(The Railroad Never-Ending Story)

I

n the movie, Groundhog Day, Bill Murray plays a smug and selfish person caught in a time loop; the same day keeps repeating itself, over and over again.

On November 30, 2012, the Paulsboro school district in New Jersey was forced to close its three public schools due to the derailment of a Conrail train that lost some tanker cars that careened down into Mantua creek. One of the tankers containing vinyl chloride was punctured as it slid down the embankment. Responders hastily supervised evacuations without proper breathing equipment. The school district closed for six days and eventually sued Conrail for $5.8 million. Sixteen police, fire and rescue personnel also filed suits1.

While vinyl chloride causes dizziness and sleepiness, it can result in people passing out and even dying.

The chemical is a carcinogen. At higher temperatures, it becomes unstable. Burning the vinyl chloride releases phosgene (a WWI chemical weapon) and hydrogen chloride, both which are also toxic2.

On February 3, 2023, 38 cars of a 150 car freight train derailed in rural East Palestine, Ohio, a town of approximately 4,600 population alongside the Ohio River. Some of those cars collided and caught fire. It was determined that five of those derailed tankers contained vinyl chloride.

Benzene and butyl acrylates were also discharged. While none of those tankers containing the vinyl chloride were leaking, a predicted “rapid temperature change” worried Norfolk Southern – an explosion could happen. Only two days after the wreck, the rail company decided to burn off the vinyl chloride. Until then, neighboring Pennsylvanian residents were urged to keep windows and doors closed.

Those in a radius of 2 miles were evacuated prior to the burn.

También se derramó benceno y acrilatos de butilo. Si bien ninguno de esas cisternas que contenían cloruro de vinilo tuvo fugas, un inminente “rápido cambio de temperatura” preocupó a Norfolk Southern: podría ocurrir una explosión. Solo dos días después del accidente, la empresa ferroviaria decidió quemar el cloruro de vinilo. Hasta entonces, se instó a los residentes vecinos de Pensilvania a mantener las ventanas y puertas cerradas.

Denser than water, the vinyl chloride is sinking to the bottom of lakes, ponds and waterways. As of this writing, (Feb. 19, 2023, the vinyl chloride has supposedly passed Cincinnati, Ohio. The Ohio Department of Health Director, Bruce Vanderhoff has just stated that the air and water quality around East Palestine is “generally safe.” Of interest is the challenge from Ohio senator, J.D. Vance to those EPA officials to drink the water from any stream around East Palestine4.

Between Paulsboro and East Palestine, 20,000 liquid gallons of paraffin wax flowed from a derailment in Sandusky,Ohio. Another 20,000 gallons of a flammable chemical in Illinois Thomas Block Lorain, OH was lost followed by 1,423 gallons of combustible petroleum distillates in western Pennsylvania.

These are local or neighboring events rather than national, here, in the Great Lakes area5.

Also between the two events, trains have lengthened to almost 2.5 miles long (Ibid).

During this time period, the Norfolk Southern railroad has implemented a euphemistic management philosophy labeled Precision Scheduled Railroading (PSR) that favors moving more freight for lower costs while slashing safety inspection times, personnel and maintenance that “pads corporate profits”2. While PSR insists it benefits customers ‘by providing consistent, reliable, predictable service,’ its reduction in personnel, maintenance and inspection times contradicts corporate PR6.

Since the beginning of 2021, there have been 334 derailments in California. The Bay

Area provides hazardous materials and toxic chemicals passage to oil refineries, pesticide plants, agricultural centers, etc. Union Pacific and BNSF pursue “lower operating costs, lower operating ratios and higher profits above safety” – in other words, Precision Scheduled Railroading. The longer trains put more wear and tear on tracks while the rail industries’ workforce has been cut7. Perhaps Richmond will be the next East Palestine?

Durante este período, Norfolk Southern ha implementado una filosofía de gestión eufemística denominada Precision Scheduled Railroading (PSR) que favorece el movimiento de más carga por menor costo al tiempo que reduce drásticamente los tiempos de inspección de seguridad, el personal, y el mantenimiento que “fortalece las ganancias corporativas”2.

Si bien PSR insiste en que beneficia a los clientes al ‘brindar un servicio consistente, confiable y predecible’, su reducción en personal, mantenimiento y tiempos de inspección contradice a su oficina de relaciones públicas corporativas6.

