n March 27, the Marathon City Council rolled up its sleeves and went to work.

The issue of permit fees, raised last month to a flat 3 percent of new construction cost, was renegotiated. Staff and council members pulled out pencils and calculators and adjusted the fee to 1 percent for new construction, and then set parameters for average construction costs per square foot — $200 for site-built homes and $125 for mobile or manufactured homes.

When the city changed the rules two weeks ago, the cost of new construction was provided by the permit seeker. But worries about inequality — whether purposely underestimating the cost of construction to pay a lower fee, or the widely disparate square footage costs of an upscale versus a modest home — prompted the change.

The new method of using square footage makes fees easier to calculate and permits are issued more quickly.

City Manager Chuck Lindsey said it wasn’t the city’s intent to increase fees.

“Our intent is to make the process better, get permits out the door faster, be more efficient and not to raise prices,” said Lindsey.

He noted that in researching permit fees for other municipalities, city staff found wide disparities between, say, Islamorada and Homestead, and that Marathon’s fees were “very low.”

He also said the building department is supposed to be revenue-neutral and self-supporting. “With the daunting task of paying for the cost of Hurricane Irma, there is a need for an increase.

To be honest, what that increase should be, I don’t know.”

Councilman Dan Zieg said, “We do need the increase but it needs to be moderate. We need to be sensitive to our families.”

Councilman Mark Senmartin, the only “no” vote on the permit fee ordinance passed two weeks ago, said

even now the fee percentages are still arbitrary and urged staff to continue to do research. Councilman Steve Cook expressed support for the new system.

“If I were a resident looking at constructing a new home, I would at least know what I was looking at in terms of permit fees. I wouldn’t have to worry about how much the permit fees would be for my electric, sewer and plumbing,” Cook said about the new square footage calculation versus the 2017 method that involved square footage plus counting fixtures like hose bibs and electrical outlets.

Mayor Michelle Coldiron asked the council to consider using the affordable housing funds to pay for new construction permit fees for owneroccupied residences, or those that are deeded affordable. She said the need is there after Hurricane Irma destroyed more than 400 homes in Marathon, but the benefit should only be offered to those who meet the income criteria.

Marathon Finance Director Jennifer Johnson said there is approximately $450,000 in the fund right now — derived from impact fees when developers transfer hotel room building rights — but some of the money is already obligated to first-time home buyers under the city’s program to provide down payments to qualified residents.

The permit fee changes are effectively immediately and the council said it would make them retroactive (to the March 13 amendment) at the next meeting when the new resolution is ratified.

• • • • • Two, four, six, eight … Those are the numbers that have been bandied about regarding how long a mobile food vendor, or food truck, might operate in one location before moving on.

On March 27, the council decided on eight hours.

The Marathon Planning Commission met on March 19 and issued its recommendations to the council — that a food truck might stay in place six hours before it would be required to move 1,500 feet to another location.

“What I’m really concerned about is this 1,500-foot rule,” said Cook. “It might have been a horrible joke. Just send (the food truck) to another lot.

Whether they move 20 feet or 1,500 feet, it shouldn’t matter.” Cook was referencing the controversial law, since struck down, that required that liquor stores in Marathon be located more than 1,500 feet apart.

In addition, food trucks will be able to operate from dusk to dawn. Council said it would determine licensing fees, and cap the number of licenses, in the near future.

‘GREEN SHIRTS’ COMING TO KEYS The Monroe County Long Term Recovery Group has invited World Renew Disaster Response Services, also known as “The Green Shirts,” into the Keys to meet with people who still are recovering from Hurricane Irma and need financial, emotional and/or household help.

World Renew Green Shirt volunteers meet with individuals to gather data and prioritize a person’s needs so that the Monroe County Long Term Recovery Group can connect the individual with the best available resources.

For people who need help, World Renew will be hosting walkin centers at three locations in late March and April: Upper Keys: Coral Isles Church, 90001 Overseas Highway in Tavernier.

OBITUARY

Theresa Elver 1951-2018 There will be a celebration of life for Theresa Elver on Sunday, April 15 from 4 to 7 p.m. at Key Colony Inn. Elver was a much-loved bartender at the restaurant for more than 30 years.

Elver was born on Jan. 30, 1951 in Jacksonville and passed away on Jan. 20, 2018 in Beverly Hills, Florida, after a battle with cancer.

