T

he results of the Florida Keys election are not yet certified, and one race was close enough to prompt a mandatory recount, but the island chain turned red hot on Election Day. The most surprising upset was Republican Eddie Martinez’s defeat of incumbent Democrat Heather Carruthers in the County Commission District 3 race.

Only 141 votes separated the two candidates, with Martinez receiving 50.15% and Carruthers’ getting 49.85%, according to the Supervisor of Elections office.

“The only race we’ll do a recount for is the Carruthers-Martinez race,” Supervisor of Elections Joyce Griffin told the Keys Weekly on Nov. 4.

The recount starts Thursday, Nov. 5, “and will take a couple days,” Griffin said. “It’s hard; I’d rather not have to do any recounts. People say it must be harder to lose by a landslide than only a few votes, but I don’t think so. When it’s so close, there’s always that hindsight and second-guessing about what someone could have done differently.”

Keys Weekly spoke with several local election watchers and political pundits, who had the following reactions to the all-Republican wins in each partisan race in the Florida Keys: TODD GERMAN, CHAIRMAN OF HOMETOWN “What a night,” said Todd German, chairman of Hometown, which

hosts several candidate forums throughout the campaign. “The Republican sweep really happened yesterday. The Republicans had 3,000 more voters than the Democrats on Election Day. “Obviously, the Eddie Martinez upset over Heather Carruthers was the biggest surprise. Up until Election Day, based on the early voting and vote-by-mail results, Heather was handily in the lead. I don’t think anyone is more surprised than Heather and her team.

“Debbie Mucarsel-Powell being defeated by Carlos Gimenez was another big surprise.”

STATE SENATOR-ELECT ANA MARIA RODRIGUEZ “It was a great night,” said State Sen.-elect Ana Maria Rodriguez, who replaces termed-out Sen. Anitere Flores, also a Republican. “Now we all have to work together for the best interest of the Keys and our community and move beyond the election. We need to bring home the resources, as well.”

Rodriguez will be working handin-hand with U.S. Rep.-elect Carlos Gimenez, who flipped the Democratic seat held by Mucarsel-Powell.

Rodriguez said she’s known the Gimenez family for decades.

“They are a decent, hard working family,” Rodriguez said. “I don’t think there is a better person to represent us in Washington, D.C. than Congressman-elect Gimenez.”

She attributed the overall Republican win in Florida to the number of Latinos in the state.

“I think the vast majority of the state population, particularly Latinos who immigrated to the U.S. because they were oppressed by socialism, definitely tilted the scales,” Rodriguez said.

We had a strategy, and we knew the Democrats’ focus was on early voting and vote by mail,” said Nick Mulick, Republican Party of Monroe County chairman. “We knew Republicans tend to vote at the polls, as well as NPAs (non-party affiliates).”

With Republicans in federal, state and county seats, Mulick said there’s a unified force.

“It’s a lot easier to go to Congress when you have a Republican representative and a county dominated by the Republican Party to ask for more funding to get more attention to issues here like water quality and reasonable development,” he said.

A FAREWELL MESSAGE FROM In 2003, fresh from completing my degree at Florida State University, I moved to the Upper Keys to begin a job as aide to Representative Ken Sorensen that would indelibly shape my entire professional life to this point. After Ken termed out, Representative Ron Saunders, a Democrat, kept me on as his aide, despite my Republican affiliation. I served him even as he was Minority Leader, which I credit for my ability to understand and work with both sides of the aisle. From both men I learned the intricacies of helping our unique area in Tallahassee. We are too often forgotten in this southernmost district, and policies that may work well in other parts of the state may not be well-suited to our community and way of life. With this knowledge and experience, I was able to hit the ground running when you honored me with election as your state representative in 2012.

I am incredibly proud of what we accomplished for this district across my four terms in office, from sponsoring the state’s first agritourism legislation to the landmark Florida Keys Stewardship Act, to safeguarding our lobster and stone crab fisheries for future generations. This area generates a great deal of revenue for the state, so I was also laser-focused on bringing those dollars back home. I know that the hundreds of millions of dollars we secured for critical needs such as water quality, hurricane recovery and other major infrastructure projects had a big impact on our local governments and local communities.

The eight years I’ve spent in office have also been the first eight years of my son, Drake Thomas’s life. To Drake- I know that serving in this role has resulted in me missing so much – baseball games, fishing trips, movie nights – and that’s been hard for you to understand. But what drives me is the hope that when you scuba dive amongst our coral reefs in Pennekamp State Park, or fish off our dock in Key Largo – and when you do that with your own children decades from now, you will know that it was your mom that helped protect it for you and for them. The work I’ve done is because I love you. But there is nothing I have ever done and nothing I ever will do that is more important than being your mom.

To the amazing people who entrusted me with this role – the voters of district 120, and particularly of my adopted home, Monroe County. The contrasts between my childhood home of Alaska and the Keys could not be greater physically nor could they be further apart, but the people within could not be more similar – resilient people of strong character who love where they live and are at one with our natural environment. You have blessed me by allowing me not just to serve you, but to represent you in the truest sense of the word. To bring your values and priorities, goals and dreams to Tallahassee.

To each of you, I hope I have exceeded your expectations in serving this unique district.

A new representative will be sitting in the District 120 chair when the House organizational session convenes in just a few short weeks. To my successor, I offer some light-hearted words of advice. When in the Capitol, you will be sitting a lotmeetings in your office, committee meetings, and late-night floor sessions. Elevators can also be extremely difficult to come by, so if you are only going one or two floors, take the stairs! Also, walk fast, because not only does it help your body counteract the sitting, the lobbyists can’t keep up! But in all seriousness, you will face your fair share of difficult decisions, just try to keep the people of this district in the forefront of your mind, over everything and everyone else, and you will find your way.

Again, thank you all for the honor of serving you in the Florida House.

The Key West Committee for Safer Cleaner Ships won a decisive victory on Election Day, garnering more than 60% approval of the proposed amendments to the city charter that will limit the size and capacity of cruise ships that can visit Key West’s public cruise ship docks.

ey West voters handily approved three changes to the city’s charter that will significantly reduce the number of cruise ships and people that can visit Key West once the industry again gets underway.

The amendment limiting the number of people who can disembark from cruise ships each day in Key West passed with 63% approval. The amendment prohibiting ships with a capacity of 1,300 or more people passed with 61% approval and the amendment giving priority to cruise lines with the best health and environmental records secured an 81% approval.

