Owners Association (TKPOA) Pavilion Office will be closed until further notice as of March 20th, 2020.

As a precaution to prevent the spread of COVID-19, and to protect the health and safety of our residents and staff, the TKPOA Pavilion Office will be closed to the TKPOA property owners and the public. Our TKPOA essential staff are still working behind the scenes and will be available by phone and online during regular business hours of 8:30 a.m.–4:30 p.m., Monday–Friday [Closed Saturday and Sunday]. The TKPOA will continue to provide essential services as required from the water company, facilities, security and administration departments. The TKPOA facility maintenance staff, water company staff and security patrol officers have been instructed to take extra precautionary steps when responding to calls for service to maintain social distancing while responding to property owners.

The Board of Directors and Committee meetings will be held as a web hosted conference call and Town Hall Forums have been suspended until further notice or will also be held as a web hosted conference call.

The TKPOA indoor pool, playground, tennis court and pickleball courts are closed until further notice. TKPOA staffing and expenses haves been adjusted due to these closures. We will continue to closely monitor emerging information from the CDC and California Department of Health and evaluate future operations as we have more information and will make adjustments to our overall operation and staffing.

Various cities in California have included the following in their definition of essential businesses: plumbers, electricians, exterminators, custodial/ janitorial workers, handyman services, funeral home workers and morticians, moving services, HVAC installers, carpenters, landscapers, gardeners, property managers, private security personnel and other service providers who provide services to maintain the safety, sanitation, and essential operation to properties.

Community associations and their management

companies should continue to operate.

The March 19th, 2020 memorandum from Department of Homeland Security referred to in the California Governor's Executive Order allows for workers needed to ensure continuity of building functions, including security further defines the essential services required.

The Architectural Control Department (ACD) of the TKPOA is still accepting Architectural Control Committee (ACC) application submittals for review.

Please submit your applications by either dropping them off at the Pavilion located at 356 Ala Wai Blvd, South Lake Tahoe through the mail slot next to the front door, by mail via USPS or via email. Email applications to Lcallahan@tahoekeyspoa.org. ACD staff will get back to you with your application status. Please don’t forget to include the review fee with the application.

The TKPOA accounting department is available via email or phone while this temporary closure is taking place. As a reminder the TKPOA staff would like to suggest a couple of ways you can pay your assessments online.

The disease causes respiratory illness (like the flu) with symptoms such as a cough, fever, and in more severe cases, difficulty breathing. You can protect yourself by washing your hands frequently, avoiding touching your face, and avoiding close contact (1 meter or 3 feet) with people who are unwell.

The “incubation period” means the time between catching the virus and beginning to have symptoms of the disease.

Most estimates of the incubation period for COVID-19 range from 1-14 days, most commonly around five days.

Check in with Yourself During Coronavirus Isolation 1

CORONAVIRUS HAS AN UNDENIABLE IMPACT in our lives,

and the current Shelter in Place directive doesn’t necessarily shelter us from the anxiety caused by the pandemic. As we do our part to stay home and help flatten the curve, we can take this time to check-in with ourselves as part of our daily routine to reduce stress and promote well-being within our households.

Anxiety and stress is often caused by feeling a lack of control. In uncertain times like these, take time to focus on what you can control: creating a routine, eating healthy, getting enough sleep, and exercising. Although these aspects of your life may alter slightly due to home isolation, you still have control over making the effort to do them to the best of your ability every day.

While social distancing has moved many of us to connect with others via phone or video chat, don’t forget to check-in with yourself. Here are five questions you can ask yourself and connect with things that you can control for your overall well-being:

“How well did I sleep last night?” Ask yourself if you feel refreshed, and take a look at how many hours you slept.

“How does my body feel?” Conduct a selfcheck to see if there are any signals pointing to some stretching or activity that you would benefit from.

“What is my current stress level?” If you feel highly stressed over something, identify that source, be it school, your health, your personal relationships, etc.

“How am I managing my time?” While we can’t control a pandemic per se, we can control our daily routine to better manage sleep, nutrition, personal relationships, and pursuing things that support health and wellness.

