n open hearing is set today for Christine Blasey Ford, the Palo Alto University professor who has accused Supreme Court nominee Brett Kavanaugh of sexually assaulting her in high school, to testify. She’ll be followed by testimony from Kavanaugh. Both Ford and Deborah Ramirez, a former Yale classmate of Kavanaugh’s who accuses him of sexual misconduct, want an FBI investigation. So the Weekly asked…

Do you believe the allegations against Brett Kavanaugh or is it suspicious timing?* “Yes, I believe the allegations are true,” said Jerry Volduc of Key West.

“No, I don’t believe the allegations at all and I’m pissed about this whole thing,” said Zaira Sepulveda. “(Ford) doesn’t remember where it happened or what party she was at? It’s ridiculous.”

It’s hard to muster enthusiasm for a root canal, but it’s a necessary evil. That’s what residents of Stock Island and Key West will have to accept with the upcoming Cow Key Channel project, due to start in February 2020.

Still shaking off the repercussions of the North Roosevelt renovation as well as Hurricane Irma, it’s hard not to be pessimistic. But the good news is that FDOT, the city and county are listening and addressing concerns.

What is indisputable is the Cow Key bridges are in critical condition.

“I’ve seen the pictures,” said Greg Veliz, Key West assistant city manager.

“We have a responsibility to make the bridges better for public safety but the inconvenience will be much larger than the North Roosevelt project. It’s a small bridge but our only bridge that all roads lead to in and out. I think FDOT is finally grasping the gravity of the situation.”

While bridges are built for a 50year lifespan, the northbound bridge dates back only to 1978 and the southbound bridge to 1985. Salt water from wave runners and the bridges’ proximity to the water has corroded bands 2, 3, and 4 and made both bridges structurally unsound, according to FDOT Maintenance Project Administrator Josh Keyser. inspected every two years but these bridges have been on a one-year cycle leading up to this decision. FDOT ’s initial proposal is a 16- to 20-month, $3.2 million renovation wherein one bridge will be closed at a time, leaving only one lane open in either direction.

“It should be noted the time period 16-20 months is a worst case scenario; it may not be that long,” said Keyser.

“All the repair plans have not been finalized.”

Furthermore, in order to help consolidate traffic, College Road will only be open at the north end, resulting in one way in and out to the hospital, college, jail, golf course and other sites.

“There are so many concerns — where to start?” said Virginia Panico, executive vice president of the Key West Chamber of Commerce, who attended FDOT’s first open meeting on Sept. 20.

Panico questioned the timing of a traffic study, which FDOT has yet to do.

“We really listened, and now we are adjusting the plans when to do the study during Fantasy Fest and peak traffic times, not now in September, ” said Keyser.

“Our absolute number one priority is ambulances and fire trucks; we cannot go forward without a plan for emergency vehicles to cross without obstruction,” said Veliz. Keyser said there would be room on the shoulder of each bridge for emergency traffic.

Also concerning to Panico is the February start time, the height of tourist season and traffic. “The start date doesn’t necessarily mean when we break ground; we are looking at maybe May and have it affect slower seasons,” said Keyser.

“Businesses are barely hanging on after Irma,” said Panico. “Time is money and when company workers are spending more than an hour a day in traffic, jobs are not going to get done.

Everyone will pay because there will be overtime.” She has also asked about a temporary bridge and proposed staggering work and school times. Panico plans on contacting state representatives and senators for additional funding to work 24/7 and possibly be done with construction in half the time. Veliz is in favor of the idea.

Greg Sullivan, senior district manager for Waste Management, said his trucks run more than 100 daily trips through the U.S. 1 and Roosevelt intersection.“I think we need a pedestrian crosswalk at the triangle and one continuous green light coming into town that only allows a right hand turn,” said Sullivan. “And leaving town, there would be no immediate left turn onto College Road. Instead, College Road would only be accessible through a new red light at the northern entrance.”

