Latinos, The Red Wave and the 2022 Midterm Elections

R

epublicans, pollsters, and most political pundits across party lines were expecting that both the U. S. House & Senate as well as state legislatures & governorships held by Democrats would flip to Republican in the 2022 midterm elections.

They predicted a so-called Red Wave. I will briefly discuss some of the analysis predicting that Latinos would shift right in the 2022 midterm congressional elections and outcomes in congressional districts with large Latino populations.

The analysis regarding Latino voting behavior swinging to the right has been based on two primary factors: 1) the election of Republican candidates in congressional districts that have a majority Latino population and have traditionally voted Democratic; and 2) the diminishing vote margins in Democratic victories over Republicans.

Trump’s margins in 2016 and 2020 are often referenced as an indication that Latino voters are shifting right. Dan Balz, of the Washington Post, noted that Trump’s support among Latinos grew by 10 percent nationally between 2016 and 2020. Daniel Garcia, of Libre Initiative —a conservative Latino advocacy group— claimed that Democrats were now struggling to energizing rural and working-class Latinos, especially males. This at least in part explains the Republican Party’s initiative to target and flip Latino dominated districts.

Both South Florida and South Texas have been at the center of discussions regarding congressional districts with a majority of Latinos shifting to the right and voting Republican.

It could be argued that Florida is unique and atypical because of its demographics. A large percentage of Latinos in Florida have a history

La EPA y el Glifosato

E

n estos últimos años, los investigadores han descubierto amplia evidencia de que el glifosato causa un gran daño al bioma intestinal1. Al mismo tiempo, se descubrió que el glifosato cruza la barrera hematoencefálica y desregula los niveles de tumor necrosis factor alpha (TNF-α), un regulador crítico que protege al cerebro de la producción de síntomas similares a los del Alzheimer. El glifosato también afecta los cambios en la regulación de genes, como la disminución de los niveles de micro-moléculas de Ácido Ribonucleico (miRNA) miR-22, miR17 y miR-30 y el aumento de miR-10. n recent years, researchers have found ample evidence that glyphosate causes extensive damage to the gut biome1. At the same time, glyphosate has been found to cross the blood/brain barrier dysregulating levels of TNF-a, a critical regulator protecting the brain from producing symptoms similar to Alzheimer’s. Glyphosate also affects gene regulatory changes such as decreases in levels of miR-22, miR-17 and miR-30 and increases

In a study by Dr. Nancy Swanson et al, government databases were searched for GE crop data, glyphosate application data and disease epidemiological data. These data demonstrated that Pearson correlation coefficients were significant on a wide range of chronic diseases and their linkage to the exponential increase of glyphosate1. Furthermore, when one correlates Swanson’s research with both Dr. Damien Verzenassi and Dr. Andres Carrasco’s researches, the United States’ Agricultural Health Study (AHS), a study of health outcomes in a cohort of licensed pesticide applicators and their byproducts, the AHS study becomes isolated and dubious.

It should be remembered that in 1985, the EPA initially classified glyphosate as a Group C chemical, a possible carcinogen to humans.

In their research, Monsanto had discounted a “statistically significant increase in pancreatic cancers among rats exposed to a relatively low dose of Roundup”2.

Due to heavy lobbying from Monsanto, the EPA either assisted Monsanto by looking askance at the evidence of the pancreatic cancer or was kept in the dark by Monsanto. The Precautionary Principle and rigorous research was then replaced by a lax comparison study based on equivalency.

to be emphasized that there is no regulatory process to measure difference or equivalency between substances. A “claimed lack of difference is used to assert that GMOs are substantially equivalent to non-GMOs and [are] therefore safe. But, objective standards to measure equivalence or difference do not exist”3.

Let’s say 16 out of 62 markers are found to be statistically different in those two substances. The differences, only 25%, are considered small and therefore “not biologically relevant.” So, the pancreatic cancers are not biologically relevant? The two substances are now substantially equivalent!

In its own research, the EPA is hamstrung by an agreement which, while giving the federal agency access to GM seeds for “a wide range of research,” upon closer inspection, this access “covers research into crop production practices... , not research into issues such as the health risks of genetically engineered crops”4. At the same time, there are “no legal requirements that the reports and studies companies submit to EPA are published or peer reviewed”5.

And, while genetic modification alters cells in ways that we can neither fully understand, predict, Thomas Block Lorain, OH or control, it stands to reason “that glyphosate might exert more than one disrupting effect” – just maybe, it might end up chelating or hoarding essential metals from the body6. That is why the Precautionary Principle is so important and why the Principle is so ignored by agribusiness. It should be noted that GMO foods have not been engineered for food safety or even for increases in flavor or nutrition, rather their existence is due to two traits: “pesticide production and herbicide resistance”7.

noticed that since the early 1990s when glyphosate use was placed on the agricultural market, early onset cancer has seen a progressive growth in the world. This dramatic increase is found in breast, colon, esophagus, kidney, liver and pancreas cancer and indicates a substantial change in our diets, lifestyles, weight, environmental exposures and microbiome. There is a birth cohort effect that shows that “each successive group of people born at a later time – e.g., a decade later – have a higher risk of developing cancer later in life ... we predict that this risk level will continue to climb in successive generations”.8 Carcinógenos no pagan Peaje viene de la vuelta

Y, si bien la modificación genética altera las células de maneras que no podemos comprender, predecir o controlar por completo, es lógico pensar que “el glifosato podría ejercer más de un efecto perturbador”; por ejemplo, podría terminar quelando o agrumando metales esenciales del cuerpo6. Por eso es tan importante el Principio de Precaución —y por eso es tan ignorado por la agroindustria.

Cabe señalar que los alimentos GMO no han sido diseñados para la seguridad alimentaria o incluso para aumentar el sabor o la nutrición, sino que su existencia se debe a dos características: “producción de pesticidas y resistencia a herbicidas”7.

