As residents of the Village of Islamorada continue their post-Hurricane Irma recovery, the village’s planning department must tackle how to issue permits for non-conforming docks built before 1986. As part of the effort, the staff is also mulling the idea of “registering” those docks.

the time was that docks extending too far out were dangerous.

But what if your dock was built before 1986?

Docks that existed prior to 1986 are considered nonconforming but are still legal. Pre-1986 docks are also exempt from building limitations that order the structure extend out to meet the four foot requirement.

Any docks that existed in the Keys pre-1986 were considered legal wherever they terminated. However, nowadays things have changed. For example, certain parts of Islamorada, namely Lower Matecumbe, ban long docks – anything extending over 100 feet – while other parts of the village require administrative approval for long docks.

So, under what other circumstances might a waiver be granted for a dock that ends in a depth of less than four feet? As of March 13, no docking waivers have been granted, and the complete answer to what constitutes a waiver may be clearer following the Thursday, March 15 council meeting.

“No waivers have been given since Hurricane Irma by village staff other than for fees and walk through permits for emergency repairs on the list of items we handed out about two weeks after the storm,” said Islamorada Village Manager Seth Lawless.

As waiver criteria are still unclear, the charter does delineate some exceptions: • Property owners that present a bathometric survey showing a seagrass colony or hard bottom community negatively impacted may have the minimum depth requirement waived.

• Pre-1986 docks destroyed by the hurricane may be rebuilt in the same design and location with a few stipulations: First, the repairs cannot adversely affect storm water runoff, navigation, or disturb the habitat of a threatened or endangered species. Second, the rules requires a landscape setback, otherwise known as a bufferyard, be installed. Finally, any replacement of a non-conforming dock must comply with every requirement set out in the rules to the most practical extent.

What constitutes “practical” may be one of the issues raised during the upcoming Village Council meeting on Thursday, March 15 starting at 5:30 p.m. at the Founders Park Community Center, MM 87 bayside.

GRANDFATHER DOCK Village to discuss registration “The village is trying to allow (residents) to keep these docks, since they have been established so long. We’d like to see these older docks grandfathered in,” said Islamorada Mayor Chris Sante.

The village’s charter lays out the general standards for all docking facilities in Islamorada. As it reads, docks are to be designed to be only T-design and other perpendicular designs, unless they impede navigation of a waterway. When measured across, docks can’t exceed 10 percent of the water body they sit in, and with a moored vessel, lift, or mooring piles cannot block more than 25 percent of the surrounding navigable waters.

All docks must meet a few requirements. First, there must be four feet of water at mean low water level (MLW) where the dock ends. In some cases, a dock can end in less than four feet of water if the depth allows for an average sized vessel to rest adequately.

Manager and co-owner of South East Marine Construction, Pete Diaz, says the village’s four-foot standard is strong, but believes the issue of replacing pre-1986 docks is complex.

“An issue before was that in some cases for property owners to reach the depth standard, the length of the dock would go beyond what the village allowed. In cases like that, people get what is called a viewing platform. That allows us to install pilings and build a walkway out, but viewing platforms should not be allowed in any way to be used for mooring a vessel,” said Diaz.

The four feet depth rule was enacted throughout the Keys in 1986, when Monroe County first enacted its land development regulations.

Mayor Sante says he previously raised the idea to have the rule changed to three feet. His concern at

n March 10, hundreds of members of the community gathered inside the Coral Shores High School gymnasium to pay tribute to longtime Office Manager Jackie Moates. One by one, those closest to Moates approached the podium to speak their thoughts and sentiments.

Over the course of two hours many tears were shed, laughs were had, and stories shared. Moates’ penchant for toughness was underscored only by her zeal of bringing out the best in everyone.

he effort young Upper Keys entrepreneurs have put into preparing for the Keys Kids Business Faire has caught the attention of the local commerce community. The Islamorada Chamber of Commerce extended the offer to host the Business Faire as part of the annual Island Fest on Saturday, March 24, and the kids accepted.

About $3,000 in scholarship money will be split among the top three winning entrepreneurs.

