RISING WATERS FIRM helps navigate home flooding issues

IRM (Fair Insurance Rates In Monroe) is always trying to help. Navigating wind and flood insurance with changing policies and government requirements is difficult for any Keys homeowner.

FIRM, which is funded in part by grants from the Community Foundation of the Florida Keys, the City of Marathon, and member donations, has been holding a series of free workshops tackling flood issues. This week, the second series of workshops took place in Key West, Key Largo and Marathon, teaching the community the ins and

wins all the time, so you have to have a plan.” Scott seemed hopeful about getting more supplemental federal grant funding to help residents elevate their homes, but urged everyone to write their congressman about it all the same.

Mel Montagne, president of FIRM, is encouraged by the response and hopes residents take advantage of the workshops. But for Montagne, the biggest issue is the looming expiration of the National Flood Insurance Program (NFIP) that Keys homeowners with a mortgage MUST have. It was to expire on Sept. 30, but federal lawmakers put a stopgap extension in place then. “The government has been kicking the can on this one and hopefully we will hear this week,” said Montagne. If the program is re-authorized, it’s most likely to have a five-year term.

The NFIP is huge. Nationwide, there are 5 million policies, and 3 million of those are in Florida. Monroe County has 30,000 flood insurance policies on the books. If the program expires, not only will it affect homeowners with existing mortgages required to have this flood coverage, but also the real estate industry and those seeking to buy and sell today. The lapse could delay or cancel “approximately 40,000 home sale closings per month nationwide,” according to The National Association of Realtors.

Congress must now reauthorize the NFIP by no later than Jan. 19, 2018.

CITY OFFICIALS CHANGING ORDINANCES TO COMBAT COSMETIC SCAMS

O

ver the last two years, pages and pages of complaints have been filed with the Key West City Attorney’s office — the result of the cosmetic store industry practices in Key West. Written statements are filled with phrases like “not given price of product,” “pressured into buying,” “tried to return,” “no written estimate,” and “no refund.”

Most of these were filed by tourists who, after returning home and checking the credit card bill, were shocked to find they had been charged thousands of dollars for cosmetic products.

Complaints range from the product’s price not being clearly stated before purchase, off-premises canvassing (hawking on the sidewalk), products that are unusable, and not being able to receive refunds or make returns.

So far, the City Attorney’s office has handled 19 cases, five that went to hearing and one which was dismissed.

The cases usually result in settlement, but not without legal strong-arming.

But, according to Code Enforcement officer Jim Young, 61 complaints have been filed since 2014. That’s enough to prompt City Attorney Shawn Smith and Chief Assistant Ronald Ramsingh into action. At the commission meeting on Jan. 3, staff told the commissioners that the stores weren’t going to change their game, so the city has to change the rules.

Often the sales pitch starts with the simple application of a “sample.” In the U.S., samples are usually free —a common practice, from food to perfume.

However, at the Key West cosmetic stores on Duval Street, the samples end up on the total receipt of purchase and at outrageous prices. A dab of face cream could result in a charge for an 8-ounce bottle, which could cost hundreds of dollars. It’s hard to determine the price because the shops often do not lawfully display it.

The protest at Tresor Rare on Duval Street was an effort to obtain a refund for an Alabama couple’s $3,100 after they suffered an allergic reaction and were unable to return the product. HAYS BLINCKMANN/Keys Weekly

Key West’s current law states, “No permit holder shall commence or initiate the application of cosmetic samples in any form for a customer without first furnishing to the customer a written statement showing the final total cost of the item or service to be purchased by the customer.” The problem with the law is the “to be purchased” phrasing. In April 2017, Magistrate Donald Yates declared the city ordinance too vague and, as a result, the city lost a case against one of the stores.

Ramsingh said the judge declared the cosmetics store employee could not guess what was to be purchased.

