ey West’s cruise ship saga continues, but has slowed to idle speed, now that the Safer Cleaner Ships Committee has cast doubt on the law firm City Attorney Shawn Smith enlisted to help draft and defend the city’s cruise ship limits.

Smith initially had recommended the Tallahassee-based Radey Law Firm as outside counsel and the city commission was slated to vote on accepting their legal representation at Wednesday’s commission meeting.

But before that vote could take place, SCS president Evan Haskell submitted a series of questions about Radey Law Firm’s prior clients and ties to anyone who opposes the extreme reduction in Key West’s cruise ship industry.

On Aug. 25, Haskell wrote to Mayor Teri Johnston and the city commissioners, “At a Commission meeting one month ago, City Attorney Shawn Smith rejected our recommendation of former Florida Deputy Attorney General Joe Jacquot to serve as counsel to the City for drafting and defending an ordinance implementing limits on cruise ship operations, stating that Jacquot was not a sufficiently ‘independent’ choice. At last week’s meeting, City Attorney Shawn Smith stated that he intends to hire the Tallahasseebased Radey Law Firm. Our initial review has uncovered a number of potential conflicts of interest in this proposed arrangement, due to the fact that Radey has represented members of the Florida Harbor Pilots Association on multiple occasions from 2014 to 2018. We do not know if Radey currently represents any harbor pilots, or the cruise in-

dustry, or Pier B, or any of the other collaborators who have sought to undermine local municipal control of cruise ship operations. Using City Attorney Smith’s own standard for ‘independent’ counsel, we ask the Commission to fully investigate potential conflicts with the harbor pilots and other parties, before any steps are taken toward hiring Radey as outside counsel.”

The letter continues with a series of 15 questions about Radey’s current or prior relationships with or representation of harbor pilots, cruise lines, cruise associations, Key West’s privately owned cruise ship dock, Pier B, and its owners and attorneys.

Haskell also asks in his letter, “Did the (Radey Law Firm) provide any advice or counsel during either the drafting or legislative consideration of Florida legislation during 2021 whose purpose was to preempt citizen referendums relating to cruise ships passed by any Florida city or county? If yes, to whom was the advice, counsel or drafting provided?”

In their Aug. 30 response to Haskell’s letter, Radey shareholder and attorney Drew Parker denies any conflicts of interest and wrote, “Before we ever proposed a repre-

sentation to the City of Key West, we completed a comprehensive conflict check and considered all pertinent representations. As our letter indicated, we do not believe there is any conflict. That statement was true then and true now. Unfortunately, despite that assurance, we believe that some of the questions suggest that our firm would have a bias, and that is, at a minimum, unfounded.

“As a firm, we are committed to our clients and we work earnestly on their behalf. We also seek out engagements that will be mutually beneficial. After considering all the issues and correspondence to date, we believe the proposed representation would not appear to best serve the interests of Key West or the Radey Law Firm. While we appreciate being considered by Key West, we would like to withdraw our offer of representation. We wish Key West much success in all of its future endeavors.”

CRUISE INDUSTRY MAKES OWN CASE

L

eaders from two of the world’s largest cruise travel associations sent a letter to Key West city officials on Aug. 27 in an effort to “correct important misrepresentations.”

Representatives from the groups also spoke with the Keys Weekly on Sept. 1, emphasizing their willingness to work with the city of Key West and be a part of any discussions, although that has not occurred in recent months.

Michele Paige, president of the Florida Caribbean Cruise Association, emphasized when speaking with the Keys Weekly that the letter was in no way intended to lay any sort of groundwork for any legal action against the city of Key West.

“Absolutely, 100% no,” Paige said. “The cruise industry is not going to force our ships and passengers on Key West. We are in no position to take a position about what Key West does with cruise ships. And if our ships do come to Key West, and those passengers, who are American citizens for the most part, are not made to feel welcome, that wouldn’t speak very highly of Key West. I understand Safer Cleaner Ships committee has a message and beliefs, but other people have ideas and information as well, and to hear those people get booed at a town hall meeting is disappointing. We are ready, willing and able to work with the city of Key West. We’re sort of on the outside looking in and trying to understand what our role is and will be.”

In answer to a question from the Keys Weekly about the likelihood of any smaller cruise ships coming to Key West, as repeatedly suggested by the SCS committee, Paige said, “Those smaller ships don’t exist and the larger ships are the most environmentally advanced.”

Salerno, senior vice president of maritime policy for Cruise Lines International Association (CLIA).

“We’re a very public facing industry. We’re a floating billboard for our industry, and if cruise ships didn’t take their environmental regulations and responsibility seriously, our passengers wouldn’t tolerate it,” Salerno said. “Even before the pandemic, anything coming out of the ships’ smokestacks or going into the water are strictly controlled, regulated and taken very seriously.”

The letter discusses the claims made in the “legislative intent” document that was drafted by the Key West Committee for Safer Cleaner Ships to outline the rationale for Key West’s drastic reduction in the number of cruise ships that visit Key West.

“The ‘legislative intent’ document states that public awareness of the health risks of cruise ships has increased because of scientific, regulatory and media scrutiny during the COVID-19 pandemic,” wrote the cruise industry officials. “It also suggests that cruise ship travel increases the risks of COVID-19 and other disease transmission in Key West and other port communities. However, under the CDC’s Framework for Conditional Sailing Order, associated technical instructions, and the CDC’s COVID-19 Operations Manual, the cruise industry is now the most highly regulated travel and tourism sector in the United States, and it has the most comprehensive set of preventive protocols and surveillance and response procedures. No other sector must adhere to such comprehensive requirements developed by the CDC.” The letter ends by stating, “The cruise industry strongly values our longstanding partnership with the City of Key West and its businesses and residents, and we look forward to finding mutually agreeable solutions.”

he Key West Sunrise Rotary Club is making its third attempt to hold its 10th annual Key West Brewfest.

The pandemic forced the cancellation of last year’s event, and the threat of Hurricane Dorian put the kibosh on the 2019 event.

But as of Sept. 1, this year’s 10th annual Key West Brewfest is a go, said Charlie Mench, one of the organizers of the sudsy event that raises money for the Rotary club’s local scholarship programs and other charitable endeavors.

They certainly make it easy to support a good cause, when the signature tasting event on Saturday, Sept. 4 offers scores of beers, hard ciders, seltzers and other adult beverages.

The $40 general admission fee includes a tasting glass that can be filled and refilled at dozens of booths that pack Key West’s South Beach in the 1400 block of Duval Street for the tasting event. The $100 VIP tickets include early admission into the tasting booths, a T-shirt and passed appetizers.

Rotarian and Key West Brewfest organizer Sue Fowler says, ‘This is our third attempt to hold our 10th annual event — fingers crossed.’

