WANT TO REGULATE VACATION RENTALS? Make a complaint to the city — not the sheriff

F

or those of us who live near a vacation rental house, there are more inconveniences than benefits.

The benefits were that when the vacation rental ordinance was issued, there were very few motels that offered our tourists adequate accommodations. In 1999 the Buccaneer Lodge burned down, Faro Blanco was decrepit, the Ramada was closed, and the hotels on Key Colony Beach were dealing with hurricane damage. As tourism is, by far, our most important and essential economic engine, the lack of hotels was a serious problem, to which vacation rentals offered a solution. Additionally, the vacation rental concept meshed well with Marathon’s desire to be a “family” destination, a distinction that separated us from the Bourbon Street ambience of Key West.

But vacation rentals brought their own problems, from increased traffic in residential areas, to overcrowded “party houses,” late night noise, increased trash, and most importantly, a loss of privacy and the sense of residential community by the weekly influx of strangers on vacation into our residential areas. The deleterious effect of vacation rentals was documented in a scholarly study in Key West, which confirmed the worst fears of the opponents of vacation rentals, and had a major impact on the county’s decision to prohibit vacation rentals in most residential areas in the county — they are only allowed in certain zones for a minimum of 28 days. The City of Marathon chose to allow vacation rentals for a minimum of 7 days, and the economic effects, including an increase in property value and increasing tourism, seemed to approve that decision. But vacation rentals were always seen as a temporary or at least a flexible policy that could be amended or modified to protect residents while allowing the

necessary economic stimulus that the rentals provided. Additionally, rental agents generally acted responsibly in culling the applications to deter inappropriate renters.

This balanced approach was diminished when the state announced that it would allow vacation rentals to operate throughout Florida, subject only to existing ordinances regulating them. Otherwise, the state preferred no regulation (or limits) at all. Fortunately, Marathon had an existing ordinance, but the state policy implied that if any modification or amendment to the local policy was enacted, the ordinance would be void and the state policy of no regulation would control.

While it seems that the state has once again diluted local control of our city, we are not without options and resources that allow the reasonable regulation of vacation rentals. Our city ordinance allows the city to suspend any vacation rental license for “3 violations … in any 12 month period.”

Violations, spelled out in the code, in addition to common law concepts of nuisance, include excessive parking, uncovered or inadequate trash receptacles, noise after 10 p.m., and occupancy limits. It’s a good ordinance and, if properly enforced, allows Marathon residents a powerful tool to regulate and control vacation rentals in their neighborhoods.

BUT the violation(s) must be reported, in writing, to the City Code Enforcement Department, and that means complainants must identify themselves; no anonymous complaints. And while reporting to the sheriff’s office is recommended, that reported violation has no effect on the vacation rental license, only code enforcement complaints do.

And since the ordinance was passed, guess how many code enforcement complaints about vacation rentals have been prosecuted? None,

zero, nada, bupkis, not a single one!

That may speak to our sense of community more than our best interest. I suspect that many people aggrieved by renters, myself included, have complained directly, and loudly, to the vacation rental tenant who is causing the problem. That usually has positive results, and who wants to go to City Hall and file a complaint the day after yelling at your new neighbor?

But if you want to see fewer vacation rentals, at least until we can amend our ordinance to regulate and attrite them, the only effective way to make a change is to make a written complaint to city code enforcement, and follow that up to ensure that the violation is either admitted or proven, so that the vacation rental license is at risk for its bad behavior.

Aside from the obvious result of fewer vacation rental houses, the threat of filing code enforcement complaints will immediately affect rental agents who must increase their vigilance, and the information given to the renter, to protect the license. Owners of vacation rental houses will become more proactive toward their renters to protect their neighbors to avoid anyone filing complaints. And the city will increase enforcement of the ordinance in response to complaints being filed.

The ripple effect of code enforcement complaints will reduce the problems associated with vacation rentals, and help restore peace and quiet in our neighborhoods.

We have the tools to improve the situation, but we must use them.

Fresh perspective on affordable housing, food trucks, signs

he Marathon City Council gave Habitat for Humanity of the Middle Keys $150,000 toward the construction of 11 affordable housing units. The money was the difference the organization needed to make up in the $950,000 purchase price of the Anchor Inn from the current owner IMBY Inc. That $150,000 is in addition to the $800,000 coming from the Monroe County Land Authority. (The initial county grant was for $650,000; in a subsequent meeting the county agreed to increase the amount to $800,000.) The $950,000 buys the land and the affordable allocations.

The city appropriated the money from its affordable housing fund.

City Councilman Mark Senmartin suggested the city pay only $110,000, equating the amount to what it would offer 11 firsttime home buyers with down-payment assistance.

“It gets you close to your goal,” Senmartin told Christine Todd-Young, executive director at the Habitat chapter in the Middle Keys.

“It’s a mere four percent of the entire project. I don’t think that four percent is a large ask,” said Todd-Young, adding that the cost to just build the project, in addition to land and building rights, is expected to be $3.2 million, or $290,000 per unit.

Councilman John Bartus spoke in support. “You don’t come to the city for money often. And one of the goals of this city is to encourage home ownership wherever we can.” The resolution was passed unanimously.

