he rumors are flying about prospective medical marijuana shops in Key West. Media outlets reported that a medical marijuana shop had designs to open at 1300 Duval Street, but the city has yet to issue a license to the business. We said hi(gh) to fellow Key Westers and asked:

According to the U.S. government, the suicide rate in 2017 was the highest it has been in at least 50 years — 47,000 suicides, up from almost 45,000 the year before. Tragically, that was well below the number of drug overdose deaths in 2017 — 70,000, a number that also increased 10 percent over the year before. Reach out.

n Dec. 4, at her first Key West City Commission meeting since the election, Mayor Teri Johnston waded into a recurring debate — cosmetic shops — and did some pro-active planning regarding the imminent arrival of medical marijuana dispensaries in Key West. The meeting also included a heated debate on a potential ban of certain types of sunscreens (for more, see page 30).

City Attorney Sean Smith told

the council that the city cannot issue a license for marijuana dispensaries before the state issues a license. And, dispensaries will be held to the same standards as pharmacies.

“Has the state issued licenses to any locals?” asked Commissioner Sam Kaufman.

“No,” Smith replied, despite reports of a new dispensary opening soon on Duval Street. Kaufman also reminded his colleagues to deal fairly with dispensaries.

“Within reason, we should make the medical marijuana available. We

shouldn’t stand in the way of that,” Kaufman said. Staff was directed to review city policy regarding medical marijuana dispensaries.

Regarding cosmetic shops, the council discussed directing staff to rewrite code to increase fines. Smith told the council that violations are not confined to a particular business, but are a concern city-wide, in particular on Duval Street. Currently, the fines stand at about $500 per incident, deemed not enough of a deterrent.

Commissioner Mary Lou Hoover asked if the city could write a rule to address product application by people not licensed as cosmetologists in spaces leased for retail purposes only.

Johnson asked staff for “a new ordinance and new fine,” which would be more of a deterrent for unsavory selling techniques.

IN OTHER NEWS: • The commission honored retired chief of police Donie Lee and looked back on his legacy. Lee said serving as chief in his hometown was the “honor of my life.” The commission also honored Dorothy Todd, who was retiring from the information technology department.

• The council designated Dec. 21, 2018 as National Homeless Persons’ Memorial Day. Stephanie Kaple of the Florida Keys Outreach Commission said, “We need to recommit ourselves to ending homelessness, hunger and poverty in our community.”

• City Manager Jim Scholl briefed the commission on a recent cruise ship collision with one of the piers, which was destroyed in the crash. Until repairs are complete (which have yet to be scheduled), cruise ships would not be able to dock.

• The commission heard about the status of, and redevelopment ideas for, “Mount Trashmore” from citizen Tom Malone and environmental author Ed Russo. There was discussion regarding removing the landfill entirely, to make way for affordable housing, and the cost of such a project. (For more, see page 13.)

• The council also voted 4-3 to vacate city rights over an alleyway in Bahama Village at Thomas Street and Baptist Lane, over the objection of two neighbors. The applicant said it would not become a driveway and impede parking. Kaufman, Clayton Lopez and Billy Wardlow dissented.

n the succession of events, the Florida Territory was established in 1821, Monroe County on July 3, 1823, and Florida became the 27th state on March 3, 1845. Monroe County, as it was originally delineated, was a much grander parcel of real estate than it is today and reached north from Key West to the southern shore of Lake Okeechobee and west to Charlotte Harbor. Key West, the county’s largest and most successful city, was declared the county seat. On Jan. 8, 1828, Key West became Monroe County’s first incorporated city. Identifying the second incorporated city proves a little tricky, as it would not be the first city to leap to mind. On Aug. 12, 1885, Fort Myers became the county’s second city to become incorporated.

Boasting a population of 349, it was the west coast’s largest city south of Cedar Key. When Lee County was established on May 3, 1887, Fort Myers was named the county seat.

ish With a Hero will be hosting 19 wounded veterans from Heroes on the Water at the Big Pine Key Fishing Lodge from Thursday, Dec. 6 through Monday, Dec. 10.

Event participants will be fishing out of the Big Pine Key Fishing Lodge on kayaks to help reduce the impact of post-traumatic stress and traumatic brain injury while receiving the benefits of camaraderie and community support. Major sponsors of this event include Big Pine Key Fishing Lodge, Chapman and Cardwell Capital Management, the Marathon Rotary Club, and Monroe Marauders Military Vehicle Club.

There will be a welcome dinner and reception held at Boondocks Restaurant at MM 27 on Saturday,

Dec. 8, starting at 6 p.m. All members of the Keys community are invited to attend the dinner and reception for a donation of $20 and an advance RSVP to show support for our nation’s military heroes.

Can you tell the difference between a local and a tourist when they walk in the bar; what’s the difference? I primarily deal with locals upstairs, which is great, but lately I’m getting much more European tourists who love the food, as it’s more like home.

Favorite Drink? Duh! Andrew’s Manhattan fashion … haha, I invented it. Second favorite is Bud Light, it’s still a job after all.

