ey West’s mask madness has gotten ugly, with business owners and residents turning against city officials — and each other — in their efforts to curb the spread of COVID-19 and prevent business closures.

A Facebook group called “No To Key West Outdoor Mask Mandate” has formed in opposition to the city commission’s Nov. 19 passage of an emergency ordinance requiring masks whenever someone leaves their residence.

Restaurant owner Joe Walsh’s businesses — Jack Flats, Waterfront Brewery, Caroline’s and Fogarty’s — have received 10 of the 13 citations issued by code compliance officers for non-mask compliance. Walsh told the city commission on Thursday that he has a “don’t ask don’t tell” mask policy in place because the way to prevent infection is by keeping sick people away from others. Walsh said he ensures his employees are paid and fed during their quarantine period. Of his 463 employees, his restaurants have seen 12 positive cases and have quarantined 62 workers, Walsh told Keys Weekly on Nov. 20.

“The city is overly simplifying things by saying that wearing masks keeps people safe,” he said. “It’s giving people an artificial sense of security that masks will prevent infection. The way to prevent infection is by keeping sick people away from other people, not by telling sick people to wear masks and go to work.”

Business owner Marie Pierre Sanders agrees with Walsh about the mask requirement and accused city officials at Thursday’s special meeting of disregarding the governor’s executive order that prohibits penalties for individuals not wearing masks.

“What makes you, Madame Mayor and city officials, think you’re above the governor’s executive order?” she asked.

“Our island is being destroyed by your actions and people are turning against each other.”

Longtime resident Christine Russell reminded the commissioners they were elected to represent — and protect — everyone, “not just the business owners.”

Other restaurant owners have pleaded with city officials not to let the actions of a “few bad actors” prompt the city to enact a shutdown of all businesses, most of which are working to comply with the mandate.

“The division that’s happening in this town is not good,” said Bill Lay, who owns La Trattoria, Virgilio’s and La Trattoria Oceanside. “Close to 100% of businesses are trying to comply, but the bridges between people are growing longer, not shorter.”

Restaurant owner Danny Hughes of Two Friends Patio Restaurant suggested in writing that the city “use the tools that it has” by enforcing its lease with Walsh for the city-owned property he leases at Waterfront Brewery.

“With the resurgence of COVID cases in Key West, the city commission has re-enacted one of the most onerous mask ordinances in the country,” Hughes wrote. “Requiring a mask when walking outside alone has no basis in science, which has already been proven. Why not enforce the existing ordinances — and the existing leases that are in place — to try to reverse the resurgence of COVID-19? The majority of the business community has responded admirably to the pandemic, but there are a few ‘bad actors’ that geometrically drive the number of cases upwards. It is unconscionable to punish the majority of businesses with a shutdown for the sake of a few businesses that we do not hold accountable under the terms of their leases. In short: Use the tools you’ve got before buying new ones.”

Walsh said that the city’s code case against Waterfront Brewery for mask non-compliance was dismissed on Nov. 19.

TIMING IS EVERYTHING DAYTIME COMMISSION MEETINGS DRAW 100+ PARTICIPANTS

T

here’s no such thing as perfect timing when scheduling public meetings so they’re accessible to the most participants. But two recent special meetings, held in the morning, drew four times the number of online participants as the two most recent evening meetings.

Granted, the daytime meetings included specific and attention-getting topics, but the increased daytime attendance prompted the Keys Weekly to take a closer look at the city commission’s meeting schedule and public meetings in general.

“There was a time when most people worked 9-to-5 jobs, came home, and filled their evenings with community and social events. The American city council meeting was built to serve people with this lifestyle,” states an article by Boxbast, a company that provides live streaming services for municipal governments. “However, the 9-to-5 lifestyle is no longer the norm. People work all hours of the day. They travel more. They have more outside-of-work activities. With so many things pulling them in different directions, people are prevented from dedicating an evening to their city hall to hear about community happenings.”

Key West’s tourism industry means thousands of residents don’t start work in hotels, bars and restaurants until after 5 p.m., when the commission meetings typically begin.

The two recent daytime commission meetings, held on Nov. 10 and Nov. 19 to discuss a potential citywide curfew and the city’s COVID regulations, respectively, drew 111 to 126 online participants, with several others in person.

The Nov. 17 regular meeting that started at 5 p.m. — and also included a COVID-related discussion — drew 37 participants. By the time the officials reached the COVID update, which was the last agenda item, the attendance had dropped to 25, according to the information on the Zoom meeting screen.

Since Mayor Teri Johnston took office more than two years ago, the city commission has been meeting at 5 p.m. and has included an e-comment feature that allows citizens to submit online comments about particular agenda topics.

The Keys Weekly asked some local business owners whether daytime or evening meetings are better for them, and some elected officials whether they’d consider holding one daytime and one evening meeting per month to provide greater access.

Restaurant owner Bill Lay, who has attended recent daytime and evening meetings online and in person, said he would prefer daytime meetings, “but I will accommodate whatever,” Lay said.

Restaurant owner Joe Walsh, who has also attended all recent meetings online or in person, said, “I preferred the old 6 p.m. start time on first and third Tuesdays, But I could see arguments for both day or night.

