O

n Gov. Ron DeSantis’ first official visit to the Keys on April 16, local officials had the opportunity to share their concerns with him in Marathon — hurricane recovery, water quality and Everglades restoration topped the list.

He also announced a new plan to clean every canal in the Florida Keys over the next 10 years. According to Rhonda Haag, Monroe County’s director of sustainability, there are 500 canals in the Keys; 172 have received recent attention after Hurricane Irma.

“That’s huge,” said Islamorada Village Manager Seth Lawless.

DeSantis did not elaborate on how much the plan would cost, but said the program would be ad-

ministered by state Department of Economic Opportunity.

“He saw how flawlessly we cleaned up after the hurricane — under budget and ahead of schedule,” said Monroe County Commissioner David Rice. “He knows this will be money well spent to protect the environment.”

Besides Keys dignitaries, also in attendance were Lt. Gov. Jeannette Nunez, who has Keys roots with a home in Islamorada, Director of Emergency Management Jared Moskowitz, Director of Economic Opportunity Ken Lawson, and Secretary of Environmental Protection Noah Valenstein.

T

he Lake Okeechobee Systems Operating Manual (LOSOM) is being redeveloped by the U.S. Army Corps of Engineers.

The Corps is in charge of regulating water levels of the lake, which is a lot more complicated than it sounds, and is inviting feedback from citizens affected by the lake and its runoff.

Lake Okeechobee has long been under scrutiny for its potential toxic environmental impact, especially its bluegreen algae bloom and its discharge into local waterways. Ultimately, that runoff ends up in the waters around the Keys.

The Corps says the purpose of the new manual — the first one since 2008 — is to reevaluate operations for Lake Okeechobee and its water level regulation schedule, as well as regulate operations of additional infrastructure: the Herbert Hoover Dike rehabilitation, Kissimmee River Restoration Project, the Comprehensive Everglades Restoration Plan (CERP) and C-43 West Basin Storage Reservoir and C-44 Reservoir and Stormwater Treatment Area.

What does all this mean? We break it down:

WHAT? The LOSOM dictates operations like how the Army Corps regulates water levels. The workshops, meetings and open comment period mark the beginning of a four-year process to rewrite the manual for the lake’s operation. The plan will be finalized in 2022. According to the Army Corps of Engineers, almost 2,000 members of the public have attended these “scoping meetings” to offer comment on the LOSOM currently in drafting process.

WHERE? Lake Okeechobee outflows into the Everglades, rivers like the Caloosahatchee and St. Lucie, smaller tributaries, the Florida Bay, coastal lowlands, and ultimately, the waters surrounding the Florida Keys.

WHY? The consequences of Lake Okeechobee water level regulation have proven crucial on the surrounding areas.

In the March 20 community meeting in Marathon, Congresswoman Debbie Mucarsel-Powell commented: “Every action that you take up north at Lake Okechobee has an impact down here. … That water charges our aquifer, prevents saltwater intrusion, provides us with fresh seafood and resources, and allows the people of

Monroe County to enjoy the way of life that makes them so unique. On the other hand, when that water flow is not made available, the community has suffered through seagrass die-off, algae blooms, poor water quality, and negative impacts on fish and wildlife.”

Now vice chair of the Water Resources & Environment Subcommittee, she is seeking $200 million for the Corps’ environmental restoration projects in South Florida.

“We need more fresh water discharge into Florida Bay during rainy season, and a lot more in dry season,” said Ross Boucek, a scientist with Bonefish and Tarpon Trust, also at the March 20 meeting.

Groups like Bullsugar report that in 2018, anticipating a dry season, the Army Corps didn’t draw down Okeechobee Lake levels adequately.

Their predictions were off, and in order to lower lake levels, they discharged “billions of gallons of toxin-filled water into coastal communities or to avoid piling too much behind an unstable dam,” according to Bullsugar. This is alleged to contribute to the toxic bluegreen algae bloom overtaking coastal waterways.

WHO? Any citizens are welcome to comment, but some comments are more useful to the Corps than others. The Army Corps is inviting input and asks people to consider: • What studies do you want to see?

ack in the day, when Monroe County Sheriff Rick Ramsay was a sergeant detective working narcotics, he knew of a man who shot himself in the stomach just to get a prescription for OxyContin.

“He didn’t want to kill himself; his intent was to get Oxy,” said Ramsay. In the 20 years since then, he’s witnessed OxyContin and street heroin ravage lives. “I’m glad Monroe County is taking some action on this.”

SEEKS TO RECOUP COSTS ASSOCIATED WITH OPIOID ADDICTION Last week, Monroe County filed a complaint that names Purdue Pharma and other opioid manufacturers and distributors on behalf of the county. It is not part of a cookie-cutter class action suit; rather, the case is specific to Monroe County and the impacts of the opioid epidemic in the Keys.

Monroe County joins a long list of entities with similar lawsuits dating back to 2007. According to the Washington Post, there are more than 1,600 entities — cities, counties, states and even Native American tribes — suing Purdue for allegedly creating a drug it knew was addictive and lying about it. OxyContin was first marketed in 1996.

“Lawsuits like this one have been going on with local governments throughout the country for the past years. But each plaintiff will have a different story, provide different medical services and been impacted differently,” said Monroe County Attorney Bob Shillinger.

Cynthia Hall, assistant county attorney, cited costs to the county’s self-insured health plan, EMS services and the population of Monroe County availing itself of services connected to the opioid epidemic such as addiction treatment, opioid related investigations, arrests, adjudications, incarceration, the treatment of addicted newborns, burying the dead, and the cost of placing children in foster care.