PARADISE here is a reason Key West excels at the nightlife, and one of them is bartender and manager Andy Ambrose at .5 upstairs at Nine One Five Restaurant on Duval. The saying goes, “Andy always wins…” because “staying for one” inevitably ends up “two or three.” Originally from Woolacombe, U.K., Ambrose’s English lilt, genuine smile and penchant for soccer are obvious and infectious. He was born to entertain, as his parents were hoteliers back in the U.K., and Ambrose pursued hospitality college training in France and Australia.

“I never planned on being a bartender/bar manager but found I certainly had a knack for it. I come from a family that loves to talk and be social, so it’s not really a job, more a fun hangout and a nice living along the way.” Ambrose came to Key West to help then-Nine One Five owner Stuart Kemp, 16 years ago and has seen the bar upstairs through its many evolutions. As he puts it, “I just outlived everyone.” He also is the proud father of four beautiful kids raised in Key West with his wife Rachael, and he boasts their favorite days are at Ft. Zach eating cheese toast and drinking Cuban coffee.

Like running a good bar, Ambrose has found the ultimate balance: “Every day’s a Saturday night, but as long as you can hold it together, you can make this island your own little paradise.”

Thoughts on the state of the service industry in Key West? The service industry has been the backbone of this island since the day I arrived here. Without it, I think the place would struggle, so that’s why it’s important the new people running this town pay attention to affordable housing issues. It’s out of control, frankly.

Full Name? Worst nickname? Andrew Ambrose. Worst nickname has to be Skinny Ambrose or Skinman. It makes me laugh, though, as it doesn’t really apply.

Which TV, movie or superhero character is your alter ego? Alter ego would be Superman of course, but my family would probably disagree and say Deadpool.

What job would you be terrible at?

Least favorite job would be a plumber because I still bite my nails. Ha. If invisible in Key West what would you do? If I was invisible I’d probably follow the ghost tour around town and freak the tourists out good and proper.

On what occasion do you lie? Do I lie?

Never. Just ask my wife.

What job would you secretly love to have? The job I would most love to have would be president. Come on ... I don’t need to have to explain this one.

‘IT’S NOT REALLY A JOB, MORE A FUN HANGOUT’ Do bartenders really “hear” everything? I hear way more than I could ever mention in this local paper — I’m saving them for my memoirs.

Do you have a life credo or motto? My life motto is Familia Primum - Family First.

What makes a really “good” bar in Key West that keeps people coming back? My locals are seriously the nicest people. I weeded out all the horrible people ages ago.

Why bartend in Key West; what makes it interesting? What keeps you doing it? Bartending is different every single day; I get to meet a crazy ass bunch of people, and that’s just my co-workers.

What do you wish people didn’t tell you after they have had a few? In turn, what makes you laugh to hear about? I have to hear couples slagging each other off one day and then being all loved up the next, it makes ya eyes roll I tell ya.

What is something you think everyone should do at least once in their lives?

Everyone should live their dreams, as we’re dead for a long time.

Lunch with one famous person, whom would you choose? Lunch would be with James Joyce as I never understood one of his books at school and maybe he could explain them.

My friends and family would describe me as … a good laugh who’ll be there for ya.

My autobiography would be titled …

“Shaken, Not Stirred.”

I can never refuse … a shot.

When I go, I will go … Wait. I ain’t going nowhere; life’s too much fun.

n Nov. 30, Realtors and friends of Realtors gathered on the lawn at the Oldest House on Duval Street for the 2018 Installation and Awards Gala.

Led by President Will Langley and with Darla Fry-Guevremont as Mistress of Ceremonies, the Key West Association of Realtors honored standout performers, as well as their officers and directors. In a town where real estate is an industry that fuels our economy financially and socially, the evening was brimming with good cheer.

That may sound mystifying, but at Amri it feels right. Owner Jasmine Davis quotes guests who have stopped her and said, “The energy here is so amazing, I don’t want to go.” I relate, having been to Amri last Saturday for their Eminence Organic Custom Facial.

Annie, who did my facial, was thoughtful and knowledgeable. She presented beautiful stones to use during the facial and explained how they oxygenate the skin and calm stress. Annie also chose a particular blend of tea to use on my skin — rosehips, lavender, chamomile and rose petals — and she used other culinary ingredients, like a hot paprika, to increase circulation in the face.

She described each product, made by Eminence Products, a benefit corporation, which adheres to strict ethical standards.

Amri espouses that they “only partner with brands that have a very transparent supply chain and we can ensure your products are being sustainably and ethically made.” This is integral to Davis’s business model.

She said, “It’s my personal ethics, and my business practice couldn’t be separate from that.” She said, “It’s about people empowering people and being conscious of the planet.”

wouldn’t want to support that. But we’ve somehow conditioned ourselves to turn a blind eye.” She said, “When you open your eyes to the truth — whether business or personal — you can’t close them again.”