“Vagueness is a constitutional challenge,” he said. “In order to bring the regulation in line with that ruling, we need to remove that phrase,” said Ramsingh. “So, if the new ordinances passes, we will not need to verify whether or not the samples were actually purchased; we will require an estimate before any samples are applied — irrespective of they are eventually purchased or not.”

The tweaks to the law have the commissioners’ support. Only Commissioner Sam Kaufman, an attorney, said removing the phrase isn’t enough.

“You’re going to get defense lawyers still arguing ... This is not a complete fix for me,” he said. Kaufman urged city staff to close all the legal loopholes

the cosmetic stores might exploit. The commission directed staff to come back with more aggressive measures to deal with what Mayor Craig Cates calls “predators.”

One of the areas City Attorney Shawn Smith is looking at is looking at is tougher enforcement of the off-premise canvassing, or hawking goods on the sidewalk. Ordinance Sec. 1-15 of the city code allows the city to seek prosecution of those violations in county court as a second degree

misdemeanor, punishable by up to 60 days in jail. “I’m talking about imprisonment,” said Smith, who also suggested more undercover sting operations.

For now, the burden of enforcement falls upon the employees of Code Enforcement. Staff says they are further hampered by stores that remove employees listed in the complaints, change ownership and even the store name to confuse the prosecution.

The city’s consideration of the latest amendments is not yet scheduled.

STROLL AMONG THE DEAD

Cemetery walks begin Jan. 27

T

he first Cemetery Stroll to be offered at the Historic Key West Cemetery this season will take place on Saturday, Jan. 27. During the stroll, small groups of visitors will be escorted to gravesites where interpreters will tell the stories of the deceased in brief monologues. The groups are scheduled for departures at 9:30, 9:50, and 10:10 Reservations are necessary, and can be made by calling 305-304-1453.

Among the gravesites to be visited are those of the Los Martires de Cuba, the Figueredo plot, the Benjamin Albury family restoration, the Otto plot and Piedad Ayala.

The tour will take about 90 minutes. Participants should wear comfortable shoes and plan to walk over a mile on uneven ground. Bottled water will be provided.

The stroll allows participants to learn about some of the people who have given Key West its character.

Space is limited for the tours and pre-registration is required. A donation of $20 (cash or check) per person to the Historic Florida Keys Foundation is recommended. Participants should enter the cemetery by the Frances Street gate and go to the registration table on 2nd Avenue.

Additional strolls will take place on Feb. 24 and March 24.

erman physicist Werner Heisenberg’s “Uncertainty Principle” states it is impossible to precisely know the position of a particle, as well as its momentum, at the same time.

Put two unpredictable, charismatic and wildly dissimilar characters on stage, and the same theory will apply. This is the premise of playwright Simon Stephens’ relatively young play titled “Heisenberg,” at The Studios Of Key West Jan. 25-28. Starring local legend Mike Mulligan and Chi-

cago talent Dana Black and directed

by Dennis Zacek, artistic director emeritus of Chicago’s Tony Award recipient, Victory Gardens Theater, the play is a modern romance full of extraordinary dialogue and charming twists.

“There is a freeness in the way it is written,” said Black, who came to Key West from Chicago just for the part. “It is how people speak but also their inner dialogue is spoken as well, so it’s more revealing.” Black, who mostly does theater, also works in television and recently appeared on an episode of “Chicago Med.” “Heisenberg,” hailed as a realistic comedy, is set in six scenes and 80 minutes with no intermission – and it should be noted, not once is Heisenberg actually mentioned in the play.

Alex Priest, played by Mulligan, is a lonely and reserved 75-year-old butcher who meets 42-year-old dramatic Georgie Burns, played by Black. Their relationship unfolds as she enters his life like a frenetic thunderstorm, as part con artist and part crazy woman. But eventually, Georgie serves as a catalyst for change that Alex, given his age, thought could never happen again in sex, love and life.

