Florida is one of four states where convicted felons do not regain the right to vote, until and unless a state officer or board restores an individual’s voting rights. In the November election, Florida voters will decide on Amendment 4, which would restore felons’ voting rights (except those of convicted murders or felony sexual offenders) after they have completed the terms of their sentence and probation. While Florida already has a process to do that, only a few applicants have had their rights restored and the process can take years.

Council to consider options for pedestrian crossing KATIE ATKINS

A

fter a bit of backlash in recent months from residents about a potential pedestrian bridge at Founders Park, the village council will revisit another option tonight: pedestrian islands.

What are pedestrian islands, you ask?

They’re small medians used on stretches of road where speeds and traffic volumes make crossing on foot an obstacle at times. Heavy traffic in Islamorada is as common a topic as affordable housing, which is also on tonight’s agenda.

The concept of a permanent pedestrian bridge at Founders Park, MM 87, has been discussed since 2016. Plans were approved earlier this year by the village council, with the bridge set to go up in November 2019 to provide a safe crossing and relieve congestion during events.

The plans could be scrapped, with concrete islands to be discussed separately as a project throughout the village.

“But we’d have to start at the beginning with that,” said Village Manager Seth Lawless.

“The statement that the bridge is for safety of the people crossing is correct, but the bridge costs $3 million and we maintain the elevators and electric,” said Islamorada Mayor Chris Sante, who put the discussion item on the agenda. “A permanent pedestrian island is a very low-cost alternative and can be used throughout Monroe County. This also would cut down on center lane passing.”

Cost has been the No. 1 reason cited by council members and residents against the bridge project.

Islamorada Chamber of Commerce President and real estate agent Joe Young is opposed to the project.

“I am not anti-bridge,” he said. “I just don’t think we need a permanent structure for six days out of the year. It’s a monstrosity in the middle of the scenic highway. Do we want to look at a big bridge that is only used six days out of the year?”

Discussion regarding the village purchasing three lots for affordable housing is also set for tonight.

“I’m looking to see if council wants to purchase more land for housing,” Sante said.

The meeting starts at 5:30 p.m. at the Founders Park Community Center.

he 18th Amendment prohibited the manufacture, transport, export, sale, or possession of alcoholic beverages in the United States. The National Prohibition Act was also known as the Volstead Act. Andrew J. Volstead, a Minnesota Republican and chairman of the House Judiciary Committee, sponsored the legislation written to provide a means to enforce the 18th Amendment. It was passed by Congress on Oct. 28, 1919. When the 18th Amendment went into effect on Jan. 16, 1920, it ushered in a 13-year period known as Prohibition.

In the years that followed, up and down the Atlantic demarcation of the jurisdictional limit of the United States, hundreds of mother ships from Key Largo to New Jersey anchored along an imaginary line outside of territorial limits. It was known as Rum Row. These ships, stocked with liquor, awaited American captains willing to make the run out to international waters to conduct business in the hopes of making it back to shore where they could make a tidy profit.

Back on land, secret (and not so secret) drinking establishments popped up around the country and became known as speakeasies, drums, and blind pigs. One of these was Club Florence located in Key West at 1117 Duval St. Owner Raul Vasquez

allegedly gave his club its particular name because a number of the regulars had wives named Florence. Because Vasquez worked regular hours at a local cigar factory and could not always tend the bar, he kept a marble slab on the bar where customers could tally their drinks. Raul claimed never to have lost a bottle. Not wanting to advertise his illicit business by hanging the regular sign “Club in Rear,” he used gingerbread with the cutouts shaped like liquor bottles and the suits from a deck of playing cards to advertise the availability of booze and gaming on the premises. These days, 1117 Duval St. is home to the Speakeasy Inn. The Blind Pig, another Key West watering hole, operated out of the building at 428 Greene St. Built in 1851, the structure has served as an ice house and city morgue, wireless telegraph station, cigar factory, and bordello. Owner Isaac Wolkowsky rented the building to Joe “Josie” Russell during the Prohibition years for $3 a week. Russell operated the Blind Pig until Dec. 5, 1933, the day Prohibition ended, when he changed the name of his bar to Sloppy Joe’s. He would move the bar to its current location in 1938.

he History of Diving Museum will celebrate its 13th anniversary this October.