“What are ways I got through challenging times in the past?” Developing objective optimism by reflecting back on what skills helped you make it through other challenges in your life can help you face challenging times—use those tools or skills now.

2020 BULKHEAD REPLACEMENT

Projects Update

THE TAHOE KEYS PROPERTY OWNERS ASSOCIATION (TKPOA) has recently completed the Request for Proposal (RFP) process on March 12th, 2020 for three bulkhead projects that affect TKPOA property owners. The TKPOA staff have been coordinating this issuance of this RFP with the California Tahoe Conservancy (CTC) Upper Truckee River and Marsh Restoration Project which includes a bulkhead installation project to isolate the “sailing lagoon” from the Tahoe Keys Marina and is scheduled for the summer of 2020. The reason for this was to hopefully create a “competitive bidding” period for the Bulkhead Project RFP’s with all the contractors bidding on the CTC and TKPOA projects that were potentially scheduled concurrently for the summer of 2020.

The TKPOA RFP’s for these bulkhead projects had gone out to 32 potential contractors, which included the contractors that attended the mandatary Pre-Bid Meeting for the Upper Truckee River and Marsh Restoration Project, local bulkhead contractors and recommended bulkhead contractors with the deadline is March 12th, 2020 for the submitted proposals.

The time period in which the TKPOA issued its RFP’s was coordinated with the CTC bidding process to allow all contractors to consider the TKPOA bulkhead projects for bidding, prior to the CTC bid deadline.

The TKPOA Bulkhead Replacement Project are as follows:

Replacement Project: is 540 linear feet of sheet pile replacement that will be constructed with chance anchors at 8-foot centers with an exterior waler to the steel sheet piles. This project was designed by Noble Consultants G.E.C. Inc. and permitting for the project has been coordinated by Simon Environmental Inc., and TKPOA staff. The TKPOA has been working on the East Channel East Bulkhead replacement project since 2016 because this project is governed by the 1991 Stipulation for Entry of Judgment, between the TKPOA, the

Tahoe Keys Beach and Harbor Association (TKB&HA) and the Tahoe Keys Marina and Yacht Club (TKM&YC).

The TKPOA is required by the 1991 Stipulation for Entry of Judgment to take the lead on this project, complete the project and then request reimbursement from the TKB&HA at 30% of the project cost and TKM&YC at 40% of the project cost. As documented by Ron Noble, with Noble Consultants G.E.C. Inc, the bulkhead is beyond its useful life and is need of replacement before a potential collapse occurs. As the joint owners of the East Channel bulkhead we may be required to move forward with repairs or replacement to this bulkhead by State, Federal and Regional regulatory agencies because the East Channel is considered part of Lake Tahoe which is a Tier III rated Outstanding National Resource Water (ONRW) and is Federally protected. Out of the 32 RFP’s that where sent out to potential contractors the TKPOA only received two valid and one invalid RFP submittals ranging from $1,665,000 to $2,205,820. (Not including design and permitting expenses to date). The engineers estimate for this project was $1,274,469.

PROJECT #2: The Cove 3A Bulkhead – Replacement Project: is 107 linear feet of sheet pile replacement that will be constructed with chance anchors at 8-foot centers with an exterior waler to the steel sheet piles. This project was designed by Noble Consultants G.E.C. Inc. and permitting for the project has been coordinated by Simon Environmental Inc., and TKPOA Staff. The TKPOA staff has been working on this project with the Cove 3A Cove Advisors since 2016. The cost of this project is the responsibility of the Cove 3A Townhome property owners because this bulkhead is owned “in common”. The Davis Stirling Civil Code requires the Cove Townhome property owners to reserve, repair, maintain and replace their owned “in common” reserve components such as the bulkhead. The Cove 3A property owners have been working toward funding their reserve for this project as scheduled for 2020, but do not have a fully funded project, so they have also conducted a Special Assessment Vote in 2019 to fund this project, but the vote did not pass. Out of the 32 RFP’s that where sent out to potential contractors the TKPOA only received CONTINUED ON PAGE 14

Cove Advisors Needed for Bavarian Isle, Aloha Isle, Mount Tallac Village III, and Cove 2 It is important that all TKPOA subdivisions are represented by a property owner living within their subdivision. Per the Advisor rules, any owner in good standing may volunteer to serve as the Advisor to their Subdivision or Cove. Otherwise the property owners may nominate themselves or another owner within that subdivision, confirmed by a vote of the Board of Directors.