Desde principios de 2021, ha habido 334 descarrilamientos en California. El Área de la Bahía es el portal de materiales peligrosos y productos químicos tóxicos a refinerías de petróleo, plantas de pesticidas, centros agrícolas, etc. Los ferrocarriles Union Pacific y BNSF buscan “costos operativos más bajos, índices operativos más bajos y mayores ganancias por encima de la seguridad”, en otras palabras, Precision Scheduled Railroading. n its first day in office, the Biden administration proposed a comprehensive immigration reform law based in large part on a bill first proposed by the Bush administration and a bipartisan Senate coalition that proposed moving from primarily family-centered to meritbased criteria and emphasizing employment categories vital for the U.S. economy. It was passed almost immediately in the House with bipartisan support but tabled ever since by the threat of Republican filibuster in the Senate.

The new government also announced and began day one implementation of a series of executive orders designed to reduce the inhumane and essentially anti-immigrant policies of the Trump administration, such as family separation and refusals to consider asylum requests during the Pandemic, as well as spur the flow of skilled technical, medical, and agricultural workers.

Vice President Kamala Harris was charged with coordinating the policy area for the administration, and soon took off on her first overseas trip to Mexico and Guatemala to improve coordination with the two countries – the tip of the so-called Central American Iron Triangle (Guatemala, Honduras and El Salvador) -- that had been responsible for the primary pathway and largest flow of immigrants to the U.S. during most of the previous two decades.

Yet as the program was just getting off the ground and before the Vice President even reached the countries of origin, Republican leaders had begun calling for the impeachment of Secretary of Homeland Security Mayorkas for supposed flaws in the new policy and were ridiculing Vice President Harris for not having visited the border before she went overseas.

n su primer día en el cargo, la Administración Biden propuso una ley de reforma migratoria integral, basada principalmente en un proyecto de ley propuesto por primera vez por la Administración Bush y una coalición bipartidista del Senado. Esta proponía pasar de requisitos principalmente centrados en la familia a factores basados en el mérito y enfatizar el empleo en categorías vitales para la economía estadounidense. Fue aprobada casi de inmediato en la Cámara con apoyo bipartidista, pero desde entonces pospuesta por la amenaza de una obstrucción republicana en el Senado.

El nuevo gobierno también anunció y comenzó desde el primer día la implementación de una serie de órdenes ejecutivas diseñadas para reducir las políticas inhumanas y esencialmente antiinmigrantes de la Administración Trump —como la separación familiar y la negativa a considerar las solicitudes de asilo durante la pandemia, así como estimular el flujo de trabajadores calificados técnicos, médicos y agrícolas.

alleging that the border was out of control and being overrun – the same national emergency that Trump kept proclaiming but never happened during his presidency. And of course the border area was in turmoil because Trump had dramatically reduced the flow of immigrants and used the Pandemic to bottle up well over a million asylum seekers in Mexico and the Iron Triangle alone, among many other changes that also reduced the work potential of nearly a million DACA Dreamers and cut the flow of specialized workers to the lowest level in decades.

Then —the minute news of Biden’s election reached Latin America— the hope of reaching and entering the Land of Promise started hundreds of thousands on the march and in rafts not just from Mexico and Central America, but also from Nicaragua, Venezuela, Colombia, Cuba, Haiti and much of the rest of the area. Suddenly, after more than two years of Pandemic quiet, the border was again in tumult and hardly any of Trump’s ballyhooed new border walls had been completed.

The Biden administration agrees with the majority of the American people that immigration makes a vital contribution to the dynamism, vital resources base, openness, competitiveness and innovativeness of the U.S. economy. Instead of immigration as a drain on the economy, it is generally viewed as a motor that needs to be applied judiciously. Asylum seeking is also a human right.

In contrast, Trump era brutality and outright restrictions on immigration and disregard for asylum rights had so severely curtailed legal migration to the U.S. that it contributed to the contraction of the US economy in 2020.

Our lack of labor force flexibility and severe worker shortages in several areas helped fuel inflation and reduce the capacity of the U.S. to cope with the Pandemic and adjust to supply chain bottlenecks that were then worsened by the War in Ukraine1.

We also now have an enormous pool of frustrated neighbors in the DACA program who have lost their path to citizenship and their right to work in the U.S. even though most of them came to the U.S. as children or were born here, speak only English and have never lived in the countries to which the Trump administration was trying to send them because their parents had been undocumented immigrants.