STRUCTURAL INTEGRITY? KEY WEST BUILDING OFFICIAL WANTS PROOF THAT CONDO IS ‘SAFE FOR HABITATION’

A

New Town condo association has until Friday, Sept. 3 to prove its building is "safe for habitation.”

The city of Key West's chief building official, Raj Ramsingh, sent a letter to Santa Clara Condominium Association on Friday, Aug. 27, demanding confirmation from the association’s engineer "that all or part of the building is safe for habitation.”

The 111-unit Santa Clara complex at 3312 Northside Dr., which was built in 1980, "is obviously in serious need of repairs, to the extent that I don't think the repairs can be completed safely while the building is occupied," Ramsingh wrote on Aug. 27. "I do not want to condemn this building because doing so would necessarily displace so many residents, but if I have to, I will."

The letter states that on Aug. 25, Ramsingh received an engineering report from JL Sanders that was dated nearly a month earlier, on July 28.

In that report, JL Sanders describes a rapidly deteriorating building and an estimated $8.8 million of repairs that are immediately necessary.

The condo association’s board is holding an emergency meeting on Thursday, Sept. 2 to discuss the city’s latest letter. The board held a previous Zoom meeting with unit owners earlier in August to discuss the building’s deteriorating condition.

“We’ve been acutely aware of issues with our building,” said Travis Doll, a unit owner

and vice president of the condo association’s board. “But it’s now gotten to the point where bigger repairs are needed and we’ve started talking with banks about getting an association loan for the $8.8 million.”

In order to repay that loan, condominium owners would have to pay $80,000 to $90,000 per unit, or an additional $600 to $650 per month in condo fees, Doll said.

Those fees currently range between $600 and $860 per month depending on the size of the unit. The fees bring in about $800,000 a year, prompting some owners to question what the property managers have been spending money on each year.

“We’ve reiterated with the ownership at large and with the city that we have completed major projects every year for the last several years,” Doll said. “Those projects and the increasing costs of construction and labor in Key West are where the owners’ money and dues are going.”

One unit owner who asked not to be identified said they are no longer staying at the unit they own.

“I’m afraid we are in dire straits of a building collapse,” the owner told the Keys Weekly, while pointing out a crumbling stairwell, a laundry room ceiling propped up by steel beams and exposed rebar in several places. “"We've been pressuring our property management company, ICAMCO, to expedite the repairs to our more urgent projects, like

those concerns mentioned by the city,” Doll said. "We've recently learned from a few of our main service vendors that ICAMCO has delayed certain projects that the board had already approved. Additionally, just a few days before the city’s visit and the recent letter from the city, we requested updates from ICAMCO on the prioritized projects.”

Property manager Daniel Garcia, who works for ICAMCO property management company, did not return multiple phone calls and text messages from the Keys Weekly.

Doll said on Sept. 1 that Santa Clara had just received notice that ICAMCO was canceling its management contract with Santa Clara.

“Obviously everyone’s really nervous, given the tragedy in Miami,” Doll told the Keys Weekly. “Surfside has spooked everyone, but that is very much not the case with Santa Clara. We have no parking underneath and no pool leaking under the building. The engineers are using some scary language to spur a sense of urgency, and we’re stepping into high gear.

“The city has said they’ll help us with expediting permits,” Doll said. “The last thing the city wants to do is displace so many owners and tenants given the housing situation in Key West.”

Ramsingh acknowledged his reluctance to condemn the building in his Aug. 27 letter to the association.

Ramsingh ended his letter by writing,

“Should the engineer recommend an evacuation of all or part of the building, the city will work with the board to help in any way we can in order to find a solution. … We are here to help, and most importantly, keep our citizens and residents safe.

“There is also an immediate safety concern with the access to the roof. I was able to get on the rooftop with ease as there is no locked door at the top of the stairwell.

Children, or anyone for that matter, can access the unsecured rooftop and fall 7 stories down. This needs to be addressed immediately.”

The condo board had previously “asked ICAMCO to replace the locking door hardware on the roof. That was not done and we found the door secured with rope,” Doll told the Keys Weekly on Sept. 1.

Santa Clara is not alone Santa Clara Condominiums is not the only structure in Key West that concerns building officials. Immediately after the Surfside collapse on June 24, city officials conducted cursory inspections of about 38 aging Key West properties. The city’s building department notified the owners of nine of those properties of specific concerns and the need for an engineering report.

In addition to Santa Clara, according to documents received from the city of Key West, the other eight properties whose owners received letters from city building officials include: Ocean Walk apartments, Key Plaza shopping center, 1800 Atlantic Condominiums, La Concha Hotel, the Professional Building on 12th Street, Winn Dixie Plaza, Key Plaza Publix and the city-owned Park ’n’ Ride garage on Grinnell Street.

Engineering assessments are being collected and reviewed for each of those properties.

Marathon takes action as well The city of Marathon also has taken action in the wake of the Surfside collapse that killed 98 people when most of the building collapsed.

On Aug. 10, the Marathon City Council passed a law requiring inspections of commercial and high-rise buildings erected more than 17 years ago.

Marathon’s law does not apply to residential units that are considered “minor” — occupied by 10 or fewer people, or 2,000 square feet or less.

According to Marathon Planning Director Brian Shea and Building Director Noe Martinez, the city is preparing the groundwork by coming up with form letters and ensuring engineers can sign in to the city’s software that governs building, code and permitting. More than 400 condo units have been targeted, as well as about 200 other commercial buildings in Marathon. Shea said the notices will probably be sent in batches, over a period of time.

Noe said the 17-year age requirement is based on his decades of experience in the building industry.

“If you move into a new home or building, it usually takes an average of 14 to 17 years before the owner begins renovating or fixing it up, and it also takes into account our aggressive climate,” Martinez said, adding that he knows the inspections, findings and fixes may be cumbersome for private owners. “I don’t have the luxury of special enforcement when it comes to health and safety.”

Martinez said he has already observed some older, two-story concrete buildings in Marathon with “bulging” walls that could indicate structural problems.

eaths related to COVID-19 infections stood at 63 in Monroe County on Aug. 31.

Of those deaths, two were among individuals who were vaccinated, per the county’s top health official.

Bob Eadie said the Keys have seen an uptick in deaths since a spike in COVID-19 cases shortly after the Fourth of July. Of the total deaths, the majority, if not all, had underlying health conditions.

“The thing to remember is those conditions were managed well, and they wouldn’t have died on that day were it not for the COVID infection,” he said. “I don't want to minimize the fact that COVID is really dangerous, and for people who just say, ‘They would have died anyway,’ it’s disingenuous in the sense that they could have lived longer.”

A final case count report provided by the local health department to the public on May 21 reported 49 deaths from the first confirmed COVID-19-related death on April 2, 2020. That means 14 deaths from COVID-19 have been confirmed from late May to the end of August.