“This historic vote shows that regulating cruise ships is an issue that unifies Key West, bringing together Republicans and Democrats, young and old, black and white,” said Arlo Haskell, treasurer of the Key West Committee for Safer, Cleaner Ships, which led the cruise ship reduction movement by securing 2,500 signatures on petitions to have the questions placed on Key West ballots.

WHAT’S NEXT? And now come the lawyers.

“Unfortunately there’s going to be some legal action against the city pertaining to these amendments. This got dumped in the city’s lap and there’s a lot of confusion out there,” Key West Chamber of Commerce President Greg Sullivan said Wednesday morning on U.S. 1 Radio.

The city of Key West is bound by the voter-approved charter amendments to change the city’s charter and limit the ships that can dock at the city’s cruise port facilities.

But what about the privately owned cruise ship dock at Pier B, behind Margaritaville Key West Resort & Marina?

The owners of that facility have joined one existing lawsuit that questions the city’s authority to mandate costly reductions to its business operations and officials expect

them to file their own suit. In addition, several local businesses that depend on revenue from cruise ships and their passengers also had retained the Horan Law Firm to represent them even before voters approved the amendments on Nov. 3.

The time for discussion and compromise has passed due to the binding nature of the referendums, Sullivan said.

City Manager Greg Veliz told the Keys Weekly the morning after the election, “Obviously this will go to court, which could take years, and we’ll have to defend the amendments to our city charter. I’m sure Pier B will file suit.”

When asked whether he’s met with cruise industry representatives about whether they’ll send “smaller, safer ships” to Key West rather than the larger ones that have come since the 1980s, Veliz said, “I have met with the cruise industry officials, and the same companies that own the smaller ships also own the bigger ships.

I don’t mind telling you guys exactly what they told me, which is, that inviting the smaller ships to come to Key West, but not the big ones is like inviting me to your dinner party, but not my wife and kids.”

“This is a business decision that became a political decision,” Veliz said.

The city manager said he wasn’t sure what, if any, role the committee will play for here forward.

“The process is pretty straightforward and governed by the charter,” said Arlo Haskell. “Once the supervisor certifies the vote, then the mayor and city clerk simply sign off on it and the amendments become part of the charter. We’re monitoring to make sure everything happens as prescribed.”

Veliz said the discussion is not immediately urgent until the cruise ships resume sailing. They stopped in the early days of the coronavirus pandemic.

here will be a mandatory recount in the nonpartisan Key West City Commission race for the District VI seat between incumbent Clayton Lopez and challenger Ryan Barnett.

Lopez held onto the commission seat by just 19 votes on Election Night.

Supervisor of Elections Joyce Griffin said at 10:30 p.m. on Nov. 3 that there will be a mandatory recount. The canvassing board meets at 10 a.m. Friday, Nov. 6 to examine any provisional ballots, according to the Monroe County Supervisor of Elections office website.

“We’ll take it,” Lopez told the Keys Weekly right after the votes were counted Tuesday night. “I just want to thank all the people who came out and supported me and recognized the value of my experience over the learning curve faced by a new commissioner.”

The morning after Election Day, on Nov. 4, Lopez told U.S. 1 Radio he wants to “continue to get our COVID numbers down as we focus on our economic recovery.”

Lopez also said he wants to continue to work on the city’s affordable housing project.

“Talking about affordable housing in Key West is like talking about world peace in a beauty pageant,” but we have to get to work on this critical issue, he said.

KEY WEST CITY COMMISSION DISTRICT VI Clayton Lopez 50.45% Ryan Barnett 49.55% Barnett said on the morning after Election Day that he hopes Lopez continues “to move the needle” in the city.

“There’s a lot of moving pieces, and Commissioner Lopez has been there for 15 years,” Barnett said. “I can only hope for the best with a lot of critical issues in District VI.” One of those issues is the determination of what to do with 6.6 acres at Truman Waterfront that was initially destined to be a combination of housing above retail shops.

The District VI city race was the only one that went to a runoff election because none of the three initial candidates secured more than 50% of the votes in the August primary. That primary also included candidate John Wilson Smith, who garnered about 17% of the vote.

Other city races, all of which are nonpartisan, were decided in the August primary, when Mayor Teri Johnston defeated bar owner and former commissioner Mark Rossi. Commissioner Billy Wardlow defeated Kimball Ingram in the New Town District III race. The other commissioners either did not face challengers or were not up for reelection.

he Florida Keys have consistently had a high voter turnout, but 2020 set a new record. According to the Monroe County Supervisor of Elections office, the turnout was 84.8%.

Monroe County Supervisor of Elections Joyce Griffiths sent out an email on Nov. 4 announcing the huge number.

“That crash you heard is the record being broken,” she wrote. “Vote by mail + Early Voting + Polls as of 2 p.m. (on Nov. 3) = 84.28 percent.” In fact, the number would climb a little higher to the aforementioned 84.8% The Keys has always had high turnout at the polls, however. Consider: • In the 2016 general election (Trump vs. Clinton): 79.17% • In the 2012 general election (Obama vs. Romney): 76.3% • In the 2008 general election (Obama vs. McCain): 81% • In the 2004 general election (Bush vs. Kerry): 77.17% • In the 2000 general election, the one with the “hanging chads” (Bush vs. Gore): 70.43% The Monroe County Supervisor of Elections has a very, very comprehensive record of voting in the Florida Keys.

Under the election data button on the election site, clicking on the detailed results button will open an archive that dates all the way back to 1932. It’s hard to decipher the copies of faded, type-written pages, but it’s possible that turnout in that year was as high as 78%.

So, yes, turnout in Monroe County has always been high.

“I think that’s fantastic. I am encouraged by the turnout.

With all the money and the advertising spent on political campaigns, I think that the best way to get around it is turnout,” said Josh Mothner of Marathon, who has worked as a campaign advisor.

In the Keys, Republicans outnumber Democrats 23,631 to 18,855. There is also a large number of independent voters — 14,962. According to polling data submitted by Monroe County to the state, more Democrats voted via absentee ballot than Republicans (9,512 to 8,126). But more Republicans voted early when compared to Democrats (7,503 to 4,413). Of those who were provided absentee ballots, there were more outstanding (not yet returned as of Nov. 3) Republican ballots than Democrat ballots.