Davis described Amri as “a family affair.” A stylist for many years, she moved to Key West from Michigan at the suggestion of her brother — and now business partner — Michael Tramont, whom Davis calls “my rock.”

Her daughter Morgan handles social media and branding, and the two have an upcoming buying trip to California in search of apparel. She also said: “Amri isn’t me, or my brother, or Morgan. It’s every single team member we have here and every guest we meet.”

In some ways, Amri makes buying easier. “You don’t have to exhaust yourself worrying about: was that ethically made,” Davis said. In other ways, it’s not easier for everyone.

While it feels wonderful to have a clean conscience, there is also a bottom line: the products at Amri are expensive. A facial and two products, before tip, with a local discount, ran me $250. It’s unfortunate that our commercial model oft renders conscious consumption a luxury.

Davis points to staying power: quality products will have a longer life in a cabinet or closet.

Amri aims to have staying power too, as a haven of self-care with a conscience. Perhaps Davis said it best: “People just want to be seen, heard, and cared for. And to do it on this beautiful island, Key West … it’s like heaven.”

MT. TRASHMORE BACK ON THE DOCKET

ommissioner Sam Kaufman thinks it’s finally time to do something about Mt. Trashmore, and all the commissioners agreed at Tuesday’s commission meeting. It’s not the first battle cry over the now grass-covered dormant landfill, but maybe, finally, it will be the last?

The Key West landmark has been hovering over the Stock Island skyline for decades and has been a thorn in the city’s side. It’s wasted land in more ways than one.

At the Dec. 4 city commission meeting, Kaufman proposed a task force to study the environmental impact and possible economic solutions for the 18-acre parcel. The last commission discussion about the landfill took place in 2016, when commissioners asked for a $76,000 stabilization report from CH2M Hill Engineers. John Paul Castro gave the preliminary findings of the report that has yet to be finalized.

“The initial estimate to remove the landfill to road level is $70 to 190 million dollars,” said Castro.

“That would be 80 to 100 trucks running about 120 times a year, minus vacation and holidays, for three to four years.” Certainly, it’s not the price tag the commissioners were expecting.

“It’s been ignored for a long time,” said Kaufman before the meeting. The landfill has passed previous testing and has been in compliance with federal regulations, but that hasn’t stopped Kaufman from being concerned about the leachate, or pool of waste that may have gathered under the soil over time. Leachate can contain some of the worst toxins from decomposed waste and filter into the surrounding soil and, ultimately, water. “This is an opportunity for us to confirm it is safe.”

But what if it is a Pandora’s box, and the city will need to spend millions of dollars to fix any underlying problems? “I am not supporting a tax increase to support this, but in turn, is it really better to ignore it?” said Kaufman.

“Right now, it meets environmental standards, and we don’t want to upset that,” said City Manager Jim Scholl at the meeting. He did confirm that there was never a liner placed under the landfill, which is usually the barrier to stop the leachate from infecting surrounding areas. “Yes, there are plenty of unknowns,” Scholl agreed.

Kaufman praised Scholl for keeping up with environmental testing.

The consensus was to determine the highest and best use of the property over the next year.

Instead of an independent task force as Kaufman suggested, the commission voted for the Key West Sustainability board to oversee the viability of the property. Kaufman did hesitate over the Sustainability board’s ability to take on another task, given its time constraints. The suggestion was made that the Sustainability board be asked to meet every month instead of every two months to address the problem.

Overall, commissioners wanted to learn more about economic opportunities with the looming hill.

Commissioner Billy Wardlow was keen on a solar farm or installing windmills.

Before the 1940s, the now Indigenous Park on White street and Wicker’s Field at Kennedy Drive were the two Key West landfills. Because of the smell and horseflies, a permanent landfill was erected on Stock Island outside the city, now known as Mt. Trashmore. For 50 years, the landfill gathered garbage until reaching 90 feet above sea level. By 1993 the city adopted a “waste to energy” means of disposing of garbage on the mainland, and the landfill officially stopped accepting garbage. Mt. Trashmore was covered in ash that eventually became a blanket of grass. Waste Management operated a transfer station until 2009, when it moved to Rockland Key, ending all garbage operations at the site.

COUNTY VS. STATE LOCAL GOVERNMENTS EYEING MORE GUN CONTROL

n ongoing battle between local governments and the state over gun control has brought Monroe County into the mix.

Last month, Monroe County Commission voted 4-1 in favor of joining Miami-Dade, Broward, and Leon counties in their lawsuit to overturn State Statute 790.33. The law not only disallows local city and county governments from legislating stricter gun control, but it also allows the removal of any city or county officials who attempt to do so.

Even if local governments tried to pre-empt it in any way, they’d be in violation of the law.

Public officials could be removed from their job, fined $5,000 and have no public funds for legal defense.

“It’s not just about gun regulation; it’s home rule,” said Monroe County Commissioner Heather Carruthers, who voted in favor of joining the other counties in the suit. “We are the only non-charter county who will have weighed in on this at all.”