In other news: • Councilman Dan Zieg brought up sign ordinance enforcement, emphasizing sandwich board signs, pennants and flags on the Overseas Highway’s right of way. Growth Management Director Doug Lewis said that many of the signs are “on the edge” of the prohibited zone, and also added that the signs have proliferated — more than doubling to 140 — in the past year.

Council directed staff to involve the Marathon Chamber of Commerce and schedule workshops in March.

• City staff told council that a public forum for suggestions for the former Quay property, now a city park, would be scheduled for February. Bartus inquired whether the studies regarding cost comparisons of building, permit and impact fees is complete, and when that workshop could be scheduled. Lewis told the council that the studies findings would be reviewed soon.

• Utilities director Carlos Solis updated the council on plans to fix parts of 106 nonfunctioning streetlights along Sombrero Beach Road. The deadline for the bids is late next week. Solis said the work itself — repairing saltwater intrusion damage to the junction boxes — would take about 45 days.

• Mayor Steve Cook floated the idea of reducing the speed on Grassy Key to 45 mph. Other councilmen chimed in with ideas ranging from warning signs for southbound traffic approaching Kyle Avenue (an almost blind corner), cutting back vegetation, adding acceleration lanes, and removing the turning lane at Guava Avenue and extending the center “suicide lane” that allows for multi-direction turning. Solis told the council that the water utility will begin work there soon, and the speed limit will drop during construction, providing an effective trial.

• Staff will bring back proposed amendments to the city’s food truck ordinance and schedule workshops. Senmartin suggested removing the limitations on hours a food truck can operate, as well as language that says the vehicle must be removed from view when it is closed. He also said he doesn’t agree with the cap of seven licenses, but said he would leave that alone if the council agreed to a “use-it-or-lose-it” policy to keep businessmen from buying and selling the licenses as a commodity.

Councilman Luis Gonzalez disagreed, pointing out that he knows businessmen who want the license only to operate during special events.

• Senmartin broached the subject of city policy and employees with medical marijuana cards. Council and staff acknowledged it’s an evolving part of employment law and agreed to keep abreast of how other municipalities are handling the issue.

• Chief John Johnson said he is looking into solutions that would provide automatic, better and faster address and route mapping in first responder vehicles, similar to what the Monroe County Sheriff’s Office uses.

• Serenity Cove, located on the former Longhorn Lodge property across from The Boat House on the east end of Marathon, now has two conditional use agreements approved by the City of Marathon. The land has been vacant for about 15 years and the rights for the hotel rooms transferred to the Marriott Courtyard. It was previously approved for 17 market-rate homes. This week, the council approved the construction of 42 workforce housing units in a single building, three stories over parking. The council stressed this is an either/or agreement, but the site cannot accommodate both. Both plans call for retail space on the highway. The developer, Prime Group, said the project could start immediately if and when it is allocated some of the 300 building rights currently being challenged by administrative appeal in Tallahassee. Planning Director George Garrett said he doesn’t expect an opinion to be issued until this summer. The developer’s representative also said it has built similar affordable housing in the Upper Keys, where it owns another resort, and has had trouble finding qualified applicants for the “low, low” end of the affordable housing rentals.

• The council agreed to extend developer agreement and conditional use plans for the property known as “Jo Jo’s” on Grassy Key for four years. The original plans for 14 market-rate homes, a marina store and gas station were approved five years ago. Staff will bring back a package that includes what constitutes “substantial progress.” Councilmen Senmartin and Zieg expressed frustration at “endless agreements” of stalled projects.

• City of Marathon attorney David Migut voluntarily resigned at the Jan. 14 meeting. His severance package includes a lump sum payment of 20 weeks of base salary and 7.5 weeks of accrued vacation and sick time, as per his original employment contract. He bid the city farewell and wished the council well. He and his family plan to relocate to St. Augustine.

igeon Key was identified on early Spanish charts as Cayo Paloma. Paloma is the Spanish word for pigeon. The story goes that the island was once home to large flocks of white crowned pigeons.

It would appear as Dove Kay on an 1846 chart. A couple of years later, in “Reconnaissance of the Florida Reefs and All the Keys,” F.W. Gerdes would write, “The first key in Bahia Honda Bank W. of Key Vacas Harbor is named Pigeon Key.” Pigeon Key, the lynchpin of the Seven Mile Bridge, is an amazing little island and one of the few in the Florida Keys chain that proved integral during construction of both the Over-Sea Railroad and several versions of the Overseas Highway. During the railroad’s construction years, the island was used primarily as a work camp. An article dated Jan. 21, 1912, appearing in the Indianapolis Sunday Star, reads, “The camps are in charge of a resident or division engineer with the one at Pigeon Key presently the most active. At high tide Pigeon Key is about two acres in extent and perhaps three acres at low tide. There are four bunkhouses, each designed to hold 64 men; one of them for the foremen, who are housed apart from the laborers. Each has a reading room with good lights. Good mattresses are provided on standard double-decked bunks, with plenty of clean bedclothes; all laundry work being done by the company. Once a week all beds are washed and thoroughly disinfected to keep any parasites from getting a start.”