Republicans falsely accuse the administration and Democrats in general of favoring open borders and unregulated immigration and fail to recognize that the U.S. had achieved one of the largest reductions in the flow of undocumented migrants in U.S. history between 2005 6 Joaquín MARCH 2023

and 2017.2 It was an effort started by President Bush and continued by President Obama, despite the obstruction by highly conservative Republicans, called Nativists, who oppose nearly all migrants. For this reason President Trump emphasized building border walls and harsh law enforcement measures. To intimidate people who might think of immigrating, he separated children from their parents at the border and took other inhumane actions. He hardened the embargo against Cuba and took similar harsh measures against Nicaragua and Venezuela.

Although the record is not clear, there is little evidence that the flow of undocumented immigrants had slowed further before the Pandemic hit with full force and allowed the Trump administration to interfere even with internationally protected asylum rights.

Trump also stopped or reduced a whole series of U.S. programs designed to help the economies, combat human trafficking, and reduce human rights abuses in the neighboring Western Hemisphere countries that have long been the major source of undocumented migrants at the border. Imagine just tiny war torn and corrupt El Salvador, the smallest country in Latin America, ranks fifth as a source of U.S. immigrants since 2000.

Trump policies and actions clearly followed some very old and generally lamented U.S. traditions. At the beginning of our republic, the Nativists hated the German colonists and wanted to deny citizenship even to the two German-speaking regiments who fought for George Washington and barely survived the winter at Valley Forge. In the 1840s the Know Nothing Party was formed to oppose Irish and Catholic immigrants. In the 1880s the U.S. passed our first immigration law to exclude Chinese immigrants and favor only northern Europeans.

In the Jim Crow era of all out segregation and Ku Klux Klan celebrity, the U.S. passed the most discriminatory immigration law in history and contributed directly to the deaths of hundreds of thousands, if not millions, of Jewish, Armenian, and other refugees during the Second World War. And in 1979 the era of mass school continues on page 23

Estos críticos volvieron a asegurar que la frontera estaba fuera de control y estábamos siendo invadidos —la misma “emergencia nacional” que Trump siguió proclamando pero que nunca sucedió durante su presidencia. Y, por supuesto que la zona fronteriza estaba en crisis: Trump había reducido drásticamente el flujo de inmigrantes y utilizó la pandemia bloqueando a más de un millón de solicitantes de asilo en México y en el Triángulo de Hierro. Repentinamente, y después de más de dos años de tranquilidad pandémica, la frontera volvió a estar en tumulto y casi ninguno de los nuevos muros fronterizos tan publicitados por Trump se había completado.

La Administración Biden concuerda con la mayoría del pueblo estadounidense en que la inmigración es una contribución vital al dinamismo, la base de recursos vitales, la apertura, la competitividad y la innovación de la economía estadounidense. En lugar de considerar la inmigración como un ancla para la economía, generalmente se le ve como un motor que debe aplicarse con prudencia.

La petición de asilo también es un derecho humano.

En contraste, la brutalidad de la era Trump —al igual que las restricciones absolutas a la inmigración y el desprecio por los derechos de asilo— habían reducido tan severamente la migración legal a los EEUU, que contribuyó a la contracción de la economía estadounidense en 2020. My muffler drags a little and needs replacing; it often backfires which is quite embarrassing.

I’m missing one hubcap, a rear view mirror, and my antenna is bent.

I wouldn’t take me on long trips but short ones are fine.

In the hills, I no longer have the power to go up steep grades.

My tail pipe drags a little but a few wires holds it up.

I could use a fill up since my needle is marking “E”.

I don’t require much upkeep and I run on regular.

Yet I’ve traveled many a road and highway and seen many fine places.

Best of all I’m already paid for!

Now I sit in a field of grass nearly forgotten but still serviceable.

One can only imagine what a nice car I must have been when I was new.

fines del mes pasado, Valley Improvement Projects (VIP) —en colaboración con la organización nacional y sin fines de lucro, Environmental Working Group (EWG)— publicó un informe que revela que en el 2021 se aplicaron más de 6 millones de libras de pesticidas agrícolas en todo el Condado Stanislaus, de los cuales más del 20% —o al menos 1,3 millones de libras— fue Telone, un pesticida fumigante considerado carcinógeno.

