What, if anything, is the lesson that the Monroe County School District can learn from these events?

“The tragic incident that took place last week in Broward County is a reminder to everyone in Monroe County regarding the importance of ‘See Something, Say Something’ as we work together to prevent such a tragedy from taking place in our schools,” said Superintendent Mark Porter. “It is a reminder to school and law enforcement personnel as to the importance of proper implementation of all safety and security measures, as well as a reminder to parents to be vigilant in monitoring the online behavior of their children.”

LETTER TO THE EDITOR Thank you, county The Tavernier Community Association would like to extend gratitude and appreciation for the hard work and efforts to partially re-open Harry Harris Park and on-going work to improve and repair the entire park. At the Feb. 21 BOCC meeting, the Commission will have an additional opportunity to support the Park by voting “yes” on agenda item C-20 to work with FWC via the FBIP program to repair the boat launch.

Much of this process would not be possible without the hard work, grit, and efforts of Monroe County and the leadership demonstrated by Monroe County Assistant Administrator Kevin Wilson. Mr. Wilson made himself available to the TCA general meeting in December, to a standing room fire house of Tavernier residents. Mr. Wilson maintained a professional demeanor in tense meeting with the post Hurricane Irma heat. He answered questions and made bold guarantees to the people. Mr. Wilson, and the Public Works department came through on those guarantees and the park is now partially open. Through these words and actions, the neighborhood has renewed confidence that the Park will return better than ever.

Local officials support “carve out” exemption to proposed vacation rental law

An issue brewing in Tallahassee could affect just about every corner of the Florida Keys. It’s about the character of Keys neighborhoods and property value and property rights and taxes. But for short, it’s referred to as “home rule.”

State vs. Local power: Home rule is the ability of local governments — think the City of Key West or Monroe County — to tailor laws to fit their unique environment and constituents; that’s above and beyond what state law stipulates. It is a part of the state constitution, added in 1968 — Article VIII, Section 2(b). The opposite of home rule is called preemption — the legislature overturning home rule because it conflicts with state law, or is inconsistent with the majority of laws.

Companion Senate and House bills that, if passed, would gut the concept of home rule are making their way through committee. Senate Bill 1400, authored by Sen. Greg Steube of Sarasota, and House Bill 773, authored by Rep. Mike La Rosa of Osceola County, would effectively strip local governments of the right to dictate how vacation rentals are allowed. Currently, both bills have a provision that would allow local governments to keep their “grandfathered” rules in place, but that could change at the next committee stop. Current Keys laws state there shall be no rentals of less than seven days in Islamorada and Marathon, or 28 days in unincorporated Monroe County. In effect, the bills would pave the way for nightly rentals not only in the Keys, but throughout Florida.

According to the Sun Sentinel, Sen. Steube sought to change state rule on vacation rentals after he bought a home on Florida’s east coast that he cannot rent due to local rules.

“I have always believed in the premise that it’s my property and I will do what I want with it,” said Marathon Councilman Mark Senmartin. “That

said, I also see myself as a responsible and courteous neighbor. The very thought of giving control to people in Tallahassee that have no idea about our community makes me angry. We are big boys and girls and are capable of managing our issues without their ‘help.’”

The House bill is set to be reviewed by the Government Accountability Committee on Feb. 22. The 23 committee members include Rep. Holly Raschein who represents the Florida Keys.

“While the issue of regulating vacation rentals is a concern to many local governments around the state, in the Florida Keys the challenges we face are even more pronounced,” Raschein said. “We are the only area in the state that operates under a ROGO system with a finite number of building permits remaining. We recognize the important role that tourism plays in our economy; however, it is critical that we find a way to balance these vacation rentals with the need to provide long-term housing for our workforce, especially in the wake of Hurricane Irma.”

The House bill is set to move to the Commerce Committee next before it can be heard on the floor and voted upon. The Senate bill has passed the Regulated Industries Committee and is set to move to the Appropriations Committee next.

Many in the Keys oppose the idea of the state setting vacation rental law.

To that end, Monroe County, Village of Islamorada and the City of Marathon have co-authored an amendment to the bills, or a “carve-out.” It would exempt state Areas of Critical Concern, which include the Keys. (There are four Areas of Critical Concern in Florida, but

only Monroe County has a substantial population.)