Each Cove Advisor is responsible for handling the general affairs of the cove including unit/common area facilities; report maintenance, repair and other property owners issues to TKPOA management and follow-up in keeping those property owners up to date with current events, general affairs of projects happening within the Keys, and manage the cove’s budget.

two valid and one invalid RFP submittals ranging from $650,000 to $771,000. These submitted RFP’s exceeded the 2019 Engineers Estimate for this project. (Not including design and permitting expenses to date). The engineers estimate for this project was $264,000.

PROJECT #3: The Cove 3C Bulkhead –

Replacement Project: is 880 linear feet of new free-standing heavy-duty sheet pile wall about 10 to 12 inches outside of existing sheet pile wall. [This project will not include chance anchors or a waler]. This project is designed by Reno Tahoe Geo Associates Inc. and permitting for the project has been coordinated

by Simon Environmental Inc. and TKPOA staff. The TKPOA Staff has been working on this project with the Cove 3C Cove Advisors since 2019, due to signs of earth movement, bulkhead and fence/gate tilting as well as the results of the 2019 Bulkhead Monitoring Report.

This project had to be “fast tracked” for draft design and permitting to be included in this competitive bidding time period. The cost of this project is the responsibility of the Cove 3C Townhome property owners because this bulkhead is owned “in common”. This Bulkhead replacement project was originally scheduled for 2028, so to now move it forward to 2020 causes a funding shortage issue. The Cove 3C property owners have been working toward funding their reserve for this project that was originally scheduled for 2028, but do not have a fully funded project, so they also conducted a Special Assessment Vote in 2020 to fund this project, and the ballot counting date has been postponed to April 4th, 2020. Out of the 32 RFP’s that where sent out to potential contractors the TKPOA only received one invalid RFP submittal. The engineers estimate for this project was $1,610,000.

Moving Forward

For the summer of 2020 the CTC is planning on moving forward with their Upper Truckee River and Marsh Restoration Project. At this time the TKPOA Keys Breeze

Board of Directors are still considering the East Channel East Bulkhead – Replacement Project, and the costs associated with delaying the project another year or two. Unfortunately, the cost of this project has come in higher than expected. The original estimate for the TKPOA bulkhead replacement was based on forecasted costs of $2,500 a linear foot. Current cost are now in the range of $3,083–$5,900 a linear foot not including design, permitting, and contingency costs.

Based on the current costs for these four bulkhead projects submitted during a “competitive bidding” period the TKPOA Board of Directors, Cove Advisors, property owners and TKPOA staff will need to reassess the funding and timing for future bulkhead replacement projects. Utilizing this current pricing, adjusting for inflation and other factors, these bulkhead replacement projects, and all others will require increased reserve funding to contract and complete these projects with or without additional special assessment payments from TKPOA Property Owners. The Board of Directors, TKPOA staff and Cove Advisors will need to determine “if and when” they will want to conduct another Request for Proposal (RFP) bidding period for these projects together or separately.

Unfortunately, to wait until the individual bulkheads sections fail and respond with an “emergency repair” is another risk to face with potentially higher project costs, permitting issues, structural damage to property, potential loss of insurance coverage and the risk of fines from State, Federal and Regional regulatory agencies because the TKPOA Lagoons and East Channel are considered part of Lake Tahoe which is a Tier III rated Outstanding National Resource Water (ONRW) and are Federally protected.

THE TAHOE KEYS PROPERTY OWNERS ASSOCIATION (TKPOA) Board of Directors is looking for volunteers to serve as the Inspector(s) of Elections and as Ballot Counters for the upcoming Annual TKPOA Board Election.

The Inspector of Elections is responsible for receiving ballots and verifying the voting homeowner’s eligibility prior to the vote count date in order to determine the amount of disqualified and valid ballots received and whether the required quorum amount of received ballots was achieved.

Ballot counters assist the Inspector(s) on ballot count day with tallying the results of the vote and announcing the members appointed to the Board of Directors for the upcoming 2020–2021 Board term.