With the completion of Flagler’s train tracks, Pigeon Key stopped operating as a work camp and transitioned into the home base for the maintenance crew as well as the bridge ten-

der in charge of opening and closing the swing bridge over Moser Channel whenever boats needed to pass. From there, a small community developed and from 1912-1935 as many as 40 people called the island home. A school opened in 1923 and on April 9 of the same year, Post Office Pigeon Key was established. It would operate for a decade.

The 1935 Labor Day Hurricane would alter the course of history not just for Henry Flagler’s railroad, but for Pigeon Key, too. While the Category 5 hurricane is still considered the most powerful storm to strike North America, it was not a large storm. The eye wall crossed the island chain only 20 miles away, but Pigeon Key was left relatively undamaged. Flagler’s railroad could not make the same claim as 40 miles of track were twisted and torn from the bedrock. Sept. 2, 1935 would ultimately become the day the train to Key West died.

A little more than a year later, the Florida East Coast Railway sold the right-of-way of the Over-Sea Railroad to the state of Florida for $640,000 – included as part of the right-of-way was Pigeon Key. Because the railroad bridges had largely withstood hurricane forces and remained standing, those abandoned bridges between Lower Matecumbe Key and Big Pine Key were widened to accommodate automobile traffic. The Overseas Highway, prior to the 1935 hurricane, had been incomplete and required passage aboard an automobile ferry to complete the trek from the mainland to Key West. Retrofitting the railroad bridges so that they became suitable for automobile passage would eliminate the sometimes unreliable and always time-consuming ferry system. The project was overseen

by the newly formed Overseas Toll and Bridge District, headquartered at Pigeon Key. When the Overseas Highway reopened to traffic in 1938, the improved road system had also become a toll road with two toll booths, one located at Lower Matecumbe Key and one at Big Pine. All money collected at the booths was brought to operations at Pigeon Key. Though created to repay a $3.6 million federal loan obtained to improve the Overseas Highway, the funds were being used to lavish expensive food and drink on the district headquarters. Other fraudulent indulgences included the construction of a swimming pool and the purchase of a luxury cabin cruiser for fishing.

Once the schemes were uncovered, the Overseas Road and Toll Bridge District was closed, the toll booths hauled away and, on April 15, 1954, the road opened as the Florida Freeway. The change of name did not go over well with locals, who petitioned to have the name changed back to the Overseas Highway. Pigeon Key was subsequently given to Monroe County and today the old wooden buildings out on the island sit like a ghost town of sorts. The historic island is managed by the Pigeon Key Foundation and tours of the island feel a great deal like stepping back in time. For $12 ($9 if you are a Monroe County resident), a boat will take you out to the island.

Plant clinics set for Marathon The UF/IFAS, Monroe County Master Gardener Volunteers hold plant clinics to address residents’ plant, insect and gardening questions every month in Marathon through March.

Jewish services to be held in Marathon The Keys Jewish Community Center will be holding a short afternoon service and social gathering on Sunday, Jan. 19 at 2:30 p.m. in Marathon.

This is the second time that the organization, whose normal services take place in Tavernier, has held services in Marathon. KJCC has a number of members in the Middle Keys and wishes to reach out in order to meet their needs.

HELLO, LIEUTENANT Kellenberger promoted; headed to Islamorada patrol division

n Jan. 9, Monroe County Sheriff Rick Ramsay announced the promotion of Sgt. Chuck Kellenberger to the rank of lieutenant.

Kellenberger is to head up the patrol division in Islamorada, replacing Lt. Mike DiGiovanni, who is being transferred to the training division. Kellenberger is one of four lieutenants in the Keys patrol division.

Kellenberger, 48, has spent 25 years on the force. Most recently, he’s worked in the Middle Keys district. He started as a cadet, then became a dispatcher while also serving as a reserve deputy before attending the academy and joining patrol. In addition, he is a certified firefighter and EMT and serves as a volunteer.

“I am very pleased to be promoting a hometown officer,” said Ramsay. “He’s a hard worker and represents me well, leading by example. He enforces the law with professionalism.”

Kellenberger said his favorite part of the job is, simply, helping.

“It’s satisfying. I grew up in this community and admire how everyone here helps everyone else. When I was growing up, folks extended a hand and I want to do the same thing,” he said. “I look forward to joining Capt. Corey Bryan and continue to work with the team. This is my home, this is my family.”

In his new position, Kellenberger will be tasked with carrying out Ramsay’s vision of community policing and getting to know the business leaders and partners in the Upper Keys.

n Florida, a handful of new laws went into effect at the start of the year.

While the most talkedabout change involves texting while driving, several others could affect your life here in the Keys.

Cigarettes & vaping: The minimum age to purchase cigarettes or vaping products went up from 18 to 21. In the next 30 days, most fruit- and mint-flavored nicotine vaping products will be banned by the FDA.

TIFFANY DUONG Lower business property taxes: Taxes on commercial leases dropped from 5.7% to 5.5%. The reduced sales tax rate applies to rentals, leases and licenses to use real property.

Texting: Texting while driving has become a “primary offense,” meaning cops can pull drivers over on suspicion of texting while driving alone. “Texting” includes emailing, messaging, and otherwise typing on a cell phone while driving.

