The paper ballots will appear in the Weekly only twice. Once this week, and again next Friday, Aug. 25. Voters have until Monday, Aug. 28 at 5 p.m. (sharp!) to turn those in. After several grueling days of paper ballot counting the top three in each category will appear in an online ballot that begins on Friday, Sept. 1 at 5 p.m.

Once the online balloting begins, voters have a leisurely 21 days to consider the top of the charts. The voting ends on Friday, Sept. 22 at 5 p.m.

Speak up about wind insurance Fair Insurance Rates in Monroe (FIRM), will testify at the Citizens Property Insurance Corporation (Citizens) rate hearing before the Office of Insurance Regulation (OIR) on Wednesday, Aug. 23, vigorously opposing any further increases in windstorm insurance rates by Citizens for Monroe County.

This is the eighth consecutive year that FIRM appeared and testified against further rate increases. In past years, no consumer organizations other than FIRM testified.

The rate hearing will be held at 4 p.m. at Florida International University Biscayne Bay Campus and can be seen live on the Florida Channel website at www.thefloridachannel.org. FIRM encourages interested citizens to attend and show support, and we are currently working on a coordinated effort to assist with that endeavor. FIRM will testify that Citizens has unfairly raised windstorm insurance rates for Monroe County so that they now are over 220 percent of the 2010 rates. This has resulted in Monroe County paying premiums totaling more than $700 million more than claims since 2004. FIRM will argue that the four state-approved windstorm rating models utilized by Citizens yield widely inconsistent results when applied to Monroe County. Equally troubling is the fact that despite a statutory mandate to provide affordable insurance, Citizens has consistently chosen the model that is least favorable to Monroe County.

FIRM is still awaiting the results of its legal proceedings against the Florida Office of Insurance Regulation (OIR) concerning the 2017 rate increases. FIRM alleges that OIR had wrongfully denied FIRM its lawful right to present its case before an Administrative Law Court. If FIRM is permitted to bring its case before an Administrative Law Court, FIRM will seek to show that the rate setting methodology utilized

by Citizens and approved by OIR is flawed in many respects as it relates to Monroe County.

Fire burns home in Marathon A member of the Monroe County sheriff’s office lost everything in a house fire that occurred in the early morning hours on Aug. 10 on Gulfstream Boulevard. Many in the community know Monroe County sheriff’s office crime scene investigator Detective John Underwood. He, his wife, their children and grandchildren were all living in the home and have lost most if not all of their belongings.

John’s friends and fellow employees at the sheriff’s office have set up a Go Fund Me account to help them recover (Search “help the Underwood family” at www.gofundme.com). Any and all donations will be much appreciated.

There will be two fund raisers to benefit the family next weekend: On Saturday, Aug. 26 from 11 a.m. to 1 p.m. at Marathon Community United Methodist Church, and on Sunday, Aug. 27 from 2 to 6 p.m. at Overseas Pub & Grill.

Habitat can help with critical repairs Habitat for Humanity of the Middle Keys is accepting applications through Sept. 30 for its Critical Home Repair Program. This program is specifically focused on repairing or replacing stairs leading into your home, or repairing or installing a wheelchair ramp, to improve safe access to your home. n her 90s, Betty Walker is slowing down – to the extent that she no longer plays 18 holes of golf … just nine. Oh, and earlier this summer the Marathon resident popped up to Canada for the unveiling of a special exhibit at the Naval Museum of Quebec. The family yacht, a 1937 Chris-Craft had been found and fully restored. It has a long and storied history, now properly celebrated by our northern neighbor for its role in the Canadian Royal Navy during World War II. The history of this remarkable boat began on the day Britain declared war on Germany on Sept. 3, 1939. Canada immediately followed suit. The news came over the boat radio while the Caldwell family — Betty’s natal family — was “camping” aboard the vessel in the Thousand Islands of Canada.

“My dad heard the news and said, ‘That’s it. We’re going home,’” recounts Betty. On the following day, he presented the boat to the Canadian Royal Navy.

