This 80+ page document includes the upcoming year’s Operating Budget, Notice of Assessment Increases, Budget and Assessment Summary, Annual Update of TKPOA’s Reserve Study, and other pertinent required information for members of the TKPOA as we prepare to go into a new year. This mailing is a requirement of Civil Code §4040 for Homeowners Associations.

In 2018, the costs for printing and mailing the Annual Disclosure to all 1,529 members of the TKPOA totaled approximately $12,000.

Before Getting Back to It:

Precautions to Consider When Returning to Play

By Jeffrey A. Orr, MD WITH THE WEATHER GETTING COLDER AND THE SNOW FALLING, it’s time

to break out the winter gear, get outside, and start enjoying some frozen nature. However, if you have recently suffered an injury and are looking to get back to outdoor activities this winter, here are a few precautions you may benefit from before charging into the backcountry or joining the kids in the terrain park.

NUMBER ONE

Give yourself enough time to recover from an injury. One of the most common reasons people have a setback in their recovery is simply not giving their body enough time to fully heal before resuming sports play.

Recovery time varies, and depends on the body part involved along with the severity of the injury. Some injuries only take a week of conservative management, while other injuries may require surgery and several months of formal rehabilitation.

NUMBER TWO

It is important to make this an active recovery process. Early mobilization and functional rehabilitation are important principles in physical therapy. Some fractures and injuries do require a period of immobilization, though this is kept to a minimum. Getting to work on improving range of motion and strengthening the muscles will help improve function in an injured limb.

NUMBER THREE

Keep a positive attitude. It is common to experience frustration, anxiety, and even depression after an injury. Typically, these feelings are most severe in the immediate aftermath, and tend to improve as progress

is made towards returning to sport participation. However, if left unaddressed, these feelings can slow rehabilitation and delay return to activity.

NUMBER FOUR

Get medical expertise. Regularly seeing a health provider can be beneficial to give you the specifics of your injury and provide you with a timeline for healing. Working with a physical therapist can also help you maximize your recovery efforts.

And last, do not ignore the rest of your body!

Focused rehabilitation on a specific body part should not take away from overall health and conditioning. In particular, emphasis on core strength and flexibility will go a long way in helping you return to your pre-injury activity level.

The road to recovery is typically not a straight path and coming back from an injury can be a frustrating and time consuming process.

Minor setbacks are common when you test yourself and increase your activity level.

Hopefully, you only have to recover from your injury once. When you take the appropriate steps and return to exercising safely, you minimize your risk of re-injury and can maximize your time on the slopes.

Cove Advisors Needed for Bavarian Isle, Aloha Isle, Mount Tallac Village III, and Cove 2 It is important that all TKPOA subdivisions are represented by a property owner living within their subdivision. Per the Advisor rules, any owner in good standing may volunteer to serve as the Advisor to their Subdivision or Cove. Otherwise the property owners may nominate themselves or another owner within that subdivision, confirmed by a vote of the Board of Directors.

Each Cove Advisor is responsible for handling the general affairs of the cove including unit/common area facilities; report maintenance, repair and other property owners issues to TKPOA management and follow-up in keeping those property owners up to date with current events, general affairs of projects happening within the Keys, and manage the cove’s budget.

By Kirk J. Wooldridge, General Manager AT THE SATURDAY OCTOBER 19TH, 2019 Tahoe Keys Property

Owners Association (TKPOA) Board of Directors Regular Board Meeting, the Board approved the recommendation from the Water Quality Committee (WQC) to set up a separate fund at the El Dorado Community Foundation, a 501 (c) 3, named the “Tahoe Keys Waterways Restoration Fund”. The purpose of this fund “is to improve the water quality and recreational use of the Tahoe Keys Waterways”. By setting up this 501(c)3 fund at the El Dorado Community foundation, the TKPOA is requesting assistance in providing a vehicle to receive tax deductible donations and certain grants to fund studies, new technologies, and methods for fighting Aquatic Invasive Species (AIS) and cyanobacteria Hazardous Algal Blooms (HABs) in Tahoe Keys Waterways and Lake Tahoe. Over the years, there have been many requests from TKPOA Property Owners and area residents if such a 501(c)3 organization existed to allow for donations to be accepted for AIS projects that would directly benefit the Tahoe Keys Waterways, and now there is such a fund.

