“We’ve started what we call the battle rhythm,” said Martin Senterfitt, Monroe County’s director of Emergency Management. “It’s like a timeline that we began when the storm was eight days out.”

He describes the Hurricane Dorian “dry run” in the Florida Keys as a checklist that begins with a phone tree, touching base with the section chiefs of the incident command system, a structure that provides order and outlines duties in the times of disaster.

Senterfitt also said he’s been in touch with the weather service, more than the prescribed amount, and also fielded calls from Tallahassee. Cities and counties around Florida render mutual aide by sending trained, incident-command professionals to areas affected by storms.

“Tallahassee has called us, not because they think we will be affected, but because they want to know who they can move where, based on where the storm hits,” Senterfitt said. “Right now, Florida is like a giant chessboard with pieces laid out all over the state.”

Assistant Attorney. She’s also the county’s emergency operations logistics chief, constantly recruiting members to her team.

“It’s very important to have a similar command structure, used by every emergency management agency in the country.

We’re better trained and we know what to do,’ she said. “In the event of a future storm, we’ll have to bring in fewer outside resources, although we will always need help.”

Marathon Fire Chief John Johnson is also on the move. He’s going department by department in the city, checking for storm readiness — topping off fuel tanks, inventorying emergency supplies.

“We’ll also be visiting local construction sites, reminding them to secure loose objects and bringing down cranes so as to minimize storm damage,” he said.

In the event of a serious storm, the City of Marathon has signed a “hurricane contract” to ensure it will have the right communication equipment. Johnson said the equipment would arrive before the storm, and be able to provide data lines and phones lines, via satellite, immediately after with guaranteed bandwidth.

SOLVE THIS MYSTERY, PLEASE Information being sought on Fishermen’s Hospital anchor

A

s the rebuild of Fishermen’s Community Hospital continues, so does the restoration effort on a key feature that sat outside the facility.

The anchor located next to the entrance has been a part of the hospital dating back to the 1960s. But that’s about all Mariners Hospital’s Dr. Brian Magrane and Candy Fincke know and they are searching for more answers. Who donated it?

Where did it come from?

Fincke, an information specialist, said she didn’t know about Magrane’s maritime history interest until they crossed paths during the Bougainvillea Ball in January.

“As we were going to tear down the building, one of the salvageable things was the anchor,” Fincke said. “The hospital planned on saving it and moving it back once the hospital was done. I found out that Magrane worked on these things. We couldn’t keep it on the property, so Magrane said we could bring it up to Tavernier to work on.”

The hospital opened its doors in 1962, but Magrane said the first documented photo showing the anchor at the facility dates to July 14, 1963. And while Magrane said it’s a key piece of evidence, he said the article makes no mention of the anchor.

Fincke said she’s gone through descriptive auxiliary meeting reports and hasn’t found any details either.

Magrane said the anchor is in good condition. Once the restoration is complete, he said it’ll last another 50-plus years so long as it’s maintained.

“We can conclude that it is Spanish in origin … clearly 17th century,” Magrane said. “It’s made with layers and forged, so it took some pretty extreme man hours to craft it. Due to wear, the core of the anchor is what we’re left with, but it’s solid as ever before.”

Magrane said the anchor is a key piece to Marathon’s history, as well as the hospital’s.

“You walked into the hospital and it was right there,” he said.

Magrane and Fincke are soliciting help from the public to solve the anchor mystery. If you have any information on who donated the anchor to the hospital, or where it came from, call 305-942-6744.

KEY VACA’S FIRST FLAGPOLE? MARATHON HISTORY BRAD BERTELLI

n 1910, George S. McClure was living in a wood frame house in the newly developing railroad town of Marathon.

In a collection of notes listing important dates in Marathon’s history, McClure is said to be the owner of the “first flagpole raised on Key Vaca with a United States flag.” The year was 1910.

While McClure might have been the first to raise a flagpole in Marathon, he was not the first to raise one on Key Vaca. The Pensacola newspaper The Floridian reveals the raising of a flagpole nearly 100 years prior. In a “Notice to Mariners” published on Feb. 10, 1823, the community of Port Monroe is advertised. “The public is informed that this settlement was commenced, November 19th, 1822 by Joshua Appelby of New Port, Rhode Island, and John W. Fiveash of Norfolk, Va. Immediately at the west of the Key (Vaca), which lies latitude 21, 41 N., is the settlement, which there is a flag staff erected.”