While May 21 marked the local health department’s last daily case count update, people were still able to view deaths, new cases and other data by county on the Florida Health Department’s website. By June 4, publishing of COVID-19-related deaths by county came to an end.

Today, weekly reports issued by the Florida Health Department, out of Tallahassee, every Friday detail total deaths statewide. Between Aug. 20 and Aug. 26, the state reported 389 deaths. Case and vaccination data is provided by county further down in the report, but deaths by county aren’t shown.

When asked if he received any explanation from the Florida Health Department in Tallahassee behind the move, Eadie said, “I can answer that in one word. No.” Eadie added the local health department keeps track of deaths from daily census reports from hospitals.

“They will also report any deaths in the previous 24 hours,” he said.

The Weekly reached out to the State Health Office of Communications to inquire about COVID-19-related death data and how many deaths since a surge was seen in the Keys after July 4. No response was received before press time.

Statewide, the health department’s latest weekly report, issued Aug. 27, shows 43,979 COVID-19-related deaths out of the more than 3.1 million cases since the pandemic broke out. That’s a case fatality rate of 1.4%.

Data from the U.S. Centers for Disease Control on Aug. 31 reported 230 deaths in the last seven days and a total death count in Florida of 44,561. The Florida Health Department and CDC have gone back and forth in recent weeks over the way case and death data is being reported.

New COVID-19 infections in the state appear to be plateauing, with 151,749 confirmed cases reported between Aug. 20 and Aug. 29. The week before saw 150,236 cases.

In Monroe County, 386 new COVID-19 cases were reported. That’s down from the previous week when 491 new infections were seen. A little more than 700 shots were administered to bring the total number vaccinated to 52,347, or 76% of the county population.

“There’ve been a lot of conversations about people who’ve been vaccinated and who have been hospitalized or come down with a serious case. Those are really small compared to the number of people actually vaccinated,” Eadie said. “No vaccination is going to be 100% effective for the population, but it’s been really effective.”

Baptist Health South Florida said it was caring for five patients with COVID-19 in Monroe County on Aug. 31. Throughout its network from Miami to the Keys, 656 patients were being treated. Gina HalleyWright, spokeswoman for Baptist, said an overwhelming majority of positive patients at the hospitals are unvaccinated.

“We have seen a steady decline in the number of COVID cases across the system,” she said. “We are hopeful and continue to encourage the community to remain vigilant.”

Lower Keys Medical Center remained in yellow status on Aug. 31. Thirty-six COVID19-positive patients were being cared for, of whom eight were in intensive care and seven receiving ventilator care.

Those with compromised immune systems are beginning to receive a booster shot. Eadie said there’s still some controversy whether a booster shot is needed for everyone with the vaccine’s effectiveness.

But he said the CDC determined that it’s a good idea to get one.

“And I would agree,” he said. “Those who have real issues concerning their immune system, they can go to any of the pharmacies and fill out a form, make appointments online and receive the vaccine.”

he promise of great coffee starts as soon as one turns down Shrimp Road on Stock Island, where signs lead the way, introducing The Great Lakes Coffee Co., its pourovers, craft coffees and cold brews.

That promise is fulfilled as soon as one enters the new coffee shop and inhales.

“It’s the way a coffee shop should smell, right,” said general manager Karina Watson, who spent months at the company’s home base in Detroit, Michigan learning the science behind and intricacies of their caffeinated creations.

Located at The Perry Resort & Marina, The Great Lakes Coffee Co. opened last week. The Key West location is the company’s fifth store, and the first one outside the state of Michigan.

“The roastery is in Michigan, so we source our beans from fair trade suppliers in Africa,” Watson said, pointing to the map that’s constantly updated to show where that week’s beans were grown.

“So right now, we have beans from Kenya, Uganda and Ethiopia. Then we roast them in Detroit. And we make all our flavors right here, in-house,” she said. “Our vanilla, our spicy mocha flavor is made with homemade cayenne syrup and cinnamon.”

(The spicy mocha is a delicate mix of sweet and heat, with the spice hitting the back of the throat almost as an afterthought.)

COMPETITIVE COMPENSATION?

T

he city of Key West has been losing good workers to other public employers that offer higher pay. But officials didn’t know how much less they were paying city staff — until now.

It turns out the city is paying its employees, on average, 12% to 17% less than the county, the sheriff’s office and the local water and power utilities.

It would cost about $2.75 million to correct the situation in one fell swoop, and would result in an average increase of about $5,400 for each of the 508 positions evaluated. Some would get less if they’re already earning closer to their counterparts at other agencies; some would receive more.

Those figures are part of the salary study conducted by Evergreen Solutions, a Tallahasseebased firm that has done similar studies for other local government agencies over the past decade or so. Evergreen president Jeffrey Ling presented his company’s findings at the city’s Aug. 25 budget meeting.

The good news is the city’s seven lowest pay grades already meet the new state minimum wage of $15 per hour, Ling said, adding that the study compared the city of Key West with Monroe County, Monroe County Sheriff’s Office, Florida Keys Aqueduct Authority and Keys Energy Services. The study only looked at salaries and hourly wages and did not take into account benefits packages, retirement or pension contributions, Ling said.

Two of the biggest challenges facing Key West are what Ling called “range compression” and “rank compression.” Rank compression, he said, means there’s not enough of a pay difference between a worker and his or her supervisor, meaning there’s not much, if any, incentive for a worker to want to move up and assume more responsibilities.

Range compression occurs when there’s not a significant difference between what a 10-year

employee makes and what someone who starts today will make, Ling said.

“The city falls about 17% behind what someone would be receiving to start a job at another entity,” he said.

“There’s a 15% gap at the midpoint of someone’s career and a 12% end-ofcareer difference.”

Ling suggested that once the city reconciles its pay structure with that of its closest public competitors, then officials should consider implementing a pay plan that “rewards high performers, because they’re the ones who will typically be lured away.”

Ling also acknowledged that “this is one of the toughest times to recruit and retain employees. Private companies are doing signing bonuses and they’re even paying people to come to an interview in some cases. But really, retention is what you need to focus on in order to slug it out with other employers.”

Finance Director Mark Finigan reminded the commissioners that the $2.75 million cost of implementation would be slightly less, as the city has already budgeted a 4% across-the-board raise for employees for the coming budget year.

In answer to a question about the city’s struggle to find and keep qualified professionals, such as certified planners, Ling suggested the city look more frequently at what it is paying for those positions and adjust accordingly.

“We know from research that millennials and Generation Z have in mind a certain expectation of how often their title should change or they should move up,” Ling said. “That expectation is much shorter than what the Baby Boomers and Generation X have. And so, as a result, those younger professionals are more likely to vote with their feet and leave if they’re not promoted more often.”

Pre-pandemic, those younger professionals changed jobs about every four years, according to preliminary research, Ling said. He expects those workers will leave much sooner since the pandemic.