THE FOLLOWING PROCEDURES for application

submittals are provided for your information as required by State Law and are taken from Section 3 of the Architectural Control Rules.

Section 3 – Plans, Applications and Plan Submittal Procedures

03.01 Plans: It is the responsibility of the owner of any property proposing new construction, remodeling, painting, construction of fences, boat dock, boat ramps, bulkheads, or any other improvements to the property or exterior of the structure to submit plans for the proposed construction or improvements to the ACC for approval prior to the start of any construction.

03.02 Any property owner seeking project approval from the ACC must be a member in good standing of the Association with all Association assessments and charges paid current. If Association assessments are in arrears, any such submittal will not be accepted and will be considered automatically denied.

03.03 When additional information is required for the ACC to evaluate any application, such information must be submitted within thirty (30) days of notification by the ACC. If no response is received, then the application will lapse. Plans, sample materials and deposit will be returned.

03.04 Denied plans shall indicate the reason(s) for such denial within thirty (30) days’ time from said disapproval. An owner may appeal to the ACC for review of any denial. An applicant must resubmit modified plans within ninety (90) days from the date of the disapproval letter or appeal hearing, whichever is later, or the application will lapse, and all materials and deposits will be returned to the applicant.

03.05 Plan Submittal: Two sets of building plans must be submitted to the ACC for approval before any construction commences to include the breaking of ground for foundation. The submittal and the hold harmless document must be signed by the property owner, no exceptions.

Architectural Control Committee (ACC) approval is evidenced by the ACC stamping and

signing of the plans. No opinion or advice, written or oral, shall constitute approval.

Approval of the submitted plans by the ACC is not to be construed as indication of the accuracy or structural integrity of the submitted plans.

03.06 NEW RESIDENTIAL PLANS are valid for two (2) years. OTHER APPROVED PROJECTS are valid for one (1) year only. Unless the project is completed, new applications are required after the expiration of the permit.

03.07 Plans must include the following when submitted: • Plot plan showing setbacks and easements.

• Floor plans.

• Elevation plans, showing all sides of the structure. The drawings must indicate height of the building from the curb flow line at center of front property line to the roof ridge.

• Samples of exterior materials and colors.

• Landscaping including automatic irrigation system, sod, trees, shrubs, etc. It is required that all ground be covered with some variety of plant life cover. See Section 10.

03.08 The plot plan shall show all property lines including the front property line (the dedicated street line), the curb line, the approximate high waterline and any recorded easements, and all front, rear, and side setbacks as proposed on the property. Any incorrect data or omissions could invalidate ACC approval.

03.09 No plan changes will be made to any ACC approved plans without submitting changes to the ACC for approval. Requests for approval of changes must be submitted in writing and, if necessary, revised plot plans and elevation drawings must be submitted to the ACC for review and approval. Any deviations from the originally submitted and approved colors or materials must be resubmitted to the ACC for review and approval. All structures shall be built in conformity with the plans, as amended and approved. Changes need to include architectural design, chimneys, height variations, outside pipes, sheet metal, fences, decks, paint color, railings, bulkheads, docks, and shrubbery.

Association (TKPOA) will start seeking candidates for the four seats on the Board of Directors that will be vacated at the end of the current term of office. Board Members: Robert Meyers, Vice President; Jim Siegfried, Treasurer; Michael Keller, Director; and Dennis Daniel, Director have their 2018–2020 terms coming to an end. President Joe Sherry, Secretary Sean Ward, and Director Melvin Meyer still have their 2019–2021 terms to complete. A mailing to all TKPOA property owners will be going out on April 24th, 2020 announcing the upcoming election and requesting you to volunteer your services as a TKPOA Board Member through the self nomination process.

From the TKPOA BYLAWS ARTICLE VII, Board of Directors:

SECTION 2. Number and Qualification of Directors The Board of Directors shall consist of seven (7) persons who shall be owners of lots whose memberships are in good standing with all assessments current and not subject to any suspension of membership rights. Only one owner per lot shall be eligible to serve on the Board at any time and at least one of the seven Board positions shall be occupied by a townhouse owner.