‘LOOK FOR THE HELPERS’ Local coastie awarded highest service honor

Coast Guard Bosun Tracy Mannes, 31, received the service’s highest honor in a ceremony earlier this week at Station Marathon for her bravery during the 2017 mass shooting in Las Vegas.

ust this month, Coast Guard Bosun Tracy Mannes, 31, was awarded the service’s Coast Guard Medal for her actions in 2017, during the mass shooting at the Route 91 Harvest music festival in Las Vegas.

The award is the highest honor in the service and the awards ceremony at Coast Guard Station Marathon was attended by the third-highest ranking officer in the service, Coast Guard Master Chief Petty Officer Jason M. Vanderhaden, as well as a slew of other dignitaries from Florida and the Keys.

“They kept shaking my hand and saying, ‘Thank you,’ but how can you respond to that?” shrugged Mannes. “There is nothing that can prepare you for this. It was a knee-jerk reaction — from taking off my shirt to jumping on them.”

Mannes used her own body to shield her partner as well as her best friend and two teenage girls they befriended at the concert. Her partner was hit three times in the leg. The mother of one of the teenagers was killed. In all, 58 people were killed, 422 were wounded, and about 851 were injured in the attack.

Mannes and her best friend, Tracy Huddleston, who is also in the Coast Guard, both received the Coast Guard Medal. Mannes’ partner has recovered from her wounds. All three women are still shaken by the events, of course.

Mannes is a West Palm native who has served six years in the Coast Guard. She’s been ported in Cape Canaveral, Florida; attended bosun school in Virginia; and ported in Galveston, Texas, before moving to the Keys in June.

Mannes said she and Huddleston are humbled and honored by the award, although they had no expectations of any recognition. Mannes was named 2017 Enlisted Person of the year for the Coast Guard’s 8th District, not only for her role during the shooting, but also for her involvement in volunteering with school-age children as well as volunteering during Hurricane Harvey in Houston with the American Red Cross.

The Keys Weekly declines to name the shooter and, instead, repeat the words of the late Fred Rogers. “When I was a boy and I would see scary things in the news, my mother would say to me, ‘Look for the helpers. You will always find people who are helping.’ … I did, and I came to see that the world is full of doctors and nurses, police and firemen, volunteers, neighbors and friends who are ready to jump in to help when things go wrong.”

SEPTEMBER Here is the story in her own words: My partner and I flew out to Las Vegas for the festival and met up with my best friend, also in the Coast Guard, who was stationed in Los Angeles. On the last day of the concert, we befriended a family on the shuttle on the way over to the fairgrounds. There was a grandmother, her two daughters, and two granddaughters — 14 and 16 years old.

We moved between the two stages to watch the acts, and at one point, the teenage girls said they wanted to get closer to the stage. We said we would take them, and we maneuvered our way through the crowd until we were about 100 feet from the stage, while the grandmother and mothers stayed further back near the chairs.

At some point, the mother of the 14-year-girl ran up. I think she was trying to pull us to safety. She fell on top of us.

I thought she was trying to use her body as a shield, too. Her head ended up in the lap of my best friend and we realized she had been shot in the neck. We applied pressure, but at one point she stopped bleeding. My friend and I just looked at each other and we knew she had died.

During the next pause in gunshots, while (the shooter) was reloading, I guess, we ran for cover to a small bar. We needed to get the 14-year-old to safety, off the field, that was our duty.

And then we made another run to the exit. From there we walked about a mile until a diner owner let us come inside. We waited five hours for an ambulance. My partner and I didn’t realize until later she had been shot three times, although the third was probably a ricochet.

Nothing can prepare you for this. And there is no ‘special lesson’ to learn. I love music and I won’t stop going to concerts. I am maybe more aware of my surroundings, and subconsciously noticing where the exits are, just in case …

Only written comments on Sanctuary Blueprint?

Last week, the Florida Keys National Marine Sanctuary introduced their Restoration Blueprint along with their Draft Environmental Impact Statement (DEIS).