Keyser appreciated the feedback from Panico and Sullivan. FDOT plans on having more meetings for public input.

MONROE COUNTY COMMISSION MOSQUITO CONTROL DISTRICT The board recently approved the purchase of two helicopters for $3.6 million. Why not drones?

Ralph De Palma (D): I am a licensed commercial pilot and hold airframe and power plant certificates, worked on the Space Shuttle.

Drone use is being tested for surveillance and some minimal treatment activities. But are in the very early stages. FKMCD will need to replace old airframes soon. I can help guide those procurements.

Phil Goodman* (R): For the past four years we have used two small drones, within restricted limits. Numerous governmental regulations currently prevent us from expanding use. We will always have large areas to chemically treat that require the new, larger aircraft. Before other aircraft are replaced, drones could be a real game changer.

How do you balance the Upper Keys residents’ tourism fatigue — with more daytrippers and traffic jams — and the appetite for the tourist dollar in the Middle Keys and Key West?

DISTRICT 2 Michelle Coldiron (R) Tourism needs, traffic snarls and quality of life issues matter Keys-wide.

Let’s form a Keys Sustainable Coalition with stakeholders from tourism, businesses, neighborhood associations and government. We’ll brainstorm solutions such as expanded mass transit or establishing ferries and area trolleys to reduce the number of cars on the road.

Tommy Ryan (D) I don’t believe it’s only the Upper Keys that deals with tourism fatigue. Perhaps the TDC could use brick-and-mortar funds to address the issue, such as more bus service from mainland airports. The county and municipalities could join together to get a mass transit system working. Let’s look to others and see what worked.

DISTRICT 4 David Rice* (R) Tourism fatigue can be expressed in terms of too many cars, too little highway.Potential solutions are: 1.

Placement of temporary housing for emergency relief workers. Many are commuting daily from Broward and Dade. 2. Greatly enhanced improvements in public transportation for both workers and tourists. 3. Place a toll on U.S.1.

Vicki Tashjian (No party) This is a difficult issue that has increased over time. Explore options for mass transit and include positive advertising to get off the road. Another issue is the day-trippers that bring boats, especially in the Upper Keys. I think about this often. The over use damages the environment, but we do not want to restrict our own use.

‘SCRATCHING THE SURFACE’

NEW HOUSING AT SUNSET MARINA NEARS COMPLETION

B

ob Pabian has the right attitude: to every problem there is a solution. He accepts the solution may not be perfect at times, but at least it should be a step in the right direction.

Pabian is a housing developer and owner of Pabian Properties of The Keys, and he is passionate about improving the housing situation in the Lower Keys.

Back in 2016, Pabian lobbied for a 60unit apartment project at the waterfront Sunset Marina on Stock Island; some argued it didn’t provide enough affordable housing, but others such as Mayor Craig Cates threw their support behind it. Now, as of this month, the final inspections are being made on the complex and it’s providing muchneeded housing. The project was delayed seven months due to Irma and should have

1 been completed a year from its start date, but as promised, the complex has provided 38 new workforce units and 22 market rate units.

Its completion and relatively fast turnaround can be a road map for other developments, Pabian said. Pabian has been building homes and complexes from here to Marathon for the past 20 years. He has a good formula of using modular homes built by the Palm Harbor company that are inspected and registered in the State of Florida, built to code and to withstand 180mph winds with impact-resistant doors and windows. Pabian Properties then hires local contractors for building, A/C, sewer, etc. to get the units up and running. The result is 60 units that are 800 square feet each with 2 bedrooms and 2 baths, a shared pool, gym,

and even dog area on the grounds. The complex is not only pretty but solid; in 21 years, Pabian Properties hasn’t lost a single home due to a storm.