The “Tahoe Keys Waterways Restoration Fund” (TKWRF) will be managed by a five member committee and the El Dorado Community Foundation (EDCF). The EDCF will set up a Special Project Expendable Fund to receive the donations and issue the grants from the Fund as authorized by the Committee. It will be the EDCF’s responsibility to receive and properly administer the funds in compliance with IRS rules and accepted accounting practices. The Fund will be subject to an administrative fee of 2% of donations or a minimum of $300 whichever is greater. This will cover the cost of IRS requirements to acknowledge donations, investment management, oversight and issuance of grants, financial reporting to the Committee, and quarterly fund statements. Part of the accounting could include setting up “sub-accounts” to track specific projects tied to grants received. The fund will receive an apportioned investment return while on deposit with the Foundation. Funds will be invested in short term return (savings account) to be available for projects. Since 1991, the EDCF have helped generous community members make the most of their charitable giving. They act as stewards for local residents and organizations who entrust their gifts to the care of the EDCF to build a permanent endowment for our community. The TKWRF is seeking a five member committee to serve a two year term. The TKPOA Water Quality Committee (WQC) has recommended the five member committee be comprised of: two WQC members, one Architectural Control Committee (ACC) Member, one TKPOA Board Member and one “Member at Large”. The responsibility of this TKWRF committee is to run the organization’s business affairs with the EDCF, review grant applications submitted, and approve grant submittals when the organization requirements are met. The TKPOA will provide basic administrative support to the TKWRF for the two years at no charge through a Memorandum of Understanding (MOU).

ASSOCIATION (TKPOA) is required to contract for

the following insurance coverages: Property and Casualty (P&C), Difference in Conditions (DIC) Earthquake, Flood, General Liability, Auto Liability, Umbrella/Excess, Marina Legal Liability, Water Management Liability, Security Liability, Cyber, Directors and Officers (D&O), and Fidelity. Per the TKPOA BYLAWS ARTICLE IX, Duties and Powers of the Board, Section 1. Specific Powers, the Board of Directors are require to (f) Contract for and pay premiums for fire, casualty, liability and other insurance and bonds (including indemnity bonds) This insurance coverage needs to comply with the TKPOA CC&R’s requirement stated in ARTICLE X Insurance, Sections 1–7.

For the 2020 Annual Budget and 2019–2020 Insurance Coverage Terms the cost of the combined insurance coverage has risen significantly from $397,553 to $785,839 a 97.7% increase. This total cost of $785,839 is allocated between the Common, Water Company, Water Quality assets, and the Townhome/Cove and Subdivisions with Reserves. A total allocation of $668,874 for Townhome/Coves and Subdivisions with Reserves and $116,965 for the Common, Water Company, Water Quality Assets and departments. This increase in insurance coverage raised many of the Townhome/Coves insurance expense by 125.0% or greater, which required another review and revision to all of the Townhome/Cove 2020 Budgets after October 1st, which resulted in an average increase of up to 19.9% in quarterly assessments.

The reasons for this increase is due to the lack of Insurance Companies willing to provide Property and Casualty (P&C) coverage for large Scale Home Owners Associations for 2019–2020 renewal periods.

Specifically for the TKPOA, our last term Property and Casualty insurance provider CIBA pulled out of the market all together, as well as Philadelphia Insurance whom previously provided this coverage to the TKPOA, and did so when the Cove 1 Townhome Fire occurred. However, this is not just a TKPOA issue, but rather an industry wide issue for all California Home Owner Associations due to the past and recent major incidents from large community wild fire damage and related casualties.