El Brigham and Women’s Hospital es una de las muchas instituciones médicas que han notado que, desde principios de la década de 1990 —cuando el uso de glifosato se colocó en el mercado agrícola— el cáncer de aparición temprana ha experimentado un crecimiento progresivo en el mundo. Este aumento dramático se encuentra en el cáncer de mama, colon, esófago, riñón, hígado y páncreas —e indica un cambio sustancial en nuestras dietas, estilos de vida, peso, exposiciones ambientales y microbioma. Hay un ‘efecto de cohorte’ de nacimiento que muestra que “cada grupo sucesivo de personas nacidas en un momento posterior, por ejemplo, una década después, tiene un mayor riesgo de desarrollar cáncer más adelante en la vida... prevemos que este nivel de riesgo seguirá aumentando en las generaciones sucesivas”.8

A

lthough comedian Trevor Noah may not have become comparable to Alexis de Tocqueville or Lord James Bryce as he has gotten to know America over the last decade, a recent comment by him about the value of black women has won him kudos for the wisdom it reflects —“I always tell people if you truly want to learn about America, talk to black women.”1 There should be little wonder about the role of women in our society after they, especially African-Americans and the welleducated, and their closest allies* have gradually aroused the popular bulwark against antidemocratic trends and explicitly authoritarian developments in the U.S. in the 21st century.

Their crucial role in the last three national elections even helped stem the rise and power grab by Donald Trump and his authoritarian confederates on January 6, 2021 and in the 2022 election – the election deniers, extreme MAGA Republicans, white supremacists, Christian nationalists, QAnon conspirators, and anti-government militias.

Misogyny and its integral connection with other rightwing prejudices, especially white supremacy, obviously accounts for part of the problem, but a failure to understand the evolution of the meaning of democracy has also been crucial. The fact that our founding fathers were reluctant to call the Constitutional government they founded in 1789 a democracy was part of our slow start. Property rights and the quasi-aristocratic beliefs in the privileges of white men were the major obstacles that led Benjamin Franklin and company to call our new government a republic, yet the framers clearly believed in the revolutionary idea voiced by the Declaration of Independence that the source of power was the people.

The Framers were also aware that the definition of The people had been changing rapidly since their struggle with the power of the British aristocracy had begun. By the time of the Constitutional Convention, the property, military service and other qualifications limiting the right to vote had been declining in most states. Suffrage, the right to vote, especially for Congress and state legislatures, had reached about a third of the adult white male population by 1787. Recognizing the gravity of the struggle that was occurring over the definition of the people and the rights of citizens, the subjects were largely left out or only partially formulated in the Bill of Rights.

Thus much of the first thirty-some years of our republic focused on eliminating traditional privileges that limited the voting rights of free white men or in using the state to expand the range of opportunities, such as access to land and money, and the roads and canals people needed to get to new lands and markets.3 The struggle to expand the definition of The people was so intense by the late 1820s that it was called a revolution, and the achievement of nearly universal white male suffrage was called the Age of Jacksonian democracy, and the idea that democracy Gene Bigler, PhD Writer & consultant was in effect government by all the people on global affairs, was finally widely used.4 former professor, retired diplomat Yet achievement of just universal white male suffrage revealed almost simultaneously how incomplete the task was.

By the 1840s completely different questions about the people and their rights were being raised. First was the fitness of Irish and German Catholic immigrants to be included in those with voting rights. Then a whole series of issues arose related to the problem of slavery which completely refocused the attention of the nation and with it the issue of voting rights for women also began to emerge.

The incredible publicity and long legal battle of the Amistad case demonstrated to the nation that even the slaves on that unfortunate vessel had the Court confirmed right to life and liberty, but nearly everything else at the time showed how powerless the anti-slavery cause had become. Not even the eloquence of John Quincy Adams and Daniel Webster could stop the gag rule from being applied to prevent any substantive debate or even mention of slavery in Congress. Party got nowhere in its first two elections notwithstanding its great energy and reach.

In 1842 the ever more overtly pro-slavery Taney-led Supreme Court in Prigg v. Pennsylvania ruled that anti-slavery states could not pass laws to forbid officials from aiding in the capture and return of runaway slaves. Despite the organizational prowess of the American Anti-Slavery Society (AA-SS) and its allies, it complained futilely that the 250,000 members of the pro-slavery oligarchy were still able to overturn the efforts of the 12 million freemen (the sizable majority provided by the non-slave states) opposed to the extension of slavery in the annexation of Texas, supporters of the Wilmot Proviso and alarmed over the Kansas-Nebraska abrogation of the Missouri Compromise.

The struggle against slavery had, however, also raised the consciousness of women about the exclusion of rights to them. Elizabeth Cady Stanton and Lucretia Watts and other participants in the AA-SS were the organizers of the 1848 Seneca Falls Convention which launched the global women’s rights movement, but then the intensity of the slavery issue consumed the nation in the Civil War contest to preserve democracy. the State Superintendent of Public Instruction (SSPI) of the California Department of Education (CDE) or designee deems appropriate.

A pupil fee includes, but is not limited to, all of the following: 1. A fee charged to a pupil as a condition for registering for school or classes, or as a condition for participation in a class or an extracurricular activity, regardless of whether the class or activity is elective or compulsory, or is for credit.

2. A security deposit, or other payment, that a pupil is required to make to obtain a lock, locker, book, class apparatus, musical instrument, clothes, or other materials or equipment.

3. A purchase that a pupil is required to make to obtain materials, supplies, equipment, or clothes associated with an educational activity. A pupil fees complaint may be filed with the principal of a school or our superintendent or his or her designee.

A pupil fees and/or LCAP complaint may be filed anonymously, however, the complainant must provide evidence or information leading to evidence to support the complaint.

A pupil enrolled in a school in our district shall not be required to pay a pupil fee for participation in an education activity.

A UCP complaint shall be filed no later than one year from the date the alleged violation occurred.

We shall post a standardized notice of the educational rights of pupils in foster care, pupils who are homeless, and former juvenile court pupils now enrolled in a school district and pupils in military families as specified in EC Sections 48645.7, 48853, 48853.5, 49069.5, 51225.1, and Uniform Complaint Procedures (UCP) process. This notice shall include complaint process information, as applicable.

A notice of health and safety issues pursuant to HSC section 1596.7925 shall be posted in each state preschool classroom program.

The notice shall (1) state the health and safety requirements under Title 5 of the California Code of Regulations that apply to California state preschool programs pursuant to HSC section 1596.7925 and (2) state the location continued on next page at which to obtain FEBRUARY 2023 Joaquín 11

The staff member, position, or unit responsible to receive UCP complaints in our agency is Enrique Torres, Executive Director, Constituent Services, (209) 933-7100 ext. 2195 (EPTorres@stocktonusd.net) Complaints will be investigated and a written report with a Decision will be sent to the complainant within sixty (60) days from the receipt of the complaint. This time period may be extended by written agreement of the complainant. The person responsible for investigating the complaint shall conduct and complete the investigation in accordance with our UCP policies and procedures.