The county commission’s interest in this issues stems from 2014, when Big Pine resident Doug Varrieur set up a gun range in his backyard. His range received so much local and national attention that it landed on major news outlets and shows such as “The Colbert Report.”

The show visited his Big Pine Key residence to get a look at his gun range and interview neighbors who mainly spoke against it.

With a target mounted to a backstop, installed against a 12-foot-tall shed, Varrieur fired his weapon in the direction of a canal that boaters, kayakers and others used. Before he shoots, however, family members are near the canal to warn if any watercraft is approaching.

One of the only state restrictions regarding recreational shooting on private residential property is that bullets cannot project over a road or a dwelling that’s occupied. Also, shots cannot be reckless or negligent. Not even noise ordinances could stop shooting from homes in residential neighborhoods.

Varrieur was not the only example of a person trying the sensibilities of officials who believe in common sense gun control. He did, however, highlight the need for home rule.

The state statute 790.33 is otherwise known as the Joe Carlucci Uniform Firearms Act. Who was he? Carlucci was a New York transplant who spent a decade in Jackson-

“This is where the rubber meets the road,” said Carruthers, “and for local government, we should handle those issues.” She expressed disappointment in the dissenting vote, which was cast by Monroe County Mayor and Commissioner David Rice, who Carruthers said has previously voted in favor of local government control. “I was surprised at the lack of consistency supporting home rule.”

Rice said he supports the primary intent of the legal challenge, but not the secondary.

The primary challenge centers on whether it is constitutional to penalize, or threaten to penalize, elected city or county officials with fines or suspension of office if they pass new gun laws.

“What this is about is the constitutionality — whether we can be fined $5,000 or removed from office by the governor … little fun things like that,” said Rice. In other words, the state constitution outlines the many reasons officials can be removed from office, such as drunkenness, incompetence, or commission of a felony — but creating new, more restrictive laws about guns is not one of the reasons.

“Quite frankly, the issue of local control causes me to be sympathetic with the lawsuit because Tallahassee often creates ‘one size fits all’ solutions that don’t help us down here,” Rice said.

And yet, he said he’s looking down the line at what might happen if the challenge is successful. Then, he said, every local county and city government would be within its rights to create specific gun laws, creating a hodgepodge of laws that only exist within certain geographical boundaries. Rice cited a case in which an honorably discharged veteran was jailed after a traffic stop in New Jersey that revealed his grandfather’s shotgun stowed in the back of a moving van.

“I am not opposed to intelligent discussion and doing the best job that we can do to end gun violence,” Rice said, “But I am against putting otherwise innocent people in jail because we have created an unknowable mass of laws that trap them into a situation.”

LITMUS TEST Challenge filed to Marathon’s extra 300 units SARA MATTHIS sara@keysweekly.com

A

Marathon resident has filed an administrative challenge to the City of Marathon’s plan to add 300 affordable housing units. The additional development rights are part of 1,300 awarded by former Gov. Rick Scott to Monroe County following Hurricane Irma. So far, the City of Marathon, Key West and Village of Islamorada have begun the process of amending their comprehensive plans to accommodate the additional units.

Cecelia Mattino alleges the additional development will impact hurricane evacuation and that residents of the new units aren’t necessarily part of the workforce, nor are the units truly affordable.

In a press release issued

by Friends of the Lower Keys, Mattino said, “Residents of the new housing to be developed under Marathon’s ordinance don’t even have to be members of the workforce. It’s another one of those boondoggles where developers can build all of the units at the highest end of affordable housing – the most profitable for them – but the real working people of Marathon still won’t have affordable housing.” The press release also has endorsements from the Florida Keys Environmental Fund.

The case will be heard by an administrative law judge from the state Department of Administrative Hearings. Mattino is represented by attorney Robert Hartsell; attorney Richard Grosso — a wellknown challenger of Florida growth management policy — is also on the legal team. If the challenge is rejected, an appeal could be filed with the First District Court of Appeals in Tallahassee.

The petition for administrative hearing states that Mattino lives on 80th Street in Marathon, and that she is the mother and primary caretaker of her 100 percent disabled daughter. Property record searches indicate that the home belongs to her daughter, but the record is sealed. In addition to the claims above, the petition said hurricane evacuations are dangerous for the daughter, and stressful for Mattino.

“The city received a petition to our Comp Plan amendment ... and is currently reviewing,” said Marathon City Manager Chuck Lindsey.

“It is our policy to refrain from commenting on pending litigation.”

Monroe County still has not accepted the 300 extra affordable building rights from the state, although the commission has not ruled it out, either. It is still under study, according to Monroe County attorney Bob Shillinger.

“We’re going to be watching to see what arguments are raised,” said Shillinger.

“I would not be surprised if the other cities who move forward to accept the building rights would face similar challenges.”

F

rom the time he could pull out the Tupperware bowls and coffee cans, a strong, regular, repeated pattern of movement and sound — rhythm by definition — would set the tempo of the musical beginnings of Key West artist and performer Ross Brown.