“Yes, we can do better for low income housing. We are about 40 years behind the curve here in Key West and just scratching the surface,” said Pabian. “But we need housing no matter what kind.” The more affordable Sunset Marina Apartments at $1,500 a month went first, and now they have market rate units left, ranging between $2,709 to $2,900. Pabian acknowledges it’s not affordable for everyone but in order to build such housing there is a bottom line.

“To get truly affordable we need $800 a month and that’s a numbers game. We need to be looking at such things like private money, government funding and tax credits.

I believe we have the brain power in Key West to make housing happen,” said Pabian, who fell in love with Key West on his first visit and does not want to see the lower income workers pushed out. “We have to involve a diversity of people from government, developers, to the school board to put our heads together to make it work.” Pabian believes the right city commission is in place to go forward with more ideas.

Cates, who will be cutting the ribbon on the apartments in October, said, “The combination of affordable and market rates are needed to build. These units are beautiful, brand new, structurally sound for hurricanes and you can’t get as much for the same price elsewhere. Right now, every little piece helps.” Cates looks forward to breaking ground on 104 units up College Road in December.

he 18th Amendment prohibited the manufacture, transport, export, sale, or possession of alcoholic beverages in the United States. The National Prohibition Act was also known as the Volstead Act. Andrew J. Volstead, a Minnesota Republican and chairman of the House Judiciary Committee, sponsored the legislation written to provide a means to enforce the 18th Amendment. It was passed by Congress on Oct. 28, 1919. When the 18th Amendment went into effect on Jan. 16, 1920, it ushered in a 13-year period known as Prohibition.

In the years that followed, up and down the Atlantic demarcation of the jurisdictional limit of the United States, hundreds of mother ships from Key Largo to New Jersey anchored along an imaginary line outside of territorial limits. It was known as Rum Row. These ships, stocked with liquor, awaited American captains willing to make the run out to international waters to conduct business in the hopes of making it back to shore where they could make a tidy profit.

Back on land, secret (and not so secret) drinking establishments popped up around the country and became known as speakeasies, drums, and blind pigs. One of these was Club Florence located in Key West at 1117 Duval St. Owner Raul Vasquez allegedly gave his club its particular

name because a number of the regulars had wives named Florence. Because Vasquez worked regular hours at a local cigar factory and could not always tend the bar, he kept a marble slab on the bar where customers could tally their drinks. Raul claimed never to have lost a bottle. Not wanting to advertise his illicit business by hanging the regular sign “Club in Rear,” he used gingerbread with the cutouts shaped like liquor bottles and the suits from a deck of playing cards to advertise the availability of booze and gaming on the premises. These days, 1117 Duval St. is home to the Speakeasy Inn. The Blind Pig, another Key West watering hole, operated out of the building at 428 Greene St. Built in 1851, the structure has served as an ice house and city morgue, wireless telegraph station, cigar factory, and bordello. Owner Isaac Wolkowsky rented the building to Joe “Josie” Russell during the Prohibition years for $3 a week. Russell operated the Blind Pig until Dec. 5, 1933, the day Prohibition ended, when he changed the name of his bar to Sloppy Joe’s. He would move the bar to its current location in 1938.

JASON BEEMAN — BANKER, CONCH — REFLECTS ON THE LIFE AND TIMES

B

y way of the Bahamas generations ago, Jason Beeman is a born-andraised sixth-generation Conch. With a deep love of Conch baseball in his veins, he isn’t joking when he says he has 48 first cousins from Key West on his mother’s side.

The vice president of lending and credit services at Keys Federal Credit Union and graduate of Florida State University with a business management degree, he’s been a member of “THE” Rotary Club of Key West for more than 10 years, and is a former board member of Key West Chamber of Commerce.

But, his heart is in the city’s baseball leagues, where he’s been coaching since 2003.