Currently, I think COVID responses, protocols, as well as dramatic technology improvements, are stronger drivers than starting times. There are many more remote attendees. One daytime and one evening meeting per month would allow broader participation. I am not sure the city wants that. The decisions seem to come to a vote already decided. The public, if invited, might be able to share a different perspective and we can’t have that.”

Many officials were amenable to possible changes.

Johnston said she would consider alternating one daytime and one evening meeting per month. Commissioner Mary Lou Hoover said, “I’m flexible.”

“I have supported including daytime meetings in the past. I like the idea of alternating daytime and evening meetings to potentially give the most opportunity for public input,” Vice Mayor Sam Kaufman said.

“Daytime meetings allow for the advantage of city staff being available. We have had low attendance in the past during daytime meetings and evening meetings. Attendance and participation does seem to be a function of the topics. Historically, our budget workshop meeting is during the day and has very few attendees from the public as an example.”

Commissioner Clayton Lopez had a slightly different perspective.

“I don’t think that the numbers we can look at currently are a true measure of participation. Both of the recent daytime meetings were for a specific purpose and were dealing with issues that required our doing so,” Lopez said. “I would be open to alternating meetings. But strictly holding daytime meetings, I would oppose. Were this topic brought up last year (and it was), I wouldn’t be able to attend because I was still working. That’s true for a number of my constituents as well. My concern is if the meetings were held during the day, I nor my predecessor would have been able to entertain the thought of running, because we both worked. Most working people don’t get off from work until at least 5 p.m.”

When asked about the challenge in a tourism destination, where hundreds of hospitality workers don’t start work until after 5 p.m, Lopez said, “I understand and agree. That’s why although my preference is evening meetings, I wouldn’t oppose alternating.”

‘HOPING THINGS GET 2021 ’ BETTER IN YEAR TDC ALLOCATES MONEY FOR KEYS EVENTS

P

robably the best predictor of what 2021 holds for the Florida Keys is the Tourist Development Council’s calendar and funding plan. The budget has been approved, and it looks a lot like years past.

“The same organizers are applying, but we didn’t have as much money to give out this time,” said Vicki Tashjian, chair of the DAC III in the Middle Keys. For example, in 2019, the Key West Songwriters Festival received $150,000 in seed money. In 2021, it’s $100,000.

While the budget reflects a best-case scenario, already several big events in the Upper Keys have been canceled due to the COVID-19 pandemic — Holiday Fest in December and Baygrass Bluegrass in February. The Gigantic Nautical Flea Market will be virtual in 2021, but in a normal year is the second or largest event in terms of attendance in the Florida Keys.

In November, organizers of the Marathon Seafood Festival asked the Marathon City Council permission to continue planning for the event normally held in March.

“We’re planning and hoping things get better by the time of the event,” said Marathon Chamber of Commerce CEO Daniel Samess.

In conversations with Bob Eadie, the county’s top health administrator, Samess said they will be looking for low positivity rates and numbers trending down.

“If we go ahead, the event will be in complete compliance and reliant upon the department of health’s guidance and blessing, as well as local municipal measures that may be in place,” he said.

Samess said that if a TDC-funded event is canceled due to the pandemic, organizers have the ability to return the money or postpone it.

“We have options. None of them are ideal, but it is what it is,” Samess said.

The Harbor Walk of Lights at Key West’s Historic Seaport is part of Key West Holiday Fest, which received $35,000 in tourism event funding.

T

he giant truck came from North Carolina, not the North Pole, but it smelled like Christmas in Key West on Nov. 23, when volunteers unloaded more than 600 Christmas trees for the MARC organization’s annual tree sale.

Although not scheduled to start officially until Friday, Nov. 27, executive director Diana Flenard said they’ll start selling trees as soon as people want to start buying them. Workers at the Monroe Association for Remarkable Citizens have been busily unwrapping and setting up displays.

Two additional tree shipments will arrive in the first two weeks of December and the sale will last until Christmas Eve — or until all the trees are sold.

The tree sale is MARC’s largest annual fundraiser, and also features decorated wreaths, poinsettias, mistletoe airplants and a gift shop filled with ornaments and decorations.

CASES INCREASE, RECATEGORIZED AS KEYS ENTERS SNOWBIRD SEASON

wo COVID-19-related deaths were reported in Monroe County over the last week, bringing the total to 27 since March when the pandemic emerged in the Keys.

Seventy-six new cases were confirmed to the Florida Health Department in Monroe County over the last weekend. And as a result of local contact tracers’ work, 321 cases in the Keys were recategorized from “missing city” to the person’s location at the time of the positive test.

Since March 20, cases out of Key West have approached 1,800, while confirmed COVID-19 cases in Key Largo are nearing 400 and 300 in Marathon. Cases are just over 3,140 as the Keys enter holiday and snowbird seasons.

With the holidays approaching and more people traveling, Bob Eadie, health officer for the Florida Health Department in Monroe County, is placing emphasis on wearing masks, social distancing and avoiding crowds to decrease chances of exposure to COVID-19.