If 2020 had a theme, it was definitely early voting. According to floridapolitics.com, about 71% of ballots nationwide were cast before election day. In Florida, that number was 62%, or about 2 million more than early or absentee voted in 2016.

In Florida, any ballots that are not received by 7 p.m. on election day will not be counted, with the exception of overseas votes that were postmarked by election day (this usually applies to military personnel serving in other countries).

ue to Election Day, Key West officials met Wednesday this week (after presstime) rather than the usual Tuesday, and were slated to approve a $298,000 contract with architect Bill Horn to design and guide the process for a new homeless shelter, known as KOTS, short for Keys Overnight Temporary Shelter.

The new shelter will remain in its current location on Monroe County Sheriff’s Office property on College Road. The new building will be code-compliant and could be a 24-hour shelter rather than one that’s only open in the evening hours.

The City Commission also was expected to approve a special event permit for the Monroe County Commercial Fishermen’s Association to conduct the annual Florida Keys Seafood Festival at Truman Waterfront Jan. 16 and 17.

The commission also was expected to approve a $498,000 expenditure for the fire department to buy 55 self-contained breathing units that are used during fires, but have also been used more frequently during the COVID-19 pandemic.

In other city news, the board that directs funding and projects to improve the Bahama Village neighborhood meets at 5:30 tonight (Thursday, Nov. 5).

The Bahama Village Redevelopment Advisory Committee will discuss changes to the city’s zoning laws to allow for the construction of 40 dwelling units per acre on six acres of property at Truman Waterfront.

The proposed zoning change, according to Planning Director Katie Halloran, “is an essential part of an effort to promote the Bahama Village community, encourage the redevelopment of vacant cityowned properties and encourage local business and workforce housing in the Bahama Village community.

“The proposed zoning district is designed to expand the Bahama Village neighborhood and encourage mixeduse development including neighborhood retail, educational and historical nodes, recreation facilities, and high density mixed income housing including affordable workforce housing,” Halloran wrote in her explanation.

ey West Police Chief Sean Brandenburg announced this week the addition of K9 Jigsaw to the police department.

Jigsaw, who has just completed training and certification, is a generous donation from Key West residents Tom and Becca Ahrensfeld.

Jigsaw is working with K9 Officer Tommy Anglin, replacing K9 Ben, who recently retired.

As avid animal lovers, when the Ahrensfeld family learned of the department’s need for a K9 officer, they said they were honored to have the opportunity to secure the acquisition and training of the new dog.

They were especially pleased to meet the new K9 and his partner and handler, Officer Anglin, minutes before they began their first shift together last Friday night.

Jigsaw is a 2-year old imported German shepherd.

His name is a reminder of the department’s commitment to the Autism Society of the

Keys. His name matches the wraps on the School Resource Officers’ cars and is a reminder of special autism awareness challenge coins and shoulder patches. The coins and patches can be purchased to support the Autism Society of the Keys.

The Ahrensfelds, Key West residents and owners of four dogs themselves, say they couldn’t think of a better way to give back to the city they call their southern home.

When they are not in Key West they live on their farm in Cape Cod with their children, horses, goats, donkeys, chickens and ducks.

They host an active 4H program and firmly believe, and take pride, in teaching others the joy and value that animals can bring to human lives. To be able to give the Key West Police Department such a talented, beautiful and sweet animal to help them in their law enforcement efforts means the world to them, they said in a note to Brandenburg.

Many residents may have noticed an increase on the Sheriff’s Office social media pages as well as reports in the press of mandatory notice to appear citations being given to anglers with over-the-limit or undersized fish or lobster.

This isn’t a coincidence. Deputies have been going after these violators at my instruction and with the help of our partners with the Florida Fish and Wildlife Conservation Commission and State Attorney’s Office.

We are seeing more and more visitors return to the Keys and that includes anglers on the fishing bridges along U.S. 1.

Unfortunately, my agency is also seeing too many anglers — mostly from mainland Florida — who believe they can fish here while ignoring wildlife laws.

The Sheriff’s Office has been citing people far too often lately who either claim ignorance of the law or chose to casually break it.

The good news: We have made many good cases in recent months and continue to do so. I want everyone in this community and to those who visit us to know that this behavior will never be tolerated while I am Sheriff.

Help me spread the word.

If you are in possession of too many or undersized fish, you can expect to be given a citation that makes your appearance in court mandatory. Additionally, you will face the appropriate fines.

Some people may say most of these incidents are minor violations and no big deal. I disagree. These resource violations when viewed in total have a large impact on the fishery and future generations’ ability to enjoy it.

Theater vs. COVID

A FIGHT FOR CENTER STAGE

C

OVID has been a real showstopper across the board. Though not ideal, other industries have adapted fairly well to social distancing and the use of face masks.

But covering the face of an actor is akin to removing a restaurant server’s arms — it’s their most important tool.

If any industry, or group of people, could find innovative, impressive ways to carry on, it’s these performing virtuosos.

When the universe tried to destroy collective creativity with the coronavirus, these gifted minds found a way, understanding as they do that humans depend on creativity and the welcome escape of a darkened theater for the balance between normalcy and chaos. No one understands it more than artists.

When the initial order came out to close operations, most of the theaters in town were coming to the end of their season. Make no mistake, the shutdown still cheated them out of crucial membership drives and fundraising opportunities.

As time progressed and other businesses began to open, theaters stayed dark, sitting in silence while actors went unpaid, their creativity stifled. Something had to be done.

That’s when Waterfront Playhouse teamed up with US1 Radio 104.1 in a brilliant partnership. Beginning in May, they started presenting shows to the ears of fans — staging live radio broadcasts.

Just like those classic nights of gathering ‘round and tuning into the ol’ transistor for entertainment. October listeners heard “The War of the Worlds,” and though November will be skipped for turkey day festivities and the opening of “Typhoon Judy,” December will bring a reading of the timeless classic “A Christmas Carol.”

Broadcasts are currently scheduled through April (along with a season of live shows).

“Our actors love doing the radio shows,” said Waterfront artistic director Tom Thayer. “It’s nice for them to have even a little paycheck coming in these days.”

Erin Stover Sickmen, artistic director for The Studios of Key West, agreed.