The gift, or appropriation, of non-war ships during wartime for war uses wasn’t an anomaly. (In the U.S., the practice dates back to the Spanish-American War.) According to the Juno Beach Centre Association — a Canadian non-profit with a museum in Normandy, France — the Royal Canadian Navy started the war with only 13 boats. By the end, it had 450 ships in all, including two cruisers, 17 destroyers, 67 minesweepers and 12 “armored yachts.”

This impressive fleet made the Royal Canadian Navy the world’s fourth naval power, according to the museum.

The Jeffy Jan II, named after the first son and daughter of two brothers who owned a mill in Canada, was a 36-foot Chris-Craft cruiser. Betty recalls she and her older brother (Jeff) having watermelon seed-spitting contests off the aft of the boat.

During wartime, however, the boat was used to transport dignitaries to the larger warships based at the mouth of the St. Lawrence River.

“The yacht was used for the entire duration of the war. In 1943 it was used by Sir Winston Churchill as his private harbor ferry when secret talks were held in Quebec City with President F.D. Roosevelt to develop the strategy for the Normandy invasion the following year,” wrote Betty’s son, Michael. “As a result, our family

pleasure boat became known as ‘Churchill’s Yacht’ to everyone associated with the Canadian Navy’s war effort around the port ... pretty heady stuff.”

After the war, the boat was acquired by a couple of families but wasn’t “found” again until 2015. Betty learned of it when the director from the Naval Museum of Quebec contacted her for some backstory. The boat was then fully restored to 1937 standards and put on display.

“I think the Jeffy Jan II is like the ‘The Little Engine That Could,’” said Betty.

Litigant continues to file new ADA lawsuits Local lawyers advise checking business websites SARA MATTHIS

ince Juan Carlos Gil filed suit against Hawks Cay Resort in July, he has filed 11 more lawsuits against other companies, including Ann Taylor Inc. Gil, a blind man, alleges that the companies’ websites don’t function with his reader software, preventing access to the entire site. This brings his total number of ADA-related lawsuits to nearly 100.

In June, he won a federal lawsuit against Winn-Dixie in which he asserted the Winn-Dixie website violated the Americans With Disabilities Act (ADA) because it was not fully accessible to the visually impaired. Federal Judge Robert Scola Jr. ordered Winn-Dixie to take remedial action to change its website to allow full access to visually impaired users. Gil’s lawyers look to

net more than $200,000 from WinnDixie for their trouble, according to Forbes Magazine, but Gil is not entitled to damages.

Scola wrote in his June 2017 order that “Winn-Dixie has presented no evidence to establish that it would be unduly burdensome to make its website accessible to visually impaired individuals.”

So far, Gil and his lawyers have targeted the websites of this top end resort in the Keys but other businesses have been named in similar lawsuits such as Billabong, See’s Candy, Bose, Ron Jon Surf Shop, Burger King, Nautica, Puma, Vera Bradley and Applebee’s.

In July, two more federal district court judges in New York issued rulings which mirror Scola’s decision in the Winn-Dixie case.

“For now this is an unsettled area of the law, but business owners should undertake to examine their own websites to determine if they allow access to blind and deaf consumers,” said John Campbell, of the Law Offices

The Florida legislature recently passed a statute aimed at providing businesses some relief from ADA lawsuits. The statute, which took effect on July 1, provides that “An owner of a place of public accommodation may file a certificate of conformity or remediation plan with the Department of Business and Professional Regulation. Such filing serves as notice to the public that the place of public accommodation is in compliance with Title III of the Americans with Disabilities Act or that such place of public accommodation is making reasonable efforts to comply with such act.”

“What effect this new statute will have on ADA lawsuits in federal court remains to be seen,” said Campbell. “For now, the safest course of action would seem to be to contact your IT professional and see what if anything needs to be done to update your website.”

In 2016, the City of Marathon settled out of court with Eddie Sierra of Miami. As a deaf man who didn’t understand American Sign Language, he told city officials he did not have reasonable access to the recordings of city meetings.

