SCHOOL BOARD SAVES CONCH BASEBALL SEASON OFFICIALS AGREE TO POSTPONE STADIUM CONSTRUCTION MANDY MILES mandy@keysweekly.com

C

onch baseball is “safe at home.” Officials made the call on Feb. 8 to save the 2023 baseball season by postponing construction of Key West High School’s new football stadium. The Rex Weech baseball complex on Glynn Archer Drive backs into the football stadium on Kennedy Drive and will necessarily be affected by construction of the new stadium. Dozens of baseball players — past, present and future — plus parents, coaches and fans, packed the school board meeting to protest a revised stadium construction timeline that would have made baseball’s Rex Weech Field unavailable for the 2023 season. As it turned out, the baseball players and fans didn’t need to protest, and instead applauded loudly when school board members decided to postpone the sta-

dium construction until after the 2023 baseball season. “Unless we have a field available and transportation to take our players to that field, we can’t cancel a high school baseball season,” board member Mindy Conn said Tuesday to the appreciative audience. “I don’t see how there’s any other option. Too many kids go to college through the high school baseball program.” The audience applauded again when board member Andy Griffiths said, “If there are no good options, I don’t see that we have any other choice but to delay construction until April 2023.” Their enthusiasm continued when board chair John Dick reminded his colleagues and the audience that he had been the first to suggest the delay a month or so ago to save the baseball season. No one argues that the Key West High School football team’s Tommy Roberts Memorial Stadium is in dire

need of an overhaul, although some residents question the new stadium’s $15 million price tag. Construction was slated to begin this coming April, after the 2022 baseball season. But work was significantly delayed when environmental assessments revealed soil contamination that must first be fixed. That requires crews to cap the contaminated soil with a special protective layer, and raise the football field by at least one foot. With the deteriorating football bleachers unsafe for use, the Conchs’ football team has been playing its home games at the school’s “Backyard,” a newly built football field and track behind the high school. But there is no baseball field at the Backyard and the baseball team has no alternative location. The nearby city-owned ballfields at the Sterling complex aren’t regulation size for high school baseball. “To be clear, we never intended for any season to be interrupted,” Superintendent Theresa Axford emphasized at the meeting. “Our plan was for construction to occur from April to December of this year, so it would have started after this current baseball season. But we were thrown a curveball by the Florida Department of Environmental Protection when they found contaminants in the soil. So we’re looking for a solution.” continued on page 7

SAFER CLEANER SHIPS CALLS CRUISE ORDINANCE ‘A JOKE’

MANDY MILES The county school board agreed to postpone construction of Key West High School’s new football field instead of canceling the 2023 Conch baseball season. CONTRIBUTED

One unpopular solution, proposed by Pat Lefere, the school district’s director of operations, was to start stadium construction in November 2022 and have it mostly completed in July 2023. “Tommy Roberts Memorial Stadium will not be available for the 2023 baseball season. Please plan accordingly,” states a Dec. 16, 2021 memo from school district facilities planner Doug Pryor to KWHS principals, coaches and school district officials that explained the contamination and revised timeline. The memo shocked baseball players and supporters, including longtime baseball supporter Jack Niles, who owns Niles Sales & Service car dealership in Key West. Niles and several others urged the school board to postpone construction until after the 2023 baseball season. Dick floated the idea of a delay at last month’s meeting, where board members all expressed concern and frustration with the delays and mitigation requirements. “This was always planned with baseball season in mind, but the DEP put us behind,” Lefere said on Feb. 8, warning the school board that a postponement could add $500,000 to $1 million to the stadium’s $15 million price tag due to the rising costs of materials and labor, and current supply chain shortages. Dick told Lefere, “You had originally planned this around baseball season. Look, these people want to play baseball. Get some applause.

Save the baseball season.” Lefere responded, “We’ll follow the direction of the board.” As the baseball crowd filed out of City Hall, where the school board meeting had taken place due to the anticipated crowd size, Dick promised a “crown jewel” of a new football stadium — after the baseball team’s 2023 season at Rex Weech Field — and hopefully another state championship, Dick added. “I can’t imagine these older kids losing the opportunity to play their final baseball season at their home field,” Sam Holland Jr. told the Keys Weekly while leaving City Hall on Tuesday. His son, Sam Holland, is a freshman varsity outfielder for the Conchs. Holland’s father, Sam Holland Sr., was a star first baseman who played with former Conchturned-pro Boog Powell when the Conchs earned three state championships. “Despite his success in college baseball, my father’s fondest memories are of playing Conch baseball with all his high school buddies. I just can’t imagine taking that away from Key West kids.” Holland Jr., who owns the Conch House guesthouse and other local businesses, said he has coached Key West youth baseball for years, “from tee ball to Pony League, and I have to say, Jack Niles deserves a tremendous thank-you from all of us here tonight for his unwavering support of and involvement in Key West’s baseball programs.”

ey West’s long-awaited cruise ship ordinance to turn three voter-approved initiatives into local law does not mention passenger or size limits of cruise ships, at the two city-owned piers or the privately run Pier B. City commissioners on Feb. 15 will discuss the ordinance that was released Tuesday, Feb. 8 as part of the meeting agenda. The draft ordinance prohibits water, land and air pollution by cruise ships and makes the vessel and its owner responsible for any cleanups. It establishes a coral reef restoration fund and requires sick passengers to be treated on board except in lifethreatening situations. In a Feb. 8 memo attached to the draft ordinance from the Tripp Scott Law Firm, their attorneys state, “We continue to coordinate with you and work with the Pier B owners toward an amendment to the development agreement. … Discussions with Pier B have included: ship size limitations, ship docking limitations, ship docking blackout days, passenger disembarkation limitation and an increased disembarkation fee and coral reef restoration.” City Commissioner Sam Kaufman told the Keys Weekly, “It should be emphasized that we do need to include limitations on ship size and number of passengers in this process. We are disappointed these aspects are not in the current ordinance, but the commission has been advised that these limitations must be part of an amendment to the development agreement with the owners of Pier B. This amendment process is also underway. The city attorneys expect to have a draft of this amendment available prior to the March 1 city commission meeting.”