The DEIS is the formal document detailing what actions the Sanctuary is proposing in order to mitigate significant damage to the marine environment as a result of climate change, recent hurricanes Irma and Michael and the degradation of water quality.

It is vitally important that all user groups participate in the scoping process. Following presentations at each location, Sanctuary personnel will seek public input on each alternative.

However, those in attendance in Key West, Marathon and Tavernier will only be permitted to submit written comments. This will necessitate also attending a Sanctuary Advisory Council meeting in October or December to provide oral comment.

Our organization, the Florida Keys Commercial Fishermen’s Association, has asked FKNMS Supt. Sarah Fangman to revisit this issue by appropriating time at all presentations for oral, public comment. We recognize the importance of maintaining a healthy and vibrant marine environment.

Lodging association gives scholarships

arathon High School graduate Rachel Lebo receives a $6,000 scholarship from Karen Thurman, vice chair of The Lodging Association of the Florida Keys and Key West. The group traditionally awards $4,000 to a Monroe County graduate seeking a degree in culinary or hospitality fields. However, the association chose two recipients in 2019. Lebo received $6,000 toward her tuition at Daytona State.

Organizers are planning a “soft” opening of the new Nature Center on Big Pine Key on Wednesday, Sept. 4.

The center’s regular hours will be Tuesday to Friday, from 10 a.m. to 3 p.m., with expanded hours as volunteer staffing becomes available. Admission is free.

Best of Marathon voting continues

M

arathon residents have until Friday, Aug. 30 at 5 p.m. to finalize the top three nominations in each category of the 2019 Best of Marathon contest.

Straight from the Weekly’s IT guy, Travis Cready: “Our readers should visit the Weekly’s website, keysweekly.com, and click on the Best of Marathon banner. Every voter will have the chance to nominate a business or person for each category.”

There are about 50 categories, ranging from the Best Place to Have a Wedding, to the Best Cup of Coffee, Best Realtor and Best Pool. For the first time ever, the Weekly is striking the Best Neighborhood category.

There will also be some new categories, such as Best Beer Selection.

The finalists are announced on Thursday, Sept. 5 in the Marathon Weekly. Voting begins AGAIN on Friday, Sept. 6 online at keysweekly.com as voters choose their favorite from the three finalists, or four if there’s a tie. In order for the ballot to be valid, and counted, more than 35 categories must be filled out. Otherwise, it’s considered ballot-stuffing and that’s a no-no.

That means each voter gets two votes — one in the nominations period, and the other to help determine the finalist. Cready has some special mumbo jumbo magic that makes it so every voter can only vote once.

The voting closes for good on Friday, Sept. 20 at 5 p.m.

And then the real fun begins. We let all the nominees chew on their fingernails for an ENTIRE week before the winners are announced at the awards party on Saturday, Sept. 28. As Marathon knows, you haven’t really “arrived” until you’ve been roasted during one of the skits.

CWA STRIKE

COMMUNICATION WORKERS OF AMERICA CHALLENGE AT&T

Some 20,000 AT&T workers in the Southeast who are members of the Communication Workers of America (CWA) union are striking because of what they say are unfair labor practices.

Two thousand of those workers are lining the streets outside of AT&T facilities from Pembroke Pines to Key West. Here in Key West, you’ll see workers outside the AT&T facilities on United and Southard Street.

If you’ve had trouble with service — including the call center, instillation and repair, landline telephone, Ethernet and fiber optic connections, the strike may be the reason.

“It’s an unfair labor practices strike,” said Christopher Walterson, AT&T employee and president of the Communication Workers of America Local 3122, which stretches from Key West to Pembroke Pines. “(Workers) went out because AT&T violated the NLRA (National Labor Relations Act), because they didn’t have anyone at the bargaining table that could make a decision,” he said. “So, we filed separate charges against the company.”

The other incident that prompted the regional strike took place in Miami, where union workers were doing their jobs while wearing a sleeve with the CWA emblem on it and the words “I pledge.” The workers were disciplined by AT&T and asked to leave and not return while wearing union apparel. “I’d hope to see AT&T allow us to act within our rights and wear unionbranded apparel and send someone to the bargaining table who can make decisions. But until that, we’ll be out indefinitely.”