SECTION 3. Term of Office

Each director shall serve for a term of two (2) years, with three (3) directors elected in odd-numbered years and four (4) directors elected in even-numbered years. No individual shall serve more than two (2) consecutive two-year terms on the Board. Each director, including a director elected or appointed to fill a vacancy or elected at a special meeting of members, shall hold office until the expiration of the term for which he or she was elected and until a successor has been elected and qualified.

Board of Directors

The Association has responsibility for its common elements as well as the management and operation of the Association's business affairs; all in accordance with standards established by the Governing Documents. To the extent that an association (in our case non-profit 501(c)(4) corporation) has such authority and control, it is its Board of Directors that carries out these duties and responsibilities.

TKPOA’s responsibilities include: on-going maintenance functions, upkeep of the common elements, and to provide and direct TKPOA management and staff. The TKPOA Board's authority includes all of the powers and duties enumerated in general law, as long as these powers are not inconsistent with the provisions of the Governing Documents of the Association. To be successful, the TKPOA Board of Directors must uniformly and fairly govern the community, and it must have a reasonable level of participation by each of its members over time.

The duties include: preparing for and participating in 12 Open Board Meetings during the year, 12 Executive Session Meetings during the year, serving as liaison to a standing committee, providing articles for the monthly Keys Breeze, and participating in Town Hall Forums and other meetings to represent the Association and to seek input from members. It requires the contribution of 20 hours per month to 20 hours per week. If you have questions about running for the Board, the current and prior Board Members are a good resource of information.

Officers of the Association

Once the Board of Directors have been elected, each year Article XI of the TKPOA Bylaws requires that the President and Vice President shall be elected by the Board from among the Directors. The Board may appoint, or may empower the President to appoint, such other officers (Secretary and Treasurer) as the affairs of the Association may require, each of whom shall hold office for such period, have such authority and perform such duties as are provided for in the Bylaws and as the Board may from time to time determine.

The TKPOA acts through its officers, committees, TKPOA management and staff. The Board of Directors makes the policies for the Association, but the officers, committees, TKPOA management and staff carry out these policies and administrative functions for the community. All of the officers have an affirmative obligation to act with utmost good faith towards the Association and cannot deal in the funds or the property of the Association to their own self-advantage.

I invite your candidacy as an Association Director for the coming Fiscal Year 2019– 2021 two-year term. The successful operation of our Association is dependent on a qualified and dedicated Board of Directors. The Board meets each month based on an agreed upon yearly schedule at the TKPOA Pavilion to conduct Association affairs and provide members an opportunity to express their views and offer suggestions.

Hazardous Material Spill/Release Notification Guidance

Members and their guests play an important role in protecting the health of Lake Tahoe. Boat sewage, graywater, cleaning products, spilled fuel and oil, trash and aquatic invasive species are all potential sources of pollution. Government alone cannot protect California’s environment and Lake Tahoe. Every boater must take responsibility for pollution prevention and try to minimize the environmental and public health impacts from boating activities.

It is your responsibility as a boater and a member of the TKPOA community to report hazardous materials spills. If in doubt, report the release!

The following are the reporting procedures from the Cal OES - California Governor's Office of Emergency Services – California Hazardous Material Spill/Release Notification Guidance.

Notification is required regarding significant releases from: • Facilities • Vehicles • Vessels • Pipelines • Railroads State law: Handlers, any employees, authorized representatives, agent or designees of handlers shall, upon discovery, immediately report any release or threatened release of hazardous materials (Health and Safety Code §25510). Federal law: Notification to the National Response Center is required for all releases that equal or exceed federal reporting quantities: (EPCRA) Owners and Operators to report and (CERCLA) Person in Charge to report.

WHEN TO NOTIFY Q: When must emergency notification be made?

A: All significant spills or threatened releases of hazardous materials, including oil and radioactive materials must be immediately reported. Notification shall be made by telephone.

WHAT INFORMATION Q: What information is required?