“When we started looking into this, we realized how far-reaching it was. We talked to the sheriff’s office, the medical examiner, court administration, human services advisory board,” Hall said. “We spent about a year on research.”

Monroe County Commissioner David Rice, who has a doctorate in chemical psychology, said the pattern of drug abuse in the Keys has changed.

“Twenty years ago, a heroin addict was a rare bird down here. That has changed,” he said.

“Personally, I know people who we’ve lost and

the hell they went through because they were prescribed opiates for chronic pain, became addicted to it, and woke up dead one morning.

Opiate abuse takes a huge toll on society, across social strata.”

Ramsay said the blame is more widespread: pharmaceutical companies, doctors, pharmacies, pharmacists. “It’s greed,” he said, sharing that he personally approached prescribing doctors years ago and was essentially told to kiss off, that he didn’t understand pain management.

The lawsuit is being handled by outside counsel. Morgan & Morgan is the lead law office, but includes the counsel of lawyers from seven other law firms. The lawsuit alleges that opioid manufacturers made false and deceptive marketing claims to increase the use of opioids and the profits, and grossly understated the addictive risk. The lawsuit also alleges that named opioid distributors failed to fulfill legal obligations regarding monitoring, detecting, reporting or investigating suspicious orders.

In 2011, the state of Florida cracked down on the popular “pill mills” — or clinics freely prescribing OxyContin and other opioid narcotics. During that time some of the worst abuses involved bus loads of “patients” who would make their way down I-95, collecting prescriptions from various clinics under a variety of false names, sometimes even stolen identities. And though the state laws curtailed the activity of pill mills for the most part, addicted patients were forced underground.

“These addicted people, they had to turn to something,” said Ramsay. “And that was street heroin. Today they shoot it, snort it or smoke it.”

Ramsay said the rise in crime associated with the opioid epidemic has many faces — burglaries for cash, burglaries with the intent to plunder medicine cabinets, the cost for arrests, investigations, jail time and medical attention.

This past week, a Key Largo student, 14, was arrested for bringing Xanax to school and giving it to two other students.

While not an opioid, it is a drug that makes opioids more dangerous because it also suppresses cardiopulmonary function. It, too, is addictive. And then there’s Fentanyl, which is often mixed into street heroin.

Just a few grains is enough to be fatal for some. According to the National Institute of Drug Abuse, Fentanyl is 50 times more powerful than morphine. OxyContin is said to be 10 times more addictive than crack cocaine.

Hall said the lawsuit is not frivolous.

“Opioid addiction has real costs for Monroe County taxpayers and we think it’s important to get the money back,” she said. “So we need to shine the spotlight on the problem and possibly fund recovery and treatment programs that will hopefully reduce the scourges of opioid addiction.”

In Islamorada, 97 doses of Narcan have been ordered since 2016. Fire Chief Terry Abel said some people only need one dose to come back around while others require

multiple doses just to keep them breathing.

The county said it collected data for more than a year to make its case from a variety of sources — the sheriff’s office, the medical examiner, court administration, human services … even libraries.

It’s still early days and there are a number of litigation issues that need to be worked out: Whether the defendants will try to separate OxyContin usage from heroin usage, whether other Keys municipalities will join the suit, and whether it will end, if the county is successful, in a one-time settlement or some other type of arrangement. Hall said she expects the case to take years to litigate, but not decades.

As of three months ago, more than 36 states are suing Purdue Pharma. Last month, the pharmaceutical company settled with the state of Oklahoma for $270 million. The company has been embroiled in litigation since 2004.

The case has been filed in the U.S. District Court for Southern District of Florida in Miami. The lawsuit is assigned to Judge Jose Martinez.

There’s no exact way to tabulate OxyContin or heroin abuses, but one set of numbers at least sheds light on the subject — the number of Narcan dosages administered in the Keys. An opioid overdose essentially suppresses the natural instinct to breathe. Narcan, or naloxone HCI, is an FDA-approved emergency treatment of a known or suspected opioid overdose. Narcan kits cost about $90 each. In the Keys, they’re carried by EMS personnel and sheriff’s deputies. On average, EMS delivers about 200 dosages of Narcan to patients experiencing an overdose in the Keys every year.

he live interview series “Off the Record” returns on Friday, May 3 to the Key West Theater in the Back Stage Listening Room.

The newest installment will feature Key West Weekly Publisher Britt Myers interviewing three notable Key West residents with varying backgrounds and journeys. Key West Theater and Rams Head Productions’ Bill Muehlhauser will be joined by the dynamic Qmitch Jones, along with the inspiring grace of Terri White.

“Each of these guests brings something different to the show,” said Myers. “Bill has played a monumental role in reshaping our music scene.

Terri is one of the most acclaimed Broadway talents in the world. And Qmitch? Well, I’m not sure any stage is big enough for Qmitch — so buckle up.”

Myers said “Off the Record” was a vision that Big Stage Productions creator Nick Norman discussed with him several times in 2018, but Myers remained skeptical about the response. The first segment of the series occurred in March 2019.

“To be honest, I didn’t think anyone would pay 20 bucks

to come see me,” said Myers, laughing. “And thank God I was right. The evening is about the guests we bring on and their incredible stories and unbelievable journeys — and these next three individuals will take us on an amazing ride.”

According to Myers, Norman’s vision was to create an unrestricted feel in an intimate setting, while interviewing guests without the restraints of edits or measured responses often found in mainstream media.

“This format creates a raw experience for the guests on both sides of the stage,” said Myers. “Many of the stories I often encounter in my business are best told in their most candid forms — long before they reach the edited formats in typical media channels. These interviews capture every ounce of the tears, laughter and passion that these people evoke.”