A graduate of Key West High School – “We are cool, we are fine, we’re the Class of ’89” – he prides himself in raising his Conch kids. He has three sons, Jacob, 22, Caleb, 17, and Joseph, 13, and daughter Ella, 18 months old. His sons are very good ballplayers. Jacob played for the Conchs until breaking his collarbone while on a snowboarding trip. Caleb is a senior at KWHS and has chosen the path of music production, and Joseph “Jojo” is in eighth grade and a second baseman. “We’ll see if he decides to continue on in high school,” he said. As for Ella, he’s guessing girls’ softball and ballet in a few years.

So, The Weekly asked him a couple questions to get to know him a little better.

One fun fact about you? I’m WAY funnier that you think.

What’s the most rewarding project you’ve worked on?

Tricking my wife, Jana, into marrying me.

Working in the loan industry, what has surprised you about 2018? Americans are still in a borrowing mood, and our total tab for consumer debt could hit a record $4 trillion by the end of 2018.

How did Hurricane Irma affect this year’s outlook? At Keys Federal, we really went out of our way to help our community as much as we could, giving very low rate “disaster recovery” loans almost immediately to help people start getting back on their feet. We also shifted gears, trying to help members work through insurance claims on their homes and vehicles.

What does success look like?

Being able to live and work in my hometown, having a happy and healthy family, and being able to share that experience with my lifelong friends from here that are doing the same.

What do you think your grandmother would consider the biggest changes in Key West? My grandmother, Elize Roberts, would find it crazy that we can’t catch jewfish (goliath grouper) or conch any more.

She would also think that there aren’t enough “Key West families” left here, since a good number have exited in the last 10-15 years.

Proudest achievement? While serving in the U.S. Army during my younger years, I got the chance to shake hands with one of my heroes, Colin Powell.

What was your first job? I worked for Benny and Gilda Fernandez at Key West Chemical while in high school.

When you’re at work, what are you really wishing you were doing? On the kitchen floor playing with my 18-month old daughter, Ella.

Dream meal: you are sitting at a diner counter eating … who walks in and sits next to you?

My mom, and we eat real conch fritters and drink an ice-cold beer.

Favorite Keysy thing to do?

Taking my boys out to dive the reef.

Which TV or movie character is your alter ego? Jimmy Conway from “Goodfellas.”

What would your superpower be? Fix stupid.

Best piece of advice you ever received? If you are the smartest person in the room, you are in the wrong room.

What is your nerdiest passion?

Is karaoke nerdy?

If you could take one item on a deserted island, what? why?

Cell phone. Duh. Favorite guilty pleasure? Golf. I mean … shopping with my wife.

If you won the lottery, what’s the first thing you do/buy? I would buy my in-laws a home in London where my wife’s sisters’ family lives and a home here in Key West, so they can spend more time with their grandchildren.

What’s on your bucket list?

Become a pilot.

If you could change the world, what would you do? I would, somehow, try to bridge the gap between the ultra-wealthy and the poverty-stricken groups.

Favorite place you’ve traveled to? I’ve always had a special place in my heart for Punta Cana, Dominican Republic.

What did you want to be when you grew up? Starting pitcher for the Atlanta Braves, hands down.

THE STUDIOS OF KEY WEST The Studios of Key West is a multidisciplinary presenter, arts center, and artist residency provider. The Studios sheltered 20 people during Hurricane Irma and became a national media communications hub in the days following. It provided housing for displaced artists and schoolteachers and hosted a concert that raised $20,000 for relief efforts.

ept. 21 was National POW/MIA Recognition Day, a time to remember “the sacred obligation to never leave those behind,” said guest speaker RDML Stephanie Keck, USN. Longtime local resident U.S. Navy Lt. Raymond L. Blazevic (RET) was honored with a plaque for his service and capture as a Korean War POW from 1951-1953. Shot down over North Korea, Blazevic, a radar operator, survived his capture and even went on to fight in the Vietnam War before retiring to Key West and raising his family here.

PROTECT FLORIDA DOLPHINS FROM ANOTHER SPILL

D

olphins are everything to me.