With the new year, police can now issue uniform traffic citations for texting behind the wheel. A first offense is a $30 fine and court fees. Holding a phone in a school zone could result in a fine.

Real ID: Does your driver’s license have a little gold star on the top right?

If so, you’re safe. If not, you’ll need to get a Real ID sooner rather than later.

Real ID attempts to improve the security of licenses and ID. cards. On Oct. 1, 2020, you won’t be able to fly in/out of Florida on a commercial airplane with a non-compliant license alone. As of the new year, non-compliant licenses no longer can be renewed online.

Minimum wage: Florida’s starting minimum wage increased by $0.10, from $8.46 to $8.56. Amendment 2, which voters will be able to vote on in November, would increase this to $10 in 2021 with a gradual rise to $15 by 2026.

New Florida laws took effect Jan. 1

Notarizing documents: Need to notarize a document in Florida? Now you can do it online. Notaries must be physically present to perform the service, but signatories can now be anywhere in the world and still have documents legally notarized through online-video communications.

Prescriptions: Prescriptions now must be sent electronically. Medical care providers have until license renewal or July 1, 2021 to comply. A waiver and a few exceptions exist.

fter graduating from high school, Coldwell Banker Schmitt’s Sam Williams moved from Grove, Oklahoma — in the top, right hand corner of the state — to Colorado. He was working at JC Penney for $9 an hour, he said, when a salesman approached him and sold him a discount card for oil changes.

Williams didn’t own a car.

“The guy says to me, ‘Well, do you have a girlfriend? Buy her the card!’ And the next thing I knew I had shelled out the money,” Williams said, from his second-floor office in the Marathon real estate office. Long story short, he got a job selling the discount cards, too.

“I knew from the moment I was standing in front of that first door, getting ready to knock on it, that I was going to be a salesman,” he said.

How long did you live in Colorado? I spent four years there doing the door-to-door sales.

It gave me the experience and training to do what I am doing now.

Who were your customers?

Anybody on the other side of the door who owned a car. I loved apartment complexes. It was a pretty simple pitch, but it was fun. I could hit 100 doors in four hours.

How did you get to the Keys?

I came out to visit my mom and dad who were living here at the time. I thought there was no way I could live in the islands — it was too similar to where I grew up.

That changed on my third visit to the Keys.

How old were you when you moved to Florida? Twenty-one years old. For the first 30 days, I fished every single day on the Marathon Lady. (My dad worked aboard.) Then I got a job at the Island Fish Co. Back then it was the hub of Marathon. Everybody came through the place. I met a lot of people and eventually, years later, they became my customers.

What makes you a good salesman? Four things: energy and enthusiasm, market knowledge, aggressive lead follow up and my database.

People like energy and enthusiasm. It’s infectious. A lot of times, it can win you the deal even if you didn’t have the best presentation.

What are some of your proudest achievements? I’ve been the top agent for both dollar volume and total number of sales in the Middle Keys for the past eight years, and No. 2 Keyswide.

What are some of the tools in your box of sales? I spend time thinking about which of my activities generate income and I have a real estate coach. We have numbers, goals and a business plan every year so we know where we’re going. It’s a game changer and the only way to be able to build a reliable income in this business. The accountability aspect is very important.

Do you have repeat customers? Yes. There’s a lot of turnover in this market. People come down, buy a condo and then upgrade to a half duplex or a single-family home. They get their foot in the door and position themselves to move up to the next level.

What did you think you were going to be when you grew up? I had no idea. I wasn’t good in school; I just wanted to work. I would skip to go sell minnows, bait and fishing licenses at my grandfather’s sporting goods store. The very first day that I sold the oil change discount cards, I sold out by noon and made $300 in four hours. I never looked back. How much you’re worth depends on how much you put into your work.

Would you ever start another career? I don’t see myself leaving Coldwell Banker Schmitt.

I have a strong allegiance and we are offered a vast amount of resources. The fact that 46 of the top 100 agents in the Keys are from Coldwell Banker isn’t by accident, but by design.

You’re a big fitness nerd; what do you like about it? It’s the accountability thing again.

At Keys Strength and Conditioning I like the group exercise; a lot of energy comes from that group and it’s very motivating. I can’t believe what it does for my mindset and my energy. I wish I had found this earlier in life. My daughter, Mia, who is 7 years old, sees me and her mom working out and is starting to explore the kids’ obstacle races.

Do you have a bucket list?

Well … I have planned four Spartan races for 2020, does that count? And I go to four career conferences a year. And we take one major travel vacation every year.

What’s the easiest and hardest obstacle in a Spartan race? The monkey bars or the walls are the easiest. The rope climb is the hardest.

If you were stranded on a desert island, what three things would you need? A spear gun, a snorkel set and a water purifier. I love life, so I am all about survival.

Do you have a life motto? You become what you think about. I tell that to my daughter all the time.

onroe County Sheriff Rick Ramsay presented College of the Florida Keys President Jonathan Gueverra with a check for $100,000 last week. The donation will help fund the college’s new Key Largo campus.