Key West hired attorney Ed Pozzuoli of the Tripp Scott Law Firm to help draft the ordinance and at Tuesday’s meeting is expected to approve a $250,000 expenditure to pay the Fort Lauderdale-based law firm’s fees. Pozzuoli warned the city commission in December not to “put into ordinance a mirror image of the voter referendums without you understanding the potential liability.” Pozzouli told the city commission. “There’s a long-standing contract with Pier B, and it’s not just a contract, but a formal development agreement. It runs through 2025 and is subject to an automatic renewal of 10 years. … You’re governed now by that development agreement with Pier B.” Arlo Haskell, treasurer of the Key West Committee for Safer Cleaner Ships, which has spearheaded the cruise ship reductions, on Wednesday dismissed the draft ordinance as “a joke of an ordinance.” “It would allow Mark Walsh to bring 1,000-foot-long cruise ships to Pier B 365 days a year. It would let the city bring 730 ships per year to the two docks they control. All this time and effort and expense for an empty gesture of an ordinance allowing 1,095 enormous cruise ships every year. Where are the limits?” said Haskell. “It has no relevance whatsoever to the urgent issue of cruise ship reform that has engaged our community for nearly two years. … It seems more and more clear that the city does not intend to take any action at all on cruise ships. So we are calling on the U.S. Army Corps to enforce their permit and immediately suspend all cruise ship operations at Pier B.” The city commission meets at 5 p.m. Tuesday, Feb. 15. he College of the Florida Keys recognized high-achieving students who made the President’s List at events at the Key West campus and Upper Keys center on Feb. 3. College President Jonathan Gueverra hosted the students, along with their family and friends, to personally congratulate the students and encourage continued success. second candidate will seek the Monroe County School Board District 1 seat in the Nov. 8 election, per Supervisor of Elections Joyce Griffin: Key West mom and bookkeeper Gabrielle Brown. Key West attorney Darren Michael Horan has also announced his candidacy. The current sitting District 1 board member, Bobby Highsmith, told Keys Weekly he will not seek reelection. “​​Basically, eight years is plenty,” Highsmith said. “I’d like to see others step up with fresh ideas and enthusiasm. It’s been a great honor. I’ve enjoyed my service very much. I’m extremely proud of our school district and the great work that’s being done. I sincerely appreciate the voters and campaign supporters who allowed me to hold office for the past two terms. I wish my successor, whomever that might be, the best of luck in moving the district forward positively and successfully.” Brown is a 50-year-old Florida Keys native, widow, mother, grandmother and foster mother. She told Keys Weekly that she loves her community and is very active in her church. As a daughter of a former county commissioner, she spent much of her childhood in the ’70s and ’80s on the campaign trail with her father. She has been a bookkeeper, mostly in the construction industry, for 20-plus years. “I am excited about this opportunity to serve,” she said. “I was born and raised in Key West and am very proud to be a Conch. I believe it is my duty as an American citizen to be involved in my community, and the education and not indoctrination of our children should be a priority. ”

Brown has two adult children, both of whom attended Monroe County schools. In addition, she currently has a 7-month-old foster child. “I am dedicated, and passionate about my community and the well-being of children and their future,” she said. “The school board’s mission statement speaks about being global citizens. I believe that our children should be encouraged to be involved locally and to love their community and their country.” When asked how she thought the current school board is doing, she said, “I support the decision of the school board to allow face masks to be voluntary and not mandatory.”

KEYS COMMENTERS SUGGEST WHERE TO MEET YOUR SPECIAL SOMEONE

B

ooed up. Per that esteemed reference source, UrbanDictionary.com, the term “booed up” means the following: “In a relationship, esp. in the manner that the two involved seem joined at the hip and don’t do anything that doesn’t involve each other. This can potentially irritate friends.” Are you among the irritated in the Keys and not “booed up”? Especially as Valentine’s Day is coming on fast? Relax. Keys Weekly has got you covered. We conducted research on Facebook (we know, we know) on a local community page and asked the following question: Where can you meet your special someone in the Keys? Surprisingly, we got some solid advice. At least 80 commenters left 278 comments on this post, and we’d like to share what they had to say. First of all, we did have quite a few naysayers: “There is no hope here! Everyone is booed up or just looking to hook up! The Keys has to be the worst place to be single. Just being real,” said one female. Then we had a lot of jokers, such as Key West’s David Sloan: “The water at the Green Parrot will get you pregnant.” And three females wrote in to agree with him.

Another commenter suggested this particular Keys online source: “Keysso.net … the most popular gated community in the Keys.” However, many posters did actually have useful advice. Quite a few wrote that they met their boo in a Keys bar. For example, in our research, we discovered not just one but five couples met at Sharkey’s Sharkbite Grill in Key Largo. Savanna Edwards just celebrated her one-year wedding anniversary in October with her husband, whom she met at Sharkey’s — and she had a T-shirt made celebrating that fact. And Jordan Budnik met her boyfriend of four months at Sharkey’s. “He’s the most awesome person I’ve ever met. He’s phenomenal,” Budnik said. So, why is Sharkey’s such a great place to meet people? we asked her. “It attracts locals,” said Budnik. “You’re always going to meet someone interesting.” She did have one caveat about meeting people in bars: Don’t hang out too late. “We’re both not bar hoppers,” she said. “We were there for dinner. The Keys Kritters tend to come out of the mangroves at 3 a.m.” Quite a few commenters met their significant others at a Keys bar. Shayne Messina met her husband of 17 years at Havana Jack’s in Key Colony Beach. And here are other bars where Keys locals met their boos: Key West’s Half Shell Raw Bar, Smokin’ Tuna Saloon and Cowboy Bills Honky Tonk Saloon; Stock Island’s Hogfish Bar; and Islamorada’s Hog Heaven.