“We are responsible for supporting our audience as well as our actors, crew and artists,” she said. With changes having to be made, improvisation is the edge needed to carry on and bring in money for paychecks. Online shows were the logical answer, given the newly enhanced ability of technology to reach viewers.

(Home theater, literally? Perfect.) The Studios of Key West has been livestreaming their popular “Between Two Palms” series, and Fringe Theater has its own streaming series, “Fringe Fridays,” with new theater highlights each week.

Still, the goal is to bring theater back to its traditional, live form.

Key West Theater has dipped its toe into that pond, and recently received high marks from audience members and performers when it hosted the Big Bawdy Boo-lesque show over Halloween weekend. Tables were socially distanced and audiences willingly complied with mask rules. The venue’s management, Rams Head Group, also has used the city’s largest outdoor venue at the Coffee Butler Key West Amphitheater at Truman Waterfront for its Sunset Series at the Amp, a Saturday evening series of affordable ($10) shows featuring multiple local musicians. Each show starts at 5 p.m.

Theatre XP founder/producer Bob Bowersox took it upon himself to examine how the public felt about in-person theatrical events amid a pandemic. He circulated a four-question survey among 2,600 patrons, asking if they felt comfortable attending shows during COVID. He learned that some 20% of respondents were not comfortable doing anything

1 public until the pandemic was over, while about 67% felt comfortable attending live theatre again — if it could be outdoors.

The remaining 13% were undecided.

The answer was clear: Shows had to move outside. But moving live productions to open-air space is not simple. It requires daily setup and breakdown of lighting, sound systems, intricate sets and delicate costumes, plus socially distanced tables for audience members. In absolute serendipitous timing, The Studios of Key West completed construction of its rooftop event space, Hugh’s View, providing room for small shows al fresco. Their recently staged, sold-out reading of a Theatre XP show proved major successes: Not only could they sanitize everything easily, but crowd control was surprisingly efficient. They sold “pods” (cocktail tables set six feet apart, per CDC guidelines) as their seating options that can accommodate up to four people. Staggered checkin times allowed for small groups on the elevator, as well as through the indoor studio spaces along the way.

Taking a similar approach, Red Barn Theatre will use pods for its outdoor courtyard performances. Audience arrangement will be based on ticket sales each night, spaced appropriately in groups of two, three or four people. The theater will also offer tableside cocktail service to avoid crowded lines at the bar.

“All of the theaters are doing everything we can to get live performances back to our patrons as safely as possible,” Bowersox said. And truthfully, the industry is the last group that wants a virus — no one wants to miss a curtain call. All safety measures are key for rehearsals.

The Waterfront has even adopted a new online ticketing system that automatically determines socially distanced seat assignments based on individual ticket sales.

2 Perhaps the most fascinating plan of action for COVID has been by Theatre XP. The Association for the Blind has been recording TV shows with narration to help blind people understand what is happening on screen. Bowersox has been recording his plays with actors and a narrator in a studio (located behind Key West Theater on Eaton Street). This will help add variety to the sssociation’s selection, and helps a writer get his work out to a larger audience.

The collaboration among theater companies as well as with US1 Radio proves that even a global pandemic cannot stop creative flow.

Support for the arts is always needed to keep the Key West community full of enrichment and diversity. Donations, ticket purchases, even volunteer efforts all help.

The radio live readings offer a great opportunity for those with stage fright to act. To help fundraise, sell tickets, or even sanitize spaces before/after shows, extra hands are in demand and highly appreciated.

new website is helping Monroe County residents cope with the impacts of the pandemic and apply for various assistance programs.

United Way of Collier and the Keys, working with the Florida Keys Outreach Coalition, has launched KeysHelp.org to help people apply for relief in English, Spanish and Creole.

Keys families and individuals affected by COVID-19 can apply for up to $250 per month for assistance with food, prescriptions, medical bills, childcare, communication and transportation costs by connecting with case managers at the Florida Keys Outreach Coalition (FKOC).

The system enables clients to apply for assistance from the safety of their homes, using mobile phones, tablets, or computers, and enables case managers to help them while working remotely, at a safe social distance.

Residents can securely fill out an online application including uploading needed documents to complete the process quickly and safely. Additional community resources and information are available at KeysHelp. org, with more being added in the coming months.

“We could not be more grateful to our local United Way for helping us find a solution,” said Stephanie Kaple, executive director of FKOC. “The need has been so great; we just didn’t have the manpower to meet it as quickly as we would like.

But now we have this amazing tool that is going to help us not only now in this moment but also in the future.”

Since March, the number of residents seeking assistance with critical needs more than doubled.

Calls for help have grown dramatically, as the ALICE (AssetLimited, Income Constrained and Employed) families that United Way of Collier and the Keys serve have been heavily affected by the economic toll.

“These households live paycheck to paycheck, with very little or no savings to help them deal with unexpected expenses or loss of income like those incurred during COVID-19,” said Leah Stockton, UWCK Keys area president. “Requests for assistance are at an all-time high, including in the wake of Hurricane Irma. We are also seeing many callers who have never needed to seek assistance before.”

JUDGE DISMISSES KEY WEST LAWSUIT INVOLVING HANDCUFFED CHILD

T

he federal lawsuit that Key West resident Bianca Di Gennaro filed against police officers and school employees, following the arrest and attempted handcuffing of her child at school, was dismissed without prejudice on Friday, Oct. 30, according to court records.

“Without prejudice” means the case can be refiled, and Di Gennaro’s attorneys, Devon Jacob and Benjamin Crump, intend to do so, Jacob told Keys Weekly on Nov. 1, after the paper reported the dismissal on Oct. 31.

The dismissal order, signed by federal Judge K. Michael Moore, indicates that Di Gennaro’s attorneys failed to file a “joint scheduling report” in a timely manner.

Jacob, who’s based in Pennsylvania and handling the case with Crump’s Florida associates, said he was never aware of any deadlines because his name and contact information were never added to the case docket.

Jacob had filed what’s known as pro hac vice admission, a legal term that allows an attorney to participate in a case in a jurisdiction in which he is not licensed to practice law as long as that attorney is working with co-counsel inside the jurisdiction, according to Cornell Law School.

The Clerk of Court is instructed to close this case. All pending motions, if any, are denied as moot. The parties may move to reopen this matter...”

“We got the pro hac vice admission and paid the fee, but, according to Mr. Crump’s associate, the court clerk said our payment had not posted,” Jacob said.