“This is a two-day event which will allow our young entrepreneurs a more realistic experience at showcasing their wares in front of a thriving marketplace. Likewise, we hope that with 7,000 visitors it will open the channels for more sponsorships and community partnerships,” said Brainery Co-founder, Lizz Smoak.

With the fair fast approaching, “biz kids” like Maddie Hull are diligently preparing for a busy day of work. Maddie’s concept for the fair is the Capital Kids Café, a French themed café. Maddie’s never been to France, but that’s ok, she has help.

Tavernier’s Café Moka is mentoring Maddie by helping her coordinate with wholesale dealers to obtain imported French ingredients.

Through that partnership, Maddie was able to find authentic ingredients that she plans on using for some of her baked goods.

Maddie’s interest in French cuisine dates back before the competition.

“My dad worked in France for a little while, and every time he came back he brought me macaroons. I really want to learn how to make those,” said Maddie.

Since the venue changed, Maddie slightly altered her original concept of a 10-person café to accommodate more seating, and has kept the gift shop. Gift shop items range in price from $5 for sunglasses, necklaces, bracelets, and hair pins to $15 for animal plush purses.

Her menu for the Café will include baked goods that patrons will be able to decorate with icing, sprinkles, chocolate chips, and peanuts. Most baked items are priced at $2 or $3.

Madeleines, Lemon Berry Bars, and macaroons are just some of the goodies she’ll be making for the faire.

Maddie Hull says her homemade Madeleines go perfectly with a cup of hot tea.

“I’m also thinking of making white chocolate and raspberry cupcakes. I have an American Girl baking cookbook at home, and these look really good,” said Maddie.

To keep her baking skills sharp Maddie has been watching youth baking competitions and cooking shows with her dad. Some of her favorite shows are “Diners, Drive Ins, and Dives” and “Man Fire Food.”

Maddie knows her customers are going to be thirsty too, so she’s preparing to make a big batch of her homemade raspberry lemonade, and her original “Madd Tea.” Look for Capital Café goodies at the fair, they’re hard to miss. Her product packaging, logo, and booth design use a pink, grey, white, and black color scheme.

The team of Zeffie Crockett and Anaia Woods are putting the finishing touches on their products for their boutique — A to Z Makeup, Accessories, and Jewelry. The children of business owners, the pair will be selling sea glass art jewelry and makeup.

“A couple months ago my mom and I had this idea to wrap sea glass.

We worked together to make those and it inspired me to do this,” said Zeffie.

One piece of handmade jewelry takes about 15 minutes to make, and

comes in teal, white, blue, and green. With 7,000 people expected at Island Fest, she’s planning for a big order.

Her items are marked at $7 to $9 for necklaces, depending on size, and $5 for hair accessories and bracelets. Each piece of glass is unique, so the pair is marketing the items as one-of-a-kind.

Anaia is tackling the process of making her homemade makeup with a little help.

“She’s doing most of the homemade makeup and is using a secret recipe her mother shared with her.

We’ve also made our own recipe for the blush,” said Zeffie.

Makeup is priced at $3 to $5 for blush and lipstick, which comes in a variety of colors like light purple, pink, and reds.

Plantation Key School teacher Anne Osborne is also helping the pair develop their concept by providing information, ideas, and showing them how to calculate profit, and manage balance sheets.

Locals plan for St. Patrick’s on Saturday

UPPER KEYS Snappers Snappers is hosting its annual St. Patrick’s Day celebration and parade. The parade lineup and starting point is at Burton Memorial Church, and begins at 3 p.m.

The parade path will continue down U.S.1 along the bike path to Snappers. The best float in the parade will be awarded a $100 bar tab. Floats, bikes, groups, golf carts, or persons wanting to participate can register the day of the parade.

After the parade, guests can stick around for live music by Dangerous Dave. Drink specials for the day include $1 green draft beer, Jell-O shots, and Irish Car Bombs.

Snappers will be serving its take on corned beef and cabbage, too.

Florida Keys Brewing Co. Grab your green and get hungry.

Florida Keys Brewing Co. is teaming up with M.E.A.T. eatery and taproom to feature classic Irish dishes at its St. Paddy’s Day celebration at its new taproom and beer garden.

