HALLIBURTON, TRANSOCEAN SETTLEMENT MONEY AVAILABLE FROM DEEPWATER HORIZON KATIE ATKINS

S

ettlement money is still being paid out eight years after the Deepwater Horizon oil rig exploded off the Gulf Coast, killing 11 of 126 workers on board and resulting in an 87-day oil spill.

The damage done by 134 million gallons spewing into the Gulf of Mexico resulted in two different settlements, making for the largest total environmental damage settlement in history: $20.8 billion approved by a federal district judge in 2016. It ended all civil and criminal penalty claims against the owners and operators of the Deepwater Horizon rig – BP, Anadarko, TransOcean and Halliburton. It also included economic damage claims submitted by the five Gulf states and their local governments.

Those who were part of the BP settlement, which has now been paid out, can start the process with TransOcean and Halliburton, said Marathon-based attorney Rich Malafy. He specializes in real estaterelated litigation.

Monroe County had a “presumption of causation,” meaning damages and losses were presumed to be caused by the oil spill.

And the second part: the Halliburton and TransOcean settlement set aside more than $1.2 billion, according to the National Oceanic and Atmospheric Administration.

Of that, $902 million will be distributed to certain plaintiffs as punitive damages and $337 million will be distributed to existing Deepwater Horizon economic loss claimants.

To be a part of the TransOcean and Halliburton settlement, you would have to have lived in Monroe County or one of the other affected counties and show a loss over a certain period of time, Malafy said.

“A lot of people got discouraged about the BP settlement because you had to come up with records going years back,” Malafy said. “As long as you did the BP settlement, you’ve already done the heavy lifting and we just have to push the ball over the goal line.”

Aside from the deaths of hundreds of thousands of animals and extensive damage to beaches and wetlands, coastal businesses experienced economic losses and real estate deals fell through in the Keys. The Keys were threatened by the oil spill, and even though none made it here, fear led many tourists to change their vacation plans.

The oil left Gulf Coast states reeling from a devastated ecosystem, the deaths of as many as 105,400 sea birds, 7,600 adult and 160,000 juvenile sea turtles, and up to a 51-percent decrease in dolphins in Louisiana’s Barataria Bay, according to NOAA. When Congress passed the RESTORE Act in 2012, it dedicated 80 percent of all administrative and civil penalties from the responsible parties to ecological and economic recovery efforts in the Gulf.

n Oct. 27, the mass shooting at Tree of Life Synagogue in Pittsburgh rocked the nation.

A week later, on Nov. 4, Key Westers gathered to honor the victims as a community at B’nai Zion synagogue on United Street. Rev. Randy Becker organized the service with the Key West Interfaith Ministerial Alliance under the name “Key West Says ‘No,’ to AntiSemitism.” Rabbi Shimon Dudai led the group in the Mourner’s Kaddish.

Kim Gordon sang a rendition of “Ose Shalom,” Sam Kaufman read from the Book of Proverbs, and other faith leaders contributed words and prayers.

More than 200 people of the Keys gathered from many different faith congregations and traditions.

Rabbi Dudai emphasized the Key West motto of “One Human Family,” and the gathering denounced acts of hate and anti-Semitism.

Eleven people were killed and seven injured, many of them elderly, in the Pittsburgh shooting. Gregory Bowers, 49, is in custody and faces multiple federal charges in connection with the shootings. The violent episode brought gun control and hate crimes back into the national dialogue.

WHO OWNS THE ISLAND?

KEY WEST HISTORY

he simple introduction of the two words Key West evokes the likelihood of a colorful tale.

The first recognized owners of the island prove no exception.

Key West was originally owned by Don Juan de Estrata. Estrata sold the island to Juan Pablo Salas in 1815.

Under the Spanish Land Grants, if supporting documentation was provided, property transactions under Spanish rule were recognized

by American courts. The problem was that Salas sold the island to more than one person. Salas would sell the island to an attorney named John Strong. He also sold the island to John Simonton on Jan. 19, 1822.

Strong, in turn, would sell the island twice, to John Geddes of Charleston and George Murray.