“We settled without litigation,” said Marathon City Attorney David Migut, adding that the case pre-dates his employment with the city. “We provided him with some closed-captioned DVDs and paid $8,117.50.”

Migut said Sierra has filed similar suits in MiamiDade and Broward counties.

In 2015, Howard Cohan filed about 800 lawsuits, including against Keys resorts, claiming he was not afforded access to the resort facilities such as a pool lift. Two of the Keys properties prevailed as Cohan had never registered as a guest.

RECYCLE TIMES 3 MARATHON STEPS UP TO THE BIN

n Aug. 5, Dolphin Research Center’s Mary Stella posed a simple question on a Facebook group: “I’m curious as to what you think about no longer offering plastic straws … do you think a significant number of customers would complain if you didn’t have them or would most just shrug it off and not really care?”

Two-hundred-and-one comments later, statements ranged from “I wouldn’t drink a drink without a straw due to hygienic reasons,” to “I wouldn’t care, straws are for sissies.” Needless to say, the question opened dialog for many Middle Keys residents and business owners.

Here are a few things three environmentally-conscious local women said will help “save the ocean” a little bit at a time.

DEBBIE HEGLAND Marathon Key Action Network’s (MKAN) approach has been two-pronged, focusing on business recycling and the “Bag It” program. “We will be working to introduce programs to the public which will encourage the elimination of single-use plastics, in general,” said MKAN’s Debbie Hegland. “Bottled water, straws, bags, plastic utensils, and as many single-use plastics as possible.”

Hegland says to take a refillable water bottle with you wherever you go and to tote things like coffee cups around, too. At home, she suggests using glass containers instead of plastics for storage of food because they last longer, and to shop for recycled products from shoes and paper products to floor mats and mulch.

ELISE MUCHA Brutus Seafood Owner Elise Mucha saw a need to phase out her standard single-use bags and recently purchased biodegradable plastic bags for her takeout orders. The bags have the same shelf life and heat and cold tolerance as a traditional plastic bag, but contain an algae-based additive that microbes love, which helps in the breakdown process.

“It’s not much more than the regular bags I was buying,” she said, saying she spends an extra $16 per case. “I don’t want to ruin this environment, and if it saves one animal’s life, it’s worth it.”

On a side note, she only offers straws to guests who request them. She hopes other stores and restaurants in town will follow suit. She buys the bags from webstaurantstore.com.

MICHELLE COLDIRON Marathon City Councilwoman Michelle Coldiron brought the reusable bag discussion up at a recent city meeting. “They are not just for the grocery store,” she told The Weekly. “Remember them at your favorite dress shop, hardware store, or drug store. Take them with you for your carry out.”

With all the discussion on Facebook recently regarding straws, her advice is simple: stop using plastic straws. “They are dangerous to our sea life, too,” she said.

While Florida has pre-empted local municipalities from making laws that prohibit plastic bags, she said at a recent council meeting that there is room for initiatives to lessen the impacts of single-use plastic bags.

A

ccording to Jay Elliott, the Keys are made for stargazing — there’s less light pollution, the east-west axis of the islands makes for better viewing of the north and south (where all the good stuff is in the sky), and there’s very little swing between day and night temperatures.

Why does that last one matter? “Well,” said Elliott, “stable temperatures mean less weather to interrupt star viewing.”

Elliott moved to the Keys 15 years ago by way of Central Florida by way of Ohio. His expertise is in electronics, applied in space and in water. He’s worked at the Kennedy Space Center and also the Harbor Branch Oceanographic Institute. During the last recession, he seized the moment to follow a dream.

“I moved to the Keys on my sailboat,” he said, smiling.

He is a very active member of the Florida Keys Astronomy Club, and invites folks to look through his telescope every time he sets it up — which is about every week, although the club has more formal events during high season.

Astronomy is aweinspiring. Just look at how it’s a part of everyday life — Milky Way chocolate bars, Saturn cars and all the songs that mention the stars or the moon.

Where are the best and worst places for stargazing in the Keys? The best place would be the Dry Tortuga’s but I haven’t been there yet. There are many dark spots in the Keys and the state parks are all wonderful. The worst?