The complainant has a right to appeal our Investigation Report to the CDE of complaints regarding programs within the scope of the UCP of by filing a written appeal within 30 days of receiving our Investigation Report.

The appeal must be accompanied by a copy of the originally-filed complaint and a copy of our Decision.

We advise any complainant of civil law remedies, including, but not limited to, injunctions, restraining orders, or other remedies or orders that may be available under state or federal discrimination, harassment, intimidation or bullying laws, if applicable.

En los Ojos d These are selected reports from young adults reviewing the artist’s exhibition “Are You With Me” in Riverside, CA. Adriana Sonya Fe’s art really spoke to one’s heart. There were art pieces that I could relate to and it was very touching. Her artwork was very one of a kind and the colors she uses makes it pop out. There was texture like soft, rough and these textures made the art piece so amazing.

It made sense, it all connected together so well.

Now —the artist herself was very outgoing and a kind person... I feel that she puts much emotion and imagination into her artwork. It’s astonishing. Sonya Fe is an inspiring person, she gives me inspiration to continue doing art and to never lose my imagination. I liked that in almost all her art pieces she had a story. Some were sad and others were interesting to hear.

To sum it up Sonya Fe is an inspiration to me. She is a talented person and all her artwork that I saw today were amazing. I hope I get to see more of her artwork in the future.

ric shapes in her work, favoring imagination over realism. Mixing Dorland’s wax into the paint adds an almost translucent effect. And to create the crisp lines and patterns, Sonya uses edges of credit cards and doilies as stencils. But ultimately, Sonya uses theses unique techniques to express meaning- touching on culture, femininity, and mourning.

Much of Sonya’s work features children.

But rather than postcard-perfect dolls, Sonya’s subjects appear as respectable individuals.

Through these portraits, Sonya reveals glimpses of her own memories and views. She reflects on growing up in a large family, the thrill of adulthood, and mourning loved ones. More relevantly, many drawings focus on migrant children and the COVID lockdown. In these pieces, Sonya uses duller colors and gesso to convey the loneliness of current events.

Throughout the tour, Sonya makes her process clear to visitors. Indeed, her inspiration and process are written on the walls of the gallery, giving the viewer a deeper insight into her work. But many would agree that Sonya’s work speaks for itself. Through her paintings, Sonya’s message is clear: “I want the viewer to feel, see and understand what I am sayingto not be continued on the next 3 pages

Adriana El arte de Sonya Fe realmente le habla a uno al corazón. Había piezas con las que podía identificarme —fue muy conmovedor.

Su obra es única y los colores que usa hacen que resalte. Tenían una textura suave, áspera y estas texturas hacían que la pieza fuera tan asombrosa. Todo se conecta muy bien, tiene sentido.

Ahora —la artista misma era muy extrovertida y muy humana... se siente la emoción e imaginación que plasma en su trabajo. Es asombrosa —Sonya Fe es una musa, me inspira a seguir haciendo arte y nunca perder la imaginación. Me gustó que casi todas sus piezas tiene una historia. Algunas eran tristes y otras eran interesantes de escuchar.

En resumen, Sonya Fe es una inspiración para mí. Ella es muy talentosa y todo el arte que le vi hoy fue increíble. Espero poder ver más de su obra en el futuro.

Eva While I was researching Sonya Fe I read that she had a lot of personality. I was glad to find out that was true. I was happy to see that she was glad to be there and she seemed very humble and like a very good person all around.

Before the tour started I was looking at her art and I understood its power. During the tour I was really happy to see that she told us the story about what the painting was about because it seemed like she actually cared for her audience and wanted us to know what was going on in her painting. Since she wanted us to understand the story behind the painting I also appreciate how the names of her paintings are also telling us the story.

While she was telling us what was going on in her art I found myself getting extremely emotional and choking back tears because her paintings and art have so much emotion in them and I found myself relating to so much of the art. I can tell that Sonya Fe wanted to reach her audience and I felt that I was definitely that target audience. I also love that she knew what she was talking about when speaking about the different cultures.

I wish I had a chance to talk to her because I genuinely would have so much to say to her. I also love how she uses the human body in such a respectful way —because a lot of people would consider some of her artwork taboo or inappropriate. I am very grateful to be able to hear her speak and experience her artwork.

I will never forget her or her work.

Gran parte del trabajo de Sonya representa niños. Pero, en lugar de maniquíes perfectos “de postal”, los personajes de Sonya parecen individuos respetables. A través de estos retratos, Sonya revela destellos de sus propios recuerdos y puntos de vista. Reflexiona sobre crecer en una familia numerosa, la emoción de la edad adulta, y el duelo por los seres queridos. A lo largo del recorrido, Sonya habla sobre su proceso a los visitantes. De hecho, su inspiración y proceso están escritos en las paredes de la galería, brindando al espectador una visión más profunda de su trabajo. Pero muchos concordarían en que el trabajo de Sonya habla por sí mismo. A través de sus pinturas, el mensaje de Sonya es claro: “Quiero que el espectador sienta, vea y entienda lo que estoy diciendo, que no se quede atrás”.

que tenía una gran personalidad. Me alegró corroborar que era cierto, que estaba contenta de estar allí, actuaba con mucha modestia, y se notaba que era muy buena persona.

Antes de que comenzara la gira, estuve mirando su arte y ya estaba percibiendo su poder. Durante el recorrido, me gustó mucho que nos contara la historia de cada pintura porque parecía que realmente se preocupaba por su audiencia —y quería que supiéramos qué estaba pasando en cada lienzo. Y así como ella quería que entendiéramos la historia detrás de cada pintura, ahora apreciaba cómo los títulos corroboraban la historia.

A medida que contaba lo que estaba pasando en sus piezas, me anduve emocionando y tuve que contener las lágrimas —porque su arte, sus pinturas, son muy emotivas y sentí que me identificaba con gran parte del ellas. Podía claramente ver que Sonya Fe quería llegar a su público —y sentí que, definitivamente, yo era su audiencia. También me encantó que supiera lo que decía cuando hablaba de las diferentes culturas.