“We have the electronic payment receipt, which we’ve sent to the clerk, so the matter is being corrected.”

Jacob said the statute of limitations for the case has not ended, and it will be refiled.

LAWYER SAYS THEY’LL REFILE AFTER TECHNICAL GLITCH

Federal court records show the case Bianca Di Gennaro filed in August against Key West police officers and school employees was dismissed on Oct. 30 by Judge K. Michael Moore. An attorney for Di Gennaro’s attorneys says they’ll refile.

“Mr. Crump and his associates were assuming I was receiving all correspondence and handling it, but I wasn’t getting anything,” Jacob said.

Moore’s Oct. 30 dismissal order states: “The deadline for filing a joint scheduling report has passed and no extension of time has been requested,” the judge’s dismissal order states. “Accordingly ... it is ordered and adjudged that this action is dismissed without prejudice. The Clerk of Court is instructed to close this case.

All pending motions, if any, are denied as moot. The parties may move to reopen this matter upon the Parties filing a joint scheduling report.”

The dismissal was news to plaintiff Bianca Di Gennaro’s parents, former Monroe County commissioner Mario Di Gennaro and his wife, Margitta, who are the grandparents of the boy at the center of the lawsuit. Margitta Di Gennaro said she had not heard anything about it when contacted by Keys Weekly on Oct. 31.

An Aug. 20 article in the Keys Weekly details the 22-page lawsuit and includes comments from the boy’s grandparents.

The article also reveals that the boy’s father was present for his son’s arrest,

according to the police reports, and had requested it to teach his son a lesson following prior behavioral issues.

Di Gennaro’s attorneys filed the suit in August 2020, two years after the incident at Gerald Adams Elementary School, against the city of Key West police department, the Monroe County School District and individual officers, teachers and principals.

Police officers were seen on video trying to handcuff Di Gennaro’s then-8-yearold son after he had allegedly punched a school employee in the cafeteria. The handcuffs were too big and kept sliding off the boy’s hands.

The case and video, widely circulated on social media, made national news.

Crump has represented the families of Trayvon Martin and Ahmaud Arbery, who were the victims of racially motivated murders, and the family of George Floyd, who was killed on May 25 by former Minneapolis police officer Derek Chauvin.

he Florida Keys Council of the Arts and the City of Key West Art in Public Places Committee recently announced the installation of five new sculptures at the Duval Street Pocket Park, all created by artists from Monroe County.

The works were selected from a competitive application process, and are available for purchase from the individual artists while they’re on display.

“This is a wonderful asset to our community, which truly allows everyone access to the arts,” said arts council executive director Liz Young.

The following artists and their works are all on display: Adam Russell created “Red Obelisk”; Trish Pleasant created “Hawksbill Reef”; Bill Lorraine created “Ann’s Girl”; Tim Marshall Curtis created “Cetacean {Fishtrick)” and Paola Effio created “Catfish.”

There are plans to add a sixth sculpture by artist John Martini at a later date. Also gracing the pocket park is a series of artistic benches, created by artist Colin Selig, made from recycled propane tanks. The benches are brightly colored, adding a whimsical, tropical splash of color to the public seating.

The new art is at the pocket park that was sponsored by business owner Michael Halpern at 1400 Duval St., between the Southernmost House and Southernmost Beach Cafe.

TREATS IN A TROUBLING TIME MOM & POP KEY WEST HOSTS KIDS’ MASK-QUERADE

C

oncerns about coronavirus troubled parents of trick-ortreaters this year, but the Key West business community stepped up and provided a safe and socially distanced Halloween event at the Coffee Butler Key West Amphitheater.

The Mom & Pop Key West small business group sponsored the Mask-querade, under the direction of Paul Menta, who owns Key West’s First Legal Rum Distillery.

The event welcomed 525 masked and costumed kids, who were admitted in groups to allow for social distancing, Menta said. They trick-or-treated at decorated tables manned by local business owners who gave away everything from candy to cupcakes.

And at a much smaller event across town, a group of Key West friends gathered at Higgs Beach for their own tricks and treats.

ellness, welcome and an awareness of where things originate are the guiding principles of the Green Pineapple brand in Key West, where owner Jennifer Hulse embraces a philosophy of “conscious consumerism.”

“As a brand, we want to encourage a lifestyle of whole-body wellness and an eco-conscious lifestyle,” said Hulse, who bought the Green Pineapple, 1130 Duval St., in April 2018 and added a yoga studio.

“People are really making an effort today to understand where things come from, whether it’s the food they eat or the items they buy,” Hulse said.

“And we want to encourage that. We feature clothing, gifts and home decor items made from sustainable materials and fair-trade sources, most of which are available exclusively in Key West at Green Pineapple.”

The Green Pineapple brand has grown to include not just the Duval Street boutique, yoga studio and cafe, but additional retail locations on Petronia Street and at The Perry Hotel on Stock Island. All three locations offer men’s and women’s clothing, with sustainable children’s clothes available at the 310 Petronia St. shop.

Hulse recently expanded the Green Pineapple Café, which now features the culinary talents of Chef Layla Barr, who has perfected the art of wholesome, plant-based nutrition in foods that taste as good as they look — and that actually do a body good.

The café is largely vegetarian and vegan, and all baked goods are gluten-free, Barr said.

“But I’m not going to call it a vegetarian café because that scares some people off. Besides,I’ll occasionally feature a beautiful grilled fish as a daily special.”

Hulse wants to cater to those “who want to put good things on their body and in their body to keep them strong, vital and able to do good in the world,” she said, adding that the brand recently launched its new online store at greenpineapplewellness.com.

And the symbolism behind the pineapple was not lost on Hulse when she bought the place in 2018.

The pineapple has been a sign of welcome and hospitality since the American colonists began importing the fruit from the Caribbean in the 1700s.

“Because trade routes between America and the Caribbean islands were often slow and perilous, it was considered a significant achievement for a host to procure a ripe pineapple for guests,” reports the Indiana University of Pennsylvania School of Hospitality Management. “Similarly, some accounts tell of New England sea captains who, upon returning from trade routes in the Caribbean or Pacific, placed a pineapple outside their homes as a symbol of their safe return.”

As its symbolism grew more widely recognized, the pineapple was often used to adorn 18th- and 19th-century bed posts, tablecloths, napkins and other items associated with welcoming guests.