In the interim, Simonton took on three partners, John Whitehead, John Fleming, and Pardon Greene. It was Simonton who would be declared the rightful owner on May 23, 1828.

n the evening of Nov. 6 in Key West, there were toasts and embraces, as well as tears shed and gnashing of teeth. Democratic gubernatorial hopeful Andrew Gillum, who visited our progressive town (a dot of blue at the end of a long red line) just last week, lost a historic race against Trump-endorsed Ron DeSantis. In an upset flipping the other way, incumbent Republican House Representative Carlos Curbelo lost to Democratic contender Debbie Mucarsel Powell.

Incredibly, Rick Scott beat Bill Nelson for Senate by only one vote in Monroe County, with final numbers at 18,021 and 18,020 respectively. I can only pray that lacking Nelson vote wasn’t one of my hungover buddies.

Sidebar at Aqua was teeming with nail-biting Democrats and the Harvey Government Center was a flurry of activity, with results rolling in to the celebratory teams of Holly Raschein, Michelle Coldiron, and Phil Goodman. Tensions ran high all over town.

If anywhere in town was a great representation of what Key West and “One Human Family” really means, it was the Teri Johnston mayoral party at Waterfront Brewery. In fact, the Key West artist who coined the phrase, JT Thompson, was there toasting our new mayor personally.

Johnston’s was also a historic victory—she is the first “out” lesbian mayor to be elected in Florida.

Johnston’s response to the pioneering nature of her victory was, “That’s what I’ve been told,” as reported by the Miami Herald. That kind of casual attitude toward acceptance — which might be groundbreaking elsewhere — is exactly what makes Key West so great. Johnston’s sexual identification, as historic and hopeful as it may be for the LGBT community

and America as a whole, was not the focus here, because we are a community that presumes tolerance as a baseline. The 20-year Key West resident ran an issues-driven campaign.

Johnston, who garnered nearly 67 percent of the vote, credited her victory to her team cooperation, and she said she looks forward to “working together” and continuing to build the “inclusive environment” that is Key West. County Commissioner Heather Carruthers was also in attendance (and also identifies as gay, for the record) and she commented on being proud of the “respectful races” that were run locally for multiple offices. Tellingly, the first person to congratulate Johnston at the Harvey Government Building was Margaret Romero, her opponent.

Respect and tolerance should be the norm all over America, but that’s often not the case. Whether our personal favorite candidates won or lost, it makes me proud to see Key West setting a higher bar for political rhetoric and tone of political.

I saw a lot of hugs and handshakes across the aisle last night. While Key Westers sometimes feel isolated as an outpost of liberalism in a sea of Keys conservatism, we should credit our community for being capable of crossing boundaries of race, creed, gender and sexual identity, and political affiliation. And we do it all in sunglasses and a smile. I may campaign to expand the island’s “One Human Family” motto to the rest of America.

A SONG IN HER HEART CARMEN JO RODRIGUEZ IS A KEY WEST CLASS ACT

Full Name? Carmen Jo Rodriguez.

And nickname? Cha Cha. Do you have a life credo or motto? Say what you mean; mean what you say! … And don’t talk the talk if you can’t walk the walk.

S

inger Carmen Jo Rodriguez has been serenading local audiences for decades. With delight and energy, Rodriquez loves to sing, and she has proved it on stage from theaters to nightclubs all over Key West. On Nov. 16 and 17, Rodriguez will open the 2018-19 Waterfront Playhouse’s season, starring in “Carmen by Request,” and it’s the perfect kickoff.

Born and raised in Key West, Rodriquez spent her childhood on Duval Street at her parents’ restaurant, Rod’s Restaurant, and by age 18, she was singing in the clubs around town. It was only natural that her first piano accompanist was Coffee Butler when, at 17, she won Miss Congeniality in a Key West pageant.

Without formal training for acting or singing, she has persevered. “I always say ‘I can do that,’ then learned as I went.”

Her style ranges from rock ‘n’ roll to standards, folk, island, Latin and pop. She even learned country music to sing in the style in Las Vegas in her 20s. Often side by side with cherished piano player Bobby Nesbitt, Rodriquez’s sultry voice has been an iconic Key West sound. For a girl who never set out to be a singer — she has a degree in education — she understands it’s not just about talent. “You have to be an entertainer, give people a memory. I learned when someone believes in you, you begin to believe in yourself, and it’s great to share that with the audience.”