“Is it concerning about Thanksgiving and the travel that’s going on? Yes. And I understand people are really experiencing the pandemic fatigue for all of this, so they want to see their loved ones and they’re traveling,” he said.

“But activities like that without taking precautions really open the whole population to a much worse situation than we had the first time around.”

Increased cases have brought increased contact tracing efforts. Eadie said it’s manpower-intensive to call several people who may have been in contact with a confirmed case.

New guidelines on Nov. 23 from the Centers for Disease Control and Prevention, however, state that case investigation and contact tracing should not be pursued if more than 14 days have elapsed since the specimen collection. The CDC goes on to urge health departments to prioritize case investigations of people who tested positive for or were diagnosed with COVID-19 in the past six days.

“It’s concentrating on priority cases in a way, and I don’t know how they’re going to define that … just in the sense that with so much of the spread of the COVID virus, traditional contact tracing is just not effective as it could be, having so many cases to follow up,” Eadie said. “You need to figure out how we mitigate what’s going on in (the) community because it’s here, and you can’t prevent it from being here now, so how do you make sure it has the least impact? That’s really where we are right now throughout the country and Monroe County as well.”

As of Nov. 24, six people were hospitalized at Lower Keys Medical Center with COVID-19.

Fishermen’s and Mariners hospitals had none.

Eadie said while a vaccine is coming, it won’t be widely available to the public until late spring and early summer.

No, this isn’t a test for a hernia, rather a new collection method to test for COVID-19 called Curative. It is FDA-approved, self-administered, free and available in the Keys. Best of all, it has none of the unpleasant characteristics of the nasopharyngeal swab that features a far-reaching swab that invades the nasal and sinus cavity. And, because the patient and administrator don’t come into close contact, it’s safer too.

“Our unique, self-collected oral fluid swab COVID-19 test offers a painless, simple option with quick (24 to 48 hour) results and no cost to patients,” said CEO and co-founder of Curative, Fred Turner.

According to Curative, there are 8,000 testing sites nationwide. A search of the company’s web site shows a handful in South Florida, plus one on Big Pine Key at the Moose Lodge.

The procedure is for the patient to cough multiple times to release the virus from the upper and lower respiratory

tract, then swish the saliva around in his or her mouth.

The patient then swirls the swab on the inside of both cheeks, underneath and on top of the tongue, the roof of the mouth and in between the teeth and gums.

Patients put the swab in a provided tube and give it to an employee. Results are sent in a day or two via text or email.

Curative’s test received emergency use authorization from the FDA in mid-April and has been widely used in places like Los Angeles and Chicago, as well as for testing NBA players and employees. Turner said his company’s clinical trials have found their oral fluid collection method to be 90% accurate in detecting COVID-19.

Curative has three labs — in California, Texas and Washington, D.C. The test is free and no insurance is necessary.

eysHelp.org is a new website helping Monroe County residents cope with the impacts of the pandemic and apply for various assistance programs in English, Spanish and Creole.

United Way of Collier and the Keys and the Florida Keys Outreach Coalition encourage Keys families and individuals financially affected by COVID-19 to apply for up to $250 per month for assistance with food, prescriptions, medical bills, childcare, communication and transportation costs.

Additional community resources and information are available at KeysHelp.org, with more being added in the coming months.

Since March, the number of residents seeking assistance with critical needs more than doubled.

Calls for help have grown dramatically, as the ALICE (AssetLimited, Income Constrained and Employed) families that United Way of Collier and the Keys serve have been heavily affected by the economic toll.

“These households live paycheck to paycheck, with very little or no savings to help them deal with unexpected expenses or loss of income like those incurred during COVID-19,” said Leah Stockton, UWCK Keys area president.

“Requests for assistance are at an all-time high, including in the wake of Hurricane Irma. We are also seeing many callers who have never needed to seek assistance before.”

HELP WITH THE RENT/MORTGAGE M DEADLINE TO SPEND THE MONEY IS LOOMING

onroe County received $13 million in CARES Act funds. Part of it — $1.43 million — is to help Keys residents with rent and mortgage payments missed due to pandemic-caused unemployment.

Right now, county staff is racing the clock to get it all spent — properly. The funds must be spent by the end of the year, and local officials need time to dot all the i’s and cross all the t’s before the checks can be cut.

The good news is that eligibility is easy to meet — tenants or mortgage holders must fall under the median income range, or a single person making $84,600 or less and be able to demonstrate a hardship caused by the pandemic. Furthermore, anyone who qualifies can get his or her rent or mortgage paid in full for 10 months (March through December).

According to Social Services Director Sheryl Graham, 312 Keys households have applied and 143 households are in various stages of pending approval. So far, 100 households have received assistance in Monroe County, according to Graham.

“We are extremely hopeful we will be able to serve all who are eligible,” said Graham.

The delay is an outgrowth of the twopart application process. Mortgage holders or renters must provide at least seven different types of documentation ranging from income to leases, and then landlords or banks must agree to, and apply, to become “vendors” on record with the county. Checks are cut directly to the banks or landlords, in full, for the 10 months. Social Services staff is handling the applications and the Clerk of the Courts staff is auditing the applications and issuing the funds.

“The documentation required … it’s voluminous,” said Lisa Tennyson, the county’s legislative affairs director.