She is survived by her son, Micah Clark, his wife Telli and grandson Jake of Beverly Hills, Florida. She is also survived by sisters Tina Mackie, Candy Clark and Cynde Clark of Maine, sister Pat Lenz of Tampa, and brother Richard Wing of New Hampshire, plus numerous nieces, nephews, aunts and cousins. She loved her family very much.

Elver enjoyed the Keys life and all that it entailed, and also reading and travel. One of her enduring passions, however, were her dogs. She is survived by Mr. Dumas and a small statue of the canine will be erected at Key Colony Inn in Elver’s honor.

udith Fee could barely speak when asked about her husband Henry and his time at Tranquility Bay Adult Day Care. Her voice shuddered, and tears rolled down her face. “It’s hard to talk about it,” she said. “They are just so wonderful.

When they opened, it was an answer to my prayers.”

Henry was diagnosed with Alzheimer’s disease, affecting his memory and quality of his life, and his wife Judith’s. “They have been challenging his mind,” she said. “He has been sleeping so much better.”

She now has free time to have lunch with her daughter-in-law, and freedom to do things during the day.

“Who knew I would miss ironing so much,” she said.

Henry said he was having a good day, while relaxing at the center. “I had a good lunch; I don’t remember what it was, but it was good.” He likes puzzles and sang “yeeeeeesssssss” in a perfect baritone pitch when talking about his love for karaoke.

Raisel Mendez and her husband Oscar Hernandez opened the Key Largo location in 2012 after Mendez realized there was nowhere for her grandfather to go to socialize and do activities. “It was hard for us to work because we were worrying about him at home,” she said.

Along with karaoke, the center has computers, exercise station for yoga and Zumba, nail and beauty salon area, arts and craft room, and cafeteria. There are two bathrooms and a shower, in case there is an accident.

The staff checks the participants’ blood pressure and blood sugar daily. They also offer door-to-door transportation, even making runs to Big Pine Key to pick up a participant. The Marathon center also travels to the senior center daily for lunch and more socialization.

Fee says Mendez is filled with energy. “As soon as Henry sees Raisel and Ada, he perks up,” she said. “They make everyone feel like the center of attention.”

The Key Largo location has on average 30 people; the Marathon location is now at six after opening in February. The center caters to anyone older than 60 years of age, but anyone with a disability over the age of 18 is welcome. Monroe County has a grant program for those with memory loss, where the co-payment can be as little as $1 per month, which includes the transportation, breakfast, lunch, snack, and monthly field trips (they go places like Dolphin Research Center and Lion Country Safari, at no extra fees). The center is also covered in many insurance programs and they will work with anyone’s financial situation.

“It is very difficult for me,” said Fee of her husband’s condition. “But, now it’s not as bad as it was.”

County, cities still waiting on FEMA funding

A

cross the board, the governmental entities in Monroe County have yet to receive any federal funds associated with Hurricane Irma. In fact, the City of Marathon, Key West, Village of Islands and Monroe County have self-funded every bit of recovery that has happened since Sept. 10.

It is, admittedly, a very complicated process to submit a “project worksheet” or PW. And, yet, professionals started the job when Keys officials were still operating out of the Emergency Operations Center. From the beginning, Keys officials understood that every “i” had to be dotted and every “t” had to be crossed in order to apply successfully and receive the federal dollars administered by the Federal Emergency Management Agency, the so-called Public Assistance Grants.

“It’s cumbersome,” said Key West Finance Manager Mark Finigan. “The money is not flowing down. We have several ‘PW’s’ at the state level that don’t seem to be moving forward. Our federal FEMA representative, in place locally to support us, is unable to give us answers as to why this is not moving forward. I wish the state would assign a FEMA representative to the Keys, too.”

For example, the City of Marathon submitted one PW for citywide safety inspections in the amount of $441,720. It was sent to FEMA on Nov. 9, 2017. It has been “obligated” — meaning FEMA has

approved the project — but has been stalled at the state level since then.

The costs associated with Hurricane Irma to local governments are staggering.

Monroe County estimates it will cost $93 million. The Village of Islamorada says $6.4 million. Key West estimates $16.9 million and the City of Marathon estimates $30 million. Those are estimated costs, but it’s an important factor because in past storms, those round numbers were then used to expedite funds to the affected public agency. For example, in the case of Monroe County that does not include future requests for mitigation or repairs to the airports.