However, the Irish grub has been given slight a twist. The menu includes a Sheppard’s pie made with sweet potato, a homemade bratwurst sandwich with homemade sauerkraut and mustard. For those with a sweet tooth, M.E.A.T. is also planning on making its original bread pudding, only this time with Lucky Charms cereal and a creamy vanilla glaze. Hearty eats need hearty brews, so the brewery will feature craft beers like its Shenanigans Irish Red aged in Jack Daniels and Highlander Mocha Stout.

Dillon’s Pub & Grill As one of the Upper Keys’ only Irish pubs, Dillon’s Pub and Grill is the place to be on St. Patrick’s Day. As part of their annual celebration, the pub is hosting an Irish faire beginning 11:30 a.m. On the menu this year is corned beef and cabbage, Shepherd’s pie, bangers (Irish sausage) and mash, and the Irish bulldog — which is Irish sausage smothered with mashed potatoes, cheddar, bacon, and dijonnaise sauce. Supplies are limited, so get there early! Live music begins at 7 p.m. and runs until midnight. The pub is also welcoming the Jameson and Jägermeister girls to its celebration.

MARATHON Key Colony Beach The little Middle Keys town is planning its annual St. Patrick’s Day Parade. Parade assembly begins at 4:30 p.m. at the 15th Street circle.

All walkers meet at Sunset Park.

The parade starts at 5 p.m. and will end at the intersection of 1st Street and East Ocean Drive. All organizations, clubs, animals, lodges and individuals are invited to wear green on their person, their bike, their car or their truck. There’s corned beef specials on the menu, plus March Madness on the TV. Key Colony Inn Get your Irish eyes smiling from noon to 9 p.m. There’ll be live music all day with John Bartus and friends. From noon to 4 p.m., enjoy corned beef and cabbage, $2 draft beer, mozzarella sticks, fried clam strips, sausage and peppers and buffalo style chicken wings. Then, from 4 to 9 p.m., the restaurant will serve a complete St. Patrick’s dinner in the Irish tradition. The restaurant will have its regular dinner menu as well. Traditional Irish dancers will entertain and teach.

Sparky’s Landing Corned beef and cabbage with carrots and potatoes? Check. Corned beef on rye and fries? Yes. Sparky’s, in its new location next to the Holiday Inn Express, MM 53.5, will also feature Guinness, Car Bombs, Irish whiskey and green beer.

n Sunday, March 18, the annual Islamorada Seafood and Art Festival returns to Morada Way. Cosponsored by the Islamorada Moose Lodge, Morada Way Arts and Cultural District, the festival will run from 11 a.m. to 5 p.m. Guests can travel along the Old Highway from the Islamorada Moose Lodge to Florida Keys Brewing Co. to sample some of the Keys’ favorite seafood recipes made by local chefs.

Three stages of live music will entertain festival goers and an authentic Junkanoo band will parade the entire route twice during the day. Juried artists will be displaying their art and crafts. There will also be a Kidz Zone and 2 dog rest areas onsite. A 50/50 raffle drawing is scheduled at 5 p.m. at the Moose Lodge. A $5 donation is requested for Moose Charities.

LEGISLATIVE WRAP Good news for the Florida Keys

• The legislature approved $5.9 million in funding for a new Emergency Operations Center. During Hurricane Irma, essential personnel evacuated to Ocean Reef for safety as the current facility is not sufficiently storm-hardened.

Officials say the new EOC will be placed at the Marathon airport.

• Statewide, the Florida Forever program received a $100 million boost. The Keys will receive $5 million for land acquisition, plus $5 million in Stewardship Act funds for water projects such as canal restoration. Last year, Florida Forever received no new funding.

• Florida Keys Community College will receive $5 million for classroom facilities and renovations and also hurricane impact gap funding to cover lost enrollment after Hurricane Irma.

• Several Keys programs also received funding. The free mobile pumpout for vessels was funded at $227,000.

Florida Keys AHEC received $250,000 to continue to run school clinics. The Monroe Association for ReMARCable Citizens (MARC) received $100,000 for job training. And MOTE Marine received $500,000 for coral restoration.

arlier this week, the 2018 Florida legislative session came to an end. The legislature approved an $88.7 billion budget that includes many initiatives for the Florida Keys, including investing in nearshore waters and even funding for a new, Category 5-rated Emergency Operations Center. Perhaps the most important is $15 million in funding for affordable housing.