PIGEON KEY LEASE GRANTED

County working on appeal for base camp reimbursement denied by FEMA

T

he item was hardly finished being read into the record before the Monroe County Board of Commissioners agreed to extend the lease to the Pigeon Key Foundation for the management of the tiny island in the middle of the 7 Mile

Bridge.

The island was originally leased to the nonprofit in 1993 for 30 years. The new lease runs through 2033, with an option to renew for an additional 10 years.

Foundation director Kelly McKinnon thanked the county staff and commission.

“We’ll make sure Monroe County is proud of Pigeon Key and continue the work we are doing out there,” he said.

The county also revised the amount of the cost of the wooden Pigeon Key ramp renovation to $2.4 million, an increase of almost a half-million dollars. Staff said the change was needed due to a plan error for steel weight calculation in regards to structural needs.

The commission was not so understanding, however, after hearing from a representative from the 208-unit affordable housing project in the Lower Keys, the Quarry. He was requesting an additional $84,000 to build a structural retaining wall to support a road.

So far, Monroe County is paying the developers of the project almost $1.5 million — to create a new access road to reduce loads on neighborhood streets, complete wastewater connections, build a bike lane and add buffering landscape. The additional $84,000 would improve the road that would revert back to Monroe County ownership. It was also too much for commissioners Heather Carruthers and Danny Kolhage.

“This was a strategic error,” said Kolhage of the request for extra funds.

“Is it worth it? Eighty-four thousand dollars? After everything we’ve provided to you guys?” Carruthers asked of representative Bart Smith.

Commissioners Michelle Coldiron and David Rice soothed the waters.

“This is for a retention wall to protect a road that will be turned over to the county eventually; this is an investment for the affordable housing that we all want,” said Coldiron.

Coldiron, Rice and Kolhage agreed to pay the extra $84,000, while Monroe County Mayor Sylvia Murphy and Carruthers voted no. The motion carried.

LOCAL CONTRACTORS INVITED TO APPLY The Monroe County Board of County Commissioners approved requesting proposals from companies and vendors to provide a variety of emergency services in the event of a hurricane or other natural disaster. Monroe County Emergency Management and the Monroe County Attorney’s Office will work with companies on standby contracts.

“These contracts are only activated in the event of an emergency, like a hurricane,” said Assistant County Attorney Cynthia Hall. "This is the critical response needed from day one to day 120 to facilitate rapid and effective recovery after a storm."

Emergency services needed include plumbing, roof repair, catering, janitorial and mold remediation. The complete list of needed services is noted on the county’s Request for Proposals (RFP). The RFP will be on Demand Star starting on Saturday, April 20 at www.monroecounty-fl.gov/demandstar. Proposals are due

by May 29 at 3 p.m.

In other news: • There will be a public hearing on Thursday, April 25 at 5 p.m. in the Marathon Government Center to review the land management plan of state lands, leased to Monroe County. The update is required every 10 years, and statutes require a public hearing now that Monroe County manages more than 160 acres. Coldiron is one of the members of the public advisory board.

• The commission gave the go-ahead to County Attorney Bob Shillinger to investigate the possibility of bringing misdemeanor probation services inhouse and the costs associated with the move. In the past, the contract has been outsourced to various organizations such as the Salvation Army.

• The commission approved the purchase of two lots on Big Pine Key for affordable housing, and one for conservation.

• Finance Director Tina Boan informed the commission she had received another $666,000 in FEMA reimbursements. She anticipates receiving another $11 million for debris work by the next meeting.

The commission also asked for an update on the appeal of the $6 million costs for a base camp during Hurricane Irma that FEMA has denied. The county attorney drafted a letter to the state Department of Emergency Management. “I’m encouraged and optimistic,” said Shillinger.

County Administrator Roman Gastesi told the commission that the state director of Emergency Management has told him verbally he has to take care of Hurricane Michael’s effects on the Panhandle before he can turn his attention to the Keys.

• Legislative Affairs Director Lisa Tennyson briefed the commission on happenings in Tallahassee. (See page 10 for details on bills.) She outlined various “pre-emption bills” — designed to remove authority from local governments and grant it to the state. She said she’s hopeful that the vacation rental bill, allowing nightly rentals in residential neighborhoods, is stalled. And she warned commissioners about SB 1730 and HB 207, legislation that would deny local governments the ability to negotiate affordable housing provisions when granting permits for new developments.

“All of these pre-emption moves seem to be happening in a wave,” said Kolhage. “Where is this stuff coming from?”

• The commission approved the purchase of five “less than fee” transactions, that would remove the building rights from privately owned lots. The move lessens the county’s exposure in takings cases come 2023, when the state will no longer grant new development rights in the Keys, while the homeowner continues to pay taxes on the parcel that can no longer be used to build a new home.

W

hat you see is not all that you get with Craig Reynolds, landscape architect. Soft-spoken, he downplays his adventures and his ability to build beautiful landscapes, along with his growing reputation as a preeminent landscape designer here and abroad. Born in Panama, in the same hospital as John McCain, Reynolds came to Florida with his family, who moved around the U.S. quite a bit during his childhood. He earned a bachelor’s degree in fine art at Ohio State and returned to the University of Florida to get a master’s in landscape architecture. His landscape drawings are works unto themselves.