Growing up in a “musical household” in Pennsylvania, music was a constant. Both Brown’s father and grandfather played guitar. His dad was into heavy guitar-driven music, especially classic rock and blues.

There were perks and benefits to always having a jam spot growing up, and he was at home with a drum kit.

Listening to his father’s huge vinyl collection, playing on a toy drum set, it’d still be a few years until the younger Brown would pick up and fall in love with the guitar. Though there were always guitars in the house, until he was about 11 years old, he wasn’t allowed to touch them.

“One day my dad was like, ‘here, try this,’” said Brown, recalling his father putting a guitar in his hands and showing him some blues riffs.

While his dad was instrumental with his guitar influences, it was his mother who turned him on to the sounds and grooves of Medeski, Martin & Wood and Tower of Power. These musical styles would begin carving and defining his musical journey.

“I just took to the funk,” said Brown. Although he played guitar and sometimes bass in the high school jazz band, it wasn’t until he moved to Philadelphia to attend college that he was able to really experience Philly’s amazing jazz tradition. Graduating from Drexel University with a degree in computer information systems, he would stay in Philly and go on to do the “corporate thing” for a while. From doing live sound in concert venues to corporate audio-visual work, he found

himself spending way too much time doing all the things that were based around the music business, but not playing music.

“I was always doing other things to make ends meet, rather than doing what I really wanted to be doing, which was playing music.” After traveling extensively, even once driving from Philadelphia to Costa Rica and back, he would eventually sell his home in Philly.

After 15 years, Brown would return to his hometown of LeHigh Valley, Pennsylvania for two years. It was here that he met some friends who brought him to Key West. One of those friends just happened to be local musician Jeff Clark, who also was from Pennsylvania. Clark is the reason he came to Key West the first two times to play.

“I recall getting here, and music was everywhere, coming from all sides, and I remember thinking: I can do this.” It was Clark who ultimately gave the advice that would set the stage for the future. He said if you wanted to make it in Key West, you have to learn to play solo, something Brown had really never done before as he always played in bands. He took that advice to heart, went home and started playing with a looper. That was back in 2012, and he’s been in Key West, often as a solo act, but collaborating as well, ever since.

F

ilmmaker, writer, director and cultural icon, John Waters’s resume is impeccable, yet his self-description reads like the encyclopedia of bad taste. Dubbing himself the “Pope Of Trash” and “The People’s Pervert,” Waters carved a niche in the entertainment world by making outrageous films like “Pink Flamingos,” “Hairspray,” “Cry Baby,” “Pecker” and “Serial Mom.” These movies have become cult classics for honoring misfits, perverts and weirdos. For five decades, Waters has celebrated kitsch like no other artist, with movies, books and photography mastering tawdry themes and characters that mock the dark side of middle America. At 72, Waters still hasn’t stopped poking fun at suburbanites and calling out the ironies of the holidays. The acerbic wordsmith brings it all on stage with his popular annual and critically acclaimed “John Waters Christmas Show” at the Key West Theater, for one night only on Sunday, Dec. 16.

“I love going to places like Florida that are not thought of as Christmasy,” said Waters, who has a long history with Key West. Waters stayed with friend, muse and star of many of his movies, the infamous Miss Divine, in Key West while writing parts of his bestselling book “Shock Value” (1981). In 2013, Waters returned to headline the Key West Film Festival for the documentary feature “I Am Divine,” about the beloved friend and drag queen. Now it’s his second year bringing the Christmas show to the Key West Theater, and Waters loves a comeback story.

“I have done the show for 14 years, but I rewrite it every year. I owe it to my audience,” said Waters, who has an endless array of thoughts and memories of the holiday season unlike any other. He is peculiarly sentimental about the holidays, in a contrarian way, often through funny observations: “I don’t understand living crèches, with real babies and animals. Animals can’t be forced to pray; we can’t make them choose Christianity.” And don’t get him

started on holiday decor, “I feel sorry for teenagers whose parents overdecorate the house; it’s a real embarrassment. The kids can’t sell pot during the holidays with so many lights on. But what I really love is that one house on the street that refuses to decorate.”

Conversely, Waters is strict about some traditions: “I sign over 2,000 cards a year and put a lot of thought into it.” As for receiving cards, of course he loves the witty ones, but electronic cards? He deletes every one. “How can you deny the mailman the honor?” As for Christmas decorations, Waters said, “I have always been inspired by the ‘50s; it’s easily mockable.” But he has a great reverence for the culture of Martha Stewart, who strikes the opposite image of his oft-flamboyant vision. “I met Martha Stewart at the Grammys — it was like good taste met bad taste, but I have a lot of respect for her; she’s an ex-con.”

But Waters has no qualms about showing his softer side, as he easily talks reverentially about cooking for his family every year and his favorite gift to give, simply a book. He had no idea he may find Judy Blume at Books & Books and thought it was a great idea to pop by for a little Christmas shopping. Waters maintains the ability to draw in audiences, whether to tell the story about the time when the Christmas tree fell on Grandma or the time when his mother tried to put up real candles instead of Christmas lights, which Waters described succinctly as “terrifying.” As a whole, Waters thinks of Christmas as a “beautiful and weird” display of decor, tradition and festivities. He undoubtedly will entertain with his idiosyncratic observations about his favorite season and create the holiday spirit like no other.