Telone, también conocido como 1,3-Dicloropropeno, estuvo prohibido en California entre 1990 y 1995 (de hecho está prohibido en 34 países… pero no en los EEUU) —utilizándose en una amplia gama de cultivos, donde destacan las almendras en el Valle, y las fresas en la costa. Projects (VIP) VIP, alongside many others across the state, is fighting for better protections at the state level. But we can’t wait for new state legislature to protect our local community, especially if we have local power to implement local protective measures.

Web posting all Notices of Intent (NOI: notice of intent to apply restricted material that must be preapproved prior to application) should be mandatory —as well as the expansion of the notification project to the entire county.

We believe that increasing quick access to NOI’s for the county through web posting, is within their capacity, and will give all community members the opportunity to have an advance notice of, at least, proposed restricted material applications near them, if they wish to have it, and without having to submit a public records request that can take 10 days or months to access, so we can take precautionary, protective measures.

Farmers are not obligated to label or mark their fields to identify where the ¼ mi starts or ends, Labeling fields to show buffer zones on fields is not a state law, its simply just recommended by DPR. In Stanislaus, not many farmers practice this recommendation.

Should we wait till something bad happens? Or should we be preventative, and do what is best for the health and safety of the children now?

Some Farmers have good communication with neighboring schools. But unless it’s an obligation and not just a recommendation, we can’t rely on farmers to do the right thing. We can help farmers ensure they will not expose children to toxic material by requiring them to confirm with the school district or school principal that children are not on campus at the actual date and time of the application.

The town of Grayson is home for one of four Pesticide Notification Pilot Programs, and the only one still in effect. We are asking for the AC to expand on this program to the entire county. In addition, we would like them to upgrade their current system based

here is growing desperation among immigrant rights groups amid continued policy paralysis and a tightening of rules under the Biden administration. Some argue a pardon is the only way forward.

With the prospect of a legislative solution for Dreamers – and the millions of undocumented immigrants in the country – as far off as ever, the California-Mexico Studies Center is raising anew the idea of a presidential pardon in its newsletter, “El Magonista.”

The idea is not new. In 2017, immigrant rights activists asked former Pilar Marrero President Obama to use his pardon authority in the days prior to thenAssociate Editor President-elect Trump’s inauguration to protect undocumented immiEthnic Media grants or, at the very least, Dreamers.

Services Obama refused, and under Trump every effort was made to eliminate Obama’s signature DACA program, which offered temporary protection for those undocumented immigrants who arrived in the US as children.

While courts at the time protected DACA, it’s now under siege again and will likely come before the Supreme Court for a third time. It has survived similar legal challenges twice before, but all bets are off with the current makeup of SCOTUS. The editorial by El Magonista calls on President Biden to use his pardon for “Dreamers and other undocumented peoples living in the United States.”

“No other viable solutions have been suggested by any other immigration groups or elected officials – PERIOD,” the authors argue. “The time has come for Dreamers to stand up and demand President Biden issue a full pardon to all undocumented residents.”

It’s been 21 years since the first DREAM Act legislation was introduced in Congress.

Dreamers have since become a powerful advocacy voice within the US immigration policy arena.

But some activists contend that a pardon will not regularize Dreamers’ status. They also question the legal force such a pardon would carry given that under current law being undocumented is a civil violation rather than an actual crime. continued on next page MARCH 2023 Joaquín 17

But there is a growing sense of desperation within the immigrant rights movement because, as El Magonista notes, “no one else has suggested anything but hollow, band-aid efforts to finally relieve the 11 million undocumented immigrants living, working and paying taxes in the U.S. right now.”

From day one the Biden administration promised comprehensive immigration reform, including protection for Dreamers. And while it has reversed many Trump-era administrative rules and regulations, it has since hardened its position on asylum and border issues in response to growing political pressure from the right coupled with the continued arrival of migrants from Venezuela, Nicaragua, and Cuba, among others.

Just last week the administration proposed a new rule on asylum requiring non-Mexican petitioners to first seek asylum in one of the countries they pass through before entering the US. The move united the typically fragmented immigrant rights movement in opposition to what they are calling the “Trump Ban II” While clearly designed to deflect conservative criticism of Biden as an “open border President,” the fact is that restrictionism has never been a winning strategy for Democrats, either in protecting them from Republican attacks on immigration or in winning votes from erstwhile supporters.

Obama is a perfect case in point. He deported more immigrants than almost any prior president, a fact that won him few if any Republican allies. He also created DACA, protecting some 600,000 Dreamers from deportation.