When Reynolds saw Raymond Jungles’ landscapes in a magazine, he applied for a job and followed Jungles to Key West. When Jungles left, Reynolds stayed and opened his firm as the only licensed landscape architect in Key West. Now, with 25 years in the business, Reynolds has been nominated for HGTV’s Outdoor Awards for three years running and won several categories; he has been named one of the top landscape designers in 2016 and featured in numerous magazines; and has completed over 100 residential projects. Reynolds also has a pilot’s license and travels to the Bahamas and the Caribbean for projects. With a team of other architects, his firm handles no fewer than 25 projects at a time. However, Reynolds isn’t all work and no play — the office ping pong table has seen almost 4,000 games, and on days off, he flies his son Jack and friends to trampoline parks.

How did you become a landscape architect? After realizing that a degree in fine arts does not an income make, I looked for a career that kept my creative side in play and had something to do with the outdoors. It worked.

When it comes to the environment and Key West, what’s the worst thing you can do in your garden?

And the best? The obvious answer is don’t create lawns, they are more work. And only plant natives. Definitely stay away from invasive species and bad trees. Things look better and are easier to maintain if you use the right plant in the right place in terms of sun/shade, water requirements, salt

tolerance, etc. Plus there are a lot of great Caribbean native plants that do very well here. It’s a manmade garden; it should be what you want.

What’s the coolest plant you’ve ever seen? The ugliest? That’s like asking a parent which child is their favorite!

How did you become a pilot? A good friend asked me if I wanted to start training with him and share the costs.

I did, and it turned out to be fun. Now it’s how I get to our projects throughout Florida and the Bahamas.

What’s the most illegal thing you’ve done? What happens in Iceland stays in Iceland.

What question would you most like to know the answer to? Why is brick on sand considered impervious?

What job would you be terrible at?

Condominium association manager.

What skill would you like to master? Instrument flying, which I am currently working on.

What do you still do the old fashioned way? I still draw design concepts by hand with colored pencils and an eraser.

Who is your alter ego? Holly (Craig’s wife).

Favorite guilty pleasure? Doritos.

If you could grant Key West one wish, what would it be? Free housing for good, qualified teachers, nurses, police, firefighters and the like.

What quirks do you have? I go to bed way too early.

ccording to numbers from the Centers for Disease Control, 1 out of 59 children ages 8-11 place somewhere on the Autism spectrum. The data was taken from 2014 school records and was up from 1 in 68 two years previous; so imagine the number for 2019?

Autism is now a common parental topic, making coping as a community even more of a priority.

Dance Key West, founded

by Kyla Piscopink, has taken the initiative to offer Autism Movement Therapy (AMT) for children ages 7-12 anywhere on the spectrum. It’s a dance class just for kids who may not have a lot of opportunities to participate in extracurricular sports or activities. AMT combines movement, music and improvisation to stimulate both sides of the brain. It wakes up the mind and improves behavioral, emotional, academic, social, speech and language skills.

With limited resources due to demographics, programs and classes helping families and kids are not only welcome but more than needed.

“We all have a family member or friend, someone we know with children affected by autism,” said Piscopink. “Parents struggle. We want to fill the void, offer dance and the joy of self-expression, make opportunities available.” Piscopink has worked with the MARC House program and has made it a part of Dance Key West’s fundamental ideology to open up dance to everyone. Developing the class was easy, as the Key West Theater, their home, had been floating the idea for a while and the teacher was equally easy to find – Cricket Desmarais.

“Don’t be afraid; there are no expectations,” said Desmarais, who is not only a dancer and yoga instructor but also the mother of an

autistic child. “The hardest part is the social aspect, but it’s important too.” Desmarais is compassionate about the fact that each child reacts differently in group settings; she has experienced it herself as a parent. She wants potential parents and students to know it’s okay; whatever happens happens in her class.

“Parents are eager but also overwhelmed. Dance is a great tool regardless of ability. It’s about showing up, having fun and finding out what’s possible, and that’s empowerment.” With years of dance experience, Desmarais still became AMT trained for the program.

“Dance and music create pathways in the brain, rewire it and use the whole brain. The movements are structured and have purpose.

Having my child listen to music and dance, I am still learning about this, but I see the difference,” she said.

“We want to let parents know, you’re safe here; it’s so much more than a class. We are all in this together,” said Piscopink.

The first classes will be offered April 19-May 17 for $18 per 45-minute session, parents, teachers, and paraprofessionals welcome. Piscopink and Desmarais will be looking to expand classes as well as find additional funding to reduce the costs of the courses through grants and donations to help local families. Other organizations that offer help and will be promoting the classes are Autism Society in the Keys (ASK) (autismsociatyofthekeys.com) and Center for Autism & Related Disabilities (CARD) (www. umcard.org).

udiences can celebrate world music, with an emphasis on Cuban rhythms, during the annual Afro Roots Fest showcase in Key West.

Music and film events are planned Thursday through Saturday, April 18 to 20, in multiple venues.

The fest begins at 9 p.m.

Thursday with a kick-off party at the Green Parrot Bar, featuring live music by Electric Piquete, a critically-acclaimed Latin funk and fusion band known for its originals and interpretations drawing on Afro-Caribbean, jazz and rock influences. There is no cover charge for the show.

The focus turns to film Friday, April 19, with a 6 p.m. showing of the musical documentary “Eliades Ochoa: from Cuba to the World” at The Studios of Key West. The film spotlights the world-renowned Cuban guitarist and singer who was an original member of the iconic Cuban band known as the Buena Vista Social Club. A Q&A session with the director, Cynthia Biestek, and a reception for film fans will follow the screening. Tickets are $10.