“When Dr. Gueverra told me a few years ago about a campus in the Upper Keys, I told him to count me in, and that I would come up with the money to help,” Ramsay told the Weekly. “It’s all about partnerships; the sheriff’s office loves being a team player and supporting good causes that help the community.”

The donation came from drug forfeiture funds and not taxpayer dollars, confirmed Adam Linhardt, director of media relations for the sheriff’s office. “It’s not uncommon for the sheriff to donate $100,000 to the community,” he added. “It’s legally complicated, but the sheriff always makes the determination what his legal options are and what will best serve the community. We do our best to help as many people as we can.”

Ramsay is known for his fiscal responsibility and his push to give money back to the community, Linhardt said. “A big part of the sheriff’s leadership philosophy is to be a steward of taxpayer money or money flowing into the office that we did not foresee, like drug forfeiture money,” he said. “The sheriff tries to give that money back to the community when appropriate to do good things.”

The sheriff’s office has a longstanding, good relationship with the College of the Florida Keys, where cadets can take criminal justice classes and other training, said Ramsay. “The new campus will help the community overall with higher education for all our citizens. It will also enhance law enforcement training capabilities services in the Upper Keys, and even South Dade, with advanced training otherwise not accessible because Key West is so far,” added the sheriff. He noted that this partnership is “good for all” and further evidence of his strong belief in partnerships among police, residents, businesses, churches and schools.

Gueverra agreed. “The sheriff and I have been partners ever since I took the helm at the college,” he said. “This gift is a continued demonstration of his commitment to our community and education. Without his office’s ongoing support, we would not have a quality, affordable, locally accessible law enforcement training facility.”

The sheriff’s office assured the Weekly that as more money comes available down the road, the sheriff would continue to find uses that benefit as many in the community as possible.

Locals register for race next Thursday Locals can register for the 7 Mile Bridge Run on Thursday, Jan. 23, 2020 beginning at 6 a.m. The field is limited and often sells out in minutes. Runners must show a photo ID with the same Monroe County address with which they registered when picking up the race packet. Out-of-Keys runners who attempt to register in the Keys resident category will be disqualified and will not receive a refund.

FKAA offers discounts for seniors, disabled veterans The Florida Keys Aqueduct Authority is continuing its effort to assist income-eligible seniors and permanently disabled veterans by reducing their monthly utility bills. This discount removes the base facility charge for the water bill and will also eliminate the wastewater base facility charge for those customers in FKAA wastewater districts (Bay Point, Big Coppitt, Cudjoe Regional, Conch Key, Duck Key, Key Haven and Layton). Qualified customers may save up to $42.11 per month. This assistance is currently provided to about 2,000 households in the Keys. To be eligible the applicant must be 60 years of age or older or a permanently disabled veteran on the date of application. The household income must be less than the maximum benefit limits set by the Social Security Administration for benefits. The current maximum income for a single person household is $36,132 and, for a residence with more than one occupant, the maximum allowed income is $72,264. Discounts are only available on the applicant’s primary residence.

To apply, customers complete the application online or at any of FKAA’s three customer service offices. New applications are accepted throughout the year, but will expire on March 31 of the following year. To continue the discount without interruption, customers must reapply by March 31.

he Jan. 22 BOCC meeting will be Craig Cates’ first as the Monroe County District 1 county commissioner.

Gov. Ron DeSantis appointed Cates to fill the vacancy left by Commissioner Danny Kolhage’s early resignation in November 2019. The former Key West mayor shared with the Weekly his thoughts and priorities approaching his first meeting.

“I’m excited to represent the citizens of Monroe County,” Cates said. “I thought it wouldn’t be until November this year, but now I get to go to work right away.”

His transition from city to county government has been relatively easy because the big issues are the same, he said. “I’ve worked with the county quite a bit over the years on all these issues, so thankfully, there isn’t much of a learning curve to get to speed.”

Still, Cates has spent the last month since his appointment meeting with department heads within the county, researching major agenda items, and reviewing big projects in the pipeline. “I want to meet everyone so they know what kind of person I am and what I would like to accomplish in the county,” said Cates.

Cates has also invited constituents to meet with him on Thursday, Jan. 16 at 5:30 p.m. at Bernstein Park on Stock Island. He hopes this community meeting will be the first of many interactions with stakeholders and the community.

The commissioner cited several important issues for his district, which includes Stock Island. Topping his list are zoning changes,

abandoning roads and transferring and awarding new ROGO units. He anticipates the major item at January’s meeting to revolve around the approval of 280 new affordable housing units as the Wreckers Cay Apartments at Stock Island, LLC project. The proposal includes 70 low-income, 70 median-income and 140 moderate-income units, which will be built on what used to be a trailer park on Stock Island. The county also plans to abandon three roads to expand the acreage of the project and to maximize how many affordable housing units can be built. Cates hopes to leverage the abandonment to negotiate more low-income units for the county.

“We need some assurance that if we give something up, we will get back something we want for the residents.” The project is slated to be one of the most complex ever attempted in the Keys, said the commissioner.

“Luckily with my experience in past projects, I understand what’s going on with land development regulations and zoning.”

