the best time at grown-up girlscounts. I’ve been laughing nonstop,” as well as, “Just learned how to skin a squirrel – jacket and pants style – and call a turkey to kill it.” And, finally, “I am a whiz with a shotgun. Who knew?!”

Each workshop was 3 1/2 hours long – a solid first experience. I don’t think I could have started a fire, hunted anything or braved the wilderness – until now. And, while I don’t intend to sign up for “Naked and Afraid” anytime soon, I do feel more equipped to adventure and try new activities. On our last night, FWC’s Sandy Clutter donned a headscarf that read “Camp Like a Girl” while leading the group in old girl scout songs. Susie Cox joined her, dancing around the fire and getting attendees to join in on chants about the muffin man and meeting a bear. The energy was infectious. “When was the last time you had dessert of s’mores around a roaring campfire, listening to and singing old-time camp songs?” Susie asked. “Lots of smiles and sticky fingers on the way back to the cabins!” I can’t remember the last time I felt that relaxed and free. The start time is about 5:15 a.m. and the race runs all day, Saturday night and into Sunday morning. Runners will be crossing U.S. 1 at several points: Atlantic Boulevard in Key Largo, Lignumvitae Channel in Islamorada, the Channel Five Bridge, Guava Avenue in Grassy Key, Knights Key Boulevard in Marathon and Veteran’s Memorial Park at the south end of the Seven Mile Bridge. The race historically has not heavily affected traffic on U.S. 1 as the runners are typically spread out and running on the shoulder, Heritage Trail and bike path. BEAUTIFUL MUSIC … … from a total jerk?

PATRICIA A. FASCHING 1932-2022 It is with heavy hearts that we say goodbye to our beloved mother, Patricia A. “Patti” Fasching, as she began her journey from this life on April 24 in Marathon. She died peacefully in her home at the age of 89. Born Patricia A. Fritchey in Allentown, Pennsylvania on May 15, 1932, Patti lived a full and rewarding life as a devoted wife, mother, grandmother and great-grandmother. She married the love of her life, Frank, on Sept. 8, 1951, at 19 years of age, after graduating from Central Catholic High School. After working as a secretary for the Lehigh Valley Cooperative Potato Growers, she became a homemaker and mother of five children: Anthony, Nanette, William, Joseph and Karen. Later, Patti worked part time at Inches Away Figure Salon. She was a forerunner of the fitness movement of the ’70s, and always stayed in tiptop physical condition. Patti was a loving mother, wife and homemaker. In her honor, Sept. 30, 1983 was proclaimed as Patti Fasching Day in Allentown by Mayor Joseph Daddona for her loving contributions to her family and community. She was also named honorary chairman of the board of Queen City Electrical Supply Company in Allentown. After the death of her husband in 2009, Patti became a full-time resident of the Florida Keys. In an effort to combat her grief, she adopted a trained emotional support dog, an English lab named Ilsa. Patti and Ilsa would frequent her daughter’s 4th grade classroom, allowing special students to read with Ilsa. Patti was an active member of St. Columba Church in Marathon. She was loved by many, including her family members, friends, caregivers, service providers and her pastor Debra Maconaughey. Patti is survived by her daughters Nanette Young and Karen Thomas of Marathon and her son Joseph (Linda) Fasching of Orefield, Pennsylvania. Her husband Frank of Allentown, sons Anthony Fasching (Jerri) of Whitehall, William Fasching (Kathleen) of Allentown, and granddaughter Sarah of Ithaca, NY, predeceased her. She has seven remaining grandchildren: Frank (Chelsea) of Marathon, Katrina (Richard) of Chula Vista, California, William of Bethlehem, Pennsylvania, Krysti of Marathon, Joseph (Victoria) of Kutztown, Pennsylvania, Nicholas of Orefield, Pennsylvania, and Anthony of Whitehall, Pennsylvania. She was also blessed with four great grandchildren: Ethan and Hannah Hinzo of Chula Vista, California, Sophia Young of Marathon, and Trey Fasching of Kutztown, Pennsylvania. A service will be held on Saturday, June 25 at 10 a.m. at St. Columba Episcopal Church in Marathon, when her extended family will gather together for her celebration of life. In lieu of flowers, please offer any donations to Payton’s Promise Sanctuary, 487 29th St. Ocean, Marathon, FL 33050. Payton’s Promise is a non-profit organization that provides sanctuary for homeless dogs nearing the end of life who have special needs or are otherwise difficult to adopt. Patti has genuinely touched the hearts of many. She will be deeply missed, but her infinite love will live in our hearts forever.