The Aug. 25 presentation was just the beginning of ongoing discussions among city managers and department heads, City Manager Patti McLauchlin told the commissioners.

No decisions were made at that meeting about how and when to fully implement the recommended pay structure.

hirteen Cuban migrants landed early Tuesday morning near Key West’s Higgs Beach, adding to the increasing number of illegal migrants trying to escape food, supply and healthcare shortages in the island nation that has been wracked by COVID. The 2017 ending of the United States’ so-called “wet-foot/dry-foot policy” that had allowed Cubans to remain in the country if they landed on American soil means most migrants are returned to their island nation via Coast Guard cutter.

“Most Cubans who want to try for a U.S. visa now have to go to embassies in other countries — and getting there is almost impossible due to sharp cuts in air traffic during the pandemic,” the Los Angeles Times reported on Aug. 10.

“Most can’t afford tickets anyway unless relatives can front them the money. That has pushed many

Cubans to launch themselves into the sea on small boats or rafts to attempt the dangerous crossing of the Florida Straits.

“The U.S. Coast Guard said recently it has intercepted 595 Cubans at sea since the current fiscal year started Oct. 1. That’s larger than any full fiscal year since 2017. … It’s still small in comparison with the nearly 5,400 halted at sea in 2016 or the dramatic crises of 1994-95 and 1980, when Cuba’s government temporarily stopped trying to block departures and tens of thousands set out en masse. Thousands died at sea.”

It’s also still far smaller than the current flow of those who have somehow made their way to the continent and worked their way north. The U.S. Border Patrol had recorded 26,196 Cubans trying to enter the U.S. illegally between Oct. 1 and June 30, most by land, often through Mexico, the L.A. Times article states.

ENCOUNTERS WITH THE GRAY GHOST

MARK HEDDEN ... is a photographer, writer, and semi-professional birdwatcher. He has lived in Key West for more than 25 years and may no longer be employable in the real world. He is also executive director of the Florida Keys Audubon Society.

I

was not expecting the Gray Ghost, not expecting it to come up the way it did over my shoulder, not expecting it to move on ahead and around the low bank of trees and out of my life before I could really even fathom it was there. It moved as if guided by unseen forces, smooth, quiet and effortless. I saw it for about three seconds, too fast to even think about raising my camera.

I had one of those moments where I was simultaneously ecstatic that I saw it and crestfallen that the experience had been so brief.

In the years after my father died I had a series of dreams where I would run into him out in the world – in the parking lot of a grocery store or flipping through the jazz section at Tower Records – and he’d say something like, “Oh, hey, yeah, turns out I didn’t die.” And then he’d pause for a second and say, “But I am dying now.”

Seeing a Gray Ghost always gives me the slightest twinge of that, a small and unpredictable swirl of joy and melancholy that fades in intensity faster than it rises. Which is a lot of spiritual baggage to project onto a bird that is just simply going about his day.

The Gray Ghost is a nickname for the male adult northern harrier.

The “gray” part is pretty obvious when you see them in a photo or an illustration in a field guide – their upper parts and face are a sort of a sleek ash gray. (They have some black wingtips thrown in for visual drama.) The “ghost” part has to be experienced in real life. It comes from the way northern harriers can appear out of nowhere, silent and assured, seemingly unaffected by gravity, as if existing on a different plane than our own mortal one.

Part of this derives from harriers being some of the slowest fliers out there. It comes down to wing load – long wings and a relatively light body mass make it seem as if they can just hang there, almost stopping at will in midair. Their long tails act as powerful rudders, making them highly maneuverable. The downtempo speed facilitates their hunting habits.

Nearly any account you read about the species describes them as owl-like because of their facial disks – concave groups of feathers that surround their eyes and direct sound to their ears, a bit like a parabolic mic. It allows them to hear things like mice scuttling through the grass – to track them as they start and stop, as they change direction, as they run full speed. It allows them to reach down with their long legs, seemingly out of nowhere, and grab their unsuspecting prey with needle-sharp talons. The name harrier comes directly from their tendency to harry prey.

A male northern harrier’s wings are about 10% shorter than a female’s, but they tend to be about 35% lighter. Which makes their wing load even lower and their slowest speed even slower, thus contributing to their ghost-like manner.

Northern harriers breed across the upper half of the U.S., their range stretching all the way to northern Canada and Alaska. They are leapfrog migrants, meaning the southern part of the population tends to stay in the same territories year round, but the northern population migrates over and through to more southerly territories, extending all the way into the Keys and across the Caribbean and even to South America.

According to the numbers from the Florida Keys Hawkwatch, an average of 635 northern harriers migrate into the Keys every fall. Last year was a record year, in which they counted 1,037 of them. (How many stay in the Keys and how many cross over to Cuba and points south is still unclear.)

Most of the harriers seen in the Keys are young birds, brown, but with an orangey breast and belly. (Females look similar to juvenile birds, but with a pale breast and belly.)

In the early 2000s I spent a couple seasons up in Marathon, trapping, banding and releasing migrating hawks. We managed to trap a few dozen northern harriers every year. Almost all were juveniles. Five or six times we caught adult females.

Occasionally a Gray Ghost would come into the field where our mist nets were set up. Mostly they just moved on south without hesitating. Occasionally one would take a couple loops around the field, interested, but wary. Only once did we manage to catch an adult male and put a band on it.

Most years, the Florida Keys Hawkwatch starts on Sept. 1. That tends to be when the migration really gets going. This year, mostly to see if there was a significant flight of swallow-tailed kites coming through the Keys, they started earlier, on Aug. 1. And there have been some interesting results – 648 swallow-tailed kites so far, and 724 osprey. Mixed in with all of that, they’ve caught sight of four northern harriers, all of them Gray Ghosts.

It’s unlikely that four birds means much in a statistical sense, but it’s kind of interesting that all the ones that have come through this early have been adult males. And it’s nice to think of them moving around the Keys, gliding through people’s lives, both seen and unseen, specters that are as real as any of us.

One of these days I might even get a photo of one.

The island community would suffer during the Seminole War. On Aug. 7, 1840 some 130 Indians attacked the island. Six people were killed and many of the buildings looted and burned.

Housman and his wife, Elizabeth Ann, would survive the attack and move to Key West. According to accounts by Charles Howe, who remained on the island after the attack, Housman returned to Indian Key in September. Though urged to return and reopen his general store, he went back to Key West at the end of October. In a letter written by Howe, “he cleared out for good — took everything he had left, to Key West … to sell at Auction — his Negroes — Boats — vessels & I think I see his object, he is as usual very schemey, he is a good deal in debt…”

Housman would be working a shipwreck during what was reported to be a period of turbulent weather on May 1, 1841. According to stories told about him, while attempting to move from one ship to another, he was caught between the two ships and crushed to death.