A decade later, even that protection now appears to be faltering, leaving the country – and millions of undocumented immigrants – mired in continued immigration policy paralysis. ¿única Salida para los Dreamers? viene de la vuelta

The excerpts shed light on the history of Hispanos’ or Nuevomexicanos’ war at home in the U.S. and why they went to war overseas during WWII (1941-1945).

n the period 1848 to 1900, the U.S Government’s and Anglo/Euro American’s political and economic control of the Southwest created a deep social division between the new Mexican Americans and the Anglo/Euro American migrant populations that flocked to the Southwest. In the process Mexican Americans experienced subordination and racially motivated violence. The social division was punctuated by Mexican American revolt and rebellion and a violent response and suppression by law enforcement and vigilantes.

In New Mexico, the Spanish-speaking or Hispano population was the majority population for a much longer period, and it has been argued that the delay in the statehood of New Mexico until 1912 was secondary to the larger population distribution of Hispanos. Anglo/ Euro American aggression was tempered and the relations between Anglo/Euro American migrants and Hispanos more amiable because of the larger Hispano population and their capacity to fight back against mistreatment.

Resistance to Anglo/Euro American control began in 1846. A failed Nuevomexicano and Indian plot to oust Americans supported

by Colonel Diego Archuleta and Father Antonio Jose Martinez, both prominent leaders in the Nuevomexicano community, was suppressed. However, a year later the U.S. Territorial Governor, Charles Bent, was assassinated in Taos. In the ensuing violence many homes were sacked and 15 to 20 prominent landowners, either wealthy pro-American Hispanos (called Ricos) or Anglo/Euro Americans, were killed. The military suppression of the nativist revolt resulted in approximately 200 Indians

and Hispanos either killed or wounded and 15 to 20 ringleaders executed for treason. Treason against a government they did not recognize as legitimate, and this episode left a heritage of ill-will between Hispanos and Anglo/Euro Americans.

In the 1870’s and 1880’s, in Lincoln County, Nuevomexicano sheepherders had to defend themselves against Anglo/Euro American cattlemen resulting in a raging range war. New Mexico became inundated with Anglo/Euro American desperados and criminals seeking refuge in New Mexico’s geographical isolation adding to racial violence. Many joined the Lincoln County range war against Nuevomexicano sheepherders. Among them were Texans with a burning hatred of Mexicans.

In the late 1880’s Hispanos engaged in organized armed resistance. The White Caps or Las Gorras Blancas formed and claimed to have 1,500 members. A Spanish land grant, the Las Vegas Grant, containing 500,000 acres was held in-common by the inhabitants of the town Las Vegas in Northern New Mexico. Anglo/Euro American homesteaders, squatters and ranchers began acquiring and taking-over Nuevomexicano communal land.

They began putting-up fences “enclosing as many as 10,000 acres” and blocking access to timber, water, and grazing lands. Anglo/Euro American immigrants viewed Nuevomexicano communal land as unoccupied and unclaimed and part of the public domain available for appropriation.

In 1889 Hispanos took-up arms. Night riders wearing long black coats, slickers and white masks retaliated. They targeted railroad companies and land continued on next page MARCH 2023 Joaquín 19

grabbers cutting fences and destroying property. That year 300 armed men destroyed 9,000 railroad ties belonging to the Atchison, Topeka, and Santa Fe Railway lines, and “...the following year nine miles of barbed wire fence was destroyed in a single night.” “Local bands of Las Gorras Blancas rode sporadically, at least until 1926, as extranjeros continued to usurp chunks of common land.”

As the history above demonstrates, Hispanos were always willing to defend themselves against encroachments on their ancestral lands and basic human rights. Within a few decades of the Las Gorras Rebellion, they would commit to defending lands beyond the borders of their ancestral homeland. In 1941 they would enlist or would be drafted into defending the United States against its enemies in WWII and into protecting United States colonial territories in the Philippines.

Ironically, both Hispanos and Filipinos had a parallel history of Spanish conquest and colonization and then incorporation into the political orbit of United States through war.