Affordable housing tops Cates’ concern both for his district and for the county. His other critical concern is sea level rise and how it will affect everyone in the Keys in the future. “People are getting concerned whether the Keys will be here in 30 to 40 years. We need to assure them that it will,” said Cates. “We need to do things to mitigate, plan and show the public that we won’t be lost to the sea.”

Relying on his experiences in Key West, Cates explained how the Southernmost City has already installed injection wells, drainage, pumps and generators to eliminate flooding. “We redid the drainage on Duval Street; it used to flood and doesn’t any more.

We can do more projects like this.

I have a lot of experience, and I’m excited to bring that to the county,” added Cates.

“All these issues will be challenging because there’s no magic wand for any of it,” he said. “We will try to make the best decisions for the community, but there’s gonna be some give and take.

They’re all challenging issues, but I’m up for the challenge.”

SCHOOL TRANSPORTATION FACILITIES TAKE SHAPE IN KEY WEST, MARATHON

A

block-long fence on Stock Island encloses the construction project that eventually will enable the school district to convert its downtown transportation and administrative headquarters into long-awaited workforce housing.

The new, $14 million Transportation and Internal Services building that Ajax builders is constructing on 5th Street on Stock Island will house the school district’s Key West bus fleet, maintenance bays, transportation offices and other internal department offices.

The building is due to be finished for the 202021 school year, according to a timeline discussed at a November school board meeting.

“Initially, our sole intent for the Stock Island property was to only use it for the transportation department,” Superintendent Mark Porter said back in July, when fielding concerns about the project cost. “But then we decided to add other internal departments to the mix because that would help us vacate a significant portion of the Trumbo Road property.”

The Stock Island site also will include 5,000 square feet of space for the storage of paper records that are being digitized.

Former school board chairman Bobby Highsmith called the transportation building, “the first

time in 16 years that this school district has made a positive step toward converting Trumbo Road to housing.”

But the school district is also addressing its transportation needs in the Middle Keys.

In Marathon, “Building No. 5” is under construction at the northeast corner of the Stanley Switlik Elementary School site. It’s approximately 7,000 square feet, and wrapped into the larger renovation of the school, set to be complete by the time the 2020-21 school year starts in August.

District maintenance and transportation employees, who currently work out of a smaller building nearby, will use the new facility.

“This will be an official space with a bus bay,” said Doug Pryor, the district’s facilities manager.

"There will also be spaces for parts and tire storage, a workshop, maintenance storage, a locksmith shop, plans storage and ancillary offices.”

The entire school renovation is projected to cost $38 million and is about half complete. The staff and students have officially moved into the new administration and new classroom building.

“The students and staff in the old Sue Moore building have been moved into the portable classrooms while the space is renovated. That renovation will also include the cafeteria building,” Pryor said.

Bluegrass fest this weekend

W

Islamorada Community Entertainment’s eighth annual Craft Beer and Baygrass Bluegrass Festival culminates with the main concert on Sunday, Jan. 19 at Islamorada’s Founders Park, MM 87. Multiple award-winning artists from around the U.S. will descend upon two stages for a day’s worth of jamming and toe tapping.

“We’ve invited our favorite Florida brewers to join with some of the country’s top bluegrass, newgrass and Americana performers for three days of great music in the Florida Keys,” said David Feder, president of ICE. On Friday, Jan. 17, the party events kick off with a 6 p.m. “Square Dancing in the Streets Party.” On Saturday, Jan. 18, there’s a Pickin’ Party with a full night of music on two stages, and a craft beer tap takeover starts at 4 p.m. Both events are a $10 donation per adult; those 17 and younger are admitted free.

arathon is set to welcome two new art installations: one at Crane Point Museum, and the growth of a new park on the west end of town.

Lori Gaukel, who owns Shady Palm Art Gallery, has been hatching her plan for four years. She is developing a children’s art park on the triangle of land between her business and the entrance to the state and county government center located at 2798 Overseas Hwy., on the gulfside.

“When we started, it was filled with trash,” said Gaukel, “and poisonwood.”

Now, it’s home to two plaster sharks and one manatee. There’s another on the way: “It’s going to be a ‘Marilyn Monroe’ manatee complete with the white dress,” said Gaukel.

Right now the land belongs to the Department of Management Services, a branch of the state government. She said her husband, Barry, who is also a Weekly photographer, “lucked” into dialing the right number in Tallahassee.

He learned that the state can’t lease land to a private person, but could lease it to a governmental entity, such as the City of Marathon. Lori Gaukel said Marathon Rotary Club members

like City Manager Chuck Lindsey, Councilman John Bartus, and especially Planning Director George Garrett have been instrumental.

Gaukel is brimming with ideas for the park. She wants to build a stage and invite young musicians and performers. She wants to paint a community mural using residents’ and visitors’ handprints that would become, for example, a depiction of brain coral. She also wants grass and flowers, and has a fresh and local take on Chicago’s art in public places featuring the bull. In Marathon, that would be fish.

“I am so excited about this park,” she said.