The Studios of Key West also is the setting for a Saturday night concert of Cuban music by Cortadito, whose traditional stylings have evoked comparisons to the Buena Vista Social Club. Known for performing standards from the early 20th century, the band will introduce melodies from their latest release, “Canciones de Julio.” Ticket prices for the 8 p.m. show range from $32 to $55.

Following the concert, music lovers can head to the Green Parrot for a 10 p.m. after-party showcasing the Spam Allstars, whose music has been called everything from a blend of electronica, Afro-Cuban and hiphop to “descarga” or Latin jam.

The Afro Roots Fest also features events in Islamorada and Key Largo. There will be a Memorial Day weekend concert Sunday, May 26, at Islamorada’s Florida Keys Brewing Co. and Key Largo’s festival event will be June 28-29 at the Murray Nelson Government & Cultural Center.

n Sunday, April 18, 1982 a roadblock was set up at the junction of U.S. 1 and Card Sound Road by the U.S. Border Patrol.

A cadre of federal agents directed Florida Highway Patrol officers and Border Patrol agents to put into place the flashing red lights and barricades of a U.S. border checkpoint just after three o’clock in the afternoon in front of the Last Chance Saloon.

All northbound traffic departing the islands from a weekend in paradise came to an immediate halt.

Armed men approached each vehicle, asking not only for identification, but also proof of citizenship — and not just from the drivers!

Leaving the Florida Keys had become identical to leaving Canada or Mexico.

It did not take long for the resulting snarl of traffic to stretch all the way to Key Largo, 18 miles away.

International media outlets began billing the quagmire as the world’s biggest parking lot. The roadblock devastated the Keys economy. Hotel rooms emptied; grouper and Key West pink shrimp began to spoil in the coolers of waterfront restaurants. Barstools gathered a fine layer of dust.

What was the ultimate result?

The Conch Republic was created.

WIND STORM, TAKINGS BILLS STALLING

L

egislative session is at the midway point in Tallahassee, and bills with implications in Monroe County aren’t faring too well.

Senate Bill 1694 and House Bill 1019 address takings claims within areas of critical state concern. Under the bill, state and local governments located in an area of critical state concern, like the Florida Keys, would share liability 50-50 when defendants are successful in propertyrights litigation. But that’s only if the court has found liability against the state and local government, the regulation restricting development or use was mandated by the state land planning agency and the regulation was adopted by the local government restricting use.

Legislation, sponsored by state Sen. Anitere Flores, passed the Senate Community Affairs Committee on April 9 with a 5-0 vote. It now sits in the Appropriations Committee. However, the bill in the House sponsored by state Rep. Brad Altman hasn’t moved since its March 5 introduction.

While legislation appears to be on life support, Monroe County Director of Legislative Affairs Lisa Tennyson said it’s still breathing.

“Although it passed two Senate committee hearings, it’s not moving in the House,” she said. “However, it’s possible that it could be tacked onto another bill, as an amendment, and the same might happen in the House.”

Bills in the House and Senate related to wind storm insurance are also facing an uphill battle. Senate Bill 1476 and House Bill 1145 set out to put a cap on annual rate increases for policyholders in Monroe County at 5% the next two years, January 2020 to January 2022. Today, rate hikes can spike 10 percent.

by Flores, continues to sit in the Rules Committee. A related bill introduced by state Rep. Holly Raschein awaits consideration as well.

“The bill doesn’t appear to be moving,” Tennyson said.

BILL UPDATES CONTROVERSIAL BILL STALLING SB 824 preempts to state regulation of vacation rentals, including but not

limited to the inspection of rentals. It would also eliminate grandfathered local government ordinances that have vacation rental regulations. The bill, sponsored by state Sen. Manny Diaz Jr., was not considered by the Senate Committee on Innovation, Industry and Technology on March 26, and it was later postponed during an April 10 meeting.

OTHER NOTABLE BILLS SB 720 and HB 525 — Florida Keys Community College Legislation sponsored by Flores and Raschein would rename Florida Keys Community College to The College of the Florida Keys. In the Senate, the bill gained unanimous approval from the Appropriations Committee. It now waits to be heard on the Senate floor. The bill passed unanimously in the House.

SB 1666 and HB 1221 — Maritime Law The bill defines criteria for vessels in a long-term storage status on our waterways, and directs FWCC to study the impacts of these vessels on the derelict and at-risk vessel numbers. And drawing from the Keys’ experiences with marine debris following Hurricane Irma, it also directs FWCC to look at factors such as significant tropical storms or hurricanes and to make recommendations to the governor and legislature for potential management options for future long-term storage of vessels on our waters. Raschein says this bill has been approved by two House subcommittees and will now go before the State Affairs Committee. A similar bill sponsored by Flores is ready to go to a vote on the Senate floor.

HB 771 and SB 816 — Recycling Legislation requires counties and municipalities to address contamination of recyclable material in specified contracts and prohibits them from requiring collection or transport of contaminated recyclable material by collectors. The bill continues to sit in the State Affairs Committee.

In the Senate, legislation moved out of the Community Affairs Committee on April 9 and is on the Appropriations Committee’s April 18 agenda.

ill and Amy Lay, the husband-wife team behind both outposts of the beloved Italian restaurant La Trattoria, as well as Catered Affairs, have big plans for Benihana. On Sept. 21, 2018, they also picked up the neighboring restaurant to La Trattoria Oceanside, Benihana and purchased the 22,000 square foot building that houses the two restaurants.

“The first thing we did was literally break down the ramp between the two restaurants,” said Bill Lay. “I pulled a Reagan: Tear down that wall!”

The fun, fanfare and great food of Benihana has long made it a local favorite, and the Lays plan to preserve that, while updating it with a vision for the future.