There is evidence that Hispanos and other Mexican Americans saw going to war as a means-to-prove-themselves and to gain access to the social and economic opportunity structure Anglo/Euro Americans had benefited from since prevailing in the Mexican American War. Proving themselves to gain war veteran benefits and fulfilling a societal expectation of patriotism and military service could be called a form of “militarized citizenship.” Further, it could be argued that for Hispanos full enjoyment of the social and economic benefits of citizenship had been denied or derailed, and they saw military service as a pathway to gaining them. Even though full citizenship and its benefits had technically been granted nearly one hundred years earlier through provisions of the Treaty of Guadalupe Hidalgo in 1848..

iego remembered hearing about this serial killer, still at large, staying two jumps ahead of San Francisco City Police Department investigators, frustrating everyone, and frightening the general public.

“Was this woman another of his unfortunate victims? But, if so, who is this man?”

Diego asked himself. Perhaps the man lying on the floor was the Five-Star Hotel Killer?

Serial killers often leave their signature: knife wounds to the chest, a confession, or a letter.

Was the altar his signature?”

The Captain, too, entertained the remote possibility that the woman had been murdered by the Five-Star Hotel killer, but he did not want to voice that suspicion until the investigation had ruled out the most likely type of suspect—a jealous ex-husband or lover, who would definitely have a motive to kill the man she was with, and possibly her, as well.

Pointing to the dead man on the floor, Captain Williams asked: “Could this man have raped and killed the female victim,“ he asked, raising his pointed finger, and holding his arm straight, pointed towards the bathroom, “and then walked from the bathroom to the bedroom, where he was surprised by an intruder and sustained a blow to the head, right here by the front of the bed? Or did a different perpetrator kill both victims?”

“Most murders don’t have altars,” Diego said. “We can’t ignore that evidence. I can find out, but I’ve never read anything about an altar at the Five-Star Hotel killer crime scenes.”

The police used two conference rooms in the hotel to interview Claremont Hotel staff.

They quickly learned that the female victim was Dr. Cecilia Rollins, a club member who was recently widowed. Mrs. Rollins had rented the room for a whole week. She had been observed eating in one of the hotel’s restaurants on several occasions with different white

services in the past. The masseuse, a Marilyn Hastings, said nothing seemed unusual, other than her client seemed in a hurry, as she said she had a date at 5 pm. A room service waiter reported that at 6:30 pm, he delivered dinner for two, with two bottles of red wine, to the room, and Dr. Rollins gave him a big smile and a generous tip. That was apparently the last time anyone saw her alive.

Captain Williams ordered the investigators to request telephone records for Dr. Rollins and to search her browsing history and other computer files on the laptop found in the room. Two ambulances came and took the dead bodies to the coroners. The white male victim did not appear to have been registered at the hotel; neither had anyone seen him in the hotel or at the club. The police ended their interrogation of the staff, and as soon as they had cleared out from the hotel grounds, the hotel resumed its former elegance as if nothing had occurred.

At the Berkeley Police Department on Martin Luther King Jr. Way, the Homicide Division was humming like a beehive: pictures of the crime scene were enlarged, tacked to bulletin boards and arrows drawn to indicate relevant evidence. After they had explored the different scenarios and possible theories about the Claremont Hotel killings, investigators were left with one unlikely, but intriguing possibility, that the dead man was the Five Star Hotel Killer.

This theory was bolstered when Captain Williams picked up the telephone, and after a brief conversation, announced that forensics had just confirmed that the white male victim’s fingerprints matched those found at the scenes of two of the other Five-Star Hotel homicides.

But… if the white male was the Five Star Hotel Killer, how did he meet his death? Who had killed him? There was no forensic evidence of another person in the room. The detectives speculated that an unknown killer made the altar after murdering the Five Star Hotel Killer, concluding that the altar was probably not created by Five Star Hotel Killer, but instead by someone who targeted the Five Star Killer.

The briefing took over an hour before reaching consensus; the Five Star Hotel Killer had murdered his seventh victim and died from trauma to the head inflicted by a third person.

Finally everyone went their separate ways to further study the case and to work on other pending cases of the Berkeley Police Department.

friend with the San Francisco PD, Diego learned that newspaper clippings on previous Five Star murders did not mention anything about altars found at the crime scene, concluding that the altar was not created by the Five Star Killer, but instead by someone who targeted the Five Star Killer.

What in the world was going on? He keyed in killings that shared common evidence; women murdered with a knife, women found dead in bathtubs, altars, candles, Chinese sculptures, and roses, dating back fifty years.

He got hundreds of hits.