The second art in public places has been three years in the making. It is the last-but-one piece to be installed on the Florida Keys Sculpture Trail. Five others were installed from Key West to Islamorada before Hurricane Irma seriously disordered the Keys. “Bridge” by Jamie Emerson will be installed at Crane Point Museum. The art piece — shaped like a triangle with cutouts — features murals on the inside. The artist plans to come to Marathon in February to touch up the pictures. The museum is in the process of creating a suitable foundation for “Bridge,” so named because it formerly occupied a pier at Riverside Park South Waterfront.

The trail features sculptures created by the Art Students League of New York’s Model to Monument program. The idea is the brainchild of Key West philanthropists Jacob Dekker and John Padget.

“Susann D’Antonio and I co-chaired the installation, curated it. We found every location, brokered every deal,” said Elizabeth Young of the Florida Keys Arts Council. She found the spot for “Bridges” while speaking at the Marathon Rotary Club. “Charlotte Quinn stood up and said, ‘I’ll take it!’” said Young, laughing.

he 2020 Rock and Roll Hall of Fame inductees were announced this week, setting off a social media firestorm as many questioned the selection process and the true definition of “Rock and Roll.” Regardless, on May 2, The Doobie Brothers, Depeche Mode, Whitney Houston, Nine Inch Nails, The Notorious B.I.G. and T. Rex will all join a legendary list of timeless musicians. And while much of the selection process is subjective to the ever evolving artistry around the rock genre, there is always plenty of room for debate on those who have yet to receive a ticket to Cleveland’s Public Auditorium. RESTORATION BLUEPRINT Stakeholders weigh in on Sanctuary proposal NOAA’s Restoration Blueprint was introduced at the Sanctuary Advisory Council’s meeting in August, and the community has been buzzing about it since.

The proposal seeks to balance the need to bring our marine environments back to health while still promoting the economies and industries depending on those resources.

Four alternatives were presented, but constituents were invited to comment upon as much or as little of the proposals as they wanted – whether that be a specific reef, certain regulations, or an entire alternative. Alternative 3, the sanctuary’s preferred plan, would result in major changes in terms of expanded boundaries, additional zoning, tighter regulation and a new management plan.

Keys Weekly spoke with environmentalists and stakeholders in affected industries about NOAA’s Restoration Blueprint.

Do What We Can Today, To Save What We Can For Tomorrow So far, community response to the Restoration Blueprint proposed by the Florida Keys National Marine Sanctuary has been divided. At the recent community forum I attended, the loudest voices were those of fishermen and backcountry guides who are concerned that the proposed changes will negatively impact their livelihoods.

We need to listen to the Keys’ fishermen – they are world-renowned experts in their field and their opinions should carry as much weight as anyone’s.

But we also need to hear from experts in marine conservation and restoration. Because if there’s one thing I think everyone can agree upon, it’s that the Keys are not what they used to be. Not by a long shot. And the consensus among scientists and conservation practitioners is that if we don’t act now to restore and protect what remains of our marine ecosystems, everyone’s livelihoods in the Keys are in jeopardy.

Coral Restoration Foundation (CRF), one of this community’s most active leaders in coral reef science, conservation, and restoration, supports the Sanctuary’s preferred options outlined in the Restoration Blueprint.

At CRF, we see the difference that Sanctuary Preservation Areas (SPAs) can make for our work – corals planted in SPAs tend to grow better, because they are afforded protection from anchors and fishing. We also see a relationship between the traffic on a reef, and the health of the corals on that reef. On Molasses Reef, perhaps the most popular diving reef in Key Largo, the health of corals planted by CRF has been historically poor. At Carysfort Reef, which receives comparatively less traffic, corals are growing well, even after the destruction of Hurricane Irma. At North Dry Rocks Reef, with only three mooring balls, corals planted by CRF are now dominating the tops of reef spurs.

A common claim is that none of this matters if we don’t first address the water quality issues of the Keys.

But CRF grows more healthy coral in its nurseries than can be planted in a given year.

These nurseries have the same water as reefs, so what gives? The nurseries are protected areas, and there are so many corals that a “safety in numbers” effect essentially snowballs their health and growth.

This translates to the reefs, too. On nearly 30 Keys reefs, there are corals that would not be there without CRF’s work. In most cases these corals are now the only representatives of their species on those reefs. And on well-managed reef sites, these planted corals are now maturing and spawning naturally.

This serves to illustrate an important theme for corals. These little animals face a myriad of issues in the Keys, but they can be incredibly resilient, if they are just given a chance – if just a few of the issues facing them can be alleviated or eliminated. Water quality is at least a state-level issue (if not a federal-level issue) and, while it does need addressing, it will not be fixed tomorrow or next month or even next year.

In the meantime, we can give our corals and the reef system they build a fighting chance by enacting the sanctuary’s preferred options and removing the most localized and direct impacts affecting reef health. Middle Keys team bests Palm Glades Prep

T

he Marathon High School boys basketball team came roaring back from Christmas break to beat Miami’s Palms Glades Prep Academy 50-43 on Jan. 10 for the second win of the year. “We played well enough to win, but definitely didn’t play our best,” said coach Kevin Freeman. The team only had seven players as one was suspended. Anthony Ross had a career high of 27 points during the game. On the following day, the team played Palmer Trinity — still with 7 players — and lost 61-27.