“It’s about making the world better in doing, not just being,” said Mulligan. “It’s life-affirming and reminds us to keep our eyes open throughout life’s journey.” Mulligan, who worked with Zacek last year on the stunning production of “Blackbird,” was immediately charmed with the transformation of his character, identifying with the idea that life will always have uncertainty and wonder.

The play’s minimal set of simply two tables, two chairs and two actors puts the spotlight directly on Stephens’ writing and Black and Mulligan’s acting.

“It feels very personable,” said Black. “The pace of the conversation is very important.”

Written in 2015, the play has only been produced in New York, Los Angeles and London and now Key West and has earned a 2017 Tony nomination for best actor.

mergency management officials and Monroe County administrators held six public meetings from Jan. 8-15 to gather feedback from Keys residents regarding Hurricane Irma. The openforum meetings were also a way for emergency staff and administrators to talk about some of the things done right and wrong, before, during and after the storm. County officials also announced the formation of all-volunteer groups for each area to debate areas of improvement in detail.

The meetings, which followed a similar format, were led by Monroe County Senior Director of Strategic Planning Kimberley Matthews and Monroe County Emergency Management Director Martin Senterfitt.

Islamorada’s meeting was centered on pre-storm planning and preparation, medical facilities, utility concerns, FEMA’s role in emergency management, reentry, supply and location of fueling stations, volunteer coordination and communication.

“I am very pleased that the county staff is soliciting input on Irma — what we did well and what we can do better,” said Islamorada Chamber of Commerce Executive Director Judy Hull.

“Getting the citizens and businesses involved in the solution is a great idea and I look forward to participating in the process.”

In Marathon, the main talking points included public communications, re-entry into the Keys, Boot Key, and shelters. In addressing shelters, Sheriff Rick Ramsay explained the challenges of housing citizens and emergency personnel into a space, the high school, not designed to serve as a permanent shelter, but rather a refuge of last resort. Ramsay followed up by stressing the importance of mandatory evacuation.

At the Marathon meeting, Senterfitt also discussed the idea of having pre-storm contractual agreements with private individuals, businesses and entities that could assist in immediate post-storm recovery.

The Lower Keys meeting drew a full room. Among those attending was Big Pine resident Tommy Ryan. Ryan, a retired New York City firefighter experienced in emergency management, called the meetings “productive” but had some suggestions.

“I personally feel they need to have more specific meetings for each item they talked about,” he said. “The one idea I totally disagree with is the concept the county has to leave the worst hit area to clean last. If they had done it in the beginning ,I think it would have been a different story.”

Housing, marine debris removal, and reentry were also discussed at the meeting.

“Our team attended each of these public meetings to ensure any concerns that came up regarding federal assistance would be quickly communicated to the congressman and appropriate agencies,” said Joanna Rodriguez, communications director for U.S. Rep. Carlos Curbelo. “The biggest takeaways were a general frustration with communication, reentry after the mandatory evacuation, and debris removal.” She said a new Emergency Operations Center seems to be one of the most actionable solutions proposed, as well as re-examining federal debris removal laws and pre-determining debris sites.

followed by a 6 to 8 p.m. dinner of classic Key West/Conch recipes featuring produce grown at Grimal Grove. The meal is to feature alligator pear salad, shrimp and grits, whole pig and fish roast, with traditional Conch sides and sauces.

Key West Food Tours creator Analise Smith returns as coordinator of the Picnic’s Conch Cook-off – a competition in which Conch cooks vie for the winning title and a cash prize.

t’s rare that the family business is folk singing but it’s just a way of life for the Guthrie family. Spanning generations, social movements and influencing singer songwriters for almost 80 years, the Guthries have built the framework for American folk music. Still going strong, the Key West Theater will host Arlo Guthrie, at 70 years old, along with his son Abe and daughter Sarah Lee for their Re:Generation Tour Jan. 26 and 27.

The night will be filled with the family legacy of storytelling, bits of lore and history, as well as some of the greatest folk music crafted.