Writers commended the following sage advice about meet-up places from John Seckinger: “It depends if you are a guy or a girl and your age… if you are a girl... dive school, work on a fishing boat, gym, Home Depot… if you are a guy… Home Depot, dance class, cooking class, church groups, yoga class, etc.” Barbara Whitesell wrote in to second that advice — she actually married her scuba dive instructor. Also, posters approved the following tips from Leah Benner: “The bocce court? The gym, the golf course, at Key West local events like Santa con, full moon party, zombie bike ride, if you like boating, a bar where boaters hang out? Volunteer groups that have a lot of social events for fundraisers.” Indeed, Keys special events and parties got the thumbs up from Amy Soto. She met her husband of 24 years at Key West’s Mallory Square sunset celebration — he is a tightrope walker. And Islamorada’s Jennifer Oughton met her husband of 13 years at the full moon party at Morada Bay. And let’s not forget that tried-and-true way of definitely running into someone: crashing your cart into theirs at the grocery store. Yes, this did really happen to Key West’s Anne L. Rice at Publix. She literally ran her grocery cart into another (male) customer’s in the produce aisle … and he later became her boyfriend. But not right then and there. “I was so embarrassed,” she recalled. “I was looking the other way and crashed into him. Then I ran into him again at a restaurant. It’s a small town. And he said, ‘You’re the one who crashed into me.’” He gave her his card, they became friends on Facebook … and they started dating two years ago. But perhaps it’s always best to keep in mind what our mothers told us: Use your judgment wisely. As Becca “Keys Chick” Lundy wrote, “Met my husband when I moved here. Set your standards and expectations and don’t waver from that list. It’s hard to find a partner here, though, honestly. If they match up to you, grab them!”

A

s anyone who’s tried can attest, the dating scene in the Keys can be, shall we say, rough. For every good date, it seems that there are 10 bad ones. With Valentine’s Day serving as a reminder of love and all that was meant to be, sometimes all we can do is laugh as we also look back on the connections that were most certainly not meant to be. With that in mind, Keys Weekly presents some of our readers’ most comical dates. And in the interest of preserving the last scrap of mystery in our tiny island community, these were better left anonymous. “I was set up on a blind date. The day before the big night, I looked him up on the MCSO website. At the bottom of his arrest record, there was a button that said ‘next.’ He had a whole second page of arrests! Anyway, we’ve been together for seven years now.” “Many moons ago, I head-butted a guy at Irish Kevin’s. I ended up marrying him.” “On one of my first dates after moving down here, I was hanging out with a girl and we were at dinner having a good time. She asked me what my zodiac sign was. I didn’t have a clue. So she asked me for my birthday and looked it up. Apparently I was an Aries. Based on that alone, she said we weren’t compatible. I split the check.” “This was the first, and only, time I ever asked someone out while I was at work. I worked at a tourist attraction, and she was in one of my tour groups. Afterwards, it was pretty obvious she was hanging around to talk to me more. I asked if she wanted to get dinner later that night, and we went out and had a great time. We went from dinner to the beach and back to hanging out at my apartment. During dinner she mentioned that she recently split up with her boyfriend. When she left, she mentioned that she’d be pretty busy when she got back home and probably couldn’t keep in touch. I was okay with that, and just enjoyed the time spent together. At 2 a.m., I got a phone call from her. She was extremely upset, and told me her boyfriend – apparently not an ex, like she had told me – had tracked her phone and was now furious with her. She ended the call by saying, ‘So, I guess I can keep in touch with you after all.’ I hung up pretty quick.” “I once took a girl to the sandbar on a date. About three hours before the wedding, my girlfriend called to tell me she was able to get out of work and go to the wedding. She was extremely happy, but my third date was, understandably, not. My third date almost refused to come because she wouldn’t have a dance partner, but did eventually end up showing up. Needless to say, when the three mixed together, nothing good happened. Word to the wise: if you’re going to have a wedding date, there’s a reason the card says ‘plus ONE.’” “I had been trying to set a date with a woman in Key West for a couple of weeks. We had texted back and forth quite a bit, and she told me how excited she was to see me and get away from her friend group, including her exboyfriend. We set a date to meet at a bar in Key West, but when I drove down there and walked in, I found her shooting pool with all her friends. I stayed for one round, but near the end of the game she let slip that one of the guys I was playing against, was, you guessed it, the very same ex-boyfriend. As soon as the 8-ball sank, I left.” “A guy asked me to go to the high school football game on our first date. I told him I could go, but my dad was going to drive me and pick me up as soon as the game ended. We’re at the game, and everything is going fine. Towards the end, I see him talking to another girl. When I asked him why, he said ‘Well, she’s my date for later because you have to go home.’ I never went out with him again.”

he Key West Garden Club at Fort West Martello in Key West will host the annual “It’s for the Birds” event to benefit Key West Wildlife Center, which rescues and rehabilitates injured birds. The event takes place from 3:30 to 6 p.m. on Sunday, Feb. 20 and includes food, drinks, educational birds and informational displays about the center’s work with native wildlife, as well as a silent auction, a “wine wall” and more. A handmade quilt by Key West resident Jessica Argyle will also be raffled off. Advance tickets are available at keywestwildlifecenter.org. The nonprofit provides rescue and rehabilitative care to over 1,400 wild birds annually. It also provides rescue services for sea turtles, tortoises and marine and land mammals. The center provides 24-hour emergency rescue services for wildlife in Key West and the Lower Keys. Its fo-

cus is on rescuing, rehabilitating and returning its avian patients to the wild. The staff works closely with other local and regional rescue groups to provide rehabilitation for non-avian species. The center is state and federally permitted to rescue and rehabilitate sick or injured native wildlife. It does not remove healthy land mammals, including raccoons and opossums, from homes or businesses. The center is not permitted and does not remove non-native species from homes or businesses, including green iguanas, parrots, Muscovy ducks or other non-native reptiles, birds or amphibians. wo items on the Feb. 8 Florida Keys Aqueduct Authority board meeting agenda raised eyebrows and drew harsh criticism from nearly anyone who pays a water bill in the Florida Keys. If approved, the proposals, which initially were included on the consent agenda and set for rubber-stamp approval without discussion, would have provided free health insurance for life to any FKAA board member with at least eight years of board service, as well as their spouse or domestic partner. The second proposal would have extended the same insurance benefits to the utility’s top executives, even after their employment contracts end. The board deleted the two proposals from the agenda at the start of their meeting and did not discuss them at all. Board member Cara Higgins told the Keys Weekly before the meeting, “The staff

proposal to give board members and their spouses health insurance for life needs to be fully and openly discussed by the board. I do not support this item as presented and will not vote to approve it.” Longtime Key West business leader Virginia Panico addressed the concerns of many when she spoke during the public comment period. “Thank you for pulling these items,” Panico told the board. “I also suggest that you have an actuary look at what this would cost. It’s interesting that this even came up, especially after the county in the 1990s eliminated benefits for life due to the cost. In the 2000s, the mosquito control board also ended it. “These proposals were quite shocking to a lot of people. The phone calls I received were angry. I hope this doesn’t turn into you guys instead including the benefits for life into employment contracts. People want to be sure this doesn’t happen.”