The museum is inviting locals of the Florida Keys to dive in by offering a discounted rate on memberships.

All packages will be reduced by $13 through Oct. 31 — a nod to the institution’s 13th anniversary. The standard adult price will be $37 for a single adult membership, $62 for two adults and $137 for a family membership (same household).

Members receive free admission 362 days of the year, and 25 percent discount off additional visitor admissions. Members can reserve seats for the free monthly Immerse Yourself! presentation series on the third Wednesday of every month at 7 p.m.

Having a membership also means discounted rates or free admission for special events throughout the year. And most items in the museum store are discounted 10 percent for members.

The museum has exhibits to interest non-divers, as well.

They focus on topics ranging from marine biology to history to military and local treasure salvage. The featured exhibit changes throughout the year, and currently focuses on the development of technical diving and rebreathers. The whole family can enjoy scavenger hunts, interactive displays and more. The museum is pet-friendly.

Memberships support the museum and its educational outreach program. Throughout the year, the museum works to provide outreach to 4th grade classes throughout the Keys. Staff and volunteers go to the schools to teach, inspire, and foster new ideas about how people interact with the underwater world.

his week, Fish With a Hero is partnering with Project Healing Waters to bring 25 wounded and disabled veterans to Islamorada for two days of guided fishing out of Bass Pro Shops World Wide Sportsman. Activities include offshore and back country fly and bait fishing.

Participants benefit from the curative power of being on the water with other disabled veterans suffering from PTSD and TBI (Traumatic Brain Injury), and other disabilities and wounds of war.

The event is sponsored by Bass Pro Shops, Radco Industries, FreeWheeler Realty and the National Air Traffic Controllers Association. “These 25 heroes have been selected from among the best of over 7,700 participants in Project Healing Waters programs nationwide,” said Captain Mark Gibson, director of Florida Keys operations for Fish with a Hero. ‘I LOVE WHAT I DO’ O Meet Richard Strickland, director of airports

ut of a pool of 97 applicants, Richard Strickland was recently chosen as the No. 1 pick for Monroe County’s new director of airports. The San Diego native will oversee Key West International and the Florida Keys Marathon International airports and replaces Don DeGraw, who resigned in July.

Strickland has a bachelor’s degree in finance, as well as 20 years of experience in airport management at some major airports across the U.S. They include Detroit and San Diego International airports and, most recently, Strickland was director of the Meadows Field Airport in Kern County, California.

What did you want to be when you grew up? A hedge fund manager in New York City.

Who has been your biggest inspiration in life? Probably my dad because of his work ethic and dedication to everything in life.

What’s your goal or vision for the airports? To continue to enhance the air service and the connectivity for Key West and the overall tourism industry.

Favorite place to travel? Copenhagen, Denmark. There are a lot of great spots around the world, but to this day, the nicest people in the world are in Copenhagen.

What do you do in your spare time?

I enjoy watching college football.

If you didn’t have to sleep, what would you do with the extra time?

Probably travel.

What made you want to work in aviation? Different mentors over the course of my career.

For lunch with one famous person, who would you choose, and what would you eat? Ronald Reagan. Probably lobster.

What is your greatest fear? Honestly? Wasps?

Favorite cocktail? Ketel One martini, up, with three olives.

Who are your favorite sports teams?

San Diego State, obviously, but I’ve always liked Notre Dame and the University of Miami.

ordan Budnik has been tapped as the new executive director for the Laura Quinn Wild Bird Sanctuary.

A graduate of Georgia College & State University, Budnik started at the Wild Bird Center in May 2017 as the education coordinator. She most recently served as the assistant executive director.

“She is a talented young woman who multi-tasks beautifully,” said board chair Frank Derfler. “She has infrastructure things to do and at the same time she has to put a lot of emphasis on raising money. Jordan is just the person to do that.”