“Between the pineapple as a symbol of welcome and the green movement today, we’re a welcoming place that supports a sustainable lifestyle,” Hulse said, adding that the Green Pineapple soon will begin hosting monthly art showcases at its three locations, with schedules on its Facebook page.

Green Pineapple Café is open daily from 9 a.m. to 6 p.m., with expanded hours coming this winter.

RED BARN THINKS ‘OUTSIDE THE BOX’ THEATRE USES COURTYARD TO KEEP AUDIENCE MEMBERS APART

K

ey West’s Red Barn Theatre – now entering its 41st professional season – has found some ways to step “Outside the Box” by welcoming patrons back to the theater experience while making sure they are doing so in the safest and healthiest way possible.

In keeping with its “Outside the Box” theme, the Red Barn’s new season will make full use of the open-air Zabar courtyard that fronts the theater. The bricked space, comfortable and shielded by the overhang of a royal poinciana and surrounded by the foliage of Betsy’s Garden, is large enough to accommodate a decent-sized stage, and socially distanced outdoor seating for upwards of 40 theater-lovers. The Key West Woman’s Club, whose building fronts the property along Duval Street and which owns the courtyard space, has endorsed the Red Barn’s plans.

“In a survey of our patrons earlier this year, we found that most indicated they were not comfortable sitting inside a closed theater space just yet, but they’d most certainly come back to theater if we could present our productions outdoors,” said Bob Bowersox, actor, producer and publicity director for the theater. “So we took our time, looked at the options, and found we had exactly what our patrons were asking for sitting right in front of us.”

Artistic Director Joy Hawkins has planned a full season of live theater in the courtyard space, and thrown in a couple of unique online extras.

One of those extras will kick off the Red Barn’s 41st “Outside the Box” season Nov. 25-28 with an online production of Nora and Delia Ephron’s “Love, Loss and What I Wore.” The play, which was a hit for the theater back in 2013, will be brought to life again in a new incarnation performed live and recorded. Patrons will be able to access the streaming show through the Red Barn’s website, redbarntheatre.com. Those purchasing any of the season membership levels will be admitted free. Tickets are otherwise $10.

“This is a show that is tailor-made for the Zoom platform,” said Bowersox, who is producing, with veteran Carole MacCartee directing. “Five women, talking to the audience and among themselves about the trials and tribulations of clothes. It’s hard not to be laughing every second – it’s one of those plays that’s enormously funny because it’s so true and everyone can relate.”

The play will star Key West’s Barbara Mundy, Melody G. Moore, Peggy Montgomery, Susannah Wells and Amber McDonald Good. Tickets can be purchased at redbarntheatre.com and the link and password to the show will be offered at the end of the transaction.

The other extra will be a Christmas gift to Key West – a free offering of “With Bells On,” which made its premiere last Christmas at the Red Barn. It also will stream across the Red Barn’s website Dec. 16 – 20. Starring Trey Gerrald and Don Bearden, and directed and costumed by Christopher Peterson, the show revolves around a meek and mild accountant stuck in an elevator with a flamboyant drag queen on Christmas Eve. Access to the free streaming video of the play will again be through redbarntheatre.com. If patrons are so inclined, they can return the gift by making a donation in support of the Red Barn when they access the website.

The main stage shows planned for the “Outside the Box” outdoor theater space will run January through April. First

up is “Quarantine for Two,” a brand new play from Key West’s Hy Conrad, who is well-known for his writing on TV’s “Monk” series. The show will run Jan. 12 through Feb. 6.

Planned for Feb. 23 through March 20 is “Cats Talk Back” by Bess Wohl, a funny “Waiting for Guffman”-style parody that purportedly reveals the secrets behind the making of Andrew Lloyd Webber’s legendary musical and the dark side of the Great White Way. And winding up the Red Barn’s season March 30 through April 24 will be “Sez She” by Jane Martin. The show is performed by five actresses, who reveal through monologues the funnier, stranger sides of these early days of the 21st century. Hilarity, surprise and homespun philosophy top the contemporary perspective on everything from sexual harassment to sleeping in theaters to the erotic appeals of silence.

The Red Barn’s annual membership drive is in full swing and can be accessed through redbarntheatre.com. Membership revenue is critical to the Red Barn’s operations, and each level comes with its own special perks, which are available on the website.

MOVES AND PROMOTIONS SHERIFF’S OFFICE ANNOUNCES COMMAND LEVEL CHANGES

S

heriff Rick Ramsay announced changes at command levels in the Upper, Middle and Lower Keys as the agency says farewell to some long-standing members due to retirement while welcoming new members up the chain of command.

“I am saddened to say goodbye to some of the hardest working law enforcement officers a sheriff could ask for,” said Ramsay. “But, at the same time, it’s always exciting to see those with that same commitment be rewarded for their hard work and rise up through the ranks. So, these announcements are bittersweet for many of us within the agency. I offer my sincere gratitude to those entering retirement and an equally loud congratulations to those moving up.”

The following members will be promoted by Ramsay on Monday, Nov. 16. Those retiring will do so at various dates in the weeks ahead.

• Lower Keys Commander Capt.

Donnie Catala is retiring after decades of service to Monroe County.

The native Key Wester has been with the sheriff’s office for more than 30 years. He has served a litany of roles, including as a Lower Keys general crimes detective and then sergeant over that unit as well as on the sheriff’s office SWAT Team.

• Executive Director Patricia Thompson will move in as the new Lower Keys commanding officer.

Thompson formerly supervised detectives with the Special Operation Unit and Major Crimes Division and as such oversaw the most important counter-narcotics and serious crimes investigations in the Keys. Thompson has a law enforcement career spanning decades, including time as a special agent with the FBI. Before retiring from the FBI, Thompson worked some of the biggest criminal federal cases in Miami-Dade and Monroe counties. Thompson retired from the FBI and later joined the sheriff’s office in 2018.

• Major Crimes Unit Detective Vince Weiner will move in as the new director of the Special Operations Unit and Major Crimes Division.

Weiner spent decades with the Florida Department of Law Enforcement, many of those years as a supervisor in Monroe County, investigating serious crimes at the state level.

Weiner resigned from the FDLE as a regional agent in charge. He then came on board at the sheriff’s office

in 2012 as a road patrol deputy and eventually became a major crimes detective. He also served as school resources officer at Sugarloaf School, before going back to the Major Crimes Unit where he solved two longstanding cold murder cases.