Me hubiese gustado mucho tener la oportunidad de hablar con ella, porque realmente tendría mucho que comentar con ella. También me encanta el uso del cuerpo humano de la manera más respetuosa porque mucha gente consideraría que algunas de sus obras de arte son tabú o inapropiadas. Estoy muy agradecida de haberla escuchado y experimentar su obra.

Nunca la olvidaré ni a ella ni a su trabajo.

El Dorado, a yellowed legend

n driving through Stockton, there’s no more familiar thoroughfare than El Dorado Street.

And no one seems to pay much attention to where its name came from, and probably it does not matter.

But today we are a year shy of the 500th anniversary of an event that is most relevant to the name: That’s when Spanish fortune seekers finished sailing the length of the Amazon River —naming it after the female archers who attacked them in part of the voyage— and found out there was no mythical El Dorado after all.

El Dorado, a name much utilized around California, is actually a Colombia native, as is much of the coffee I drink at the office.

Tall tales, short minds El Dorado —literally “Gilded One”— is the name of a legendary native chief. Back in the days of easy empire-sacking, Spanish conquistadors were drunk with the high-paying adventures of Tenochtitlán (Mexico) and Cuzco (Peru).

Looking to keep the momentum, they searched far and wide for the next gold-laden city. In the heights of Colombia, they found the Chibcha nation, where people had lots of little gizmos made of gold. After the surprise, the welcoming, the gifts and the customary treachery, a summary general expropriation was in order, followed by torture to find out the source of the gold.

During the ordeal, an old tribal sage rehashed an elaborate tale of a gold-plated mountain city, whose inhabitants annually performed an odd ritual on the shores of a crater lake. Their chief would be covered with soft clay, then with gold dust and, along with four lesser chieftains, placed in a raft filled with riches. They would then be continued on next page pushed to the center of the lake, where the

La leyenda de El Dorado, y cómo perdió el brillo A

l manejar por Stockton, no hay arteria más familiar que la calle El Dorado. Y nadie parece prestar mucha atención al origen de ese nombre —y probablemente no tiene importancia alguna.

Pero hoy estamos a un año del aniversario de un evento que es bastante relevante para ese nombre: fue hace 500 años que los buscafortunas españoles lograron navegar todo el largo del río Amazonas el más largo río del mundo— bautizándolo en honor a las arqueras nativas que los atacaron en parte del viaje, descubriendo al final que, después de todo, no existía el mítico El Dorado.

El Dorado, un nombre muy utilizado en California, en realidad es originario de Colombia, al igual que gran parte del café que bebo en la oficina.

Cuentos chinos, mentes simplonas El Dorado, literalmente “Enchapado en Oro”, es el nombre de un legendario jefe indígena. En los días en que los saqueos de imperios eran la orden del día, los conquistadores españoles estaban embelesados con las grandemente remunerativas aventuras de Tenochtitlán (México) y Cuzco (Perú).

Buscando continuar la buena racha, buscaron por todas partes la próxima ciudad llena de oro. En las alturas de Colombia, encontraron la nación Chibcha, donde la gente tenía muchos artilugios hechos de oro. Después de la sorpresa, la bienvenida, los obsequios y la traición de rigor, se ordenó una sumaria expropiación general —seguida de torturas para descubrir el origen del oro.

Durante ese calvario, un viejo sabio de la tribu recalentó una elaborada leyenda de una ciudad montañosa bañada en oro, cuyos habitantes anualmente realizaban un extraño ritual a orillas de un cráter que albergaba un lago. offerings were dropped into the waters, and the chief would dive and come back clean of clay and gold.

That was “El Dorado.”

The story had the effect the old man expected: The conquistadors rushed out to the mountains and left them alone.

The search for the fabled city, the story of the unfortunate lake described by the sage and the many attempts to empty it is fascinating and full of well-known names -- von Humboldt and Sir Raleigh among many -- and it lasted until 1965, when the Colombian government declared the purported area a Historical Monument.

Weber’s El Dorado California inherited the name from the Gold Rush. The tales of “hills covered with gold” were compared to those of El Dorado, thus the connection. Ol’ Capt’n Weber -- who named Stockton’s street -- realized it was the real road to (HIS) riches.

History shows us the Conquistadors were so busy trying to find tangible gold that they failed to see golden opportunity and/or beauty.

Likewise, we have too many locals and shallow entrepreneurs blinded by their search for the gold -- namely, quick revenue. Their pursuit makes them unable to see the real treasures we still enjoy. And many, like those 16th century Spanish captains, will swear there is nothing here. No gold, no value.

I realize Stockton’s El Dorado is not precisely “paved with gold,” but then again, if it were, we may have to have our mayor plastered in hyacinths and thrown into the McLeod Lake... along a few Council members.

Finalmente el jefe se sumergía para luego salir a flote limpio de arcilla y oro. Ése era “El Dorado”.

La historia tuvo el efecto que esperaba el anciano: los conquistadores corrieron hacia las montañas y los dejaron tranquilos.

La búsqueda de la fabulosa ciudad, la historia del desafortunado lago descrito por el sabio y los muchos intentos de vaciarlo es fascinante y llena de reconocidos personajes —Von Humboldt y Sir Raleigh entre muchos— y duró hasta 1965, cuando el gobierno colombiano declaró la hipotética zona Monumento Histórico.

El Dorado de Weber California heredó el nombre por la Fiebre del Oro. Los cuentos de “cerros cubiertos de oro” fueron comparados con los de El Dorado... de ahí la conexión. El viejo Capitán Weber, que bautizó la calle con ese nombre en Stockton, se había dado cuenta de que ése era el verdadero camino hacia (SU) riqueza.

La historia nos demuestra que los conquistadores estaban tan ciegos tratando de encontrar oro tangible que no vieron ni una oportunidad dorada como tampoco belleza alguna. De la misma manera, hoy tenemos demasiados emprendedores locales y empresarios superficiales cegados en su búsqueda de oro, hoy por hoy, lucro inmediato.

Su búsqueda los hace incapaces de ver los verdaderos tesoros que aún disfrutamos. Y muchos —como aquellos capitanes españoles del siglo XVI— jurarán que aquí no hay cosa alguna. No hay oro, no hay cosa valiosa alguna.