avid Crosby is a total jerk. At least that’s what many of his old bandmates say. A founding member of the Byrds as well as Crosby Stills Nash and Young, Crosby has known the heavenly heights of music stardom as well as the hellish lows of serving prison time for drug and gun violations. A case of hepatitis C necessitated a liver transplant in 1994, courtesy of Phil Collins. Crosby really pissed off Neil Young, calling his girlfriend Daryl Hannah a “purely poisonous predator.” Neil responded, “Crosby should write an introspective book: ‘Why People Won’t Talk to Me Anymore.’” Crosby spit similar venom about Graham Nash’s divorce and accused Nash of only hanging around “just trying to keep the money coming.” Nash was about as happy as Young was. And a representative of Byrds co-founder Roger McGuinn said that “(Crosby) is not hated. But that doesn’t mean anyone wants to work with him.” So how does a guy who seems to be such a jerk make such incredibly beautiful music? Crosby recently released “For Free,” a wonderfully textured and brilliantly composed album that is absolute ear candy. The opening track, “River Rise,” begins with Crosby’s sweet vocal over a piano, and builds into a climactic chorus that features Michael McDonald and Crosby’s layered vocals. The man does know a thing or two about harmony. Combining his love of his life in California with a reflection on his own dwindling years, Crosby sings, “Let the clock run out, don’t care about it, not today.” “I Think I” begins with some beautiful and intricate acoustic guitar work, something that’s luckily present all over this album. A song about lessons learned over time, “I think I found my way” is the sentiment that glues this song together. Although not credited, I swear I can hear Boz Scaggs contributing a vocal response in the third chorus of this song. “The Other Side of Midnight” is pure, beautiful Crosby. His angelic vocal harmonies tell us of a dream world where the stars are in different places and nights are spent counting galaxies out at sea — put on a set of good headphones, close your eyes and transport yourselves onto that dream boat.

An album standout is his collaboration with Steely Dan’s Donald Fagen, “Rodriguez For a Night.” With characters straight out of the Steely Dan roster, a selfJOHN confessed “drugBARTUS store cowboy” pines unrequited for a is the Mayor of woman who’s smitthe City of Maraten with “the outlaw thon. The title track, “For Free,” is the wonderful Joni Mitchell classic from her younger days. Crosby and Mitchell had a brief relationship that resulted in his producing an album for her and getting her out to the nascent singersongwriter scene in Laurel Canyon where musical history was made. Joni and David are still on good terms, and she has to be pleased with this version of her song, presented here as a duet with the amazing Sarah Jarosz. Their vocal harmonies flow beautifully around the piano accompaniment, telling the story of the street musician playing real good for free. If this proves to be Crosby’s last album (he says he has two more to record), there wouldn’t be a better finale than the closer, “I Won’t Stay For Long.” A song about a man nearing his last days, this reflective track was actually written by his son, James Raymond. Raymond is the album’s co-producer. He co-wrote a lot of the songs and plays a lot of the instruments on the record. Crosby gives the perfect take on Raymond’s words, perhaps one of the few with the perspective to do so: “I’m standing on the porch / Like it’s the edge of a cliff / Beyond the grass and gravel / Lies a certain abyss.” While Crosby may have pissed off a lot of people, he still found more than a few stellar talents to help bring out his own. And this album is one of the best collections of songs I’ve heard in a while — impeccably produced, and sung by a man whose voice sounds 50 years younger than he really is. May 3 brought a battle of often-confused sea creatures as the Dolphins took on the Mahi for supremacy on the diamond in a hard-fought 9-9 tie. Majors and minors baseball games will continue every Monday and Wednesday at 5:30 p.m. with final games on Wednesday, May 25.