Budnik says her main focus will be engaging the public and reaching out to new donors.

“The Bird Center is a unique kind of non-profit,” she said. “We are located in a migration pathway. Not only do we have extreme community impact, we also have a great impact on animal populations and bird migrations up into Canada and all the way back down.”

At a recent council meeting, the Village waived more than $25,000 in code fines for a hurricane-damaged property owner. How would you have voted and what would your comments have been?

Ralph De Palma (D): I am a licensed commercial pilot and hold airframe and power plant certificates, worked on the Space Shuttle. Drone use is being tested for surveillance and some minimal treatment activities. But are in the very early stages. FKMCD will need to replace old airframes soon. I can help guide those procurements.

Phil Goodman* (R): For the past four years we have used two small drones, within restricted limits. Numerous governmental regulations currently prevent us from expanding use. We will always have large areas to chemically treat that require the new, larger aircraft. I agree. The key word in Code Compliance is compliance. We want the property to come into compliance, not to ring up excessive fees that are impossible to pay. And we do have to collect administrative fees such as investigatory time and special master costs.

There is an old saying, “What’s good for one is good for all.” There was a case where a motel owner owed a large amount of money due to fire department regulations. The motel was sold and the fees were waived on the property because the new owner resolved all the issues, which I thought was fair.

Yes, I would have waived. I was present for the meeting and heard the facts first hand. The issue was hurricane debris on a vacant lot and Code Enforcement was a bit aggressive. The fines should never have been given in the first place.

Code enforcement is in place to protect homeowners and property value. Exceptions can be made in emergency situations provided the violations do not affect other home values. This is the purpose of the appeal process and must be taken on a case-by-case basis.

n a little more than five years, new development will come to a grinding halt in the Florida Keys. At least, that is what the State of Florida has decreed for the islands it has designated an “Area of Critical Concern.” Beginning in 2023, it will no longer issue new building permits for Keys municipalities.

None. Zilch. Zip. Nada. If this comes to pass, what happens next? Will landowners sue because the state (and local governments) is gutting the value of their investment by preventing them from building their dream home on their vacant lot? Will that raise taxes?

What will happen to real estate values?

Will builders be out of business? The ramifications are wide and far-reaching. The future starts now.

ack in 1972, Florida initiated a statewide planning and growth management law that required each county to create a “Comprehensive Plan” for land use management and to accommodate the fast population growth Florida was experiencing.

In the 1960s and 70s, the Florida Keys had become infamous for rampant drug smuggling and ineffective government.

Local Keys government appeared to accommodate both smuggling and unrestrained development. One of the issues that brought the development issue to state attention was a 1972 plan to build three high-rise apartment buildings in Marathon, which led to a well-publicized campaign for “No high-rise in the Keys.” As a result of the public outcry, only one tower was built (Bonefish Towers) but development in the Keys was now on the state’s radar. Because of the Keys’ unique environment, and the risk to America’s only living reef, environmental organizations such as Friends of the Everglades, 1000 Friends of Florida and local activists such as George and Mary Barley in Islamorada lobbied the state to do more to protect the Keys from overdevelopment and inadequate governance.

Locals are very used to living in an “Area of Critical Concern” — it’s as normal as sliced bread. But there are only five such areas in Florida — City of Apalachicola, City of Key West and the Florida Keys (counted separately), The Green Swamp, and The Big Cypress Swamp. In Apalachicola, the area measures about 12 city blocks by 13 city blocks. The Green Swamp and Big Cypress Swamps are very sparsely populated. While there are environmental stipulations that come with this designation, it only has one purpose: “to guide local government growth and development decisions related to local comprehensive plans and land development regulations.”

comprehensive plan. (Under Gov. Rick Scott, the Department of Community Affairs morphed into the Department of Economic Opportunity.)