Reconozco que El Dorado de Stockton no está precisamente “pavimentado con oro” pero, si lo estuviera, es posible que tuviésemos que enchapar a nuestro alcalde con jacintos y arrojarlo a al Lago McLeod... junto a unos cuantos concejales.

l término “abuso infantil” no se escuchaba en el barrio. La justicia a los hijos desobedientes la solía impartir un padre con una nalgada, una nalgada con la mano abierta, o una paliza con un palo o rama de árbol, o peor aún, una cuerda de planchar o un cinturón. “No más espérate hasta que llegue tu apá’ del trabajo”, advertían las madres. Y sabíamos la que nos iba a llegar cuando nuestros papás regresaran del trabajo esa noche.

Nunca olvidaré el “¡Whap! ¡Paf! ¡Whap!” de un cinturón o un cordón de planchar cayendo sobre las piernas y las nalgas de mis amigos y sus gritos lastimeros: “¡No! ¡No! ¡No papá!” Y las maldiciones del padre, “¡Muchacho cabrón! Ándale! Ándale! ¡Ándale!” como todo padre descarga su ira en un hijo desobediente. Era el derecho indiscutible de un padre golpear a su propio hijo sin la interferencia de los vecinos o la policía.

Respetaba a mis amigos que lo tomaban como hombres, ni siquiera llorando. Al día siguiente, blandían sus moretones y magulladuras como insignias de valor. En cuanto a mí, yo era un gran llorón, con un abismalmente bajo umbral para el dolor.

Pero todos mis amigos entonces hablaban de recibir palizas de sus papás —así que no era solo algo mexicano. Nunca fue cuestionado en esos días; así era como se hacían las cosas.

Pero también los había visto fuera de control y la brutal mano de un padre ‘macho’ que parecía disfrutar golpeando a sus hijos... o a su esposa para no ser menos. Sin embargo, incluso golpear a una esposa era un tema privado del hombre y pocos se atrevían a interferir.

En el Barrio, nunca escuchamos “time out” o “vete a tu cuarto”, porque la mayoría de nosotros ¡ni siquiera teníamos un cuarto propio para ir! Nuestro miedo a la paliza nos mantenía derechitos. Cuando mi madre se iba a trabajar durante los veranos a la fábrica de conservas Tillie Lewis, me dejaba una lista

Limpiar tu cuarto. Alimentar al perro. ¡Enciende los frijoles a eso de las dos en punto, y pon el fuego bajo ¡y que no se te quemen! Yo llegaba a casa alrededor de las 5:30 todos los días, a veces a pie, o me había traído en coche otra persona que vivía en el barrio.

Entonces, debido a que mi padre estaba ausente en mi vida, le correspondería a mi madre administrar la disciplina.

Aunque era estricta y manejaba la casa ‘como se debe’, era justa, y solo “me las daba” cuando —después de varias advertencias— continuaba desobedeciendo sus simples reglas.

Como buen hijo, ponía los frijoles a las dos en punto, tal como ella me había indicado, calculando que podía colarme en un paseo en bicicleta de 30 minutos, o visitar a Robert o Charly para alcanzar de jugar una ronda de Monopoly bien rápido... y aun así tendría tiempo de sobra para volver corriendo a añadir agua a los frijoles. Pero justo cuando a Robert le salía un 3... y eso lo pondría en Park Place donde yo tenía tres hoteles ¡saltaba aterrorizado! “¿¡Qué hora es!? ¿4 en punto? ¡¡Mierda, los frijoles!!” y salía como tromba a casa lo más rápido que podía para ver que ya el humo salía de la cocina.

Hay pocos olores peores que los frijoles quemados, y no había forma de disimularlo. El hedor impregnaba los muebles, las cortinas e incluso las paredes, y duraba horas, ¡incluso si uno abría todas las puertas y ventanas! “¡Maldita sea! ¡También continúa a la vuelta

Justice to disobedient children was usually meted out by a father with a nalgada, a spanking with an open hand, or a paliza with a palo or tree branch, or even worse, an ironing chord or a belt. “No más espérate hasta que llegue tu apá’ del trabajo”, mothers would warn. And we knew we were going to get it when our dads came home from work that night.

I’ll never forget the “Whap! Whap!

Whap!” of a belt or ironing cord coming down on the legs and butts of my friends and their pitiful screams, “No! No! No Papá!” And a father’s curses, “Muchacho cabrón! Ándale! Ándale! Ándale!”

As a father vented his rage on a disobedient son. It was a father’s undisputed right to beat his own son without any interference from neighbors or the police. I respected my friends who took it like men, not even crying. The next day, they would brandish their welts and bruises like badges of valor. As for me, I was one big cry-baby, with an abysmally low threshold for pain.

But all of my buddies then talked of getting whuppins’ from their dads, so it wasn’t just a Mexican thing. It was never questioned in those days; it was just the way things were done. But I had also seen it rage out of control by the brutal hand of a macho father who just seemed to get pleasure from beating his kids, or his wife for that matter.

Yet, even the beating of a wife was a man’s private business and few dared

to interfere.

In the Barrio, we never heard “time out” or “go to your room”, because most of us didn’t even have a room of our own to go to! Our fear of the paliza kept us on the straight and narrow. When my mother left for work during the summers at Tillie Lewis cannery she left me with a simple list of tasks: “Mow the lawn.

Clean up your room. Feed the dog. Turn on the beans about two o’clock and put the burner on low and don’t burn them!” She would get home about 5:30 each day, sometimes on foot, or having caught a ride with someone else who lived in the barrio.

So because my father was absent in my life, it would be up to my mother to administer discipline. Though she was strict and ran a tight ship, she was fair, and I only “got it”, when after several warnings I continued to disobey her simple rules.

Like a good son, I would put on the beans at two o’clock, just as she had instructed, calculating that I could sneak in a 30 minute bike ride, or visit Robert or Charley to play a quick game of Monopoly, and still have plenty of time to rush back to add water to the beans.

But just as Robert rolled a 3, that would put him on Park Place where I had three hotels, I would leap up in terror. “What time is it!?

4 o’clock? Oh shit, the beans!!” And I would pump home as fast as I could to find smoke bellowing from the kitchen.

There are few smells worse than burnt beans, and there was no disguising it. The stench permeated the furniture, the curtains, and even the walls, lasting for hours, even if you opened all the doors and windows!

“Damn! I forgot to mow the lawn, too!”