hey’re proud, preening, pink and more social than anyone would expect. They’re Rhett and Scarlett, the beloved flamingos at the Key West Butterfly & Nature Conservatory, 1316 Duval St. And they turn 10 on Valentine’s Day. The breeding pair of Caribbean flamingos were hand raised and have lived at the conservatory since they were 17 months old, savoring their own wading pool, lush tropical vegetation and the adoring attention of everyone who meanders through the giant butterfly atrium. Their names are the result of a naming contest. The Key West attraction is thought to be the only facility in the country that houses flamingos along with thousands of butterflies. Rhett and Scarlett’s craving for attention led the conservatory owners George Fernandez

and Sam Trophia and their caring staff to launch weekly “flamingle” events that allow up to six guests per day to spend an hour with Rhett and Scarlett, who often join the guests in the white gazebo that overlooks their wading pond. Sometimes the birds preen visitors’ hair, or try to sit on their laps. Other times they’re content to keep the spotlight and cameras on them as they stand tall and perform their feathered show of bowing, dancing, prancing and dipping. KEYS SHERIFF HAS STRONG MESSAGE FOR PAGAN’S OUTLAW BIKER CLUB

A

n outlaw motorcycle gang in the Keys? Really? Yes, sheriff’s deputies have arrested three members of the Pagan’s Motorcycle Club in the Lower Keys in the past two weeks. (The erroneous apostrophe in Pagan’s is theirs, not ours. All three of those arrested had guns. All three had drugs — two to 12 grams of cocaine each and four grams of a crystallike white powder that the suspect said was Molly. But before you start rewatching all seven seasons of “Sons of Anarchy”, Sheriff Rick Ramsay describes the recent spate of arrests more as a circumstantial coincidence than a concerted effort by a biker gang to infiltrate a small town. “A lot of things happened at once to make the issue seem worse than it is,” Ramsay said, but added, “All three recent arrestees — two of them are Key West locals and one was in town for the Pagan’s annual meeting on Big Pine Key — had guns and drugs on them, which means our guys now treat the group’s members as armed and dangerous.” But the club has been coming for years to Big Pine for an annual membership meeting. “This is nothing new. There’s not an invasion of biker gangs suddenly occurring,” Ramsay said. “They stay at the Big Pine Motel, Looe Key Resort and at Parmer’s. They have a barbecue and recruit members, which is fine as long as they’re peaceful, and we generally haven’t had problems with them. Like the mob, outlaw motorcycle gangs don’t want to draw attention to themselves or to any criminal enterprises occurring within them.

And I do believe drug sales are a coordinated enterprise within the Pagan’s. It’s organized crime and I’ll give them as much attention as they demand. I want them and our citizens to know that they’re not going to intimidate law enforcement.” Ramsay pointed out that most Pagan’s are on their best behavior while they’re here. And most — but not all — are smart enough to realize there’s only one road out of the Keys, he said. “We have Stinger Spike Strips along the highway every seven miles. I can get deputies positioned in front of someone long before they reach the mainland. If they want attention, I’ll give them plenty of attention. We’re the biggest gang. My gang has chapters in all 67 Florida counties, but my chapter presidents are called sheriffs.” Ramsay said the recent arrests were separate and individual incidents. On Sunday, Feb. 6, Pagan’s member Ryan St. Clair, 29, of DeLand, Florida, was arrested at the Bahia Honda Bridge. St. Clair told deputies he had had an argument with his girlfriend and had slept under the bridge. He was wearing a Pagan’s sweatshirt and ball cap, but had no motorcycle under the bridge. St. Clair was charged with carrying a concealed weapon without a license, possession of cocaine, possession of marijuana and possession of a controlled substance without a prescription. A search revealed two knives, a 9mm handgun, a stun gun, two grams of cocaine, four grams of a crystal-like white powder that St. Clair identified as “Molly,” and eight grams of marijuana, the sheriff’s office reports. He went to jail. On Feb. 3, deputies arrested Pagan’s member Austin Christopher Reynolds, 26, of Key West, after he fled from a deputy on

U.S. 1 on Stock Island. Reynolds was charged with possession of a firearm by a convicted felon, possession of a weapon (a large knife) by a convicted felon, possession of cocaine, fleeing and eluding, evidence tampering, reckless driving and knowingly driving with a suspended license. Officers recognized Reynolds when he was leaving Key West on his motorcycle, and knew he had a suspended license. When they attempted to pull him over, he veered onto the bicycle path and fled, but was soon caught after witnesses saw him discard a gun on the bike path, Ramsay said. And on Jan. 27, deputies arrested Pagan’s member Justin August Meyer, 31, of Key West following a search warrant of his Staples Avenue home. “He lived with his girlfriend’s parents,” Ramsay said. “That’s where we executed the search warrant.” Meyer was charged with possession of cocaine, possession of a firearm by a convicted felon, possession of ammunition by a convicted felon and possession of drug paraphernalia. About 12 grams of cocaine, an AR-15 pistol, a 9mm pistol, 140 rounds of ammunition, $3,310 in suspected drug sales and a digital scale were found in the residence. “That arrest was related more to a drug investigation than to his Pagan’s affiliation,” Ramsay said.