I respect them as intelligent creatures in the wild, and I rely on dolphins being healthy and happy in their natural habitat to make a living. My local business, Dolphin Safari Charters, can only thrive while pods continue swimming and playing among the Keys, which is why I’m outraged at the Trump administration’s recent plans to bring oil drilling to our waters.

Oil and dolphins don’t mix. Past disasters are proof that oil exposure has dire consequences for marine mammals.

When BP’s Deepwater Horizon rig exploded in 2010, more than 200 million gallons of oil gushed into the Gulf of Mexico over the course of 87 days. Spreading slicks, as well as the harmful chemical dispersants used to clean up the spill, had enormously negative impacts on marine life throughout the region.

Because they must surface to breathe, dolphins are at high risk of direct contact with spilled oil.

Additionally, large mammals like dolphins and whales are particularly vulnerable to accumulating toxic chemicals in their tissue — this buildup can damage DNA and poses long-term, even intergenerational effects in these top predators.

So many whales and dolphins died following the Gulf spill that the government dubbed it an “unusual mortality event” with oil exposure as the root cause of these deaths. In the most heavily oiled parts of the Gulf, dolphins developed lung disease at rates five times higher than average.

Dolphins got too skinny

and lost their teeth. Gulping down or inhaling oil resulted in adrenal gland and lung lesions. Even several years afterwards, bottlenose dolphins struggled to give birth to healthy calves.

The damage that the explosion caused to Gulf ecosystems is deeply troubling. Hundreds of dolphins call Key West waters home, and I couldn’t bear to watch those numbers dwindle.

If the toxic impacts of a spill struck dolphin populations here, there would be no reason to take people out on my charters. People don’t pay to see sick or stranded dolphins.

Drilling even closer to Florida’s coastline is just asking for another disaster like Deepwater Horizon — one that coastal businesses like mine cannot afford. A spill would affect hardworking Americans throughout the entire state. Healthy ocean resources along Florida’s coast support nearly 610,000 jobs and provide roughly $37.4 billion in GDP through tourism, fishing and recreation industries.

We could forfeit this major economic driver if we industrialize our beaches with leaky pipelines and scatter our horizon with oil rigs. I could lose my business if oil began washing up on our shores. Florida business owners and coastal residents oppose new offshore drilling. The federal government should take notice and reverse course on this reckless proposal to drill in our waters.

DUVAL DECISION HURT BUSINESS, LOCALS, TOURISTS

H

ere are my thoughts about this year’s Poker Run and how we arrived here: The decision by City Management to close Duval Street and place barricades was not good — not good for business, not good for locals and not good for tourists. But, this was not a decision made by the City Commission and was not made under the best of circumstances. I will explain.

In 2016, the Sunrise Rotary Club (the group that managed the Poker Run in Key West for many years) announced that it would no longer take part in the event. The organizer announced that he approached many local non-profit groups and none would agree to manage it. Also, during the 2016 Poker Run, there was a violent incident at a local bar involving known motorcycle gang members. Law enforcement intelligence and local agencies reported a significant increase in motorcycle gang activity nationwide and specifically in Florida.

In 2017, the City Commission voted to approve the Poker Run event after the organizer submitted an incomplete application months late (historically the application is submitted 6 months prior to the event and required by City Code Section 6-58). This event has been successful over many decades.

The relationship between the Poker Run organizer and the City had been very good for many years. Dozens of groups that hold festivals or events in Key West submit applications each year which include street closure requirements, security, recycling and liability insurance. Previous Poker Runs provided the necessary application and insurance in advance of the event which were regularly approved by the City Commission including my vote in approval of the event in 2016.

The 2017 Poker Run was approved by the City Commis-

sion despite the application being submitted months late, having no local management team in place, and making no apparent efforts to mitigate motorcycle gang participation in the Poker Run. A simple message that gang colors are not welcome at this event should be included in advertising the event (and it appears that no such message [was] conveyed yet again in 2018).