She would usually let one of the two of these transgressions pass with a simple warning: “A la siguiente vas a ver!” But the after a few next times I would get it.

clothes inside the washing machine. It was about two inches wide, an inch thick, three feet long, and forked on one end. When the dreaded moment came, she would grab the palo, and drag me into the kitchen. But before my paliza began, I would beg for mercy: “No! Mom, no!

Mom, no! I’m sorry, I won’t do it again!” But it was too late. I would even feign crying, but she just laughed, “I haven’t even hit you yet!”

When the blows started, I assumed a defensive stance, like a boxer against the ropes, preparing for a barrage of body shots. “You really want something to cry about? I’ll give you something to cry about!” She would scoff at my fake tears. “Ándale! Ándale!, Ándale”, and the thrashing began. In a feeble effort to protect my butt, I placed my open hands together behind my back, but the whacks stung my palms, which hurt just as bad. “¡Para que aprendas a obedecérme!”

She was sullen afterwards and we didn’t speak for a couple of days. I knew she had not enjoyed the episode, either.

Though I never thought about it consciously, when I had my two sons Miguel and Fernando later in life, I would instinctually defer to the palo. Early on, I made it clear to my sons that I came from a palo culture, and I would take no defiance or disrespect from them. A traditional Mexican woman, my wife expected me to discipline our boys and never interfered. But now that I was executioner, it never occurred to me that I would have to learn to control my anger or that I might seriously hurt them during the spanking; I could always stop myself, I believed. The guilt I felt afterwards was debilitating. No one had ever even spoken about that.

Oddly, the old phrase, “Son, this is going to hurt me more, than it’s going to hurt you”, began to suddenly ring true, though I continued to scoff at all the silly talk about the evils of spanking, how it didn’t work, about the psychological damage it caused, and how it would create another generation of abusive children. For me, the palo was the only way I knew; it had worked for me, and it would work for my own sons.

However, it all ended one day after my youngest son Fernando, then about 14, had exhausted my patience. We were in the garage when I exploded at him. Looking around, I saw nothing I could use as a paddle, so I tore a thin wooden slat from the siding of a lightweight fruit box lying on the floor. I held him by the arm, and struck him over and over on his thighs. He started to wail in a way I had never heard before. “He’s really putting on a good show, just like I used to” I concluded, and 20 Joaquín FEBRUARY 2023

kept swinging. “Ow! Ow-ow!! Dad, there’s a nail in the board! There’s a nail!!”

In horror, I looked and saw two small nails protruding from the slat. My eyes welled with tears as I dropped it on the cement floor. My wife grabbed for him, holding him tight, and I reached out to hug him, too. “I’m sorry. I didn’t know! I’m sorry”, I repeated stupidly.

Luckily, the nails were slightly bent and had only penetrated his skin superficially; but the reality that I could have seriously hurt him scared me.

This would be the last time I ever spanked either of my sons, though to this day, we all chuckle about it when I retell the story. Still, I can’t help but wonder whether the spoiled kids of today wouldn’t benefit from the resurgence of the old palo? I grew up just fine, and seem none the worse for it.

Siempre podía detenerme, creía yo. La culpa que sentía después era debilitante. Nadie había hablado que eso pasaba.

Extrañamente, esa vieja frase, “Hijo, esto me va a doler más a mí que a ti”, comenzó a sonar cierta de repente, aunque continué burlándome de todas las tonterías sobre los males de las nalgadas, cómo no servía para cambiar cosa alguna, sobre el daño psicológico que causaba —y cómo yo estaba creando otra generación de niños abusadores. Para mí, el palo era el único camino que conocía; había funcionado para mí, y funcionaría para mis propios hijos.

Sin embargo, todo terminó un día después de que mi hijo menor, Fernando —entonces de unos 14 años— había agotado mi paciencia.

Sobre la Dispar Comparación Getting at the de Raza y Disparate Impact of Racismo Race and Racism

E

n casi todos los artículos o libros, si no en todos —sobre el actual racismo en los Estados Unidos— se exhiben estadísticas de correlación que muestran cómo los afroamericanos están subrepresentados de alguna manera (por ejemplo, Derrick Bell en Faces at the Bottom of the Well, nota al pie de la pág. 162). Since we are presented considerable amounts of this sort of evidence, it seemed that it might be interesting to examine some statistics on racial disparities. The National Basketball Association has 30 teams, which means there are 30 head coaches. Given that as of 2022 blacks constitute 13.6% of the United States population, one would expect four NBA head coaches to be black. This is using the logic of those who present statistics to show

the disparate impact of racism. In fact, as of today, 14 head coaches are white and 16 are black or 53.3%.

This data suggests that racism is not very helpful in explaining the results. Adding the fact that 71.5% of the players are black complicates things, though it has given rise to the theory that the head coaching jobs are underrepresented as the proper baseline should be the percentage of players, not total United States population.

By comparison, the National Football League has 32 teams. Black players are 57.5% of the total. Of the 32 head coaches, 27 are white and 5 are black. That is, black head coaches are only 15.7%. Thus, the number of NFL head coaches approximates or is a bit larger than the percentage of blacks in the total population. Once again, however, the percentage of black head coaches is far smaller than the percentage of players.

If observations about simple disparate impact are based on total population, the results can be confusing or misleading. One might argue that reverse racism exists in both sports and greatly favors black players. Common experience refutes this: those sports are extremely competicontinued on next page

tive and management would, in the words of Red Auerbach, “draft a green man if he could get him a rebound.” Basically the best players get hired.

This is not to say that the NBA and NFL was not racist at one time, as evidenced by the first blacks being drafted only in the early 1950s, and there seemed to be quotas on the number of black players for a number of years after that.

What this does show is that simplistically showing percentages of blacks in any category is insufficient to explain much. Context is necessary. The failure to provide context debases the discussion There is evidence in the real estate industry that there is an element of racism in the decision-making of realtors. Blind tests were run where identical financials and resumes were presented for comparable black couples and white couples. The evidence showed in numerous studies that black couples (a) were qualified for lower loan amounts and (b) were guided to different and less desirable housing. Those studies were done decades ago.

More recently similar studies were done, but in the interim qualifying for loans has largely become automated. The result was that loan qualifications for both groups were nearly identical but some variance remained in recommending areas in which to purchase.

This is convincing evidence that racism was involved in guiding clients but that this has been reduced in recent years. It also shows that racism’s effects may be compounded when there is more than a single decision gateway.