TRACKING LEGISLATION State bills gaining momentum and losing traction JIM McCARTHY

n Tallahassee, state legislators are working with colleagues as they push their bills toward approval in a 60-day legislative session, which began Jan. 11. Senators and representatives have until March 11 to move their legislation to Gov. Ron DeSantis' desk for consideration. Several proposals with Keys implications are gaining momentum. Others are stalling. SENATE BILL 442 Introduced by state Sen. Ana Maria Rodriguez, R-Doral, Senate Bill 442 authorizes land authorities to assist counties that received federal and state grants for residential flooding and sea-level rise mitigation projects. This includes elevation of structures above minimum flood elevations, demolition and reconstruction of structures above minimum flood elevations and the acquisition of land with structures at risk of flooding. Land authorities act as intermediaries between landowners and government agencies that regulate land use. Acquiring property for conservation use is their core mission. But land authorities, like the one in Monroe County, also provide funding for affordable housing projects, protect conserved land from private acquisition and use and maintain conservation land stewardship programs. The bill garnered unanimous support from the Senate Community Affairs Committee, 9-0, on Feb. 2. It now sits in the Rules Committee. SENATE BILL 198 A bill aimed at restoring seagrass is gathering concern over the belief that the proposal would only destroy it even more. Sponsored by Sen. Ana Maria Rodriguez, Senate Bill 198 would grant easements on sovereignty lands for mitigation banking, a practice in which an environmental enhancement and preservation project is conducted by a public agency or private entity to provide mitigation for unavoidable wetland impacts within a defined mitigation service area. Through seagrass mitigation banks on submerged public lands, private companies could grow and manage seagrass on easements that are granted to them by the state. Companies could then sell credits to landowners that conduct projects, such as channel dredging, that ultimately harm seagrass. The bank is the site itself, and the currency sold by the banker to the landowner is a credit, which represents the wetland ecologi-

cal value equivalent to completion of one acre of restoration. Many have raised concerns over the idea, including the Department of Environmental Protection. “Preserving seagrass resources is not appropriate for compensatory mitigation, because if loss or degradation of seagrass resources are said to be offset by preserving existing seagrasses that are already protected, then there will be a net loss of seagrass resources.” Seagrass serves as a vital resource for Florida Bay and an important habitat for fish in the backcountry. Legislation currently sits in the Senate Rules Committee. A companion bill in the House by Rep. Toby Overdorf. R-Stuart, hasn’t gained traction. Similar legislation passed through the legislature in 2008, but it was vetoed by then-Gov. Charlie Crist, who stated that “authorizing the conveyance of sovereignty submerged lands for a bank selling credits to facilitate the destruction of seagrasses on sovereignty submerged lands elsewhere could fail the constitutional public interest test.” HOUSE BILL 537 If approved, landlords could offer their tenants the option to pay a fee in lieu of the security deposit. Sponsored by Mooney, House Bill 537 doesn’t require a landlord to offer a tenant this option; however, if a landlord chooses to go this route, the tenant could terminate the agreement any time to pay the security deposit in full. Per bill language, the fee is not a security deposit and does not absolve the tenant of any obligations under the rental agreement, including paying rent as it becomes due and any costs and damages beyond normal wear and tear that the tenant may cause. The bill could facilitate use of security deposit insurance. This insurance product insures a landlord against losses that would otherwise be covered by a security deposit or advanced rent. Different insurance providers offer different levels of coverage. Security deposit insurance protects the landlord and is distinct from the more commonly used renters insurance, which provides personal liability and personal property protection to the tenant. Legislation awaits second reading.

ull funding for the Florida Keys Stewardship Act appears to be on a better track than in prior years in Tallahassee. On Feb. 2, the Florida House and Senate’s appropriations committees unveiled their budget proposals. Both included $20 million for a Stewardship Act that funds critical water quality projects. Budget proposals for the critical Keys program fall in line with Gov. Ron DeSantis’ recommended budget for the upcoming 2022-23 fiscal year, which begins in July. An initial House spending proposal last year included $2 million for the Stewardship Act. A Senate budget proposed nothing for the program. With legislative approval by the end of session, DeSantis signed a budget last year with a full $20 million in Stewardship funds and an additional $5 million for land acquisition. State Rep. Jim Mooney worked to include full funding for the Stewardship Act last year. Even with budget proposals including the $20 million, Mooney told the Keys Weekly a long road is ahead. “We are continuing to work our request through the system,” Mooney said, “but we

are staying confident that as we start the process through the budget that there will be appropriations that fall into place.” State Sen. Ana Maria Rodriguez told the Keys Weekly that she’s delighted to see that the House and Senate budgets have included the $20 million. “While the fight isn’t over until the end of session, I feel that we’re starting from a position of strength, and this will help us as budget negotiations proceed,” she said. “The Florida Keys are an ecological gem, and all efforts should be made to preserve it for generations to come.” In a press release, Monroe County Mayor David Rice said the county is thankful to House and Senate leadership for their recognition and support of funding that protects valuable Florida Keys resources. In 2016, the state allocated $5 million for the Stewardship Act. A year later, that amount jumped to $13.3 million. In 2020, DeSantis slashed Stewardship funding by $10 million to offset the state’s financial losses due to the COVID-19 pandemic. A 60-day session in Tallahassee concludes March 11.

ou don’t think of Herman Melville as a funny guy, but he was. Darkly so. There’s an oftquoted paragraph in “Moby Dick” where he talked about being in the grips of depression, a.k.a. the “damp, drizzly November” of the soul. He described himself as pausing in front of coffin factories and bringing up the rear of every funeral that passed, which made you wonder what kind of neighborhood he lived in. He described having to prevent himself from “stepping into the street, and methodically knocking people’s hats off,” which I think might be the most relatable urge ever. At least if you live in a tourist town. When these moods and impulses took over, he said – or his narrator said – it was “high time to get to sea.” I wasn’t quite at the chapeau-slapping stage the other day, but I was in a bit of a funk, at loose ends, whatever you want to call it. There was really no excuse for it. The weather was perfect. It had been weeks since the dog had stolen and/or destroyed anything important, expensive or sentimental. No one was even doing any construction in the neighborhood. And I thought about Melville and his prescription, and the fact that I live on an island which is – get this – entirely surrounded by the sea. There really is no excuse for wallowing. So I grabbed my binoculars, got on my bike, and pedaled slowly down White Street to the pier. The water, when I got there, was as calm as I have ever seen it. Dare I say limpid. Smoothness as far as the eye could see, with these sad little waves slapping ineffectually against the rocks. It might as well have been summer, if the light wasn’t gorgeous and the temperature a relentlessly pleasant 70 degrees. I rode to Higgs Beach. The only birds I saw flying at either place were laughing gulls and royal terns and the occasional rock pigeon. Feh. I was considering going home to continue my funk when I decided to head to the nature trail next to 1800 Atlantic. The trail is usually pretty reliable for warblers or other songbirds, though none made themselves apparent as I crunched along the newly laid gravel. At the end of the trail the cool shadiness opened into a wide arc of air and some more oppressively placid water – a cathedral of emptiness. There was a distant parasail boat hauling some foot-dangling tourists around, and a cluster of jet skis, but they were somehow quiet, too. The world’s got nothing for me today, I thought, while simultaneously thinking, maybe it’s the other way around. So I sat down, and tried to be zen about things. I told myself I would just sit there for 10 minutes and see what happened. Whenever Edward Abbey wrote a travel piece, he would pull out a notebook and name all the plant life he saw. Which seemed