“They used to expedite 50 percent of the claim, and then figure it out later,” said Monroe County Administrator Roman Gastesi on the advance of “upfront” money, “but they are not doing that any more.”

According to U.S. Rep. Carlos Curbelo’s office, Florida did not request expedited funding for emergency work which may have been requested by other states/territories.

Gastesi and other Monroe County officials traveled to Washington, D.C. last week seeking more recovery dollars, including for canal cleanup. He said he had the opportunity to meet with Florida’s FEMA Director Wes Maul. Maul told

Gastesi that the Monroe County requests for funding had been assigned, but not “tasked” to an outside consultant, and would be shortly. Gastesi added that he hopes to see some activity this week.

“Listen, FEMA is overwhelmed. There were three hurricanes, and fires in California. It’s a complicated process, and ultra sensitive because there have been issues in the past,” said Gastesi.

According to the New Orleans TimesPicayune, the Hurricane Katrina Fraud Task Force said it had prosecuted 1,439 people in half the country’s 94 federal judicial districts for illegal activity related to hurricanes Katrina, Rita and Wilma.

Several entities reported that the amount of Katrina fraud could near $1 billion.

“What complicated things is that FEMA initiated a new reimbursement process and model on Sept. 17, 2017. So even the consultants and FEMA employees had to learn aspects of the new model,” said Islamorada Finance Director/ Deputy Village Manager Maria Basset.

Islamorada only recently received its final payment from the results of Hurricane Wilma-related expenses. Wilma hit the Keys in 2005.

The PW funding requests first land on the desk of a federal agent, a FEMA Program Delivery Manager. There is reportedly one in the Florida Keys who conducts weekly meeting with municipal and county stakeholders. After he deems

it ready, it moves to the FEMA consolidated reporting center where it undergoes more checks such as environmental review. If it meets approval there, then it heads to the state Department of Emergency Management and the Public Grants division.

But Texas and Puerto Rico, for example, are faring differently after disasters there. There is wide disparity in how FEMA has obligated funds among states for events that happened both before Hurricane Irma, and after. For example, there is $633 million of obligated public assistance grant money for Hurricane Harvey in Texas. There is $1.3 billion for Puerto Rico and another $442 million for the Virgin Islands to recover from Hurricane Maria. So far, $26 million of public assistance grants have been obligated for the state of Florida to pay for Hurricane Irma.

Monroe County has obligated funds totaling $3.3 million out of a total $16 million submitted to FEMA in estimated damage. Every single dollar of that is accounted for by a professional adjustor, an expensive proposition.

The county, Marathon and Key West are using Adjustors International for help with FEMA forms. The Village of Islamorada has two adjustors from DMS Disaster Consultants and those services have already cost the village $400,000. Key West is including the administrative cost

of these professionals as part of each PW. (For example, Key West submitted a reimbursement of $65,000 for emergency repairs to a footbridge; an additional $1,467 was requested to pay for the administrative costs.) Monroe County has a 26-page contract with Adjustors International. It is paying the Engagement Manager $275 per hour which includes lodging and other expenses. The Project Officer and Public Assistance Specialist are paid $205 and $175 hourly, respectively, including benefits.

Marathon has taken out a $10 million line of credit to cover Hurricane Irma recovery costs. Monroe County has a $40 million line of credit. Both Islamorada and Key West have been able to self-fund the projects thus far, but the lack of cash affects which types of projects it can tackle.

about $4.5 million in unassigned funds.

The extra money has been used to cover Irma-related expense since last fall, but that money is gone now, said Bassett.

“If we don’t get reimbursement by the time we start on other projects, like Anne’s Beach, for example, then we could move on to borrowing money and taking advantage of the grants we have in place to go forward with the projects,” said Bassett.

The City of Key West is having a similar experience.

“For example, we’ve already spent $100,000 on repairs to Fire Station 3,” said Key West’s Finigan. “It has a partially collapsed roof, needed mold remediation and the generator inspected. That work has been done and paid out and we are putting together a PW to submit to FEMA.” Key West has yet to tackle the estimated $1 million restoration of the basin seawall between Margaritaville Resort and Mallory Square connected by a footbridge. Finigan said engineers have been sent out to look at those needs.

“We can move some of our capital around, defer the capital plan so we can get that accomplished,” he said.