Now he just had to look through them. The time flew by and many people left the building before Diego noticed that Captain Williams and he were the only ones left in the homicide division. Diego waved at the Captain as he walked by his office on his way out.

The police release read, “Double homicide at Claremont Hotel in Oakland, California: White female drowns in bathtub and white male dies from severe trauma to the head.”

Hotel Claremont II viene de la vuelta

Ahora sólo tenía que mirarlos. El tiempo pasó volando y muchos ya habían abandonado el edificio antes de que Diego notara que el Capitán Williams y él eran los únicos que quedaban en la División de Homicidios. Diego saludó al Capitán al salir y pasar frente a su oficina.

El comunicado de la policía rezaba: “Doble homicidio en el hotel Claremont en Oakland, California: una mujer blanca ahogada en la bañera y un hombre blanco muere por trauma encefálico”.

In contrast to such overwhelmingly pejorative attitudes toward immigration, the Cato Institute, a leading conservative think tank in the Alan Friedman tradition of free enterprise economics, has developed a program to teach Americans about the many common but incorrect myths they hold about immigration. Some of the most important false ideas include: • The belief that immigrants take jobs from older Americans, lower wages, and hurt the poor. None of these are true.

• That immigrants use the welfare system more than others when they actually use it less.

• That immigrants raise government spending, but they actually pay more taxes than the value of the services they receive.

• That immigrants are more likely to commit crimes when they actually do so much less than those of us born here.

• That immigrants constitute a significant risk of terrorism when the FBI shows that the greatest risk of terrorism comes from white supremacist right wing militias.

• That the U.S. takes in proportionally many more immigrants than other countries when the U.S. is actually now almost at the bottom of the list among rich countries.

• Immigrants do not reduce the incomes of skilled American workers, they actually increase them and contribute to programs for worker development.

• That immigrants are an economic curse when they are actually a blessing in their willingness to start new enterprises, their scientific contributions, and their inventiveness and spread of new technologies.3 The Biden administration approach to the countries that are producing the recent heavy increase in the flow of refugees and asylum seekers also differs enormously from the Trump administration, especially here in the Western Hemisphere. The spread of authoritarian and corrupt regimes in Central and South America in the last decade or so contrasts to the partnership of democracies that had developed in the 1990s and along with explicit migration agreements, like those with Mexico and Cuba, that helped stem the flow of undocumented immigrants earlier.

Additionally, the Trump cold shoulder to Latin America, refusing even to personally

attend the 8th Summit of the Americas in Peru, coincided with a major expansion of Chinese presence and influence in countries across the region, including even such close U.S. allies as Panama and Mexico. By 2020, China had surpassed the U.S. as the leading trade partner of South America and even much of the Caribbean by a large margin. To build back hemispheric trust, President Biden extended COVID-19 assistance in the region, orchestrated the development a new hemispheric national security plan, and personally hosted the 9th Summit of the Americas in Los Angeles in 2022.

Despite the promising initiatives by the Biden administration, the huge mass of migrants who had been seeking to reach the U.S. for nearly three years began to overwhelm the U.S. border before the new Biden team was even partly in place. Experts estimate that the Biden administration had to take a record of over 2.4 million detention and removal actions of migrants just in FY 2021, but enough still entered the U.S. for Republican governors in Florida, Texas and Arizona to round up bus and airplane loads of new arrivals and send them off to cities in the Northeast and California in order to raise a ruckus about the border issue.

Meanwhile, in Latin America the attitude toward the U.S. continued to sour as the Pandemic hit their region harder than the rest of the world. The U.S. led the world in developing new vaccines and in progressive measures to reduce the economic impact, while Latin America was undergoing the highest death rate and the severest economic downturns.4 The result was less cooperation than the Biden administration hoped for and the need for more concerted efforts all along the way.

Thus the initial help in shipping a few million vaccines to a region with over half a billion people had to be increased substantially, especially as word reached our neighbors, who had a severe shortage of vaccines, that reluctance by some Americans to get vaccinations was leading to the expiration of millions of doses before they were being used here.