Monroe County was one of the last areas to receive the CARES Act funding for rent and mortgage expenses, and applications weren’t issued until August. It took another month to work out the details with the Clerk’s office on what type of documentation was required and checks began being issued in late September.

“We are doing absolutely everything we can to get this money spent before the deadline of Dec. 30, 2020,” said Graham. “One file can take weeks or even months to verify and finalize, so we have scores of files pending eligibility, waiting on documentation from applicants, banks, landlords, employers, former employers, etc.”

Graham said the county has asked whether the deadline to spend the money will be extended and the answer is “extremely unlikely.”

“The U.S. Treasury is who would have to extend the deadline and so far we have been advised that there is no indication an extension will occur. We are moving at the most feverish speed we can,” she said.

••••• Spending other CARES Act funds is going a little more smoothly. So far, the county has issued $2 million in business assistance in Monroe County, and recently issued a call for non-profits to apply for $1 million in assistance.

The county has also issued a first round of $350,000 to a handful of Keys food pantries.

“And that amount can be replenished as it is drawn down,” said Tennyson.

Both Florida Keys Electric Cooperative and Keys Energy Services have worked with the county to identify residential and commercial clients who owe money due to hardships caused by the pandemic, lockdown and quarantine. About $400,000 of Cares Act funds have gone to erase those debts.

“The utilities assess their own customers and we get a list. We cut them one check, and they retire the accounts in arrears,” Tennyson said. “Their customers are incredibly happy, and so are we.”

Local municipalities are also applying to the state for portions of the CARES Act funding to recoup costs associated with the pandemic.

CARRUTHERS FILES LAWSUIT CHALLENGING ELECTION RESULTS CLAIMS EDDIE MARTINEZ IS INELIGIBLE TO HOLD OFFICE DUE TO RESIDENCY VIOLATION

ormer County Commissioner Heather Carruthers filed a lawsuit on Nov. 23 challenging the results of the Nov. 3 election in which she lost the District 3 County Commission race to Eddie Martinez.

The lawsuit, filed against Martinez, Supervisor of Elections Joyce Griffin and the county’s canvassing board, claims that Martinez did not live in the County Commission District 3 on Election Day, and is therefore ineligible to hold the office, according to the Florida Constitution.

“Carruthers further seeks a judgment of ouster of Martinez and a revocation of his commission as Monroe County Commissioner District 3,” the lawsuit states.

The complaint asks the court to direct Griffin and the canvassing board to “vacate the results of the Nov. 3 general election for Monroe County Commissioner District 3 and certify Carruthers as the winning candidate.”

Carruthers’ attorney Bernadette Restivo writes in the 13-page lawsuit that Martinez “did not legally reside in District 3 on Election Day.” The suit claims that

Martinez was registered to vote using an address of 1100 Truman Ave., Key West, which is located in District 3; however, the suit claims, that address is not a residential dwelling, but rather the business address and a commercial property that houses Martinez’s land surveying business.

When contacted by the Keys Weekly, Martinez said the Truman Avenue property includes a residential apartment.

“I’m shocked and saddened that she can’t accept that she lost,” Martinez said Monday evening. He had not yet seen the lawsuit. “It’s a shame she’s wasting everyone’s time and she better stay away from investigating my family and what school my kids attend.”

“Martinez changed his address to 1009 Simonton St., Key West with the supervisor of election on Nov. 5,” the suit claims.

Further, the complaint states that Martinez slept at the Marriott Beachside Hotel on Election Night, not at 1100 Truman Ave. The Beachside Hotel is not in District 3, but rather District 1, the lawsuit states.

“Carruthers files this action as a post-election contest to disqualify Martinez and challenge his eligibility to serve as Monroe County Commissioner District 3,” the lawsuit states.

rganizers of the Key West Artisan Market, which was due to start its weekly Sunday market last week, announced the cancellation of the market until further notice.

“With due regard to the safe and healthy environment in Key West, the city has canceled the Holiday Parade and all special events on city property through Dec. 31 due to the concerns regarding the COVID-19 increase in cases in Key West and Monroe County,” organizers said in a press release that quoted the city’s official announcement.

“This includes the Key West Artisan Market, which was scheduled to start Nov. 22 at Indigenous Park,” organizers said. “After months of delay by Monroe County for permits at the Higgs Beach location next to the dog park, the city had offered the new location in the parking lot of the Key West Wildlife Center as an alternative. The City Commission passed the resolution unanimously at its Nov. 17 meeting.

In the few days since the approval, the commission passed a strengthened face-covering mandate at an emergency meeting and has been working on other measures to help lower potential COVID exposure.

“We are devastated for our artists, vendors and mom-and-pop businesses who have worked hard to beef up inventory to meet the demands of this popular market,” organizer Sean Krikorian said.

“Many of them have had very limited opportunity to make any income during the seven months of being shut down. But at the same time we stand behind the city’s decision to keep our community safe and appreciate all they are doing to move Key West in a better direction.” Krikorian acknowledged.