The Holiday Season is, unfortunately, a time when thieves target residents in myriad ways. As is often the case, most crimes are crimes of opportunity. That means simple precautions, such as locking vehicles and residences, are often the only difference from being unaffected by crime and being a victim. Please lock your doors!

Here is a list of some other Holiday reminders: • As online mail-order services such as Amazon continue to grow in popularity, so do thieves who target packages left on porches and doors. You can combat this problem by asking neighbors to help keep watch or by mailing to a different location if you know you won’t be home at the delivered day. You can also request that packages require a signature to be delivered. Another option growing in popularity is the use of home surveillance cameras. These technologies continue to drop in price while their ease of use rises. You can link many of them now to your smartphone for real time monitoring.

Install surveillance cameras and make sure they will capture the face of an intruder.

• Don’t leave fishing and diving equipment unattended outside. It only takes a thief a minute — literally — to take it.

• Leave a radio or television on so the house looks and sounds occupied.

• Large displays of holiday gifts should not be visible through the windows and doors of your home.

• Do not leave packages or valuables on the seat of your car. This creates a temptation for thieves. If you must leave something in the car, lock it in the trunk or put it out of sight.

• If you are gone for an extended period, call your local Sheriff’s Office substation. Our deputies will keep an eye on your property while you are away.

reat perfumers know ... the right scent can take you on a journey and transport you through time, kindling memories and powerful emotions along the way.

Such is the premise behind “Darius,” the elegant, evocative and magical play by Paris-based playwright JeanBenoît Patricot, making its U.S. premiere on Saturday, Jan. 5 and Sunday, Jan. 6 at The Studios of Key West’s Helmerich Theater. Preferred ticketholders can enjoy a small plates dinner before the performance, inspired by the script and designed by Chef Martha Hubbard of The Roost. General tickets (which do not include dinner) are also available for the 8 p.m. performance.

The play is told in an exchange of letters and e-mails between Claire Chambaz, a Parisian woman with a disabled son, and Paul Lagarce, a famous French perfumer. Her son, Darius, now 19 years old, was born with a rare disease that has, over time, deprived him of all his senses. Now with only the sense of smell remaining, she appeals to the perfumer to create a series of scents that will help her dying son recall joyful moments in his short life. Bittersweet and poignant, the play is an unforgettable journey into olfactory memory.

Similar in format to A.R. Gurney’s popular play “Love Letters,” performed at The Studios in 2016, the play stars

past Studios Board President Rosi Ware as Claire, and current Board President Stephen Kitsakos as Paul, all guided by the hand of esteemed stage director Murphy Davis.

“The first time I read the play I was deeply moved,” says Ware, who has a strong connection to disabled adults through her long-time volunteer work for the Monroe County Association for ReMARCable Citizens. “The work I do with MARC gives me a window into the lives of the developmentally disabled, and helps me understand Claire’s experience, allowing me to prepare for the role.”

The special two-night performance is a fundraiser to help finance the remaining costs of constructing Hugh’s View, the rooftop terrace that will be open to the public by the end of 2019, and will offer a view of the Gulf and Atlantic from one of the highest points on Key West. All proceeds will go toward this project.

Following the show, all audience members will enjoy a unique dessert created by Chef Hubbard. The event is generously supported by the Fleming Street Faith Center.

Knight Pier was erected by private funds in 1997 with 730 names. Since then, 529 names have been added, making a total of 1,259 loved ones affiliated with Key West. THE CURIOUS CASE OF DETAINEES AT MONROE COUNTY JAIL

T

his week, the ACLU—along with the ACLU of Florida, the Southern Poverty Law Center, and Gibson, Dunn & Crutcher LLP—filed a lawsuit against the Monroe County Sheriff’s Office on behalf of Peter Sean Brown, a U.S. citizen who had been working at Mango’s in Key West.

Brown reported a harrowing experience, being taunted by officers at Monroe County Detention Center and ultimately threatened deportation to Jamaica, a country he has only visited once. Brown insisted he was a citizen — he was born in Philadelphia — and was transferred to a federal detention center in Miami, where, 12 hours later, he was released. Brown’s written complaint was met with, essentially, a message that the sheriff’s hands were tied: “Mr. Brown, You are being held on a felony VOP and an ICE hold. It is not up to us to determine the validity of the ICE hold. That is between you, your attorney, and ICE.” Sheriff Rick Ramsay’s office responded in a press release to the breaking news of the lawsuit. “Local law enforcement throughout this country has been caught in the middle of a political argument regarding immigration,” said Ramsay. “This was an unfortunate case of mistaken identity by ICE regarding a subject who was initially in state custody for violating probation.”