In the real estate experiment, the older experiments had 2 gateways [loan qualification; guidance as to area]. Decades later the first gateway had become automated and is, in theory, race-neutral with the computer relying only on the data absent race identification. The second gateway still had an effect, but it had no previous racial decision to add to so that the final result was less racially biased.

It would seem that any serious discussion about race should involve serious examination of the ‘evidence’ presented. While the failure to do so does not completely derail the discussion, it leaves it open to claims that what has been presented are ‘fake facts’. Maybe even worse, it is hard to have discussions that help us understand the issues and maybe even move toward solutions.

From many locations on its legendary twenty-two acre property, one can witness the red-orange towers of the Golden Gate bridge emerge out of the fog and hold up the rest of the sky, and in the evenings the spectacular views of the San Francisco Bay shimmer in orange-yellow lights against a dark night. During the late summer afternoons, the hotel looks more like a white palace with a gable tower chiseled out of white marble.

Looking up at the massive dimensions of the hotel, one wonders how those silent partners who developed the property ever managed to accrue enough money to purchase such a lavish quantity of property. Imagine 279-guest accommodations that are plush, comfortable, luxurious, and modern.

The Claremont is a place where the idle rich hang out. Here, like in all international hotspots, the successful are pampered with winning cuisines, fitness complexes, hiking, tennis courts, and health therapy.

The wealthy and the wanna-be wealthy come here to luxuriate in the comfortable surroundings, indulge their appetites, enrich their way of life, and to rub shoulders with people like themselves. The Claremont Hotel Club is where people come to experience the grace and elegance of perfection, a place where the air that fills one’s lungs also fills the mind with fresh ideas. No question, those that come here fall in love with the quality of life that the Claremont Hotel Club offers its members and guests. * *** At the entrance to the hotel, the gates were upright and opened; two police cars with their flashing red and blue lights guarded against anyone from going in and out without permission from Captain Williams.

the Berkeley police. The officers and their K-9 partners were dispatched to check the hotel’s entire property. The sun cast its light on the white walls of the hotel giving the appearance of a monastery rather than a hotel. The Claremont Hotel gave the appearance that it was casting its own light. Behind the hotel, four tennis courts were in use. The players, much accustomed to dictating the terms of any arrangement, insisted on completing their sets before being interrogated by the police. The grunts by the tennis players hitting the ball back and forth echoed up the hill to the back entrance of the hotel.

“Ugh!” “Aah!” “Ugh!” “Aah!” “Ugh!” “Aah!” “Ugh!” **** Inside the hotel, the police separated the employees and escorted them to separate ballrooms. Some of the guests were directed to stay in their rooms until further notice.

Diego de Campos, a homicide detective for the police department drove up to the gate, and the security detail waved him through. Diego noted the number of police on the grounds of the hotel. Once inside, he was escorted to the elevator, where he went to the third floor. The elevator announced the opening of the door with a loud “ding.” Inside the suite where the homicide had taken place, forensics staff was busy collecting evidence.

A detective standing next to the yellow tape informed Diego, “a double 187, a white female in the bathroom and a white male in the bedroom. The woman floating in the bathtub with soapy water and blood appeared to be about five feet four, weighed one hundred and thirty pounds and she was about fifty years old.”

Diego inspected the multiple knife wounds on her chest, and the forensics officer’s badge, and then replied. “Thanks, Jorge. Looks like a knife was used to sketch out a star on her chest by connecting the stab wounds.”

Jorge added, “ugh, she drowned. Her lungs were filled with soapy water.”

A trail of bloody footprints came from the tiled bathroom floor and on to the carpeted bedroom floor. The second victim was a white male, found naked and face down on the floor with blood on his chest and arms. A bloody knife encircled with yellow tape rested a few inches from his left hand. This victim was approximately fifty-five years old, about six feet 24 Joaquín FEBRUARY 2023

tall, weighed roughly 200 pounds, and had a tattoo of a rose on his right shoulder. The man had severe trauma to right side of the head, but other than the head trauma, there was no other injury on his body.

Diego looked around the bedroom, smelling his way into the bedroom following the aroma of roses. He found a bouquet of red roses on a night table near the bed. A card attached to the dozen roses read, “Love thy self, Cecilia!” In the bathroom, he opened a sliding mirrored door to the closet. The closet smelled heavy with burnt wax and incense. Inside, he found a small altar, containing a two-foot Chinese character sculpture with melted wax dripping down its front side; eight partly burned red roses lay in front of the sculpture; and two newspaper articles cut-outs from the San Francisco Chronicle, placed side by side in front of the altar. At the base of the altar, eleven garlic heads were displayed in two rows of five with a single garlic head on top of the second row. The physics of the arrangement of the offerings seemed rushed; the objects were unevenly spaced, as someone had built it in a hurry.

Diego scanned the newspaper articles about prostitutes murdered at five-star hotels in the San Francisco Bay area, including the Fairmont and the Ritz-Carlton. All of them had been stabbed multiple times and left to bleed to death in bathtubs. The prostitutes were high class, and each had a clientele of rich johns.

gressional districts where Latinos will make up a significantly larger share of the vote than in the nation as a whole. These include California’s 9th,13th, 22nd, 27th, and 45th; Colorado’s 8th; New Mexico’s 2nd; Nevada’s 1st and 4th; as well as Texas’ 15th, 28th and 34th already discussed.

Overall, the outcomes in the above races do not appear to show Latino voters significantly shifting to the right or a Red Wave. Of the 12 districts, seven voted Democratic and five voted Republican.

Unfortunately for Democrats in California, Republicans won four of the five districts identified. However, it is not clear if Latinos voted for Republicans or didn’t vote at all? Did candidates energize Latino voters in the 13th, 22nd, 27th, & 45th Districts? Another question is what made the 9th District different?

The 9th District includes San Joaquin County and the Stockton area and was won by Democrat Josh Harder. His Latino Constituency Director, Erik Garcia-Bautista, described Harder as a “fierce advocate for DACA recipients” and an effective advocate for Latinos in Congress. Erik worked tirelessly to connect the Harder campaign with Latino voters and

the Stockton Latino community. He organized meetings with Harder and Latino leaders to discuss immigration reform, economic development, jobs, cost of living issues, and solicited feedback on other important issues impacting the Latino community. The Harder campaign implemented a phone & text bank with Spanish speaking campaign volunteers that contacted thousands of Latino voters. I would argue that the Harder campaign in the 9th District did energize Latino voters, and it made the difference.

