How the property buying process works

Once your offer for a property has been accepted, the legal process begins. A legally binding contract between the seller and you is put in place. A date for completion is agreed which is when the title to the property is transferred and you take possession of the property. Up until contracts have been exchanged, either you or the seller can withdraw from the transaction without being legally held liable.

However, once the contracts have been exchanged you can lose your deposit if you fail to complete therefore it is vital you are certain of the implications before you sign anything.

The property searches

You will need a conveyancer to request infor mation from the local authority to check particulars about any planned developments, disputes, roadworks or land works that may affect the property, or whether the property is on land which has been known to flood or been used before for excavation.

Stamp Duty Land Tax (SDLT)

Stamp Duty Land Tax (SDLT) is a gover nment tax that is charged when you buy a property in England and Wales.

It is often transferred by your conveyancer when you exchange on your property, and must be paid within 14 days of purchasing your home. Only those buying a property pay Stamp Duty.

Rates are dependent on the price of the property and are organised into bands. There are different rates if you are buying a second home or a buy-to-let property and in most cases, First Time Buyers are exempt from paying it. (£425,000 cap). Our Conveyancing team will be able to advise you of the Stamp Duty payable on your purchase.