Brown was arrested on a VOP—violation of probation—for a misdemeanor marijuana offense, and his original charge was for a felony crime of violence against a police officer. After the VOP arrest, the Monroe County Sheriff’s Office received an order from the Department of Homeland Security to detain Brown for ICE to pick him up.

According to the Basic Ordering Agreement (BOA) between the Sheriff’s Department and ICE, Ramsay’s officers have to detain people in custody who have been earmarked by ICE as undocumented immigrants. Technically, Ramsay would have been breaking federal law by releasing Brown.

In January, ICE announced 17 BOAs with sheriffs throughout Florida. U.S. Immigration states that when “an alien is arrested on a local criminal charge, all too often, they are subsequently released before ICE has the opportunity to pick them up.” So, ICE is using local law enforcement to detain and house people whose identities are flagged in the Homeland Security database. All sheriffs’ departments, including Monroe County, have computers connected to federal agencies.

Adam Linhardt, director of media relations at the Monroe County Sheriff’s Office, said, “When you get processed in our jail, we run your fingerprints, and the FDLE (Florida Department of Law Enforcement) runs them, and shares them with national law enforcement, like the FBI, ICE, etc., so that we’re on the same page of who’s being detained where and for what.”

Cross-referencing makes sense, but why were Ramsay’s hands tied when it came to releasing someone provably a U.S. citizen?

That’s where the BOA comes back in—The sheriff’s office does not have jurisdiction, only custody, of someone who is being held at a partnering facility (the Monroe County Jail) by ICE, even if, theoretically, the detainee presented a birth certificate, a passport, and his mother.

Linhardt explains the context of ICE detainees at the Monroe County Jail: “ICE detainees are in two columns, and the first column is an initial agreement, which goes back to the 1990s.” This agreement, negotiated between the sheriff’s office and ICE directly, dictates that the sheriff’s office will house ICE detainees (generally undocumented immigrants) and for that, the county receives $87 a day, per detainee. Linhardt made it clear that he was not explaining the rules in reference to the Brown case, but rather ICE detainees held under “column one” — regular ICE detainees. He said, “The rules for those folks are different, because they aren’t here on a crime, exactly; they are being held here for immigration-related issues. They are to be held separately from a general population, and there are some different regulations for them.” Food, recreation and medical care are similar, but they might have different allowances for clothing, packages they can receive and so forth. There are 50 to 60 ICE detainees at the Monroe County Jail at any given time.

When ICE entered into BOAs with different municipalities in January, that is what Linhardt calls “the second column.” He said, “This relates to folks who are in custody, in jail, for some reason, most often at the state level.” While Linhardt doesn’t specify this, the second column is the column Brown falls under. Brown was held in General Population, because he was in the jail for a VOP, but the ICE hold meant the Monroe County Sheriff’s Department couldn’t release him. Even if he proved he was a citizen? Even so.

Homeland Security sent the Sheriff’s Office an order from a federal judge, claiming, via “biometrics” (fingerprints), that Brown was an “alien,” having been born in Jamaica in 1968. Of course, now we know that was incorrect, and we can reasonably conclude that the officers at the jail also could access records indicating that Brown was born in the U.S., but a release would go against the written order of a federal judge. In the press release, Ramsay wrote: “Though the Sheriff’s Office does not investigate immigration matters, and while I cannot release detainees under ICE custody, I immediately took action when notified of this matter months ago. I ordered Sheriff’s Office detention deputies to immediately notify ICE of a detainee’s claims of citizenship and to follow up with those claims.”

According to the BOA, the Sheriff’s Office can only hold an ICE detainee for 48 hours before they are released. In the case of Brown, he was technically still in custody for the VOP, and when transferred to Miami, his ICE clock started ticking (he was released after 12 hours). The question remains: what details of Brown’s criminal case required him to remain in jail for weeks, other than the ICE hold?

Unlike the detainees in “column one,” Monroe County only receives $50 for each detainee released to ICE under the 2018 BOA, and the money goes directly to the county—not the sheriff’s office. When the BOA came about, Ramsay declined being cross-deputized as a federal and county agent, preferring to stick to local law enforcement rather than pursuing federal matters.

Now, he’s in the hot seat despite it.

Linhardt describes “the second column” detainees (inmates in the general population who are also under an ICE hold) as “really rare.” The population of people in “column one” who often have no criminal history are held separately and that population changes often, as ICE brings in and takes away detainees. But it seems to be a legal quagmire when a county jail is essentially serving as a contractor for a federal agency, and then is sued for its inaction when the federal agency erred. Linhardt declined to comment directly on the Brown case.

n June, Hawaii Governor David Ige signed a trailblazing bill that will ban the sale of sunscreens containing chemicals, including oxybenzone, that have been proven harmful to coral reefs. Dr. Craig Downs, executive director of the Haereticus Environmental Laboratory, was an influencing force in the Hawaiian state legislation. Downs has conducted research finding that oxybenzone in sunscreen contaminates coral, fish, marine mammals, bird eggs and sea turtle eggs. He presented his research at the Key West City Commission meeting Dec. 4.