In 1992, the state required the county commission to pass a Rate of Growth Ordinance (ROGO), which severely limited the number of buildings to be built in the Keys. No further development permits would be allowed. This restriction was based on the state’s evaluation of the limited resources available within the Keys, and most importantly, the state’s determination that the restrictions imposed by ROGO would allow all residents of the Keys to evacuate within 24 hours in the event of a major hurricane. That evacuation model has been the primary rationale for restricting growth in the Florida Keys.

But why 2023? How did we arrive at that expiration date? Well, in 2012, the state and Keys municipalities came together to determine how many more building rights could be given out before the hurricane evacuation model reached “capacity.” At that meeting, it was determined that there was “one hour” of evacuation time left, or equal to the time it would take an extra 3,550 households to evacuate. The 3,550 permits were split among the county (with the lion’s share), Key West, Islamorada, Marathon, etc. The entities then identified a rate at which they would dole out the building allocations … which brings us to 2023.

There is no firm count on how many lots are still undeveloped in the Keys. Some put the number at about 3,500; others, as high as 10,000. The concern is that in 2023, there will be many, many property owners suing the county and the cities for compensation for the “taking” of their right to develop their property. At today’s property values, such a liability is far beyond the local governments’ ability to pay. That threat is perceived as a financial Armageddon by Keys governments.

“Back in the ’80s I think we estimated that it would cost $1 billion (to purchase the lots without allocations) that would be paid by the federal, state and local governments. It was too big a number to focus on. But looking back, and seeing what happened with sewage treatment, it could have been possible,” said Pattison, referring to the high cost of sewering the Keys.

In the mid-’80s, the Keys became a guinea pig of growth management, required to come up with a growth management plan long before it was required of other counties. Now, in 2023, the Keys will once again be first to test the “no new development” waters.

In response, in 1974, the state decreed the Florida Keys an “Area of Critical Concern.” (Key West’s separate Area of Critical Concern designation would come later.) In 1979, the state passed “Principles for Guiding Development” for the Florida Keys. The state took over the previously local responsibility for land management and development oversight. In real effect, all development in the Keys would be run by the state until the state had confidence that local governments could be trusted to protect the valuable resource of the Keys. That lack of confidence was not misplaced. Back in the 1980s, the City of Key West was dumping 6 million gallons of raw sewage into the ocean every day. In 1980, Monroe County approved Port Bougainville – a 2,800-unit development on 406 acres in the Upper Keys.

In 1982, a countywide election put new progressive leaders in the judiciary, state attorney, public defender, and county commission seats. A proposed comprehensive plan was presented at public hearings throughout the Keys, and in 1986 a new county commission passed the county’s first Comprehensive Plan and Land Use Regulations.

The plan evolved over 88 meetings — every single one of them attended

by Ed Swift, then a 31-year-old newly elected county commissioner appointed as liaison.

“I’m not sure why the hell that happened,” said Swift. The gargantuan task was accompanied by much opposition, including that of former state Rep. Joe Allen, who encouraged Keys residents to fight back against the state. Tensions were high at the meetings, and a report in a 1986 issue of Florida Trend magazine said an audience member at a public hearing tried to attack a speaker with a knife.

“I don’t remember that,” Swift said, “but I was at plenty of meetings where people shook their fists and shouted.”

In 1983, Charles Pattison was a Keys field agent for the state Department of Community Affairs, charged with overseeing Keys development.

(He is now director of Monroe County Land Authority.)

“The early days were contentious.

Anything the county did had to be approved by DCA,” he said.

The state and the county began cooperating in land use decisions, and the state slowly transferred more responsibility to local government but retained overall control over development in the Keys. For example, in order to build, a developer must meet a number of state-mandated requirements regarding open space, size of the building, etc. However, the state Department of Economic Opportunity must still approve changes to the

What does “a good education” mean to you? A “good education” to me is an interactive learning environment with teachers that care more about the students’ well being than whether or not they read the assigned chapters.

What is the dumbest rule at school? The best? The “no Birkenstocks allowed” rule – dumb. The best rule is probably that seniors are allowed to wear a sweatshirt from the university into which they got accepted.