like a good exercise. Sargassum, I wrote down, because it was right there and slightly acrid. Then palm tree, then gumbo limbo. Then I saw my first nearby bird. It was a willet, nothing unusual. And it was standing on one leg, head tucked under its flight feathers, asleep. Birds do that onelegged thing all the time – they will even hop around like that. They do it so often people are sometimes convinced they are missing a leg. I’ve read a couple things that confidently state they do this to keep warm in cold weather, but it was a little hard to reconcile that idea with the current temperature and the fact that you see birds doing it in Florida and other warm places year round. There are theories that some birds have what is called unihemispheric sleep, in which they rest half their brain at a time, so maybe they are also resting half of their bodies. And there is the fact that flamingos spend a lot of time on one leg, and biologists discovered that their skeletons and musculature work in such a way that it requires less energy to sleep on one leg. All of which leads to the conclusion that, like a lot of behavioral things, no one really knows why some birds sometimes sleep standing on one leg. They just do. Out over the water a pair of brown pelicans were flying around. It seemed a loose association at first, like two people who vaguely know each other walking through an airport to the same gate, but then they got more organized, diving together in various degrees of synchronicity, sometimes hitting water together from identical angles, sometimes coming from different angles and hitting half a second apart but only feet away. After they’d gulped down their pouch full of fish, they would take off again, flying seemingly without mission before, with a flick of the wing, they would auger in and dive again. It was hard to figure if they were communicating or if these were just the best practices dictated by the wind and the fish and the water. Were there subtle gestures that only pelicans would pick up on? I tried to imagine a research method that would answer those questions. I looked at my phone and it had been close to an hour. The nosee-ums were starting to outpace my ability to slap them. So I got up and headed back up the trail, my mood appreciably less dour than it had been. Small mysteries – they’ll get you out of your head.

Nick decided to take the next step and move out to Los Angeles, California, where he and Jeremiah Ritchey formed a duo called “Heavy Sole” and decided to audition for a TV show in Nashville called “Can You Duet?” The show featured some notable judges and coaches, including Naomi Judd, Amy Mayo and Brett Manning. Heavy Sole took second place in the contest and was offered a record contract with a Nashville-based label. “The contract didn’t really work out for us. The label wanted us to play a different style of music from what we wanted. We decided to forego the contract and do our own thing.” Heavy Sole, a rock duo, influenced by other popular rock duos such as the White Stripes and Black Keys, took their act on the road and successfully toured for about 10 years. When the pair eventually went their separate ways, Brownell continued to perform as a solo act and found him-

solo artist around town, but it certainly got me started.” Nick’s talent is obvious to anyone who has heard him and he started to play all over town. The Brownells also began to build a family. Nick has a 15-year-old son from a previous relationship who lives in the greater Cincinnati area. Kara gave birth to their daughter, Billie, a year and a half ago. Their second child together is due in April. Nick plays solo and as a member of a couple bands in Key West. He fronts a full honkytonk band consisting of Nick on guitar/vocals, Myles Mancuso on guitar, Drake Lenard on bass, David Warren on drums and Steve Molnar on pedal steel. He can also be seen playing on occasion with his popular hard driving rock duo Raw Dawggs along with talented drummer David Warren. Catch your entertainer of the year at 9 p.m. Monday, Wednesday, Friday and Saturday at Hank’s Hair of the Dog. He’s at Willie T’s at 9:30 p.m. Sundays and he plays with his whole band at 9 p.m. Tuesdays at Smokin Tuna Saloon.

FLORES MAY WIN IN THE COURT OF PUBLIC OPINION, BUT NOT A COURT OF LAW

W

Flores has sued the league, the Dolphins, the New York Giants and the Denver Broncos for racial discrimination. The accused have all denied his claims. When I heard his accusations, my first thought was, “Prove it.” When he was interviewed by the Broncos for their then-vacant head coaching job in 2019, Flores claims the executives who met with him were an hour late, disheveled and hung over. I think this is his weakest charge as I go back to my mantra: Prove it. Even if he can do that, what does it mean? That general manager John Elway and his cohorts didn’t take the interview seriously and did it only because the league says they have to interview a black candidate? I think that happens in a lot of NFL coaching interviews. Nothing new there. Elway and the Broncos have denied being hung over. I heard one commentator espouse that owners should be able to hire whomever they wish. Maybe. But with 32 non-black owners making money from teams that are 70% black, you’d think somewhere along the way someone would hire a black coach. As of this writing, there are but two – Mike Tomlin of Pittsburgh and, named on Monday, Lovie Smith of the Houston Texans. The Dolphins’ new coach, Mike McDaniel, has a black father and a white mother. Two other coaches, the Jets’ Robert Saleh and the Washington Commanders’ Ron Rivera, are listed as non-white. Before he was interviewed by the Giants, Flores traded text messages with New England coach Bill Belichick in which his former employer congratulated him for