Their contract expired Aug. 3, and according to union sources, AT&T has refused to bring top executives to negotiation meetings who have the power to agree to any significant changes to workers’ contracts. Walterson called an emergency membership meeting to address both the contract issue and the apparel issue. The workers have been striking since last Thursday, Aug. 22.

Walterson says that up and down the Keys, and on the mainland, the communities have turned out to support the striking workers and encourage their demands for fair terms.

“We’ve had very good community support, our brothers and sisters with Teamsters and the transportation unions have pitched in to help us out — even to keep us hydrated and healthy on the picket line.”

That’s not the only support the CWA has seen. Democratic presidential candidate and U.S. Sen. Bernie Sanders of Vermont stopped by a CWA march outside an AT&T Southeast office in Louisville to address the workers. At presstime, AT&T had not responded to our request for comment.

Marathon resident finds debris that could be part of a Russian rocket TIFFANY DUONG www.keysweekly.com

E

very few weeks, Tim Green paddles from his home near Sombrero Beach toward “Treasure Island” to collect driftwood for his artwork. “I make freestyle art out of things I find in the water. So, I’m always scanning,” he explained.

Pointing to his pool deck, Green said, “I was laying here on a lawn chair on a Sunday afternoon, and I looked out and saw what I thought was a huge piece of driftwood. I paddled out to see what it was, and it looked like a wing.” Green jumped on the piece and realized it floated. He called his wife, and the two used rope to tie the piece to their paddleboards and bring it to their house. Initially, he thought it was part of an airliner. “I was thinking, ‘How cool would that be?’”

Turns out, much cooler.

Unsure of what to do next, Green posted pictures of the cylindrical piece on social media, asking for leads. “It really turned into quite a conversation,” he said. His network speculated that it was likely a part of a spaceship or cylindrical booster. One commenter explained the mathematics to figure out the circumference. “Turns out the piece is probably one panel of four that covered a cylinder with a 59-foot circumference,” he said. “People thought it might be from a Titan Rocket booster that launched out of Cape Canaveral. The wildest guess was part of a space shuttle.”

This led Green to a whole new set of questions. Seeing the mass of shells and sea life that had overgrown the piece, Green guessed it had floated for ages. He said he wondered how long it had been floating in the ocean and, if it originated on Florida’s Space Coast, how it got to the Keys. Green sent an inquiry to NASA, hoping to find out more. The Keys Weekly reached out, too.

Mike Ciannilli — the Apollo, Challenger, and Columbia Lessons-Learned program manager at NASA’s John F. Kennedy Space Center — couldn't answer Green’s questions without seeing the piece in person, but did tell Keys Weekly one thing in a phone interview: “It is 100% definitely NOT shuttle-related or NASA-related from our rocket program.”

So what exactly is this big piece of potential space debris?

Ciannilli said he’s intimately acquainted with all aspects of the U.S. shuttle system and NASA rockets, and has learned quite a bit about other country’s space systems as well.

“Looking at the structure and past photos and data we have, it looks like it could be related to the Russian space program — a Soyuz rocket maybe,” Ciannilli said, adding the debris probably floated up from French Guiana in South America, where the Russians have a space center. He said it’s not the first time the U.S. has found this type of debris, nor likely the last.

When Tim Green picked up the space debris, he had to use his truck to eventually pull it up to the large size and light materials, Green originally thought it might be an airplane wing.

WHAT TO DO IF YOU’VE FOUND SPACE DEBRIS 1. Notify local law enforcement. They can contact federal agencies to identify the piece and to provide instructions for safe recovery.

2. Contact NASA Public Affairs and the main newsroom front office at 321-867-2468. If needed, law enforcement and NASA can contact the Department of Defense, which might conduct an investigation.

3. Do not try to sell or pawn any pieces, as that is a serious federal offense.

Ciannilli clarified that without analysis of the metals and alloys, no one could confirm exactly what the debris was. “The markings on that bear some resemblance to past Russian spacecraft we’ve seen. We can’t say definitively, but that’s an educated inference,” he said.