City of Marathon Chuck Lindsey said one of the most glaring needs in Marathon is to have Sombrero Beach restored.

He said the city is not in a position to pay for the design, engineering and construction up front. “I can’t do that until I get an infusion of cash. I have to keep things rolling,” he said.

Keys Strength and Conditioning celebrates re-opening

n Thursday, Keys Strength and Conditioning celebrated its grand re-opening with a party for all the gym’s clients. Owners Liz and Chris Kuck have amassed many supporters appreciative of the type of fitness classes it teaches. Besides high intensity training, the gym also offers cardio classes on its rowing machines and spin bikes, as well as power lifting classes. The gym suffered some Irma damage that has since been repaired and the space has been remodeled to reflect its growing membership.

The March For Lives protest took place peacefully in Marathon on March 24, five weeks after the Parkland shooting in Broward County. A group marched from Marathon High School to Kmart. “It was a bit emotional. Two high school girls from Broward showed up and gave a tear-jerking, poetic message,� said Larry Benvenuti. DAYS WHAT ANIMALS ARE ALLOWED WHERE?

H

as everyone noticed the explosion of dogs just about everywhere?

From grocery stores to airplanes, pooches are now a solid part of the people world. Long ago they were relegated to farms, then moved up to house pet (meaning they stayed in the house) and now as the saying goes, you can’t swing a dead cat … okay, bad joke. But dogs have become a regular part of public establishments. How legal is that?

Like stepping in the doggie mierda or merde – that’s what it feels like deciphering the legality of animals in public. Let’s start with the difference among pets, service dogs and emotional support dogs.

Animals defined as regular pets are easy – they can be discriminated against, meaning no goats, kittens, fish, hamsters, fidos, etc. in public places unless the establishment allows them.

Service dogs are legal just about everywhere, because they are trained to help the disabled. There was a time that miniature horses fit the category – not sure how – but not any more.

Now, service dogs are not just seeingeye dogs but also medical alert dogs that can predict seizures for epileptics, help with PTSD, and even ferret out gluten for celiac sufferers in a restaurant. These dogs are trained six months or more for their specialty. There’s a catch, though. There is no legal certification required or legal need to wear a service vest proving their purpose. That would infringe upon the disabled owners’ right to privacy, according to the Americans with Disabilities Act. These dogs are allowed in any public accommodation from airplanes to grocery stores, and management can only ask, according to the ADA, if the animal is a service dog

and what task it performs, since there is no paper documentation to prove the abilities.

A proper service dog, however, is trained for “public access,” meaning in public places it will not exhibit: aggressive behavior, public urination or defecation (only on command), begging for food or affection or hyperactivity or excited behaviors. (Another way to distinguish pets from service animals.) The dog also must be under leash or tether unless the owner’s disability makes it impossible to hold a leash or tether; then, they must act under voice command or signals.

“It’s about understanding dogs as tools,” said David Zuniga, owner of Dogs en Vogue in Marathon. “Unfortunately, because the ADA says it is discriminatory to ask for proof of service, a lot of people take advantage of the situation and sneak in untrained dogs.

And corporations are afraid of litigation, so they let these people slide.”

Now, if the animal defecates, urinates, shows aggressive behavior, etc. then business owners are allowed to deny access or refuse service. And yes, the animal owner has to clean up the mess.

“I wish companies would train employees to ask the right questions; then they can really find out if it is a service dog,” said Sophia Pierce, trainer and also owner of Dogs en Vogue. “The lines have gotten too blurred between service dogs and other animals.”

Service animals should not be approached, petted or offered food, but instead left alone to complete their tasks and focus on their owner. If distracted, they could miss the owner’s cues for help.

That leaves Emotional Service Animals (ESA); what’s their story? An ESA is not limited to dogs, but is any animal that provides therapeutic benefit through companionship, and no training is required. So an ESA is not allowed full public access like service dogs.

Nope, that cute teacup Yorkie isn’t allowed in the store just because it makes someone feel better. There are legal rights for ESAs so emotionally disabled persons will not be discriminated against for housing. Under the federal Fair Housing Act (FHA), an emotional support animal is permissible in a housing unit that has a “no pets” rule. It is illegal to ask about the mental disability, but ESAs do have a certificate. According to U.S. Department of Housing and Urban Development (HUD), an assistance animal is not classified as a pet, so proof starts with a letter from a doctor or even just a medical therapist (kind of blurry classification) to obtain a certificate, nowadays commonly online.