For now, the Key West Truman Waterfront Farmers Market will be allowed to continue as it is considered an essential service by the state. Due to Thursday’s Thanksgiving holiday, the Farmer’s Market will take place from 10 a.m. to 6 p.m. on Friday, Nov. 27 at Truman Waterfront. The market hopes to operate on Wednesday during the weeks of Christmas and New Year.

“Safety for our guests and participants at all the markets is our highest priority,” Krikorian said. “We will continue to work with the city to develop protocols that hopefully will allow us to continue operating the Farmers Market and open the Artisan Market soon.”

29-year-old Rockland Key woman was arrested on Nov. 21 for sending threatening texts to a woman as well as posting her address on a dating website.

Vanessa Marie Huckaba was charged with sending harassing phone calls/texts and cyberstalking.

The 36-year-old Key West victim started receiving text messages from Huckaba after the victim started dating a man whom Huckaba formerly dated. The victim told Deputy Kat Donavon on Oct. 28 that she’s never physically met Huckaba. The victim showed Donavon texts she received from Huckaba beginning on Oct. 21 in which Huckaba leaves expletive-laden threats, adding that Huckaba knows where the victim lives and works as well as her email and other personal information. The threats indicated Huckaba believed the victim was a threat to Huckaba’s young daughter.

Huckaba tells the victim she is going to need to get a restraining order and, “If you think texts are bad, next is your house and your job.” The victim asked Huckaba multiple times to refrain from contacting her.

The victim was granted a restraining order on Oct. 28.

Thereafter, Huckaba set up a fake profile on a dating website commonly used for brief sexual encounters in which she posted the victim’s home address, cell phone number and an open invitation for men for sex. The posting included the statement “fresh meth tonight.” Multiple strangers began arriving at the victim’s residence thereafter. Other strangers sent the victim nude photos of themselves.

Warrants were issued for Huckaba’s arrest.

She was booked into jail on Saturday.

The thought of a perfectly brined and browned turkey, or a heap of buttery potatoes, accentuated by a chilled white wine and a view of the harbor, would have anyone salivating. Like so many things in life, though, the reward takes effort. Keys residents, like New Yorkers, are accustomed to managing their lives from the confines of smallerthan-average living spaces. For those who live on boats, the challenges (and benefits) are magnified. A boat-based Thanksgiving is a truly next-level undertaking.

A typical galley, boat-speak for “kitchen,” will feature a two-burner propane stove, a sink attached to freshwater tanks, and a downsized fridge. The whole setup is gimballed, which means everything is secured, but allowed to sway a bit when the boat rocks. But galley real estate is a precious commodity, so the most valuable pieces serve dual purposes. Combination bottle opener and can opener? Check.

days took on a watery tone. The Deckers were anchored in Bermuda one year just before Thanksgiving when a hurricane struck. They hunkered down to ride out the storm, hitting the seas again on Thanksgiving Day, which they spent eating a canned turkey pie.

Subsequent Thanksgiving celebrations were a tad more traditional. “For seven years, I cooked small turkeys in our propane oven,” Fran said.

Julie Jeffers is known around the bight for her Thanksgiving spreads that

Carolyn Shearlock and her husband Dave currently live in Marathon, but spent six years cruising the Sea of Cortez and Central America aboard their boat, Que Tal. Those years, along with her mom’s lessons in cooking from scratch, and her dad’s expertise as a butcher, built a foundation of knowledge, turning Shearlock into a nautical chef (though not in her own modest words). HINDSIGHT 2020 LOOKING BEHIND AND AHEAD

T

he coronavirus pandemic brought some of the first cases to the Florida Keys in March and changed our island life in ways no one could have imagined.

A checkpoint kept visitors away and the virus at bay, but impacted jobs, business, income and mental health.

Policies were changed to address the increasing spread. Meetings and fundraisers were moved online, and we all became experts at Zoom, Google Meet and using our webcams as mirrors before “joining” a virtual event.

The Keys reopened to visitors in June and workers returned to jobs in hotels, bars, restaurants and retail stores, and aboard dive, snorkel and fishing boats.

Each week, in our Hindsight 2020 feature, the Key West Weekly will highlight locals’ reflections on a year of unprecedented changes and challenges.

onta Club of Key West launched “16 Days of Activism” on Nov. 21 by tying orange ribbons around the palm trees along North Roosevelt Boulevard to raise awareness about genderbased violence.

“Orange the World: Fund, Respond, Prevent, Collect,” is this year’s theme for International Day for the Elimination of Violence Against Women.

This anti-violence campaign, also known as “Zonta Says No,” is supported by Zonta Club of Key West, the United Nations, Zonta International and other organizations. Even before COVID-19 hit, violence against women and girls had reached pandemic proportions. Globally, 243 million women and girls were abused by an intimate partner in the past year.

Meanwhile, fewer than 40% of the women who experience violence report it or seek help.

Key West residents and visitors are encouraged to support the work by wearing orange during the 16 days, helping to end violence against women, and eliminating the detrimental consequences it has on the well-being of our community.

KEY WEST RAISES AWARENESS OF HUNGER, HOMELESSNESS During the Nov. 17 City Commission meeting, Mayor Teri Johnston read a proclamation observing National Hunger and Homelessness Awareness Week.