“Despite having to cut the state budget to cover the safe schools act, we were still able to secure a sizable amount of resources for our Hurricane Irma recovery efforts and important community needs like the Stewardship Act,” said state Rep. Holly Raschein.

• The Florida Keys have been awarded $15 million for affordable housing through the state’s SAIL (State Apartment Incentive Loan) program.

It provides low-interest loans on a competitive bid to affordable-housing developers each year. In the Keys, developers may designate all the units in the development for residents with annual household incomes below 120 percent of the state or local median income, whichever is higher.

State Rep. Holly Raschein also sponsored two bills that passed. HB283 grants Lower Keys Medical Center an exception in order to provide certain cardiac procedures.

Normally, hospitals must meet volume requirements that would preclude the Keys rural hospital from participating.

HB1163 amends the structure of the Monroe County Land Authority. In addition to being able to purchase land, it now has the ability to develop projects.

Also, the challenge to home rule died during session. If passed, it could have preempted local vacation rental laws, making it possible for nightly rentals in residential neighborhoods. It never made it to the second committee in the House and also stalled in the Senate.

The last three weeks of the nine-week session were devoted to the response to the Parkland school shooting that claimed 17 lives at a Broward County high school. The Marjory Stoneman Douglas High School Public Safety Act raises the age requirement to purchase some guns to 21, but does not ban AR-15s. The bill would provide additional funding for SROs, who currently are only onsite at about half of Florida schools, and has provisions permitting school staff to carry guns on the job after extensive training.

The majority of the bill deals with school safety, mental health and coordination among agencies.

It’s also possible that Floridians may never have to participate in switching the clocks twice a year. If Governor Rick Scott signs it into law, and Congress approves, Daylight Saving Time will be permanent in Florida.

Scott has 30 days to decide whether to veto items once a bill lands on his desk.

‘GIFTED’ SONGWRITER TO PERFORM Pettis brings talents to Islamorada

race Pettis has grown up with lyrics and music all around her.

The daughter of a poetry scholar mother and a father who has written hit songs for Garth Brooks, and sister of two musician/songwriters, Pettis will perform Monday, March 19, at 7:30 p.m. at Heartbreakers Beer Garden, 81001 Overseas Hwy., Islamorada.

The Dallas Morning News calls Pettis – originally from Lookout Mountain, Alabama, and now based in Austin, Texas – a “gifted young songwriter with a compelling voice; one of the most talented young singer-songwriters in America.”

The country/folk/Americana performer has won numerous songwriting awards, including the Kerrville New Folk Contest and NPR’s Mountain Stage NewSong Contest.

Her concert is presented by ICE, a non-profit organization dedicated to presenting quality entertainment and supporting cultural events in the Upper Keys. Proceeds from its events provide music, dance, and arts scholarships to local students, grants to in-school programs, and infrastructure to various local not-for-profit events and organizations.

Islamorada painter chosen as poster artist

I

slamorada mixed-media painter Anne Schroeder is poster artist for the 27th annual Island Fest.

Presented by the Islamorada Chamber of Commerce, the two-day festival will offer live music, gourmet cuisine, vintage cars and plenty of fine art. The festival takes place on Saturday and Sunday, March 24 and March 25, at Founders Park.

“It means a lot to me,” Schroeder said of being chosen as the poster artist six months after her Plantation Key residence was washed out by Hurricane Irma. “It’s really nice to still be a part of the community.”

Schroeder used a vintage chart of the Atlantic off Lower Matecumbe as the canvas for her poster piece, called “Hog Wild.” Over the chart she painted a colorful hogfish.

It’s a homage to her childhood in the area, when her family used fishing to help fill the kitchen table.

Schroeder is just one of about 100 artists whose works will be on display at Island Fest. The juried Arts & Crafts Show will feature local and national artists whose creations run the gamut from paintings and sculptures to jewelry and photography.

Also among the participants will be Phyllis Jean Bodie, who took Most Creative Artisan last year for her watercolor-on-silk painting “Anguilla.”