Well you would think it would be Duval Street, but we set up telescopes outside the Tropic Cinema where the “Sidewalk Astronomer” movie was playing and had a great time looking at Jupiter, Saturn and the moon. The moon and the brighter planets are visible from just about everywhere.

How good will the eclipse be in the Keys? The sun will be about 75 percent covered by the moon.

Begins: Mon, Aug 21, 2017 at 1:25 p.m., maximum at 2:57 p.m., ends at 4:19 p.m. DON’T LOOK AT THE SUN. Use solar glasses or a small hole in a paper to project on to the ground. Look at the shadows of the trees on the ground, they’re all crescents. Check out eclipse2017.nasa.gov for more information.

How did you become interested in astronomy? I read an article about the newer telescopes controlled with a computer. That intrigued me because I wanted to spend more time looking through the telescope, not looking for things to look at. That was in 2008.

Is light pollution getting better/ worse? No doubt it is getting worse but it doesn’t have to be. Light pollution prevention is not that difficult.

Lights should be pointing downward, amber (good) or red (better) but NOT blue or “daylight” (really bad). Also consider the number and placement of lights. Proper lighting is not sacrificing safety or security at all. The International Dark Sky Association has lots of information about proper lighting at www.darksky.org. It’s great that we’ve learned to limit our lighting for the sea turtles; all of nature everywhere should get the same respect.

What are your three favorite sky objects to look at? The star forming region in the Great Orion Nebula, Omega Centauri globular cluster and the summertime Milky Way. These are visible with the naked eye or with binoculars but even better with a telescope.

When will the best full moon rise be in the next six months and where’s the best place to watch it? I’ve got an app for that, it will tell you where the moonrise will be and what it will look like at any location — Photographer’s Ephemeris at photoephemeris. com.

What’s the best way to get involved in astronomy without spending much money? We have a friend who only used binoculars for years. That’s the best way to start. Just plain old 7X50 binoculars, a beach chair and Keys perfume (bug spray).

Astronomy magazines often have articles about binocular viewing. Of course, you can always hang out with people that have telescopes like the Florida Keys Astronomy Club.

What kind of telescope do you own? It’s a Schmitt Caesar Grain 8-inch telescope. The bigger the optics, the deeper you can see in the sky. This is a middle-ofthe-road telescope – not too cheap, not too expensive.

Any good astronomy books? “Pocket Sky Atlas,” “Sky and Telescope,” astronomy magazines.

If you could have any superhero power, what would you choose? Just the normal everyday gravityspace-time warp thing.

Your most momentous stargazing moment? Finding something in the sky and not knowing what it could be. Later finding it in the star charts as Omega Centauri at distance of 17,000 light years away.

Favorite guilty pleasure?

Milky Way and Starburst candy.

Nerdiest passion? We’re going to drive about 17 hours for 2 minutes and 40 seconds of the total eclipse. Then 17 hours back.

t’s been 99 years since the last total solar eclipse passed over the contiguous United States. And while the mechanics of the event are very similar, our ability to understand it had changed due to the advances in learning and technology. (And not since, 1979 has a total eclipse been visible from the mainland United States.)

“An eclipse teaches us so many things, but the 2017 eclipse is especially unique because of the uninterrupted land masses it will pass over,” said Lika Guhathakurta, an astrophysicist at NASA Headquarters in Washington, in an article on NASA’s website. “This will allow us to maximize our chance to collect data and connect the shadow of the moon to Earth science.”

Guhathakurta described a variety of topics that NASA-funded eclipse projects may explore, including the varying luminosity of the sun and the relationship between surface temperatures and atmospheric changes.

The eclipe will cover a narrow corridor of 70 miles as it crosses 14 states.

Future total solar eclipses will cross the United States in April 2024 and August 2045.