This annual observation comes as many prepare for the Thanksgiving holiday. This year this situation is particularly dire as so many struggle with job loss, loss of homes, and hunger.

Florida Keys Outreach Coalition’s Stephanie Kaple noted, as she accepted the proclamation, that many organizations and local governments have been contributing to ensure that no one in the community goes hungry.

For the past 30 years the National Coalition for the Homeless and National Student Campaign Against Hunger and Homelessness have sponsored National Hunger and Homelessness Awareness Week to educate the public about the many reasons people are hungry and homeless including the shortage of affordable housing in the City of Key West, especially for very low income residents.

The proclamation also encourages support of homelessness assistance service providers as well as community service opportunities for students and school service organizations.

ationwide, the tiny home trend is here to stay. Over the past decade, the movement has spawned at least a half-dozen reality TV shows, launched who knows how many “I bought a tiny home” blogs, and taken over our Instagram feeds.

According to AARP.org, the tiny home, which can be anywhere from 100 to 400 square feet, “reflects the state of the U.S. economy, the stillstruggling housing market and a growing conservation ethic to reduce and reuse.” Consequently, local governments have started to take on tiny home projects to address the needs of their tax-paying citizens.

Plus, they are so darn cute.

Monroe County recently finished building a tiny home at 41 Judy Place in Key Largo and invited the public to have a look at an open house on Nov. 21. Keys Weekly stopped by for a tour and to ask Assistant County Administrator Kevin Wilson, who was helping to run the open house, about the project.

“The reason this project started was following Irma, small lots with trailers were destroyed, so we wanted an affordable replacement option for those homes,” he said. He pointed out that replacing a home on a lot after a storm in Monroe County can be challenging to landowners, due to zoning and floodplain regulations, as well as the cost.

Assistant County Administrator Christine Hurley, who was also at the open house, agreed. “The county commission was like, ‘This has to end.’”

The Key Largo tiny home is one home in a pilot project the Monroe County Board of County Commissioners approved in December 2018. The commissioners wanted to be creative in finding products that are wind- and flood-resistant for homeowners to

consider as replacements after a disaster or losing their home. The Cornerstone Tiny Homes prototype is a hurricane-rated structure that could be used as an alternative replacement of mobile homes after a disaster. The model home is a little less than 400 square feet, and starts at $85,000 (for the home, without the land).

Wilson said the total cost for the Judy Place house was about $110,000 including the landscaping, driveway and foundation.

“Depending on your flood regulations, you may need to raise this house up,” he said. Both the house and lot are currently owned

by Monroe County.

The prototype has a porch, a kitchen, a bathroom and a combo laundry room/bedroom. Buyers beware: You may want to consult those reality TV shows and blogs for storage ideas, because there is only one closet. “(Potential buyers) can watch as many TV shows as they want; they say it always looks bigger,” Cornerstone Tiny Homes CEO Brett Hiltbrand said about the size of the model home that his company built at Judy Place. “They don’t photograph well. You’re not going to raise a four-person family in here.

But 50 to 70% of people in need of affordable housing are one- to twoperson households.”

Licensed contractor Hiltbrand, who has built “normal” size homes for many years but has focused on tiny homes for the past six years, has seen an explosion of interest in his product, which he said is the only small-footprint home that is Florida building-code compliant.

His company is also expanding: it

has 12 employees and is moving to a larger facility.

A buyer from Key West was driving up to the open house that day to put down a deposit, Hiltbrand said, and a landowner in Big Pine Key had just called. “It’s ‘Gotta get my mother out of the nursing home and into the backyard.’ It’s also forward-thinking for counties and cities to address affordable housing.”

Wilson pointed out, “The housing authority is in charge of affordable housing. The county hopes the housing authority will be inspired by this project.”

Cornerstone Tiny Homes COO Kim Hiltbrand said, “We can build these quickly.” Usually the project takes three months, but with the pandemic making materials hard to source, now it takes four.

“Everything is all done here, such as plumbing and electric. You just have to hook up water, sewer, electricity and [build] the foundation.”

She added that depending on the county you live in, she has heard of the homeowner needing only two inspections. So basically plug in and play.

“After the open house, we’ll ask for county employees who are interested to put their names in a hat,” said Wilson. The winner plucked out of the hat will get the Judy Place house. And, presumably, they will go on to create their own reality TV show or blog.

The next open houses for the tiny home at 41 Judy Place will be from noon to 3 p.m. on Saturday, Dec. 5, and Saturday, Dec. 12.

T

he Marathon Wild Bird Center is celebrating its silver anniversary this year. For the past 25 years, the nonprofit has been rescuing and rehabilitating injured wild birds.

Kelly Grinter, who runs the center, established it in 1994 to fulfill an urgent need in Marathon for wild bird care.

“Jeanie Ward of Knight’s Key Campground could no longer handle the number of injured wild birds that were coming into the park in need of first aid and a ride to Laura Quinn at the Florida Keys Wild Bird Center in Tavernier,” Grinter told the Weekly.

“I was a 26-year-old intern of Laura’s and she turned and asked me if I wanted to start my own bird center.

And, so it began.”