A: State notification requirements for a spill or threatened release include (as a minimum): • Identity of caller • Exact location, date and time of spill, release or threatened release • Location of threatened or involved waterway or storm drains • Substance, quantity involved, and isotope if necessary • Chemical name (if known, it should be reported if the chemical is extremely hazardous) • Description of what happened Federal notification required additional information for spills (CERCLA chemicals) that exceed federal reporting requirements, which includes: • Medium or media impacted by the release

WHICH AGENCIES Q: Who must be notified?

NO DISCHARGE AREAS It is illegal to release wastes, treated or not, into a federally designated No Discharge Area. Your marine sanitation device (MSD) must be connected to a holding tank or secured to prevent all sewage discharges.

California’s No Discharge Areas are: El Dorado County: Lake Tahoe.

PENALTIES State Law requires that ANY discharge or threatened discharge of oil into STATE WATERS must be reported to Cal OES. (California Government Code (GC) §8670.25.5; California Water Code (WC) §13272, California State Oil Spill Contingency Plan). Federal and state laws provide for administrative penalties of up to $25,000 per day for each violation of emergency notification requirements.

Criminal penalties may also apply.

the Tahoe Keys Property Owners Association (TKPOA) has completed over five years of monthly publications.

I would like to thank TKPOA Staff members and TKPOA Board members for all of their diligent efforts, writing, and editing each issue. I have personally received very positive and insightful feedback from many TKPOA members. Many members have commented they now read the Keys Breeze cover to cover. Of course, if you miss an issue you can always catch up online via our TKPOA website: www.TKPOA.com where each monthly issue of the Keys Breeze is posted.

The Keys Breeze publication meets the requirements of a California Home Owners Association for a Common Interest Development “Official Communication” method to its members; especially now that we have continued the monthly publication of the Keys Breeze.

The Davis-Stirling Act Civil Code §4040 and §4045 and §4050 indicates Association documents shall be delivered by one or more of the following methods: 1. Personal delivery.

2. First-class mail, postage prepaid, addressed to a Keys Breeze

member at the address last shown on the books of the association or otherwise provided by the member. Delivery is deemed to be complete on deposit into the United States mail.

3. E-mail, facsimile, or other electronic means, if the recipient has agreed to that method of delivery.

The agreement obtained by the association shall be consistent with the conditions for obtaining consumer consent described in Section 20 of the Corporations Code. If a document is delivered by electronic means, delivery is complete at the time of transmission.

4. By publication in a periodical that is circulated primarily to members of the association. [The Keys Breeze would qualify for this definition].

5. If the association broadcasts television programming for the purpose of distributing information on association business to its members, by inclusion in the programming.

6. A method of delivery provided in a recorded provision of the governing documents.

7. Any other method of delivery provided that the recipient has agreed to that method of delivery.

A document may be included in or delivered with a billing statement, newsletter, or other document that is delivered by one of the methods provided in the method list above 1–7.

For the purposes of this section, an unrecorded provision of the governing documents providing for a particular method of delivery does not constitute agreement by a member of the association to that method of delivery.

The Keys Breeze publication also meets the standards of the Corporations Code §5016.

Notices and Reports via Newsletters, that applies to California Home Owners Association for a Common Interest Development. Code §5016: A notice or report mailed or delivered as part of a newsletter, magazine or other origin regularly sent to members shall constitute written notice or report pursuant to this division when addressed and mailed or delivered to the member, or in the case of members who are residents of the same household and who have the same address on the books of the corporation, when addressed and mailed or delivered to one of such members, at the address appearing on the books of the corporation.

Please make sure you have your current address on file with the Association.

On January 1st, 2017 Senate Bill 918 went into effect and now every California community association is required to ask its members to provide their contact information and property status. Civil Code §4041 now requires, that each association must solicit the following information from its members: 1. The mailing address where notices from the association are to be delivered; 2. Any secondary address where notices from the association are to be delivered; 3. The name and address of each member’s legal representative, if any, or other person who can

be contacted in case of the member’s extended absence; and 4. Whether the member’s property is owner-occupied, rented, vacant, or undeveloped land.