Public Safety should be our first concern.

In 2018, the City Commission did not vote on any item regarding the Poker Run; this is because no application for the event was submitted to the City. I learned about the barricades on Sunday morning and I immediately called City Management. I asked that they be removed as soon as possible.

My experience is that all of the members of the City Commission are pro-business.

We have not raised taxes (now four years in a row that I have been a member of the commission). I have many friends and clients who own, operate or work businesses in the Duval Street commercial corridor.

I do not like to see the loss of business for anyone and I will repeat that the decision to block Duval Street was not one I would have made.

The City’s response in my opinion was a mistake caused by a lack of coordination with the organizer. The City of Key West needs to work out a compromise with the organizer of future Poker Run events whereby there are the appropriate agreements in place for an orderly, safe and fun event.

I know that the City Management will make this a priority going forward especially in light of what was experienced [that] weekend.

The center is open Monday through Saturday from 9 a.m. to 5 p.m. Bring identification.

• Beginning Monday, Oct. 1, the program will roll out mobile offices — buses — that travel to the most affected areas. The schedule will be on the website (above).

What sets this program apart is that it cuts out the middleman, so to speak. Residents who are eligible, and approved for the award, will have contractors and laborers sent directly to the damaged home; homeowners will not select their own contractors. It’s open to homeowners and landlords of properties that are rented at affordable rates. That includes repairs to, reconstruction or replacement of homes, including bringing the home into code compliance and providing resiliency for future storms.

It also covers completion of work to homes that have been partially repaired, and repair or replacement of manufactured and mobile homes.

The program is designed to help the most vulnerable — the elderly, people with disabilities and families with very young children. There are also income requirements and participants must earn less than or equal to 80 percent of annual median income — in the Keys, that’s $73,500 for a family of four.

“Preservation is not control – just the opposite. It means managing our own behavior, not nature’s,” ends Davis. “It means letting go, allowing nature to find its resonating beat. … We should abandon the impulse to lead and instead follow, holding ourselves to the precept that nature takes better care of itself than do humans.”

Weeks after Hurricane Irma passed, she was running a Facebook group and gathering locals to clean up the mangroves around the island chain. In the spirit of Baker, who was friends with the late Jose Wejebe, a well-known and well-loved fishing guide and “Spanish Fly” creator, his daughter Krissy Wejebe-Moloney, who runs his namesake memorial foundation, picked up on the continuation of the cleanups.

In partnership with ACT-2, a veteran non-profit located in South Florida, the Jose Wejebe Spanish Fly Memorial Foundation worked with Monroe County to identify the areas that were still in need of hurricane debris removal.

“The foundation decided to switch gears for the time being,” said WejebeMoloney. “After Irma, we still wanted to remain active even though a lot of the fishing guides were hit financially — we didn’t want to burden their time.” The foundation, which has a mission of making fishing dreams come true, is still staying true to its roots by hosting

the veterans who are coming down to help clean and then taking the hard workers out to enjoy a day on the water.

Edwin Vasco is a family friend of Wejebe-Moloney. As a veteran who fished with the foundation five years ago, he created the nonprofit ACT-2 to help other veterans feel the joy he got after helping rebuild communities following Harvey, Irma, Maria and now in North Carolina.

“It is an unforgettable life-changing experience,” said Vasco, who was inspired by Wejebe-Moloney. “Veterans are always willing to put time and knowledge into helping others.”

Since Sept. 7, Wejebe-Moloney has been hosting the Act 2 veterans on the weekends, where along with the help of locals like the Conch Republic Marine Army and Baker, they have pulled more than 50,000 pounds of trash from the mangroves in the past couple weeks alone. An especially hard-hit area, U.S.1 on Big Pine Key “behind the fences,” was their first spot. “There is so much we just can’t get to,” she said.

“But every little bit helps.”

roofs, a baby crib, and more lobster buoys than anyone can count.