Most Property & Casualty (P&C) policies are written with one-year durations, TKPOA for example is an October 1st, to October 1st. The TKPOA and the risk of a complete, total loss are slightly different. The nature of the home construction, proximity to each other and area to be contained in a fire has been deemed less than desirable. It is exactly the reinsurance market, and the shift it took when their treaties were published in July 2019 that caused such a sudden shift in the California Property Market. Simply put, with CIBA non renewing the TKPOA Property coverage, no other insurance company (per their underwriting guidelines and reinsurance contract/treaties) could (and would) take a chance at insuring more than $5 million primary on TKPOA property, for fear of a total loss. Our Insurance Brokers – Hays Insurance Services had to maintain the "full value" limit, per the TKPOA CC&R requirements, so Hays Companies with the help of their Wholesale Partner RT Specialty, "layered" the additional limits to make the TKPOA property insurance portfolio whole again. This was the cause of the sudden increase. Without the additional layers, and unwillingness of the Umbrella insurer to give the TKPOA full limits, the increase at renewal would have been modest (less than the 20% projection, General Liability was thankfully down -12.4 %) and likely only a direct reflection of the claim activity, and increase in Crime limits. By category Property insurance increased 228.3%, Earthquake 3.3%, Auto Liability 7.2%, Umbrella 67.4%, Marine Liability 0.0%, Water Management Liability 1.0%, Security Liability 2.0%, D&O 0.3%, Crime 52.9%, Cyber 5.5% and General Liability decreased -12.4%. Unfortunately, Commercial Property Insurance across the state is seeing the results of this new hard market, (this is not an isolated TKPOA situation) and it will extend to personal home owners at policy renewals also, if it hasn't already, stay tuned.

Hays Insurance Services became our Insurance Broker in 2017 and has provided an Insurance expense savings or nominal increase since that time from the 2016–2017 Term expense $459,020 with Russo Insurance, the 2017–2018 term expense $379,475 with Hays Insurance Services a $79,545 saving, 2018–2019 term expense $398,553 with Hays Insurance Services a $19,078 increase and 2019–2020 Term expense with Hays Insurance Services a $388,286 increase. TKPOA Staff will follow up and review strategies for next

year’s renewal with Hays Insurance Services to hopefully realize a saving or determine a future forecast for 2021 Budget planning.

FROM THE RECENT TAHOE DAILY TRIBUNE SEPTEMBER 10TH, 2019: New data from the California Insurance Commissioner’s Office reveals that more than 350,000 home insurance policies have been non-renewed in highrisk wildfire areas since 2015, with El Dorado County experiencing one of the most dramatic increases. “We are seeing an increasing trend across California where people at risk of wildfires are being non-renewed by their insurer,” said California Insurance Commissioner Ricardo Lara in a press release. “I have heard from many local communities about how not being able to obtain insurance can create a domino effect for the local economy, affecting home sales and property taxes. This data should be a wake-up call for state and local policymakers that without action to reduce the risk from extreme wildfires and preserve the insurance market we could see communities unraveling.”

As one of 10 counties with the most homes in high or very high-risk fire areas, El Dorado County is getting hit hard by insurance non-renewals. A total of 1,594 EDC homeowners were dropped by their insurance carriers last year, a 12.5-percent increase from 2017. Since 2015, 6,398 EDC homeowners have been dropped by their insurance carriers, according to the data.

The 10 counties with the most homes in high or very high-risk areas include Tuolumne, Trinity, Nevada, Mariposa, Plumas, Alpine, Calaveras, Sierra, Amador and El Dorado, according to the insurance commissioner.

Statewide, yearly non-renewals have remained relatively steady hovering between 83,511 and 89,571 non-renewals per year since the state began collecting data in 2015. Non-renewals increased by 6 percent last year, the largest increase since 2015. Zip codes affected by the devastating fires from 2015 and 2017 experienced a 10 percent increase in insurer-initiated nonrenewals last year, according to the data. The data doesn’t account for homeowners that re-upped with another insurance company.

2020 Budgets & Annual Disclosure

By Kirk J. Wooldridge, TKPOA General Manager THE 2020 ANNUAL BUDGET was approved at the Saturday October

19th, 2019 Board of Directors Regular Board Meeting. Preparation of the budget that was approved followed six months of work that began in April and is the result of significant efforts by the Tahoe Keys Property Owners Association (TKPOA) Staff, the Finance Committee, the Cove Advisors, and the Board of Directors.

The “Budget” actually consists of 19 operating budgets and 20 reserve funding plans. The operating budgets address the planned operating revenues and expenses for the four major funds (Common, Water Company, Water Quality, and Channels & Lagoons), 12 townhouse subdivisions, and four single-family subdivisions.