Housman’s widow, or so the story suggests, retrieved her husband and returned him to Indian Key where his body was interred beneath a marble tombstone.

The inscription reads: “Here lieth the body of Capt. Jacob Housman, formerly of Staten Island, State of New York, Proprietor of the island, who died by accident May 1st, 1841, aged 41 years 11 months. To his friends he was sincere, to his enemies he was kind, to all men faithful. This monument is erected by his most disconsolate though affectionate wife, Elizabeth Ann Housman. Sic Transit Gloria Mundi.”

onroe County completed the repairs to the partially collapsed historic archway at West Martello to match the original.

The archway is within the walls of the Civil War-era West Martello fort built in 1866 that was never officially completed. The nonprofit Key West Garden Club manages the tropical gardens along the shoreline on Higgs Beach. There is no admission, and it is open to the public.

Special events, like weddings, are often held within the walls, with the archway being a center point of many celebrations.

“We already hosted the first wedding right dab smack in front of the archway a couple of weekends ago,” said Kathleen Gillis, a volun-

teer garden club docent. “It is an iconic part of our garden, and we are so happy to have it again.”

Quitting means dealing with two habits

T

he other day, as I was returning my shopping cart to the corral at the local grocery store in Big Pine, I watched a lady take her last drag off her cigarette and then flick the butt out the window. Some quick facts: somewhere between 14% and 17% of the adult population in Florida smokes. Every year more than 32,000 Floridians die from smoking-related illness. That’s more than died in 2020 from COVID-related illnesses, and it happens every year. Additionally, almost one million Floridians suffer from chronic illnesses due to smoking.

Why is this still a problem? The root of the addiction is nicotine, one of the most addictive substances known to man.

It is on the same list as heroin, alcohol, methamphetamine and cocaine. It has both stimulant and anxiety-reducing effects.

Repetitive use causes both physical and psychological dependence. Withdrawal can be physically and emotionally difficult.

So how do you quit? You are essentially dealing with two addictions — nicotine, and the repetitive habits that you have associated with smoking. In your brain, nicotine binds to nicotinic receptors; this binding causes increased dopamine to be released. Dopamine is the feel-good chemical that our brains release after we do something we enjoy – good food, exercise, sex, and, in smokers, a cigarette. Your primary care provider can help you with this aspect. From most to least successful, varenicline, buproprion (best if used with nicotine replacement therapy) and nicotine replacement therapy all help the brain maintain increased dopamine levels, which decreases cravings.

We have learned that the habits of smoking are just as difficult to break as well. What will you do with that morning coffee? Or after an angry customer? Or while sitting next to the cart corral? I always tell people, as long as it isn’t unhealthy, do anything you like! But sometimes it is good to have some additional support. Tobacco Free Florida has numerous programs that you can enroll in, if you want to join a group, you can do that. If you would rather just check into their online resources, they can help too.

Bottom line, pick up your trash, and then call your provider and schedule a smoking cessation appointment. Your lungs, and our environment, will be happier!

Remains identified as missing Key Haven man A male body found off Key West the afternoon of Aug. 31 has been identified as 60-yearold David Martin Cottar of Key Haven.

A fisherman found David Cottar’s body around 3:30 p.m. on a flat in very shallow water near Jewfish Basin. Autopsy results are pending.

The remains of Elizabeth Estrada Cottar, 59, of Key West, had been found Monday, Aug. 30, also in Jewfish Basin near David Cottar’s anchored 17-foot Boston Whaler.

The Monroe County Sheriff’s Office is investigating the two deaths.

David and Elizabeth Cottar reportedly left David Cottar’s home in the boat Sunday night for a sunset cruise, which was a common activity for them, states a sheriff’s office report.

Anyone with information about the case is asked to call the sheriff’s office major crimes unit at 305-289-2410.

College helps high school students with applications The College of the Florida Keys is teaming up with the Key West Chamber of Commerce to help local high school students, their families, mentors and guidance counselors navigate the college decisions, requirements and deadlines in a free workshop titled “Ready, Set, COLLEGE!” The gathering will take place virtually from 5:30 to 7 p.m. on Wednesday, Sept. 8.

The first part of the workshop will focus on writing. Students will receive tips for writing effective essays for both college admissions and scholarship applications. The second half of the workshop will be dedicated to learning about different ways to pay for college through federal grants and loans, scholarships, and payment plans.

A POSITIVE OUTLOOK WITH RAY WEST

M

ulti-instrumentalist singer/songwriter Ray West has been playing music in the Florida Keys since making Key West his home in 2008. His journey is one of personal, professional and spiritual growth.

West had a challenging BEN childhood and upbringing.

West always had a love and interest in the arts. He enrolled as a theater major at Morningside University, a private institution in Sioux City, Iowa. He spent a couple years in school, but a lack of self-confidence and some poor decision-making prompted him to drop out of school.

At this point, he had not taken up music. He owned a little harmonica and would listen to R.E.M’s “Out of Time’”album and play along until he figured out a few notes.

“At the time, I had a crush on a gal who played the flute,” says West. “I went and bought a flute and hit the streets in Minneapolis to busk for money. I only knew about four notes, but got to be pretty good at playing them quickly and rhythmically.

One day, a lady sat and listened to me for a bit, wrote me a check for $20, told me that my playing made her think of springtime, and thanked me. At that moment, I knew I wanted to play music.”

West met two other struggling musicians, a guitarist and a percussionist, and they formed a trio called Third Stone. They began to play music around Minneapolis and became quite popular. However, poor decisions led to their split and Ray began to play solo music. He soon recorded the first of his four solo albums of original music.

After spending time playing music in many towns and at festivals, following the Grateful Dead tour and even spending time as a music mentor for special education children in Cleveland, one of West’s longtime friends, Johnny, called and said he should come down to Key West to check out the scene. Johnny, many of you may remember, played his flute with his dog by his side out on the streets of Key West for many years. Ray took Johnny’s advice and came to the Keys in 2008.

“The first person I saw perform here was Raven Cooper,” recalls West. “I thought to myself, ‘Well the bar is quite high down here. I hope I can measure up.’”

West was eventually hired by Looe Key and Willie T’s for his first paid gigs in the Keys. West began to find work as a musician while also building a successful side job as a painting contractor. He has continued to pursue his music career in the Keys and has been involved in many great events and benefits. West established “Votes for Notes,” which was a talent competition that served as a benefit for Habitat for Humanity. It was a three-day annual event where attendees would vote for their favorite musical acts with money rather than votes. Whoever received the most money (votes) would be declared the winner and all the money would go to Habitat for Humanity.

West has recently been involved in a few very cool tribute events. He fronted and led a Jethro Tull tribute band at the Conch Town Record Music Video Festival in Marathon in 2020. In March of this year, West played lead guitar in the Allman Brothers tribute band fronted by Gregg Allman’s son Michael Allman.