Baker, who helped create the #fishforjose tag, feels the movement is growing, adding #pickupforjose to the online repertoire.

“My dad always stopped the boat to pick trash out of the water,” said Wejebe-Moloney. “While he’d be talking on the phone, he’d be grabbing trash out of the seaweed on his property when I was a kid. That stuff just sticks with you.”

‘WHAT THE FORK?’ SILVERWARE WITH A TWIST

ira Tocco is a well-known Lower Keys real estate agent, but what some don’t know is that her interests in metal manipulation has sparked a new passion in her heart. “I love real estate,” she said. “But, this is a whole lot cheaper than therapy.”

Pounding away at forks, spoons, and knives, Tocco says there is no better de-stressor. Having created more than a couple hundred pieces already, her favorites range from octopus to mermaids, and even a birdhouse.

“It’s a great way to upcycle,” she said. “I love looking at a piece and figuring out what it can be.”

A fan of puzzles and seek-and-find games, she says the same rings true with the flatware.

She searches out the origins of her pieces before she repurposes them. Her favorite finds so far are sterling silver three-prong forks from 1904. “Someone used these in 1904, and here I am today repurposing them for future generations,” she said.

Tocco sticks with sterling silver and silverplated items to mold into new pieces. “I learned the hard way that stainless steel kills your equipment,” she said. Now, friends of hers from all over the country carry a magnet in their bags to help her find new pieces that will eventually become art.

2 Her mentor and friend Carol Joye taught her the craft over the past couple years. “I never took the time to learn the art form when she did and when she offered a class at Artists in Paradise, I knew now was the time,” she said.

After the class, Tocco continued an apprenticeship with Joye, who is now moving (Tocco is, of course, the selling agent), and Joye encouraged Tocco to take over her spots in local galleries.

WHAT HAPPENS IN

n a little more than five years, new development will come to a grinding halt in the Florida Keys. At least, that is what the State of Florida has decreed for the islands it has designated an “Area of Critical Concern.” Beginning in 2023, it will no longer issue new building permits for Keys municipalities.

None. Zilch. Zip. Nada. If this comes to pass, what happens next? Will landowners sue because the state (and local governments) is gutting the value of their investment by preventing them from building their dream home on their vacant lot? Will that raise taxes?

What will happen to real estate values?

Will builders be out of business? The ramifications are wide and far-reaching. The future starts now.

ack in 1972, Florida initiated a statewide planning and growth management law that required each county to create a “Comprehensive Plan” for land use management and to accommodate the fast population growth Florida was experiencing.

In the 1960s and 70s, the Florida Keys had become infamous for rampant drug smuggling and ineffective government. Local Keys government appeared to accommodate both smuggling and unrestrained development. One of the issues that brought the development issue to state attention was a 1972 plan to build three high-rise apartment buildings in Marathon, which led to a well-publicized campaign for “No high-rise in the Keys.” As a result of the public outcry, only one tower was built (Bonefish Towers) but development in the Keys was now on the state’s radar. Because of the Keys’ unique environment, and the risk to America’s only living reef, environmental organizations such as Friends of the Everglades, 1000 Friends of Florida and local activists such as George and Mary Barley in Islamorada lobbied the state to do more to protect the Keys from overdevelopment and inadequate governance.

Locals are very used to living in an “Area of Critical Concern” — it’s as normal as sliced bread. But there are only five such areas in Florida — City of Apalachicola, City of Key West and the Florida Keys (counted separately), The Green Swamp, and The Big Cypress Swamp. In Apalachicola, the area measures about 12 city blocks by 13 city blocks. The Green Swamp and Big Cypress Swamps are very sparsely populated. While there are environmental stipulations that come with this designation, it only has one purpose: “to guide local government growth and development decisions related to local comprehensive plans and land development regulations.”

comprehensive plan. (Under Gov. Rick Scott, the Department of Community Affairs morphed into the Department of Economic Opportunity.)