Since then, over 20,000 birds have been brought to the center by good samaritans, locals and visitors. Grinter joked that locals who find birds on a regular basis are affectionately called ‘bird magnets.’

Most injuries to birds are caused by humans in one way or another, she said, but natural selection (starving birds) also makes up a significant portion of her patients. While she tries to make the latter comfortable with heat and fluids, sometimes they don’t make it, she said. But, when there is still a “spark of life there” and they recover, she feels like it helps make up for the ones that didn’t make it due to humans.

At the sanctuary, the self-guided tour takes visitors over the quarteracre nook at Crane Point to visit some 40 permanent, resident birds. Oliver the osprey has been there for 18 years and Mr. Black-Bellied Plover for 19 years. The latter has even been a National Geographic model for famed photographer Joel Sartore.

The Marathon Wild Bird Center also helps rescue small mammals found orphaned or injured in its area.

“We utilize the same volunteers to transport these occasional patients to Ark Angels in Tavernier. I’ve known and worked with Ark Angels founder Karen Dettmann for over 25 years,” said Grinter.

The bird sanctuary has a team of four who have worked with Grinter in some capacity since the beginning and an additional volunteer squad of roughly 30 who transport birds, run errands, do landscaping and host educational programs for the center.

Volunteering opportunities are always available, Grinter noted, and the center always can use more help.

On this milestone birthday, Grinter is asking the community for help to stay afloat. The annual operating budget has been about $50,000/year, she said. The current budget is almost double that because of a shortage of volunteers, rising cost of food to feed the resident animals and general maintenance costs.

“Staying operational for another 25 years is going to take innovation and funds,” Grinter said. “Our future is on the table.”

Grinter noted that while there is always the possibility that a not-forprofit is going to close, her goal, after 25 years, is to make sure that doesn’t happen to the Marathon Wild Bird Center.

“I love and enjoy what I do. I don’t know why I continue to do it other than just that,” Grinter said. “The need to help our wild birds will continue as long as their biggest threat, us, is present, too. (The Center) shall persevere.”

KEYS TOURISM COUNCIL EARNS STATE MARKETING AWARDS

T

he Monroe County Tourist Development Council garnered four top Florida tourism marketing awards on Nov. 19 during a Flagler Awards ceremony in Tampa.

The event, postponed after the annual Florida Governor’s Conference on tourism was canceled in September due to COVID-19, was a scaled-down gathering with mandated social distancing and facial coverings for about 100 participants.

The TDC earned awards, known as “Henrys” in the print advertising, television advertising and out-ofhome categories and for public relations. The TDC received a silver award for mobile marketing and a bronze for direct marketing.

The statewide competition was judged independently of Visit Florida and evaluated work accomplished in 2019.

NewmanPR, Tinsley Advertising and Two Oceans Digital are the respective public relations, advertising and internet agencies for the TDC. The print advertising award was for Keys sportfishing ads. A campaign that featured Florida Keys-branded taxis plying the streets of London won the out-ofhome division’s “Henry” and television advertising was for a Tinsleyproduced ad focusing on direct flights to Key West International Airport.

COMPLAINTS AGAINST NURSING HOME SUSTAINED IN RESIDENT’S CARE

During my 10th grade year of high school I dropped out of school and attended the Youth Challenge Academy (YCA) at Fort Stewart, Georgia, a military school specifically for “at-risk youths.” I enjoyed the military structure and leadership taught by YCA and wanted to continue living that lifestyle by enlisting in the U.S. Army.

How many years have you been in the military? I am eight years in so far and intend on doing a total of 20 years or more.

Had you ever been to the Florida Keys or Key West before your current assignment?

I had never been to Key West. I didn’t even know it was a place until I received orders. Crazy enough, I used to watch MTV’s “The Real World Key West.”

Did you choose Key West or were you just assigned here?

I was assigned to Key West.

What were your first thoughts when hearing you were coming to the Keys?

Google search and immediately became excited to be around the beach and not have to deal with another winter for a long time.

Hobbies? Running, swimming, video games, pickleball and any other adventurous activities.

Favorite things to do? Mentor people!

Have you ever attended Fantasy Fest and if so what were your initial thoughts?

Yes! My first thoughts were that I couldn’t tell whether it was better or worse than what I had heard about it.

What do you like most about the Keys? The water, the heat and the friendly community.

What do you like most about your assignment? The many bonds that I have built and the influence that I have been able to inspire beyond my own branch of service.

What would you change about living here in Key West if you had the power to do so?

I really have enjoyed my time here in Key West. I feel welcomed and a part of the community and I would not change a thing.

tephanie Matlock Fouts is relieved her mother no longer lives in a local nursing home where she suffered rashes, a pelvic fracture and weight loss, among other ailments dating back to August.

Despite now receiving care in a different facility, Matlock Fouts says, her mom is no longer the same as before her health started to deteriorate a few months back. A recent report by the Agency for Health Care Administration sustained complaints she brought over her mom’s care against the nursing facility in Tavernier that led to her hospitalization.

Issues go back to mid-August when 81-year-old Nancy Fouts fell out of her bed inside her room on the second floor at Crystal Health & Rehab Center, located at 48 High Point Road.