Each year, the Association must distribute an “Annual Budget Report” and an “Annual Policy Statement” these items and additional required items are included in TKPOA Annual Disclosure. According to TKPOA Bylaws ARTICLE XII, Member assessment Obligations and Association Finances, Section 5: Budgets and Financial Statements: (a) A pro forma operating budget for each fiscal year consisting of at least the following information shall be distributed to Members not less than 45 nor more than 60 days prior to the beginning of the fiscal year: (i) Estimated revenue and expenses of the Association on an accrual basis; (ii) The amount of the total cash reserves of the Association currently set aside for the future repair or replacement of, or addition to, those major components of the Common Areas and Common Facilities which the Association is obligated to maintain and for contingencies; (iii)An estimate of the current replacement cost of the estimated remaining useful life of, and the methods of funding to defray repair or replacement of, or additions to, those major components of the Common Areas and Common Facilities which the Association is obligated to maintain;

(iv) A general statement setting forth the procedures used by the Board of Directors in the calculation and establishment of reserves to defray the cost of repair, replacement or additions to major components of the Common Areas and Common Facilities which the Association is obligated to maintain.

On October 31st, 2019 the TKPOA Annual Disclosure was mailed out to all Property Owners. All these required Disclosure documents must be distributed by “First-class mail, postage prepaid, registered or certified mail, express mail, or overnight delivery by an express service carrier.” (Civil Code §4040.), however upon written consent of members, associations may distribute documents and disclosures electronically.

The Davis-Stirling Common Interest Development Act is the California Civil Code and (Section §5300 and §5570) contains the detailed Disclosure requirements and the deadlines for most of these required items. The reasons for this increase has achieved through the following significant changes with the Common budget revenue overall decreased by -4.2% over the 2019 Budget in the following areas: Vacation Rental Fees 93.5%, increasing from $400 for a TKPOA Vacation Home Rental (VHR) rental permit to $700 for the 2020 Fiscal year.

The following Common expenses increased over the 2019 Budget that are significant, Legal Expense by 102.3%, Insurance by 20.4%, Office Equipment Administration 100.0%, Wages – Public Service/ Security 3.5%, Recreation Repairs and Maintenance by 50.0%, Maintenance Wages by 3.2%, Health Insurance – Maintenance by 15.6%, Landscape Wages by 6.6%, Architectural Control Department (ACD) Workers Compensation 645.3%, ACD Health Insurance by 17.7%, and Cash Replenishment from the proposed sale of the Lake Tallac “New Buildable Lot” by 100% or $221,316, Some significant decreases are budgeted as follows, Administration Billing to Others by -6.2%, Other by -100.0%, Annual Picnic by -100.0%, Postage by -20.0%, Maintenance R&M Contractor by -30.0%, ACD Wages by -9.4%, and Street Light Maintenance by -20.8%. The Common budget expenses overall decreased by -4.2%.

The 2020 Water Quality Budget increased overall by 12.0% compared to the 2019 Budget. Total Water Quality Assessment increase by 35.3% over the 2019 Assessment with the combined increase in Reserve

funding. The following expenses increased significantly, Electricity by 233.3%, Wages by 18.7%, Payroll Taxes by 18.7%, and Professional Services Waste Discharge Requirements (WDR) by 35.3%.

The 2020 Water Company Budget increased overall by 2.1% compared to the 2019 Budget. Total Revenue increased by 2.1% due to increased Assessment Revenue.

Total Water Company Assessment increase by 14.7% over the 2019 Assessment with the combined increase in Reserve funding.

The following expenses increased significantly, Legal by 226.6%, Professional Services by 122.2%, Outside Services by 121.4%, Insurance by 35.8%, Wages by 13.9%, Payroll Taxes by 13.9%, and Health Insurance by 59.1%. The following expenses decreased overall significantly, Workers Compensation by -19.5%, and Cash Replenishment by -97.4%.

The TKPOA has 302 landlocked properties, 164 properties that are non-lagoon front, and 138 properties are also non-lagoon front and are members of Tahoe Keys Boat and Harbor Association (TKB&HA). At the October 19th, 2019 Regular Board Meeting, the Board of Directors approved charging these properties the same Water Quality Assessment and Channels & Lagoons Assessment as lagoon front properties, as well as Common and Water Company Assessments. Those properties that are members of the TKB&HA will receive a “Boat Slip Credit” per the 1991 Legal Agreement – Water Quality Billing.

