All activities are at the CATT office unless otherwise noted.

I

am so pleased to see our membership growing with new and exciting faces and businesses. Attending the membership orientations has always been a favorite of mine because I have the opportunity to meet new members and establish new business relationships. All of our orientations, mixers, and events really are an excellent means by which to utilize the CATT membership. These new members are the ones who ask about the benefits and always introduce some great new ideas. About the mixers! I can’t believe I won the TV at the last mixer! I was entered into the early renewal raffle. More exciting than that was the new prospective members that turned out in Incline Village at Sierra Verde Home Design Center. Interest from Incline was excellent, but also we had prospective members drive out from Truckee for this one! On Thursday March 26, I’ll be at the next orientation. Hopefully everyone in attendance will recognize the April 3 membership deadline to be listed in the CATT Building and Remodeling Guide. This is a one of the huge benefits we have as members. The Guide is distributed all over and in some places it disappears from racks and locations in a day! Think about that, when people see our Guide they are quick to pick it up. Once again, new things are happening, new committees are active, and all the CATT benefits keep growing.

n June 2014, the CA legislature passed SB 854 (Public Works Contract Registration Law). SB 854 establishes a new public works contractor registration program. Requirements of this new program apply to all public works contracts, regardless of value or funding source. The new program has three parts:

Congratulations to Teri Scharosch, recently named Executive Director for the Builders Association of Northern Nevada (BANN). Teri had previously been BANN’s Director of Operations. BANN was chartered in 1956 and is affiliated with the National Association of Home Builders. BANN is one of CATT’s reciprocal members.

6 It requires all public works contacts to be reported to the CA Department of Industrial Relations (DIR) within five working days of the contract being awarded; 6 As of March 1, 2015, no contractor or subcontractor may be listed on bids/proposals for public works contracts unless registered with the DIR; and 6 As of April 1, 2015, no contractor or subcontractor may be awarded a contract for public works unless registered with the DIR. Cost is $300 for a contractor or subcontractor to apply and register. If a contractor or subcontractor has more than one entity or business that bids on or performs public works, then each of those entities must be registered with DIR. This registration requirement is not just for public works with the State. Local jurisdictions cannot award a contract to a contractor or sub unless they are registered with DIR. he Truckee Home & Building Show on Memorial Day Weekend, Saturday, May 23 and Sunday, May 24 is coming up soon! CATT has a booth at the show and we are looking for members who can volunteer for a three hour shift. The CATT Booth (#27) is at the entrance to the north display area (old gym). From that strategic location, CATT members will give out “hot off the press” copies of the 2015 Building & Remodeling Guide. As CATT reps, members explain the Job to Bid procedure to homeowners and answer their questions. Sometimes homeowners come loaded with a roll of plans ready to write up their job description, no prompting needed! CATT Home Show Co-Chairs Gerald Wallace (Truckee Tahoe Stone & Tile Cleaning) and Colette Fonseca (Spirit Tahoe Interior Design) have great ideas for the CATT Booth this year! The workshop will cover: how to use TRPA’s online resources; TRPA’s new electronic approval process for BMP retrofit design; commercial and multi-family residential BMP permits and maintenance; using the NRCS Standard Drawing Booklet (included) for BMP installation. Q&A for Contractors By Shauna Krause, President, Capitol Services, Inc.

W

hile most contractors have a grasp of the laws they work under, some of those rules really require an expert eye. Long-awaited in California, the availability of LLC licensing is not without some remaining rumors and confusion among contractors. Finally, we have to disappoint a NV contractor who thought he might avoid one CA exam… Q: I read in one of your recent articles that in order to Qualify more than one license the individual must own at least 20% of each entity. Is there a specific B&P code section that states that requirement? A: Yes, B&P Code section 7068.1 conveys the few circumstances that allow for an individual to Qualify more than one license. These include: 1) There is common ownership of at least 20% of the equity of each individual or firm for which the person acts in a Qualifying capacity; 2) The additional firm is a subsidiary of or a Joint Venture with the first. “Subsidiary” is defined as one firm owning at least 20% of the other firm; or 3) The majority of the Partners, Officers, or Managers are the same. Q: We are in the process of getting a contractor’s license for our Limited Liability Company (LLC). Our application was rejected and according to the CSLB’s website the reason for the rejection is that the members/managers don’t match. Do you know what that means?

A: As you likely already know, LLC’s are required to register with the Secretary of State and file a Statement of Information listing the Members/Managers/Officers of the company. The personnel that you have listed with the Secretary of State must match exactly with the personnel you have listed on the application and contractor’s license. The CSLB’s rejection is most likely because what you have listed on the license application doesn’t match exactly what you have listed in the Secretary of State’s records. Q: We have a “C-30” (Installing Equipment to Treat Water) license in Nevada and we need to get licensed in California. I looked through the list of classifications and it appears that I will need to get a “C-55” (Water Conditioning) license in CA. Is there a trade exam for that? I didn’t have to take one in Nevada. If there is a trade exam, will I qualify for reciprocity? A: Yes, there is a trade exam for the “C-55” classification. With the exception of the “C-61” classifications, all other “C” classifications require a trade exam. Unfortunately the water conditioning classification is not reciprocal so you will be required to take two, both the law and trade exams. he 18th Annual CATT/BMD & Johns Manville Golf Tournament is Wednesday, June 10, 2015 at Gray’s Crossing in Truckee, CA.