In 1992, the state required the county commission to pass a Rate of Growth Ordinance (ROGO), which severely limited the number of buildings to be built in the Keys. No further development permits would be allowed. This restriction was based on the state’s evaluation of the limited resources available within the Keys, and most importantly, the state’s determination that the restrictions imposed by ROGO would allow all residents of the Keys to evacuate within 24 hours in the event of a major hurricane. That evacuation model has been the primary rationale for restricting growth in the Florida Keys.

But why 2023? How did we arrive at that expiration date? Well, in 2012, the state and Keys municipalities came together to determine how many more building rights could be given out before the hurricane evacuation model reached “capacity.” At that meeting, it was determined that there was “one hour” of evacuation time left, or equal to the time it would take an extra 3,550 households to evacuate. The 3,550 permits were split among the county (with the lion’s share), Key West, Islamorada, Marathon, etc. The entities then identified a rate at which they would dole out the building allocations … which brings us to 2023.

There is no firm count on how many lots are still undeveloped in the Keys. Some put the number at about 3,500; others, as high as 10,000. The concern is that in 2023, there will be many, many property owners suing the county and the cities for compensation for the “taking” of their right to develop their property. At today’s property values, such a liability is far beyond the local governments’ ability to pay. That threat is perceived as a financial Armageddon by Keys governments.

“Back in the ’80s I think we estimated that it would cost $1 billion (to purchase the lots without allocations) that would be paid by the federal, state and local governments. It was too big a number to focus on. But looking back, and seeing what happened with sewage treatment, it could have been possible,” said Pattison, referring to the high cost of sewering the Keys.

In the mid-’80s, the Keys became a guinea pig of growth management, required to come up with a growth management plan long before it was required of other counties. Now, in 2023, the Keys will once again be first to test the “no new development” waters.

In response, in 1974, the state decreed the Florida Keys an “Area of Critical Concern.” (Key West’s separate Area of Critical Concern designation would come later.) In 1979, the state passed “Principles for Guiding Development” for the Florida Keys. The state took over the previously local responsibility for land management and development oversight. In real effect, all development in the Keys would be run by the state until the state had confidence that local governments could be trusted to protect the valuable resource of the Keys. That lack of confidence was not misplaced. Back in the 1980s, the City of Key West was dumping 6 million gallons of raw sewage into the ocean every day. In 1980, Monroe County approved Port Bougainville – a 2,800-unit development on 406 acres in the Upper Keys.

In 1982, a countywide election put new progressive leaders in the judiciary, state attorney, public defender, and county commission seats. A proposed comprehensive plan was presented at public hearings throughout the Keys, and in 1986 a new county commission passed the county’s first Comprehensive Plan and Land Use Regulations.

The plan evolved over 88 meetings — every single one of them attended

by Ed Swift, then a 31-year-old newly elected county commissioner appointed as liaison.

“I’m not sure why the hell that happened,” said Swift. The gargantuan task was accompanied by much opposition, including that of former state Rep. Joe Allen, who encouraged Keys residents to fight back against the state. Tensions were high at the meetings, and a report in a 1986 issue of Florida Trend magazine said an audience member at a public hearing tried to attack a speaker with a knife.

“I don’t remember that,” Swift said, “but I was at plenty of meetings where people shook their fists and shouted.”

In 1983, Charles Pattison was a Keys field agent for the state Department of Community Affairs, charged with overseeing Keys development.

(He is now director of Monroe County Land Authority.)

“The early days were contentious.

Anything the county did had to be approved by DCA,” he said.

The state and the county began cooperating in land use decisions, and the state slowly transferred more responsibility to local government but retained overall control over development in the Keys. For example, in order to build, a developer must meet a number of state-mandated requirements regarding open space, size of the building, etc. However, the state Department of Economic Opportunity must still approve changes to the