COMPARISON 2019 vs. 2020

In comparison to the 2019 Annual Budget and Annual Quarterly combined Assessment for Common, Water Quality, Water Company and Channels & Lagoons for 2019 of $626.00, for 2020 the Quarterly Assessment will be $709.00 per Quarter. The following areas affected the 2020 Budget with increases in expenses:

• Payroll Wages increased due the California Minimum Wage Increase from $12.00 to $13.00 in 2020, and a 2.5% budget for salary increases based on the TKPOA Annual Evaluation system for merit increases for a combined total of $99,696 ($16.30 per Quarterly Assessment).

• Health Insurance increased overall by 16.0% or $41,961 ($6.86). Also for 2019, the TKPOA Board of Directors has elected to continue the elimination of the Employee Benefits funding level and not offering coverage for Long Term Life and Disability, Accidental Death and Dismemberment with Blue Shield.

• Repayment for Operations funding from borrowing short term from Reserve Funding for $167,250 ($27.35) Common budget.

• Common Legal Expenses increased for pending Legal issues of $75,000 ($12.26).

• Water Company Legal Expenses increased for Tahoe Keys Marina & Yacht Club (TKM&YC) pending Legal issues of $22,543 ($3.69).

• Water Company/Water Quality Professional and Outside Services budgets increased for Technical Support for $10,924 ($1.79).

• Water Quality payroll increased for the Water Quality Supervisor/Aquatic Invasive Species (AIS) Coordinator position to work fulltime year round for $10,080 ($1.69).

• Water Company Outside Services increased for Technical Support on South Y PCE Plume Investigation and Legal Strategy for $13,004 ($2.13).

• Combined Insurance Costs increase $15,876 ($2.60), for all Departments.

• An increase of $7,094 ($1.16) to reconcile the Common, Water Quality, Water Company and Channels & Lagoons budgets for this analysis.

The following changes created decreases and cost savings in the 2020 Operating Budget: • A Common budget decrease of -$265,000 (-$43.33) for the proposed Net Sale of Lake Tallac “New Buildable Lot”.

• A Common budget Revenue increase of -$92,500 (-$15.12) due to an increase in the Vacation Home Rental (VHR) Permit Annual fee.

• A reduction in Water Company Assessment to generate cash surplus -$82,055 (-$13.42).

• Elimination of the 2020 Annual Picnic costs for -$20,000 (-$3.27) Common budget.

• Elimination of the shared part time Front Desk/ ACD Staff position -$24,062 (-$3.93) Common budget.

• Reduction in Weekend Security Coverage -$3,000(-$0.49) Common budget.

For the 2020 Reserve Budget portion of the Annual Assessment for Common, Water Quality, Water Company and Channels & Lagoons the following planned increases in Reserve funding have been approved and implemented for 2020: • For the Common Reserve a 15.94% increase for $47,093 increased the Assessment. ($31.00 per Property Owner Annually and $8.00 per Quarter) For an overall Reserve Assessment of $56.00 per Property Owner per Quarter compared to $48.00 in 2019.

• For the Channels & Lagoons Reserve a 185.00% increase for $226,290 increased the Assessment. ($148.00 per Property Owner Annually and $37.00 per Quarter). For an overall Reserve Assessment of $57.00 per Property Owner per Quarter compared to $20.00 in 2019. This increase is primarily due to the forecasted cost increase in the East Channel Bulkhead Replacement project.

• For the Water Company Reserve a 35.87% increase for $121,180 increased the Assessment. ($81.00 per 1510 Property Owners Annually and $20.00 per Quarter). For an overall Reserve Assessment of $76.00 per Property Owner per Quarter compared to $56.00 in 2019.

• For the Water Quality Reserve a 175.09% increase $128,459 increased the Assessment. ($84.00 per Property Owner Annually and $21.00 per Quarter).

For an overall Reserve Assessment of $33.00 per Property Owner per Quarter compared to $12.00 in 2019.