getting the New York job, only to learn that Belichick had mistakenly sent the text to the wrong Brian when he meant it for Brian Daboll, who had allegedly been selected as the Giants’ new coach before Flores was interviewed. That one flies a little bit because of the Belichick texts, but is probably not enough to win an entire case. And the Giants have denied they had hired Daboll before they interviewed Flores. Flores also charges that Dolphins owner Stephen Ross invited his coach and an unnamed quarterback (presumedly Tom Brady) to meet on a yacht in deference to the no-tampering rule, as Brady was employed by another team. Flores refused the invitation. Then comes the big one. Flores says he has proof and, if he does, we have a very different scenario here. The former Dolphins coach claims Ross offered him $100,000 for each loss in 2019. The losing record would have moved the team up in the draft and given them better picks of players. Flores said he refused the offer. The team lost 11 games that season – without Flores’ help – and from the sixth draft position took quarterback Tua Tagovailoa, while Cincinnati, in the top spot, took Joe Burrow, who has led the Bengals to Sunday’s Super Bowl. Flores says he has corroborating evidence that proves Ross wanted him to dump games. If he does, that could force Ross to sell the team, which is what some Miami-based writers are calling for. In the meantime, former Cleveland Browns coach Hue Jackson has indicated that team owner Jimmy Haslam offered him a bonus for each loss that moved the Browns up the draft ladder. So, what do we have here? We have a legal case of accusations. Some may be proven and may be enough to force Ross to sell the Dolphins. Others may be true, but unable to be proven. The NFL will be embarrassed nonetheless. And Flores will not be hired to coach another NFL team – ever. My suggestion: The league needs to strongly enforce the Rooney Rule. The owners, or whoever makes the hires, need to make a solid connection with a minority – meaning black – candidate.

All this comes as we’re trying to concentrate on Sunday’s Super Bowl LVI, which will match the Los Angeles Rams (favored by 4 to 4½ points) in their home stadium to the Cincinnati Bengals. I’m sorry, but I’m unable to give an unbiased pick. When I was in Dayton, Ohio, I had season tickets to the Bengals’ home games and unabashedly rooted for them. I also reported on their previous two Super Bowl losses, both to the San Francisco 49ers, at the Pontiac, Michigan Silverdome and at Miami’s Joe Robbie Stadium. So, yes, I’m rooting for the Bengals. But, I’ll tell you what I think. The Bengals have won all their playoff games by less than a touchdown. Their “luck” will run out Sunday. The Rams will win by 20 or so points.

ongtime Keys resident Carolyn Guarini knows that people either love Valentine’s Day or hate it. She wanted to come up with an event that was for everyone. “I wanted to create not just a show, but an experience that will have people walking away and looking forward to the next event. Dinner seems to be a focal point on Valentine’s Day, so I thought why not combine dinner with a show full of super talented musicians?” Guarini’s Love Songs show at Key West Theater combines local and national talent on one stage, showcasing not only their original music, but some amazing covers. “This show holds touches of comedy and will be nothing short of entertaining,” she said. Chef Martin Liz, from Key West Personal Chef and Lost Kitchen Supper Club, has put

together a menu with something for everyone, even the vegans. Liz is a Conch and loves to showcase Key West cuisine. A portion of proceeds will benefit Paw Patrol Pet Rescue and Sanctuary. “Andy Westcott and I adopted our senior chihuahua babies from Paw Patrol in April 2020,” Guarini said. “We are lucky to have so much talent on our little island here in Key West. ony Sands grew up in South Philly listening to his parents’ Frank Sinatra records, then started singing the songs when he was as young as 11. He was only in his teens and 20s when he started singing in bars, then cultivated his Sinatra-like style and started singing those songs in piano bars. “Unfortunately, I have green eyes, instead of Sinatra’s blue eyes, but hopefully my vocals make up for that,” said Sands, who has been performing Sinatra’s songs and paying tribute to the musical icon’s voice, mannerisms and style for more than 30 years on stages up and down the East Coast, from Key West to Atlantic City, and out west in Las Vegas and Reno, Nevada. Sands’ latest performance at Key West Theater is called “The Rat Pack Together Again,” and offers a trip back in time. “For just a moment close your eyes and if you had ever been to the Sands Casino in Las Vegas you could picture the night, the venue and three talented young entertainers

starting out on what would become arguably three of the most famous careers in the entertainment industry,” Sands said. But back to reality… Tony Sands’ Rat Pack Together Again takes place at 8 p.m. Sunday, Feb. 20 at Key West Theater. It’s a tribute to the legendary careers and antics of Frank Sinatra, Sammy Davis Jr. and Dean Martin. The venue is far from the Las Vegas desert. Three superstars who came together in the 1960s will be re-created. All have since died, but their image is being carried on by three performers who assume the roles of the three singers during their glory days. Tony Sands as Sinatra, Robert Cabella as Martin and Steve Roman as Davis combine to bring their audiences the best of the Rat Pack songs, comedy and sketches and their individual hits with the onstage banter that made their act a big hit in Las Vegas. FRINGE THEATER PRESENTS ‘HOW I LEARNED WHAT I LEARNED’ THIS WEEK SHOW RUNS THROUGH FEB. 12 AT THE KEY WEST ARMORY

ringe Theater, in partnership with the Florida Keys Council of the Arts, presents August Wilson’s autobiographical one-man play “How I Learned What I Learned” at 7 p.m. Feb. 8-12 at the Key West Armory, 600 White St. Wilson (1945-2005) was a Pulitzer Prize-winning playwright best known for his 10 plays that chronicle the experiences of African-American families in the neighborhood of Pittsburgh known as the Hill District. Wilson was born and raised in the district, so writing about it came naturally. He sat on stoops and in barbershops, listening to the stories and vocal cadences of the people around him. Then he wrote those stories into 10 plays – one for each decade. His plays captured the changes that occurred in Pittsburgh over 93 years and won two Pulitzer Prizes for Drama in the process. Fringe Theater presented Wilson’s “The Piano Lesson” at the Frederick Douglass Gym in February 2019. The play was directed by Wilhelmina Lopez Martin and featured eight local readers and Coffee Butler on piano. The following year, Lopez Martin starred as the lead reader in Fringe’s production of “Ma Rainey’s Black Bottom” at the American Legion Post 168. “We’ve loved working with locals to present August Wilson’s riveting plays. The time just seemed right to tell the story of the man behind those plays,” says Rebecca Tomlinson, Fringe Theater’s managing artistic director. “And we knew we had the perfect person for the role, Richard Quint.” Quint was born in Manhattan, raised in Indiana, and has been living in Key West for over a decade. “I went from apples to corn to coconuts,” he likes to joke. Audiences may know him from Fringe’s readings of “The Piano Lesson’’ and “Ma Rainey’s Black Bottom” (the latter of which he co-directed). He is active in Fringe’s education and outreach programs and serves as Fringe’s go-to dramaturg.