Although the civil code statute does not mention how often an association must solicit this information, it does state that each member is responsible for providing this information to the association on an annual basis. If a member does not provide this information, the member’s onsite mailing address is deemed to be the proper mailing address for the association to deliver notices to the member. It’s important for associations to note that as long as they request all of the contact information above, Section 4041 places the responsibility on members to provide their correct and current contact information. Requiring members to provide this information should aid associations in giving notice of meetings or for other required notices as well as with the collection of delinquent assessments as it should help negate the argument that a notice was sent to the wrong address. TKPOA provides members with a copy of Form 4041 each year with the Annual Disclosure mailing and a copy can be requested from the TKPOA Office at info@tahoekeyspoa.org.

Second, the bill requires associations to “solicit” these annual notices of each owner, and enter the date into the association’s books and records at least thirty days prior to making its annual disclosures required by Civil Code §5300.

In meeting these “Official Communication” requirements, TKPOA has utilized the Keys Breeze for Civil Code §4360 Notice and Approval of Rule Change by Board of Directors. Ideally this method will be utilized for limited rule changes of no more than a page of copy, but occasionally could be longer. In doing so, the TKPOA has saved money on mailing and staff costs to prepare rules change mailings.

Notice of Proposed Change. Before adopting or amending an operating rule or changing a fine schedule, the Board must “provide written notice of a proposed rule change to the members at least 30 days before making the rule change.” The notice must include the text of the proposed rule change and a description of its purpose and effect.

Notice is not required if the board determines that an immediate rule change is necessary to address an imminent threat to public health or safety or imminent risk of substantial economic loss to the association. Civil Code §4360.

Method of Notice. The method of providing notice of a rule change is described in Civil Code §4360 as the methods approved by Civil Code §4040, §4045 and §4050.

TKPOA gives notice to TKPOA members of proposed changes to the rules by publication in a TKPOA Keys Breeze monthly magazine that is mailed to all members of the association or through a direct mailing.

It is during this 30 day time period once the Notice of Proposed change is posted that the TKPOA Board of Directors would like to hear TKPOA members questions on concerns on the proposed rule change through attending regular monthly TKPOA Board meetings, emails, phone calls, attending the corresponding TKPOA Committee Meetings that the rule change may have originated with, or through contacting the TKPOA Administrative Assistant.

1. After the 30 day review period, the proposed change will go back to the Board for approval to be adopted.

Any member feedback that has been provided during the review period is considered by the Board before a decision is made.

2. If the Board approves the proposed change, the adopted rules is published in the Keys Breeze, or sent as a member mailing a second time as a notification to the membership that the rule has been changed along with its effective date.

Notice of Adoption. Within 15 days of voting on the rules, the board must notify the membership of the results of the vote. Civil Code §4360.

Once adopted the new rule or rule change is added to the Association Rules and is enforceable. The TKPOA Rules and Governing Documents are enforceable by the TKPOA Board of Directors, through TKPOA member discipline process, suspension of privileges, fines and in some cases El Dorado County Ordinances and Codes.

Based on ongoing updating and adding to our rules, the TKPOA Board of Directors, Architectural Control Committee (ACC) and TKPOA Community members are all looking to improve the Tahoe Keys for all of its members. The Annual Audit is currently being conducted for the Fiscal Year 2019. The Board of Directors approved a contract with Gilbert and Associates to conduct the 2019 Annual Audit at the January 18th, 2020 Board of Directors meeting.

The TKPOA Annual Disclosure and 2020 Budget was mailed out November 1st, 2019, and is also available on the TKPOA website. Over 400 homeowners opted to have the TKPOA Annual Disclosure and 2020 Budget sent to them via email rather than a hard copy in the Keys Breeze

mail, giving the TKPOA a substantial savings on printing and mailing costs. If you also wish to participate in helping the Association to save money, you will find the “Consent to Receive Disclosures via Electronic Delivery� on page 33 of the Annual Disclosure. This form can also be requested from the Front Desk at info@tahoekeyspoa.org. Simply complete the form and return it to the Association at TKPOA, 356 Ala Wai Blvd., South Lake Tahoe, CA 96150.

The April Finance Committee meeting is scheduled for Tuesday, April 21st, 2020 at 10:00 a.m.

As a reminder, the Budget meetings, the Board meetings, and the Finance Committee meetings, and are open to members of the TKPOA (meeting dates are subject to change).