• Islamorada Commander Capt. Corey Bryan and his wife, records assistant Peggy Bryan, will both soon be retiring after more than 30 years of service each with the sheriff’s office. Corey Bryan has been an active member of the Islamorada community as a member of the Upper Keys Rotary Club.

The couple were usually spotted leading parades and public events at Founders Park. He took a leading role working with the village on everything from school safety to traffic concerns on the Old Highway to activity in the Indian Key Fills.

The Bryans have a son, Lt. Spenser Bryan, who continues to work for the sheriff’s office.

• Middle Keys Lt. Derek Paul is heading to the Village of Islamorada where he will serve as the new captain or commanding officer. Paul is a Marathon native and a 23-year member of the sheriff’s office who started work in the Bureau of Corrections at the main jail on Stock Island, before moving over to road patrol. He’s also served in the Upper Keys while on road patrol and it was there when he was last promoted before he returned to his home community.

• Soon-to-be promoted to lieutenant as second-in-command in the Middle Keys, Sgt. Mark Jones will take Paul’s spot in the Middle Keys.

Jones was born on mainland Florida and has 32 years of law enforcement experience, including time with the Marion County Sheriff’s Office. Jones worked as an undercover officer and also worked with the High Intensity Drug Trafficking Area (HIDTA) task force, where he participated in some of the most notable drug interdictions in the Keys.

• Middle Keys Detective Leon Bourcier will be promoted to sergeant and fill Jones’ role in Middle Keys road patrol. Bourcier has been with the sheriff’s office since 2008 and has worked in Marathon in road patrol and as a general crimes detective. He has worked as a detective since 2016.

BRIEFLY MAN ARRESTED FOR SEXUAL BATTERY ON JUVENILES Key West Police Detectives arrested a Key West man on two charges of sexual battery on two juvenile girls.

Eugenio Rivera, 74, was arrested Nov. 4 and is being held on $300,000 bond at the Monroe County Detention Center for allegedly sexually battering a 12-year old and a 9-year old.

The allegations stretch back to 1991 and 2018, the department reports.

CARRUTHERS CALLS SPECIAL MEETING NOV. 18 Monroe County Mayor Heather Carruthers has called a special virtual meeting of the Board of County Commissioners at 9 a.m. Nov. 18. SOUTH FLORIDA SYMPHONY GOES VIRTUAL FOR SEASON The South Florida Symphony, born in Key West 23 years ago, is making its 2020-21 season available to classical music aficionados around the globe by staging a series of virtual concerts featuring worldrenowned performers.

The virtual series, consisting of six Masterworks concerts beginning Saturday, Nov. 21, protects audiences and musicians from the risk of coronavirus transmission. Concerts will be performed live without an audience and recorded by expert directors and sound engineers for broadcast to music lovers.

The season launches Saturday, Nov. 21 with a concert featuring Wolfgang Amadeus Mozart’s Symphony No. 41 in C Major and Violin Concerto No. 5, “Turkish.” The latter piece features violinist Huifang Chen.

Subsequent Masterworks performances, all scheduled on Saturdays at 8 p.m., will take place Dec. 5, Jan. 16, Feb. 27, March 27 and April 24. The concerts feature works by a diverse roster of composers, ranging from Ludwig van Beethoven to Igor Stravinsky.

As well as the symphony’s musicians, the season showcases internationally acclaimed soloists including violinist Lara St. John, cellist Zuill Bailey and pianist Svetlana Smolina.

Audience members can access the virtual concert hall through season packages or single-concert passes. Allaccess season passes start at $200 per household (a special offer for new subscribers) for admission to the six virtual concerts as well as bonus content.

Single-concert access is $45 per household. The concerts can be viewed on a desktop, laptop, mobile device, tablet or smart TV.

‘IT TRULY IS A FAMILY’

NEW PIER AT SEA BASE DEDICATED TO DOUGLASS’ 30 YEARS OF SERVICE

W

ith a big grin, Keith Douglass looks out at a newly-constructed concrete pier spanning 285 feet at the Florida Sea Base in Islamorada. In the years to come, thousands of scouts across the country will set foot on the pier — named after Douglass — as they hop on sailboats for an adventure in one of the most diverse ecosystems in America.

The facilities director of the high adventure program base for the past 11 years, Douglass couldn’t help but reflect on his 30 years of service and many memories as an executive with the Boy Scouts of America. Count his 10 years as a cub scout and boy scout, and Douglass has been a member of the Boy Scout family for 40 years.

Just recently, Douglass decided to call it a career. In celebrating his many years with Boy Scouts, a ceremony was held with friends and family at the Sea Base to officially unveil Douglass Pier. Of his 30 years with Boy Scouts, half was spent at the Florida Sea Base.

“I so much enjoyed working here and being a part of the Sea Base family,” he said. “I truly miss it already. I still come back and do some work as a consultant when they need me and as a volunteer.

“It truly is a family in my 40-some years with Boy Scouts,” he continued. “I still go back to people who served on my staff, facilities and program departments, and they still keep in touch with me. Some are married with children now. It’s just so neat.”

A Philadelphia native, Douglass first became involved with scouting in 1960 as a cub scout. He obtained the arrow of light award and ended up joining Paoli Troop 1 when he was 11 years old. Douglass earned the Eagle Scout rank in 1967 with a bronze and silver palm. He also earned the Ad Altare Dei Catholic scouting’s religious award.

Douglass earned his bachelor’s degree in business administration and completed graduate work in the same discipline and is also a U.S. Navy veteran.

In his 30 years as an executive with Boy Scouts of America, Douglass served in various capacities as district executive, senior district executive, senior exploring executive and field director positions in the Chester County Council. In 1986, at age 34, he became the scout executive of the Sullivan Trail Council in Elmira, N.Y., where he served four years.

Douglass’ career began at the Florida Sea Base in 1990 when he accepted a position offered by founder Sam Wampler for director of programming. From their home in Watkins Glen, N.Y., Douglass, his wife, Diane, and two kids, who were 4 and 8 at the time, traveled to the Sea Base aboard their 24-foot sailboat “Ginny.” The journey took 52 days.

Serving as programming director for four years, Douglass left in 1994 following his election to the Monroe Board of County Commissioners. Upon completing his four-year term in 1998, Douglass became development director for Rural Health Network and executive director of the Crane Point Museum in Marathon.