Athletes prepped and ready for swim games

T

he Area 11 Special Olympic Swim Games will be held on Saturday, Aug. 19 from 7 a.m. to 3 p.m. at Founders Park. Organizers are expecting more than 150 swimmers from Monroe and Miami-Dade counties to compete for qualifying spots in the State Games in October. Led by Key West Conchs Coach, Kathy Gilmour, this year’s swimmers are expecting to dive headfirst into the competition.

The area swim games are being supported by local businesses like Jersey Boardwalk Pizza, All Keys Rentals, and Jimmy Sno. Volunteers are still needed for the event.

Those interested in volunteering can sign up by following links posted to the Special Olympics Florida Monroe County Facebook page.

Athletes from both counties competed in the area standup paddleboard games in July. ‘PAW-TY’ TO HELP CLEAR THE SHELTERS

M

ore than 200 animals are in shelters in Monroe County and could use the help of locals who have a big heart and the commitment to take on a new best friend. The nationwide Clear the Shelters event takes place Saturday, Aug. 19 and Florida Keys SPCA’s Key West and Marathon campuses and Marrvelous Pet Rescue in Key Largo are participating. The event waives all adoption fees, but the current procedures and policies still apply.

In addition, all three rescues will be having fun “paw-ty’s” for animals and animal lovers.

The Marathon and Key West SPCA will be open from 10 a.m. to 6 p.m. and will have face painting, door prizes, Kiss a Pooch stand, food, and fun for the whole family.

“We are in the middle of hurricane season,” said Tiffany Burton from Florida Keys SPCA. “In the event of a major storm, we have to evacuate all of our animals. This event could help us put a large number of animals into homes which will tremendously help us.”

Marrvelous Pet Rescue will be open from 9 a.m. to 3 p.m. and will also be doing a $25 microchipping event and lifetime registration for pets.

There will be a doggie day spa and nail clipping at the event, Puppy 101 classes, painting with Jessica Ann art, food and beverages, a rummage sale, and a doggy pool paw-ty.

“And, it’s our 10-year anniversary,” said Marrvelous’s Zana Khan.

Marrvelous is located at 5 Homestead Ave. at the Lions Club, Key Largo.

Marathon SPCA campus is behind the airport and Key West SPCA campus is on Stock Island.

MARATHON’S FLORIDA KEYS SPCA has 81 animals available for adoption.

Here are a couple cuties who could use a new home.

TINY Julie Boterri and her husband have been fostering Tiny, a 6-year-old American bulldog, with hopes he’ll find his fur-ever home at the Clear the Shelters event.

Tiny is now cancer free, his heart is full of snuggles and he gets along great with others.

REMY Remy is a large breed female puppy who was found abandoned in a

Shooter Mary Beth Martel and Richard adopted Shooter in Marathon from an abusive home 13 years ago. “We consider ourselves truly blessed by his love,” said Mary Beth, who was volunteering at the time to take shelter photos of the animals for adoptions. “It was pure magic; we rescued him and he rescued us.”

Shooter won third place in a national photo contest, and gave back financially to his shelter, which made him a celebrity in the Keys. The family plans to spread his ashes in the Keys sometime soon.

KATNISS Straight out of “The Hunger Games,” Katniss is a regal cat rescued from her life on the streets. Her time on the streets was not kind and with a swollen eye and a raspy meow, this kitty has looks perhaps only a mother could love, but a beautiful personality full of affection.

GEORGIA 418 days. That’s how long ago Georgia was rescued from a lonely life on a chain tied to a tree in a backyard.

Georgia was a frightened, un-socialized dog but the staff and volunteers at the Marathon Campus have worked tirelessly to earn her trust and affection to prepare her for a new home.

What organizations and activities are you involved with at MHS and why are they important to you? I’m involved in a few different clubs like Mu Alpha Theta, Nike Club, National Honor Society, and The Health Club. I’ve also been a class officer every year and now the Vice President of our senior class. I’m also involved in volleyball and soccer. These organizations are important to me because they teach me how to be a leader and how to work together with others.

Which class or teacher has best prepared you for life after high school and why? Mrs. Heyl has definitely done a great job in preparing me for life after high school. The way she teaches and works with students has taught me all the skills I need.