This year, Bodie will present underwater-themed watercolors and what she called her “Blue Nudes,” in which the blue shadows of naked women are depicted over backdrops of locations around the world. “It’s very subtle,” she said.

Augmenting the Island Fest art show for the second time will be the Plein Art Paint Out. During both days of the show, artists will set up at various places, including the beach and

near the music stage, where they will paint complete works live. The artists will then frame their creations before putting them up for sale near the Chamber of Commerce information booth.

The Arts & Crafts Show is just one of Island Fest’s many offerings. Others include live music, a vintage car show, a homemade boat race, the popular Taste of Islamorada competition and plenty of activities for children.

he 7th Annual Jimmy Johnson’s “Quest for the Ring” Championship Fishing tournament ran from March 7-10 and had 99 teams participate. Tournament week includes a two day National Billfish Championship, one day National Sportfish Championship, and Celebrity Pro-Am. The tournament also has the largest guaranteed purse in sports fishing history, doling out more than $1.5 million. Over the course of the two-day Billfish Championship, 377 fish were caught.

The tournament raised more than $100,000 for charities through its Celebrity Pro-Am Day and fundraising at the awards dinner. Some of the most recognizable celebrities in the Celebrity Pro-Am competition were DJ Williams, Richard “RIP” Hamilton, Jonathan Vilma, Twan Russell, Worldwide Wes, Brett Romberg, Greg Mark, Allen Iverson, Desmond Howard, Dan Stubbs, Djimon Hounsou, Alex Gonzalez, and Coach Jimmy Johnson.

Cleaning existing steel. This is step one of the project, working east to west. It’s sandblasted, primed and then coated with zinc. Sandblasting off the rust reveals the integrity of the piece.

The lower level is a full walking surface; the second is a mesh net to bring workers closer to the steel beams.

They work five or six days a week and are employed either by the engineering company WSP, the contractor Saffo Contractors Inc., or the subcontractor Cekra Inc.

Replacing the steel. The majority of the steel is salvageable, according to the senior project manager.

So far, only about 25 percent of it has had to be replaced. This is the second most common repair being performed.

Concrete repairs. The third most common repair is fixing spalling and cracks. Using a form (that looks a bit like a metal cage), large pieces of concrete are removed and then replaced with high-quality materials. Cracks are repaired by injecting epoxy.

e’re two years in. The Old Seven Mile Bridge closed to pedestrians in July 2016 and there’s roughly another four years until it will reopen; insiders say they are looking at early 2022. The entire project is expected to cost $77 million, to be split three ways — the state Department of Transportation pays 75 percent ($58 million), the county funds 18 percent ($14 million) and Marathon agrees to shoulder 7 percent ($5 million).

But what, exactly, is going on out there? The old span is littered with equipment and supplies and busy workers, glimpsed only for a second as cars speed across the new Seven Mile Bridge.

“The project is very, very clean,” said Pom Chakkaphak, the senior project engineer employed by WSP. Protecting the Keys’ unique environment is priority one, he said. The second is the safety of workers and non-workers and the third is site security. It takes a small act from a minor deity to get out there.

The initial plan calls for the state DOT to drop more than $32 million on initial repairs with the county chipping in $2.7 million. Over the next 30 years, the county will be responsible for a $207,000 annual maintenance bill in addition to setting aside another $5 million that will cover half of the 30-year paint job the county is splitting with Marathon. The bridge is owned by FDOT. The Old Seven Mile Bridge was decommissioned in 1982 and closed to auto traffic in 2008. Pigeon Key, the five-acre island in the middle of the bridge — or at the end of the old span — is still open to the public. Some of the buildings remain from Pigeon Key’s incarnation as a work camp for the Florida East Coast Railway. The buildings are used today for housing for educational groups as well as administrative offices of the non-profit Pigeon Key Foundation.

To visit the historic island run by the Pigeon Key Foundation, buy a ferry ticket from the Hyatt Faro Blanco Resort, 2010 Overseas Highway in Marathon or call 305-743-5999. Tours are at 10 a.m., noon and 2 p.m. The ferry is the only way to visit one of, if not the, most important historical sites in the Middle Keys. As far as the very popular pastime of walking the old bridge, well, that’s going to have to wait for a little while.