Although he enjoys playing cover music and tributes, West really wants to push a movement for original music here in the Keys.

“There are many talented musicians here in the Keys. Several of them have written some great original music. I would love to see the Keys become recognized as a hub of great original music. I love to see others’ creativity. It’s a refreshing change from playing covers.”

West continues to push himself to grow as a musician and as an individual.

He wants to inspire others. West has mentored a few young musicians in the Keys including rising star Shastina Chiles.

He continues to encourage others to be creative and play their original music. His musical, personal and spiritual growth has helped him to take on a new outlook in life.

“My current mantra is, you’ll never outperform your own self-image. Make sure you have a healthy one. You can and will certainly succeed when you truly believe that you will.”

Women’s flag football has been a long journey

After the games end, the players shake hands and there are lots of smiles.

“That’s the way all sports should be,” she said.

We were having lunch once again as I learned the advances of flag football since last we met. I have admired her tenacity in driving her sport, so much so that we have met almost every year. This year, she offered a new restaurant, Kennedy’s on Kennedy Drive. I hadn’t been there for many years. Expansive menu. Great food. Super service. I highly recommend it.

Past restaurants in our string of meetings have included Bobalu’s on Big Coppitt and Goldman’s in the Winn-Dixie Plaza. I would recommend those, too.

As we talked, she said she was already packed, getting ready for a trip to Jamaica.

“Next year, I’m going to Pakistan and Sierra Leone,” she said.

Beruldsen is playing catchup after the virus kept her from traveling last year. All of this leads up to the Kelly McGillis tournament Jan. 24-31, 2022, in Key West. “It’ll be the official 30th tournament,” said Diane. “We had a 30th this year, but it was just for local teams. The teams around the world couldn’t travel. So we’ll have the official 30th next year.” The founder says the largest tournament was in 2001 when 48 teams participated. Now, the tournament includes social events as well as clinics for playing, coaching and officiating and the women’s speakers program, which is how she met Jaimie Saffa.

Saffa had contacted Beruldsen about coming to Key West and played on the Loose Women’s team, which is a team of players unaffiliated with any group of players. During the speakers program she told her story.

She had lived in Sierra Leone during the time of a civil war from 1991 to 2002. Saffa talked about being raped, her father being killed and her brother having both hands cut off. She, her mother and brother escaped to Canada.

But next March, she will meet Beruldsen back in Sierra Leone to spread the gospel of flag football. “We’re already scheduled for four cities, teaching flag football to the girls in the schools. It’ll be our biggest promotional tour.”

Raising funds to support her travels has always been a problem. She has cleaned homes.

She delivered mail. She has been a substitute teacher. She has worked as a server at several island restaurants. She has tried a variety of jobs that will allow her to continue her extensive traveling, introducing the game and working as its ambassador.

Two years ago, Diane went through chemotherapy and radiation to recover from colon cancer. She’s had cataract surgery in both eyes.

It cost a sum, which she got from her partner, Wenke Breistein. “Any time I can’t find something,” she says, “I want my money back for the eye surgery,” she laughs. Beruldsen and Breistein, who is from Norway, have been together for 20 years.

Diane says they won’t get married because “the government kept us from being married for so many years.”

She is also super active with the Stock Island Association.

At 62, and still pounding her Brooklyn accent, she only plays when necessary, meaning when the “Loose Women” lack players.

Her role, besides being the queenpin of women’s flag football, is officiating games. She plans to retire from all of this in five years.

But, she’ll always be the founder.

W

ith a loss, but well-played, in its opening game, Key West High’s football team heads to Port St. Lucie Friday, Sept. 3, for a 7 p.m. game against Centennial.

After a week off, the Conchs play their first home game at 7 p.m., Sept. 17, against St. Brendan at the Backyard behind the high school. Centennial lost its opener, 17-13, at Sebring.

Key West lost, 16-13, at Palmetto Ridge on Aug. 27, giving up a pair of touchdowns and two-point conversions in the first quarter before almost pulling out the victory by manhandling the home team in the second half.

Palmetto Ridge scored on an 80-yard pass on the third play of the game and scored a second TD on its second drive, both times adding a 2-point conversion.

When Key West scored, still in the first half, coach John Hughes obviously felt that the Conchs had to go for the two-point conversion as well. It failed.

Early in the fourth quarter, a 13-yard pass from Preston Herce to Mike Cates plus a kicking extra point, brought the Conchs to within 16-13, the final score.

CRUISE INDUSTRY RESPONDS THE LETTER BELOW WAS SENT AUG. 27 TO KEY WEST OFFICIALS Dear Mayor Johnston, We are writing on behalf of the cruise line members of the Florida-Caribbean Cruise Association (FCCA) and the Cruise Lines International Association (CLIA) who respect Key West and the community’s input on cruise operations. We have reviewed the “legislative intent” document which is before the City Commission outlining the rationale for the ordinance to greatly restrict cruise ship operations. The document suggests that the ordinance would provide protections for public health and local medical infrastructure; result in incidental benefits for quality of life, the environment, and the economy; and that it would have no excessive burdens to commerce. As the justifications for the ordinance do not accurately represent the current state of the cruise industry, we would like to correct important misrepresentations for the record.

The document states that public awareness of the health risks of cruise ships has increased because of scientific, regulatory, and media scrutiny during the COVID-19 pandemic. It also suggests that cruise ship travel increases the risks of COVID-19 and other disease transmission in Key West and other port communities. However, under the U.S. Centers for Disease Control and Prevention’s (CDC) Framework for Conditional Sailing Order, associated technical instructions, and the CDC’s COVID-19 Operations Manual, the cruise industry is now the most highly regulated travel and tourism sector in the United States, and it has the most comprehensive set of preventive protocols and surveillance and response procedures. No other sector must adhere to such comprehensive requirements developed by the CDC. Further, extensive scientific and regulatory scrutiny during the COVID-19 pandemic, as well as the cruise industry’s ongoing consultations with medical and public health experts, has resulted in the development of highly effective protocols for the mitigation of COVID-19 from the time of guest booking, through all aspects of a cruise itinerary to disembarkation.

Media scrutiny associated with the outbreaks of COVID-19 aboard cruise ships in early 2020 occurred when no public health authorities understood the nature of COVID-19, the means of transmission, or proper response and mitigation strategies. The rate of infection on cruise ships in the early days of the pan-

demic was comparatively easy to detect due to industry reporting requirements; however, as the world subsequently observed, the rate of infection was equally serious in virtually all other comparable settings. Most importantly, the “legislative intent” document fails to account for the extraordinary amount of learning that has occurred over the past year, and how the industry has completely revamped its public health protocols based upon what we now know about the virus and its behavior. The cruise industry is in a very different place today. Since limited, phased-in resumption of cruise operations began in July 2020 in Europe, more than a million passengers have sailed on cruise ships globally with a minimal number of COVID-19 cases and a very low passenger infectivity rate of 0.004 percent. The updated public health protocols have proven to be effective; this is further enhanced by the availability of highly effective vaccines. CLIA cruise lines are operating with high percentages of fully vaccinated passengers and crew typically at upwards of 95 percent to 100 percent, which far exceeds levels of vaccinations at venues on land.