The amendment sets out not only an exemption to the bill, but also the right to change its existing, grandfathered law. Since 2011, state law dictates that no municipality may change its vacation rental law — at all — without losing its grandfathered status and reverting to state law.

Besides the Keys, organizations within Palm Beach and Longboat Key have expressed dismay. And Monroe County Attorney Bob Shillinger said regardless of whatever bill may or may not pass, this is simply a zoning issue, one that Monroe County is monitoring closely.

“Zoning laws have been in place since the 1920s,” he said. “This essentially is allowing a commercial enterprise in a residential district. It’s the equivalent of putting a hotel in a residential district.”

Value and taxes: The implications of a preemption by the state to govern local vacation rental goes beyond the fear that a Keys homeowner may be subject to nightly, rowdy parties at the vacation rental next door. This is also about a home’s value and taxes.

Real estate professionals agree that a vacation rental home is easier to rent by the week than by the month.

That means real estate investors would choose a home in Marathon over one, say, on Big Pine Key, and possibly pay a premium to do so. The other side of the coin is also true but less common — that someone buying a second home who doesn’t intend to rent it out may wish to own in a neighborhood with a minimum of transitional neighbors.

Some think the state’s preemptive strike against vacation rental law is too radical to come to fruition. But consider that last year, the state did the very same thing when it came to transportation network companies Lyft and Uber.

MONROE COUNTY

In Monroe County, vacation rentals pay a so-called “bed tax” — 12.5 percent of the value of the rental. For example, a $1,400 per week three-bedroom, two-bath home rental on a canal would generate $175 in taxes. In December 2017, the Monroe County Tax Collector collected almost $3.5 million in bed tax. Of that, $1,036,000 was generated by vacation rentals, not hotel rooms. The county sends 7.5 percent of that to the state, and 5 percent stays local. The local money goes into the Tourist Development Council fund that advertises the Keys as a destination, and also pays for brick and mortar projects of a touristy nature.

Airbnb, an online service for people to lease or rent short-term lodging, is a proponent of the state exemption of vacation rental law. Airbnb reported that in 2017, some 40,000 Florida hosts earned a combined $450 million by renting out lodging to an estimated 2.7 million guests. However, the company has a checkered past in Monroe County when it comes to paying bed tax. Back in 2016, it offered an undisclosed monthly amount for bed tax, but refused to allow the county to verify the rentals by homeowner name and address. Monroe County declined and yet Airbnb still has a smattering of listings in the Keys. According to the tax collector, Airbnb tells owners they are paying the bed tax, but the county has received no money. The tax collector administrators report that similar companies, such as VRBO, are more compliant.

Of course, every homeowner is subject to property taxes and insurance costs. Those high costs, said real estate broker Brian Schmitt, compel some homeowners to rent their homes to tourists. He said that in his neighborhood, four long-time owners of second homes started renting after the recession of 2008.

“Even if you don’t have a mortgage, that’s a cost of $1,000 to $2,000 a month for the lawn service, pool service, running the a/c and paying taxes and insurance,” Schmitt said. “If they didn’t short sell, they had to change the way they thought about their houses or else sell into a depressed market and take a hit. They are renting today because it was the best option. And, remember, these people don’t enjoy the homestead tax exemption and have no ability to vote.”

Schmitt continued, “But at the end of the day for me, being in the real estate business, I have to respect property owners’ bundle of rights and I expect that they would respect, hopefully, me too — the people who are living here. And, by and large, that has been my personal experience.”

It struck down local governments’ laws regarding the regulation and number of taxis to allow Lyft and Uber to operate in every city. There are other bills challenging home rule afloat this session, as well. For example, House bill 521 would void local tree regulations.

The Senate and House bills are expected to be heard in at least two committees each before reaching the floor for a vote. There are only 16 days left in the legislative session.

SCOTT RUSSELL KNOWS THE HUSTLE Monroe County’s property appraiser is a funny family man

“I

have literally been in the appraisal sector from the beginning,” said Monroe County’s Property Appraiser Scott Russell, who took an elective course in college. “I was hooked after the first class because it’s the perfect blend of desk work combined with the ability to get outdoors to complete property inspections.”