I

t’s midafternoon on a gusty day in the Florida Keys. The seas are 4 to 5 feet and the sunshine is abundant. Yeah, another perfect day in paradise and I’m milling about smartly on the boat, dedicated to not getting anything done. Just as my dedication is peaking, one of the rental boat office girls comes running down the dock, phone in hand and wearing panic like a bad sunburn. She comes straight to my boat and CAPT. MIKE informs me that they have a lost boat that is in BARBER trouble.

“No, (expletive) we’re in trouble.”

“Well, sir if you’re not sinking, taking on water, and there is no medical emergency; what is the trouble?”

To this he answered, “We can’t see land anywhere and we’re lost!”

It took a few minutes to find out what kind of boat he rented, when he left the dock, and whether he was in the Gulf of Mexico or the Atlantic. Once I had his general location I got him back on the phone and told him to set a course due north and look for a 10-story condo unit. The plan was for him to call me back when he could see it.

He calls me back in two minutes and says, “Listen, on this compass … should the big N be facing the front of the boat or me to steer North?” Once I’m sure he is heading north, I headed out to intercept him. Before I can get out of the harbor he calls and says he sees the condo. He sounds like a man who just won the Powerball lottery.

I’m not a fan of incorporating old adages into my writing, but … “you can’t make this stuff up.” The rental boat had a Richie Magnetic compass, GPS chart plotter, and a paper chart of the Middle Keys.

So the moral of this event should be that being a prudent, experienced mariner must include the capacity to look after the newbies. While cruising coastal waters, many of the dangers we encounter are the other, less-experienced captains. Our historical legacy demands that we take on the responsibility to provide assistance to all vessels in distress that we have the resources to provide without endangering our own crew and vessel. It is a big legacy. It is distasteful because none of us instinctively sympathizes with the rookies among us. If you’re reading this, I trust that you are one of the prudent mariners and understand this responsibility.

TWO YEARS, FOUR MONTHS Irma keeps on giving…

A

mong the typical conspiracy theories and partisan bickering, there have been some serious complaints about issues in Marathon on social media.

People wonder why there are still very few street signs, the lights down Sombrero Beach Road don’t work — the litany of Irma frustrations remains long and, well, frustrating. And that’s totally understandable.

We are well past Irma’s second anniversary. And out of more that $30 million in direct costs to the city from Irma, Marathon has yet to see $2 million in FEMA reimbursement.

And it helps to recall that the key word is “reimbursement.” The city has to spend the money on a project before we get any funds. Not only that, the city can’t spend any money until the project has been approved for reimbursement by FEMA. Marathon moved forward on Sombrero Beach because FEMA approved the PW (Project Worksheet). We prioritized our parks and beach restoration to help restore quality of life for our residents. But Marathon hasn’t had that many other PWs approved… including those for street signs. Federal law does not allow the city to move forward without FEMA approval; ergo, no street signs.

I realize how frustrating it is. It’s very frustrating to drive up and down U.S. 1 and see street numbers painted on electric tie line poles. It’s frustrating to want to do so much more knowing that our hands are tied by FEMA’s bureaucracy.

The only thing we can realistically do is keep pushing and keep lobbying FEMA to push our PWs through. Our city manager, council members, staff and lobbyists continue working to make progress and rebuild our town.

Marathon has budgeted for $11 million in FEMA reimbursements this fiscal year, and I’m hopeful our hard work and perseverance will pay off. In the interim, patience and understanding will go a long way.

There is, however, one way we could have done more. The city has the same millage rate it did before Irma came through. Had we only voted in a nice tax increase, and not worried about waiting for reimbursement, we could have had street signs and a whole bunch of other stuff. Thankfully, our manager, finance director and staff kept the city running debt-free while

While social media is full of spleen-venting folks looking for and assuming the worst, it always helps to find the real story. Instead of tearing down, why not try and be part of the solution?

If you, like many of us, aren’t happy about FEMA’s reimbursement timetable, you can help.

Pick up the phone or computer, and contact our congresswoman and our two senators. If they suddenly got hundreds — even thousands — of calls and emails from frustrated constituents about why our islands are still waiting for Hurricane Irma assistance, it just might make a difference!

ne of the Keys’ largest craft shows is right around the corner. The 35th Key West Craft Show takes place Saturday and Sunday, Jan. 25-26, from 10 a.m. to 5 p.m. each day. Over 70 local and national artists will line several blocks of Whitehead and Caroline streets. The Presidential Gates will be open to welcome guests to view the artists along the Truman Annex entry.

Fine craft artists travel from as far as California, Oregon, Colorado, Michigan and along the East Coast to showcase their work. Many of the community’s favorites will be returning, along with a number of new artisans and craftsmen.

This year’s artisans offer a variety of work, such as home decor in metal and wood. Visitors will find artistic clothing and accessories from hats to handbags, ceramics and handturned wood kitchen items. Many vendors have jewelry in gold, silver, glass, metal and precious stones. Handcrafted furniture, toys and metal sculpture are all offered at the show.

New this year is “The Market� at the Key West Craft Show, featuring local honey, body scrubs, handmade soaps, candles and more. “In a world of convenience, we often forget to step back and truly appreciate handmade items,� said show director Grace Epperly. “We invite you to come down and support these