Lastly, Pierce cautions pet owners taking untrained animals into public places. “Owners do not want to leave their animal alone at home but then, the animal may not be mentally equipped for loud public places.” Putting animals in situations they cannot handle can do more harm than good and cause them stress, resulting in aggressive behaviors or again, unwanted accidents. Oh scheisse.

New Life moves home

fter months in a temporary space at the Marathon Garden Club, New Life Assembly of God in Marathon is set to host Easter service at 10 a.m. at its refurbished home thanks to the hard work of many including Pastor Keith LaFountain, right, contractor Chad Neller, center, and super volunteer Dave Beckley. (The first service is the sunrise service at Sombrero Beach, an interdenominational affair.) According to LaFountain, the building suffered significant damage from Hurricane Irma. “The only thing we saved were the speakers hanging from the ceiling,” he said. The entire space is light and bright in tones of gray and white with new floors, ceiling tiles and a commercial kitchen. LaFountain said he’s been thinking about the connection between the new space and his fresh message. “The cross removes fear, shame and guilt,” he said. “I want to build on that.” The big metal building to the side of the existing church will be the new sanctuary and the renovated space will become the parish hall. e has three degrees — a bachelor’s in entomology from Penn State, a master’s in entomology and plant pathology from University of Tennessee, and a doctorate in entomology from Auburn University. So, has Larry Hribar ALWAYS been interested in bugs?

“No … well, yes. I guess I was always bringing flies and butterflies into the house when I was a kid. And one memorable occasion when I tried to catch a honey bee with my bare hands,” he said, laughing. His parents, second generation immigrants from Slovenia, encouraged the interest with a tiny microscope one Christmas.

Hribar is coming up on his 20-year anniversary at the Florida Keys Mosquito Control District and said the advances in biological deterrents are the most promising. In addition to his busy work schedule, he is father to three — one high school senior, one high school sophomore and a seventh grader. He has also volunteered and been volunteered for multiple positions in the local Boy Scout and Cub Scout scene. He is, himself, a former Boy Scout.

For god’s sake, how do you pronounce that? LOL! Only my grandparents could pronounce it correctly.

It’s a soft breath in the beginning (the “h”) then accent the “REE” and finish with “bar” a little softer. People in the “old country” trill the r a little. (Editor’s note: It’s “rebar,” like the construction material.)

What’s your position at Florida Keys Mosquito Control District? Director of Research.

What is one daily task you perform?

Data entry.

What’s your favorite bug?

Louse flies; parasitic flies found mostly on birds but some mammals.

What’s the coolest thing about the Aedes aegypti mosquito? Aedes aegypti left Africa and spread all over the world in a few hundred years. It is an amazing story of dispersal and colonization.

Why is there a moth with your name? There isn’t a moth with my name, but there is a predatory fungus gnat and a feather mite. I sent the specimens off to experts who determined they were species unknown to science and they named them after me. Most biologists never get a species named for them and I ended up with two.

What was the hardest Eagle Scout badge to earn? For me it was Emergency Preparedness.

Dream meal: you are sitting at a diner counter eating; who walks in and sits next to you? My father.

What’s your best guilty pleasure? I love accordion music.

What are the top five, must-read books in your library? “The Way of a Pilgrim,” Anonymous; “Atlas Shrugged,” Ayn Rand; “To Serve Them All My Days,” R.F. Delderfield; “The Prophet,” Kahlil Gibran; and “The Foundation Trilogy,” Isaac Asimov. (I know, that’s seven.)

Which TV or movie character is your alter ego? Shemp Howard (One of “Three Stooges.”)

She was there all alone and I ran into her and asked her if she wanted to go get lunch. The next thing I knew I was married with three kids.

What superpower would you choose and why? Being able to fly.

How did you meet your wife? I was working at the University of Florida back in 1994. We finished teaching a course on mosquito biology and control for scientists from South America. I went in the next day to feed the mosquitoes. Everyone had gone home except for one lady from Argentina. She was there all alone and I ran into her and asked her if she wanted to go get lunch. The next thing I knew I was married with three kids.

How many languages do you speak?

English is my native language and I get by in Spanish. I used to speak a little Italian and a little Arabic but I’ve forgotten most of them without practice.

Are you a news junkie? I used to be but nowadays it seems to be mostly opinion and very little news.