Greg Harland, a NASA public affairs officer, said rocket pieces show up on beaches all over the world. He said the public should notify law enforcement immediately for a variety or reasons, from safety to cloak-and-dagger stuff.

“There might be inert gases or fuel cells attached to rockets, and we don’t want anyone to get hurt,” Harland said.

“Space is intriguing and space is awesome, but it also shouldn’t be the thing that kills you.”

If authorities determine the space debris is unremarkable, it could be a case of finders-keepers, Harland said. “But … this is space technology. There are only five or six nations in the world that launch things into space. So, think how valuable those technologies are to adversaries who haven’t yet figured them out.”

American space debris is covered by the International Traffic in Arms Regulations (ITAR). Finding it isn't a problem, but trying to sell or pawn it would be, Harland said. Since rocket and space technology implicates U.S. national security and foreign policy, exporting such technology to a foreign national is be a "very serious federal offense" under ITAR and could get a U.S. citizen looking for a quick buck "in a big pot of hot water."

Green was surprised by the revelations and isn’t quite sure what comes next. “I’m fascinated something from so far away and intended for space could end up off Marathon,” he said.

It may be that the authorities come to collect it, or it may become an arresting piece of “yard art” and the tale of a lifetime.

eadership Monroe County, the educational non-profit community leadership organization, announces its twenty-eighth year of programs with the selection of Class XXVIII. The program is aimed at residents who are active in leadership roles within the private sector, government, or community organizations. Through a series of one-, two- and three-day sessions over seven months, participants examine fundamental public and private segments throughout the county to inform and help them make quality leadership decisions which they can incorporate into their respective companies and organizations. The program also provides an environment for mutual awareness on community issues, which class members confront. Sessions begin Sept. 27 in Key West, with subsequent monthly classes, throughout the Keys, culminating with graduation in April 2020.

Leadership Monroe County is an independent non-profit, governed by a countywide 17-member board. Officers are: elected LMC alum president Henry Rosenthal, vice president John Johnson, secretary Mindy McKenzie, and treasurer Bruce Halle, with program coordinator Michael Shields.

‘CONDUCTED IN BAD FAITH’ Judge rules against plaintiff over website accessibility JIM McCARTHY

On Aug. 23, a federal judge in Miami turned the tables on a plaintiff and lawyer who were suing a South Florida gas station for failure to provide closed captioning on the TV screens embedded in gas pumps that provide entertainment as customers fill their tanks.

The judge, Paul C. Huck of the U.S. District Court, Southern District of Florida, described the plaintiff and lawyer’s behavior as “unethical and sanctionable … conducted in bad faith,” and said he would impose “additional sanctions on both.”

The federal judge’s actions will no doubt bring a sigh of relief to many Keys residents. For months now, there have been rumblings about hush-hush settlements from not only businesses, but also municipalities, which have been charged with flouting the Americans with Disabilities Act because content on websites isn’t completely accessible to hearingor vision-impaired users. Complaints ranged from the lack of closed captioning on videos posted to websites, to pdf documents that are incompatible with screen-reading technology. In many cases, a plaintiff-lawyer team will file dozens of cases at once.

Monroe County has settled two such cases.

“The third one was so vague, so lacking in any type of detail, that I refused to settle,” said Monroe County Assistant Attorney Cynthia Hall. “I refused to settle and was prepared to litigate the case. I was in the process of telling the plaintiff’s attorney when he voluntarily dismissed with prejudice, which means he can never re-file.”

She said the tide is starting to turn.

“Federal courts are beginning to show a healthy degree of skepticism about the legitimacy of these sorts of cases,” Hall said.

Of the three cases against Monroe County, two involved the same lawyer, Scott Dinin, mentioned in the federal court order here.

The reason the cases haven’t disappeared completely is that there is not a set of rules for how to make a website accessible. A lot has changed since President George H.W. Bush signed the Americans with Disabilities Act during a ceremony at the White House on July 26, 1990. Just look at the rapid technological developments in those nearly 30 years

with the Internet and websites and phones and tablets.

Websites play a vital role in the modern commercial world. Amazon and eBay are the go-to for many to purchase goods. People are now their own travel agents, booking their stays and cruises online. With smartphone applications, people can order their pizza from Domino’s or a sandwich from Subway.