“I grew up chasing Dad’s bus as it left the farm to tour. I always wanted to be on the bus,” said Sarah Lee Guthrie, Arlo’s youngest daughter and musician. “Now the circle is unbroken, and to have generations up on stage, it’s phenomenal and I am so grateful.”

The foundation of the Guthrie music was instilled in American culture by Woody Guthrie, Arlo’s father and Abe and Sarah’s grandfather. In 1940, as an alternative to “God Bless America,” Woody penned the famous “This Land is Your Land” that still resounds today.

Woody become the most influential folk singer, working with Pete Seeger and eventually inspiring a young Bob Dylan. Growing up with his father’s music, Arlo made it big in his own right in 1967 with his satirical, counterculture hit “Alice’s Restaurant Massacree” that was 18 minutes long and tackled the Vietnam draft, American blind justice and littering. His biggest Billboard hit was his rendition of “The City Of New Orleans.” Later, Guthrie started one of the first indie labels, Rising Son Records, and has appeared on television with recurring roles in two major network television series (“The Byrds of Paradise” and “Relativity”), and feature films “Alice’s Restaurant” and

“Roadside Prophets” (1992), and has authored three children’s books.

Since Abe and Sarah Lee grew up surrounded by music, the family legacy seemed inevitable. Abe joined his father’s band in the ’80s as a producer and keyboardist and Sarah Lee has recorded multiple albums of original music for two decades.

“The stage is a sacred space for us,” said Sarah Lee Guthrie. “Watching our father, we know what a powerful tool music is. He is one of the last great storytellers and he can bring a whole room together.”

Arlo and Sarah will be trading off on songs, his and her originals as well as some family gems. “We like old school theme with instrumentation, such as Dad playing the banjo, harmonizing and telling stories,” she said. “We’re blue collar singers. It’s a blessing being a folk musician without the pressure of mainstream.”

What class has best prepared you for life after high school? Mr. Whaley’s AP Calc class and Mrs. Blythe’s AP Physics class. Whaley teaches like a college professor and Blythe’s class taught me life skills.

What advice would you give to underclassmen? I’d tell underclassmen not to be afraid to try out a sport or club because they are nervous. They may just find a passion they love. I regret not trying out for lacrosse my freshman year.

What is your favorite social medium, why, and whom do you follow? My favorite social medium is Snapchat, because I can talk to all my friends and see what they are doing. I like to follow my friends who graduated last year.

What do you want to be remembered for at Key West High School? I want to be remembered for being a person the younger people on the swim team could look up to. I always looked up to the older kids when I was on the Bone Island Swim Club knowing that I wanted to do that when I was older, too.

Who has been your biggest inspiration at Key West High School and why? My biggest inspiration has been Coach Lori Basco. She has been my coach throughout high school and has inspired me with her selflessness. She deserves a lot of appreciation for all the hard work it takes to keep the swim program up and going.

AUTHOR MAKES POINTS TO STUDENTS WITH PERSONAL STORIES

amaica Kincaid, internationally celebrated author, visited the Key West High School as a part of the Key West Literary Seminar last Friday. She addressed seven classes of junior and seniors and kept them laughing with her wit and wisdom. On the heels of the president of the United States declaring Haiti a “sh#hole,” Kincaid – who is from another Caribbean island, Antigua – quickly made light of the offense before the students. “Sometimes people do remarkable things from sh#tty countries, and not just Norway.” The author, now a professor of African-American studies at Harvard, kept the students engaged with personal stories. Kincaid told them she wrote a 600-word sentence because she wanted to, wears pajamas during the day and could read at 3 years old because, as she said, “I like to subvert expectations of me.” The biggest hurdle for Kincaid’s career was not the color of her skin – she grew up in an all black society on Antigua, so what did it matter? – but having the courage to write what she wanted to and the way she wanted to, being herself. She left the kids with these words of wisdom: “The certificate to happiness is

to find out what you want to do and do it well, and then hope it feeds you.” She also recommended reading “Paradise Lost”

by John Milton, a book she was punished once to write out every single line, as well as the King James Bible and the Oxford English Dictionary cover to cover.