What is something you know now that you didn’t know when you were a freshman? That when Mr. Calderwood says, “Don’t overload yourself senior year,” for once he was right.

What organizations and activities are you involved with at ICS and why are they important to you?

Student body president, Interact officer, class officer, INC Club, Key Club, scorekeeper for volleyball and softball.

These organizations and activities have all prepared me for life after high school and the importance of learning how to roll with the punches.

What are your plans after high school? I will be attending University of North Florida with a degree in communications (as of right now).

‘GULF’ AUTHOR TO SPEAK IN KEY WEST

A

s enormous as its subject, the Pulitzer prizewinning book “Gulf - The Making of the American Sea” by Jack E. Davis, is the first comprehensive, incisively written history about Florida’s backyard, the Gulf of Mexico. Davis presents the Gulf, a natural extension of the southern United States, as an invaluable geographical component of the country as well as a distinct marker of American history and its economic rise.

The heart of the book is about the relationship between nature and the shaping of America. Coming to Books and Books at The Studios of Key West on Friday, Oct. 5, author Jack E. Davis will speak on his extraordinary portrait of what he calls “America’s Sea” and its inarguable importance to the culture, past and future of America.

Davis has turned the Gulf’s history into a very thoughtful and well-researched story. “Gulf” is a comprehensive and sensitively written history of the 900-mile wide stretch of water, from the Pleistocene period to the present. ELECTION TO EDUCATION Unused campaign funds help school

T

he Rotary Club of Key Largo has donated $1,000 to help provide free child care for 4and 5-year-olds at Key Largo

School.

The funds were a pass-through donation of unused campaign contributions from newly-elected school board member Sue Woltanski, who ran unopposed for District 5 of the Monroe County School Board and will assume office in November.

“High quality childcare is scarce in the Upper Keys and I believe this program fills a vital need in our community,” Woltanski said. “The state only funds three hours per day but extended before- and after-care hours at Key Largo School are a great example of a school serving its community’s needs.”

The voluntary Head Start program, also available in Marathon and two Key West locations, is open to children from low-income families who are not yet old enough for kindergarten. It gives them a jump start

at school success with pre-reading, pre-math, language and social skills.

“It was our honor to assist Sue in making her donation happen by way of our charitable foundation,” said Key Largo Rotary president Jennifer McComb.”

Key Largo School is close to our hearts and we’ve provided ongoing support to its programs for many years.”

The Rotary Club of Key Largo donates a brand new book to the school library every week, selected from the teachers’ wish list and signed by a guest speaker. n the last six weeks, Hurricane Irma marine debris removal throughout the Keys has been ahead of schedule – so ahead of schedule that another 41 canals have been added to the laundry list.

Adventure Environmental Inc. the lead contractor on the multi-million dollar cleanup project with Monroe County, has until March 2019 to bring the waterlogged debris to the surface.

During a discussion at the Sept. 19 meeting of the Board of County Commissioners, Adventure director Greg Tolpin said crews are 22 percent of the way through.

That leaves more time to clean an additional 41 canals, with 15 in Key Largo, 16 in Islamorada and 10 in Marathon.

“This is to stretch the existing $49 million grant further,” said Rhonda Haag, county sustainability director. “In some of the canals, there’s not a lot, so there is a diving team on each boat and they’re using the divers to get the stuff on the bottom.”

If there were no new canals added to the list, Adventure would still meet the clearing deadline by January for all 103 canals.

So far, 29 have been cleared, Haag said. Among the estimated 59,281 cubic yards of debris in all canals, about 12,000 has been collected, Tolpin said.

The debris includes a car and a minivan that were removed from a canal on Big Pine Key this week.

Adventure Environmental and subcontractor Arnold’s Towing of Stock Island have a combined workforce of about 60 people committed to the project using four grapple trucks, five sonar boats and 15 barges specifically built to perform in the Keys environment. Wood Environment and Infrastructure Solutions Inc. is monitoring the work.