The statement about available medical capability in Monroe County overstates the potential shoreside medical needs of cruise ships and ignores the highly vaccinated population on cruise ships. It also appears to omit consideration of visitors to Key West that arrive by other means such as land or air that are not subject to the same COVID-19 mitigation standards or vaccination requirements in place for tourists arriving by cruise ships.

The document also outlines how the ordinance would bring incidental positive benefits to Key West residents, including the protection of environmental resources through reductions in the turbidity of local waters. It should be noted that the referenced study on turbidity by the U.S. Navy was from 18 years ago and appeared to have been undertaken in conjunction with a dredging project, which would naturally raise turbidity concerns including the contributory effects of wakes produced by passing ships. Normal cruise ship operations, however, are subject to strict environmental protection requirements.

For example, the U.S. Environmental Protection Agency’s Vessel General Permit and the forthcoming Vessel Incidental Discharge Act regulations, as well as the cruise industry’s self-imposed commitments under CLIA’s Waste Management

Policy, create a highly regulated framework for protecting the quality of local waters.

Additionally, the document refers to a 2021 report from Florida International University’s Water Quality Lab that “found water quality indicators desirable for the health of corals and seagrass beds, including turbidity, showed significant improvement during the year-long cessation in cruise ship traffic from March 2020-March 2021.” However, what is not noted is that the report also acknowledges that, “Waters around Key West are in an extremely dynamic environment. It is the site of major interaction of the Gulf Shelf, the Florida Current and the islands chain.... Those regional players may blur local changes very easily.” This underscores the complex and evolving nature of the situation.

Finally, based on the stated overarching legislative intent to protect public health, safety, and welfare in the City of Key West, it would seem the ordinance would be applicable across multiple travel and tourism sectors, including visitor arrivals by land and air. However, the ordinance focuses on cruise lines, which make up around 20 percent of tourism in Key West and have the travel and tourism industry’s most comprehensive protocols in place.

The cruise industry strongly values our longstanding partnership with the City of Key West and its businesses and residents, and we look forward to finding mutually agreeable solutions. ‘MISSION INSPIRE’ Classrooms go beneath the surface and on the bay JIM McCARTHY

nside Monroe County classrooms, students will take their learning beneath the depths as they explore the world’s only underwater research and education laboratory. Through data collected by Florida International University scientists, young learners will also interpret and analyze water quality data from Biscayne Bay, where excessive amounts of phosphorus and high water temperatures have led to massive fish kill.

Interactive lessons and engaging activities have arrived inside Keys classrooms through FIU’s “Mission Inspire.”

The Monroe County School District is the first to adopt and take part in this new FIU curriculum, which includes digital courses, or “expeditions, that utilize research to make lessons relevant.

Elaine Pritzker, director of education outreach for FIU, said the new “Mission Inspire” simplifies concepts and provides real world examples to connect what they’re learning. Comprehending gas pressure laws can be a tough concept to pick up on, but applying it to scuba diving can help learners understand the importance of pressure at various depths.

“Mission Inspire” also shows that science is not just for researchers and lab technicians.

“It requires a lot of different people,” she said. “Even if you see yourself as a communicator, there’s still something you can do and you can be part of this.

We’re also showing the exploratory nature of science and how you don’t always get it right the first time, and that we learn when something doesn’t go the way we expect it.”

FIU’s education outreach program prepared for a series of in-person field trips in early 2020 for Monroe County Schools, thanks to funding from Royal Caribbean. After the first few, the global COVID-19 pandemic struck, forcing the team to pivot to virtual field trips. When those concluded, the school system wanted to continue the partnership, mentioning their teachers needed more interactive content and curriculum for their classrooms.

Education outreach decided to expand their programming — and came up with “Mission Inspire.” The team created everything that goes into each module, including lesson plans and other supplemental materials, like videos, and made sure each lesson in the learning modules ties back to research conducted by FIU scientists.

FIU’s new curriculum includes “Expedition Ocean,” which takes students to Aquarius Reef Base to learn more about the coral reef ecosystem, issues of coral bleaching and sea level rise and what scientists do in the underwater research lab. Deployed 60 feet beneath the surface of the Florida Keys National Marine Sanctuary, Aquarius provides unparalleled means to study the ocean. It also serves as training grounds for specialized divers and astronauts.

“Aquarius is something that is so unique. Anyone who has read about “20,000 Leagues Under The Sea” or seen “Atlantis,” the idea of living underwater is something we thought would be exciting.

That would give us a hook to touch on other issues we knew were core to what students are trying to learn,” Pritzker said.

Everything from water quality data to the loss of mangroves due to development are examined in “Expedition Biscayne Bay.” Students will also learn the detriments surrounding marine debris and how human activity plays a role in wildlife, the community and tourism.

“These are really big problems that are going to require a lot of different people working on a lot of different levels,” Pritzker said. “It’s inspiring not only students, but also parents. It’s a whole community effort that they’re most invested in. We’re also trying to bring this outside of the Keys to places that are more landlocked, because they have a role in it too.”

Pritzker added that it was a “no-brainer” for FIU to go to Mornoe with the new curriculum.

“We're in their community. We feel that’s part of what we want to do. We want to help them understand what we’re doing in our backyard and what they can do,” she said Teachers like Joylyn Smith, a marine science and environmental science teacher at Key West High School, are excited to use the “Mission Inspire” curriculum in their classes.

“I'm looking forward to using these lessons to foster a sense of ownership in our local environment in my students,” Smith said. “I am a huge advocate of place based environmental education and these lessons are incredibly relevant and well thought out.”

As the Marathon editor, I have too many good things to say about the Keys Weekly Newspaper and Marathon community to put into words here, my last issue as editor. (Though I plan to be a frequent contributor for the rest of my life.) I know that I am leaving at the top of my game for the top news organization in the Florida Keys and I am proud of what we have all achieved together. I know that the friendships I have made at the paper, and through the paper, are forever.

Mark and I will never leave Marathon — we love it way too much — but look forward to being able to get off the rock to see our family more often. Who knows, we might even begin to socialize at places other than the shop or the office.

You know who else didn’t leave?

The bugs. And so I’ll back slowly and quietly into the bushes a la Homer Simpson with this, the story that put me on the map, published in the Oct. 13, 2012 issue of the Marathon Weekly.