“We are very excited about our new bar build-out,” said Bill Lay, “which hopefully will be done by the end of the year.” They plan to move the bar to the front and center of the restaurant, in order to take full advantage of the beautiful water view.

“The best view in the house is that of the sushi chef,” Bill laughs, “and we really want to show off that view to guests.”

Benihana will also have a new happy hour, food and drink specials, and an earlier opening time, 4 p.m. They’ve already spiced up the cocktail menu with punch bowl drinks for sharing, like the “Blue Ocean,” as well as the top-shelf new Beni-tini, made with Grey Goose and fresh hibiscus tea.

“We’re going to open up at 4 p.m. every day, and it will be for happy hour drinks and sushi,” said Amy Lay. They are also going to have a signature Teppanyaki chef behind the sushi bar, “so that you’ll be watching the same show you would get at the table at the bar.” While new items may pop up on the menu, the Lays are maintaining the familiar, flavorful Tappanyaki style food.

In a place known for its showmanship, they are also embracing the fun … and taking it a step further. That’s right: they’re getting a giant gong.

“We are definitely getting a big, 6- to 8-foot gong. We hope to call last call and then hit the gong,” Bill jokes. The Lays are toying with names for the new bar, like “Bonsai Bar” or “Koi.”

“There will be Benihana fried rice at one of the holes!” said Amy. “Catered Affairs and La Trat are very involved and excited to get Benihana back into the community more, and the staff is on board and super excited.”

“With our growth, we look forward to creating new jobs,” said Bill. “It has always been a personal business goal of mine to create jobs for people, and while growth is important, with growth comes opportunity.”

egalization of medical marijuana was voted into Florida law on Nov. 8, 2016, and the changes have happened fast. Some 116 dispensaries have opened statewide, operated by 12 parent companies licensed by the Florida Department of Health. On March 18, Governor Ron DeSantis signed Senate Bill 182, allowing a physician to “determine that smoking is an appropriate route of administration for medical marijuana,” meaning smoking cannabis is legal for patients for the first time. Last but certainly not least: Monroe County’s first medical marijuana treatment facility had its grand opening on April 11.

Surterra Wellness is located at 3126 Flagler Ave. in Key West. The space is reminiscent of a spa, with multiple seating areas, soothing music and staff at the ready to assist patients. Surterra is open to the public — you don’t have to have a medical marijuana card to take a peek at the offerings or have a consultation, but you do need one to purchase any of their cannabis products. Surterra also has a list of doctors to refer patients to (See box, opposite page).

Surterra’s chief marketing officer, Levent Hamdemir, visited Key West to take part in the ribbon-cutting and explain the role of cannabis — in many forms — in patients’ lives. Patients were lined up for consultations and, ultimately, purchase.

“Every year, we are expanding the scope,” said Hamdemir. “One of the interesting challenges that we see is that, unlike traditional pharmaceuticals that have one active ingredient treating a symptom, all of our products are helping your body deal with life and your environment better.” Hamdemir cites the holistic nature of medical cannabis treatment: as an anti-inflammatory, hormone regulator, anxiety reducer and seizure treatment.

Hamdemir said that while cannabis is normally organized by strains, those monikers tell a patient very little about the plant’s specific health benefits (it’s hard to know whether “Sour Diesel” or “Strawberry Fields” is better for joint pain). Surterra instead engineers products based on the symptoms or “needs”

it is addressing, and each product is a blend of cannabinoids. They have names like “Calm,” “Soothe” and “Revive.” The products incorporate THC (tetrahydrocannabinol) and CBD (cannabidiol) in different percentages; the former creates the euphoric feeling associated with marijuana, while the latter has no such effect.

How do they isolate strains and create formulas that address certain medical concerns?

Their research and development team works with physicians and looks at the more than 100 cannabinoids in the plant. While only a handful have a euphoric impact, they all potentially have different health effects.

“We just recently acquired a new division of scientists based out of Boston,” Hamdemir said, “and we are competitively invested in research and development.” While cannabis is still federally illegal, however, scientists studying the effects of the plant can’t receive federal funding, and thus there is limited science based in the U.S. Surterra is looking at research from elsewhere, like Israel.

While U.S.-based research is limited, last June, the FDA approved a cannabisbased epilepsy drug called Epidiolex, and it’s the first FDA-approved substance that is derived from the marijuana plant. This makes companies like Surterra — which also has divisions that work with policy makers to move medical marijuana legislation ahead — hopeful.

The federal law isn’t stopping the science, or the business, from progressing.

While Surterra is the first dispensary to open its doors in the Keys, there are two more on the horizon in Key West.

Jeff Burgess, chief licensing official for the City of Key West, said MedMen on Duval Street has already registered and paid its city taxes, while another, Trulieve, has yet to apply for a city license.

“Licensing isn’t much different (from other retail spaces),” said Burgess. “The only thing that’s different is that they have to be listed on the Department of Health website. The Department of Health authorizes the companies, and they can have x number of facilities throughout the state.”

This is new territory for doctors, too. Dr. Gregory Sonn prescribes legal forms of cannabinoids to patients who are seeking treatment for their pain and other medical issues. Sonn has offices in the Upper Keys and Key West, and he is the largest prescriber of medical marijuana in Florida.

Some of the top ailments and complaints coming into his office include anxiety, depression, seizure and insomnia.

Sonn is dually boarded in family practice and palliative medicine and has been prescribing medical marijuana since 2016. He said that prescribing medical marijuana is based on the doctor’s ability and knowledge.

“We are tasked with building our own bank of information,” he said. “We all have our own. I have 50 diagnoses who qualify. Some doctors may only have two.”