The hurricane marine debris is being taken to nearby sites before being hauled to Homestead for proper disposal.

ive days after Hurricane Irma rolled over the Lower and Middle Keys, a semi-truck overloaded with relief supplies was trailered to the Keys by seven members of the Swansboro Rotary Club.

“That’s what Rotarians are for,” texted Swansboro Rotarian Justin Cleve.

Earlier this week, the Upper Keys Rotary Club returned the favor, when Don Horton and Carla Bahn hauled a trailer full of supplies north to their club.

“Man, it was great. Everyone was so happy,” Cleve told the Weekly. “It was a feeling you couldn’t explain. We are getting supplies and they are going as fast as they come in. It was great to unite with him and complete the Rotary circle.”

Once Horton and Bahn arrived at the distribution center, they were impressed by its organization. Victims fill out a simple form when they arrive, describing their current water/electric

situation and how many people and pets are in the home. Teenagers, unable to return to their school because it is being used as a shelter, grab all the necessary supplies and load them into the trunk of the car. Those receiving assistance never leave their car.

“What a great group of people. It’s all working and fishing people — just like us in the Keys,” said Don Horton.

Horton said it took about 15 hours to get from the Keys to Swansboro, but they were slowed coming home due to flooded roads and detours. With so much of the area still under water, the road to recovery is long and donations are still very much needed.

Tarps, fans, dehumidifiers, nonperishable foods like pasta and sauces, baby food, diapers and cleaning supplies top the list. Those wishing to support the survivors financially can send their checks to the Swansboro Rotary Foundation, P.O. Box 1851, Swansboro, NC 28584. Local folks may want to simply send their donations to the Upper Keys Rotary Club.

Horton and Bahn said the Rotarians have invited them back for an oyster festival in March.

“And we will be there,” he said.

State gets $616 million for Rebuild Florida

tate level officials joined locals for the kick off of the Rebuild Florida program. The first phase of Rebuild Florida is the Housing Repair Program, which will assist families to rebuild their homes that were damaged or destroyed by Hurricane Irma. The program will distribute $616 million across the state of Florida, funds that came from the federal Housing and Urban Development Department (HUD). Rebuild Florida will be administered by the state Department of Economic Opportunity.

• Beginning Monday, Oct. 1, the program will roll out mobile offices — buses — that travel to the most affected areas. The schedule will be on the website (above).

What sets this program apart is that it cuts out the middleman, so to speak. Residents who are eligible, and approved for the award, will have contractors and laborers sent directly to the damaged home; homeowners will not select their own contractors. It’s open to homeowners and landlords of properties that are rented at affordable rates. That includes repairs to, reconstruction or replacement of homes, including bringing the home into code compliance and providing resiliency for future storms.

It also covers completion of work to homes that have been partially repaired, and repair or replacement of manufactured and mobile homes.

The program is designed to help the most vulnerable — the elderly, people with disabilities and families with very young children. There are also income requirements and participants must earn less than or equal to 80 percent of annual median income — in the Keys, that’s $73,500 for a family of four.

KEYS BREWS GET HIGH Florida Keys Brewing showcases at Colorado beer festival

merry band of bearded and tie-dyed brewers from the Florida Keys Brewing Co. just returned from a cross-country adventure, sharing their brews at the Great American Beer Festival in Denver, Colorado.

“I don’t think anyone had as much fun as us,” said Brewing Co. proprietor Cheryl McBay. Two members of the brewery drove the tied-dyed beer van more than 1,700 miles to the festival.

Although the brewery didn’t bring home any medals, “We were ecstatic just to be invited,” said McBay. The three-day festival hosted more than 800 craft breweries from across the country, with an attendance of some 62,000 people.

“We were the brightest and happiest booth and had a line the entire time,” McBay added.

“We learned a lot and look forward to next year when we can bring some awards back home.”

“So we started down that path and then the opportunity came to buy this place. We’ve owned it since April,” Turner said.

Sena-Hopkins has known Midway Cafe since he was a teenager, through visits with family.

“It was almost too good to be true. It’s great for locals and for visitors, and seemed like the perfect fit for us,” Turner said.