No injuries were sustained from the incident, but another fall occurred some 16 days later, leading her to suffer a pelvic fracture. She was subsequently brought down to the first floor for rehab.

It wasn’t until a Facetime call Matlock Fouts had with her mother in late August that she started noticing her mother’s deteriorating health. Matlock Fouts questioned staff, who assured her she was fine and in good health.

By late September, Matlock Fouts noticed some serious problems over her mom’s appearance. That night, Matlock Fouts was informed her mother was vomiting. She asked the nurse how much she weighed. Fouts was told 123 pounds. Months before, Matlock Fouts said, she weighed around 140 pounds.

Based on reviews of the facility, observations and interviews, AHCA concluded the facility failed to provide new interventions for “resident one” in the facility, whom Matlock Fouts identified as her mother, after her fall. Per the report, initial interventions to prevent the fall from happening again were documented as frequent checks every two hours, keeping the door slightly open for monitoring and educating use of the call bell. But the prevention plan didn’t provide a plan to keep her bed at the lowest position when she was in it, nor did it involve use of mats to prevent potential injury.

As for her mother’s weight, a dietitian recommended she receive no-sugar shakes twice daily for an additional 400 calories and 14 grams of protein.

Records show, however, that the nosugar shakes were never ordered by facility staff. Per the report, the facility’s director of nursing said the communication system between the dietitian and nursing staff was broken. Further, the nursing director said she and her staff were not reading the emails sent by the dietitian, leading to a delay in the ordering of the shakes.

On Sept. 29, Nancy was transported to the emergency room at Baptist Hospital in Homestead after she was found to have gastrointestinal bleeding. It wasn’t the only issue Nancy had, as Matlock Fouts said her mom’s liver enzymes and kidney enzymes were elevated. She had renal failure, and her weight was around 100 pounds. Matlock Fouts said her mother also had a pressure injury stage 2 to the sacrum, which is an open ulcer, or bedsore.

She also has deep tissue injuries to her heels and elbows.

“All I want is proper care for any resident who’s at that facility,” Matlock Fouts said. “If it takes my voice to make that happen, then that’s all that matters to me because that facility is not being run correctly in my opinion.

I fear there’s going to be continued neglect unless someone’s had accountable.”

The nursing facility said licensed and registered nurses were re-educated on completing weekly weighing when recommended by the registered dietitian. The facility, within its corrective action plan, also said that nurses were re-educated on the importance of appropriate interventions in place to prevent resident falls and injury.

“Licensed/registered nurses will receive ongoing quarterly education, ensuring appropriate interventions are completed and documented in clinical record,” the facility states.

Matlock Fouts added that she’s waiting for a report on an investigation from the state Department of Children and Family Services. She is also among several who are suing the facility for neglect of a loved one inside the facility.

Matlock Fouts said her mother has no desire to walk and eat.

“She’s not the mother who I knew prior to her pelvic fracture,” she said.

Some 18 inspections were conducted by AHCA during 2020 that range from complaints to monitoring and fire, life and safety. Deficiencies were cited on 11 of those inspections, with four corrected.

he Sunset Celebration is back at Mallory Square, featuring acrobats, jugglers, psychics, a tightrope walker and vendors selling food, jewelry, original artwork, photography, T-shirts and other handmade items.

“We were shut down for 81 days between March and June, and are thrilled to be back in action and welcoming some new vendors and performers at discounted rates,” said Ryan Stimers, a wire-bending sculptor at Mallory Square and treasurer of the Cultural Preservation Society, which manages the Sunset Celebration. “We previously had limitations on the number of photographers or jewelry makers who could be a vendor at sunset, but we’ve lifted those limitations and are offering discounted rental rates for newcomers. We also have parking permits, so there’s a good chance a vendor will be able to park for free down there to give the sunset a try.

“We’re thrilled to be back open and bringing in some new faces and talents,” Stimers said. “It’s been a really tough year, and some of our longtime regulars are playing it safe and haven’t been down there during the pandemic.”

In addition to the iconic nightly event that starts 90 minutes before sunset, the Cultural Preservation Society will host a special Small Business Saturday craft fair from 3 to 7 p.m. on Saturday, Nov. 28 at Mallory Square.

“We still have some spaces available for Small Business Saturday,” said organizer Linda McCall. “Interested vendors can email SunsetSmallBizSat@ yahoo.com to reserve a space. This is for locally owned businesses that may want a direct, face-to-face exposure to tourists this weekend. It’s also a great opportunity for local artists to give the Sunset Celebration a try. So many artists are out of work right now and we gratefully remain an open venue for them. One of the misconceptions about Sunset Celebration is you have to work a minimum number of nights. That’s not true — work as much or as little as you want. We’d love to have new artists give us a try.”

Masks are mandatory at Mallory Square, as they are in the rest of Key West. Five hand-sanitizing stations have been installed and social-distance markers are on the pavement to keep people apart.

The event replaces the normal Thursday Farmers Market due to the Thanksgiving holiday. Stock the pantry and fridge with fresh produce, exotic fruit, local seafood, honey, oils, spices, infused vinegars, pickles, pastries, cigars and much more.