he College of the Florida Keys (CFK) celebrated the groundbreaking of its new STEM charter high school, the CFK Academy, with a ceremony on Feb. 8. The 7,000-square-foot building, being constructed by Ajax Building Company, will be located on the college’s Key West campus and is scheduled to be complete in December 2022. The CFK Academy, which will be a free public high school, will open its doors to students in grades nine through 12 in the 2023-24 school year. The complete high school experience will come with additional perks of being part of the college, including the opportunity to earn an associate degree and industry credentials alongside a high school diploma. “Buildings are more than just physical spaces. At CFK, they represent safe havens; they help to instill confidence; they provide opportunity,” said Jonathan Gueverra, CFK president and CEO. “With this facility, we hope to decrease the number of individuals whose access to top level STEM and career technical education is limited.” The school’s curriculum will apply a project-based learning approach through all grades and place emphasis on science, technology, engineering and math (STEM) fields. Students will have access to a variety of college-level academic and career technical education courses and programs

through expanded dual enrollment opportunities. Dual enrollment allows high school students to complete courses that earn both high school and college credits, at no cost to the students or their parents. Currently, many dual enrollment students commute between their high school and CFK to take advantage of the program. The addition of the CFK Academy will allow students to take a full curriculum of both high school and college courses in one location. This will provide more options and convenience for high school students aspiring to get a head start on college while they are completing their high school graduation requirements. The CFK Academy will be a part of the college community; however, it will have its own space, including 24/7 security and a designated school resource officer. The school will also maintain the standard technological and curriculum requirements for the state. “In 2019, Governor DeSantis set a goal of making Florida the number one state in the nation for workforce education by 2030,” said Gueverra. “We can get there, but it will take a combined effort that allows for education, training, retraining, lifelong learning, and refocusing our efforts to educate all individuals. It will take innovation, creativity and adequate resources. This CFK Academy is a step in that direction.” — Contributed

ey West resident Christie Stewart created Waggin’ Meals, a farm-to-table dog food company, after her 14-year-old best friend Jack (a dachshund) was diagnosed with liver disease. “Our veterinarian said we needed to start feeding him a prescription diet plan or make his meals. Unfortunately, my friend Jack only lasted one night before we had to say good-bye. After many tears and a trip to the farmers market, I set out to create a simple yet wholesome alternative to store-bought dog food and treats for my other two precious dogs.

“I started making healthy meals with the wholesome ingredients that our dogs need to be healthy and thrive. I began giving them out to our friends and delivering the meals. Waggin Meals was formed, and it has been a journey of joy. It’s simple: humans love their animals and want the best for them. A PRIVATEER AND GROCERY STORE OPERATOR

THE I OLDEST MAN IN KEY WEST BRAD BERTELLI is an author, speaker, and Florida Keys historian. His latest book, “The Florida Keys Skunk Ape Files,” is a fun blend of two of his favorite subjects — Florida Keys history and the Skunk Ape.

n a letter written dated March 3, 1935, poet Robert Frost wrote: “The oldest person I could find in the Key West grave yard yesterday (Sunday) was a veteran of the war of 1812 who died in Key West at 108 years of age. But may have lived to be older than that. His inscription wound up ‘A good citizen for 65 years.’ He must have been a bad citizen for 43 years then. That’s what undermined him and shortened his life.” The tombstone honored Thomas Romer, the long-lived African Bahamian who was born in Nassau, New Providence, in 1788. The marker also reads, in part, “In memory of Thomas Romer, Privateer in the War of 1812.” He served, in his way, at the behest of the U.S. Navy. During the war, Romer worked as a privateer, a form of legalized, or government-sanctioned, piracy. A privateer worked under the authority of a letter of marque. A host country issued letters of marque that authorized private citizens to attack ships from another country during times of war. A privateer was permitted, by law, to attack ships that were flying flags from countries with which the host country was at war. In 1812, the United States was warring with Great Britain, and Romer was working to disrupt the activities of British ships. Working as a privateer was like working as a pirate, but with a few outstanding caveats. While both pirates and privateers essentially performed the same job and did so in the same conquering manner, a pirate attacked whomever they wanted, and the captain and crew retained the entire prize. The privateer used his own ship, hired his own crew, and paid his men out of his own pocket. In exchange for the right to attack ships, a percentage of any prize the privateer could secure was given to the government sponsoring the letter of marque. Romer settled on Key West during its infancy as an American territory, sometime around 1826. He then began to fulfill the other phrase etched into the marker at his gravesite: “a good citizen for 65 years.” While writing for the Miami Herald in 1969, Wright Langley wrote that Romer operated a grocery store that catered to the ships arriving in the harbor during his many decades in Key West. He provided fruits and other food stores to Navy ships that pulled into port, as well as to private and commercial vessels. It can be imagined that at least some of the produce he sold came from the farm owned by Sandy Cornish and his wife, Lillah. The two arrived in Key West in the 1840s and purchased a farm near Truman Avenue and Simonton Street circa 1850. Cornish, who bought and fought his way out of slavery, became one of the island’s richest men. According to Jefferson B. Browne, who wrote the fantastic peek into the island’s early history, “Key West: The Old and New,” published in 1912: “Old Uncle Tom Romer was known to every officer and man in the Navy of the old days.”

There is a contemporary account of Romer’s funeral service printed on a strip of newspaper print that is undated. The author’s name is omitted, though it was clearly written from not just a Key West resident but by someone who knew Romer: “Poor old Tom Romer is no more. The laughing, genial face of ‘Old Tom’ is (illegible) death. Never to flash with humor, or his tongue to quaintly tell with philosophical resignation his sorrows and mistakes during a century of life. How many years he lived no man can tell, he told the writer of this notice barely a year ago, that he was one hundred and fourteen years old. … Tom’s body was seen at the house of his daughter Nora Vickers and was transferred, followed by his numerous friends, to the Baptist Church on Thomas Street, where the funeral activities were conducted by the Pastor, Revd. W.C. Vesta, Huger, Butler and Weeks. His friends were numerous and highly respectable; their dress was appropriate and their deportment admirable. The respectable portion of our colored people cannot be surpassed anywhere, in these particulars; the absence of white friends, and we know he had many, was commented upon.” The writer ends his account with a nod to Shakespeare. “Alas poor Tom, I knew him, Horatio, a fellow of infinite jest, of most excellent fancy. Peace to his ashes.”