How did you start singing and performing and from what age? I was 17 years old when I started singing, and a friend drove me to an audition for a band. She insisted that I could sing. And I got the job. The band played a lot of parties and then I was in a Miss Key West contest that my mom insisted I enter. They had a talent part of the contest and my first piano player was Coffee Butler (Coffee and His Cups). I didn’t win, but a gentleman came backstage and said, “I’m going to put a band together and I want you to be the singer.” Well he did, and the band was called Together, and I sang in every club in Key West. The good old days were lots of fun.

What has performing in Key West taught you over all these years? That I like singing all types of songs, and it’s important to give people a song to help remember a memory, a place, family and friends.

What did you think you would grow out of but haven’t? Collecting stuff. And it really does help now that I’m working as a prop mistress.

Which TV, movie, or superhero character is your alter ego? Marilyn Monroe.

What job would you be terrible at? Being a piano player. I once took a piano course in college but the teacher told me, “Carmen you really need to stick with singing.” Ha. If invisible in Key West what would you do? Check on how people are taking care of their children and pets.

What question can you ask to find out the most about a person? What do you wish you had done differently in your life?

Favorite guilty pleasure? Fried shrimp.

What job would you secretly love to have? Being a comedian.

What is something you think everyone should do at least once in their lives?

Leave their cell phones at home and just talk with each other.

What has been your favorite moment on stage? For me, every moment on stage is my favorite.

Lunch with one famous person, whom would you choose? Barbra Streisand. I’d bring the stone crabs; I hear she loves them.

How did you get involved in marrying people (she is a marriage officiant)? A friend of mine got a new job at a hotel as a sales and event manager for weddings. She was having a hard time getting officiants to return calls or confirmations. She knew I had no problem being in front of people, so I got my notary certificate and came up with different wedding wows. I have now married hundreds of people from around the globe, and it’s so wonderful when they come back to visit on their anniversaries here in Key West.

What do you consider your greatest achievement? Having the capacity to pick myself up, bounce back and carry on regardless of the situation and living in the NOW.

My friends and family would describe me as … helpful, loyal, generous, vibrant and sparkly.

SAY GOODBYE TO ERECTILE DYSFUNCTION Treatment can replace the blue pill

nyone curious about solutions to erectile dysfunction (ED) should learn about this innovative treatment. It’s not new — it’s been used in Europe for more than a decade — but due to America’s pharmaceutical dependency and the big business of erectile enhancement pills, let’s just say this treatment has had a soft start. It’s called penile lithotripsy and hands down the easiest way for a long-lasting solution without surgery, pills or even pain.

Urologist Dr. Bruce Fariss has had his eye on this procedure for years and is excited to announce he has brought the treatment to Key West. (Miami is the nearest place otherwise.) Penile lithotripsy is done by a machine that creates low intensity shock waves that break up the blockage of blood flow to the penis. Moving a small wand over the penis opens up the arteries and naturally improves blood flow, the cause of dysfunction. In some cases, neovascularization can occur — new healthy blood vessels form.

The procedure is not FDA-approved, but the device is legal in the United States because it has been approved for use with plantar fasciitis.

“Lithotripsy is a win-win. The treatment is virtually painless and has no side effects. Depending on the level of the patient’s problem, I have had a patient improve after one treatment and many improve after a few,” said Dr. Fariss. The treatment is a minimum of six 10-minute sessions. Patients who respond to drugs like Viagra and Cialis will most likely respond well to

the treatment. It’s been touted to also increase sensation, sexual performance and can last one to two years or longer.

“A significant number of patients with ED have cardio problems,” said Dr. Fariss. “Both problems are about constricted blood arteries.” If patients have more complicated problems and are on medication, then taking male enhancement pills increases the risk for heart attack or stroke. A history of congestive heart failure, unstable angina, low blood pressure, or uncontrolled high blood pressure also puts them at risk. Lithrotripsy has zero side effects and will not increase further health problems.

A six-session package will cost $3,000. Most sexual enhancement procedures and pills are not covered by insurance but the overall cost pays for itself in comparison to pills. Viagra is now upwards of $70 a pill, and the generic sildenafil $30; these are only taken when sexual intercourse is expected. According to GoodRx, Cialis, a daily pill, “can cost between $350 and $1,700 for 30 tablets depending on their strength; generic tadalafil costs between $100 and $600 for 30 tablets.”