The Approved 2017 Water Quality Special Assessment (Second and Third Payments)

The Board of Directors and the Finance Committee have instructed the Water Quality Committee (WQC) to reassess both the timing and amount of the previously approved 2017 Water Quality Special Assessment. If we were able to obtain a yes vote by homeowners to change the milestones triggering payment of the previously approved special assessment, we could reduce the proposed Assessment/Reserve expenses for the support the Tahoe Keys Lagoon Restoration Project – Application for Approval to Reduce Aquatic Invasive and Nuisance Plant Species” through a Tahoe Regional Planning Agency (TRPA) Environmental Impact Statement (EIS) and a Lahontan Regional Water Quality Control Board (LRWQCB) Environmental Impact Report (EIR) for California Environmental Quality Act (CEQA) Compliance by potentially $21 per quarterly assessment for those costs that would be covered by an updated version of “Second” special assessment. Now that the TKPOA is fully emerged in this Tahoe Keys Lagoon Restoration Project EIS/EIR process some of the perceived processes, project timelines and milestones has changed significantly since the development of the 2017 Water Quality Special Assessment Ballot and voting materials. In addition to these changes, the TRPA has secured significant funding to pay for the EIR/EIS process and many of its required components over the next two years.

The TKPOA Staff and Board of Directors is continually making efforts to monitor and manage costs, and evaluate the services provided to property owners and their guests to achieve the best impact for the expenditures budgeted.

Tahoe Film Fest

Announces Opening Night Film NORTH LAKE TAHOE — Tahoe Film Fest is pleased to announce their Opening Night Film for the 5th annual film festival event. Marriage Story, starring Adam Driver, Scarlett Johansson and directed by Academy Award nominee Noah Baumbach. This highly anticipated film will open the festival on Thursday evening, December 5th, at the Incline Village Cinemas.

Writer-director Noah Baumbach offers another alternately funny and deeply moving snapshot of a marriage in its final stages. With divorce proceedings in full swing as the film opens, New York City theatre director Charlie (Adam Driver) and LA-bound actress Nicole (Scarlett Johansson) have promised to keep their separation an amicable one, not just for each other but for their young son as well, but hurtful admissions and vicious verbal spats quickly sour those ambitions. Meetings and Approvals

At the October 19th, 2019 open meeting, the TKPOA Board of Directors approved the TKPOA 2020 annual Budget, approved the August Financial Statements, reviewed homeowner delinquent accounts and scheduled disciplinary hearings on delinquent accounts. There were no approvals for lien notices for delinquent homeowners to review. Disciplinary hearings are generally held when a homeowner is delinquent on two quarterly assessments.

The TKPOA Annual Disclosure and 2020 Budget was mailed out October 31st, 2019, and is also available on the TKPOA website. 314 homeowners opted to have the TKPOA Annual Disclosure and 2020 Budget sent to them via email rather than a hard copy in the mail, giving Keys Breeze

the TKPOA a savings on printing and mailing costs. If you also wish to participate in helping the Association to save money, you will find the “Consent to Receive Disclosures via Electronic Delivery� on page 33 of the Annual Disclosure. The October 22nd, 2019 Finance Committee meeting was canceled and is next scheduled for Tuesday, November 19th.

TKPOA RENTAL PERMIT–

Board of Directors adopted the Owner, Renter, and Vacation Policy, Rules, and Regulations, which outline nuisance operating rules specific to TKPOA’s vacation rental program, including a requirement for all vacation rental properties within the Keys to obtain an annual TKPOA Rental Permit for a fee paid to TKPOA.

FOR THE 2020 CALENDAR YEAR, the permit fee has increased to $700 as approved as part of the

2020 Annual Budget at the October 19th, 2019 Board of Directors Meeting. Each year the TKPOA provides Property Owners through the annual billing and the Annual Disclosure a mailing of all the fees. If Property Owners join during the calendar year they are still responsible for the entire fee, and will not be offered a prorated fee. TKPOA VHR Permit Applications will need to be filled out by all property owners in order to acquire a 2020 TKPOA VHR Permit. Once a property owner pays the fee and fills out an application, TKPOA will issue a permit that must be displayed in a front window of the rental property. The Architectural Control Committee agreed that the existing vacation rental posting requirement is for a “permit” not a “sign” consequently no change is required to our “Sign Restrictions”. Nor is this a violation of the CC&R Article VIII Section -7 Sign, on page 41.