Maneuvering through a website isn’t easy for everybody, however, especially those who can’t see, hear or handle a mouse or phone. And it’s led to waves of ADA lawsuits in recent years against websites across the country, including here in the Keys where visitors often outnumber residents.

One Middle Keys businessman, who declined to be identified for the story, said since the ADA does not explicitly address online compliance, it is up to the courts to determine how standards apply to websites. He said he wanted to remain anonymous for fear of calling attention to the business, and opening it up to future lawsuits.

“This type of lawsuit affects every type of business; it’s a serious problem,” he said. “Anybody with a website is exposed to this and that’s a reality.”

Not only have businesses been hit with ADA lawsuits, but governmental entities have been subject to them as well. Monroe County has fielded two, settling for $10,000 and $15,000. In February 2017, the city of Marathon settled with Eddie Sierra, who is deaf, after he filed a complaint regarding the lack of closed captioning on videos posted to the web by the city. A settlement was reached in the amount of $8,117.50 and included providing captioned videos to Sierra, who also filed lawsuits in Lauderdale by the Sea, Doral and Flagler Beach.

Just recently, Islamorada settled with Juan Carlos Gil, who alleged that he couldn’t educate himself about the quality of life and governmental functions since the village didn’t have

electronic documents accessible for the blind and visually impaired.

Village Attorney Roget Bryan said settlements like Gil’s are the direct result of technology evolving and national laws failing to keep up.

“We’ll do our best to maintain the best practices and standards because there’s a lack of regulation in this area nationwide that a lot of corporations and local governments are struggling to keep up with,” he said. “Talking to colleagues at the state level, they all come and ask how we’re coping and managing.”

Hall said it’s imperative that the federal government issue rules.

“They have been invited to do so ... but haven’t taken up the responsibility. I think we will see legislation at the federal or state level, or regulations issued by a state or federal agency, and that’s what needs to happen,” she said.

“There’s an opportunity for legislation.”

Bryan says the village is in better compliance than others around the state, with a gold standard recognition for closed captioning and a fully accessible website. Bryan said the village is now getting ADA compliant in electronic document publishing.

A cottage industry is springing up around website compliance in regard to the ADA. Marc Dubin is a Big Pine Key resident who’s founder of ADA Expertise Consulting. A former Justice Department attorney responsible for nationwide enforcement of the ADA for over a decade, he’s now working and assisting businesses, as well as state and local governments, in understanding and complying with the ADA. Lawsuits pertaining to the ADA and the web come in waves, with the same general language against businesses, Dubin said. And while the ADA was written before the Internet was so widely used, he said, the Justice Department still applies the regulations

that require effective communication and nondiscrimination by a business.

“Efforts were made by the Clinton administration to write regulations, but they withdrew them,” he said. “The current administration doesn’t have any proposed.

That’s why businesses are saying that they don’t have to do anything because there are no regulations. That’s certainly an argument and one made in federal court in other parts of the country. In South Florida, that’s failed.”

Dubin said the Justice Department has adopted an international standard when addressing the accessibility of websites. It’s known as Web Content Accessibility Guidelines, or WCAG 2.0, and it’s used to determine whether there’s an ADA violation.

One of the major issues that Dubin noted is the web designer’s knowledge of the ADA and international standard that the Justice Department uses for the standard of accessibility.

“The web developer’s goal is to get more clicks and more views on the website,” he said. “They have expertise in getting butts in the seats or views on the web, but they don’t have the expertise in ADA. The business community usually says, ‘How are we supposed to know what to do? We’re not experts. That’s our contract with the web developer.’”

While he doesn’t develop websites, Dubin and his team of experts conduct a thorough review of the website. And they don’t use an automated tool.

“We have our experts go page by page, manually testing each page used by communities of the deaf, blind or those who can’t use the website other than (with a) keyboard,” Dubin said. “We tell them what’s in compliance and what’s not.”

Dubin said he doesn’t assist plaintiffs bringing ADA lawsuits in the Keys. More, he helps local businesses in defense of the suits.

“I made that commitment when I started this business,” Dubin said. “I am trying to be helpful and I’m trying to educate the business community.”