FULL SPEED AHEAD Workshop discusses testing, budget

T

he Monroe County School Board met on Tuesday at Coral Shores High School to discuss the testing calendar for students and take the first glimpse into next year’s budget.

Testing calendar for students Monroe County School District and Executive Director of Assessment and Accountability David Murphy asked for an extension to the testing calendars from the state due to lost instructional time due to Hurricane Irma. Most tests were extended by a week across Florida, but Monroe County was offered opportunities to push writing, reading, and science additional weeks. The issue is that if testing is done late, then the school’s “state grade” will come back late and the testing will coincide with high school AP testing.

“When we talked about this initially with principals there was hesitancy because of the late reports, but after the principals talked to their leadership teams, all agreed that they would like to test as late as possible,” said Murphy. “The principals will have the flexibility to do what they think is best for the students.”

Board member Ron Martin agreed.

“We are honoring what the building leaders wanted; they are the guys and girls in the trenches,” he said.

Superintendent Mark Porter added that responses to modify the testing schedule usually go unrecognized. “Perhaps there is some empathy for our students and teachers this year,” he said.

“Students are the product.

That’s the main goal to make sure we can give teachers what they need to produce the best product.”

Board member Andy Griffiths said the board should send a thank you letter to the state for the leniency.

First glimpse of the financials for 2018 Three different prognostications were presented to the board by Executive Director of Finance and Performance James Drake.

In all, the district needs to add somewhere between $1.8 million to $2.9 million to the budget. “The state keeps reducing its support for the district,” said Drake.

“We need something a little better than the past couple years,” said Porter. “The value goes up a little every year since 2012, but the value will be back where it was in 2006 for the 2018-2019 budget. Just because the value goes up doesn’t mean that the district would end up with more money because the state can roll back the local required effort or LRE.” Since the request was prepared Aug. 3 before Hurricane Irma, Drake said the data doesn’t mean a whole lot right now. The new assessment will be made Jan. 23. “We don’t have a good idea of the effect of Irma on school taxable values,” he said. “But, after Wilma, our taxable values skyrocketed.”

(Side note: The anticipated estimate rises even in the wake of a hurricane because in the case of lost mobile homes, because the assessment is more on the value of the land; and in the case of other damaged homes, improvements will be made, making them also worth more.)

Staff at Florida Department of Education expect that Miami-Dade, Broward and Hillsborough are significantly under their enrollment estimates, meaning a lot of the state dollars will go to the under-enrolled counties.

Orange and Osceola counties’ enrollments are up. Eventually the averages will self-correct.

“In our county, most of the value is in land,” said Drake, adding that about 60 percent of the homes are not homesteaded in Monroe County. Therefore, the brunt of the money comes from investment homes, second homes, and commercial property.

“This is where being a 90 percent county helps us, that’s why we generate more funding than similarly sized districts,” said Drake.

Monroe County is almost always the highest funded on a per-student basis in Florida, mainly because of the cost of living. “Some counties are not very rich,” said John Dick. “We are a 90-percent county, which means we are a rich county from our tax base and a lot of our local money goes into our schools.”

The district’s school board budget meetings will begin March 5.

istoric Tours of America hosted their 5th annual “Season Kickoff Party” this past week.

HTA, along with more than 300 industry supporters, partners and friends were on hand to celebrate the launch of the industry’s busy season. “I don’t even like to call it an HTA party,” said HTA Marketing Coordinator Monica Munoz.

“We started it to honor our partners and friends who support us and over the years the event has

become more about them. It’s their party and that’s just how we like it.” More than 15 vendors were on hand to dish out fresh eats, drinks and homemade paella, with live music from The Durtbags. Attendees also had the opportunity to win coveted raffle prizes — including trips to the Dry Tortugas, Nashville and four $500 certificates for a cruise. Moreover, $700 from the event was donated in support of Sister Season.