“I am surprised men have been hesitant,” said Dr. Fariss. “Then again, we have become drug dependent when we don’t have to be.” Painless, non-surgical, non-invasive, and a happier sex life: it sounds like a win-win for both men and women.

veryone has different qualms about the Florida Keys community in which they live.

Maybe it’s a lack of affordable housing, homelessness or heavy traffic on the Overseas Highway — at least those were the top three on a list of concerns for Middle Keys residents last time Monroe County did a community health assessment.

Now is the time for residents to get involved and let county officials know what tops their own personal lists of health concerns.

“This is not just another Health Department survey,” said Alison Kerr, public information officer. “This is countywide and we need everyone to be involved so we can take action and identify community health priorities and strengthen programs.”

Kerr said since she released the survey last week, about 130 people have responded.

“The more the merrier. We want all the representation we can get,” she said.

People who live, work and spend time in the Keys can fill it out online, and it takes roughly five to 10 minutes. Face-toface interviews will be conducted as well, Kerr said.

The anonymous survey, which is available through the end of the month, is one of several steps in the informationgathering process. The first part, titled Public Health Essential Services, happened Oct. 31 with a meeting of more than 30 medical professionals in Key West. Their part involved a 100-question survey relating to what the county is doing to address public health concerns.

“We’re ranked pretty high in cirrhosis and drowning and motor vehicle accidents among those who are drinking alcohol,” Kerr said.

That’s been the case for a few years. Kerr said last year 23 percent of residents countywide engage in binge drinking, the highest in the state of all 67 counties. Monroe County also has the highest alcoholic liver disease and cirrhosis death rate in the state, she said.

On Nov. 1, a public meeting was held with about 30 people in attendance, and it allowed people to share some of the issues, strengths, weaknesses and threats facing Monroe.

“All of that data in the four-hour meeting and the Oct. 31 meeting will go into the countywide assessment, and we’re still crunching the data,” Kerr said.

INSPIRING WANDERLUST ‘ATLAS OBSCURA’ AUTHOR COMES TO KEY WEST

“H

ave an adventure plan,” says author Dylan Thuras. What a wonderful thing to tell children, encouraging them to see the world. Inspiring kids to travel into volcanos from Iceland to Japan, to see cliff dwellings in China or thousands of fireflies in Tennessee, Thuras’s new book, “Atlas Obscura Explorer’s Guide for the World’s Most Adventurous Kid,” should be on every wish list from parents to progeny. ey West’s new bar, Henry and Eli’s Side Street Pub is so dog-friendly it even has a menu for its four-legged patrons.

Saturday, a grand opening will be held at the pup-loving pub at 112 Fitzpatrick St. It serves high-end bar food and a wide variety of wine and beers.

“We are family-owned and veteran-owned,” said co-owner Sherree Turcott, who, with her husband Jesse and uncle Scott Grubb, opened the bar three weeks ago.

The grand opening will raise money for the Florida Keys SPCA. It’s also a birthday party for Eli, one of the canines after which the bar is named.

Dogs looking for a fur-ever home have a special place in the Turcott family, seeing as how both Henry and Eli were found wandering the streets after being disowned by their families.

After being taken in, veterans said Henry would not survive because of heartworms. But miracles seemed to happen often around Henry, Grubb said, and he pulled through for another 14 years.

Henry passed away in 2015, but his memory lives on as the bar’s namesake, Turcott said.

Eli has a unique story, too.

The Turcotts were heading home from a friend’s wedding two years ago in Bradenton when they found Eli in the street. After a few days of searching for Eli’s owners, they found he had not been taken care of by his first family and continuously ran away from their house. After he was returned to the shelter, they adopted him and renamed him. He can be spotted walking around Old Town or lounging at his pub.

Key West funk band The Happy Dog will perform at Saturday’s grand opening, which is a petfriendly event, and the SPCA will be giving away door prizes and raffles.

There will be puppies up for adoption as well.

“Additionally, we are partnering with the other two new businesses on our street, Tropical Vibes Cones & Bowls and Pacific Jewelry,” Turcott said.

HISTORIC NAMESAKE VISIT BY THE USS KEY WEST SET FOR VETERAN’S DAY WEEKEND

T

odd Stoughton, 52, served 27 years in the U.S. Coast Guard, 17 of them at Station Key West, as a part of Aids to Navigation Team Key West, and on multiple Coast Guard cutters out of Key West.