BUILDING PERMIT ISSUES Delays prompt changes SARA MATTHIS

unicipal building departments are struggling to keep up with the volume of work following Hurricane Irma. In the Village of Islamorada, the numbers are up, from issuing about 240 permits a month to about 300 a month. The City of Marathon has already processed more permits in the six months since Hurricane Irma — 4,018 — than it did in all of 2016. Monroe County’s numbers are up too; 4,500 permits since Irma versus the 7,400 in all of 2017.

Chris Gratton of Keys Contracting Services said everyone is overwhelmed right now. “We do construction work all over the Keys, and permits are just delayed.

I’ve been waiting months for a simple demolition permit in the Upper Keys, but it’s across the board.”

According to some sources, the wait is about three weeks for a roof permit and up to three months for new construction in some areas of the Keys, whether that’s a municipality or unincorporated Monroe County.

Contractors and permit issuers agree the amount of paperwork is daunting.

“I’m curious by nature, so I counted. A roof permit in Monroe County requires 62 pages of paper,” said Rainey Thompson of Guardian Roofing. “I actually bought a little red wagon from Amazon and loaded it with my paperwork to take to the county office. If you don’t laugh, you’re gonna cry.”

Marathon City Manager Chuck Lindsey said, “While we have received no federal or state reimbursement since Irma, we are doing our best to act as good stewards and always find improvements. With our current fiscal constraints, we are getting very creative on how to find efficiencies and speed up processes.”

One of the simplest methods of speeding up the process is using a “private provider service.” These are essentially private building inspectors, already approved by a local government, who come out to a site to review the work and finish the forms to be submitted for municipal or county approval. Currently working in the Keys are firms such as All Aspects and MT Causley, who employ certified planners and inspectors.

Gratton said a county inspector can be delayed and needlessly tie up a job supervisor who is waiting at a job site for the inspector. Scheduling is more certain with a private provider, he said.

At City of Marathon there is currently a backlog of 480 permits.

Monroe County has a backlog of 1,631 permits that have been applied for since Hurricane Irma. Numbers from the Village of Islamorada were not available at presstime.

On Tuesday, the City of Marathon proposed changes to its current fee schedule, a flat fee based on the cost of the project. For example, new construction permit costs used to be $625 for the first 1,000 square feet and 65 cents per square foot after that. Now, it would simply be $30 per $1,000 of the project’s costs. If the project is valued at less than $1,000, the homeowner would pay the minimum permit fee of $93.50.

“Using a percentage will speed up the release of permits. It takes much longer to do it the old way and time is of the essence to get people back in

their houses, keep construction workers working,” Gratton said.

Because the old system calculated by square foot, and the new system by cost, it’s difficult to quantify the difference. And while costs vary from project to project, it could mean some homeowners will pay more. Marathon Councilman Mark Senmartin said the speed of the new process is good, but the added burden to the homeowner is wrong.

“As far as remodels or additions go, the flat fee works fine,” said Senmartin. “But in new construction, you are really overpricing the job. For a $400,000 home, you’re going to pay $12,000 in permit fees plus another $3,000 for impact fees. In Marathon, we had 433 homes destroyed in the storm. We are penalizing those people with this new system.”

Marathon Councilman Dan Zieg said reducing the wait may be worth it to some homeowners.

“Right now some are waiting up to two months for a permit,” Zieg said.

“Under the new system we hand you your permit inside of 15 minutes. I think the homeowner is going to be tickled pink.”

Key Colony Beach also charges a flat fee — $40 per $1,000 of project cost.

It’s unclear how Marathon will deal with cost overruns that drive up the cost of the project — such as deciding to add a pool or dock — or how permit techs can know if a contract is fairly priced. Marathon City Manager Chuck Lindsey said the streamlined process is important to put people back in the their homes as quickly as possible.

“We are going to track this,” he said. “If the numbers or the process needs to be adjusted, we can do that.”

In Islamorada and Marathon, municipal personnel have been moved from other departments to help with the onslaught of work. Islamorada Village Manager Seth Lawless is one of those people. Earlier this week, he became the interim planning director when Cheryl Ciofarri left the village’s employ. Lawless will remain in the position until a permanent replacement can be found.