Fue una de las pocas acólitas de Trump en resultar elegida.

Harry Enten, de CNN, identificó “reñidas elecciones para la Cámara” o distritos del Congreso donde los latinos representaron una parte significativamente mayor de los votos que en la nación en su conjunto. Estos incluyen los días 9, 13, 22, 27 y 45 de California; el 8º de Colorado; el 2º de Nuevo México; el 1º y el 4º de Nevada; así como los días 15, 28 y 34 de Texas ya tratados.

En general, los resultados en las contiendas anteriores no parecen mostrar un significativo cambio hacia la derecha o una Ola Roja en el electorado latino. De los 12 distritos, siete votaron por los demócratas y cinco por los republicanos.

Lamentablemente para los demócratas en California, los republicanos ganaron cuatro de los cinco distritos en que se enfocaron. Sin embargo, no está claro si los latinos votaron por los republicanos o no votaron del todo.

Los candidatos ¿se granjearon el interés del electorado latino en los distritos 13, 22, 27 y 45? Otra pregunta es ¿qué se hizo diferente en el Distrito 9?

El 9º distrito incluye el condado de San Joaquín y el área de Stockton y ahí triunfó el demócrata Josh Harder. Su director de distrito electoral latino, Erik García-Bautista, etiquetó a Harder de “bravo defensor de los beneficiarios DACA” y una efectiva voz para los latinos en el Congreso. una reforma migratoria, el desarrollo económico, el empleo, los problemas del costo de vida —y preguntó qué otros temas de importancia afectan a la comunidad latina.

La campaña Harder organizó un grupo de voluntarios hispanoparlantes en la campaña para comunicarse con miles de votantes latinos a través de un banco telefónico y de mensajes de texto. En mi opinión la campaña Harder en el Distrito 9 integró al electorado latino y esa fue la diferencia.

ment of American democracy. At that point he had identified just 47 women, including active spouses and paramours, among more than a thousand men in the 796 painstakingly detailed pages of his account. Up to that point, women had largely been left aside.

The great cost of Civil War and Reconstruction to include African-Americans in our democracy gradually succumbed to the onslaught of white supremacy and Jim Crow segregation. Thus emancipation brought only a taste of the rights expected to be the legacy of manumission. The alliance of the women’s rights cause with the black civil rights struggle was also broken in the post War era in the face of the power of racial prejudice. American women did achieve suffrage in Wyoming in 1869 and Utah in 1870 and a dozen more states over the next fifty years, but the vanguard of the global movement had shifted overseas. versal suffrage to American women in 1920, it had already been instituted in more than a score of countries in northern Europe and the Commonwealth. Yet again gaining the vote fell fall short of the expectations that went with it even in the Jazz Age of the Roaring Twenties.

The problem was that the tradition of Jeffersonian democracy implied not just a single right, but the promise of equality of rights and being equal under the law. Elizabeth Griffith helps us understand how the struggle

by American women for the full meaning of rights, of being treated and not just counted as people, has evolved over the century since they achieved voting rights in her comprehensive study, Formidable: American Women and the Fight for Equality, 1920 to 2020 (Pegasus Books, 2022). In considering the situation of women, and especially the campaign for the Equal Rights Amendment to the Constitution, this author had wavered for several decades between indifference and mild support.

Reviewing the record of struggle in this book and how it has returned the women’s movement to the forefront of so many other progressive causes from civil rights to access to education, housing and health care, has convinced me that the Constitutional Amendment is still needed. It is hard to imagine even the current unprecedentedly partisan majority overturning Roe and taking a number of its other decisions in the face of an Equal Rights Amendment (ERA) included in the Constitution. Indeed, the ERA is still needed in the struggle for liberty and justice for all.

The detailed but historically focused record that Griffith provides may still not be enough to gain a full appreciation of the moment we actually face today, the challenges that the Trump administration revival of misogyny and racial prejudice represent for America right now, and how vital the contribution of women is to the struggle. However, Dahlia Lithwick fills the void brilliantly with her latest book, Lady Justice: Women, the Law and the Battle to Save America (Penguin Press, 2022).

This veteran legal journalist and Supreme Court reporter offers compelling and well documented accounts of eight contemporary legal battles being led by women in the U.S. today.

Lithwick details how the prowess, dedication and leadership of women in the judiciary and suffrage battles have been crucial for us all.

The cases she covers include, 1. The work of Acting Attorney General Sally Yates in standing up to the Trump effort to institute a ban on Muslim immigration; 2. The role of Becca Heller and the International Refugee Assistance Project in

protecting individual students and other migrants with legitimate reasons fulfill American interests in their immigration; 3. The initiative, bravery and prowess of Robbie Kaplan in prosecuting the Nazi sympathizers behind the Charlottesville Unite the Right rally and its abuses; 4. Brigitte Amiri’s humanitarian legal intervention to enable a 17-year old abused and abandoned girl on the U.S. border achieve the abortion and health care Trump officials tried to deny her; 5. The ingenuity of Vanita Gupta as the CEO of the Leadership Conference of Civil and Human Rights in resisting the Trump administration’s complete rollback of Justice Department work on behalf of women and underprivileged groups before becoming Merrick Garland’s Deputy Attorney General; 6. Establishing the bona fides of the Christine Blasey Ford and Anita Hill and the #MeToo movement by uncovering the role of Justice Alex Kozinski in establishing the acquiescence of conservative judges to sexual harassment against female clerks in the 9th Circuit Court of Appeals in San Francisco; 7. The pioneering organizational work of Stacey Abrams in increasing the access and participation of women and other minorities in Georgia elections; 8. The leadership and judicial achievements of Nina Perales on behalf of Latino voters through the work of the Mexican American Legal Defense and Educational Fund (MALDEF) in Texas.

Lithwick’s very contemporary case studies reveal how partisan influences in the judicial system have undermined the impartial application of the rule of law and suggest just how serious the new threat to equality has become in recent decisions being issued by the Supreme Court to overturn precedents and create new bastions of privilege. At the same time they show how women lead and help swell the ranks of those who embrace the rights of all the people and increase the potential of people of color, immigrants, and women in the fight for democracy and equality.