Obtaining a medical marijuana card isn’t complicated, Sonn said. First, people need to see a doctor who certifies the patient. Once patients get a diagnosis that’s deemed acceptable, they apply to the Florida Department of Health. Once the doctor and DOH give their approvals – it can take at least two weeks to obtain a card – patients can purchase medical marijuana products. Sonn said he lets patients freely choose the products they like. As for dispensaries, Sonn recommends trying them all.

“They all have initial patient discounts,” he said. “I always tell everybody you should get as much discount products as you can. Maybe you fall in love with a certain dispensary, maybe you don’t. But if someone has specific requests, I do have knowledge of every dispensary to deliver to make specific recommendations.”

The Florida Department of Health’s user-friendly website makes it easier for patients to find doctors and dispensaries, as well as review current legislation.

“We are in a transformative age,” said Hamdemir.

he Conch Republic Cup, part of Key West Cuba Race Week, has an interesting past. In 1996, the Key West Sailing Club, now the Key West Community Sailing Center, received an invitation from Commodore Jose Miguel Diaz Escrich of Hemingway International Yacht Club of Cuba to run a race from Key West to Veradero. At that time, the race had been run two times previously in the ’70s.

Peter Goldsmith, owner of Geslin Sails, was the fleet sailing captain of the Key West Sailing Club and accepted the challenge. Peter and his then partner Michele Geslin put the race together in ’96-’97 with the help of Mark Lindas, Mark Milnes and Glenn Sykes, among others. They successfully put on a number of races from ’97 to 2003 and, during this time, the race took on a life of its own. After two years of running from Key West to Varadero, Commodore Escrich proposed the Conch Republic Cup (CRC) four-race series.

In 2003, during tense relations with Cuba, the U.S. government decided it did not want to allow the race to proceed. So on the way to the start of the CRC ’03, racers were escorted out of the harbor to Sand Key by many government boats and a helicopter photographing the proceedings. They did not stop participants on the way out, but for the first time in seven years, they boarded most boats returning from Cuba and confiscated cameras, GPS systems and charts. Peter and Michele were arrested and charged with “trading with the enemy,” but

were later released and exonerated.

In 2015, when the Obama Administration changed the restrictions on travel to Cuba, the race was renewed, with Karen Angle at the helm alongside Peter Goldsmith. They have established the Conch Republic Cup as a nonprofit organization dedicated to the pursuit of sailing education and friendship with Cuba.

The nonprofit continues the tradition of the four-race series of the CRC, traveling with 54 boats and 475 people to both Varadero and Havana. In 2018, the race had to abandon Varadero; the new administration restricted the ability to enter that marina.

This year, CRC continues but has changed the format. CRC 2019 is the 10th edition of the race between Key West and Cuba. It will begin with the Wrecker’s Race, the “all in fun” series of races that the Schooner Wharf Bar and Grill has been doing for over 35 years. The CRC racers will then continue on to Havana, Cuba. Commodore Escrich will once again host the event in Cuba; this year marks the 500th anniversary of the founding of Havana as a city. The CRC will do its usual buoy race in Cuba alongside Cuban sailors, but will no longer race back to Key West, giving the participants more freedom to pick their appropriate weather window and time frame to return. Next year, the plan is to continue the tradition and have the CRC2020 at the end of April. More information is at conchrepubliccup.org.

‘PLASTICS NEVER GO AWAY’ JIM McCARTHY

COMMUNITY GETS LOOK AT IMPACTS, ALTERNATIVES

T

he world produced 2 million tons of plastic in 1950. Fast forward 65 years: global production of plastic exceeded 380 million tons.

From milk cartons and bags to bottles and wrappers, not a day goes by when plastic isn’t used and disposed of in some fashion. And not a day goes by when plastic isn’t entering and polluting waterways and oceans throughout the world.

On April 11, community members had the chance to view the 2016 documentary “A Plastic Ocean” at Founders Park Community Center. Journalist Craig Leeson set out in search of the elusive blue whale. But instead, he discovered plastic waste in what should be a pristine ocean. Teaming up with divers, scientists and researchers, they travel to 20 locations to examine the fragile state of the oceans, unveil some alarming realities of plastic pollution and showcase solutions to curb the issue.

The facts surrounding plastic waste and its impact on the environment are alarming.

According to National Geographic, plastic since the beginning of production six decades ago has amounted to 8.3 billion metric tons — and most of it single-use, disposable plastics that end up in the garbage. Also, 91 percent of plastic created is not recyclable, and it takes more than 400 years to degrade, so most of it still exists in some form. Only 12 percent has been incinerated.

Here at home, hotels, restaurants and businesses are beginning to take some action on the front of plastic use. Some are going without straws, eliminating single-use plastics or seeking other alternatives to plastic products. Before the movie, patrons were able to see alternative options and speak to organizations working to educate the public and advocate for less plastic.

In January, Reef Relief, a nonprofit dedicated to improving and protecting the coral reef ecosystem, visited businesses up and down the Keys, asking them to sign a pledge in which they’d offer straws only on demand or provide alternatives. When businesses signed, they received a sign to let patrons know.

“Since last January, we’ve had over 150 businesses that have signed the pledge from Key West to Key Largo,” said Mill McCleary, executive director for Reef Relief. “It’s been

really successful and it took on a life of its own after we hit 50 or so. We started having people call us or email us.”

McCleary said there are a few businesses in Islamorada that Reef Relief is getting back to.