Representatives from the cosmetics and sunscreen industry were also in attendance. Emily Manoso, staff counsel at the Personal Care Products Council, said the FDA has approved sunscreens, and the broad spectrum coverage of oxybenzone-based sunscreens is effective at preventing sun damage and skin cancer. She called the science “incomplete.” Dr. Kurt Reynertson, of Johnson & Johnson’s Regulatory and Stewardship Policy Department, testified that more research is “crucial.” He said: “I understand the concern. We want to be sure that we’re doing the right thing.”

Downs said that “sunscreen pollution doesn’t just impact the sunscreen industry,” but restaurants (oxybenzone was detected in fish being served in restaurants in Hawaii), tourism, property values and taxation. He described a “ripple

effect,” because of the impact on natural resources in the Keys.

“In 1975 we had beautiful reefs,” Downs narrated as he showed photographs, “and now it’s a pile of rubble.” He cited pollution as the cause of high death rates and reproductive failure of coral.

The presentation was compelling: 99 percent of the Florida Keys coral coverage has died in the last 50 years. Downs cited water samples taken at Fort Zachary Taylor, which had oxybenzone at levels comparable to those in Hawaii. Swimmers and sewage are the sources of the oxybenzone levels, and eight other scientific groups corroborate Downs’s research.

Executive Director of Reef Relief Mill McCleary also testified to the damage of oxybenzone sunscreens to the reef. He suggested viable alternatives, like zinc oxide sunscreens. Commissioner Jimmy Weekley spoke in favor of the ban: “I believe this is truly the right thing to do. We are dependent immensely on the water surrounding our island,” and said it is the community’s responsibility to be “stewards for the next generation.”

The commission voted in favor of postponing the vote until Jan. 15, giving the sunscreen and cosmetics industry equal time to present scientific research in their favor.

Commissioners Clayton Lopez and Sam Kaufman discussed the need to research alternatives to oxybenzone sunscreens, while Davila questioned enforcement. If passed, the ban would prohibit sales of oxybenzone sunscreens in Key West.

ote’s Ocean Fest: A Community Celebration at Founders Park entertained and educated in Islamorada on Dec. 1. Key Westers can look forward to Mote’s upcoming Ocean Fest on Saturday, April 14 from 10 a.m. to 6 p.m. at Florida Keys National Marine Sanctuary’s Eco-Discovery Center and newly remodeled Truman Waterfront. The Mote Ocean Fest in Key West will have a similar thrust.

The day featured a host of vendors from nonprofits to food and drinks as well as a scavenger hunt, music by four bands and a live painting by Pasta Pantaleo. The festival showcased the treasured marine environment while raising awareness for coral reef research and restoration.

Attendees had the opportunity to explore conservation environmental exhibits, meet live animals, experience touch tanks and more. Children practiced their casting and climbed a rock wall.

Dr. Michael Crosby, Mote president and CEO, said Ocean Fest gathers the community and organizations that are working in the environment to emphasize how critical the coral reef is to the Keys.

“The Florida Keys are literally built on coral reefs. We’ve got a very unique culture here, an economy and a way of life that is all dependent on a healthy coral reef,” Crosby said. “Unfortunately, our coral reefs are in a significant state of decline from increasing temperature to coral disease that’s spreading like wildfire through the Keys.”

Crosby said the disease has an 80 percent mortality rate and is on the verge of wiping out the last vestiges of coral reefs – pushing them into functional extinction. Crosby said Ocean Fest is trying to raise awareness of the problem and the innovative science and technology developments to combat it.

“Mote Marine Lab and our colleagues have been able to develop the methods and the techs to very rapidly restore these coral reefs through a replanting of native coral species that we have identified the resilient strains to the diseases, to increase temp, to acidification. What we are planting out there with the community will be here 100 and 200 years, and we’ll bring back the vitality and health of our coral reef ecosystem together.”

At Mote Marine Laboratory, there are 1,712 volunteers who are involved in every aspect of what the organization does. Crosby said they are essential.

“We do need citizens, local volunteer citizen scientists to be directly engaged to help us monitor the status but also in helping to actually restore these coral reefs,” he said. “We cannot do it by ourselves. The community has to get engaged in this. Their support is vital to the success of this effort.”

National Honor Society; Beta Club and Interact because they focus on my community; Zonta; Executive Board and Student Council allow me to help lead my school and be a voice in decisions; Sideline and Competition Cheer, because it teaches me life skills and creates a bond with my teammates.

What are your plans after high school? I plan to attend a four-year Florida university and possibly major in the social sciences.

What do you hope to be remembered for at KWHS? I hope to be remembered as the girl who always had a smile and was kind to everyone.

What is one favorite way to spend your spare time? I love to hang out with my friends in my spare time.

Will you make the Keys your permanent home? I probably will not make the Keys my permanent home because I would like to live in a bigger city when I’m older, but I will definitely visit often.

What three things would you like to accomplish before your 10-year reunion? Graduate from college, start my career, and travel to London.
