CTLA Editor’s Column We’re Back!

At the publishing of this edition of the TTL, we will be more than halfway through 2022. With the removal of almost all of the COVID-19 restrictions in North America, this summer undoubtedly will be about good friends, family time, traveling and, don’t forget, good food! Several of CTLA’s board members attended TLA’s Annual Conference in Williamsburg, Virginia, including Past President Jean-François Bilodeau. It was Jean-François’ first time attending a TLA Annual Conference and he left wondering why he hadn’t attended one before this year. I certainly understand his sentiments as my experience at the Austin TLA Annual Conference in 2019 was positive, to say the least, educational and had me thanking my lucky stars that I transitioned from an insolvency/collections practice to transportation.

That year was also the first year I attended a CTLA Annual Conference which was held in Winnipeg, Manitoba. While the attendees enjoyed the dine around and the beautiful Canadian Museum for Human Rights, little did we know that that would be the last in-person CTLA conference until 2022. Now, almost 3 years later, as we settle into familiar but slightly different routines, matters and issues that were set aside to deal with the fast-changing COVID-19 rules and regulations affecting the transportation industry, are now resurfacing. Our Canadian

contribution in this issue of TTL highlight some of these issues and include articles by: (i) Ben Aberant and Nicole Deniset entitled “COVID-19: Case Law Updates and Developments for Transportation Employers” which highlights developing case law around a transportation employer’s actions in the context of the pandemic; (ii) Jean-François Bilodeau entitled “Status Report on the Successes in Using Foreign Ships to Lay Submarine Cables in Canada” which provides insight into the suitability issue when applications to the use foreign vessels in Canada are contested; and (iii) Pui Hong and Marie Boyd entitled “Alberta Court of Queen’s Bench Clarifies Carriers’ Rights to Random Drug and Alcohol Testing” which summarizes an Alberta court’s decision about whether a provision in an employment contract requiring an employee to submit to Pui C. Hong random drug and alcohol testing is enforceable. We at the CTLA hope that many of our U.S. counterparts will join us in Toronto October 13, 2022 to October 15, 2022 for some excellent educational sessions, fun networking opportunities and some friendly competition. We look forward to seeing old friends and connecting with new ones!