The Ninth Summit of the Americas which President Biden hosted in Los Angeles in June 2022 was even partially boycotted because of U.S. refusal to invite Cuba, Nicaragua and Venezuela and mistakenly follow the Trump approach of harsh coercive actions against the Communist countries in the region. While 30 countries of Latin America and the Caribbean joined in the new Climate Partnership and the Americas Partnership for Economic Prosperity (APEP), some of the key countries including Mexico did not attend when these neighbors were excluded. Nonetheless, the

APEP inauguration was well received as a high standard international agreement and the first concrete indicator that the U.S. response to Chinese initiatives in the region would be more than just warnings against Chinese perfidy while diverting all the resources for the pivot to Asia.5 As has been the case all along, the Biden administration has shown its willingness to adjust its efforts and concentrate on the value of building the alliances which have proven so successful in deepening European and other third country support for the Ukraine. As a result President Biden recalled an old Senate crony, Christopher Dodd, to work with his Latin America team. The result has been a startling opening of new doors and productive low key actions.

The relaxing of restrictions on Nicaragua have already led to a regional agreement to supervise new elections there like those that ended the civil war and the defeat of the Sandinista regime in 1990. The modification of Trump restrictions on Cuba, including those which severely limited family remittances to relatives on the island, are moving the Biden government back toward the effort of the Obama administration that intended to end the U.S. embargo. And most importantly, changes in punitive measures against Venezuela have prompted the release of American businessmen from prison and most importantly the resumption of Chevron production of oil exports from Venezuela to the U.S., the one country with the refineries that can most profitably use Venezuelan oil. The restoration of a modest flow of financial resources to Venezuela not controlled by China or Russia appears to have even opened doors toward external mitigation of the draconian political and human rights practices of the Maduro regime.

The Biden administration is obviously walking a political tightrope, possibly writing off Florida to rightwing Latinos, but seeking positive gains in oil supply for the rest of the country and gaining the agreement of Canada and Mexico for the measures that promise to control the flow of immigrants from Nicaragua, Cuba, Haiti and Venezuela. The sudden decline in asylum cases after the new agreement was reached suggests that the border control program is finally on the right track.6 At the same time the strong pink tide that has brought leftist governments to power all across South America is unexpectedly favoring broader collaboration with the U.S. and new areas of initiative, especially with respect to new energy production and climate change, developing rare earth and other mineral supply chains outside Chinese control, disease concluye a la vuelta control, and worker MARCH 2023 Joaquín 23

protections, for the first time since 2003 when much of the region balked at the U.S. invasion of Iraq.

The changes are recent and largely under the radar, but like the Biden leadership on the Ukraine war, restoring global food supply, and reviving cooperation on climate change, they have so far restored and deepened trust in U.S. global leadership.7 Such sensible policies appear to be winning friends around the world. Perhaps more Americans ought to be paying attention to the real news, rather than the cries of fear and hate from Trump and his minions.

Es por esto que el presidente Biden llamó a un antiguo camarada que tuvo en el Senado, Christopher Dodd, para trabajar con su equipo de América Latina. El resultado ha sido la sorprendente apertura de nuevas puertas y discretas pero productivas acciones.

El relajamiento de las restricciones a Nicaragua ya ha llevado a un acuerdo regional para supervisar allí nuevas elecciones como las que pusieron fin a la guerra civil y la derrota del régimen sandinista en 1990. La modificación de las restricciones que puso Trump a Cuba —incluidas las que limitaban severamente las remesas familiares a familiares en la isla— están ayudando al gobierno de Biden volver a la iniciativa de la Administración Obama, la que pretendía poner fin al embargo estadounidense. No solo eso… los cambios en las medidas punitivas contra Venezuela han significado la liberación de empresarios estadounidenses que estaban en prisión y, lo que es más importante, la reanudación de exportaciones de petróleo de Venezuela a los

La restauración de un modesto flujo de recursos financieros a Venezuela —que no es controlado por China o Rusia— parece incluso haber abierto las puertas hacia una mitigación externa a las draconianas prácticas políticas y de derechos humanos del régimen de Maduro.

Es obvio que la Administración Biden está caminando por una cuerda floja política, posiblemente abandonando los latinos de Florida para la derecha, pero buscando ganancias positivas en el suministro de petróleo para el resto del país —y ganando el acuerdo de Canadá y México para las medidas que prometen controlar el flujo de inmigrantes de Nicaragua, Cuba, Haití y Venezuela. Los cambios son recientes y en gran medida pasan desapercibidos, pero al igual que el liderazgo de Biden en la guerra de Ucrania, la restauración del suministro mundial de alimentos y la reactivación de la cooperación sobre el cambio climático, hasta ahora han restaurado y profundizado la confianza en el liderazgo mundial de EEUU7.