Today, he is the risk and safety manager for the City of Key West.

“I still get to make an impact on employees, residents, Conchs and visitors,” he said of his job.

“I’m surrounded by another diverse workforce that gives the same effort day in and day out that I saw in the military.”

He met his wife, Tania, in Key West and they married in 1990.

His three daughters were born in Key West, and he is incredibly proud of his three grandkids.

“After I transferred to Key West in 1986, I stayed on the East Coast,” he said. “Key West became home, and when I was transferred out of Key West, to places like Sandy Hook N.J., St. Petersburg, Fl., Beaufort, N.C., we were always planning on returning to Key West as quick as possible.”

He traveled nearly the entire Caribbean Ocean, and visited more than 100 islands, including all the U.S. Virgin Islands, all the British Virgin Islands, and still knew Key West would be home one day. His tours included Antarctica on the initial tour on the Coast Guard Cutter Glacier, and Australia, South America, Hawaii and Samoa.

“I was considered operational most of my career as a boat coxswain, deck watch officer, and boarding officer and got to see Cuba change over the years, and Haiti change over the years,” he said. “What I’ve learned is that we are a blessed nation, and the citizens and residents of the United States are very fortunate to live where we do.”

When he isn’t working, he loves to be on the water as much as possible with his family – especially spearfishing, or taking boat trips to Snipes on the weekends.

When he retired in 2014 as a chief warrant officer 4, his pins

included a permanent cutterman pin (gold for officers), coxswain pin, and Boat Forces insignia.

He retired after his last tour at Station Key West, where he was stationed twice, in 1990 as an E-5 and then as commanding officer in 2009.

During his career, he said, he valued the “men and women that proudly served our nation through the good times and the bad times,” he said.“I have seen young men and women be put in the most strenuous of situations, and perform with perfection.”

Today, he still keeps in touch with more than 100 men and women he has served with and takes pleasure in hearing about their advancement in their personal and professional careers.

“I was also pleasantly surprised to find out how many City of Key West employees have served in the military,” he said.

nly three U.S. Naval ships have ever carried the name of Key West. The third, the USS Key West (SSN-722), is the only submarine on the list — yet the Los Angeles-class sub and its crews have played a historic role in protecting the nation’s interests and freedoms for more than three decades.

Leading up to this weekend’s Key West Veterans Day events, crew members of the USS Key West will make a namesake visit from Guam and participate in Saturday’s parade. Visits to a U.S. Navy namesake are rare, with the last seven years ago.

“This is truly a historical moment,” said Ron Demes, whose accolades and title include site manager for Atlantic Targets & Marine Operations of the Naval Air Warfare Center’s Aircraft Division. “I feel it is important that we make the crew feel at home here in their namesake city.”

Demes said namesake visits don’t come around that often and “it is a great way for us to thank these men and women for their service.” Not to mention, Demes said, “the crew is proud to represent their namesake and they want to experience Key West while they are here.”

Demes has been instrumental in the crew’s visit and itinerary. On Friday, he will accompany the team to Rotary presentations, mayoral visits, a stop at Horace O’Bryant Middle School and Key West High School — along with other meetings. And after the parade, the crew will squeeze in time to view the Superboat Races and a sunset cruise — all before departing on Monday.

Those attending the Key West Veterans Day Parade will have a special opportunity to see the sub’s crew, along with a replica of the USS Key West that was constructed by Demes, Key West City Manager Jim Scholl and former Commanding Officer NAS Key West Captain Pat Lefere in 2011.

“I told the commanding officer (in 2011) if he would come to Key West, I would make a submarine to look like their boat,” said Demes. “He was blown away with the distinct details we put into the submarine. We wanted to reflect the same pride in this project that the crew holds for the Key West namesake.”

One of the distinct details that Demes referenced is the sub’s command emblem. The emblem features a conch shell with Key West emerging from the shell. According to the sub’s Wikipedia page, the shell is “the focal point of the submarine’s emblem for the fabled horn of the Greek God Triton and the symbol of the submarine’s namesake city.”

Along with countless military operations that included Tomahawk missile attacks against Afghanistan immediately following 9/11, the USS Key West was featured in Tom Clancy’s novel “Red Storm Rising” and John Schettler’s novel “Kirov III-Pacific Storm.”