With Reef Relief’s marine debris cleaning events, 200,000 pounds have been removed since Hurricane Irma, McCleary said. During the International Coastal Cleanup Day, held each year in September, McCleary says the Ocean Conservancy produces a report. It found that straws alone ranked 7th in the most commonly found types of plastics out of cleanups in Florida.

“It was something like 30,000 straws were found from these cleanups in just a few hours,” he said. “Plastics never go away.

The bigger issue isn’t so much larger debris of plastics, it’s what they break down into.”

“A huge part of our awareness campaign is to teach people that we don’t need to use plastics. You can find alternatives, like using water bottles,” McCleary said.

Janis Luckie, marketing specialist with Gordon Food Service, was on hand displaying eco-friendly items. She said Miami Beach has taken a stand to ban foam, straws and plastics. Now, businesses there are finding alternatives to use.

“Our sales reps talk reduce, reuse and recycle, and we try to make them (businesses) understand that plastics they use are being thrown into a landfill.”

Last October, the European Parliament approved a ban on single-use plastics like straws, plates and cutlery. It takes effect in 2021.

In the U.S., California was the first state to ban single-use plastics. Every county in Hawaii has taken action on single-use plastics, effectively giving the state a ban.

Recently, New York state lawmakers agreed to implement a similar ban, although food takeout bags used by restaurants, bags used to wrap deli or meat counter products and bags for bulk items will still be allowed.

In Florida, there’s a bill before the Senate and House that would remove preemptions of local law relating to regulation of auxiliary containers, wrappings, or disposable plastic bags. The bills are sponsored by state Sen. Linda Steward, D-Orlando, and state Reps.

Anna Eskamani, D-Orlando, and Michael Grieco, D-Miami-Dade. Another bill before the Senate and House would prohibit a store or food-service business from providing a carryout bag made of plastic film or a single-use plastic straw to a customer. Bills are sponsored by state Sen. Kevin Rader, DDelray Beach. Bills have not gained traction in either chamber yet.

Easy tips to help the Earth T

he Keys are at ground zero when it comes to observing the effects humans have on the environment, from seeing turtles and sea birds suffer from being impaled and engorged with plastic, to watching our hurricane seasons worsen. We also know some damning statistics: that 50% of the organisms in our saltwater environment depend on the reef and, over the last 40 years, 90% of the reef has been lost.

BAN PERSONAL PLASTIC BAG USE. We get it — it’s HARD! But each step is important. Pick up reusable bags at Publix or Winn Dixie and keep them in the trunk of the car or bicycle basket, so they’re always on hand at the store. Publix (in Key West) and Winn Dixie (on Big Pine) offer plastic bag recycling.

We also love the reusable wax wraps from Bee’s Wrap (www.beeswrap.com) to cut down on plastic bag and wrap use.

SWITCH TO A MINERAL-BASED SUNSCREEN. While the Key West city commission moved ahead with a ban on oxybenzone and octinoxate sunscreens, it doesn’t go into effect until 2021. Start early: buy your sunscreen from local purveyors like Divers Direct or Reef Relief before you jump in the ocean to snorkel, scuba or swim.

GO MEATLESS (AT LEAST ON MONDAY). While meat and dairy provide only 18% of the world’s calories consumed, they use the vast majority – 83% – of farmland and produce 60% of greenhouse gas emissions, according to The Guardian. So, meat eating is heating up the planet and devouring the land at unprecedented rates. When there are great local eateries with meatless options, like The Café and Date & Thyme, why not go meatless once or twice a week, and be a little greener?

The good news? We have community efforts through groups like Reef Relief, Mote Marine and The Florida Conservation Coalition working in concert to protect our precious environment. Regular citizens also create grassroots efforts that have a real impact on preservation and policy (hello plastic straw ban).

So, how can we do our part? These are some simple ways to be kinder to the Keys we call home.

USE REUSABLE STRAWS. Yes, we know it’s important, but do we really do it? Say “no” to straws, and if you love them too much (like me), pick some up at your favorite watering hole that sells them, like The Green Parrot. According to OceanConservancy.org, plastic straws are ranked #7 in items collected from the oceans globally. So stop sucking!

BIKE, WALK AND RIDE SHARE. Of course, cars are big smog and carbon monoxide producers, and sometimes they are also necessary for carting the kids to school and picking up the groceries. In Key West, the town is biking-friendly, but up the Keys, it can be a challenge. Make a schedule with neighbors to carpool to common destinations. Get a little exercise by parking farther back in the grocery store lot and walk to the market to get that coffee on Sunday morning.

BE A SMART BOATER. Boats in the Keys can cause significant damage to marine habitats. The Florida Keys National Marine Sanctuary is now offering a 30- to 45-minute course, available in English and Spanish, complementing existing safe boating courses. What is something you know now that you didn’t know when you were a freshman? Not everything is earned; some things are handed out to certain people.

What organizations and activities are you involved with at KWHS? I’ve played on the KWHS football team all four years; I’m involved in the Beta Club; Keys to be the Change; peer mentoring; Christian Athletes; and I’m on KWHS Executive board. These activities helped form the Jean you see today.

What are your plans after high school? Attend FGCU and receive my bachelor’s degree in business and marketing.

What do you hope to be remembered for at KWHS? I’d like to be remembered as an ambitious student.

What is one favorite way to spend your spare time? I rarely have spare time, but when I do, I find ways to better myself.

Will you make the Keys your permanent home? I do not plan to live in the Keys, but I might like to retire here.

What three things would you like to accomplish before your 10-year reunion? Before my 10 year reunion, I have hopes of owning multiple properties, opening multiple sneaker/clothing stores across Florida and purchasing a home for my parents.