Douglass was invited back to professional scouting 2009 as director of facilities at the Sea Base. Returning to the Sea Base following his political and civic stints, constructing the pool on the grounds, and dedicating four new staff housing buildings are among the memories he looks back on.

“Being able to get the pool and workforce housing built was amazing,” he said. “And I’ll never forget the naming of Wampler Way.” Then there are the memories Douglass has with the many people he ran into during his time at the Sea Base. Douglass said he could go on and on with the special times he cherishes.

“Seeing them grow up has been really special,” he said. “Diane and I attended a wedding here at the base among staff members getting married, and that was very special,” he said.

“Both my daughters work here, so seeing that happen was a memory.”

As to what Douglass will miss most, it’s the people and the projects in store for the Sea Base.

“The challenges of projects that you know are making such a difference in the lives of young people, I’m certainly going to miss that,” he said. “There are things that the Sea Base has planned, including the redesigning of the campuses. I’ll try to see some of it as a consultant, but not being directly part of it is something I’ll miss.”

“We had to work together to make it happen. We had to do it in phases to make everybody happy,” he said. “This whole marina exists because of him.”

Sharon Wampler, wife of the late Sam Wampler, said her husband would be proud of everything Douglass has done. Longtime friend Roy Gonas, who knew Douglas through Rotary, said he couldn’t find one negative thing to say.

“He’s devoted to family, faith and community and what he contributed through leadership and advice has been tremendous,” Gonas said.

Mike Johnson, executive director of the Sea Base, met Douglass in 1990 while working at the Sea Base. From his arrival via sailboat at the old dock to working with Douglass, Johnson relayed just how dedicated he was during his years with the Sea Base.

“Keith Douglass made a difference in the lives of thousands of young people during his 15 years at the Sea Base and 15 years as a BSA professional with Chester County Council,” he said. “Service to others is how Keith has lived his life, including parish council member in his church, service to Monroe County as a commissioner and mayor and as an assistant Rotary governor. He is a truly good person who cares about others; it’s been a pleasure to serve with him.”

Keith and Diane, who retired two years ago from her 40-year career in nursing, are staying busy with their marine surveying business. Keith said he also plans to continue his volunteering work as a member of Islamorada’s Achievable Housing Committee and Marathon Rotary Club.

“They definitely keep me busy,” he said.

Douglass holds a U.S. Coast Guard commercial 100-ton master’s license with auxiliary sail endorsement. He enjoys boating, fishing, diving, playing guitar and driving his 1978 MGB sports car.

MEET THE DIVER WHO CHANGES THE U.S. FLAGS ON THE SPIEGEL GROVE AND DUANE

hen longtime diver Lew Bellows moved to Port Largo nine years ago, he began diving the Keys working for Ocean Divers (now Rainbow Reef Dive Center). It bothered him that the U.S. flags on the famous shipwrecks were tattered, and he decided to do something about it.

“Someone told me the guy who used to take care of it had moved away, so I took it upon myself to do it, and I enjoy doing it,” he said.

Bellows has changed the flags on Key Largo’s two most famous shipwrecks and dive sites, the USS Spiegel Grove and the USCGC Duane, ever since.

“I came out of the Vietnam era,” Bellows told Keys Weekly. “Didn’t volunteer, didn’t get drafted. Just wandered through. But I had friends of mine that went and never came back, and I had friends who went and didn’t completely come back.”

Those memories prompt Bellows to refresh the flags about four times a year to ensure there’s always a crisp, clean flag “flying” on both military wrecks.

“I like to get clean flags up for Veterans Day and Memorial Day, at least. That’s the reason I do it, really,” Bellows said. “The algae gets going really fast, and it doesn’t really matter if it’s polyester or nylon, the algae always gets it,” Bellows said.

The Duane sits in 100 to 130 feet of water and is Bellows’ favorite place to dive in the Keys. The second-longest serving military ship in history, it was also a U.S. Coast Guard ship during the Vietnam War. In the 33 years since its intentional sinking, it’s become an artificial reef, teeming with soft corals, bull sharks, goliath groupers and tons of fish, he said.

The Spiegel’s crane arms have some of the prettiest soft corals and sponges in all of the Caribbean, Bellows continued. The Navy ship was intentionally sunk into 60 to 135 feet of water in 2002.

Bellows loves seeing the flags on both.

When the current catches them, they’re “as pretty as seeing a flag in the breeze” above the surface, he said.

He hopes the flags serve as unifying symbols especially in this time of “struggle.”

He also emphasizes that he is proud to

complete the changes for many reasons, none of which is political.

“I don’t think about pride for myself. I feel pride for the United States,” Bellows said. “I realize there’s a whole lot of neat people who gave their lives and served so that I can be a bitchy liberal. All my rightwing friends know exactly what I am; we still agree 100% on the flag.”

The actual changing of the flags is a one-man job, but Bellows takes coworkers from Rainbow Reef as dive buddies and “trainees” of sorts. He attaches the flags with plastic zip-ties and collects all the old ones to prevent plastic pollution. The currents on both ships are notorious, and the deep dives mean that he has to work efficiently.

“When I go down there, I say a prayer of some sort to those who gave their lives,” he said. “There’s nothing to interfere — just me, the flag and the pole.”

Over nine years, he’s amassed fun stories like learning the hard way not to straddle the flagpole without a wetsuit (fire coral, ouch!) and befriending a curious golden grouper on the Duane.

“For years, he’d chase the other fish away and just watch me change the flag. It was the coolest thing. Then he disappeared.

Probably onto someone’s dinner plate,” Bellows chuckled.

Bellows absorbs the cost of the flags himself and is honored to do so. The newest flags, which were changed within the past month, cost around $40 each.

The old flags are ceremoniously retired either at an American Legion or the Boy Scouts Base Camp and then usually incinerated.

After nine years, Bellows is ready to pass on the duty to Rainbow Reef, where he still works. He predicts Memorial Day 2021 will be the last flag change where he’s in charge.

“Thanks to Rainbow Reef for allowing me to have the honor of changing those flags,” he said. “I feel like I’ve done a pretty good job of it. And I’m sure someone will carry on well after me.”

Rainbow Reef always gives active military and veterans 10% off diving. On Veterans Day, both dive for free.