Household mystery bugs explained

By Sara Matthis Those little yellow and black-striped crunchy worms that seem to appear magically overnight INSIDE Keys homes have a scientific name. Officially, they are called the yellow-banded millipede.

And we got ’em first.

“The record states that they were found first in Monroe County in 2001,” said Kim Gabel, her very professional tone suggesting otherwise. Gabel, a horticulture agent with the University of Florida’s Monroe County Extension Service, said it’s not known how the Caribbean bug landed on our shores, but it has since spread to Broward and Miami-Dade counties.

Gabel assures callers (me) that they are just a nuisance. They aren’t venomous or destructive. They don’t eat household plants or poison pets.

They just make a really disconcerting crunching noise when stepped on — barefoot — in the middle of the night. Oh, and if you don’t turn on the light and clean it up right away, it’s gonna leave a mark.

“I just sweep them up and put them back outside,” Gabel said. “They are part of nature’s brigade, so to speak. The bugs break down our wood chips and create a nice fertilizer for us.”

For those seeking a more permanent solution, try adding some weather stripping to the front and back doors. Seal up the vents to the outside.

It’s possible the bugs are seeking the light or moisture. Certainly, if the millipedes knew what they had coming to them, they wouldn’t want inside the house.

“Once they enter the building, usually within 24 hours, they die due to the dry conditions,” reads one pamphlet.

One last note: Monkeys in a MiamiDade County zoo have been observed rubbing their fur with the yellow-banded millipedes. Some grackles (songbirds) have been seen to do the same thing. Apparently, millipede secretions act as an insect repellent. Eeeewww.

CARDIOLOGIST DISCUSSES WOMEN’S HEART HEALTH

t was all about women at the Key West Business Guild’s monthly luncheon on Wednesday, Sept. 1 at the Marriott Beachside Hotel.

The luncheon marked the official start of Key West Womenfest 2021. The event is sponsored by the guild and takes place Sept. 1-5 at various venues all over the island.

“For decades, the five-day celebration of Key West’s Womenfest has attracted thousands of lesbians, trans women and allies to what is arguably the premier LGBTQ+ vacation destination in the country,” states the event website. “Womenfest has a simple goal: to celebrate ALL women.

The festival offers a wide range of activities for those who want to socialize, feel comfortable being themselves, soak up some sun, then party and dance the night away. Couples, singles, and those in between are all welcome.”

Continuing the celebration of women at the guild luncheon, cardiologist Dr. Joan Homan explained the increasing cardiovascular risks that women face while they age and enter menopause.

“Our bodies’ estrogen protects us from heart disease and high blood pressure — until menopause, that is. Then our risk is the same as it is for men,” Homan told the lunchtime audience while outlining other heart risks such as smoking, obesity and an inactive lifestyle.

that it is submitting an application for a CDBGMIT-CIP grant for $4.6m to fund the improvements to the Cocoplum Beach area that will benefit all the local residents as well as visitors. Improvements include elevating roadways and drainage improvements to alleviate the loss of road access and floodwater inundation impacts due to sea level rise and storm surges. The implementation of this project is critical to this area, and they are based on recommendations on the FDEP Coastal Resiliency, Marathon Resiliency- Phase 1 grants completed in June 2019 and the Cocoplum Beach Area- Phase 2 study completed in June 2021.

This project is an effort led by the City staff to mitigate any damage and future loss of property and lives and it is considered a strategic investment to minimize risks and reduce losses on a service area with over 60% of low to mid income residents.

As shown in previous storm events, this area has been critically disrupted with severe flooding, and roadway failures. When this flooding occurs, residents and businesses in this area are trapped or prevented from doing business as usual. Frequent, prolonged inundation has damages roads, infrastructure, businesses and homes. During these flooding events, emergency response time are also increased, escalating the risk to the residents. Investing in mitigation projects like

this will improve the City’s resiliency by protecting our local residents and will enhance the CDBG-MIT community lifelines of safety and security, transportation and health and medicine.

CITY CLERK FULL-TIME Serves as City Clerk for the City and Commission. Maintains city records. Supervises City elections. Coordinates activities of commission, committees, and citizens. Provides review of financial services including monthly financial statements, accounts payable, accounts receivable, payroll and audit support. Coordinates annual budget process under direction of the city Administrator. Provides Risk Management and Human Resources services for city. Provides support to other city departments when needed. Reports to and works closely with City Administrator to support daily operations.

Requires a high degree of initiative and independent judgment.

CODE ENFORCEMENT OFFICER FULL-TIME Department: administration Salary: $52,000.00 Benefits include: medical, dental, and life insurance; paid vacation, sick leave and holidays; and retirement (employee only) Job Description The Code Enforcement Officer conducts inspections and investigates complaints for compliance with City codes and ordinances, including the inspection of short term (vacation) rentals, and enforcement of short term (vacation) rental codes and ordinances. The Officer seeks to obtain compliance with City codes through citations or warning notices while assuring due process to violators. The position is required to prepare letter and written documentation necessary to take violators to hearing for enforcement action and to provide testimony before the Code Enforcement Adjustment and Appeals Board. This position reports directly to the Code Enforcement and Vacation Rental Manager. Work is performed under general supervision which requires initiative, independent judgment, and organizational skills. The Code Enforcement Officer must deal effectively with the public, property owners and contractors to obtain compliance.

Job Responsibilities - Administers and enforces the City’s short term (vacation) rental ordinances and actively manages the City’s program to register, inspect and monitor short term (vacation) rentals within the City.

- Investigates complaints regarding code violations pertaining to building, housing, zoning, tree, sign, and other City codes by conducting field investigations and property research.

- Regularly attends and provides testimony before the Code Enforcement, Adjustments and Appeals Board or Special Magistrate regarding code violations.

- Provides violators of City codes with citations or notice of violation and gives the violator due process to comply with City codes.

- Routinely patrols designated area for potential code violations, including violations of the short-term rental ordinances, overgrown lot and untagged or inoperable vehicle, and all other applicable local civil laws and submits weekly inspection reports to the City Administrator.

- Maintains records regarding code violations via a computer-aided tracking system, and documents files until compliance is obtained or a lien is imposed.

- Prepares letters for notice of violation and notice of hearing, clearly identifying code violations and appropriate corrective action.

- Conducts follow-up inspections to previously identified code violations to ensure that code compliance is maintained.

- Assists with permitting and inspection to the degree certification is necessary and obtained from the CITY of KCB. - Maintains vehicles and equipment used in the code enforcement process in good working order.

- Nights, weekends and holiday work will be required, floating 40 hours per week.

- Typical day 2 hours office 6 hours on the road.

- Performs other related duties as assigned.

Education, Training and Experience - High school diploma required. Experience using computer software and applications. Good written and verbal communication skills, and excellent public relations skills are a necessity. Two years’ experience performing public contact work and demonstrating written, verbal, computer and organization skills is required.