He was born in Key West and raised on the island.

After high school, he started at Florida Keys Community College before transferring to Florida State University, where he studied finance and real estate. His first job in 1991 was appraising homes in the Keys. “I have to give credit to Kevin Talbott of Appraisers of the Keys,” Russell said, while also crediting his long-term predecessor Ervin Higgs.

“Kevin gave me my first job and was a mentor of mine, teaching me the practical side of appraising.”

Along the way, the family man married his wife Dianne in 1993, and had three daughters, Kaitlyn, Amber, and Emily. “My middle child, Amber, has Down syndrome; she is truly remarkable,” he said, while boasting about all three of his daughters.

He is typically referred to as Amber’s dad. After she was born, the Russells thought about moving away from the Keys. “We quickly realized Key West was where we needed to be,” he said. “Key West is an amazing community when it comes to that, truly welcoming.”

How long has your family been in the Keys? My great-great grandparents came to the Florida Keys via the Bahamas during the 1800s.

What is the biggest challenge facing your office today? The biggest challenge is Monroe County is a very linear county; this translates into staff spending quite a bit of time traveling to inspect properties. Finding comparable sales is a challenge because there are very few, what we call, homogenous neighborhoods.

What percentage of homes in Monroe County carry a homestead exemption? Approximately 37 percent.

Best piece of advice you ever received? Think before you speak. I have learned to sleep on it and I typically wake up with a different perspective. You can’t un-send that email or take back those comments made in haste.

What is your nerdiest passion? Excel; I am a junkie. I write spreadsheets for everything. Without putting your readers to sleep, the statistics needed in the analysis that comes with the job contain what seem to be countless variables, and Excel allows me to keep tabs on key statistical measures.

What was your first thought this morning?

I need to answer those 20 questions The Weekly sent to me.

Favorite guilty pleasure?

Eating. Someone once said that there are two kinds of people, those who eat to live and those who live to eat; I’m in the second camp.

If you could change the world, what would you do? That’s a loaded question; I’ll go with the pageant answer of “world peace.”

Favorite place you’ve lived? Well, I’ve lived here 46 of my 49 years, so I can’t imagine being anywhere else.

What did you want to be when you grew up?

Sheriff’s Deputy. Seeing my dad come home in that uniform, there was nothing better.

My wife Dianne would describe me as … a caring provider. There were lean times during my early years with the property appraiser’s office and I took several additional jobs to be able to provide for the family.

NAUTICAL FLEA MARKET IS THIS WEEKEND Popular Upper Keys event raises scholarship funds

T

he signature fundraiser of the Upper Keys Rotary Club is the Gigantic Nautical Flea Market held at Founders Park in Islamorada, set for this weekend — Saturday and Sunday, Feb. 24 and 25. It runs from 8 a.m. to 5 p.m. on Saturday and 9 a.m. to 3 p.m. on Sunday.

Festival organizers say there will be more than 300 vendors set up at the park located at MM 87.

“There is a basic nautical theme, but you can find so much more than that,” said Rotary member Bette Brown, listing everything from art to apparel to home goods. “There is a lot to see, so wear comfortable shoes!”

The festival also features plenty of food and drink at affordable prices — from Bloody Marys to burgers and everything in between.

The food booths are near the park’s beach so guests can nibble and sip with toes in the sand.

The purpose of the event, though, is not shopping — it’s education. The Key Largo Rotary Club and the Upper Keys Rotary Club donated about $150,000 a year to college students from Coral Shores High School and Island Christian School. Some sophomores, juniors and seniors at higher learning institutions reapply for the scholarships to support them throughout their schooling. From 2012 to 2018, the event has raised $500,000 in direct scholarship aid for local students pursuing professional or technical degrees. The two clubs also donate $60,000 a year to the Take Stock in Children scholarships — a countywide program that provides free college tuition for highperforming students from low-income situations.

“The Rotary Club Scholarship awards result from the effort of hundreds of people in the community who work the annual Gigantic Nautical Flea Market,” said Rotarian Frank Derfler.