What advice would you give underclassmen? Definitely do not procrastinate on any assignment or leave it for the last minute.

What do you hope to be remembered for at MHS? I hope to be remembered as a member of the volleyball team who made it far in their season. I hope this is the best season yet.

What are your plans after high school?

My plans are to go directly off to school and hopefully get accepted into the universities I want.

Tears for Charlottesville; zero tolerance for hate

For years, they had to live in caves and under rocks, rightfully ashamed to show their true feelings about what they believe to be the “erasing” of white history and the white man’s accomplishments.

Eight and a half years ago, however, something happened. The United States elected — gasp! — a black

president.

Anger overcame shame and white supremacists, neo-Nazis, and other bottom-feeders started coming out from their holes. The Internet was a perfect forum for the spreading of their hate-filled message, and like-minded white nationalists had a big online support group. Make no mistake — the entire birther movement was nothing but a racist effort to delegitimize the nation’s first AfricanAmerican president.

Years later, all the talk and rhetoric about “taking America back” has culminated in a nation divided, with bigotry and hatred becoming more mainstream, and tears flowing for Charlottesville over the death of a young woman who dared to stand up with others and confront these emboldened neo-fascists.

How did we get to this place? How do we as Americans, many of whom in our Greatest Generation fought and died to rid the world of fascism, accept this new status quo? How can we educate our populace about basic human concepts like love, tolerance and acceptance? How can we, as a freedomloving people, put up with mobs of white supremacists carrying torches through our streets, chanting vile slogans like, “Jews will not replace us!”

How did it become acceptable in the United States of America for people to wear t-shirts with Hitler quotes and proudly carry Nazi flags in public?

Utah Senator Orrin Hatch may have said it best in a tweet when he wrote, “We should call evil by its name.

My brother didn’t give his life fighting Hitler for Nazi ideas to go unchallenged here at home.”

These are the people who want to “take our country back.” They are the ones who “suffered” under eight years of a president with darker skin.

They are the ones who think that immigrants are ruining this nation and trying to erase white history. They long for a place where black people and women know their place, where immigrants at least look Anglo-Saxon (and better speak English and not be Muslims), and where Jews don’t control the media. They are the ones who create and spread all the lies and unfounded rumors about political figures with whom they disagree. They are living in a very demented fantasyland, and there are more than enough of them to feel emboldened and crawl out from under their rocks. They are what people are now calling the American Taliban.

So now we are in the aftermath of a bloody weekend in Charlottesville, Virginia. That large group of white supremacists and neo-Nazis went to Charlottesville purportedly to take our country back — and they are promising more of the same. They came prepared for violent conflict, and no doubt they encouraged it as well. As Virginia Governor Terry McAuliffe said, “You saw the militia walking down the street, you would have thought they were an army … [the militia members] had better equipment than our State Police had.” An eyewitness to the chaotic scene recalled, “An angry mob of white supremacists formed a battle line across from a group of counterprotesters, many of them older and gray-haired, who had gathered near a church parking lot. On command from their leader, the young men charged and pummeled their ideological foes with abandon. One woman was hurled to the pavement, and the blood from her bruised head was instantly visible.”

Let our tears flow for Heather Heyer and the two Virginia State Police who were killed when their helicopter crashed. Let us help mend those who were wounded. Let us pray for the souls of those who hold this vile hatred deep in their hearts.

And let no one — not even the president of the United States — ever suggest that there is any moral equivalency between those who come to spread a message of hate, bigotry, and fascism and those with the courage to stand up against it.

Because if something like this were to happen in my hometown, I know which side of the street I’d be on.

SCHOOL PLANS

The Monroe County School District unveiled plans of the $23 million renovation and expansion of Stanley Switlik Elementary on Thursday at a community meeting. Although the designs are not finalized, the construction is slated to begin next summer and be ready for students in the fall of 2020. During construction, portable classrooms will be added to campus. Highlights of the project include a secure courtyard, a new dock on the bayside for marine science education, and a new two-story building to house third, fourth and fifth graders.