Current California Case Law on this issue has indicated a “good faith estimate that would be sufficient to determine this charge or fee”, and this action has also been reviewed by IF PROPERTY OWNERS TKPOA Legal Counsel. There is no legal requirement that a comprehensive study or investigation is conducted to determine JOIN DURING THE this fee, and keep in mind to provide a comprehensive study would require additional TKPOA Staff/Board time at a cost. The CALENDAR YEAR THEY TKPOA Board of Directors is allowed to implement this annual ARE STILL RESPONSIBLE fee based on the provisions of the Davis-Stirling Act Civil Code section§5600. Duty to Levy Assessments; Fees to Defray Costs.

FOR THE ENTIRE FEE, AND “An association shall not impose or collect an assessment or fee that exceeds the amount necessary to defray the costs for WILL NOT BE OFFERED A which it is levied.” An Association can adopt different rules and fees for property owners who engage in short-term rentals.

PRORATED FEE. The Tahoe Keys Property Owners Association Rental Permit annual fee will be provided each year to the TKPOA Property Owners through a separate annual billing if you have applied for or have a current City of South Lake Tahoe (CSLT) Vacation Rental Permit. If you will not be renting your home as a Vacation Rental, TKPOA will need written documentation from the Property Owners stating that you will no longer be renting your property, even though you have applied for and have a City of South Lake Tahoe (CSLT) Vacation Rental Permit.

The TKPOA Front Desk operations has staffing at the TKPOA Pavilion offices open from 8:30AM-4:30PM seven days a week, Monday through Sunday. The Front Desk hours are to accommodate Property Owners, Property Owners Guests, and Vacation Rental Guests.

Currently our process to sell Recreational Passes is not an integrated Point of Sale system, so the tracking of the types of “Guests” these passes are sold to are through a manual system at the point of sale and also tracked at the point of entry at the Indoor and Outdoor pools. HOLIDAY DECORATIONS CHRISTMAS LIGHTS CANNOT REMAIN ON THE RESIDENCE YEAR ROUND. Lights should be

removed after the holiday, weather permitting.

According to the Architectural Control Rules Brochure (ACRB), Section 15, Misc.

Provisions for Exterior Grounds, Storage and Structures, Item 15.14 reads as follows:

Holiday and Traditional Displays vary widely. Displays and holiday decorations may be erected temporarily without a permit.Holiday decorations may be displayed no more than 30 days before or 14 days after a holiday (weather permitting). Decorations for personal events (birthdays, weddings, homecomings, etc.) may be displayed no more than three days before and three days after the event. All other displays require ACC approval and must be in harmony with the requisite occasion (as appropriate) and surrounding structures and neighborhood. Lights may not shine so brightly as to be an unreasonable disturbance to neighbors or drivers and no sound devices are permitted for any decoration. All lighted displays must be turned off by 11 p.m.

No display may obstruct the views from any other property.

to the increased usage of TKPOA lagoons and waterways. This is documented through Security Incident Reports, Maintenance Work Orders, Water Company and Water Quality Work Orders, Police Reports, Insurance Claims, Member Letters and Lawsuits filed against the TKPOA. As part of providing improved enforcement of the “Owner, Renter, and Vacation Policy, Rules, and Regulations” moving forward TKPOA Staff has worked towards better classification of these nuisance calls. This is a public relations process at best, and often times this depends on the cooperation of the actual occupants alleged of a nuisance complaint to provide the TKPOA Staff with accurate information.

Letters and invoices will be going out to all “Vacation Rental” TKPOA property owners based on the City of South Lake Tahoe Vacation Rental Permit list, with the $700 annual fee due by December 31, 2019. Once a property owner pays the fee and returns their permit application(s), TKPOA will issue a permit that

must be displayed in a front window of the rental property. (Permits are not transferrable).

For those Property Owners whom have not submitted payment, in accordance with the “Owner, Renter, and Vacation Renter Policy, Rules, and Regulations,” the Board of Directors may decide to hold a disciplinary hearing to consider imposing a fine and/or suspending member rights, which may include suspension of member I.D. cards and Short Term Recreational day passes sold to renters of the delinquent property, for non-payment of the 2020 Vacation Rental Permit fee.

The adopted and approved “Owner, Renter, and Vacation Policy, Rules and Regulations are available on the TKPOA Website at www.tkpoa. com, and at the TKPOA Pavilion Office. The goal of this adopted Policy, Rules and Regulations is to improve the TKPOA Property Owners knowledge and compliance to “Owner, Renter, and Vacation Policy, Rules and Regulations”, by themselves, their family Property Owners and their guests.