This event has grown in popularity to the point it causes traffic delays in the Upper Keys. To alleviate the problem, organizers offer plentiful parking at the nearby Coral Shores High School located at MM 89. A shuttle bus starts at 8 a.m. with scholarship student “docents” acting as tour guides.

The event is pet-friendly and the site has restrooms, ATMs and free Wi-Fi. Festival-goers can also access an interactive app on a smartphone that reveals the exact location of specific vendors. A suggested donation of $5 will be collected at the main gate on the southwest corner of the property, nearest the fire station.

T

he more than 100 artists who make up the Art Guild of the Purple Isles are buzzing. With an award and private reception on Wednesday, March 7 from 5:30 to 7 p.m. at the Keys History & Discovery Center, the 52nd annual Judged Members Art Show is fast approaching. The Discovery Center will display the artwork to the public every Thursday through Sunday from March 8-25 during museum hours – 10 a.m. to 5 p.m. Admission is free, and includes the discovery center.

Awards will be presented for nine categories: oil, watercolor, acrylics, plein air, sculpture/3-D, photography, digital art, other media and pen, pencil, and pastels. This year’s show chair is Sharron O’Brien.

“The art guild is working hard with the community to make sure the Keys bounce back stronger than ever.

We’ve allocated funds to those who have been impacted and affected by Hurricane Irma – all of it being raised

by artists through their work,” said O’Brien. “We’ve also partnered with local businesses to keep the proceeds and funding local. And the History and Discovery Center is such a great venue; everyone has been giving extra effort this year.”

Watercolor artist Janice De Jong and plein air artist Priscilla Coote have been chosen as this year’s judges.

With a degree in art education, De Jong was destined to inspire in the classroom. She taught at Westminster Christian School, 10 years in elementary and 22 years teaching high school art and photography. Her students have won local and national awards and grew their portfolios before reaching higher level education, thanks in large part to De Jong. After retirement, however, De Jong then became the “student” of watercolor guru Dottie Greene for 10 years. As a member of the Miami Watercolor Society, she’s chaired exhibitions for three years.

As an award winning artists, De Jong was welcomed as a signature member of the Florida Watercolor Society in 2006.

Coote will be representing the Key West art scene as one of only 13 artists invited to be featured at the Fabulous Florida exhibition in Flagler Beach in March.

“I expect to see a wide variety of subjects and media, as each artist focuses his or her own interpretation, education and life experiences into a small tangible form to share with us all,” said Coote. “Fortunately, I have evolved a set of tools I always use when judging a show, which enables me to approach it with a high degree of objectivity.”

A lifelong artist, she is known for the realism in her plein air works and studio creations. (She’s that good.)

Coote primarily uses oils, watercolor, and gouache, a glue-like substance.

Her ability to paint water is remarkable. Her work was recently on exhibit at Gallery on Green and has been featured in magazines, Netflix’s “Bloodline,” and on HGTV’s “Island Hunters.”

She’s a Signature Member of the American Society of Marine Artists and experienced show judge.

To stay organized during judging, and limit bias, Coote says she’s formed a checklist over time of “universal principles” that include: composition, technical mastery of medium, and success in conveying a chosen message.

“Artists, you may feel anxiety once you have submitted your finest efforts and are awaiting the results. But you should feel at ease instead, because the ball is now in the judges’ court,” said Coote.

The show’s more than 120 original works will be on display March 8 to March 25 upstairs at the Keys History and Discovery Center located next to the Island Resort property, MM 82 oceanside. For information about the reception, show, or the Art Guild of the Purple Isles visit www.agpi.us.

TWO “GREEN THUMBS” UP Club goes all out for 38th Garden Walk

n. Feb. 17, the Garden Club of the Upper Keys invited visitors to tour five private gardens for its annual event. This year’s Garden Walk venues consisted of a combination of commercial and residential properties.

The self-guided tour stops – Bayfront Hammock, Sunfish Circle, Coconut Harbor, Artists Trail, and Palm Corner – were prime and ready to go. The club’s “home,” The Francis Tracy Garden Center, hosted a tea party with seemingly endless baked goods. A lot has changed since the first Garden Walk in 1980. What hasn’t changed is the devotion and pride that Garden Club members put into the event.
